<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Depriving Enemy Nations of Integral Authorizations and Licenses Act of 2023</short-title></quote> or the <quote><short-title>DENIAL Act of 2023</short-title></quote>.</text></section> <section id="iddae46cb549064a9786c45d5d83a13963"><enum>2.</enum><header>Presumption of denial for licenses for export, reexport, or in-country transfer of technology to end users in the People's Republic of China or the Russian Federation</header><text display-inline="no-display-inline">Section 1756 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4815">50 U.S.C. 4815</external-xref>) is amended by adding at the end the following:</text>

<subsection id="idd5e2eee4a84c4328b698f956f3e70d76"><enum>(e)</enum><header>Presumption of denial for licenses for export, reexport, or in-Country transfer of technology To end users in the People's Republic of China or the Russian Federation</header>
<paragraph commented="no" display-inline="no-display-inline" id="id77738889cb6c4aae8ff0453ecbc2127f"><enum>(1)</enum><header>In general</header><text>Except as provided by paragraph (2), the Secretary shall deny an application for a license or other authorization for the export, reexport, or in-country transfer of technology if the end user of the technology is a covered person.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id46d975a6bd794d25819bc48e5e4d7f5c"><enum>(2)</enum><header>Congressional notification and review process</header> <subparagraph commented="no" display-inline="no-display-inline" id="id3d718bcf22014ef893c5941f03b19fd8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Before approving an application for a license or other authorization described in paragraph (1), the Secretary shall submit to the appropriate congressional committees a report—</text>
<clause commented="no" display-inline="no-display-inline" id="id3395e6a65e9b4ce29268e0c038523e00"><enum>(i)</enum><text display-inline="yes-display-inline">specifying the intended end user of the technology that is the subject of the application; </text></clause> <clause commented="no" display-inline="no-display-inline" id="id335179e397a04deb846142fa71afeff3"><enum>(ii)</enum><text display-inline="yes-display-inline">specifying the dollar value of the technology; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id92541746cc174d7c872e56eea42b637b"><enum>(iii)</enum><text display-inline="yes-display-inline">describing the technology;</text></clause> <clause id="id73cedc368cfb4caf830df595be0d41a7"><enum>(iv)</enum><text>describing the proposed end use of the technology;</text></clause>
<clause id="id2e95dbbe6bc84a039e17e0159ad874c6"><enum>(v)</enum><text>describing how authorizing the export, reexport, or in-country transfer of the technology to the specific end user advances the national security interests of the United States; and</text></clause> <clause id="id5d65590e42534901a0ab7098d5cad27a" commented="no"><enum>(vi)</enum><text>describing how authorizing the export, reexport, or in-country transfer of the technology to the specific user does not advance the national security interests of a covered country, including—</text>
<subclause id="idbeaca8df99ea48588b06a5e5f67854c0" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">the Made in China 2025 industrial strategy of the People's Republic of China;</text></subclause> <subclause id="id12df73829e834b1081ae6a288541132a"><enum>(II)</enum><text>the military-civil fusion national strategy of the People’s Republic of China, including transfer of technology to any entity identified as part of that strategy, including—</text>
<item id="id89717ceb87804a6ba8eaf27a674ca012" commented="no"><enum>(aa)</enum><text>any college or university known as one of the <quote>Seven Sons of National Defense</quote>; </text></item> <item id="id12c608b3e09e4f67a163d0a038d74037" commented="no"><enum>(bb)</enum><text>any college or university that receives funding from—</text>
<subitem id="id45fef477881d4aa8b5873e0d02f6cde0" commented="no"><enum>(AA)</enum><text>the People’s Liberation Army; or</text></subitem> <subitem id="id7cf606af2c3a488e9f94f3f763f9c570" commented="no"><enum>(BB)</enum><text>the Equipment Development Department, or the Science and Technology Commission, of the Central Military Commission of the People's Republic of China;</text></subitem></item>
<item id="idefb4165e7af449b2b1fcebe5ff5442b6" commented="no"><enum>(cc)</enum><text>any college or university in the People’s Republic of China involved in military training and education, including any such college or university in partnership with the People’s Liberation Army;</text></item> <item id="idb65fa76e6cf24ee2a0a566bb65f84d1e" commented="no"><enum>(dd)</enum><text>any college or university in the People’s Republic of China that conducts military research or hosts dedicated military initiatives or laboratories, including such a college or university designated under the <quote>double first-class university plan</quote>;</text></item>
<item id="id7cd38ca994e345c9a2c6c08cd8bce298" commented="no"><enum>(ee)</enum><text>any college or university in the People’s Republic of China that is designated by the State Administration for Science, Technology, and Industry for the National Defense to host <quote>joint construction</quote> programs;</text></item> <item id="idba631526382a437e8f71a5d5214bf082" commented="no"><enum>(ff)</enum><text>any college or university in the People’s Republic of China that has launched a platform for military-civil fusion or created national defense laboratories; </text></item>
