which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to establish a cattle contract library, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cattle Price Discovery and Transparency Act of 2023</short-title></quote>.</text></section><section id="idCB67ACBCBDEE4033B83DA12DD6560B4A"><enum>2.</enum><header>Definitions</header><subsection id="id63C3169DB5334BDF87C4D17DBA5000E0"><enum>(a)</enum><header>In general</header><text>Section 212 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635a">7 U.S.C. 1635a</external-xref>) is amended—</text><paragraph id="id3713C6B0F3FF4F23B8A4CAEB69B79E56"><enum>(1)</enum><text>in paragraph (5), by striking <quote>cattle,</quote> and inserting <quote>cattle (including fed cattle),</quote>;</text></paragraph><paragraph id="id95CDA848C666486CAE02662007EEEEAF"><enum>(2)</enum><text>by redesignating paragraphs (1) through (14) as paragraphs (2), (3), (4), (6) through (8), (10), and (12) through (18), respectively;</text></paragraph><paragraph id="idD01626395A6049F18315430D47975ADB"><enum>(3)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC0FE2C08D0042AABE15473BF8DF9DF3"><paragraph id="ide0379fc36e944f64bc1a31021bca0a67"><enum>(1)</enum><header>Approved pricing mechanism</header><text>The term <term>approved pricing mechanism</term> means a purchase of fed cattle made—</text><subparagraph id="id9870663c5aa24fe49fefe2055d0b830e"><enum>(A)</enum><text>through a negotiated purchase;</text></subparagraph><subparagraph id="id301bac043aa945b1ad879b146108a2f8"><enum>(B)</enum><text>through a negotiated grid purchase;</text></subparagraph><subparagraph id="id58fc7bf4ec714c52a0d3242692503a39"><enum>(C)</enum><text>at a stockyard (as defined in section 302 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/202">7 U.S.C. 202</external-xref>)); or</text></subparagraph><subparagraph id="id64b787bbca6e4f3784d80337afeb2c48"><enum>(D)</enum><text>through a trading system or platform for the purchase or sale of cattle, or for an arrangement to purchase or sell cattle, through any means in which multiple buyer and seller participants have the ability to, and regularly and consistently, make and accept bids and offers on or at the trading system or platform.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id9B33D06A89F245CF8DFC63B5396C44BA"><enum>(4)</enum><text>by inserting after paragraph (4) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDFA271010AD541A0BADAEB6A8F3AA132"><paragraph commented="no" display-inline="no-display-inline" id="idA6C435FCEEAA437D889501B6547E5D29"><enum>(5)</enum><header display-inline="yes-display-inline">Fed cattle</header><text display-inline="yes-display-inline">The term <term>fed cattle</term> means a steer or heifer that has been finished on a ration of roughage and feed concentrates, such as grains, protein meal, grass (forage), and other nutrient-rich feeds, prior to slaughter.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id5a9a23d96e3b4b9e876905762bc47229"><enum>(5)</enum><text>by inserting after paragraph (8) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id66de809bc0d54f81bd0ce97433197dba"><paragraph id="id20c1860661c846269d4d92e7967495d7"><enum>(9)</enum><header>Mandatory minimum</header><text>The term <term>mandatory minimum</term> means, of the quantity of fed cattle purchased for slaughter by a covered packer (as defined in section 221) for each processing plant, the minimum percentage of such cattle that are required to be purchased through approved pricing mechanisms from producers that are not packers.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idB4FA1B9E40FC4506B2A0F25CAD0D6572"><enum>(6)</enum><text>by inserting after paragraph (10) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3371647F082E43AAAA8633F53DCBCD19"><paragraph id="ideac02a4708f4454e8adc9a8a8721cb96"><enum>(11)</enum><header>Negotiated grid purchase</header><text>The term <term>negotiated grid purchase</term>, with respect to cattle, means a purchase—</text><subparagraph id="id2B34F3E7DB6F42ED8FA5E0C7DDB07238"><enum>(A)</enum><text>involving the negotiation of a base price from which premiums are added and discounts are subtracted, determined by seller-buyer interaction and agreement on a delivery day; and</text></subparagraph><subparagraph id="id53BB3E98C1744B429E8099C10403B19F"><enum>(B)</enum><text>under which the cattle are scheduled for delivery to the packer not later than 14 days after the date on which the cattle are committed to the packer.