which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Public Land Management Act of 2009 to authorize the modification of transferred works to increase public benefits and other project benefits as part of extraordinary operation and maintenance work, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore Aging Infrastructure Now Act</short-title></quote> or the <quote><short-title>RAIN Act</short-title></quote>.</text></section><section id="idcdce26ad171042f3a2c810f8dbc235be"><enum>2.</enum><header>Extraordinary operation and maintenance work; project modification</header><subsection commented="no" display-inline="no-display-inline" id="id2e22504c996241ff836a6f17962e5079"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>Section 9601 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510">43 U.S.C. 510</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide1104932a6c54c2d8bad314e0e13d1f0"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), (3), (4), (5), (6), and (7) as paragraphs (4), (7), (9), (10), (11), (12), and (3), respectively, and moving the paragraphs so as to appear in numerical order; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b81d9cb7d0344f0a90cff02ab67a25f"><enum>(2)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA2BA2A5A1F454536938ABF14485675D2"><paragraph id="idf8f4a9d975fe43caa3965c6fc2c0e630"><enum>(1)</enum><header>Adverse impact</header><text>The term <term>adverse impact</term> means, with respect to a project modification, a reduction in water quantity or quality or a change in the timing of water deliveries available to a project beneficiary from the modified project as compared to the water quantity or quality or timing of water deliveries from—</text><subparagraph id="id55960432ca4c43d583393fe7869649af"><enum>(A)</enum><text>the project with restored capacity, if the extraordinary operation and maintenance work under section 9603 is intended to restore lost project capacity;</text></subparagraph><subparagraph id="idf009e2c27981456782f4beba9e00e5d6"><enum>(B)</enum><text>the project prior to undertaking the extraordinary operation and maintenance work under section 9603, if the extraordinary operation and maintenance work is for any purpose other than to restore lost project capacity; or</text></subparagraph><subparagraph id="id24c5cce0f46f4fb189f5d622b1be3103"><enum>(C)</enum><text>project operations of the modified project without an increase in benefits for a new project beneficiary under section 9603(e)(1)(E).</text></subparagraph></paragraph><paragraph id="id569d8d1342614cf484064a2f94db0fe6"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> has the meaning given the term <quote>low-income community</quote> in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="ida35eba995b6a4094a6b153e4338b9bee"><enum>(3)</enum><text>in paragraph (3) (as so redesignated)—</text><subparagraph id="ide2d35b58dd8e402fa27785439fde63e7"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id38a23605e0dd43169766a2bde895b288"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idc987fa69418041b49679a8d322f2a468" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5DCD40099A8473FA5AA202B87E701B1"><subparagraph commented="no" display-inline="no-display-inline" id="idb3a52ff1382e4f8d82c6305080513c7d"><enum>(C)</enum><text display-inline="yes-display-inline">inclusive of any modifications to the facilities or facility components authorized under section 9603(e).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idcb5b9ce70e3c4616979732d8dec40631"><enum>(4)</enum><text>by inserting after paragraph (4) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69A48BCFDA154223A24687FA0E96EF48"><paragraph id="id4a3d425d5f1b4bf99ed1628b31032f73"><enum>(5)</enum><header>New benefit</header><text>The term <term>new benefit</term> means the increase in benefits of the modified project compared to the benefits provided by—</text><subparagraph id="id7c48e799f1c446af95531d0546cf746e"><enum>(A)</enum><text>the project with restored capacity, if the extraordinary operation and maintenance work under section 9603 is intended to restore lost project capacity; or</text></subparagraph><subparagraph id="id2da07c4769b749d8a002d0ffe01863e4"><enum>(B)</enum><text>the project as the project existed prior to undertaking the extraordinary operation and maintenance work under section 9603, if the extraordinary operation and maintenance work is for any purpose other than to restore lost project capacity.</text></subparagraph></paragraph><paragraph id="id6c0c76dddded4bbea1f04d16ad620162" commented="no"><enum>(6)</enum><header>Project beneficiary</header><text>The term <term>project beneficiary</term> means any entity that has a repayment, long-term water service, or other form of long-term contract or agreement executed pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>), for water supply from the project.