which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of the Interior to carry out watershed pilots, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Watershed Results Act</short-title></quote>.</text></section><section id="id48274ea58438420e957dd2a47fa5fb8f"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id69d5c7bb1ac74e95bfe8b14fc03b313f"><enum>(1)</enum><header>Advance watershed analytics</header><text>The term <term>advance watershed analytics</term> means the technical analysis that is—</text><subparagraph id="id897af48870ae49f08c983eccb62c4e13"><enum>(A)</enum><text>conducted before making funding available for a watershed pilot; and</text></subparagraph><subparagraph id="idb6409bf653f14e35a1b424fea8b61224"><enum>(B)</enum><text>necessary—</text><clause id="idd4a347b9f1b34d4b8fd1d48596f23cc5"><enum>(i)</enum><text>to identify specific high-impact outcome projects across an entire watershed;</text></clause><clause id="id9387dd912d61453a9e86f0ee6d034d11"><enum>(ii)</enum><text>to identify project costs and implementation feasibility constraints;</text></clause><clause id="id194a4a685e654768af23adbaf9f9e17d"><enum>(iii)</enum><text>to identify how different groups of projects impact overall watershed targets; and</text></clause><clause id="idd8cd1105494b43d991a0a1e12a37ff77"><enum>(iv)</enum><text>to develop scenarios that—</text><subclause id="id992b359b5c6344738b49399a99becbea"><enum>(I)</enum><text>maximize outcomes; and</text></subclause><subclause id="ide498ef3f7d81426c8c83432e2babf069"><enum>(II)</enum><text>are feasible to quickly implement at scale.</text></subclause></clause></subparagraph></paragraph><paragraph id="id18377b1f458c45c99f17d480fd8b9d7f"><enum>(2)</enum><header>Federal financial source</header><text>The term <term>Federal financial source</term> means an award, grant, loan, guarantee, incentive, or credit enhancement funding available to Federal agencies participating in watershed pilots.</text></paragraph><paragraph id="id5ce39b2b6e0d4e03a8a66e6bc374caee"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Environmental Outcomes Fund established by the Secretary under section 4(c)(1).</text></paragraph><paragraph id="id51db73d2031b47c89fe181bd5ac9d27f"><enum>(4)</enum><header>Management team</header><text>The term <term>management team</term> means the management team for a watershed pilot designated under section 3(b)(2).</text></paragraph><paragraph id="id0e02f42d825c43ae9bca0d13282278c9"><enum>(5)</enum><header>Outcome</header><text>The term <term>outcome</term> means—</text><subparagraph id="idfc713c7b8e51450ea37dc836a4529de3"><enum>(A)</enum><text>a quantifiable increase in surface water or groundwater; </text></subparagraph><subparagraph id="id61503be578c8437bb28353f46b6771d6"><enum>(B)</enum><text>a measurable increase in aquatic habitat quality or quantity in a watershed affected by the operation of a Bureau of Reclamation project; or</text></subparagraph><subparagraph id="ida7159dbdfba0479e83617d9231459112"><enum>(C)</enum><text>any other quantifiable benefit identified by the management team as being desirable in the applicable watershed.</text></subparagraph></paragraph><paragraph id="id5beb5d15b89548828b9c0f3bef6520c3"><enum>(6)</enum><header>Pay-for-performance contract</header><text>The term <term>pay-for-performance contract</term> means a contract to purchase successfully implemented outcomes at a negotiated per-unit price. </text></paragraph><paragraph id="idf099fa42c48a4a2380ef47905b6820fc"><enum>(7)</enum><header>Plan</header><text>The term <term>plan</term> means an actionable implementation and funding plan developed for a watershed pilot under section 3(c)(1).</text></paragraph><paragraph id="id1f8a69b7f27d4730b7db07acbecaea0a"><enum>(8)</enum><header>Qualifying project</header><text>The term <term>qualifying project</term> means a project in a Reclamation State that efficiently achieves 1 or more outcomes in pursuit of a plan, as prioritized through advance watershed analytics.