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8900022C9F014600A16BAC8C7940429E"><enum>(b)</enum><header>Cattle reporting definitions</header><text>Section 221 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635d">7 U.S.C. 1635d</external-xref>) is amended—</text><paragraph id="idbd866ee951e24083937b133aa2b064d2"><enum>(1)</enum><text>in paragraph (1), by striking <quote>7-day</quote> and inserting <quote>14-day</quote>;</text></paragraph><paragraph id="id3F939EE0CC5C4670A099D682F373A9B8"><enum>(2)</enum><text>in paragraph (8)(B), by striking <quote>market</quote> and inserting <quote>marketing</quote>;</text></paragraph><paragraph id="id8CA267CDC5A44B0D980A48A6FEC96A4C"><enum>(3)</enum><text>by redesignating paragraphs (3), (4), (5), (6), (7), and (8) as paragraphs (5), (6), (8), (9), (11), and (12), respectively;</text></paragraph><paragraph id="id4FE6C6955A7041D5A27342B6A9CB7474"><enum>(4)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB1216E1B27FB4218B27DA6D196AB552A"><paragraph id="idf33c43508e044ad08939cb200af67ad7"><enum>(3)</enum><header>Covered contract</header><subparagraph id="idFD99C3C89C694E2895A1DB16EFD0963B"><enum>(A)</enum><header>In general</header><text>The term <term>covered contract</term> means any agreement, written or oral, between a packer and a producer for the purchase of fed cattle for slaughter.</text></subparagraph><subparagraph id="idD3F34DBDF07740A78CA9A74454339E4C"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered contract</term> does not include a contract for a negotiated purchase.</text></subparagraph></paragraph><paragraph id="id1728bc05495143b79e95be9710bc2ff2"><enum>(4)</enum><header>Covered packer</header><text>The term <term>covered packer</term> means a packer that has slaughtered during the immediately preceding 5 calendar years an average of not less than 5 percent of the number of fed cattle slaughtered nationally during the immediately preceding 5 calendar years.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idF9CEB18B82F34C61964F064711029B3D"><enum>(5)</enum><text>by inserting after paragraph (6) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38359FFB99F54202B8C3C069C91BE6A6"><paragraph id="id8DFEB80E51A745B0B8BAA015137E055C"><enum>(7)</enum><header>Heifer</header><text>The term <term>heifer</term> means a bovine female that has not given birth to a calf.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id8AC55194D89747A3A7512E7CE2082EC9"><enum>(6)</enum><text>by inserting after paragraph (9) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD09FF58B83384E6AADE07B1A4EB0AF75"><paragraph id="id4249BD36453B4AEEBE04B7E4BB37C5EC"><enum>(10)</enum><header>Steer</header><text>The term ‘steer’ means a bovine male castrated before reaching sexual maturity.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id0F5ECD3D7CB8442F9AA427F023696B0F"><enum>3.</enum><header>14-Day cattle slaughter report</header><text display-inline="no-display-inline">Section 222(c) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635e">7 U.S.C. 1635e(c)</external-xref>) is amended—</text><paragraph id="idE3EE155CEDB14F0592504CC58AB4A6EE"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id3082895B266848F885E272E696179114"><enum>(A)</enum><text>by striking subparagraphs (B) and (C); and </text></subparagraph><subparagraph id="idE8C3E6C06E7647AF91497D67271C7784"><enum>(B)</enum><text>by redesignating subparagraph (D) as subparagraph (B);</text></subparagraph></paragraph><paragraph commented="no" id="id11D777832DE7442DB49BFEA40F90714C"><enum>(2)</enum><text>in paragraph (2), by striking <quote>the information</quote> and inserting <quote>information reported under this subsection</quote>;</text></paragraph><paragraph id="id00EEFB0E961640D09C3B137CB1CFD7F0"><enum>(3)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="idEE5EE7E306DA42808B8AF514B0FD4D48"><enum>(4)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0C364B6EE9E141E8BC154DA5700F783B"><paragraph id="id0B74D88A1D2E4DCBB5F15914718D9B08"><enum>(2)</enum><header>Prior day reporting</header><subparagraph id="id8042FC1282634F69AF7D8E14632E6A2A"><enum>(A)</enum><header>In general</header><text>The corporate officers or officially designated representatives of each packer processing plant shall report to the Secretary, for each business day of the packer processing plant, not later than 10:00 a.m. Central Time on each reporting day, the information from the prior business day described in subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEAC9700618FD4196B263A89CD7807CDF"><enum>(B)</enum><header>Information required</header><text>The information required under subparagraph (A) shall be, with respect to the prior business day, the number of cattle scheduled for delivery to a packer processing plant for slaughter for each of the next 14 calendar days.