which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title> To allow for civil and criminal actions against certain providers of interactive computer services, and for other purposes.</official-title></form><legis-body style="OLC"><section id="id416fc47dd77744b89a1c4b50c66d73eb" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fentanyl Trafficking Prevention Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id4B328CC425B9490B8B45BC53ED33C8DC" section-type="subsequent-section"><enum>2.</enum><header>Liability for certain Controlled Substances Act violations</header><subsection commented="no" display-inline="no-display-inline" id="idDEF7E81E522D4E9EB1A9FA8ACC9C08C6"><enum>(a)</enum><header>In general</header><text>Part D of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idC05A5A2E30C9411FBF074898AF8BA37A" changed="not-changed" display-inline="no-display-inline" style="OLC"><section id="idD92C89259D9042B1AEA3AA47A7348443" changed="not-changed"><enum>424.</enum><header>Liability of interactive computer service providers</header><subsection id="idB6318FFA99334D05A3D3F87196548F74" changed="not-changed"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered provider</term> means a provider of an interactive computer service, as that term is defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>), that at any point during the 12 months preceding the filing of an indictment or information alleging a violation of subsection (b) or the filing of a complaint in a civil action under subsection (c)—</text><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idfbc1700f968d4cdeab4d0f63e9871e45"><enum>(1)</enum><text display-inline="yes-display-inline">has not fewer than 50,000,000 United States-based monthly active users; or</text></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idaf1d6e77fa534fdca180d99119622d00"><enum>(2)</enum><text display-inline="yes-display-inline">has not fewer than 100,000,000 worldwide monthly active users. </text></paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ide75ca3376ea3458286d837b4f6737ad2"><enum>(b)</enum><header display-inline="yes-display-inline">Criminal offense</header><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idB7A6045076CD476CB554C2232B8CD571"><enum>(1)</enum><header display-inline="yes-display-inline">Offense</header><text>It shall be unlawful for a covered provider that operates through the use of any facility or means of interstate or foreign commerce or in or affecting interstate or foreign commerce, through such service to knowingly or intentionally facilitate a violation of section 401(a)(1), 409, 418, or 419 for distributing, dispensing, or possessing with intent to distribute or dispense—</text><subparagraph commented="no" display-inline="no-display-inline" id="id47F51315A3344E3C96A553E240411F3B"><enum>(A)</enum><text display-inline="yes-display-inline">an opioid or a synthetic opioid; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4CBDDCA814574CE5AE1FA8F7EE78D81D"><enum>(B)</enum><text display-inline="yes-display-inline">cocaine; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F1DDC43A7684C76B586F016B25A88B9"><enum>(C)</enum><text display-inline="yes-display-inline">methamphetamine.</text></subparagraph></paragraph><paragraph id="id8ACD6ABEB8B34A37A7BD52AD897ACA2A" changed="not-changed"><enum>(2)</enum><header>Penalty</header><text>A covered provider that violates paragraph (1) shall be fined not more than $10,000,000.</text></paragraph></subsection><subsection id="id7A3944CE271241BE9C632BE4F02D8FF4" changed="not-changed"><enum>(c)</enum><header>Civil action</header><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idFA9A8817693C471D8A835336FE861626"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may bring a civil action in an appropriate district court of the United States against any covered provider that operates through the use of any facility or means of interstate or foreign commerce or in or affecting interstate or foreign commerce, and through such service, intentionally, knowingly, or recklessly facilitates a violation of section 401(a)(1), 409, 418, or 419 for distributing, dispensing, or possessing with intent to distribute or dispense—</text><subparagraph commented="no" display-inline="no-display-inline" id="id82DD50B5E5904F94ACC0BC302E03CE4B"><enum>(A)</enum><text display-inline="yes-display-inline">an opioid or a synthetic opioid; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id876D71E8AB454100963A1C570CEE187D"><enum>(B)</enum><text display-inline="yes-display-inline">cocaine; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA6748B4A320E4ACB934A9AC4F503C047"><enum>(C)</enum><text display-inline="yes-display-inline">methamphetamine.</text></subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id106F6144C1854C71BAAA9920E8204302"><enum>(2)</enum><header>Penalty</header><text>In a civil action brought under paragraph (1), the Attorney General may recover a civil penalty of not more than $5,000,000.