which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20241121">November 21, 2024</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment and an amendment to the title</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of the Interior to carry out watershed pilots, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Watershed Results Act</short-title></quote>.</text></section><section id="id48274ea58438420e957dd2a47fa5fb8f" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id69d5c7bb1ac74e95bfe8b14fc03b313f"><enum>(1)</enum><header>Advance watershed analytics</header><text>The term <term>advance watershed analytics</term> means the technical analysis that is—</text><subparagraph id="id897af48870ae49f08c983eccb62c4e13"><enum>(A)</enum><text>conducted before making funding available for a watershed pilot; and</text></subparagraph><subparagraph id="idb6409bf653f14e35a1b424fea8b61224"><enum>(B)</enum><text>necessary—</text><clause id="idd4a347b9f1b34d4b8fd1d48596f23cc5"><enum>(i)</enum><text>to identify specific high-impact outcome projects across an entire watershed;</text></clause><clause id="id9387dd912d61453a9e86f0ee6d034d11"><enum>(ii)</enum><text>to identify project costs and implementation feasibility constraints;</text></clause><clause id="id194a4a685e654768af23adbaf9f9e17d"><enum>(iii)</enum><text>to identify how different groups of projects impact overall watershed targets; and</text></clause><clause id="idd8cd1105494b43d991a0a1e12a37ff77"><enum>(iv)</enum><text>to develop scenarios that—</text><subclause id="id992b359b5c6344738b49399a99becbea"><enum>(I)</enum><text>maximize outcomes; and</text></subclause><subclause id="ide498ef3f7d81426c8c83432e2babf069"><enum>(II)</enum><text>are feasible to quickly implement at scale.</text></subclause></clause></subparagraph></paragraph><paragraph id="id18377b1f458c45c99f17d480fd8b9d7f"><enum>(2)</enum><header>Federal financial source</header><text>The term <term>Federal financial source</term> means an award, grant, loan, guarantee, incentive, or credit enhancement funding available to Federal agencies participating in watershed pilots.</text></paragraph><paragraph id="id5ce39b2b6e0d4e03a8a66e6bc374caee"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Environmental Outcomes Fund established by the Secretary under section 4(c)(1).</text></paragraph><paragraph id="id51db73d2031b47c89fe181bd5ac9d27f"><enum>(4)</enum><header>Management team</header><text>The term <term>management team</term> means the management team for a watershed pilot designated under section 3(b)(2).</text></paragraph><paragraph id="id0e02f42d825c43ae9bca0d13282278c9"><enum>(5)</enum><header>Outcome</header><text>The term <term>outcome</term> means—</text><subparagraph id="idfc713c7b8e51450ea37dc836a4529de3"><enum>(A)</enum><text>a quantifiable increase in surface water or groundwater; </text></subparagraph><subparagraph id="id61503be578c8437bb28353f46b6771d6"><enum>(B)</enum><text>a measurable increase in aquatic habitat quality or quantity in a watershed affected by the operation of a Bureau of Reclamation project; or</text></subparagraph><subparagraph id="ida7159dbdfba0479e83617d9231459112"><enum>(C)</enum><text>any other quantifiable benefit identified by the management team as being desirable in the applicable watershed.</text></subparagraph></paragraph><paragraph id="id5beb5d15b89548828b9c0f3bef6520c3"><enum>(6)</enum><header>Pay-for-performance contract</header><text>The term <term>pay-for-performance contract</term> means a contract to purchase successfully implemented outcomes at a negotiated per-unit price. </text></paragraph><paragraph id="idf099fa42c48a4a2380ef47905b6820fc"><enum>(7)</enum><header>Plan</header><text>The term <term>plan</term> means an actionable implementation and funding plan developed for a watershed pilot under section 3(c)(1).</text></paragraph><paragraph id="id1f8a69b7f27d4730b7db07acbecaea0a"><enum>(8)</enum><header>Qualifying project</header><text>The term <term>qualifying project</term> means a project in a Reclamation State that efficiently achieves 1 or more outcomes in pursuit of a plan, as prioritized through advance watershed analytics.</text></paragraph><paragraph id="id0560D38CD7CB4B0A979721FCB95FF090"><enum>(9)</enum><header>Reclamation State</header><text>The term <quote>Reclamation State</quote> means—</text><subparagraph id="idA4C6EEE2E039421C94CC4B1E31AC173F"><enum>(A)</enum><text> a State or territory described in the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>);</text></subparagraph><subparagraph id="id55F545463CF74D5E976277379D1EB7C0"><enum>(B)</enum><text>the State of Hawaii; and</text></subparagraph><subparagraph id="id6AB85AF7612A48E0A08831E88333C48D"><enum>(C)</enum><text>the State of Alaska.</text></subparagraph></paragraph><paragraph id="id2D379827BB8A468EA6186224B54E40B2"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id3520db8372494181a4395db6be6d5b25"><enum>(11)</enum><header>Watershed pilot</header><text>The term <term>watershed pilot</term> means a watershed pilot established under section 3(a).</text></paragraph></section><section id="id1b3fbc87e8654872bb1811baadd80882" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Watershed pilots</header><subsection id="idab274e709b694ef9ac0dfdc665f56e91"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act and subject to subsection (h), the Secretary shall establish a total of not less than 2 and not more than 5 watershed pilots in a Reclamation State.</text></subsection><subsection id="id947ed540ec2041f88423e6c6248cb344"><enum>(b)</enum><header>Management of watershed pilots</header><paragraph id="idff47481ef18c45988cb311828a3fdbbf"><enum>(1)</enum><header>Management by Secretary</header><text>Management and responsibility for each watershed pilot shall be led by the Secretary.