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id80080C4BFA374AAA8587D1E08890C8A5"><enum>4.</enum><header>Expedited carcass weights reporting</header><text display-inline="no-display-inline">Section 222 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635e">7 U.S.C. 1635e</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id716A7F9E4AB04BB3890AC87E1DC2B3C0"><subsection commented="no" display-inline="no-display-inline" id="idBAF532B4BC3A46A986AAA3ECCFEE8BF6"><enum>(f)</enum><header>Expedited carcass weights</header><paragraph commented="no" id="idf21ae0048e2f47cbbdcd6c7a21835185"><enum>(1)</enum><header>Determination</header><text>Not later than 180 days after the date of enactment of the <short-title>Cattle Price Discovery and Transparency Act of 2023</short-title>, the Secretary shall determine the minimum amount of time needed by the Secretary to publicly report the daily average carcass weight of cattle slaughtered by packer processing plants.</text></paragraph><paragraph commented="no" id="id81fe27d392d7463f9d00c0889b1f0641"><enum>(2)</enum><header>Reporting</header><text>Not later than 180 days after the Secretary has made a determination under paragraph (1), the Secretary shall begin publicly reporting the information described in that paragraph within the time determined under that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="idD88F230D151B43C4AB21D02B5BDD66F0"><enum>5.</enum><header>Mandatory reporting of cutout yield</header><text display-inline="no-display-inline">Section 223 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635f">7 U.S.C. 1635f</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0DAFC975C5F8477EB74E82A3B22B5298"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id0110f416eb2c4e7cb423b1c048a14beb"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Daily reporting</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">In General</header-in-text></quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE79E874445D04B848509AED820145BB4"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause commented="no" display-inline="no-display-inline" id="idE10DB5B7D51041C498E1CF6E3C954D36"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6D64398CAC7E49F7A971C97B4C1BD738"><enum>(ii)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting appropriately;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB279E14B330477BB0748FC070192BE7"><enum>(C)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and indenting appropriately; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E89D645F4A14B4E8206031D2365190C"><enum>(D)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>Secretary at least</quote> and inserting the following: “Secretary—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA166F1723D114B969B979A2155D5ADFD"><paragraph commented="no" display-inline="no-display-inline" id="idE07C8512B7A841B3AD30A528A30013A5"><enum>(1)</enum><text>at least</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA3897B932900404A8D2914CAFA459F4A"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id91F9C66E85F64B008A0AEAB11DBF2A0A"><paragraph id="id93eade37d8a04960883a979a13b7f0a0"><enum>(2)</enum><text>at least once each year, at a time determined by the Secretary, cutout yield data.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA5C955092824434FAD5AE75113A06C28"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8619499882F641FA83F1234784FAEEC9"><enum>(A)</enum><text>by striking <quote>the information required to be reported under subsection (a)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC32CFE8FC5DD40A48C19C4F4BD811F18"><enum>(B)</enum><text>by striking <quote>day.