<item id="idb8030eae174647a6ae7865e7d61bdb38" commented="no"><enum>(gg)</enum><text>any college or university in the People’s Republic of China that conducts research or hosts dedicated initiatives or laboratories for any other related security entity beyond the People’s Liberation Army, including the People’s Armed Police, the Ministry of Public Security, and the Ministry of State Security;</text></item> <item id="idd31f63faf25f423ca3405c1f0e340f5b" commented="no"><enum>(hh)</enum><text>any enterprise for which the majority shareholder or ultimate parent entity is the Government of the People’s Republic of China at any level of that government;</text></item>
<item id="id53169b52a05146d5855afb12a22d84d0" commented="no"><enum>(ii)</enum><text>any privately owned company in the People’s Republic of China that—</text> <subitem id="id6a8a77310a77463db3e28765598ac867" commented="no"><enum>(AA)</enum><text>has received a military production license, such as the Weapons and Equipment Research and Production Certificate, the Equipment Manufacturing Unit Qualification, the Weapons and Equipment Quality Management System Certificate, or the Weapons and Equipment Research and Production Unit Classified Qualification Permit;</text></subitem>
<subitem id="id926e444cde2a41db9e3e24eb050bc5e2"><enum>(BB)</enum><text>is otherwise known to materially support the military initiatives of the People’s Republic of China;</text></subitem> <subitem id="id80e795fcecd041b290b8df9f57dc8aa4" commented="no"><enum>(CC)</enum><text>has a history of subcontracting for the People’s Liberation Army or its affiliates;</text></subitem>
<subitem id="ide7d3ad219d0e4887a83aa75267e2efc7" commented="no"><enum>(DD)</enum><text>is participating in, or receiving benefits under, a military-civil fusion demonstration base; or</text></subitem> <subitem id="idd230d5ae3efd465692925337e9fb6536" commented="no"><enum>(EE)</enum><text>has an owner, director, or a senior management official who has served as a delegate to the National People’s Congress, a member of the Chinese People’s Political Consultative Conference, or a member of the Central Committee of the Chinese Communist Party; or</text></subitem></item></subclause>
<subclause id="id367fe5ccc2094604a4dfae36cc45f242"><enum>(III)</enum><text>the Science and Technology Foresight 2030 policy of the Russian Federation, including transfer of technology to any entity identified as part of that strategy, including—</text> <item id="id5dc6214d1bf943e59ebef1e7dcba2ba3"><enum>(aa)</enum><text>the Advanced Research Foundation;</text></item>
<item id="id463fb188d7704aceb28f203cd24d6645"><enum>(bb)</enum><text>the Era Military Innovation Technopolis;</text></item> <item id="id2da35345e858451db2b4b55abf10f68a"><enum>(cc)</enum><text>any college or university that receives funding from the Ministry of Defense of the Russian Federation;</text></item>
<item id="id571e7f15d4bd4966ac7ca8a67f4f20e4"><enum>(dd)</enum><text>any entity for which the majority shareholder or ultimate parent entity is the Government of the Russian Federation at any level of that government; or</text></item> <item id="ide68f85c93678482e883841d32227cdea"><enum>(ee)</enum><text>any privately owned company in the Russian Federation that—</text>
<subitem id="id4fb11a1cd28f40fc944da08d2899cb04"><enum>(AA)</enum><text>is otherwise known to materially support the military initiatives of the Russian Federation; or</text></subitem> <subitem commented="no" display-inline="no-display-inline" id="id13ec45cfcca947409f682333f67765b9"><enum>(BB)</enum><text display-inline="yes-display-inline">has subcontracted for the Ministry of Defense of the Russian Federation or its affiliates.</text></subitem></item></subclause></clause></subparagraph>
<subparagraph id="ID82DE1ABADC8449978F66C4B06E68FAA6"><enum>(B)</enum><header>Limitation on approval during review period</header><text>The Secretary may not approve an application for a license or other authorization described in paragraph (1) during the 30-day period beginning on the date on which the appropriate congressional committees receive the report required by subparagraph (A) unless the Secretary, in the report—</text> <clause id="idb7290833e755476f905dcb00443a76e6"><enum>(i)</enum><text>states that the Secretary has determined that a pressing national security imperative exists, such that the national security interests of the United States necessitate the immediate approval of the license or other authorization; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="iddf967b6d548146948ed13c3fc9a3a97a"><enum>(ii)</enum><text>provides a detailed justification for that determination, including—</text> <subclause commented="no" display-inline="no-display-inline" id="id394244af6c684576a67185a36415450b"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the emergency circumstances that necessitate the immediate approval of the license or other authorization; and </text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="id936b53dbb9364c7a9bfd0ee32d5cbef2"><enum>(II)</enum><text display-inline="yes-display-inline">a discussion of the national security interests involved.</text></subclause></clause></subparagraph> <subparagraph id="IDE1B205416E81443E8C6394E1F34C3099"><enum>(C)</enum><header>Prohibition on approval if joint resolution of disapproval enacted</header><text>The Secretary may not approve an application for a license or other authorization described in paragraph (1) if, during the 30-day period described in subparagraph (B), there is enacted into law a joint resolution prohibiting the approval of the application.</text></subparagraph>