</text></paragraph><paragraph id="id41fe7331009b4bd99b6a9693bf3113ca"><enum>(2)</enum><header>Management team</header><text>The Secretary shall designate a management team for the watershed pilot, which shall be composed of representatives appointed by the Secretary. </text></paragraph><paragraph id="id2d24049246ca4fb580bd9eb4d42d4d8e"><enum>(3)</enum><header>Consultation</header><text>In establishing and carrying out a watershed pilot, the Secretary and the management team shall consult with—</text><subparagraph id="id9d8705657b00480eab3799ea602c492a"><enum>(A)</enum><text>State, local, and Tribal representatives;</text></subparagraph><subparagraph id="id9a4cf96435b84186ac499c839d01fcad"><enum>(B)</enum><text>nongovernmental organizations, including water and irrigation districts;</text></subparagraph><subparagraph id="id5016fa5f75e94af6b0e9129e8e6e1e34"><enum>(C)</enum><text>private sector representatives; and</text></subparagraph><subparagraph id="id1ccb96312d5742e1ae4ccbf351e5fda5"><enum>(D)</enum><text>such other individuals or entities as the Secretary and the management team determine to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="id1301f593768e4feea89699742c8db14f"><enum>(c)</enum><header>Plan</header><paragraph id="id0de0bc644c41424ea5cb1ea7a18ffded"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which a watershed pilot is established, the management team for the applicable watershed pilot shall develop and implement a 5-year plan for carrying out the watershed pilot.</text></paragraph><paragraph id="id3531b2bcab52496fb80e56ac06b901f0"><enum>(2)</enum><header>Requirements</header><text>A plan shall incorporate—</text><subparagraph id="id9cfb5fdaabe04324b4fd2369aa0e2fbe"><enum>(A)</enum><text>advance watershed analytics to establish milestones, outcome targets, an implementation plan, and a timeline for achieving the milestones, targets, and full implementation;</text></subparagraph><subparagraph id="id555ef0c8361446da989d15562af9ea6c"><enum>(B)</enum><text>a coordinated cross-agency funding strategy that will—</text><clause id="id3a32197d4fa34408b5681a0a8e90d053"><enum>(i)</enum><text>achieve the milestones and outcome targets established under subparagraph (A) in an effective and flexible manner by efficiently and quickly delivering Federal financial sources to qualifying projects;</text></clause><clause id="id313982413b55458aa54686c8d7ad8ff8"><enum>(ii)</enum><text>leverage amounts made available under sections 4(c)(4) and 7 with existing Federal financial sources;</text></clause><clause id="id28f79c08f10f4276a9a00f102bf3c8fd"><enum>(iii)</enum><text>use Federal financial sources and amounts from the Fund to leverage and attract investments from private or philanthropic sources to accelerate greater outcomes-based results; and</text></clause><clause id="id010fb14d17454e75a23edabbf19d4b95"><enum>(iv)</enum><text>concentrate Federal financial source commitments from multiple agencies in a watershed pilot during the period of the watershed pilot;</text></clause></subparagraph><subparagraph id="idbf64d6f61f9e470fa6c4fa95a27617aa"><enum>(C)</enum><text>annually updated progress tracking against milestones and targets; and</text></subparagraph><subparagraph id="idc281082ab37f40c48e9aed7adb05f65d"><enum>(D)</enum><text>such other information as the Secretary determines to be relevant to achieve outcomes on an accelerated timeline.</text></subparagraph></paragraph><paragraph id="id8cf76c27989140edb0505235380ac942"><enum>(3)</enum><header>Review</header><text>A plan shall be reviewed annually by the management team. </text></paragraph></subsection><subsection id="id8c02039b2aeb4d7a84ccdc3b81bffecb"><enum>(d)</enum><header>Notification</header><text>On adoption of each plan, the Secretary shall submit to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives a notification that the watershed pilot has been established and the plan has been adopted.</text></subsection><subsection id="idef24d909798640699633f99e2f6834b3"><enum>(e)</enum><header>Disbursement of funds to qualifying projects</header><text>Not later than 30 days after the date on which the Secretary and the management team for a watershed pilot verify outcomes from the qualifying project, the Secretary and the management team for the watershed pilot shall disburse amounts from Federal financial sources, including amounts made available under sections 4(c)(4) and 7, to a qualifying project, through pay-for-performance contracts, at agreed upon outcome prices.</text></subsection><subsection id="id1b921e92c90e4f1796980b2e7c63ad22"><enum>(f)</enum><header>Minimum outcome prices</header><text>Not later than 1 year after the date on which a watershed pilot is established, the Secretary and the management team for the watershed pilot shall set and publish minimum per-unit outcome prices.</text></subsection><subsection id="id769b303295aa4f74a63efafc807fc294"><enum>(g)</enum><header>Use of advance watershed analytics</header><text>The Secretary and the management team for each watershed pilot shall use advance watershed analytics throughout the planning, implementation, measuring, and monitoring of outcomes within the watershed pilot.</text></subsection><subsection commented="no" id="idd0d66649be1941b097d7feb6048729a0"><enum>(h)</enum><header>Authority for additional pilots</header><text>The Secretary, following notification of the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives, shall approve the establishment of more than 5 watershed pilots under this section.</text></subsection></section><section id="idb794ae97dfb444b1b3ab7c3b256593ae" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>4.</enum><header>Financing and funding of watershed pilots</header><subsection id="id13754f56564e44af889ef30cf8c3228c"><enum>(a)</enum><header>Use of pay-For-Performance contracts</header><text>In carrying out a watershed pilot, the Secretary shall enter into a pay-for-performance contract to achieve outcome-based goals described in the plan developed for the watershed pilot.