<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 222</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230201">February 1, 2023</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the designation of certain airports as ports of entry.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Airport Fairness Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA2EC0704FC9F46F49644B40B3E9755E0"><enum>2.</enum><header>Designation of certain airports as ports of entry</header><subsection id="idE0A945AD92434CA5AEE16661A8C85788"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall—</text><paragraph id="id2AB9C8F51238483DA01429099CBEC49E"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to the Act of August 1, 1914 (38 Stat. 623, chapter 223; <external-xref legal-doc="usc" parsable-cite="usc/19/2">19 U.S.C. 2</external-xref>), designate each airport described in subsection (b) as a port of entry; and</text></paragraph><paragraph id="id1311ABEACD8F48E0BE838F7CA15F03FE"><enum>(2)</enum><text>terminate the application of the user fee requirement under section 236 of the Trade and Tariff Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/19/58b">19 U.S.C. 58b</external-xref>) with respect to the airport.</text></paragraph></subsection><subsection id="id2C67D65D681A470D961C5432EC1E2432"><enum>(b)</enum><header>Airports described</header><text>An airport described in this subsection is an airport that—</text><paragraph id="idDA30EAA168F448FABE4DD9E74FAEBD02"><enum>(1)</enum><text>is a primary airport (as defined in section 47102 of title 49, United States Code);</text></paragraph><paragraph id="id37CD46FCCBCF4D89AAFCA671CADD4358"><enum>(2)</enum><text>is located not more than 30 miles from the northern or southern international land border of the United States;</text></paragraph><paragraph id="id799464570bd34c79b932dce4ebd2389c"><enum>(3)</enum><text>is associated, through a formal, legal instrument, including a valid contract or governmental ordinance, with a land border crossing or a seaport not more than 30 miles from the airport; and</text></paragraph><paragraph id="idd503dfabf8714c7ba798cf59e4924f8a"><enum>(4)</enum><text>through such association, meets the numerical criteria considered by U.S. Customs and Border Protection for establishing a port of entry, as set forth in—</text><subparagraph id="id0BE3A070B42C46BAB1BFA831FB82E54E"><enum>(A)</enum><text>Treasury Decision 82–37 (47 Fed. Reg. 10137; relating to revision of customs criteria for establishing ports of entry and stations), as revised by Treasury Decisions 86–14 (51 Fed. Reg. 4559) and 87–65 (52 Fed. Reg. 16328); or </text></subparagraph><subparagraph id="id6A0BFC087EF24FA395C942C0FE3FFE28"><enum>(B)</enum><text>any successor guidance or regulation. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