</quote> and inserting the following: “day—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id93B60619A7574CB38B9C96D59A1DC9E7"><paragraph commented="no" display-inline="no-display-inline" id="id9BFECCA35DDA49AE9E08F0D4072F0543"><enum>(1)</enum><text>the information required to be reported under subsection (a)(1); and</text></paragraph><paragraph id="id9d9aa664233b4768aa34f95d80307ecb"><enum>(2)</enum><text>a composite price using the information required to be reported under paragraphs (1) and (2) of subsection (a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id25A4459FF9B64F698DD867E6F837C656"><enum>6.</enum><header>Cattle contract library</header><text display-inline="no-display-inline">The Agricultural Marketing Act of 1946 is amended—</text><paragraph id="id62F63C013AC840E09379248302FAEC6E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 223 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635f">7 U.S.C. 1635f</external-xref>) as section 224; and</text></paragraph><paragraph id="id449D84DD94374027A2267474BCD0F518"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 222 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635e">7 U.S.C. 1635e</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B63BB5DC3D940608DC65EEEE5729A94"><section id="idCF83591E61C548B2B820686157387DBC"><enum>223.</enum><header>Cattle contract library</header><subsection id="id7ab0aced56ce42198b25b40a5764f672"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of the <short-title>Cattle Price Discovery and Transparency Act of 2023</short-title>, the Secretary shall establish and maintain, through the Livestock Mandatory Price Reporting program, a library or catalog (referred to in this section as the <quote>library</quote>), of each type of covered contract entered into between packers and producers for the purchase of fed cattle (including cattle that are purchased or committed for delivery), including any schedules of premiums or discounts associated with the covered contract.</text></subsection><subsection id="idbdebface63784c379881b230149020a9"><enum>(b)</enum><header>Information collection</header><paragraph id="id9d9e227dbb174b0f9d72a744c19c5d9e"><enum>(1)</enum><header>In general</header><text>To maintain the library, the Secretary shall obtain information from each packer on each type of existing covered contract of the packer by requiring a filing or other form of information submission from each packer.</text></paragraph><paragraph id="id53db0f92d0824f46a4c7c1b15c03aa78"><enum>(2)</enum><header>Contract information</header><text>Information submitted to the Secretary by a packer under paragraph (1) shall include, with respect to each existing covered contract of a packer—</text><subparagraph id="id4906b37c26a34bc6a12f3bb8322dbd29"><enum>(A)</enum><text>the type of contract; </text></subparagraph><subparagraph id="id483ce6ca8faa41c9aac751a1c90ee21f"><enum>(B)</enum><text>the duration of the contract;</text></subparagraph><subparagraph id="ide64e87891a064c5a9a6d358c6628515d"><enum>(C)</enum><text>a summary of the contract terms;</text></subparagraph><subparagraph id="id96aa7bd2a7784ed8acbc4fbb26f9235d"><enum>(D)</enum><text>provisions in the contract that may affect the price of cattle covered by the contract, including schedules, premiums and discounts, financing and risk-sharing arrangements, and transportation arrangements;</text></subparagraph><subparagraph id="ide1bd7bec165448a89d02c65ab1d0699c"><enum>(E)</enum><text>the total number of cattle covered by the contract solely committed to the packer each week within the 6-month and 12-month periods following the date of the contract and the percentage of cattle each week that may vary for delivery or nondelivery at the discretion of the packer, organized by reporting region or in such other manner as the Secretary may determine;</text></subparagraph><subparagraph id="id2518f4620c9f4d0e84fbbdeb45ddb465"><enum>(F)</enum><text>in the case of a contract in which a specific number of cattle are not solely committed to the packer—</text><clause id="ide28b161e60ee4f9490b8e8e5ef5e39b6"><enum>(i)</enum><text>an indication that the contract is an open commitment; and</text></clause><clause id="id6b1be3a201964ac2b95bf604e7872e52"><enum>(ii)</enum><text>any weekly, monthly, annual, or other limitations or requirements on the number of cattle that may be delivered to the packer under the contract, including the percentage of cattle that may vary for delivery or nondelivery in a given time period at the discretion of the packer; and </text></clause></subparagraph><subparagraph id="id59c993c6a3e646b787b069a38e325577"><enum>(G)</enum><text>a description of the provisions in the contract that provide for expansion in the numbers of fed cattle to be delivered under the contract for the 6-month and 12-month periods following the date of the contract.