Country of origin labeling for cooked and canned salmon.</toc-entry></toc></subsection></section><section id="id95d1d95a388b41c9a74f62d9602156b5"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id88b99df70630473e869e676dfe113de6"><enum>(1)</enum><text>to support sustainable, domestically harvested United States seafood;</text></paragraph><paragraph id="idd231245ae9cf4b2ebf3822a323227946"><enum>(2)</enum><text>to support the consumption of domestically produced fish, including fish produced through wild capture, through the enhancement of seafood policies, such as marketing, promotion, rural business development, and commodity support;</text></paragraph><paragraph id="id30d24c39e30048f68858a1b35becd9ec"><enum>(3)</enum><text>to educate and inform consumers and the public about seafood and the nutritional value of fish in the diet;</text></paragraph><paragraph id="id8e856d4b322d4013bf7bfcb7267473fd"><enum>(4)</enum><text>to develop coordinated domestic fisheries and seafood marketing and promotion activities with research and development programs; and</text></paragraph><paragraph id="ide63a1140640543039df1642424940eb8"><enum>(5)</enum><text>to establish an Office of Seafood Policy and Program Integration in the Department of Agriculture to carry out an effective and coordinated program of seafood promotion, research, and consumer information designed—</text><subparagraph id="id9825fcc70201470db500f6bf39023e51"><enum>(A)</enum><text>to strengthen the position of the domestic seafood industry in the marketplace;</text></subparagraph><subparagraph id="id52f31800bd484b34b4d1b01eb77458d2"><enum>(B)</enum><text>to maintain, develop, and expand markets for seafood and seafood products; </text></subparagraph><subparagraph id="id92eaf888bf1e449f9c9aeefab93f0a58"><enum>(C)</enum><text>to enhance economic opportunities associated with domestic seafood harvest, processing, and production; and</text></subparagraph><subparagraph id="id59a943a91a1b4648919a5c6331ea91da"><enum>(D)</enum><text>to ensure up-to-date access to and public outreach on seafood nutritional information.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id4abf7d6e2a5a4e06b3a913d646bd21b5"><enum>3.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text></section><section id="idedf6a780c87244a1a11c887d2307e1b6"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idb4c15f703b0f4c0cb050bc68d630b8c6"><enum>(1)</enum><text>seafood produced in the United States, including seafood produced through wild capture and farmed—</text><subparagraph commented="no" display-inline="no-display-inline" id="id74a9ee3964394c238d782e102c56f3ec"><enum>(A)</enum><text display-inline="yes-display-inline">contributes substantially to the national economy; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85ff8137bcfa433381d9fe725fdf6639"><enum>(B)</enum><text display-inline="yes-display-inline">could make a greater contribution to the national economy if seafood sourced from the United States exclusive economic zone were more utilized, promoted, and widely available;</text></subparagraph></paragraph><paragraph id="idd7f6c85e69ef4cebab66e102566e8b14"><enum>(2)</enum><text>seafood contributes an important nutritional component to a healthy diet through the provision of essential fatty acids, key nutrients, and lean protein, yet per capita seafood consumption remains below recommended levels;</text></paragraph><paragraph id="id8a08e8ba51454b83818ffda7c2c0f944"><enum>(3)</enum><text>commercial fisheries and seafood production in the United States provide significant employment in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d743341f33145b99f42aba61d81489b"><enum>(A)</enum><text display-inline="yes-display-inline">coastal areas, including remote regions with limited economies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id902f7d98a1324e269bc2b69ff4dae02b"><enum>(B)</enum><text display-inline="yes-display-inline">processing and distribution centers;</text></subparagraph></paragraph><paragraph id="ide8242a3d65764533bc860b1eb23f00f4"><enum>(4)</enum><text>seafood and seafood products move in interstate and international commerce;</text></paragraph><paragraph id="ided78e62d53ce45d994e2dc80bbad2606"><enum>(5)</enum><text>the maintenance and expansion of existing markets, and development of new markets, for seafood and seafood products are vital to—</text><subparagraph id="id6f51bd6dde544447bb380e823727520e"><enum>(A)</enum><text>the welfare of seafood producers and persons concerned with harvesting, processing, and marketing seafood and seafood products; and</text></subparagraph><subparagraph id="id0b25d8dec8544111adc6aaa0524eda9c"><enum>(B)</enum><text>the general economy of the United States; and</text></subparagraph></paragraph><paragraph id="ide12b4c20a3fe4b0ea28cb10c010d60ee"><enum>(6)</enum><text>local fish products are a key factor for development strategies and diversification of many rural economies.