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide63d1b00845f48fc9b3d998ae0dbc939"><enum>(5)</enum><text>by inserting after paragraph (7) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD24E04F1462D4EEFA1355590085B7977"><paragraph id="id76373936c78141bfaf4b8fd5d4b82342"><enum>(8)</enum><header>Public benefit</header><text>The term <term>public benefit</term>, with respect to a modified project, means—</text><subparagraph id="idef4259aa7e284912b3aaf925f47bdc21"><enum>(A)</enum><text>a public benefit identified under the reclamation laws; or</text></subparagraph><subparagraph id="id07ebc1ee7ad14061a26c92392622c737"><enum>(B)</enum><text>a drinking water benefit for 1 or more disadvantaged communities, including through groundwater recharge, if—</text><clause id="id72edd36c167640a5963b40a111a2654e"><enum>(i)</enum><text>the drinking water meets applicable regulatory standards;</text></clause><clause id="id5132ed8189674f24944691b8f3674f11"><enum>(ii)</enum><text>the drinking water benefit exceeds express mitigation or compliance requirements under Federal or State law;</text></clause><clause id="id42c2026089564917971e3cdfab7ec3de"><enum>(iii)</enum><text>the modified project reduces the unit cost per volume, improves water quality, or increases the reliability or quantity of the drinking water supply of the disadvantaged community as compared to the condition of the drinking water or other sources of drinking water available before the modification of the project;</text></clause><clause id="id2586e7ceafb44ae2b4748343d2a5af98"><enum>(iv)</enum><text>the drinking water benefit is quantified in a public process, including outreach to representatives of the affected disadvantaged community at the earliest practicable opportunity, to determine the scope of funding; and </text></clause><clause id="id8a5df8a1c3d9449d98c494307046d451"><enum>(v)</enum><text>negative impacts on water quality for other communities are not caused as part of the modified project.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id89b4d4ec6ade4f62a7a7fd1dc002e207"><enum>(b)</enum><header>Reimbursement of costs</header><text display-inline="yes-display-inline">Section 9603(b) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b(b)</external-xref>) is amended—</text><paragraph id="ide2c24eeafe4944808238e804c2550a36"><enum>(1)</enum><text>in paragraph (2), by striking <quote>the costs</quote> and inserting <quote>from the Aging Infrastructure Account established by subsection (d)(1) or any other applicable available account the costs, including reimbursable costs and nonreimbursable costs,</quote>; and</text></paragraph><paragraph id="id019fb6ce764d44068cced51ff9ecfe17"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1a61b3f546d249e7ab14d4f5f3f11671"><paragraph id="id0a88a94359294efb8357a6b2385bdac2"><enum>(4)</enum><header>Determination of nonreimbursable costs</header><text>Any costs advanced under paragraph (2) that are allocated to nonreimbursable purposes of the project, including public benefits described in section 9601(8)(B), shall be considered to be nonreimbursable costs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb0f379e549134d739615f8af96a5a034"><enum>(c)</enum><header>Aging infrastructure account conforming amendments</header><text display-inline="yes-display-inline">Section 9603(d) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b(d)</external-xref>) is amended—</text><paragraph id="id9f52ec650c00478db6d7018f1013c8b0"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>the funds</quote> and inserting <quote>reimbursable funds</quote>;</text></paragraph><paragraph id="id36811a88cf804143a92ca106e085e01f"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="ide01a4e0b060441c2971ce91450c58802"><enum>(A)</enum><text>by striking <quote>to fund</quote> and inserting <quote>to fund,</quote>; and</text></subparagraph><subparagraph id="id81689eabd453402db71e6b82f477ffc8"><enum>(B)</enum><text>by striking <quote>the funds for</quote> and inserting <quote>reimbursable funds for,</quote>; </text></subparagraph></paragraph><paragraph id="iddaf28b92fae14d97b2e1be52f0dd0eb8"><enum>(3)</enum><text>in paragraph (3)(A), by striking <quote>the amounts</quote> and inserting <quote>the reimbursable amounts</quote>; and</text></paragraph><paragraph id="idcaa09d036a574bc8b523ce83b525599f"><enum>(4)</enum><text>in paragraph (4)(B)(i), by inserting <quote>, including projects under subsection (e)</quote> after <quote>this section</quote>.</text></paragraph></subsection><subsection id="idd1a66aac4f214af5b9f970571c71c524"><enum>(d)</enum><header>Authorization To modify transferred works To increase public benefits and other project benefits as part of extraordinary operation and maintenance work</header><text>Section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3067f96e678e4e61b7f2682ae342b968"><subsection id="id8e40d6a51ced4967ba660cc3abebab63"><enum>(e)</enum><header>Authorization To modify transferred works To increase public benefits and other project benefits as part of extraordinary operation and maintenance work</header><paragraph id="id3f8a30d2bba346ae80a0096e7e1379c5"><enum>(1)</enum><header>Authorization; requirements</header><subparagraph id="id3078b754e041494a9c2fbc9d9ef1950c"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with any transferred works operating entity and any project beneficiaries and as part of extraordinary operation and maintenance work under this section, may develop and carry out a proposal to modify project features for transferred works to increase public benefits and other project benefits, including carrying out a feasibility study and conducting any applicable environmental analysis required for the proposal, subject to subparagraphs (B) through (G).