</text></subsection><subsection id="id7bf6a81056aa4a70a17fa339ead2c4db"><enum>(b)</enum><header>Flexibility under existing programs</header><text>The Secretary shall modify, expand, or streamline eligibility and verification criteria for existing Federal financial sources to maximize flexibility, speed, and use of Federal funds in the most effective manner to achieve outcomes under the watershed pilot.</text></subsection><subsection id="id36b279416cad463b98db1c2f72fee29b"><enum>(c)</enum><header>Environmental outcomes fund</header><paragraph id="id30ff82c2f2ec493da163828438c0b939"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an Environmental Outcomes Fund.</text></paragraph><paragraph id="id04abc93bc9c84bb09259ecaa12730496"><enum>(2)</enum><header>Use of fund</header><text>Amounts in the Fund shall only be expended on pay-for-performance contracts under a watershed pilot.</text></paragraph><paragraph id="id5c7078eb52de4714aa190dd6622694fe"><enum>(3)</enum><header>Criteria</header><text>Amounts in the Fund shall be expended in accordance with—</text><subparagraph id="id439a18b252734f90b79abc140e2ee57c"><enum>(A)</enum><text>this Act, including the plan developed for the applicable watershed pilot; and</text></subparagraph><subparagraph id="id9b0adb70dba5404ebd6d0cc1363bf6a0"><enum>(B)</enum><text>criteria established by the Secretary and the management team for the applicable watershed pilot, which shall include criteria for—</text><clause id="idfb86ea35dfaf472cb3e2a3d7dc30ee94"><enum>(i)</enum><text>eligibility of qualifying projects;</text></clause><clause id="id984beb3d75744f65b388224a77fe7401"><enum>(ii)</enum><text>types of qualifying projects;</text></clause><clause id="ida602cacc9f21422298efb4345c0af288"><enum>(iii)</enum><text>the timing of the disbursement of funds; and</text></clause><clause id="id63dad075a9e1427ea7047c91c7ad59a2"><enum>(iv)</enum><text>such other matters as the Secretary and the management team determine to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id22c69308e7324098b4a1390f50a10f22"><enum>(4)</enum><header>Mandatory funding</header><subparagraph id="id6f3e175e8745424fb0bbae446ab26b97"><enum>(A)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, on October 1, 2024, and on each October 1 thereafter through October 1, 2029, the Secretary of the Treasury shall transfer to the Secretary from the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>), $15,000,000 to be deposited in the Fund. </text></subparagraph><subparagraph id="id11084437afbb4f6a8aa5192599798c91"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall deposit into the Fund for use in accordance with this subsection the funds transferred under subparagraph (A), without further appropriation.</text></subparagraph></paragraph><paragraph id="id95cf4bb8fe6d42dc9296ca5640b39302"><enum>(5)</enum><header>Report to congress</header><text>If a watershed pilot is established as a permanent program, the Secretary may submit to Congress recommendations for modifications to funding levels and a permanent authorization of funding for the permanent program.</text></paragraph></subsection><subsection id="idf76c87b328aa4cddab73fa4f59613674"><enum>(d)</enum><header>Cost-Share waiver</header><text>Any otherwise applicable cost-share requirements for existing Federal financial sources, including under section 212(a)(1) of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1729">16 U.S.C. 1729(a)(1)</external-xref>), shall be waived for watershed pilots carried out using amounts made available under this Act.</text></subsection></section><section id="id0997a4316a1d49f286d23ed410b42014" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>5.</enum><header>Reports</header><subsection id="ida7ec6db83d4543c3afbf311a44ba0ffd"><enum>(a)</enum><header>Definition of appropriate committees of congress</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="idf1d16d631f5c414cb620e1f5b478a90b"><enum>(1)</enum><text>of the Senate—</text><subparagraph id="idd0d2dc21db5448a9bac8e60b36bb7088"><enum>(A)</enum><text>the Committee on Appropriations; and</text></subparagraph><subparagraph id="id6fe73ed397f14209b0c2cc44dde02ba1"><enum>(B)</enum><text>the Committee on Energy and Natural Resources; and</text></subparagraph></paragraph><paragraph id="ida14458f745c64b92a7c6e555e069d250"><enum>(2)</enum><text>of the House of Representatives—</text><subparagraph id="id278386e46f4d4c13bb5a45bb8317938f"><enum>(A)</enum><text>the Committee on Appropriations; and</text></subparagraph><subparagraph id="idc554949dc780422a9ed84c79ade4823b"><enum>(B)</enum><text>the Committee on Natural Resources.</text></subparagraph></paragraph></subsection><subsection id="idfac165b27c59434b813f74498cbfa4dd"><enum>(b)</enum><header>Annual reports</header><text>The Secretary shall, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the status of each watershed pilot, including progress towards the milestones described in section 3(c)(2)(A).</text></subsection><subsection id="id7329886fdad649e59c05c3c772d7adcf"><enum>(c)</enum><header>5-Year report</header><text>Not later than October 1 of the fifth fiscal year in which a watershed pilot is carried out under section 3, the Secretary shall submit to the appropriate committees of Congress a report describing, in accordance with the plan developed for the applicable watershed pilot—</text><paragraph id="id7882b504bc654c2492f7503ef9270cd8"><enum>(1)</enum><text>a summary of—</text><subparagraph id="id09af1ff2d3684207b1d6db7515d5e872"><enum>(A)</enum><text>the projected results of the watershed pilot in meeting the milestones described in section 3(c)(2)(A);</text></subparagraph><subparagraph id="id0cb1e29de7b34d8795e3f16a7237bea5"><enum>(B)</enum><text>the projected outcomes of the watershed pilot described in that section;</text></subparagraph><subparagraph id="id03029ca79143451791c439980f4a0fd5"><enum>(C)</enum><text>the total amount of funds made available under the watershed pilot;</text></subparagraph><subparagraph id="id2b4fa0e941124d208a325db7db2c5b5b"><enum>(D)</enum><text>the type of funding expended under the watershed pilot; and</text></subparagraph><subparagraph id="id70ed839545574585a2d3bb9d3922ac30"><enum>(E)</enum><text>such other information as the Secretary determines to be appropriate; and</text></subparagraph></paragraph><paragraph id="id148772ceeb794463a5197c10f4a94afc"><enum>(2)</enum><text>recommendations for continuing, terminating, or making permanent the watershed pilot.