</text></subparagraph></paragraph></subsection><subsection id="idACE34C94FD324838AB7F7778CCC99E83"><enum>(c)</enum><header>Availability of information</header><paragraph id="id10419b233b6a4513a04e3ec02ac7e922"><enum>(1)</enum><header>In general</header><text>The Secretary shall make publicly available to producers and other interested persons information (including the information described in subsection (b)(2)), in a user-friendly format, on the types of covered contracts in the library, including notice (on a real-time basis, if practicable) of the types of covered contracts that are entered into between packers and producers for the purchase of fed cattle.</text></paragraph><paragraph id="idCD127E87CA434B2292CD8377FE53EE4E"><enum>(2)</enum><header>Monthly report</header><subparagraph id="idFFBB604248B347B6A74E46CD93754188"><enum>(A)</enum><header>In general</header><text>Beginning 30 days after the library is established, the Secretary shall make the information obtained each month in the library available in a monthly report to producers and other interested persons.</text></subparagraph><subparagraph id="idB58ABCD17E784A4FB0B703675EEA9014"><enum>(B)</enum><header>Contents</header><text>The monthly report described in subparagraph (A) shall include—</text><clause id="id9f9808fd4d244b1186ca83b87ec10f64"><enum>(i)</enum><text>based on the information collected under subsection (b)(2)(E), an estimate by the Secretary of the total number of fed cattle committed under covered contracts for delivery to packers within the 6-month and 12-month periods following the date of the report, organized by reporting region and type of contract; </text></clause><clause id="id829e0de96b09485aac16e9bef35c767a"><enum>(ii)</enum><text>based on the information collected under subsection (b)(2)(F), the number of covered contracts with an open commitment and any weekly, monthly, annual, or other limitations or requirements on the number of cattle that may be delivered under such contracts, including the percentage of cattle that may vary for delivery or nondelivery in a given time period at the discretion of the packer; and</text></clause><clause id="id93b82a449faa42559ab724dfd050c4ef"><enum>(iii)</enum><text>based on the information collected under subsection (b)(2)(G), an estimate by the Secretary of the total maximum number of fed cattle that may be delivered within the 6-month and 12-month periods following the date of the report, organized by reporting region and type of contract. </text></clause></subparagraph></paragraph></subsection><subsection id="id067C180386C44A7A8590AEB85A321BD4"><enum>(d)</enum><header>Maintenance of library</header><text>Information in the library about types of contracts that are no longer offered or in use shall be removed from the library.</text></subsection><subsection id="id5b80ff70b6384c599be09b5ac34d7c42"><enum>(e)</enum><header>Confidentiality</header><text>The reporting requirements for packers under this section shall be subject to the confidentiality protections provided under section 251.</text></subsection><subsection id="id65e7cba6bf46436aa7a1254bb795dc62"><enum>(f)</enum><header>Violations</header><text>It shall be unlawful and a violation of this Act for any packer to willfully fail or refuse—</text><paragraph id="id099536DCB537434B9A46780162F8D33F"><enum>(1)</enum><text>to provide to the Secretary accurate information required under this section; or</text></paragraph><paragraph id="idCA9AF6A49F0745989DB27FC01BDB0C6C"><enum>(2)</enum><text>to comply with any other requirement of this section.</text></paragraph></subsection><subsection id="id3f72161eeb3b4994aa01e78b9d487de5"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idB8629FFEF9484F8A8DCD800F35D7E6C9"><enum>7.