which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to establish a groundwater conservation easement program, and for other purposes.</official-title></form><legis-body><section id="id36508a0228ea408ea369f04e12cf3812" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Groundwater Conservation Act of 2023</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Groundwater conservation easement program</header><subsection commented="no" display-inline="no-display-inline" id="idf9ca7da1099a4849be3edd220693861d"><enum>(a)</enum><header>Agricultural conservation easement program purposes</header><text>Section 1265(b) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3865">16 U.S.C. 3865(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide436555f95bf46b38b873225b5ecbd78"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfbba155a4b664e329491e6e702ea47c5"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60ad0871c97c4bd5874244c8a165570a"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddd50691c43954b3c8055a3dfbfbedb23"><paragraph id="id6aa59e05ed3a4084a41b8c7a5d149999"><enum>(5)</enum><text>facilitate reductions in groundwater consumption to support local, regional, or State groundwater management.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida246cbc630d04f0cb7cf0dbaafac17ab"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subtitle H of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3865">16 U.S.C. 3865 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3f88a2a9ed594b1ab75dad748a958acf"><section id="idce9d0bbf573c45eb884cdadb8a653115"><enum>1265E.</enum><header>Groundwater conservation easement program</header><subsection id="id7ad71b8992a644d8bc9fff06b4e4e13f"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide5c7408b75c2463893ed7dfb4ee01e17"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id0169903f05bf4d869a2b4eedf7d68f6c"><enum>(A)</enum><text>an agency of State or local government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4206394ef8d64fbe877279d6749cdcfa"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian Tribe; or</text></subparagraph><subparagraph id="idd5b3ffae8dfc40399af04fe30c2092e5"><enum>(C)</enum><text>an organization described in section 1265A(3)(B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id755cc3eccbea4561b69556a4c83d0349"><enum>(2)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means the surface estate of land on which eligible water rights have been historically used, as determined by governing State law, including—</text><subparagraph id="ida11adbf02626422a90f7aac3555afbee"><enum>(A)</enum><text>cropland;</text></subparagraph><subparagraph id="ide170fa24e7e84ecab3b8a873a359e16e"><enum>(B)</enum><text>grassland;</text></subparagraph><subparagraph id="id7c065e4b13e64e3cb78f56892590672a"><enum>(C)</enum><text>rangeland;</text></subparagraph><subparagraph id="ida6a7a25ba3b0464494e2fdadab25bc18"><enum>(D)</enum><text>pasture land;</text></subparagraph><subparagraph id="id0b8f15f8e23642299db762e4402f0c66"><enum>(E)</enum><text>nonindustrial private forest land; and</text></subparagraph><subparagraph id="id470a23a558ae4946b363a334157bc3cc"><enum>(F)</enum><text>other agricultural land.</text></subparagraph></paragraph><paragraph id="id5f04b7fdc87f420f83b01ba69edfee8a"><enum>(3)</enum><header>Eligible water rights</header><text>The term <term>eligible water rights</term> means rights that are—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida910343a02ab4bb59556e86b5a4227b5"><enum>(A)</enum><text display-inline="yes-display-inline">owned or controlled by 1 or more private, governmental, or Tribal landowners to groundwater that has been used on eligible land; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb61faaa7eff04b828bafe14dc6ed1757"><enum>(B)</enum><text display-inline="yes-display-inline">subject to a pending offer for the purchase of a groundwater conservation easement from an eligible entity, the purchase of which would—</text><clause id="idc06f7cb71c06490280df0a2e0509e537"><enum>(i)</enum><text>promote reduced groundwater consumption and reduced reliance on groundwater; and</text></clause><clause id="idbe56d841f0c348fbb175a3c28b9008a0"><enum>(ii)</enum><text>advance local, regional, or State groundwater management consistent with the purposes of the groundwater conservation easement program. </text></clause></subparagraph></paragraph><paragraph id="id1375cb3aa7ac4dfd84ad5c45dc1d6f15"><enum>(4)</enum><header>Groundwater