</text></paragraph><paragraph id="id0560D38CD7CB4B0A979721FCB95FF090"><enum>(9)</enum><header>Reclamation State</header><text>The term <quote>Reclamation State</quote> means—</text><subparagraph id="idA4C6EEE2E039421C94CC4B1E31AC173F"><enum>(A)</enum><text> a State or territory described in the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>);</text></subparagraph><subparagraph id="id55F545463CF74D5E976277379D1EB7C0"><enum>(B)</enum><text>the State of Hawaii; and</text></subparagraph><subparagraph id="id6AB85AF7612A48E0A08831E88333C48D"><enum>(C)</enum><text>the State of Alaska.</text></subparagraph></paragraph><paragraph id="id2D379827BB8A468EA6186224B54E40B2"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id3520db8372494181a4395db6be6d5b25"><enum>(11)</enum><header>Watershed pilot</header><text>The term <term>watershed pilot</term> means a watershed pilot established under section 3(a).</text></paragraph></section><section id="id1b3fbc87e8654872bb1811baadd80882"><enum>3.</enum><header>Watershed pilots</header><subsection id="idab274e709b694ef9ac0dfdc665f56e91"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act and subject to subsection (h), the Secretary shall establish a total of not less than 2 and not more than 5 watershed pilots in a Reclamation State.</text></subsection><subsection id="id947ed540ec2041f88423e6c6248cb344"><enum>(b)</enum><header>Management of watershed pilots</header><paragraph id="idff47481ef18c45988cb311828a3fdbbf"><enum>(1)</enum><header>Management by Secretary</header><text>Management and responsibility for each watershed pilot shall be led by the Secretary.</text></paragraph><paragraph id="id41fe7331009b4bd99b6a9693bf3113ca"><enum>(2)</enum><header>Management team</header><text>The Secretary shall designate a management team for the watershed pilot, which shall be composed of representatives appointed by the Secretary. </text></paragraph><paragraph id="id2d24049246ca4fb580bd9eb4d42d4d8e"><enum>(3)</enum><header>Consultation</header><text>In establishing and carrying out a watershed pilot, the Secretary and the management team shall consult with—</text><subparagraph id="id9d8705657b00480eab3799ea602c492a"><enum>(A)</enum><text>State, local, and Tribal representatives;</text></subparagraph><subparagraph id="id9a4cf96435b84186ac499c839d01fcad"><enum>(B)</enum><text>nongovernmental organizations, including water and irrigation districts;</text></subparagraph><subparagraph id="id5016fa5f75e94af6b0e9129e8e6e1e34"><enum>(C)</enum><text>private sector representatives; and</text></subparagraph><subparagraph id="id1ccb96312d5742e1ae4ccbf351e5fda5"><enum>(D)</enum><text>such other individuals or entities as the Secretary and the management team determine to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="id1301f593768e4feea89699742c8db14f"><enum>(c)</enum><header>Plan</header><paragraph id="id0de0bc644c41424ea5cb1ea7a18ffded"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which a watershed pilot is established, the management team for the applicable watershed pilot shall develop and implement a 5-year plan for carrying out the watershed pilot.</text></paragraph><paragraph id="id3531b2bcab52496fb80e56ac06b901f0"><enum>(2)</enum><header>Requirements</header><text>A plan shall incorporate—</text><subparagraph id="id9cfb5fdaabe04324b4fd2369aa0e2fbe"><enum>(A)</enum><text>advance watershed analytics to establish milestones, outcome targets, an implementation plan, and a timeline for achieving the milestones, targets, and full implementation;</text></subparagraph><subparagraph id="id555ef0c8361446da989d15562af9ea6c"><enum>(B)</enum><text>a coordinated cross-agency funding strategy that will—</text><clause id="id3a32197d4fa34408b5681a0a8e90d053"><enum>(i)</enum><text>achieve the milestones and outcome targets established under subparagraph (A) in an effective and flexible manner by efficiently and quickly delivering Federal financial sources to qualifying projects;</text></clause><clause id="id313982413b55458aa54686c8d7ad8ff8"><enum>(ii)</enum><text>leverage amounts made available under sections 4(c)(4) and 7 with existing Federal financial sources;</text></clause><clause id="id28f79c08f10f4276a9a00f102bf3c8fd"><enum>(iii)</enum><text>use