</enum><header>Market acquisition of fed cattle</header><subsection id="idACC8F497A84D4ABB885D4F9B46AD3664"><enum>(a)</enum><header>Sense of the Senate</header><text>It is the sense of the Senate that—</text><paragraph id="idd845024da0284403915d2499db76eac7"><enum>(1)</enum><text>all participants in the fed cattle market have a responsibility to contribute to sufficient levels of negotiated trade of fed cattle in all cattle feeding regions in order to achieve competitive bidding and maximum transparency in all relevant markets and robust price discovery for the benefit of all market participants;</text></paragraph><paragraph id="id51fc64bf4a9b429c9b5a58b4af023f92"><enum>(2)</enum><text>covered packers that use negotiated market prices or internal formulations thereof as the basis for formula marketing arrangements may have incentives to not participate in price discovery in fed cattle markets, including in order to influence the price, especially if the majority of the cattle purchases are under fed cattle formula marketing arrangements under which it is particularly important to have minimum participation; and</text></paragraph><paragraph id="id802011d4346545368be17c65c98c4c6d"><enum>(3)</enum><text>the Department of Agriculture should examine academic literature regarding minimum levels of negotiated transactions necessary to achieve robust price discovery, eliminate the potential for price manipulation, and enhance cattle producer leverage in the marketplace in each of the cattle marketing regions.</text></paragraph></subsection><subsection id="idBA49239902D14E21B6093CBA564B39F0"><enum>(b)</enum><header>Penalties</header><text>Section 253(a) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636b">7 U.S.C. 1636b(a)</external-xref>) is amended—</text><paragraph id="id7BC8DEDAAFF84FDA9D213EA4ABB22F7F"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id7384935AF9D144A3800E725B39858833"><enum>(A)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>Any packer</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4D64600ED83D42BFB03ED359FF2B295E"><paragraph id="id93FE4768F12C4C61BF605AED00B29301"><enum>(1)</enum><header>Penalty amount</header><subparagraph id="id8A6BCE97D47C4628A13C3A8D30B7EEA5"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), any packer</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id2BBED9BE45544A83A8B2B4F9FC851C27"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9601375927814EECB04DA69E6322AB2B"><subparagraph id="id526FC23D6CC74E44994047666BDBBC3C"><enum>(B)</enum><header>Mandatory minimum violation</header><text>Any packer or other person that violates section 259 may be assessed a civil penalty by the Secretary of not more than $90,000 for each violation (as adjusted for inflation).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id723A1B71741746798597C4186D6520FD"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id64978883FE9F4225AAFD6BE27B30026F"><enum>(A)</enum><text>by striking <quote>Each day</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD7CF0420229641A48A0375B42AABC14E"><subparagraph id="id3FC63D4B05AB4AB28EA1E7ED69D38E52"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), each day</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB889E27B495E4899B3B686713B27233D"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71D4C54AC48C4DE189C8B9555970B40F"><subparagraph id="id20499086F647476BB3BCC03D721D5AE9"><enum>(B)</enum><header>Mandatory minimum violation</header><text>Each week during which a violation of section 259 continues shall be considered to be a separate violation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id9e96dd25c2df4286b10a48ca7d30b5fe"><enum>(c)</enum><header>Mandatory minimums</header><text>The Agricultural Marketing Act of 1946 is amended—</text><paragraph id="id20d73897228e4e90b926c4644fc48edb"><enum>(1)</enum><text>by redesignating sections 259 and 260 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636h">7 U.S.C. 1636h</external-xref>, 1636i) as sections 260 and 261, respectively; and</text></paragraph><paragraph id="idc79d1eedb89e4c88adb0eed8fb170911"><enum>(2)</enum><text>by inserting after section 258 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636g">7 U.S.C. 1636g</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id095e02dd9ef14d97b619b06139b97b3e"><section id="ida94490aba2034807b0fc16eda7555ed9"><enum>259.</enum><header>Mandatory minimums</header><subsection id="idcb7d4232da5a47158d75cfdd509cd77c"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to establish mandatory minimums—</text><paragraph id="id91bfe785c855435d966c2ba0e1578aba"><enum>(1)</enum><text>to enhance price discovery, transparency, and cattle producer leverage for cattle market participants; and</text></paragraph><paragraph id="idc92657345e494ebca360b63abf4efe15"><enum>(2)</enum><text>to minimize and mitigate conflicts of interest and other incentives for a covered packer to influence the base price of formula marketing arrangements for the benefit of the covered packer through action or inaction in the market in which the base price is determined.