<official-title>To amend the Agricultural Marketing Act of 1946 to establish a pollinator-friendly plant labeling program, and for other purposes.</official-title>

<section id="id425a452d94b54300bfe7c723dcd9bd0f" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pollinator-Friendly Plant Labeling Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="id958db8ec55974f89b3a00cfa92a5775a" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Pollinator-friendly plant labeling program</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="id8b4e6fd4df0b451eb466ccf35f040a08"><enum>210B.</enum><header>Pollinator-friendly plant labeling program</header>
<subsection commented="no" display-inline="no-display-inline" id="idd1497022afd042c8ac5f6c333bc0e2b7"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id2cd27b57dace4d23adae32160b5f6a92"><enum>(1)</enum><header>Pesticide</header><text>The term <term>pesticide</term> has the meaning given the term in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb14330021bdc457e9bda8095379404e3"><enum>(2)</enum><header>Producer</header><text>The term <term>producer</term> means a nursery or farmer growing a plant or cultivating a seed for sale.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id3298f27aae0544b7a0069c42b502756e"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ide9b6f0ea9e074e13a6ee3a47fedf855f"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text>The Secretary shall establish a certification program for producers of pollinator-friendly plants.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="ide74e6106583a46ff8c7d9875cb1fa291"><enum>(c)</enum><header>Certification</header> <paragraph commented="no" display-inline="no-display-inline" id="id7ffcf53d25ba4bbc9ce954dee5fa015d"><enum>(1)</enum><header>Applications</header><text display-inline="yes-display-inline">To be certified under this section, a producer may voluntarily submit to the Secretary an application for the certification. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ida6eef3962abd4fb59a1cb6bc9dca2a85"><enum>(2)</enum><header>Approval</header><text>The Secretary shall approve an application for certification submitted under paragraph (1) if the producer—</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id97115266500b4b0a8d9897b6a9b135f7"><enum>(3)</enum><text display-inline="yes-display-inline">meets the requirements under this section; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8970b01266854a39861b5153cfbdab51"><enum>(4)</enum><text>has been third-party certified.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id28386664c5dd4ad5a752c99354de87cf"><enum>(d)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be sold or labeled as a <quote>USDA pollinator-friendly</quote> plant, a plant—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idf315a056386448239d529aaca12dc96a"><enum>(1)</enum><text display-inline="yes-display-inline">shall be living;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id542b019a6bdf4812b37759d1572b354e"><enum>(2)</enum><text display-inline="yes-display-inline">shall be, as determined by the Chief of the Natural Resources Conservation Service—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id9608d47cc5964f79b32265981011510f"><enum>(A)</enum><text display-inline="yes-display-inline">native to the United States; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id6f9d06ddfdf547c9b852a63437cd6713"><enum>(B)</enum><text display-inline="yes-display-inline">known to be beneficial to pollinators, including providing habitat and forage for pollinators; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idac0cba9277a84ba19ba00bcffc86dae5"><enum>(3)</enum><text display-inline="yes-display-inline">may not have been produced using any pesticide or substance (within the meaning of the term in the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>)) that may not be used in the production or handling of organically produced agricultural products under that Act.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idd4ec1feca971405ca44f0cd92a7a2e0c"><enum>(e)</enum><header>Compliance requirements</header> <paragraph commented="no" display-inline="no-display-inline" id="ID7A803FDFB8334FE795B0ECBF05F5C92E"><enum>(1)</enum><header>In general</header><text>A person may sell or label a plant as <quote>USDA pollinator-friendly</quote> only if the plant meets the requirements under this section.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID2862FA9C36EF4593B545A10D2F3C7C85"><enum>(2)</enum><header>Labeling</header><text>No person may affix a label to, or provide other market information concerning, a plant if the label or information implies, directly or indirectly, that the plant is USDA pollinator-friendly, except in accordance with this section.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id8a3e7f482ed54d5ca1e41d30c04716a7"><enum>(f)</enum><header>Labeling</header><text>A label affixed, or other market information provided, in accordance with subsection (e)(2)—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idd5c338d715fc41b0a59314627e4ea47e"><enum>(1)</enum><text display-inline="yes-display-inline">shall indicate that the plant meets Department of Agriculture standards for being pollinator-friendly; </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id41c09f26d8834723ada2d804f487353b"><enum>(2)</enum><text display-inline="yes-display-inline">may incorporate the Department of Agriculture seal;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idae38d05a963c4e38989ea3770553ed5e"><enum>(3)</enum><text display-inline="yes-display-inline">shall include the scientific name of the plant and the common name of the plant, if any;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id09574c34112d475387d0fe7cad60cf2a"><enum>(4)</enum><text>shall include the county or ecoregion that the plant species is native to and locally adapted to;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ida425f14c3ba448a486e5bb389f120a9d"><enum>(5)</enum><text display-inline="yes-display-inline">shall include the name of the producer of the plant; </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idef8d73b392d54d61a79675108d4ac1b0"><enum>(6)</enum><text display-inline="yes-display-inline">shall include an instruction that distributors and retailers are not permitted to apply any pesticide product to the plant;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6e3781dc69f740e39bd5ab1ea28dc9ea"><enum>(7)</enum><text display-inline="yes-display-inline">shall include a statement relating to the importance of supporting pollinator conservation efforts; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id2db1a5dcae984f849b457832fdf210b6"><enum>(8)</enum><text display-inline="yes-display-inline">may include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id3afebaedacac42c2b3905ea37e346642"><enum>(A)</enum><text display-inline="yes-display-inline">instructions for planting and maintaining the plant to ensure its effectiveness as a resource for pollinators; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc4cde2e0062340868e0b66ca92839f93"><enum>(B)</enum><text display-inline="yes-display-inline">advice on protecting pollinators visiting the plant from pesticide exposure; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id698ecaa42ad640a19296d9898cf38570"><enum>(C)</enum><text>a weblink or digital code, such as a quick response (QR) code, to access a webpage with additional educational information about the plant.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idca8598baf91441e6a3960d2474332d00"><enum>(g)</enum><header>Investigations and enforcement</header><text display-inline="yes-display-inline">Subsections (b) and (c) of section 2120 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6519">7 U.S.C. 6519</external-xref>) shall apply to this section in the same manner that those subsections apply to that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>). </text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id8d6334a362e948508294dea68cf7e133"><enum>(h)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this section supersedes or otherwise affects any State or Federal plant protection or plant quarantine program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