conservation easement</header><subparagraph commented="no" display-inline="no-display-inline" id="id281d09a938ce4c918a57fbfff7148352"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>groundwater conservation easement</term> means an easement or other interest in eligible water rights that—</text><clause id="id134260dda3674f04aa69299ea872d7db"><enum>(i)</enum><text>is conveyed for the purpose of supporting local, regional, or State groundwater management that reduces groundwater consumption while providing community and environmental benefits;</text></clause><clause id="idf79938eb9aa0455a9df161ce6a83ab67"><enum>(ii)</enum><text>includes restrictions on the consumption of groundwater related to the historical withdrawals of the groundwater of the landowner associated with the entirety of the eligible land associated with the eligible water rights; and</text></clause><clause id="idd81f51a0dea94edc86487571a3804a7f"><enum>(iii)</enum><text>expressly permits the landowner the right to continue agricultural production and other uses compatible with reduced groundwater consumption, consistent with the legally permissible use and administration of the water rights by the applicable State.</text></clause></subparagraph><subparagraph id="iddad2b0faa24e4d7b97841c4ab89b02e8" commented="no"><enum>(B)</enum><header>Eligible land</header><text>An easement or other interest described in subparagraph (A) may include eligible land associated with the eligible water rights described in that subparagraph, subject to the choice of the owner of the eligible land, consistent with applicable State law.</text></subparagraph></paragraph></subsection><subsection id="idf781131be6974e11be2939554d4b817b"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a groundwater conservation easement program for the conservation of groundwater resources associated with eligible water rights, which may include eligible land associated with those eligible water rights, through groundwater conservation easements.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb3c0b6fe531548baa94c46cad4a0affa"><enum>(c)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the groundwater conservation easement program are—</text><paragraph id="id50c1934de20b4c769123bf6f8e868822"><enum>(1)</enum><text>to promote the conservation and reduction in consumption of groundwater resources, including the recharging of declining aquifers, while allowing for continued agricultural production and other uses;</text></paragraph><paragraph id="id312f89ec490c4071b6d47cb69a21e187"><enum>(2)</enum><text>to support landowners in the adaptation to, and reduction in reliance on, declining groundwater resources; and</text></paragraph><paragraph id="id9520063b791c413db062cd3d3f33a102"><enum>(3)</enum><text>to protect agricultural use, community vitality, and economic well-being, including through the development of renewable energy, in the face of long-term declines in groundwater availability.</text></paragraph></subsection><subsection id="id47bb5e6a66884b8f8d446e009ac3a3b7"><enum>(d)</enum><header>Availability of assistance</header><text display-inline="yes-display-inline">The Secretary shall facilitate and provide funding for—</text><paragraph id="id0cf537e39cde413b9033764412e33a93"><enum>(1)</enum><text>the purchase by eligible entities of groundwater conservation easements; and</text></paragraph><paragraph id="id80f406be440b4df7954c5b4d9c8cebc3"><enum>(2)</enum><text>technical assistance to implement the groundwater conservation easement program.</text></paragraph></subsection><subsection id="id8c1e8ef292e94e08b75e1607ec5cd590"><enum>(e)</enum><header>Cost-Share assistance</header><paragraph id="idab9e6e79b3fa496d878e107df6c9525a"><enum>(1)</enum><header>In general</header><text>The Secretary shall encourage conservation of groundwater resources through cost-share assistance to eligible entities for purchasing groundwater conservation easements.