<subparagraph id="ID57650521E6914541B9E309A0925323D6"><enum>(D)</enum><header>Consideration of joint resolution</header>
<clause commented="no" display-inline="no-display-inline" id="id64d48534755d429d9f4c7aeca39a3438"><enum>(i)</enum><header>Senate</header><text display-inline="yes-display-inline">Any joint resolution under this paragraph shall be considered in the Senate in accordance with the provisions of section 601(b) of the International Security Assistance and Arms Export Control Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/329">Public Law 94–329</external-xref>; 90 Stat. 765).</text></clause> <clause commented="no" display-inline="no-display-inline" id="ide85de867195a485eacec19e42eb74f0d"><enum>(ii)</enum><header>House of Representatives</header><text display-inline="yes-display-inline">For the purpose of expediting the consideration and enactment of joint resolutions under this paragraph, a motion to proceed to the consideration of any such joint resolution after it has been reported by the appropriate committee shall be treated as highly privileged in the House of Representatives.</text></clause>
<clause id="idcc53c15ceb444c6f891182c67af3df60"><enum>(iii)</enum><header>Rules of house of representatives and senate</header><text>This subparagraph is enacted by Congress—</text> <subclause id="iddbde75971cd54be1a74367e61b8ab16d"><enum>(I)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text></subclause>
<subclause id="id6fc5357692fb42b2b2f8e3a0190437bf"><enum>(II)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House. </text></subclause></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id2e09c40581854507ad299bd6753f6678"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ide719715bbaa54a8786c4a37467aac880"><enum>(A)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <clause commented="no" display-inline="no-display-inline" id="id0fb96fd0689448b5b50bedeca851cf6f"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id315dec93e18048878c82d6910a0d3ef4"><enum>(ii)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id47c8008a3ae24c6da70da8fcdbdeeaaf"><enum>(B)</enum><header display-inline="yes-display-inline">Covered country</header><text>The term <term>covered country</term> means—</text>
<clause commented="no" display-inline="no-display-inline" id="id9833e6366c7b41cb85d0aa293079364d"><enum>(i)</enum><text display-inline="yes-display-inline">the People's Republic of China (including the Hong Kong Special Administrative Region and the Macau Special Administrative Region); and</text></clause> <clause commented="no" display-inline="no-display-inline" id="idd9675ca972b1431aa83423810661e149"><enum>(ii)</enum><text>the Russian Federation.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idd891bc4f57594fbdba995357b298a54f"><enum>(C)</enum><header display-inline="yes-display-inline">Covered person</header><text>The term <term>covered person</term> means—</text> <clause id="idb681b867a3b246e6974a06d72d62778d"><enum>(i)</enum><text>an individual who is a citizen or national of a covered country; or</text></clause>
<clause id="id88d374600cd946799f8a424d6fe2f253"><enum>(ii)</enum><text>an entity organized under the laws of a covered country or otherwise subject to the jurisdiction of the government of a covered country.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="id02a3cd4c10fa45aabbcf207d9676ef02"><enum>3.</enum><header>Export control treatment of subsidiaries of entities on the Entity List</header> <subsection commented="no" display-inline="no-display-inline" id="ide9482eaa42cf476aab83651b8208ece4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of Commerce shall revise part 744 of title 15, Code of Federal Regulations, to ensure that the same requirements and restrictions that apply to an entity on the Entity List apply to an entity owned or controlled by an entity on the Entity List, including an entity—</text>
<paragraph id="idc9f61ea2164b46c5ba2b6e0493141809"><enum>(1)</enum><text>50 percent or more of the ownership interest in which is held in the aggregate, directly or indirectly, by one or more entities on the Entity List; or</text></paragraph> <paragraph id="idc3856789d3054860b4a1a1c42b5226d7"><enum>(2)</enum><text>that the Secretary of Commerce considers to have an interest in all property and interests in property of an entity in which 50 percent or more of the ownership interest is held in the aggregate, directly or indirectly, by one or more entities on the Entity List.</text></paragraph></subsection>
<subsection id="idfd31e48becee4e55926398a8b16896d0"><enum>(b)</enum><header>Entity list defined</header><text>In this section, the term <term>Entity List</term> means the list maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations. </text></subsection></section> </legis-body> </bill>
