which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose sanctions with respect to associates of the International Criminal Court engaged in investigations of personnel of the United States and its allies.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Illegitimate Court Counteraction Act of 2023</short-title></quote>.</text></section><section id="id6B5468C2929242EA89659E1C0A573ECB"><enum>2.</enum><header>Sanctions with respect to the International Criminal Court</header><subsection id="id20C15F82462D4EC58BA3A11E6445F9F7"><enum>(a)</enum><header>In general</header><text>If the International Criminal Court is conducting an active investigation of, is engaged in a preliminary examination of, or is pursuing charges against a protected person, the President shall impose—</text><paragraph id="id1E357527A8F642B8B212FD814304C394"><enum>(1)</enum><text>the sanctions described in subsection (b) with respect to a covered International Criminal Court employee or associate; and</text></paragraph><paragraph id="idBBB009EDE7674D0FA1497C1D6573F328" commented="no"><enum>(2)</enum><text>the sanctions described in subsection (b)(2) with respect to any foreign person who is—</text><subparagraph commented="no" id="idF55F8569F35545AA969D2BFC3299337A"><enum>(A)</enum><text>an employee of the International Criminal Court;</text></subparagraph><subparagraph commented="no" id="id03E14482BA6A44D0AD57C009825FF0B5"><enum>(B)</enum><text>determined to be acting as an agent of the International Criminal Court or an employee of the International Criminal Court; or</text></subparagraph><subparagraph commented="no" id="id6BE65353D53E4DFD8A0FE2B15DE9C102"><enum>(C)</enum><text>an immediate family member of a covered International Criminal Court employee or associate.</text></subparagraph></paragraph></subsection><subsection id="id4CC1BD1DCAAB4A48A493E9732F5C03FD"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection that shall be imposed with respect to a covered International Criminal Court employee or associate are the following:</text><paragraph id="idC62F69F30C20472BA5B0187F8D650D20"><enum>(1)</enum><header>Property blocking</header><text>The President shall exercise all of the powers granted by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of the covered International Criminal Court employee or associate if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person. </text></paragraph><paragraph id="idc31c6d9fff5b471f80b45ce1d8f3068d"><enum>(2)</enum><header>Aliens inadmissible for visas, admission, or parole</header><subparagraph id="idd159f3eeb37445549af6b18018918cb9"><enum>(A)</enum><header>Visas, admission, or parole</header><text>In the case of an alien, the alien is—</text><clause id="id84cbd4a67515445b867e215d1b584e96"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="id6b918aebaa474d8686aeacab9f0dd871"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id36d2441108574d469b167c8c8c1a1216"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="idc706738d3efb4430be83867af80128a9"><enum>(B)</enum><header>Current visas revoked</header><clause id="id6ac015d60131493ab54e3a48bd05b51e"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subparagraph (A) shall be revoked, regardless of when such visa or other entry documentation was issued.</text></clause><clause id="id8b8e4360d5d94946ac8beffa9da0c80e"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="id55b06414dae34a56b7c17d831e20cbfb"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="idc72e40c692844155841f071c4ee2c35d"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien’s possession. </text></subclause></clause></subparagraph></paragraph></subsection><subsection id="ida0383062d8c341f1909b915013cce2b6"><enum>(c)</enum><header>Implementation; penalties</header><paragraph id="id6754d07a604b4145a0ea3a90d2f6fb12"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></paragraph><paragraph id="idce8155290acf4440b2cc48867612edf8"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph></subsection><subsection id="ide18d21f3bf304e2a944ae25ec92e2766"><enum>(d)</enum><header>Exceptions</header><paragraph id="ida7885eadf8a5439fac003e05ee367827"><enum>(1)</enum><header>Exception relating to importation of goods</header><subparagraph id="idd4804afa0e044028a6054b49549666d5"><enum>(A)</enum><header>In