</text></paragraph></section><section id="id391fd3ec47334ccfab455304ab3c40dc"><enum>5.</enum><header>Office of Seafood Policy and Program Integration in the Office of the Chief Economist</header><text display-inline="no-display-inline">Subtitle B of title VI of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7651">7 U.S.C. 7651 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD81F20EE3B3A42B6A20B9D48FD63F1DD"><section id="idf71e2b5cad924524be17ffcb2606d332" commented="no"><enum>621.</enum><header>Office of Seafood Policy and Program Integration</header><subsection id="id9331ef53369c43529a19697953743131"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to establish an Office of Seafood Policy and Program Integration to provide for the effective coordination of seafood policies and activities within the Department, and in coordination with the Secretary of Commerce and the United States Trade Representative, relating to the support of domestically harvested and processed wild and farmed seafood.</text></subsection><subsection id="idb89d6577b11a4c5e8e54c2a1fc3387a4"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish in the Office of the Chief Economist an Office of Seafood Policy and Program Integration (referred to in this section as the <term>Office</term>). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id48590ba298134db1a1dcc1dc6efdd50e"><enum>(c)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Office shall be responsible for—</text><paragraph id="id75f2337e11624dd4a84d8c19a0de0691"><enum>(1)</enum><text>the development and coordination of Department and interagency policy on seafood, including technological and policy input and advice on seafood issues;</text></paragraph><paragraph id="ida087e44d9546472d93a72b1eb6164626"><enum>(2)</enum><text>providing strategic oversight, planning, implementation, communication, and coordination of Department and interagency activities for wild and farmed seafood— </text><subparagraph commented="no" display-inline="no-display-inline" id="idbb9657ecb7dc4cc9bd0fab1bf14570f7"><enum>(A)</enum><text display-inline="yes-display-inline">to strengthen United States seafood production and seafood supply chains;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b3e3ed9911240c7b24da74a24ead6df"><enum>(B)</enum><text display-inline="yes-display-inline">to facilitate seafood research and nutrition science;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1cecfeb213cf46d79d0c1b3d21d16cad"><enum>(C)</enum><text>to maintain, develop, and expand markets for seafood and seafood products;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ea0b8a381a248799f791d601846913b"><enum>(D)</enum><text display-inline="yes-display-inline">to incorporate seafood into economic analyses, reviews, and forecasts; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25d66326c3c5405890262b080a9da6bf"><enum>(E)</enum><text display-inline="yes-display-inline">to integrate United States seafood production into Federal policy strategies to ensure—</text><clause commented="no" display-inline="no-display-inline" id="idb1ac10c9d342466eb546c0a5c127b372"><enum>(i)</enum><text display-inline="yes-display-inline">food system security and climate-resilient food production; </text></clause><clause commented="no" display-inline="no-display-inline" id="id55f64ded195d4e90b62b3a5f089611ac"><enum>(ii)</enum><text display-inline="yes-display-inline">rural business development to support food security and seafood production; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id22bf4d5ee0744f9fbdeaf8c52f3e624b"><enum>(iii)</enum><text display-inline="yes-display-inline">seafood nutrition and consumption education activities;</text></clause></subparagraph></paragraph><paragraph id="id7aece7fb0f0f4280b46eadc541121b30"><enum>(3)</enum><text>providing scientific and policy analysis to advise the Secretary and the Chief Economist regarding the development, availability, promotion, and use of seafood produced in the United States, including seafood produced through wild capture and aquaculture, in Department programs and policies;</text></paragraph><paragraph id="idb1f46a2706e44b138bf40fa1c338c417"><enum>(4)</enum><text>identifying