</text></paragraph></subsection><subsection id="id1b380a87a9b7459eb468ddd902a566d5"><enum>(d)</enum><header>Environmental outcomes funds</header><paragraph id="ide5344c72e2b84a69a1cb610df08ff5e8"><enum>(1)</enum><header>Secretary</header><text>The Secretary, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the outcomes achieved using amounts made available from, management of, and expenditures from, the Fund.</text></paragraph><paragraph id="id8768f316a7c24269b753d8204012ac28"><enum>(2)</enum><header>Inspectors general</header><subparagraph id="id53dc5e72126441218fa20e4d80322d6c"><enum>(A)</enum><header>Audit</header><text>The Inspector General of the Department of the Interior shall conduct a biannual audit of the management of, and funding (including expenditures) relating to, the Fund for the purpose of ensuring proper and effective use of Federal funding by evaluating the effectiveness of the watershed pilot in achieving the plan developed for the watershed pilot, including an evaluation of the outcomes achieved and the Federal financial sources used to achieve those outcomes.</text></subparagraph><subparagraph id="id7ee9bf639a42436fb07f68f614fec636"><enum>(B)</enum><header>Reports</header><text>The Inspector General of the Department of the Interior shall, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the 2 audits most recently conducted under subparagraph (A).</text></subparagraph></paragraph></subsection></section><section id="idea86ee6fb70c4ea9be8ef60996f7ee57" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>6.</enum><header>Duration</header><text display-inline="no-display-inline">Each watershed pilot shall terminate on the date that is 5 years after the date on which the notification is submitted under section 3(d) with respect to that watershed pilot.</text></section><section id="ida4346fc37a8b4563b5b4db3a780c0afa" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text><paragraph id="id34f2fc2ecc66425399a7a64cfb8d70d6"><enum>(1)</enum><text>for each watershed pilot, $15,000,000 for each of fiscal years 2024 through 2029, which shall be in addition to the amounts made available under section 4(c)(4); and</text></paragraph><paragraph id="idf670220d86524aa589313cbfd82e07b3"><enum>(2)</enum><text>to carry out advance watershed analytics for each watershed pilot, $2,000,000 for each of fiscal years 2024 through 2026.</text></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id4946e525ebd7403490ba9b810fa0db28" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Watershed Results Act</short-title></quote>.</text></section><section id="idc5cc3c1aadff44ddb28eb3df3d031f73" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id237ee6ec0f2a4f25840c77dd5f6577ea"><enum>(1)</enum><header>Advance watershed analytics</header><text>The term <term>advance watershed analytics</term> means the technical analysis that—</text><subparagraph id="id4c6b5919bde547c98067a3846607759d"><enum>(A)</enum><text>is conducted before providing funding for a watershed outcomes project;</text></subparagraph><subparagraph id="ide19b8068f2c3422bb53702132a78f80e"><enum>(B)</enum><text>identifies and quantifies the outcomes and costs of all potential qualifying activities across the watershed outcomes project; and</text></subparagraph><subparagraph id="iddd3575bc85534ac188686fb60c8e44e3"><enum>(C)</enum><text>assesses how different groups of qualifying activities in the watershed outcomes project could efficiently maximize outcomes for the least cost.</text></subparagraph></paragraph><paragraph id="idbe701d2d3f3643f89e4303b1573a2710"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id0fc6f91dca894d0cb5bcf99b0a10b0f1"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="id251291a72e3d43a186a27e7859413b0f"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7087d23d92894ab2b868ff528f330765"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> includes—</text><subparagraph id="id88a1cd77578d49baa95d168ab8edcbdf"><enum>(A)</enum><text>a State, Indian Tribe, Tribal organization, irrigation district, or water district;</text></subparagraph><subparagraph id="id6ed9fca9574d4c3ea575caac6c9ead95"><enum>(B)</enum><text>a State, regional, or local authority, the members of which include 1 or more organizations with water or power delivery authority;</text></subparagraph><subparagraph id="id9c9d137e268348178d93f54241e4acac"><enum>(C)</enum><text>any other organization with water or power delivery authority; and </text></subparagraph><subparagraph id="idc9bb3aa0e52140b8b5d95266dc23e3e4"><enum>(D)</enum><text>any nongovernmental entity. </text></subparagraph></paragraph><paragraph id="id1a27883108854072a03f8ac2f0f088b5"><enum>(4)</enum><header>Pay-for-performance contract</header><text>The term <term>pay-for-performance contract</term> means a contract to purchase verified outcomes produced by implemented qualifying activities in a watershed outcomes project at a negotiated price.</text></paragraph><paragraph id="id128070d495e4438786fe801bb4159d4d"><enum>(5)</enum><header>Qualifying activity</header><text>The term <term>qualifying activity</term> means a conservation project carried out in a watershed identified through advance watershed analytics as having a high likelihood of cost-effectively achieving 1 or more outcomes if implement consistent with applicable performance standards made available under section 3(e)(4).