general</header><text>A requirement to block and prohibit all transactions in all property and interests in property under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id0ccbfa2402c749ceb741ba951e8c08b7"><enum>(B)</enum><header>Good</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subparagraph></paragraph><paragraph id="idcaad27a7e42d43459772fdcd14bc8866"><enum>(2)</enum><header>Exception to comply with United Nations headquarters agreement and law enforcement objectives</header><text>Sanctions under subsection (b)(2) shall not apply with respect to an alien if admitting or paroling the alien into the United States—</text><subparagraph id="id933f17e8975849ae9c06502312407322"><enum>(A)</enum><text>would further important United States law enforcement objectives; or</text></subparagraph><subparagraph id="id11795e6819b34975966c0aec0d3e11ec"><enum>(B)</enum><text>is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States. </text></subparagraph></paragraph></subsection></section><section id="id70ACF2E514074BFA8230E597E871BE82"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4AA4055E42D8461392557F3169299162"><enum>(1)</enum><header>Admitted alien</header><text>The terms <term>admitted</term> and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>). </text></paragraph><paragraph id="id09C691697F014E4A98E0C010384D72F2"><enum>(2)</enum><header>Covered International Criminal Court employee or associate</header><text>The term <term>covered International Criminal Court employee or associate</term> means a foreign person that—</text><subparagraph id="id3A442C191FF14F1FBFC8DA465133BCA0"><enum>(A)</enum><text>has directly or indirectly engaged in or otherwise aided any effort or action by the International Criminal Court to investigate, arrest, detain, or prosecute a protected person;</text></subparagraph><subparagraph id="id4D6879F75D4C412E853CB76A24FCBCE3" commented="no"><enum>(B)</enum><text>has materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of such efforts by the International Criminal Court described in subparagraph (A); or</text></subparagraph><subparagraph id="idA008E25B6D214621A482C7009CF91BBB" commented="no"><enum>(C)</enum><text>is owned or controlled by, or has acted or purports to have acted, directly or indirectly, for or on behalf of any person that engages in such efforts by the International Criminal Court described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="id7f7c229d53c84078b876c8b55efef4a4"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text></paragraph><paragraph id="idF5D6AA068230431CBAEE2D81703A2D91"><enum>(4)</enum><header>Immediate family member</header><text>The term <term>immediate family member</term>, with respect to a foreign person, means the spouse, parent, sibling, or adult child of the person.</text></paragraph><paragraph id="id90624258EDA44281BA9323CA184C8F05"><enum>(5)</enum><header>Protected person</header><text>The term <term>protected person</term> means— </text><subparagraph id="idAF30359E3ED94F5E810F2816DA5B6188"><enum>(A)</enum><text>a member of the Armed Forces of the United States;</text></subparagraph><subparagraph id="id71B40FBEB4584BFBAAECC9610A8D89E4"><enum>(B)</enum><text>a former member of the Armed Forces of the United States who is being investigated by the International Criminal Court for alleged actions that occurred while the individual was a member of the Armed Forces;</text></subparagraph><subparagraph id="idCC8E31C2B68F4B6B905C6524ED44A256"><enum>(C)</enum><text>an employee or contractor of the United States Government who—</text><clause id="id29c969ab01ff4e3884d4a98d484123d3"><enum>(i)</enum><text>assists the Armed Forces of the United States; or</text></clause><clause id="idD1219C23C6724F3BA3E9944E4CB1401B"><enum>(ii)</enum><text>has any role in creating or implementing policies of the Armed Forces;</text></clause></subparagraph><subparagraph id="idE0F1F983BFB142B791EEA4665F784F48"><enum>(D)</enum><text>a former employee or contractor of the United States Government who—</text><clause id="id286AC80B86224A138E73E744943C666A"><enum>(i)</enum><text>as an employee or contractor, assisted the Armed Forces or had any role in creating or implementing policies of the Armed Forces; and</text></clause><clause