Federal financial sources and amounts from the Fund to leverage and attract investments from private or philanthropic sources to accelerate greater outcomes-based results; and</text></clause><clause id="id010fb14d17454e75a23edabbf19d4b95"><enum>(iv)</enum><text>concentrate Federal financial source commitments from multiple agencies in a watershed pilot during the period of the watershed pilot;</text></clause></subparagraph><subparagraph id="idbf64d6f61f9e470fa6c4fa95a27617aa"><enum>(C)</enum><text>annually updated progress tracking against milestones and targets; and</text></subparagraph><subparagraph id="idc281082ab37f40c48e9aed7adb05f65d"><enum>(D)</enum><text>such other information as the Secretary determines to be relevant to achieve outcomes on an accelerated timeline.</text></subparagraph></paragraph><paragraph id="id8cf76c27989140edb0505235380ac942"><enum>(3)</enum><header>Review</header><text>A plan shall be reviewed annually by the management team. </text></paragraph></subsection><subsection id="id8c02039b2aeb4d7a84ccdc3b81bffecb"><enum>(d)</enum><header>Notification</header><text>On adoption of each plan, the Secretary shall submit to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives a notification that the watershed pilot has been established and the plan has been adopted.</text></subsection><subsection id="idef24d909798640699633f99e2f6834b3"><enum>(e)</enum><header>Disbursement of funds to qualifying projects</header><text>Not later than 30 days after the date on which the Secretary and the management team for a watershed pilot verify outcomes from the qualifying project, the Secretary and the management team for the watershed pilot shall disburse amounts from Federal financial sources, including amounts made available under sections 4(c)(4) and 7, to a qualifying project, through pay-for-performance contracts, at agreed upon outcome prices.</text></subsection><subsection id="id1b921e92c90e4f1796980b2e7c63ad22"><enum>(f)</enum><header>Minimum outcome prices</header><text>Not later than 1 year after the date on which a watershed pilot is established, the Secretary and the management team for the watershed pilot shall set and publish minimum per-unit outcome prices.</text></subsection><subsection id="id769b303295aa4f74a63efafc807fc294"><enum>(g)</enum><header>Use of advance watershed analytics</header><text>The Secretary and the management team for each watershed pilot shall use advance watershed analytics throughout the planning, implementation, measuring, and monitoring of outcomes within the watershed pilot.</text></subsection><subsection commented="no" id="idd0d66649be1941b097d7feb6048729a0"><enum>(h)</enum><header>Authority for additional pilots</header><text>The Secretary, following notification of the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives, shall approve the establishment of more than 5 watershed pilots under this section.</text></subsection></section><section id="idb794ae97dfb444b1b3ab7c3b256593ae"><enum>4.</enum><header>Financing and funding of watershed pilots</header><subsection id="id13754f56564e44af889ef30cf8c3228c"><enum>(a)</enum><header>Use of pay-For-Performance contracts</header><text>In carrying out a watershed pilot, the Secretary shall enter into a pay-for-performance contract to achieve outcome-based goals described in the plan developed for the watershed pilot.</text></subsection><subsection id="id7bf6a81056aa4a70a17fa339ead2c4db"><enum>(b)</enum><header>Flexibility under existing programs</header><text>The Secretary shall modify, expand, or streamline eligibility and verification criteria for existing Federal financial sources to maximize flexibility, speed, and use of Federal funds in the most effective manner to achieve outcomes under the watershed pilot.</text></subsection><subsection id="id36b279416cad463b98db1c2f72fee29b"><enum>(c)</enum><header>Environmental outcomes fund</header><paragraph id="id30ff82c2f2ec493da163828438c0b939"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an Environmental Outcomes Fund.