<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2175</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230622">June 22, 2023</action-date><action-desc><sponsor name-id="S331">Mrs. Gillibrand</sponsor> (for herself and <cosponsor name-id="S322">Mr. Merkley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 208 of the Immigration and Nationality Act to reduce the waiting period for employment authorization for asylum applicants, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assisting Seekers in Pursuit of Integration and Rapid Employment Act</short-title></quote> or the <quote><short-title>ASPIRE Act</short-title></quote>.</text></section><section id="H3A26DDBD860348E0A03674939A28E7C6"><enum>2.</enum><header>Employment authorization for aliens seeking asylum</header><text display-inline="no-display-inline">Paragraph (2) of section 208(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(d)</external-xref>) is amended to read as follows:</text><quoted-block id="HEF2AAC5A5870490899C48A3A25074688" display-inline="no-display-inline" style="OLC"><paragraph id="H29E60471795C455CB6620943B9270AAB"><enum>(2)</enum><header>Employment authorization</header><subparagraph id="H8D72B0E914AE4BF797D9361874C20C8F"><enum>(A)</enum><header>Eligibility</header><text>Subject to subparagraphs (B) and (C), the Secretary of Homeland Security shall authorize employment for an applicant for asylum whose application for asylum has not been determined frivolous.</text></subparagraph><subparagraph id="HA0D0D69807C049B595C735224CD0B348"><enum>(B)</enum><header>Application</header><text>An applicant for asylum who is not otherwise eligible for employment authorization shall not be granted such authorization prior to 30 days after the date of filing of the application for asylum.</text></subparagraph><subparagraph id="HA901549F9F6A456C90D80740651C9AAB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Term</header><text display-inline="yes-display-inline">Employment authorization for an applicant for asylum shall be valid until the date on which an applicant is issued a final denial of the applicable application, including administrative and judicial review.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="idc04a73ff84a7486d8e9a6d2612c7f520"><enum>3.</enum><header>Authorization of appropriations</header><subsection commented="no" display-inline="no-display-inline" id="id4af93bfd0830489bb79714ed462058db"><enum>(a)</enum><header>U.S. Citizenship and Immigration Services</header><paragraph commented="no" display-inline="no-display-inline" id="idb1e0d04391ca4e6f9a3b797f01c84533"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Director of U.S. Citizenship and Immigration Services to increase the capacity of U.S. Citizenship and Immigration Services to address the asylum backlog, including by hiring additional asylum officers and providing basic asylum training and translation and interpretation services, $2,000,000,000 for fiscal year 2024, to remain available until expended.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id630c81f4b8ff4de3b7236316be1bcda9"><enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Not less than 75 percent of the amount authorized to be appropriated under paragraph (1) shall be used to hire personnel.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9302a50744b1415991c73f3f4e3e61c1"><enum>(b)</enum><header>Department of Homeland Security</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of Homeland Security for the Shelter and Services Program, administered jointly by U.S. Customs and Border Protection and the Federal Emergency Management Agency, to provide State and local governments and nonprofit organizations with funding for the provision of shelter, food, transportation, and other support services to migrants encountered by the Secretary $10,000,000,000 for fiscal year 2024, to remain available until expended. </text></subsection></section></legis-body></bill>