</text></paragraph><paragraph id="id76715d02ba3d46d6aff1a592237cd211"><enum>(6)</enum><header>Reclamation State</header><text>The term <term>Reclamation State</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbe57033116624912b84fa9253ad3ffe6"><enum>(A)</enum><text display-inline="yes-display-inline">a State or territory described in the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>);</text></subparagraph><subparagraph id="id8f3d5de84feb46c9a6800449391f4848"><enum>(B)</enum><text>the State of Hawaii;</text></subparagraph><subparagraph id="idb580ae7a3add483ca08773448b639f7b"><enum>(C)</enum><text>the State of Alaska; and</text></subparagraph><subparagraph id="idc4cc90d63b094e52989f80276ee25a70"><enum>(D)</enum><text>the Commonwealth of Puerto Rico. </text></subparagraph></paragraph><paragraph id="id854960e0003d4715ad03a2052ab230df"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation. </text></paragraph><paragraph id="id9becb86030114bf48e2cc444fbfe3731"><enum>(8)</enum><header>Watershed outcomes project</header><text>The term <term>watershed outcomes project</term> means the overall watershed project managed by the watershed partner.</text></paragraph><paragraph id="id59d4f51d226845599b8f7c9d626471ad"><enum>(9)</enum><header>Watershed partner</header><text>The term <term>watershed partner</term> means an eligible entity selected by the Secretary under section 3(a)(2) to carry out a watershed outcomes project.</text></paragraph></section><section id="idb5ae0b393ac844048b8b52606882bc87" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Watershed outcomes projects</header><subsection id="idf593b413febf49f0813f6b39c98d4c14"><enum>(a)</enum><header>Proposals; selection</header><text>The Secretary shall—</text><paragraph id="id3c608d914b6b410c8ca44b7d629c50ab"><enum>(1)</enum><text>not later than 1 year after the date of enactment of this Act, solicit the submission from eligible entities of proposals to develop and implement a strategy that develops and uses advance watershed analytics to cost-effectively carry out watershed outcomes projects to achieve meaningful watershed-scale outcomes in a Reclamation State; and</text></paragraph><paragraph id="idb7fc068b8393466cbaf2e92445578a03"><enum>(2)</enum><text>from among the proposals submitted under paragraph (1), select a watershed partner for each watershed to complete advance watershed analytics, carry out watershed outcomes projects in a Reclamation State, manage watershed partnership duties during the term of the partnership agreement, and support pay-for-performance contracts. </text></paragraph></subsection><subsection id="idfe73bbc57ccc416cb2359fa30afe2cd7"><enum>(b)</enum><header>Guidelines and criteria for proposals</header><text>The Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="id0b4b47175fe74170a0b2ade59a014ac2"><enum>(1)</enum><text display-inline="yes-display-inline">shall develop criteria and guidelines for the submission and selection of proposals under subsection (a); and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e3dd966cc7345f18db853fa57f8a32d"><enum>(2)</enum><text display-inline="yes-display-inline">for purposes of developing the criteria and guidelines under paragraph (1), may consider—</text><subparagraph id="id519c2b795bb0459a99f5d56835ec7b4f"><enum>(A)</enum><text>the scope of the proposed watershed outcomes project, including the selected subregion or basin-level watershed for consideration;</text></subparagraph><subparagraph id="idec8509d7876644a3a72fe2fa593d8aad"><enum>(B)</enum><text>the purpose and goals of the proposed watershed outcomes project;</text></subparagraph><subparagraph id="id4cdd97ff8a2f4a58a8c4ece0c7f0a834"><enum>(C)</enum><text>any stakeholder outreach conducted with respect to the proposed watershed outcomes project;</text></subparagraph><subparagraph id="id171f14c9d87b4d37a9cc2bd5379e5f54"><enum>(D)</enum><text>evidence of widespread support within the local community for, the proposed watershed outcomes project; </text></subparagraph><subparagraph id="id9015e27117d6455287b621e786f975e4"><enum>(E)</enum><text>the capability of the watershed partner to perform the required duties in accordance with subsection (d); </text></subparagraph><subparagraph id="idd870ae7d0fec4ab890bf33d27b489e18"><enum>(F)</enum><text>how the watershed partner will procure and use advance watershed analytics to identify and quantify the outcomes and costs of all potential qualifying activities for the proposed watershed outcomes project;</text></subparagraph><subparagraph id="id042474e352974862b8368a224db7e494"><enum>(G)</enum><text>estimated costs of completing advance watershed analytics and operating the proposed watershed outcomes project;</text></subparagraph><subparagraph id="id66e26a65bde84337819586c3fe396046"><enum>(H)</enum><text>the anticipated qualifying activity types that are relevant for the selected watershed identified under subparagraph (A); and </text></subparagraph><subparagraph id="ida0e4f2e58cfb45879dc90249070ed9eb"><enum>(I)</enum><text>plans for monitoring, evaluating, and reporting on progress made toward achieving the outcomes of the proposed watershed outcomes project.</text></subparagraph></paragraph></subsection><subsection id="id98f2c39272a74303a6a4d04b2bedeb9d"><enum>(c)</enum><header>Partnership agreements</header><paragraph commented="no" display-inline="no-display-inline" id="id9f6b5b365bcb45b9a66f2cd4036270a7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may enter into a partnership agreement with a watershed partner selected under subsection (a)(2) to design and implement a watershed outcomes project that uses advance watershed analytics to achieve meaningful watershed-scale outcomes in accordance with this section.