</text></paragraph></subsection><subsection id="id733644bd33824fd0ae93bcf9b7f5fd58"><enum>(b)</enum><header>Establishment</header><paragraph id="id959b1a4db4bc4aa9b2a19a0008fd8e18"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of the <short-title>Cattle Price Discovery and Transparency Act of 2023</short-title>, the Secretary shall establish—</text><subparagraph id="idf9f9442ad5fd4c7b813f3b574cca1e4c"><enum>(A)</enum><text>5 to 7 contiguous regions (referred to in this section as <quote>covered regions</quote>) that—</text><clause id="idF5CF45F6272E48C0976219DB5BCF4A7D"><enum>(i)</enum><text>together encompass the entire continental United States; and </text></clause><clause id="id9C7D5EC41E1C47C08D7A580FEC06FC7C"><enum>(ii)</enum><text>to the extent practicable, reasonably reflect similar fed cattle purchase practices;</text></clause></subparagraph><subparagraph id="idd443d224b88b48149804487a7eabb8c1"><enum>(B)</enum><text>a mandatory minimum—</text><clause id="idC13C9A86E8564D789334C80439BBD224"><enum>(i)</enum><text> for each covered region established under subparagraph (A); and</text></clause><clause id="id5F935A01795742C9AA5E82A08E1471E8"><enum>(ii)</enum><text>that shall be applicable with respect to each processing plant of a covered packer located in that covered region; and</text></clause></subparagraph><subparagraph id="iddf635ed0dbae4bd5ad67c742505b85c8"><enum>(C)</enum><text>a time period within which a covered packer shall be required to meet the applicable mandatory minimum, which shall be not less than 1 week but not more than 30 days. </text></subparagraph></paragraph><paragraph id="idb27b160914784f959ce247535f27152b"><enum>(2)</enum><header>Modifications</header><text>The Secretary—</text><subparagraph id="idafba0239b5be429d9403d4ccbb8b0cdc"><enum>(A)</enum><text>shall review the mandatory minimums established under paragraph (1) not later than 2 years after the date of establishment and periodically thereafter, but not less frequently than once every 5 years; and</text></subparagraph><subparagraph id="id459cf833eca6440aa191fe632a872fce"><enum>(B)</enum><text>modify any such mandatory minimum, as necessary, after consulting with representatives of the United States cattle and beef industry and in accordance with paragraph (4).</text></subparagraph></paragraph><paragraph id="id1fc0f1b6b692450b9e3ac40d6a2cee7f"><enum>(3)</enum><header>Public input</header><text>In carrying out this subsection, the Secretary shall make all proposed mandatory minimums subject to notice and comment rulemaking and a cost-benefit analysis.</text></paragraph><paragraph id="id98c5799dfcbb4fda8856ae5625923740"><enum>(4)</enum><header>Considerations</header><text>In establishing or modifying mandatory minimums under this subsection for any covered region, the Secretary shall consider the following factors:</text><subparagraph id="id4797fcb7142d449fa89b1d3230fdf53d"><enum>(A)</enum><text>The number of covered packers in the covered region.</text></subparagraph><subparagraph id="id787a24448c3e47b4b8832a07a0dc90c7"><enum>(B)</enum><text>The availability of fed cattle in the covered region.</text></subparagraph><subparagraph id="id4e67c4bd184e482f8ae45e3c10c8dff1"><enum>(C)</enum><text>Pre-existing contractual arrangements of packers in the covered region.</text></subparagraph><subparagraph id="id8d09573ef3be45339b3f269162dbfe3b"><enum>(D)</enum><text>The number of pricing transactions (pens of cattle sold) in the covered region.</text></subparagraph><subparagraph id="id820bd11d435d4fbbb25d1d1a4ddd73fa"><enum>(E)</enum><text>The proportion of fed cattle purchased in the covered region through negotiated purchases or negotiated grid purchases relative to the number of formula marketing arrangements that use the negotiated prices or negotiated grid prices as base prices. </text></subparagraph></paragraph><paragraph id="idb0cda0117c2a496da7d8ae60444e1358"><enum>(5)</enum><header>Initial mandatory minimum requirement</header><text>The initial mandatory minimum established under paragraph (1)(B) for each covered region shall be—</text><subparagraph id="id5D519165539F4C2784E3D0AC2A3A6032"><enum>(A)</enum><text>not less than the average percentage of negotiated purchases and negotiated grid purchases made in that covered region between January 1, 2020, and January 1, 2022; and </text></subparagraph><subparagraph id="id05341747E19B4246A197127E40A9F449"><enum>(B)</enum><text>not more than 50 percent.