opportunities to provide integrated access for United States wild and farmed seafood producers to Department programs to more efficiently and effectively—</text><subparagraph id="id754d5459f9104f37bf80215f30c6f1fd"><enum>(A)</enum><text>support the modernization and development of—</text><clause id="idb14709be08614c50b5fe4b5e88900cb4"><enum>(i)</enum><text>consumer education and outreach on the health and nutrition benefits of seafood consumption;</text></clause><clause id="idec1ab6e2971a4fdf950700ab85242056"><enum>(ii)</enum><text>harvesting and production technologies and processes that minimize waste and reduce environmental impacts;</text></clause><clause id="id973d80a32bf844519cd400ea8bc63492"><enum>(iii)</enum><text>value-added seafood processing and product development; and</text></clause><clause id="idf50b963953b14a34a805e0e8a1d2c979"><enum>(iv)</enum><text>infrastructure capacity to support seafood harvesting and production in rural communities;</text></clause></subparagraph><subparagraph id="id556d04134c7541a2a1adb0d31fa2734c"><enum>(B)</enum><text>strengthen capacity for local and regional seafood system development through community collaboration and expansion of local and regional supply chains;</text></subparagraph><subparagraph id="id40654e2e2ee94a1aa596de03fdefcd5c"><enum>(C)</enum><text>work to improve income and economic opportunities for seafood producers and food businesses through job creation and improved regional food system infrastructure, especially in rural communities;</text></subparagraph><subparagraph id="id339b9c6a94374f46ac85deec8c2e8f2c"><enum>(D)</enum><text>serve as a conduit of information regarding Department application eligibility and processes to support domestically harvested, wild-sourced seafood in Department food commodity programs; and</text></subparagraph><subparagraph id="id337dba543b5f4488a394d922aa1985e2"><enum>(E)</enum><text>increase access to, and use of, seafood in the school lunch program established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) to levels commensurate with Food and Drug Administration dietary guidelines; and</text></subparagraph></paragraph><paragraph id="ideb984bfa4c1a4ea0a3f15390fa32a198"><enum>(5)</enum><text>performing such other functions as may be required by law or prescribed by the Secretary.</text></paragraph></subsection><subsection id="id105a8ff4e9b0433e9359ffbaa1b3c886"><enum>(d)</enum><header>Interagency agreement for coordination</header><paragraph commented="no" display-inline="no-display-inline" id="idad5b0bb5b591472ba55a9366e1076442"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In support of the responsibilities described in subsection (c), the Office shall provide leadership to ensure coordination of interagency activities with the National Oceanic and Atmospheric Administration, the United States Trade Representative, and other Federal and State agencies.</text></paragraph><paragraph id="id7d321ebd6592402ea541253560c954d5"><enum>(2)</enum><header>Interagency agreement</header><subparagraph commented="no" display-inline="no-display-inline" id="id2b324a1654f6485386dc02175ca03c0a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Office shall develop an agreement to be entered into between the Department and the National Oceanic and Atmospheric Administration to enhance seafood purchases through the school lunch program established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf418d6877fc451c8c7e1f656c27f457"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The agreement under subparagraph (A) shall establish information-sharing protocols, including sharing the National Oceanic and Atmospheric Administration's list of domestic seafood vendors with the Department. </text></subparagraph></paragraph></subsection><subsection id="id015968c5c5f84ec39b592c408d9b391d"><enum>(e)</enum><header>Outreach</header><text>The Office shall consult with wild and farmed seafood harvesters and producers that may be affected by policies or actions of the Department, as necessary, in carrying out the responsibilities of the Office described in subsection (c).</text></subsection><subsection id="idd8fb08a1f5894b5bb98e6451d22bdb52"><enum>(f)</enum><header>Director</header><text>The Office shall be headed by a Director of Seafood Policy and Program Integration, who shall be appointed by the Secretary.</text></subsection><subsection id="id2f440cc86ba34f948196b45646aa1658"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id5353e63b3d5e4cd785b55b8856fafec8"><enum>(1)</enum><text>$5,000,000 for each of fiscal years 2023 through 2028; and</text></paragraph><paragraph id="id092b7da1241c417898cd4dc356e9e7da"><enum>(2)</enum><text>such sums as are necessary for each of fiscal years 2029 through 2033.