</text></paragraph><paragraph id="idb1576ed5c1114143a88a793a639fc0f5"><enum>(2)</enum><header>Term</header><subparagraph commented="no" display-inline="no-display-inline" id="ida03833df8d554e4a80e8f5842d7d2919"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A partnership agreement entered into under paragraph (1) shall be for a term—</text><clause id="id662b07feea1640e68a8af2c12e6d9c46"><enum>(i)</enum><text>of not more 5 years; or</text></clause><clause id="idf6683fe5e0fe4c4d90dc83a648d6a309"><enum>(ii)</enum><text>if the Secretary determines that a longer term is necessary to meet the objectives of the watershed outcomes project, a longer term established by the Secretary.</text></clause></subparagraph><subparagraph id="idb7b17d83851c48a68b5251cfae70a08a"><enum>(B)</enum><header>Renewal</header><text>A partnership agreement entered into under paragraph (1) may be renewed for a term of not more than 5 years.</text></subparagraph><subparagraph id="id770ded87909e4af3a19c014fedd578d1"><enum>(C)</enum><header>Extension</header><text>A partnership agreement entered into under paragraph (1) or renewed under subparagraph (B) may be extended 1 time for a term of not more than 2 years, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id92dcd9655ae14d3cbf29f672ab48ded7"><enum>(3)</enum><header>Technical and financial assistance</header><text>Through a partnership agreement entered into under paragraph (1), the Secretary shall provide to a watershed partner—</text><subparagraph commented="no" display-inline="no-display-inline" id="idff3c8788f03c40afaf49a3ce84cb2262"><enum>(A)</enum><text display-inline="yes-display-inline">technical or financial assistance to design and implement a watershed outcomes project; and</text></subparagraph><subparagraph id="id860e21760c6b49eaa9121f4a9a8154f7"><enum>(B)</enum><text>grants, cooperative agreements, or other financial assistance to support—</text><clause commented="no" display-inline="no-display-inline" id="idbe71473b022a42e481a7ac045a05ae03"><enum>(i)</enum><text display-inline="yes-display-inline">the activities under subparagraph (A); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idc15851db856c4ebca9295245debeee95"><enum>(ii)</enum><text display-inline="yes-display-inline">performance payments to qualifying activities under subsection (g)(4). </text></clause></subparagraph></paragraph><paragraph id="id8141d4f9ce5443c097700f270d0d5fe9"><enum>(4)</enum><header>Project development costs</header><text>The Secretary may annually award to a watershed partner an amount equal to not more than 50 percent of estimated costs of the watershed outcomes project to carry out the duties described in subsection (d).</text></paragraph></subsection><subsection id="id0a66c078699d43c2856ab8424d9d8a7a"><enum>(d)</enum><header>Duties of watershed partners</header><text>Under a partnership agreement entered into under subsection (c)(1), the Secretary shall establish duties to be carried out by the watershed partner, including considering establishing the following duties:</text><paragraph id="id7e3a6ec0253a4cb18273c60997cac69c"><enum>(1)</enum><text>Preparing a funding and implementation strategy that uses advance watershed analytics to cost-effectively carry out a watershed outcomes project by selecting a sufficient number of qualifying activities to achieve meaningful watershed-scale outcomes by—</text><subparagraph id="id8c3b2e1467134c4a99359f8959cb06e7"><enum>(A)</enum><text>completing advance watershed analytics to identify and quantify the outcomes and costs of all potential qualifying activities for the watershed outcomes project;</text></subparagraph><subparagraph id="id8deb9cee387c482681837b9ec69c13e8"><enum>(B)</enum><text>establishing baseline metrics to support the development of setting outcome prices and performance standards for the watershed outcomes project;</text></subparagraph><subparagraph id="idea5f39a1ff8d4f209551ca4e88558f72"><enum>(C)</enum><text>developing performance standards for the watershed outcomes project;</text></subparagraph><subparagraph id="idb15fdc265c224384acf095acc781af78"><enum>(D)</enum><text>leveraging financial assistance provided by the Secretary to secure additional funds for the watershed outcomes project; </text></subparagraph><subparagraph id="id5030e40ba3d84131921bdbe1c5a134cd"><enum>(E)</enum><text>designing, recruiting, and verifying qualifying activities for the watershed outcomes project; and</text></subparagraph><subparagraph id="idb6870c5be7ce40a5a10790e8688b34fd"><enum>(F)</enum><text>providing outcome and financial accounting services relating to qualifying activities carried out to achieve outcomes.</text></subparagraph></paragraph><paragraph id="id933d158f8cdd4238996c67dd3d345254"><enum>(2)</enum><text>Using the strategy prepared under paragraph (1) to prioritize qualifying activity outreach efforts.</text></paragraph><paragraph id="idb8711464012741b89357511e6c634a5d"><enum>(3)</enum><text>Working with local stakeholders to recruit and design an implementation-ready queue of priority qualifying activities.</text></paragraph><paragraph id="id609aa4c9d7a84e67baa1872f0a3cbe0b"><enum>(4)</enum><text>Ensuring that any proposed priority qualifying activities have the support of affected local stakeholders.</text></paragraph><paragraph id="idcc22996acf27408c8ef87821d640c7f7"><enum>(5)</enum><text>Setting activity outcome prices and developing performance standards for qualifying activities.</text></paragraph><paragraph id="id79d5c8eccef5458a98ce4e7fda3286f1"><enum>(6)</enum><text>Developing a plan to carry out qualifying activities having a high likelihood of cost-effectively achieving 1 or more outcomes described in subsection (f) if implemented consistent with the applicable performance standards made available by the Secretary under subsection (e)(4).