</text></paragraph><paragraph id="id04abc93bc9c84bb09259ecaa12730496"><enum>(2)</enum><header>Use of fund</header><text>Amounts in the Fund shall only be expended on pay-for-performance contracts under a watershed pilot.</text></paragraph><paragraph id="id5c7078eb52de4714aa190dd6622694fe"><enum>(3)</enum><header>Criteria</header><text>Amounts in the Fund shall be expended in accordance with—</text><subparagraph id="id439a18b252734f90b79abc140e2ee57c"><enum>(A)</enum><text>this Act, including the plan developed for the applicable watershed pilot; and</text></subparagraph><subparagraph id="id9b0adb70dba5404ebd6d0cc1363bf6a0"><enum>(B)</enum><text>criteria established by the Secretary and the management team for the applicable watershed pilot, which shall include criteria for—</text><clause id="idfb86ea35dfaf472cb3e2a3d7dc30ee94"><enum>(i)</enum><text>eligibility of qualifying projects;</text></clause><clause id="id984beb3d75744f65b388224a77fe7401"><enum>(ii)</enum><text>types of qualifying projects;</text></clause><clause id="ida602cacc9f21422298efb4345c0af288"><enum>(iii)</enum><text>the timing of the disbursement of funds; and</text></clause><clause id="id63dad075a9e1427ea7047c91c7ad59a2"><enum>(iv)</enum><text>such other matters as the Secretary and the management team determine to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id22c69308e7324098b4a1390f50a10f22"><enum>(4)</enum><header>Mandatory funding</header><subparagraph id="id6f3e175e8745424fb0bbae446ab26b97"><enum>(A)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, on October 1, 2024, and on each October 1 thereafter through October 1, 2029, the Secretary of the Treasury shall transfer to the Secretary from the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>), $15,000,000 to be deposited in the Fund. </text></subparagraph><subparagraph id="id11084437afbb4f6a8aa5192599798c91"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall deposit into the Fund for use in accordance with this subsection the funds transferred under subparagraph (A), without further appropriation.</text></subparagraph></paragraph><paragraph id="id95cf4bb8fe6d42dc9296ca5640b39302"><enum>(5)</enum><header>Report to congress</header><text>If a watershed pilot is established as a permanent program, the Secretary may submit to Congress recommendations for modifications to funding levels and a permanent authorization of funding for the permanent program.</text></paragraph></subsection><subsection id="idf76c87b328aa4cddab73fa4f59613674"><enum>(d)</enum><header>Cost-Share waiver</header><text>Any otherwise applicable cost-share requirements for existing Federal financial sources, including under section 212(a)(1) of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1729">16 U.S.C. 1729(a)(1)</external-xref>), shall be waived for watershed pilots carried out using amounts made available under this Act.</text></subsection></section><section id="id0997a4316a1d49f286d23ed410b42014"><enum>5.</enum><header>Reports</header><subsection id="ida7ec6db83d4543c3afbf311a44ba0ffd"><enum>(a)</enum><header>Definition of appropriate committees of congress</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="idf1d16d631f5c414cb620e1f5b478a90b"><enum>(1)</enum><text>of the Senate—</text><subparagraph id="idd0d2dc21db5448a9bac8e60b36bb7088"><enum>(A)</enum><text>the Committee on Appropriations; and</text></subparagraph><subparagraph id="id6fe73ed397f14209b0c2cc44dde02ba1"><enum>(B)</enum><text>the Committee on Energy and Natural Resources; and</text></subparagraph></paragraph><paragraph id="ida14458f745c64b92a7c6e555e069d250"><enum>(2)</enum><text>of the House of Representatives—</text><subparagraph id="id278386e46f4d4c13bb5a45bb8317938f"><enum>(A)</enum><text>the Committee on Appropriations; and</text></subparagraph><subparagraph id="idc554949dc780422a9ed84c79ade4823b"><enum>(B)</enum><text>the Committee on Natural Resources.</text></subparagraph></paragraph></subsection><subsection id="idfac165b27c59434b813f74498cbfa4dd"><enum>(b)</enum><header>Annual reports</header><text>The Secretary shall, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the status of each watershed pilot, including progress towards the milestones described in section 3(c)(2)(A).