</text></paragraph><paragraph id="idb2f08dc31d8c4c059b63161e90efd14b"><enum>(2)</enum><header>Scope of assistance available</header><subparagraph id="id38963f49877e43659752f11faa8b93e5"><enum>(A)</enum><header>In general</header><text>An agreement described in paragraph (4) shall provide for—</text><clause commented="no" display-inline="no-display-inline" id="idb0a57803f5034be6adf5f229192f3900"><enum>(i)</enum><text display-inline="yes-display-inline">subject to subparagraph (D), a Federal share determined by the Secretary of an amount not to exceed 65 percent of the fair market value of the groundwater conservation easement, as determined under subparagraph (B); and </text></clause><clause commented="no" display-inline="no-display-inline" id="id969bd4f8edab4c6aac0d3481e4b56886"><enum>(ii)</enum><text display-inline="yes-display-inline">an additional payment in an amount not to exceed 5 percent of the Federal share determined under clause (i) for costs associated with securing a deed to the groundwater conservation easement, including the costs of valuation, survey, inspection, and title. </text></clause></subparagraph><subparagraph id="id5a71c2f16ec04207b7d7fcc561cdbb88"><enum>(B)</enum><header>Fair market value</header><text>The fair market value of a groundwater conservation easement shall be determined by the Secretary using—</text><clause id="ida8ce992eac6a49709f17391b731fd282"><enum>(i)</enum><text>the Uniform Standards of Professional Appraisal Practice;</text></clause><clause id="idf11de2e1457745219bbd2b8b7c107f4a"><enum>(ii)</enum><text>an areawide market analysis or survey;</text></clause><clause id="id7e53085ffe3544e6b23a7dd24be9da4f"><enum>(iii)</enum><text>another industry-approved method; </text></clause><clause id="id5ad7d54af2f7408d9655a995ffb442b1"><enum>(iv)</enum><text>a methodology used by another Federal agency;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1565f287eee54037809860c279c91f67"><enum>(v)</enum><text display-inline="yes-display-inline">a model for valuation developed by a research institution; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id35b54945c509466386501339fa5713ae"><enum>(vi)</enum><text display-inline="yes-display-inline">a method of valuing ecosystem services associated with protected water rights.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb171c3cce9ed4cda926beef34b9e7b6e"><enum>(C)</enum><header>Reimbursable costs</header><clause commented="no" display-inline="no-display-inline" id="idf3a8c23cb1bb4d9fb47b8df633bdb28d"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the Secretary shall provide a payment under subparagraph (A)(ii) to an eligible entity as a reimbursement after the costs described in that subparagraph are incurred by the eligible entity.</text></clause><clause commented="no" display-inline="no-display-inline" id="id90208a9880f5421f97591355a3083288"><enum>(ii)</enum><header>Limited resource landowners</header><text display-inline="yes-display-inline">In the case of eligible water rights or eligible land owned by a limited-resource landowner, as determined by the Secretary, the Secretary shall provide a payment under subparagraph (A)(ii) in advance as part of an agreement described in paragraph (4). </text></clause></subparagraph><subparagraph id="id5c1d881aa325408e8185c8c92c02d63c"><enum>(D)</enum><header>Lower Federal share option</header><clause commented="no" display-inline="no-display-inline" id="ida43d8733f903497f87f87e6a59352a54"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity may elect to enter into an agreement described in paragraph (4) under which the Federal share does not exceed 25 percent of the fair market value of the groundwater conservation easement, as determined under subparagraph (B). </text></clause><clause commented="no" display-inline="no-display-inline" id="id5657fceebab14307b5ef97cdb1a6d403"><enum>(ii)</enum><header>No right of enforcement</header><text display-inline="yes-display-inline">Notwithstanding paragraph (4)(C)(iii), an agreement with respect to which an eligible entity makes the election under clause (i) shall not include a right of enforcement for the Secretary.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEBC57D1847C94EFF9E9D26B0AD4721D3"><enum>(E)</enum><header display-inline="yes-display-inline">Permissible forms</header><text display-inline="yes-display-inline">The non-Federal share provided by an eligible entity under this paragraph may comprise—</text><clause commented="no" display-inline="no-display-inline" id="HD93E0B589F964EC3B55A8393144F7A01"><enum>(i)</enum><text>cash resources;</text></clause><clause commented="no" display-inline="no-display-inline" id="H8DDB326D447F447BBFFA27D8DA5C32DC"><enum>(ii)</enum><text>a charitable donation or qualified conservation contribution (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)</external-xref> of the Internal Revenue Code of 1986) from the landowner from which the groundwater conservation easement will be purchased;</text></clause><clause