</text></paragraph><paragraph id="idda142068dc694124bfc6334c3f664f32"><enum>(7)</enum><text>Selecting, developing pay-for-performance contracts for, funding, and carrying out qualifying activities, in accordance with the plan developed under paragraph (6), to achieve meaningful watershed-scale outcomes.</text></paragraph><paragraph id="ideb5e7988ba374c22bfe6d2941d2bde05"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id63fb7a6c70a145b7af71999f3f628ce8"><enum>(A)</enum><text>Quantifying the outcomes for qualifying activities.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10e97fc9cbc141c7a35c5b41a28ae8d5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Verifying that qualifying activities have been implemented consistent with applicable performance standards.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id70b8b6f950e34c2bbeec4e0dc8081dc2"><enum>(C)</enum><text display-inline="yes-display-inline">Providing applicable documentation to the Secretary with respect to the information quantified and verified under subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph id="id7299efd146f745aa9f421a967c15a338"><enum>(9)</enum><text>Monitoring qualifying activities at appropriate levels to confirm ongoing performance. </text></paragraph><paragraph id="ida19153b91acb498bbf10d2e2c60ea822"><enum>(10)</enum><text>Other duties necessary to carry out a watershed outcomes project, as determined to be necessary by the Secretary. </text></paragraph></subsection><subsection id="id8a6a857b228944058e955efd0cde8ab5"><enum>(e)</enum><header>Duties of Secretary</header><text>Under a partnership agreement entered into under subsection (c), the Secretary shall—</text><paragraph id="ida504d6b31bd5498792d29e92a1f93b33"><enum>(1)</enum><text>ensure that there is widespread support within the local community for the watershed outcomes project;</text></paragraph><paragraph id="id8b4174c2c8d54ac880582359941a76de"><enum>(2)</enum><text>verify the advance watershed analytics completed by the watershed partner, to the maximum extent practicable;</text></paragraph><paragraph id="idd174ac25d911482cbc9f5c42944725d0"><enum>(3)</enum><text>ensure that there are made available to the public outcome price tables, by qualifying activity type, for use as the basis for negotiating pay-for-performance contracts for the applicable watershed outcomes project;</text></paragraph><paragraph id="ide76637c8d330474b80f4a95335b823e5"><enum>(4)</enum><text>ensure that there are made available to the public qualifying activity and watershed outcomes project performance standards that are to be used as the basis for—</text><subparagraph id="id863878320b9e48b0bd2f961a8a5bf7b5"><enum>(A)</enum><text>identifying, quantifying, and verifying qualifying activity outcomes; and </text></subparagraph><subparagraph id="id32c2aba8d4664d469790221f752ede5f"><enum>(B)</enum><text>executing pay-for-performance contracts;</text></subparagraph></paragraph><paragraph id="ide56d7e48694f468298408e8fb8e8f86b"><enum>(5)</enum><text>review outcome quantification and verification documentation provided by the watershed partner under subsection (d)(8)(C);</text></paragraph><paragraph id="idd649ed54da3d40df8875e045060d6035"><enum>(6)</enum><text>provide to a watershed partner financial assistance to purchase verified outcomes from qualifying activities in a watershed outcomes project, at prices set for the watershed outcomes project in accordance with this section; and</text></paragraph><paragraph id="idc9286f9f5233408aa4c30d4449d2b7ae"><enum>(7)</enum><text>coordinate with other Federal agencies, to the maximum extent practicable, to help leverage and concentrate funding into watershed outcomes projects. </text></paragraph></subsection><subsection id="id951ac316fedb4b6fbdade236d4192c63"><enum>(f)</enum><header>Required outcomes for qualifying activities</header><text>To be eligible for a performance payment under subsection (g)(4), a qualified activity shall produce 1 or more measurable, clearly defined outcomes that result in a quantifiable and verifiable— </text><paragraph id="id72db862c6f9f445c919fb6d1091cdc4d"><enum>(1)</enum><text>increase in surface water or groundwater;</text></paragraph><paragraph id="id038eb6a352da46c38709928c8cd11586"><enum>(2)</enum><text>increase in aquatic habitat quality, quantity, connectivity, or access in a watershed;</text></paragraph><paragraph id="idcf873336272b474c954289dbe721e7d8"><enum>(3)</enum><text>surface water or groundwater quality improvement, including water temperature reductions, or a reduction in salinity or nutrient or sediment runoff associated with irrigated agriculture; or</text></paragraph><paragraph id="id0d6a61cfea544d9687b6ba843a71d5f3"><enum>(4)</enum><text>other quantifiable benefits, as determined by the Secretary, likely to improve watershed health in the watershed outcomes project.</text></paragraph></subsection><subsection id="ide29fa18db6014adc9fa9f1984bfaf8e3"><enum>(g)</enum><header>Financial assistance for qualifying activities in watershed outcomes projects</header><paragraph id="id7ad5b7311c2e496db58cf492296ef9a1"><enum>(1)</enum><header>Leveraging Federal funding</header><text>To achieve meaningful watershed-scale outcomes, amounts made available under section 5 may be used to satisfy any cost-sharing requirement with respect to carrying out a watershed outcomes project. </text></paragraph><paragraph id="id5c153d5fc19345f5bdb26d6f96a7da7e"><enum>(2)</enum><header>Federal share</header><text>The Federal share of grants or other financial assistance for a watershed outcomes project under this Act shall be not more than 75 percent of the total cost of the watershed outcomes project. </text></paragraph><paragraph id="idc182ff90e9e04498942d044d7d4fac54"><enum>(3)</enum><header>Watershed partner contributions</header><text>The Secretary may—</text><subparagraph id="id273934c705da43eba958da19508c18da"><enum>(A)</enum><text>accept non-Federal contributions for a watershed outcomes project, including funding or financing secured by the watershed partner in accordance with the strategy developed under subsection (d)(1); and</text></subparagraph><subparagraph id="ida921718bcedf47b7ae018ade1f2a01c6"><enum>(B)</enum><text>use amounts accepted under subparagraph (A) to carry out activities authorized under this Act in the watershed outcomes project.