which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to require the Administrator of the Environmental Protection Agency to make available for sale renewable fuel credits, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Domestic Energy Production and Independence Act of 2023</short-title></quote>.</text></section><section id="id00AD089F1B754C2F85EFA62A23D1720C"><enum>2.</enum><header>Renewable fuel cost containment credits</header><subsection id="idA5757EAFD35C41F394583006F2F1BB77"><enum/><text>Section 211(o)(7) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(7)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC87B96B5825430FB41FF2B7A16C7A53"><subparagraph id="id581AE05213AC4819BA21744329DD3B4A"><enum>(G)</enum><header>Conventional biofuel</header><clause id="idE1E1B4FA18B1425C92A66751F17A4417"><enum>(i)</enum><header>Conventional biofuel waiver credits</header><subclause id="idBDFF74F0136A4A8B983920D68ED5200A"><enum>(I)</enum><header>In general</header><text>The Administrator shall make available for sale renewable fuel credits to any person with a renewable volume obligation under paragraph (2) at a price of not more than $0.20 per credit.</text></subclause><subclause id="idA9F591AC909744A182CB3D85A3B5BA45"><enum>(II)</enum><header>Adjustments for inflation</header><text>As determined appropriate by the Administrator, the price referred to in subclause (I) shall be adjusted for inflation.</text></subclause></clause><clause id="id0FCC77D6C1AB46D5998018FB32DD60DA"><enum>(ii)</enum><header>Use of credits</header><text>A renewable fuel credit sold under this paragraph—</text><subclause id="id4E0D7C5CD8B74EDF89104675CFFB1C14"><enum>(I)</enum><text>shall only be used for the purpose of complying with the requirement under paragraph (2) for the year for which the credit was sold; and</text></subclause><subclause id="id2B8EDEB1E12645ABA93CFA8DD46315F7"><enum>(II)</enum><text>may not—</text><item id="idE1F0DB90092E40A9A080A52C46D5BF5F"><enum>(aa)</enum><text>be resold or transferred to another person; or</text></item><item id="id87622AB0C4F344B29E123D97108FEA70"><enum>(bb)</enum><text>be used to fulfill the cellulosic biofuel, biomass-based diesel, or advanced biofuel requirements under paragraph (2).</text></item></subclause></clause><clause id="id537107FD300A46E7887D187204C52292"><enum>(iii)</enum><header>Use of revenues</header><text>Revenues from the sale of renewable fuel credits under this subparagraph shall be allocated in accordance with the following:</text><subclause id="id831B720036C2409BB4A934C2D68A2179"><enum>(I)</enum><text><fraction>1/3</fraction> shall be made available to the Administrator to provide grants and technical assistance to any person with a renewable volume obligation under paragraph (2) and partners of those persons for purposes of supporting investments in advanced biofuels.</text></subclause><subclause id="id1E8201BBC30148D58565356658EA5D77"><enum>(II)</enum><text><fraction>1/3</fraction> shall be made available to the Secretary of Agriculture to provide financial and technical assistance to agricultural producers for voluntary investments in alternative crops and diversified cropping systems. </text></subclause><subclause id="id969FC3E074694A6584C7C002822BFEF4"><enum>(III)</enum><text><fraction>1/3</fraction> shall be deposited into the Habitat and Wildlife Restoration Fund established by clause (iv)(I).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idfc5c2bd21d4c4bdaa99e1afa4d437597"><enum>(iv)</enum><header>Habitat and Wildlife Restoration Fund</header><subclause commented="no" display-inline="no-display-inline" id="iddf36c92efece4609833e417526c20cd3"><enum>(I)</enum><header>Establishment</header><text>There is established in the Treasury a fund, to be known as the <quote>Habitat and Wildlife Restoration Fund</quote> (referred to in this subparagraph as the <term>Fund</term>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide1d3d71dbfcf456492e3ab78165d5e71"><enum>(II)</enum><header>Amounts</header><text>The Fund shall consist of—</text><item commented="no" display-inline="no-display-inline" id="id4e426a1a8fcc48b2941978b7c215e7ab"><enum>(aa)</enum><text>amounts deposited in the Fund under clause (iii)(III); and</text></item><item commented="no" display-inline="no-display-inline" id="idb782d70a77e34c04ac9e799c0b004438"><enum>(bb)</enum><text>any amounts appropriated to the Fund.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id9887f65de8cc429e9510d6135e3f91f3"><enum>(III)</enum><header>Uses</header><item commented="no" display-inline="no-display-inline" id="id104ffa7f0c9c432f93e4aa2d462f230b"><enum>(aa)</enum><header>In general</header><text>Amounts in the Fund shall be available, without further appropriation, to the Secretary of the Interior, acting in consultation with the Secretary of Agriculture, for existing programs, the purposes of which are to protect, conserve, or restore the types of habitat and wildlife that are most impacted by the conversion of native habitat to crop production, including grasslands, wetlands, forests, and adjacent waterways in areas that have experienced significant expansion of corn and soy production since January 1, 2007.</text></item><item commented="no" display-inline="no-display-inline" id="id82087ae90c5e4a2a936aebf184cdc478"><enum>(bb)</enum><header display-inline="yes-display-inline">Agreement</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall jointly enter into an agreement with the National Fish and Wildlife Foundation to cooperatively manage amounts in the Fund in accordance with the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701 et seq.</external-xref>).</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
