which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide special authority for the provision of commercial space launch support services.</official-title></form><legis-body><section id="id0407d860757149cfaa710fc5d211d19c" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Spaceport Operations Act</short-title></quote>.</text></section><section id="id1d730f9589e642dc937a7d2d06ebb929"><enum>2.</enum><header>Special authority for provision of commercial space launch support services</header><subsection commented="no" display-inline="no-display-inline" id="id3c682a78455d4bfeb18c7799e57486aa"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/135">Chapter 135</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2276">section 2276</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idb3f238b5634246c88f5b296115dcbd4b"><section id="idc1f2ce2d767c4166b333844faea2c8c9"><enum>2276a.<?LEXA-Enum 2276a.?></enum><header>Special authority for provision of commercial space launch support services</header><subsection id="id31a2efbf608f48f9a1b18b908bf59eaa"><enum>(a)</enum><header>In general</header><text>The Secretary of a military department, pursuant to the authority provided by this section and any other provision of law, may support Federal and commercial space launch capacity on any domestic real property under the control of the Secretary through the provision of space launch support services.</text></subsection><subsection id="idd388e17d4bc04541af894ea0a90b3fef"><enum>(b)</enum><header>Provision of launch equipment and services to commercial entities</header><paragraph id="ida0d1615ecb6344dda0a69a3729dd423a"><enum>(1)</enum><header>Agreement authority</header><subparagraph commented="no" display-inline="no-display-inline" id="ida8f7808621294f02bc6d6988111943bd"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned may enter into a contract, or conduct any other transaction, with a commercial entity that intends to conduct space launch activities on a military installation under the jurisdiction of the Secretary, including a contract or other transaction for the provision of supplies, services, equipment, and construction needed for commercial space launch.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9de539871254074ba5dd92c25e9c6df"><enum>(B)</enum><header>Nondelegation</header><text>The Secretary may not delegate the authority provided in subparagraph (A). </text></subparagraph></paragraph><paragraph id="idf702f2fa6163475d8711f026357e7730"><enum>(2)</enum><header>Agreement costs</header><subparagraph id="id197e74144d17443e9820e90f39e459e5"><enum>(A)</enum><header>Direct costs</header><text>A contract entered into, or a transaction conducted, under paragraph (1) shall include a provision that requires the commercial entity entering into the contract or conducting the transaction to reimburse the Department of Defense for all direct costs to the United States that are associated with the goods, services, and equipment provided to the commercial entity under the contract or transaction.</text></subparagraph><subparagraph id="id77b0c478480747f5859abfe9f4347b06"><enum>(B)</enum><header>Indirect costs</header><text display-inline="yes-display-inline">A contract entered into, or a transaction conducted, under paragraph (1) may—</text><clause commented="no" display-inline="no-display-inline" id="id6c6e143873ef481d927a843ec4adbac0"><enum>(i)</enum><text display-inline="yes-display-inline">include a provision that requires the commercial entity to reimburse the Department of Defense for such indirect costs as the Secretary concerned considers to be fair and reasonable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7ed824c5a2b44779bd9e13dd6824c94a"><enum>(ii)</enum><text display-inline="yes-display-inline">provide for the recovery of indirect costs through establishment of a rate, fixed price, or similar mechanism the Secretary concerned considers to be fair and reasonable.</text></clause></subparagraph></paragraph><paragraph id="id25a448456669483e9d80e73614ba447c"><enum>(3)</enum><header>Retention of funds collected from commercial users</header><text>Amounts collected from a commercial entity under paragraph (2) shall be credited to the appropriation accounts under which the costs associated with the contract (direct and indirect) were incurred.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id764954fe2b2941518cb5ffd93706fe90"><enum>(4)</enum><header>Regulations</header><text>The Secretary shall promulgate regulations to carry out this subsection.</text></paragraph></subsection><subsection id="id95713052ad5d425aa401bad6a123d141"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id965a4949b96146f69f3cd0de9387fa30"><enum>(1)</enum><header>Space launch</header><text>The term <term>space launch</term> includes all activities, supplies, equipment, facilities, and services supporting launch preparation, launch, reentry, recovery, and other launch-related activities for the payload and the space transportation vehicle.</text></paragraph><paragraph id="id0a4cdb6e8cad46e8b342c5fba0f99201"><enum>(2)</enum><header>Commercial entity; commercial</header><text>The terms <term>commercial entity</term> and <term>commercial</term> means a non-Federal entity organized under the laws of the United States or of any jurisdiction within the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb672abded1e24e71b590e83054904ede"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/135">chapter 135</external-xref> of title 10, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/10/2276">section 2276</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3E695721C21C4FF3832C2F815047A7B4"><toc><toc-entry level="section" bold="off">2276a.