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id69ad2ed01aeb4c82937266426c46812f"><enum>6.</enum><header>Wild USA seafood label</header><text display-inline="no-display-inline">Title II of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id5C02664102B44AE897835DAF829B1B10" display-inline="no-display-inline" style="OLC"><subtitle id="id341f5f5d1c224924982c61344aed64bf" style="OLC"><enum>H</enum><header>Wild USA Seafood Label</header><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id3afc3b2ae43e4c889eb65e224d91080f"><enum>298A.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph commented="no" display-inline="no-display-inline" id="id7eea37e64a934adc9f1c0730826af5ea"><enum>(1)</enum><header>Fish</header><text>The term <term>fish</term> means finfish, mollusks, crustaceans, and all other forms of aquatic animal and plant life other than aquatic mammals and birds. </text></paragraph><paragraph id="idc781feb55f7b49d796a09644587c08c7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idaec1a4aa36844275a9190db39897c778"><enum>298B.</enum><header>Wild USA Seafood label</header><subsection commented="no" display-inline="no-display-inline" id="id031a5cb9f26a454b9d7b0fa2fd123213"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A retailer of fish or person engaged in the business of supplying fish to a retailer may label the fish as <quote>wild USA seafood</quote>, <quote>wild American seafood</quote>, or any equivalent designation only if—</text><paragraph commented="no" display-inline="no-display-inline" id="id15191c93595a43ecbf7927f42a75e006"><enum>(1)</enum><text display-inline="yes-display-inline">the fish is naturally born in the wild or hatchery-originated fish released in the wild; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id194d0b13f53f4a64afe7625dedefb0ac"><enum>(2)</enum><text display-inline="yes-display-inline">the fish is caught, taken, or harvested from—</text><subparagraph commented="no" display-inline="no-display-inline" id="id765ae7c285ac46fb8a0cf05500764b2b"><enum>(A)</enum><text display-inline="yes-display-inline">waters within the exclusive economic zone (as defined in section 107 of title 46, United States Code); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39c807aa31f1459a9222f4f4f27644f2"><enum>(B)</enum><text>navigable waters (as defined in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>)); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d0548ee36f14ba49924174d53393318"><enum>(3)</enum><text display-inline="yes-display-inline">if the fish is caught, taken, or harvested by a vessel, such vessel is a vessel of the United States (as defined in section 3 of the Magnuson-Stevens Fisheries Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID10819A57EA184C5784CB8A4A4BED349F"><enum>(b)</enum><header display-inline="yes-display-inline">Method of notification</header><paragraph commented="no" display-inline="no-display-inline" id="ID26126505FA5D43A9A52844AA33800851"><enum>(1)</enum><header>In general</header><text>The information described in subsection (a) may be provided to consumers by means of a label, stamp, mark, placard, or other clear and visible sign on the fish or on the package, display, holding unit, or bin containing the fish at the final point of sale to consumers.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID20E72BDFB6214D3F8E7196805D3FF186"><enum>(2)</enum><header>Labeled commodities</header><text>If fish is already individually labeled for retail sale with the label described in subsection (a), the retailer shall not be required to provide any additional information to comply with this section.</text></paragraph></subsection></section><section id="ID3AD54E2766414F06AD8E1EB2BDADB67D"><enum>298C.</enum><header>Enforcement</header><subsection id="ID3A2AC1B901E84818A15365002CED2519"><enum>(a)</enum><header>Warnings</header><text>If the Secretary determines that a retailer of fish or person engaged in the business of supplying fish to a retailer is in violation of section 298B, the Secretary shall—</text><paragraph id="ID26507D61B96E4F52B609406E911BF834"><enum>(1)</enum><text>notify the retailer or person of the determination of the Secretary; and</text></paragraph><paragraph id="IDF0FCBF023ACC40DEB63848779D368DAA"><enum>(2)</enum><text>provide the retailer or person a 30-day period, beginning on the date on which the retailer or person receives the notice under paragraph (1) from the Secretary, during which the retailer or person may take necessary steps to comply with section 298B.