</text></subparagraph><subparagraph id="id0ae8238e836549a7b5e44863b85751b0"><enum>(B)</enum><header>Maximum cost</header><text>The maximum amount that may be added to the original project cost as a result of a project modification under subparagraph (A) shall not exceed—</text><clause id="idca586c123ecc44ce8065e41c70738520"><enum>(i)</enum><text>an amount equal to 25 percent of the original cost of the planned extraordinary operation and maintenance work, in the case of a project for which the original cost of the planned extraordinary operation and maintenance work exceeds $100,000,000; or</text></clause><clause id="id1726cb2b79c44e88a297bae4ece06933"><enum>(ii)</enum><text>$25,000,000, in the case of a project for which the original cost of the planned extraordinary operation and maintenance work is not more than $100,000,000.</text></clause></subparagraph><subparagraph id="id470183b0f5ff4e9c80b7aa0acec3a05e"><enum>(C)</enum><header>Public benefits</header><text>In the case of a project modification under subparagraph (A), not less than 50 percent of the new benefits provided by the modification of the project, as compared to the original planned extraordinary operation and maintenance work, shall be public benefits.</text></subparagraph><subparagraph id="id92ee791b7e284f79a04c7d9433d0948e"><enum>(D)</enum><header>Written consent required</header><text>A project modification under subparagraph (A) shall not be constructed until the date on which the Secretary has obtained the written consent of—</text><clause id="id1b1d36bd953d4a4b93af25f1b312e1a8"><enum>(i)</enum><text>the transferred works operating entity; and</text></clause><clause id="id73c64223851d4f548fcecb154260908d"><enum>(ii)</enum><text>consistent with paragraph (2), any project beneficiary that would experience an adverse impact as a result of the modification of the project.</text></clause></subparagraph><subparagraph id="id666d7896ad164ea4b4d346cd2cc65692"><enum>(E)</enum><header>Adverse impact</header><text>Any benefits that accrue to a new project beneficiary resulting from operations of the modified project shall not be increased without the consent of existing project beneficiaries that would experience an adverse impact as a result of the modification of the project.</text></subparagraph><subparagraph id="id12a79d4b231a424cafaf55319ee9e8bf"><enum>(F)</enum><header>Reimbursement of costs</header><text>The costs of planning, design, and environmental compliance for a project modification under subparagraph (A) shall be reimbursed in accordance with subsection (b), except that any of the costs that would otherwise be allocated to a project beneficiary shall be considered nonreimbursable if the project beneficiary does not receive any increase in long-term average annual water deliveries as a result of the modification.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0951b9d83a344888b11fc7d2f9b4df0"><enum>(G)</enum><header>Eligibility of certain project modifications</header><text>If a project modification that is otherwise eligible under subparagraph (A) is in the planning, design, or construction phase as of December 31, 2022, the project modification shall remain eligible to be developed under that subparagraph.</text></subparagraph></paragraph><paragraph id="id7f5e19e584b94fbc9a3bcbbd3d91897f"><enum>(2)</enum><header>Procedure for obtaining consent and time limitation</header><subparagraph id="id813c94db592a419eb5e19c02aa97c939"><enum>(A)</enum><header>Initial determination</header><text>The Secretary shall initially determine whether the consent of a project beneficiary is required prior to construction under paragraph (1)(D) based on whether the modification or subsequent operations of the modified project would have any adverse impacts on a project beneficiary.</text></subparagraph><subparagraph id="id651e74046763484795f5ca5ed9a5e229"><enum>(B)</enum><header>Written request for consent</header><text>The Secretary shall provide to the transferred works operating entity, and any project beneficiaries, in writing—</text><clause id="idccc2ea7e6497455b8bd26e5d9486a76d"><enum>(i)</enum><text>a description of the proposed modification and subsequent operations of the project; and</text></clause><clause id="ide9e9609e1e46496baa881fa6753047b9"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1d5fd940e9b24a28a3ad30299ed3e1fe"><enum>(I)</enum><text>a request for consent under paragraph (1)(D); or</text></subclause><subclause indent="up1" id="id82919341BDCA48A09C0072C715FEAA98"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idC88A03B6CEA44BC5A033475B87AEA473"><enum>(aa)</enum><text>an explanation that the Secretary has determined that no consent is required under paragraph (1)(D); and</text></item><item indent="up1" id="idA9CD30C5EA864E658B9544C0867804A0"><enum>(bb)</enum><text>a statement that if the project beneficiary believes that the consent of the project beneficiary is required, the project beneficiary shall send to the Secretary a reply not later than 30 days after the date of receipt of the notice that includes an explanation of the reasons that the project beneficiary would experience adverse impacts as a result of the project modification.