</text></subparagraph></paragraph></subsection><subsection id="id33f9063e4c3845ad8d6b27a1a411a5fb"><enum>(c)</enum><header>Purchases</header><text>A covered packer shall, with respect to each processing plant of the covered packer, purchase through an approved pricing mechanism not less than the percentage of fed cattle required under the mandatory minimum established under subsection (b) for the covered region in which the processing plant is located.</text></subsection><subsection id="id3fb6fc3897a449a7bf6d782ed1e60212"><enum>(d)</enum><header>Enforcement</header><paragraph id="id33238DD6AE73409CA4D1ADC1CE349F45"><enum>(1)</enum><header>In general</header><text>On establishing mandatory minimums under subsection (b), the Secretary—</text><subparagraph id="id493b6df112984663adb60f98b21acc96"><enum>(A)</enum><text>shall regularly monitor compliance by covered packers with those mandatory minimums; and</text></subparagraph><subparagraph id="id21f1655650e4424f9bc07430a3ca0cd2"><enum>(B)</enum><text>in the case of noncompliance by a covered packer in a given period, may allow the covered packer to remedy the noncompliance by purchasing the applicable shortfall in the approved pricing mechanism in 1 or more subsequent periods, subject to paragraph (2).</text></subparagraph></paragraph><paragraph id="id1CFB69981D9849C0884528C6081AB02E"><enum>(2)</enum><header>Nonremedy</header><text>The Secretary shall not allow a covered packer to remedy noncompliance under paragraph (1)(B) if the covered packer has a pattern or practice of noncompliance, as determined by the Secretary. </text></paragraph></subsection><subsection id="idf47f2f4961234ed2bfdbe41587da1ce0"><enum>(e)</enum><header>Effect on premiums</header><text>Nothing in this section prohibits a formula marketing arrangement from including a premium in addition to the base price, including a premium for meat quality, consistency, breed, production method, branding, or any other value-added effort.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id1abbc4a129b34c9f9c1c83bef611fe00" changed="not-changed"><enum>8.</enum><header>Alternative marketing arrangements feasibility report</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service, shall publish a report analyzing the feasibility of alternative marketing arrangements with a base price tied to the price of boxed beef, which shall include information on—</text><paragraph id="idd91ef5ffde57461f9387ad02a353be4d" changed="not-changed"><enum>(1)</enum><text>the benefits and limitations of such alternative marketing arrangements;</text></paragraph><paragraph id="id0c1810476b144c01b2df70509f13e17f" changed="not-changed"><enum>(2)</enum><text>barriers limiting adoption of such alternative marketing arrangements;</text></paragraph><paragraph id="id7592230d27744620b83feba1c5af0205" changed="not-changed"><enum>(3)</enum><text>potential educational needs relating to the use of such alternative marketing arrangements for industry participants; and</text></paragraph><paragraph id="idf9771bf690ef43f39fed0c765ceb93cc" changed="not-changed"><enum>(4)</enum><text>risk management needs to increase the adoption and facilitate the ongoing delivery of benefits of such alternative marketing arrangements to industry participants.</text></paragraph></section><section id="idED1397D5EAA7496A9398CC4128B60477" changed="not-changed"><enum>9.</enum><header>Modifications to livestock mandatory reporting regions</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service, shall realign the livestock mandatory reporting regions established pursuant to subtitle B of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635">7 U.S.C. 1635 et seq.</external-xref>) by—</text><paragraph id="id1F08A5FE056C482CBBDF98316EE81B43" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">modifying the existing Colorado cattle reporting region to include the State of Wyoming; and</text></paragraph><paragraph id="id6C0398F417D345C0B96BEFBC7059097C" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">modifying the existing Iowa-Minnesota cattle reporting region to include the States of Illinois and South Dakota. </text></paragraph></section></legis-body></bill>