</text></paragraph></subsection><subsection id="ID6186AB7A0D734068B3F7BAB2CDACACE8"><enum>(b)</enum><header>Fines</header><paragraph commented="no" display-inline="no-display-inline" id="id21c10901f0514986a45162fa3c1230c3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may fine a retailer or person under paragraph (2) if, on completion of the 30-day period described in subsection (a)(2), the Secretary determines that the retailer or person—</text><subparagraph id="ID9693AC6867C04D2C995401F2ED9EACDD"><enum>(A)</enum><text>has not made a good faith effort to comply with section 298B; and</text></subparagraph><subparagraph id="IDAF23C51DE61A450F8800A1D29CED4889"><enum>(B)</enum><text>continues to willfully violate section 298B with respect to the violation about which the retailer or person received notification under subsection (a)(1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19e3651dae534e62a5af8a41d371cb37"><enum>(2)</enum><header>Notice and hearing; amount</header><text display-inline="yes-display-inline">After providing notice and an opportunity for a hearing before the Secretary with respect to the violation described in paragraph (1), the Secretary may fine the retailer or person in an amount of not more than $10,000 for each violation.</text></paragraph></subsection></section><section id="ID880133E150B54A84B41FAD1780D5A29B" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>298D.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may promulgate such regulations as are necessary to implement this subtitle.</text></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6f5b0c0070464377aa3f684e88ad463e"><enum>7.</enum><header>Eligibility for commercial fishing</header><text display-inline="no-display-inline">Section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>) is amended—</text><paragraph id="id4d763875d10e4b1d9a9350f372f5b8f8"><enum>(1)</enum><text>in paragraph (1), by striking <quote>in, fish farming</quote> and inserting the following: “in—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id929b89f4611b4350a6e92e0bcb0d7e83"><subparagraph id="id6d39c81f7ce74b64adf320f083231664"><enum>(A)</enum><text>fish farming; and</text></subparagraph><subparagraph id="idc87a2a451bfd4767a4bcee487c8d27bd"><enum>(B)</enum><text>in the case of assistance under subtitle B, commercial fishing.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5420b62ef6894f0fb8daeb5760bc576f"><enum>8.</enum><header>Waiver to purchase foreign seafood commodities or products</header><subsection id="id7c1e9a4b04c844258649243eaa5268be"><enum>(a)</enum><header>Definition of foreign seafood commodity or product</header><text>Section 12(n)(1) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(n)(1)</external-xref>) is amended—</text><paragraph id="id01459b2b84944af9899c0f4196ad136b"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8609cb7b79644d7db1a81c27d55a54b6"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the paragraph designation and heading and all that follows through <quote>the term</quote> in the matter preceding clause (i) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id439E276EDFB54CFABBDCC643FF3B6DEF"><paragraph commented="no" display-inline="no-display-inline" id="idd04bb33aa0e94bd28147d6b7dc55d846"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idf9f2f6bb996a4c69bf25e723066f133b"><enum>(A)</enum><header>Domestic commodity or product</header><text>The term</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id145bc3b7e8614bbfa638908ddf2e596c"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="idb33c33fb63c54750ba4224606c729669" display-inline="no-display-inline" style="OLC"><subparagraph id="id7dcc6eea0bc64edfb876ac95a5ef676c"><enum>(B)</enum><header>Foreign seafood commodity or product</header><text>The term <term>foreign seafood commodity or product</term> means a seafood commodity or product other than—</text><clause id="id2a20faeec7a84ee3b8604cc7fc6ba8d9"><enum>(i)</enum><text>a seafood commodity that is produced in the United States; or</text></clause><clause id="id7cae299011d34dc38531a625162e8faa"><enum>(ii)</enum><text>a seafood product that is processed in the United States substantially using seafood commodities that are produced in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7fd2f33e60f14431bc71457f203c966b"><enum>(b)</enum><header>Waiver</header><text>Section 