which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require transparency in notices of funding opportunity, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Grant Transparency Act of 2023</short-title></quote>.</text></section><section id="id0ec99c29ec334c0a970c6840d18826a8"><enum>2.</enum><header>Notices of funding opportunity transparency</header><subsection id="id6eed855691ef4910a1298099d54c8408"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id47e69fc7a9b1492db1ca9ab82eba0633"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term>—</text><subparagraph id="ide4ba47443b844b4fab1adeff57d7664a"><enum>(A)</enum><text>has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph id="idb912fef5cb3c4f298b4bb982a09e1e3c"><enum>(B)</enum><text>does not include the Government Accountability Office.</text></subparagraph></paragraph><paragraph id="id46d902898a664840a6febe1331809575"><enum>(2)</enum><header>Competitive grant</header><text>The term <term>competitive grant</term> means a discretionary award (as defined in section 200.1 of title 2, Code of Federal Regulations) awarded by an agency—</text><subparagraph id="id7074d4d0e1dc46af87080870db4ec34c"><enum>(A)</enum><text>through a grant agreement or cooperative agreement under which the agency makes payment in cash or in kind to a recipient to carry out a public purpose authorized by law; and</text></subparagraph><subparagraph id="id34186c4b261b49d2bf39c10533087143"><enum>(B)</enum><text>the recipient of which is selected from a pool of applicants through the use of merit-based selection procedures for the purpose of allocating funds authorized under a grant program of the agency.</text></subparagraph></paragraph><paragraph id="id40d150ef146f4ac9a152ac9bf479cde0"><enum>(3)</enum><header>Evaluation or selection criteria</header><text>The term <term>evaluation or selection criteria</term> means standards or principles for judging, evaluating, or selecting an application for a competitive grant.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44a8283696ac4b7ca6076909a18c74be"><enum>(4)</enum><header>Notice of funding opportunity</header><text>The term <term>notice of funding opportunity</term> has the meaning given the term in section 200.1 of title 2, Code of Federal Regulations.</text></paragraph><paragraph id="id63f7a2ebd59b41c4b26b1e560b9997e5"><enum>(5)</enum><header>Rating system</header><text>The term <term>rating system</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd25bb9d19db6455181ea3bdd0d69ecc6"><enum>(A)</enum><text display-inline="yes-display-inline">means a system of evaluation of competitive grant applications to determine how such applications advance through the selection process; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd30a65ea16bb428295a81a64600c61b2"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause id="id4a4e781b8bdc4f44803747cd96fbcb51"><enum>(i)</enum><text>a merit criteria rating rubric;</text></clause><clause id="idfef0978e9f9040baa81df5fa4a2177f4"><enum>(ii)</enum><text>an evaluation of merit criteria;</text></clause><clause id="id755072c22126480b8c90bf7ddbd51e28"><enum>(iii)</enum><text>a methodology to evaluate and rate based on a point scale; and</text></clause><clause id="idddf1e8d9acff4f97a1e023e60dd761aa"><enum>(iv)</enum><text>an evaluation to determine whether a competitive grant application meets evaluation or selection criteria.</text></clause></subparagraph></paragraph></subsection><subsection id="id2c2a1110616f4fe898ff3293d3793640"><enum>(b)</enum><header>Transparency requirements</header><text>Each notice of funding opportunity issued by an agency for a competitive grant shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="idc77f5ab03608458386be0a8a58df43ed"><enum>(1)</enum><text display-inline="yes-display-inline">a description of any rating system and evaluation and selection criteria the agency uses to assess applications for the competitive grant;</text></paragraph><paragraph id="id75eb8bb0003a429cb0a8b0b1545caa22"><enum>(2)</enum><text>a statement of whether the agency uses a weighted scoring method and a description of any weighted scoring method the agency uses for the competitive grant, including the amount by which the agency weights each criterion; and</text></paragraph><paragraph id="id7852f1fbc66c40858aca086b148592e9"><enum>(3)</enum><text>any other qualitative or quantitative merit-based approach the agency uses to evaluate an application for the competitive grant.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0C6DCF0C81CE4936AE965E5BE40AF854"><enum>(c)</enum><header>Rule of construction</header><text>With respect to a particular competitive grant, nothing in this Act shall be construed to supersede any requirement with respect to a notice of funding opportunity for the competitive grant in a law that authorizes the competitive grant.</text></subsection><subsection id="idc00446d31beb41e08b37334dcda19742"><enum>(d)</enum><header>No additional funds</header><text display-inline="yes-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act. </text></subsection><subsection id="idd13aaa90ee3840e1b26128a1220c239d"><enum>(e)</enum><header>Effective date</header><paragraph commented="no" display-inline="no-display-inline" id="id1fefce2153a947a8b0c6d7fd976db209"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">This Act shall take effect on the date that is 120 days after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76fe474bb349401a87c53b17aad8d268"><enum>(2)</enum><header>No retroactive effect</header><text>This Act shall not apply to a notice of funding opportunity issued before the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