commented="no" display-inline="no-display-inline" id="HDB0C8B3FC4CB42138470D11E99A73723"><enum>(iii)</enum><text>costs associated with securing a deed to the groundwater conservation easement, including the cost of appraisal, survey, inspection, and title; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H57C50E1B8A714467A47CA7D4614BCA03"><enum>(iv)</enum><text>other costs, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id3d7198d56aaf465ea19ae1e76db8a075"><enum>(3)</enum><header>Evaluation and ranking of applications</header><subparagraph id="id2dcc58c92d9f4c1f9a28e63a5bebed52"><enum>(A)</enum><header>Criteria</header><text>The Secretary shall establish evaluation and ranking criteria to maximize the benefit of Federal investment under the groundwater conservation easement program.</text></subparagraph><subparagraph id="id9f8cacc1bfad4a0281c6f5eca0b55500"><enum>(B)</enum><header>Considerations</header><text>In establishing the criteria under subparagraph (A), the Secretary shall emphasize support for—</text><clause id="ida6b2c0b65a0f4c9e9f39df283708c4d9"><enum>(i)</enum><text>maintaining or enhancing groundwater-dependent ecosystems; and</text></clause><clause id="id88e6a61e668a47eeaa485086466adc22"><enum>(ii)</enum><text>advancing long-term groundwater sustainability consistent with existing State or local groundwater management initiatives.</text></clause></subparagraph><subparagraph id="id2924f2abbe4341a2bed8e50d603b1358"><enum>(C)</enum><header>Bidding down</header><text>If the Secretary determines that 2 or more applications for cost-share assistance under this subsection are comparable in achieving the purpose of the groundwater conservation easement program, the Secretary shall not assign a higher priority to any of those applications solely on the basis of lesser cost to the groundwater conservation easement program.</text></subparagraph></paragraph><paragraph id="id637064a9e889419191bafa6e7d73efbe"><enum>(4)</enum><header>Agreements with eligible entities</header><subparagraph id="id75e09e0fc99d4cf2a3ec3bc8bf8c6d64"><enum>(A)</enum><header>In general</header><text>The Secretary shall enter into agreements with eligible entities to stipulate the terms and conditions under which the eligible entity is permitted to use cost-share assistance provided under this subsection.</text></subparagraph><subparagraph id="id91f69613dbd444129cf97543a8fe9e27"><enum>(B)</enum><header>Length of agreements</header><text>An agreement under this paragraph shall be for a term that is—</text><clause id="id15eb5451cf814d59b86ac29658d83a3f"><enum>(i)</enum><text>in the case of an eligible entity certified under the process described in paragraph (5), a minimum of 5 years; and</text></clause><clause id="idb2b2e4f038e14e9f8ccd6470b3b372de"><enum>(ii)</enum><text>for all other eligible entities, not less than 3, but not more than 5, years.</text></clause></subparagraph><subparagraph id="id2b0d014d9cab4fe68e57cc1f80d6291f"><enum>(C)</enum><header>Minimum terms and conditions</header><text>An eligible entity shall be authorized to use such terms and conditions for groundwater conservation easements as the eligible entity may establish, subject to the condition that the Secretary shall determine that those terms and conditions—</text><clause id="id36263e5e016240578fc103a943d428f1"><enum>(i)</enum><text>are consistent with the purposes of the groundwater conservation easement program;</text></clause><clause id="id5034c9f3dc2a4e30a41f162673f3414f"><enum>(ii)</enum><text>permit effective enforcement of the conservation purposes of the groundwater conservation easements, including—</text><subclause commented="no" display-inline="no-display-inline" id="id0f1964739abe48b2b4a8da4c0f050c8d"><enum>(I)</enum><text display-inline="yes-display-inline">a mechanism for the measurement of groundwater pumping reductions; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfed956e1b34f4198a8ce2d9ca1d25469"><enum>(II)</enum><text display-inline="yes-display-inline">the ability to enforce those reductions under relevant State law;</text></subclause></clause><clause id="id118eaab4dfae4ad3831136f809413936"><enum>(iii)</enum><text>except as provided in paragraph (2)(D)(ii), include a right of enforcement for the Secretary, which may be used only if the terms of the groundwater conservation easement are not enforced by the holder of the groundwater conservation easement; and</text></clause><clause id="id7b97394ab83a403cb21ea14f97c2dd00"><enum>(iv)</enum><text>subject the