<section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS-Free Procurement Act of 2023</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="idbdf5a0ee997f431baf906d6b2d34c7fe" section-type="subsequent-section" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on procurement of certain items containing perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA)</header><text display-inline="no-display-inline">Beginning on October 1, 2025, the head of an executive agency may not enter into a contract for the procurement of cookware, utensils, carpets, or furniture that contain perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA).</text></section>

<paragraph commented="no" display-inline="no-display-inline" id="id9121268a67d844f280f3bc8dcf837574"><enum>(1)</enum><header display-inline="yes-display-inline">Executive agency defined</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph> <paragraph id="id87df22f2fc03439a943a43a1714d96c1"><enum>(2)</enum><header>PFAS</header><text>The term <term>PFAS</term> means a perfluoroalkyl or polyfluoroalkyl substance that is man-made and has not fewer than 1 fully fluorinated carbon atom.</text></paragraph></section>

<section id="id2471894f4bb340ce872f61ed260d229c" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Priority procurement of products not containing pfas</header><text display-inline="no-display-inline">The head of an executive agency shall prioritize the procurement of covered items, where available and practicable, that do not contain harmful perfluoroalkyl or polyfluoroalkyl substances (PFAS). </text></section> <section id="id4f0a5a426b7c4e8a865110f0bee244db" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="idc5bb9bb9bdb2425296a6cc301f3c4037"><enum>(1)</enum><header>Executive agency defined</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph> <paragraph id="idb8cdf6677c094604a4c2a1f95039d944"><enum>(2)</enum><header>Covered items</header><text>The term <term>covered items</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idfa2cf7012c574458a02c82eaa9829148"><enum>(A)</enum><text display-inline="yes-display-inline">nonstick cookware and cooking utensils; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idbf65f89dbdf44a3892ba3f2542ffec29"><enum>(B)</enum><text display-inline="yes-display-inline">furniture, carpets, and rugs treated with stain-resistant coatings.</text></subparagraph></paragraph></section>