12(n)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(n)(2)</external-xref>) is amended—</text><paragraph id="idb5c943d64b1947d8b87307935645450b"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>;</text></paragraph><paragraph id="ide260be6011354e27a95f177c19e2a864"><enum>(2)</enum><text>in subparagraph (B)(ii), by striking <quote>for the school lunch</quote> and all that follows through the period at the end and inserting the following: “for—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2989df6d7543427b974a2f6d37f5589e"><subclause id="id81c060a092184acd87a912722fb5ffbf"><enum>(I)</enum><text>the school lunch program under this Act, including any snacks served under that program; or</text></subclause><subclause id="id89b59062360c4a66a93c10458004ad16"><enum>(II)</enum><text>the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id983d474a55504ba4a17903ebbbe844a6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1e86dcf1ba954282b936ac2c7b000a98"><subparagraph id="idcece9e8919a7477b93b5c4dff7a7bbd1"><enum>(C)</enum><header>Waiver</header><clause id="idebca54dc38a947e7a1148b639bc14dcb"><enum>(i)</enum><header>Waiver request</header><text>Except as provided in clause (ii), a school food authority shall request from the Secretary a waiver of subparagraph (A) to purchase foreign seafood commodities or products.</text></clause><clause id="id92ea0bc1574340ae98ddb57781032843"><enum>(ii)</enum><header>Exception</header><text>A school food authority may purchase foreign seafood commodities or products without requesting a waiver under clause (i) if those seafood commodities or products are not—</text><subclause id="id6bc8792ff8fa4b0f91cdad9d9f834c59"><enum>(I)</enum><text>produced domestically; or</text></subclause><subclause id="id04d540a343854d1aaa33dae16369d2e3"><enum>(II)</enum><text>available domestically.</text></subclause></clause><clause id="id90f225bcb4dd4ef9a49b38c0f25f5e67"><enum>(iii)</enum><header>Requirements</header><text>The Secretary may not provide a waiver under clause (i) unless—</text><subclause id="idf01dc81dc17044499522208d7994331a"><enum>(I)</enum><text>the seafood commodities or products for which the waiver is requested are not produced domestically in sufficient quantities or of satisfactory quality; and</text></subclause><subclause id="id3fe93e03b9fb48cf9bc4c6c7bce5d7dd"><enum>(II)</enum><text>the school food authority enters into an agreement under clause (iv).</text></subclause></clause><clause id="idcee4623bd3b444cc927db53010581f7a"><enum>(iv)</enum><header>Agreement</header><text>The Secretary may not provide a waiver under clause (i) unless the school food authority requesting the waiver agrees to make a notification of the waiver publicly available on the website of the school food authority not later than 30 days after receiving the waiver.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6bc984ca8f16424eaf03902d63137469"><enum>(c)</enum><header>Conforming amendments</header><text>Section 12(n) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(n)</external-xref>) is amended, in paragraphs (3) and (4), by striking <quote>Paragraph (2)(A)</quote> each place it appears and inserting <quote>Subparagraphs (A) and (C) of paragraph (2)</quote>.</text></subsection><subsection id="id6109f40bc328470b84d39024c156ce22"><enum>(d)</enum><header>Plan To increase seafood in the National School Lunch Program</header><paragraph commented="no" display-inline="no-display-inline" id="id7610e1d2f7fc440996678aef2712ef45"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the establishment of the Office of Seafood Policy and Program Integration pursuant to section 621 of the Agricultural Research, Extension, and Education Reform Act of 1998, that Office shall develop a plan to address factors affecting increased access to, and use of, seafood in the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) to levels commensurate with Food and Drug Administration dietary guidelines.