eligible water rights and eligible land, if applicable, in which an interest is purchased to a groundwater conservation easement plan that includes—</text><subclause id="id78f14b3a1aef412ca3661bebcaa92d53"><enum>(I)</enum><text>a description of the activities that demonstrate protection of soil resources and reduced groundwater use and meet any other conservation purposes for which the groundwater conservation easement was acquired;</text></subclause><subclause id="id7ef0c4eb4ce240ef9e1465f98b906fa2"><enum>(II)</enum><text>a groundwater conservation plan, where appropriate, that includes, at the option of the Secretary, activities that will help maintain or enhance groundwater-dependent ecosystems; and</text></subclause><subclause id="id7dd3d568b9db4d9184e598f00201e5cc"><enum>(III)</enum><text>any other provisions that the Secretary determines to be necessary to accomplish the purposes of the groundwater conservation easement program.</text></subclause></clause></subparagraph><subparagraph id="id41f9c4f44f12414cb23878cea7bf42e1"><enum>(D)</enum><header>Substitution of qualified projects</header><text>An agreement under this paragraph shall allow, on mutual agreement of the parties, substitution of qualified projects that are identified at the time of the proposed substitution.</text></subparagraph><subparagraph id="iddca34b2823ee45429253e658dbd0c8bb"><enum>(E)</enum><header>Effect of violation</header><text>If a violation of a term or condition of an agreement under this paragraph occurs, the Secretary may—</text><clause id="ida9446f484ad9420f873ba25ae49eceba"><enum>(i)</enum><text>terminate the agreement; and</text></clause><clause id="idf2b8919ea2264df8bf8cf151f915e713"><enum>(ii)</enum><text>require the eligible entity to refund all, or part of, any payments received by the eligible entity under the groundwater conservation easement program, with interest on the payments, as determined appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="idb4b40cd85d1b4c5a8ba090ba2dcd104b"><enum>(5)</enum><header>Certification of eligible entities</header><subparagraph id="id02ed9a3b314c4d39b6a165a96953c161"><enum>(A)</enum><header>Certification process</header><text>The Secretary shall establish a process under which the Secretary may—</text><clause id="id39812ff59963470c87d0be9f5c4721af"><enum>(i)</enum><text>directly certify eligible entities that meet established criteria;</text></clause><clause id="id6a6ae087da9147d8a846373fab2855be"><enum>(ii)</enum><text>enter into long-term agreements with certified eligible entities; and</text></clause><clause id="id77dd6204a04d4b34a8a3f82820c72375"><enum>(iii)</enum><text>accept proposals for cost-share assistance for the purchase of groundwater conservation easements throughout the duration of those agreements.</text></clause></subparagraph><subparagraph id="id3df090a1d6824bd7961bf599e2af868c"><enum>(B)</enum><header>Certification criteria</header><text>To be certified under subparagraph (A), an eligible entity shall demonstrate to the Secretary that the eligible entity will maintain, at a minimum, for the duration of the agreement—</text><clause id="idacebbad85c14416193890123def971cf"><enum>(i)</enum><text>a plan for administering groundwater conservation easements that is consistent with the purposes of the groundwater conservation easement program;</text></clause><clause id="id92116c6183674ae4a3dd35d3318b6f55"><enum>(ii)</enum><text>the capacity and resources to monitor and enforce groundwater conservation easements; and</text></clause><clause id="id8bdaee827096422d8d7e6060dc4ae6fd"><enum>(iii)</enum><text>policies and procedures to ensure—</text><subclause id="id2d0eda3658b54b4a92ca467831540805"><enum>(I)</enum><text>the long-term integrity of groundwater conservation easements;</text></subclause><subclause id="id69940e0786a04914a3eed926cdec2da9"><enum>(II)</enum><text>timely completion of acquisitions of groundwater conservation easements; and</text></subclause><subclause id="id1c3cfa0cda1d4ce881070befc821473c"><enum>(III)</enum><text>timely and complete evaluation and reporting to the Secretary with respect to the use of funds provided under the groundwater conservation easement program.</text></subclause></clause></subparagraph><subparagraph id="id5206dd9f3d944839a5e66a176b76b584"><enum>(C)</enum><header>Review and revision</header><clause id="id9ea8e6ada46f47438d0257e301806dbc"><enum>(i)</enum><header>Review</header><text>The Secretary shall conduct a review of eligible entities certified under subparagraph (A) not less frequently than once every 3 years to ensure that the eligible entities are meeting the criteria established under subparagraph (B).