</text></subparagraph></paragraph><paragraph id="idf902b65c0e2240499603afeea7b028de"><enum>(4)</enum><header>Performance payments</header><text>Not later than 90 days after the date on which a watershed partner verifies the outcomes generated from qualifying activities and confirms that the qualifying activity has been implemented consistent with the performance standards of the applicable watershed outcomes project, the Secretary shall provide financial assistance to the watershed partner to support performance payments. </text></paragraph></subsection><subsection id="id30f6852e215042229a729116f3ac1e8f"><enum>(h)</enum><header>Maximum number of watershed outcomes projects</header><text>Not more than a total of 5 watershed outcomes projects may be carried out under this section. </text></subsection><subsection id="idaf42adb513eb44679c0982c47151f181"><enum>(i)</enum><header>Restrictions on use of advance watershed analytics data</header><paragraph id="id8b63fe808625452d9fba4b64426b3597"><enum>(1)</enum><header>In general</header><text>Nothing in this Act affects or modifies existing law with respect to the treatment of personal data in the conduct by an employee of the Federal Government or a designee of an employee of the Federal Government in carrying out official duties of the Federal employee or designee under this Act.</text></paragraph><paragraph id="id7d172ff4531c40e0b80640b542959665"><enum>(2)</enum><header>Data collection</header><text>All information or data collected or assembled by a Federal employee or a designee of a Federal employee to complete advance watershed analytics activities, directly or indirectly, under this Act—</text><subparagraph id="id837e04897ffb41e09907294d7acd5aa6"><enum>(A)</enum><text>shall be used for the sole purpose of identifying, prioritizing, and funding qualifying activities in a watershed outcomes project; and</text></subparagraph><subparagraph id="id5f87ca0bb11a431ea8d0e020e27b9cec"><enum>(B)</enum><text>shall be considered to be confidential commercial information that is exempt from disclosure under section 552(b)(4) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></subparagraph></paragraph><paragraph id="id8f8f56852089468d802b8273236282cd"><enum>(3)</enum><header>Applicability to watershed partners</header><text>Any restrictions on a Federal employee under this section shall apply to an employee of a watershed partner.</text></paragraph></subsection><subsection id="id7877824e92524e71ab536df5c51aaa6d"><enum>(j)</enum><header>Effect</header><text>Nothing in this Act creates, impairs, alters, or supersedes a Federal or State water right. </text></subsection></section><section id="id9145115d85bd4312aae346f90081d435" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>4.</enum><header>Briefing; Reports</header><subsection id="id92d23f56ead542c486d10c4ecce87824"><enum>(a)</enum><header>Annual briefing or report</header><text>For each fiscal year for which a watershed outcomes project is carried out under section 3, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for that fiscal year, the Secretary shall provide to the appropriate committees of Congress a briefing or report describing the status of each watershed outcomes project, including progress towards the applicable strategy prepared under section 3(d)(1), including any payments made for outcomes.</text></subsection><subsection id="id703f4373433b477f90b98369329c410f"><enum>(b)</enum><header><enum-in-header>5</enum-in-header>-year report</header><text>Not later than October 1 of the fifth fiscal year in which a watershed outcomes project is carried out under section 3, the Secretary shall submit to the appropriate committees of Congress a report that—</text><paragraph id="id94c8f53d27824a179f377e06bf517153"><enum>(1)</enum><text>summarizes—</text><subparagraph id="idb65347a9d3bb418d8007e3646c9b7a29"><enum>(A)</enum><text>the projected results of the qualifying activities in the watershed outcomes project in meeting the strategy prepared under section 3(d)(1);</text></subparagraph><subparagraph id="id1809547042c940c68795d701cd9cd4f7"><enum>(B)</enum><text>the projected outcomes of the watershed outcomes project;</text></subparagraph><subparagraph id="idc8fcec8e4d994818b7596610c60e08bb"><enum>(C)</enum><text>the total amount of funds secured for the watershed outcomes project;</text></subparagraph><subparagraph id="id3cf2a398d96742d0a45d442bd9eaf709"><enum>(D)</enum><text>the type of funding expended under the watershed outcomes project; and</text></subparagraph><subparagraph id="id5d2420cfd9774546abb68b67c653a0e7"><enum>(E)</enum><text>such other information as the Secretary determines to be appropriate; and</text></subparagraph></paragraph><paragraph id="id69d14182b23c4272b0773f7daece7949"><enum>(2)</enum><text>includes recommendations for continuing, terminating, or making permanent the authorizations under this Act.</text></paragraph></subsection></section><section id="id60f24e38a9244642b05c3296f9d66180" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out this Act $17,000,000 for each of fiscal years 2025 through 2030.</text></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to authorize the conduct of watershed outcomes projects, and for other purposes.</quote>.</official-title-amendment><endorsement><action-date date="20241121">November 21, 2024</action-date><action-desc>Reported with an amendment and an amendment to the title</action-desc></endorsement></bill>