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2a97ef7a760466cb91e0f33b705d329"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The plan developed under paragraph (1) shall—</text><subparagraph id="id5c66e6bbc1ab46bd87a0527fa648fa9b"><enum>(A)</enum><text>specify how the Secretary will enhance nutrition education, recipes, and training relating to seafood and seafood preparation;</text></subparagraph><subparagraph id="id67844726b5514c449735c6a65ae7067d"><enum>(B)</enum><text>identify how the Secretary will work with seafood vendors to allow for the purchase of smaller quantities of seafood;</text></subparagraph><subparagraph id="ide0ca06538e984df4a8d1a8a29029b6cb"><enum>(C)</enum><text>establish additional flexibilities to allow school food authorities and States to procure items from local food vendors directly;</text></subparagraph><subparagraph id="idc34897424e834781a5a3b687c7173c0f"><enum>(D)</enum><text>describe how the Secretary will provide enhanced technical assistance for school food authorities and States to support seafood purchases; and</text></subparagraph><subparagraph id="id99d320e6b6444506b67a3c1842b1c8b2" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>describe any other actions identified to enhance the availability of seafood in the national school lunch program.</text></subparagraph></paragraph></subsection><subsection id="id77cf482b9ca8434489ca58b70abdb542"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section or the amendments made by this section affects the requirements under section 4207 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>).</text></subsection></section><section id="id00c3f5264a514a1e9a7ff57a8bc3e493"><enum>9.</enum><header>Business development for food security and local community resilience study and report</header><subsection id="idecebfc2d7c5a476e852b7325eb10aaf5"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct a study identifying barriers to local and regional food production, processing, and market delivery in locations facing food security challenges, including Alaska, Hawaii, and insular areas. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd8c1a4866ca14813a7bcaa2b2a0a16bb"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress a report describing the findings of the study conducted under subsection (a) and recommended congressional actions to reduce the barriers described in that subsection and foster relevant local community resilience and business development.</text></subsection><subsection id="id7677aab56786452d8e3f15f1d8640922"><enum>(c)</enum><header>Inclusions</header><text>The study and report described in subsections (a) and (b) shall identify—</text><paragraph id="id3eaebe513ff3406d952afca08b00dea9"><enum>(1)</enum><text>barriers specific to local and regional fishing industries;</text></paragraph><paragraph id="id8157572275dd477b87c07538f735f8f9"><enum>(2)</enum><text>infrastructure deficiencies in the fishing, traditional commodity agriculture, livestock, and specialty crops industries contributing to food insecurity; and</text></paragraph><paragraph id="id96b4208314c34427bda69538d4c5306f"><enum>(3)</enum><text>logistical and transportation barriers to improving food security through business development.</text></paragraph></subsection></section><section id="id034ebd19412b47eda83fc3fd1e9f9ec9"><enum>10.</enum><header>Country of origin labeling for cooked king crab and tanner crab</header><text display-inline="no-display-inline">Section 281(7)(B) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638">7 U.S.C. 1638(7)(B)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb29e4510964d488b8540cfa044676a02"><enum>(1)</enum><text>by striking the period at the end and inserting <quote>; and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5923bf1fd2c346ffb9d52c3d20abe1f0"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>includes a fillet</quote> and inserting the following: “includes—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0B4351ECDF014C6BAFC434F63AEC3B65"><clause commented="no" display-inline="no-display-inline" id="idd43d453e298a410b929896fd70053374"><enum>(i)</enum><text display-inline="yes-display-inline">a fillet</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f4f0e5b570443969ac68346c568568c"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA81BAA128DE24F169C6C1DE39DBA44F9"><clause commented="no" display-inline="no-display-inline" id="id147a158e16b54b97ac3a231734f76284"><enum>(ii)</enum><text display-inline="yes-display-inline">whole cooked king crab and tanner crab and cooked king crab and tanner crab sections.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idc4fa37e007034ed7ba69cdb6477d9362"><enum>11.</enum><header>Country of origin labeling for cooked and canned salmon</header><text display-inline="no-display-inline">Section 281(7)(B) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638">7 U.S.C. 1638(7)(B)</external-xref>) (as amended by section 10) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id81c2cb689e0e483d8a4f763825ff42f7"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc059bc952344b98b6e19bc7b311c5f2"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>;