</text></subsection><subsection id="id7329886fdad649e59c05c3c772d7adcf"><enum>(c)</enum><header>5-Year report</header><text>Not later than October 1 of the fifth fiscal year in which a watershed pilot is carried out under section 3, the Secretary shall submit to the appropriate committees of Congress a report describing, in accordance with the plan developed for the applicable watershed pilot—</text><paragraph id="id7882b504bc654c2492f7503ef9270cd8"><enum>(1)</enum><text>a summary of—</text><subparagraph id="id09af1ff2d3684207b1d6db7515d5e872"><enum>(A)</enum><text>the projected results of the watershed pilot in meeting the milestones described in section 3(c)(2)(A);</text></subparagraph><subparagraph id="id0cb1e29de7b34d8795e3f16a7237bea5"><enum>(B)</enum><text>the projected outcomes of the watershed pilot described in that section;</text></subparagraph><subparagraph id="id03029ca79143451791c439980f4a0fd5"><enum>(C)</enum><text>the total amount of funds made available under the watershed pilot;</text></subparagraph><subparagraph id="id2b4fa0e941124d208a325db7db2c5b5b"><enum>(D)</enum><text>the type of funding expended under the watershed pilot; and</text></subparagraph><subparagraph id="id70ed839545574585a2d3bb9d3922ac30"><enum>(E)</enum><text>such other information as the Secretary determines to be appropriate; and</text></subparagraph></paragraph><paragraph id="id148772ceeb794463a5197c10f4a94afc"><enum>(2)</enum><text>recommendations for continuing, terminating, or making permanent the watershed pilot.</text></paragraph></subsection><subsection id="id1b380a87a9b7459eb468ddd902a566d5"><enum>(d)</enum><header>Environmental outcomes funds</header><paragraph id="ide5344c72e2b84a69a1cb610df08ff5e8"><enum>(1)</enum><header>Secretary</header><text>The Secretary, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the outcomes achieved using amounts made available from, management of, and expenditures from, the Fund.</text></paragraph><paragraph id="id8768f316a7c24269b753d8204012ac28"><enum>(2)</enum><header>Inspectors general</header><subparagraph id="id53dc5e72126441218fa20e4d80322d6c"><enum>(A)</enum><header>Audit</header><text>The Inspector General of the Department of the Interior shall conduct a biannual audit of the management of, and funding (including expenditures) relating to, the Fund for the purpose of ensuring proper and effective use of Federal funding by evaluating the effectiveness of the watershed pilot in achieving the plan developed for the watershed pilot, including an evaluation of the outcomes achieved and the Federal financial sources used to achieve those outcomes.</text></subparagraph><subparagraph id="id7ee9bf639a42436fb07f68f614fec636"><enum>(B)</enum><header>Reports</header><text>The Inspector General of the Department of the Interior shall, not later than the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year for which the watershed pilot is being carried out, submit to the appropriate committees of Congress a report describing the 2 audits most recently conducted under subparagraph (A).</text></subparagraph></paragraph></subsection></section><section id="idea86ee6fb70c4ea9be8ef60996f7ee57"><enum>6.</enum><header>Duration</header><text display-inline="no-display-inline">Each watershed pilot shall terminate on the date that is 5 years after the date on which the notification is submitted under section 3(d) with respect to that watershed pilot.</text></section><section id="ida4346fc37a8b4563b5b4db3a780c0afa"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text><paragraph id="id34f2fc2ecc66425399a7a64cfb8d70d6"><enum>(1)</enum><text>for each watershed pilot, $15,000,000 for each of fiscal years 2024 through 2029, which shall be in addition to the amounts made available under section 4(c)(4); and</text></paragraph><paragraph id="idf670220d86524aa589313cbfd82e07b3"><enum>(2)</enum><text>to carry out advance watershed analytics for each watershed pilot, $2,000,000 for each of fiscal years 2024 through 2026.</text></paragraph></section></legis-body></bill>