id="id8936473C34074A55BE320A65499BAB31"><enum>(ii)</enum><text>is being investigated by the International Criminal Court for alleged actions that occurred while the individual was an employee or contractor of the United States Government;</text></clause></subparagraph><subparagraph id="id371DF8F07CAA49338DEE93A968C049CD"><enum>(E)</enum><text>a member of the armed forces of a country that—</text><clause id="idC18A1D4EA62549F9A416D20FE265CFF8"><enum>(i)</enum><text>is a treaty ally or partner of the United States; </text></clause><clause id="id6F59753671994FDBA7E3563A7515949D"><enum>(ii)</enum><text>is not a state party to the Rome Statute of the International Criminal Court; and</text></clause><clause id="id43357E7E54E74A019C03B9281DAC7774"><enum>(iii)</enum><text>has not consented to the involvement of the International Criminal Court in the relevant investigation; or</text></clause></subparagraph><subparagraph id="id1413CCBAA4084D069FE9F95054897E4E"><enum>(F)</enum><text>an individual who—</text><clause id="idE5293118464A4309B3B53FD46F543102"><enum>(i)</enum><text>is a former member of the armed forces of a country that—</text><subclause id="id87B489688A254E239A4267819EF0915C"><enum>(I)</enum><text>is a treaty ally or partner of the United States; </text></subclause><subclause id="id6F55400FF7824DFF8AD5DFF22AE7F01E" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>is not a state party to the Rome Statute of the International Criminal Court; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idAEF47ED055C94CBA910FAB901944B1D8"><enum>(III)</enum><text>has not consented to the involvement of the International Criminal Court in the relevant investigation; and</text></subclause></clause><clause id="idD73388E792154C6C9B3B132EF7A5C0E2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>is being investigated by the International Criminal Court for alleged actions that occurred while the individual was a member of the armed forces of such country. </text></clause></subparagraph></paragraph><paragraph id="idbd5cac5b7d4241d7bd393057fd3b3b4b"><enum>(6)</enum><header>Treaty ally or partner of the United States</header><text>The term <term>treaty ally or partner of the United States</term> means any of the following:</text><subparagraph id="idB05F027CB18A4B1C869BAD8EC1D24EB6"><enum>(A)</enum><text>A foreign country that is a party to any of the following:</text><clause id="idB235D631EA8548388B6F615D0BA664D3"><enum>(i)</enum><text>The North Atlantic Treaty, signed at Washington, April 4, 1949.</text></clause><clause id="idC8E1A081C9B946A6A8CE3C087FB62038"><enum>(ii)</enum><text>The Security Treaty Between Australia, New Zealand, and the United States of America, signed at San Francisco, September 1, 1951. </text></clause><clause id="id5FA288FD4921409DB3DF7924FA3F8084"><enum>(iii)</enum><text>The Mutual Defense Treaty Between the United States of America and the Republic of the Philippines, signed at Washington, August 30, 1951.</text></clause><clause id="id85FB5C869EE84CBDB1780874823DB03A"><enum>(iv)</enum><text>The Treaty of Mutual Cooperation and Security Between the United States of America and Japan, signed at Washington, January 19, 1960.</text></clause><clause id="idF92C583C8292473CBE9BF8966E6C822B" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>The Mutual Defense Treaty Between the United States of America and the Republic of Korea, signed at Washington, October 1, 1953. </text></clause></subparagraph><subparagraph id="idA65C0D7FD31F4238B8C0C473CE96B7E5"><enum>(B)</enum><text>Israel.</text></subparagraph><subparagraph id="id088115AF63BF41BAA23571CEA5B51169"><enum>(C)</enum><text>Taiwan.</text></subparagraph><subparagraph id="id0A5EE5795C3045048DCE9F2D15911FD6"><enum>(D)</enum><text>Sweden.</text></subparagraph><subparagraph id="idFA61C2B681654D08A7912D8EE360F3E7"><enum>(E)</enum><text>Finland.</text></subparagraph></paragraph><paragraph id="id80F43EE1B0D54CD9850ACD8EA828DBF5"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idfdc40dc2991d43789768a803e55dbd22"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="id86c662e1e6d24af5a5e44785f330feec"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="id49f82190a40a4734b2b573a4ccd2c8f1"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></section></legis-body></bill>