</text></paragraph></subsection><subsection id="idAA6A022258EC458CACC8BD2C09AE40F3" changed="not-changed"><enum>(d)</enum><header>Rules of construction</header><paragraph commented="no" display-inline="no-display-inline" id="id54EB7997F9994DC0963D0C26B4C01785" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Applicability to legal process</header><text>Nothing in this section shall be construed to apply to any action by a covered provider that is necessary to comply with a valid court order, subpoena, search warrant, statutory obligation, or preservation request from a law enforcement agency.</text></paragraph><paragraph id="id746BC3229C274E78860890E22DEDE4A2" changed="not-changed"><enum>(2)</enum><header>Mental state with respect to each item required</header><text>For purposes of subsections (b) and (c), the terms <term>intentionally</term>, <term>knowingly</term>, and <term>recklessly</term> shall be construed to mean intentionality, knowledge, or recklessness, respectively, with respect to the facilitation of each violation described in those subsections.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5E1F826ACFED4BBCBFF574AC81142A81"><enum>(e)</enum><header>Encryption technologies</header><paragraph commented="no" display-inline="no-display-inline" id="id17DFBB15D5144DB4850BA6A35B96A188"><enum>(1)</enum><header display-inline="yes-display-inline">Cybersecurity protections do not give rise to liability</header><text>A criminal prosecution under subsection (b) or a civil action under subsection (c) may not be brought against a covered provider because the covered provider—</text><subparagraph id="id309D0FBFC78944DE96024748F7C92CA9"><enum>(A)</enum><text>utilizes full end-to-end encrypted messaging services, device encryption, or other encryption services;</text></subparagraph><subparagraph id="id2262B63859414CC484257CCA512C1160"><enum>(B)</enum><text>does not possess the information necessary to decrypt a communication; or</text></subparagraph><subparagraph id="id4A568BB530AC4B34AACFCA3D456AB722"><enum>(C)</enum><text>fails to take an action that would otherwise undermine the ability of the covered provider to offer full end-to-end encrypted messaging services, device encryption, or other encryption services.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE22CB7AF56E1465F9393A197BB4D2E1D"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection is intended to undermine the use of encryption technology.</text></paragraph></subsection><subsection id="idDAC0A04E2E1A49D18F48A56A423CE880"><enum>(f)</enum><header>Protection of Privacy</header><text>Nothing in this section shall be construed to require a covered provider to—</text><paragraph id="id92BD6886A2434C57A4B675AC27411850"><enum>(1)</enum><text>monitor any user, subscriber, or customer of that covered provider;</text></paragraph><paragraph id="id031DFF9734BF4C3F945AF51F95DF65F3"><enum>(2)</enum><text>monitor the content of any communication of any person described in paragraph (1); or</text></paragraph><paragraph id="id0EDB9A4CDA044C95825C8188F90FEC9F"><enum>(3)</enum><text>affirmatively search, screen, or scan for violations described in subsection (b)(1) or (c)(1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7D122E48D069420B99A9839E10B28BF1" changed="not-changed"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by inserting after the item relating to section 423 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id325C6BDB41D347E9AE149B683F9FEDB1" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">Sec. 424. Liability of interactive computer service providers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="id57889438A37D4EE6BEE97B65516F6A07"><enum>3.</enum><header>Federal civil liability</header><text display-inline="no-display-inline">Section 230(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(e)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id31AFD2A6B6D145078B12E993C4274522"><paragraph id="id056E449D5EE54632A2012369BD45B272"><enum>(6)</enum><header>No effect on certain claims or charges pertaining to certain drugs</header><text display-inline="yes-display-inline">Nothing in this section, other than subsection (c)(2)(A), shall be construed to impair or limit any claim in a civil action brought against a provider of an interactive computer service under section 424(c) of the Controlled Substances Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id18d1b230084c4d448def5b037a00929e"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or amendment made by this Act, or the application of such a provision or amendment to any person or circumstance, is held to be unconstitutional, the remaining provisions of this Act and amendments made by this Act, and the application of such provision or amendment to any other person or circumstance, shall not be affected thereby.</text></section></legis-body></bill>