</text></clause><clause id="id17dabb693aad4e5aa2fe74224391d82d"><enum>(ii)</enum><header>Revocation</header><text>If the Secretary finds that a certified eligible entity no longer meets the criteria established under subparagraph (B), the Secretary may—</text><subclause id="id24cd01d18c5249528e3d8ba4828396d2"><enum>(I)</enum><text>allow the certified eligible entity a specified period of time, but not less than 180 days, during which to take such actions as may be necessary to meet the criteria; and</text></subclause><subclause id="id1dc3217bc3aa461f815845c8e962c453"><enum>(II)</enum><text>revoke the certification of the eligible entity, if, after that specified period of time, the certified eligible entity does not meet the criteria.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id9459c7c1c1174bfcbe518c241e1fd8c9"><enum>(f)</enum><header>Geographic scope</header><text display-inline="yes-display-inline">The Secretary may only enroll eligible water rights or eligible land under this section in regions—</text><paragraph commented="no" display-inline="no-display-inline" id="id182b5805d055417d984c842899aa103a"><enum>(1)</enum><text display-inline="yes-display-inline">experiencing significant groundwater depletion, as determined by the Secretary consistent with data of the United States Geological Survey; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id903ae398cb9c48e4bcf235d87cbdc7c9"><enum>(2)</enum><text display-inline="yes-display-inline">where groundwater monitoring and permitting exists through the State, a local government, or a groundwater management district. </text></paragraph></subsection><subsection id="id0d2d51ce4d334f22b39e388f71ae9e87"><enum>(g)</enum><header>Method of enrollment</header><text>The Secretary shall enroll eligible water rights and eligible land under this section through the use of—</text><paragraph id="id7da2ab26b210407caf66aa44ba9bd48d"><enum>(1)</enum><text>permanent easements; or</text></paragraph><paragraph id="idc6875ec2c31e49adb44516441123ab00"><enum>(2)</enum><text>easements for the maximum duration allowed under applicable State laws.</text></paragraph></subsection><subsection id="id8fb199005b5f4e9497d9b80e59c2bb05"><enum>(h)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance, if requested, to assist in—</text><paragraph id="idbc463cc076754ed7bdb3f7dc0677f3d5"><enum>(1)</enum><text>compliance with the terms and conditions of groundwater conservation easements; and</text></paragraph><paragraph id="idd06e68c30f6f4773bb0b4ba6d35fb686"><enum>(2)</enum><text>implementation of an approved groundwater conservation easement plan described in subsection (e)(4)(C)(iv).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id52b6954c45d5428883be1f75f707abf0"><enum>3.</enum><header>Adjusted gross income limitation</header><text display-inline="no-display-inline">Section 1001D of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-3a">7 U.S.C. 1308–3a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf9ddfc2e9d4e412380b00f7e3a812ef0"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd50afc953a5e4ff98f09761f48538a1a"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>In this</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35D29995FEC84EA0819FE1FAC125AE1D"><subparagraph commented="no" display-inline="no-display-inline" id="id3aec7af10f9942f6a2fc3454a70052ed"><enum>(A)</enum><header>In general</header><text>In this</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7799f6fd925b49a38dc94da5b39d8cce"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1bea800a46be42eeaf6d1bc984d0f714"><subparagraph id="id56b176e67cfc40a5bc0193124d4bbd6d"><enum>(B)</enum><header>Exclusion</header><text>In this section, the term <term>average adjusted gross income</term> does not include any income received by a person or legal entity that is a landowner of eligible land (as defined in section 1265A) as compensation for the purchase of an agricultural land easement under subtitle H.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0113a601fc3742ffb2430857644ebc2c"><enum>(2)</enum><text>in subsection (b)(3), by inserting <quote>, or aquifer recovery or a permanent reduction in consumptive use of water would be achieved,</quote> after <quote>protected</quote>.</text></paragraph></section></legis-body></bill>