</text></item></subclause></clause></subparagraph><subparagraph id="idba621c0bc55f4851b624c631956c4482"><enum>(C)</enum><header>Final determination</header><clause id="id0669c92bfb2549498856bad83bf82245"><enum>(i)</enum><header>Written response</header><text>The Secretary shall respond in writing to any reply from a project beneficiary under subparagraph (B)(ii)(II)(bb) stating whether or not the Secretary determines that the project beneficiary would experience adverse impacts as a result of the project modification.</text></clause><clause id="id0c564f7493964d568e83b929141352e1"><enum>(ii)</enum><header>Final agency action</header><text>A written determination by the Secretary under clause (i) shall be considered to be a final agency action for purposes of section 704 of title 5, United States Code.</text></clause><clause id="id0f836766b72c4b93b2e707e4f6cf5be5"><enum>(iii)</enum><header>Written request</header><text>If the Secretary determines under clause (i) that the project beneficiary would experience adverse impacts as a result of the project modification, the Secretary shall send to the project beneficiary a written request for consent in accordance with subparagraph (B)(ii).</text></clause></subparagraph><subparagraph id="id05fd03981a8a41b8a36f88e19f5f2f23"><enum>(D)</enum><header>Time period for consent</header><clause id="id23df143a091b4dd6b73b99d54a7b8ded"><enum>(i)</enum><header>In general</header><text>If written consent required under paragraph (1)(D) is not obtained by the date that is 1 year after the date on which written consent is requested under subparagraph (B)(ii), the transferred works operating entity shall proceed with extraordinary operation and maintenance work of the project without the modification, unless the Secretary extends the time for consent under clause (ii).</text></clause><clause id="idf7c66f924e9b442e9bd5f78b09a73b42"><enum>(ii)</enum><header>Extension</header><text>At the discretion of the Secretary, the Secretary may elect to extend the time for obtaining consent under paragraph (1)(D) by 1 year.</text></clause></subparagraph></paragraph><paragraph id="id7440d818c3c84d86b22d87b186a1a7fb"><enum>(3)</enum><header>Reallocation of costs based on project changes and increased public benefits</header><text>The Secretary shall allocate costs, including capital repayment costs and operation and maintenance costs, for a project modification under paragraph (1), to provide that—</text><subparagraph id="ida2b5a5e1c97646b9b41c608b97eb4a66"><enum>(A)</enum><text>annual operation and maintenance costs associated with nonreimbursable purposes of the project shall be nonreimbursable; and</text></subparagraph><subparagraph id="idfb5cb8f99eca48d0a81316a2de338068"><enum>(B)</enum><text>the cost allocation of reimbursable costs to each project beneficiary reflects any changes in the benefits that the modified project is providing to the project beneficiary.</text></subparagraph></paragraph><paragraph id="id7e7a5b237973434fa5e777c2843bc524"><enum>(4)</enum><header>Incentive for benefitting entities to participate in projects with increased public benefits</header><subparagraph id="id9711832311b3426088780a88b857b48d"><enum>(A)</enum><header>In general</header><text>The total amount of reimbursable capital costs, as determined under paragraph (3), for extraordinary operation and maintenance work described in subparagraph (B) shall be reduced by 15 percent, with each project beneficiary to be responsible for 85 percent of the reimbursable costs that would otherwise be allocated to the project beneficiary. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4262ac3e10dd411f9bf3a62cfc61fc1c"><enum>(B)</enum><header>Description of extraordinary operation and maintenance work</header><text>The extraordinary operation and maintenance work referred to in subparagraph (A) is extraordinary operation and maintenance work involving a project modification that would increase nonreimbursable public benefits without increasing reimbursable municipal, industrial, or irrigation benefits from the original design of the planned extraordinary operation and maintenance work.</text></subparagraph></paragraph><paragraph id="idd19751d278b44230a775d055c9b1936d"><enum>(5)</enum><header>Reimbursable funds</header><text>All reimbursable costs under this subsection shall be repaid in accordance with subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
