<official-title>To enable schools serving grades 6 through 12 that are located in rural areas or that serve Native American students to remodel or build new facilities to provide STEM classrooms and laboratories and support high-speed internet, to establish a program to support the modernization, renovation, or repair of career and technical education facilities, and for other purposes.</official-title>

<section section-type="section-one" id="id53E93EB2E4974073B84165D0196B08F2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inspiring New STEM Professionals by Investing in Renovation of Education Spaces Act</short-title></quote> or the <quote><short-title>INSPIRES Act</short-title></quote>.</text></section> <section id="id24DA3C2FEF694166A68437B7BF67647B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph commented="no" id="id307ee5625d8c4c9690c21cbf82606fb3"><enum>(1)</enum><text>Technological advancement has increased the types of jobs available now and for the foreseeable future. Over the next 10 years, employers will be looking to fill an estimated 821,300 openings for the top 10 occupations in the collective fields of science, technology, engineering, and mathematics (referred to in this section as <quote>STEM</quote>). STEM jobs pay well; STEM workers earn an average of $22,000 per year more than non-STEM workers at every education level. However, projections suggest that the United States won’t have enough skilled workers to fill STEM jobs.</text></paragraph> <paragraph commented="no" id="ide2e5f85125dd4d58aa8e6b205a347658"><enum>(2)</enum><text>STEM skills and knowledge are now required in a wide range of occupations, including many that are not traditionally considered to be science or engineering-related, such as sustainable agriculture, management of natural resources, and health care. </text></paragraph>
<paragraph commented="no" id="id13D2F98D7C474041A86B5B236FC0244B"><enum>(3)</enum><text>Because of the growing use of STEM skills across all job sectors, the distinction between a “rural” as compared to an “urban” job is blurring. For instance, renewable energy development and bio-based product manufacturing employ workers in a variety of areas of the United States. Known as the “new collar” economy, the phenomenal growth in job opportunities for those who are prepared will also support the growth of communities: places to raise families and invest in the future.</text></paragraph> <paragraph commented="no" id="id1371aa167e914c538b38c833fb7952db"><enum>(4)</enum><text>Good STEM experiences in middle school will lead to positive attitudes toward and expectations of STEM experiences in high school. In the middle grades, students begin to demonstrate formal logical operations (critical thinking). Further, middle school students have been shown to be highly susceptible to developing opinions about their competence and interest in STEM learning. </text></paragraph>
<paragraph commented="no" id="idDC4D0B4B403F47BFAF19A205A7710728"><enum>(5)</enum><text>Providing students with additional time in after school and summer STEM programs allows students opportunities to engage in hands-on learning that sparks interest in STEM fields and careers. Students who engage in well-designed laboratory experiences develop problem-solving and critical-thinking skills, and gain exposure to reactions, materials, and equipment in a lab setting. Sustained investments in hands-on experiences help inspire students to further their education and prepare them for high-technology careers by fostering skills sought by potential employers. Hands-on experiences significantly advance learning at all levels of science education when appropriately designed and guided by qualified educators, in a safe learning environment that is student-centered and curriculum-driven. The classroom should contain enough resources, space, and storage to permit long-term multidisciplinary projects, individual and small-group learning, and inquiry and project-based learning.</text></paragraph> <paragraph id="idb0e7b56d780c4ebf961e0f2d97355750"><enum>(6)</enum><text>The United States has unique trust and treaty obligations to provide comprehensive quality educational opportunities to American Indians, Alaska Natives, and Native Hawaiians and support Native-serving schools. However, many Native American students do not have equitable access to STEM educational opportunities. Surveys suggest that fewer than half of all American Indian and Alaska Native public high school students have access to a full range of mathematics and science courses. Additionally, schools serving Native students frequently dismissed and devalued traditional STEM knowledge, discouraging Native student engagement in STEM areas. As a result, Native Americans receive only 0.6 percent of STEM undergraduate degrees and account for only 0.3 percent of the United States engineering workforce.</text></paragraph>
<paragraph commented="no" id="id8042484C262742178C18C8CA4B801990"><enum>(7)</enum><text>To meet the challenge of educating youth to fulfill the demand for STEM workers, public schools in the United States must be equipped to educate all youth in STEM skills, especially youth who are underserved or socially disadvantaged.</text></paragraph> <paragraph commented="no" id="id45ED02D7F852400F8E2F64A36ECC1E64"><enum>(8)</enum><text>The median age of United States schools is 65 years. Nearly 50 percent of school buildings in the United States need significant repairs or upgrades, including clean and safe classrooms and laboratory spaces, up-to-date technology, and broadband. Moreover, the condition of school facilities has a measurable effect on student achievement.</text></paragraph>
<paragraph id="id037f11b6df0740bf8592580698c46a01"><enum>(9)</enum><text>For all of these reasons, the future workforce of the United States needs safe, clean, well-equipped school facilities where all students can reach their full potential and learn the knowledge and skills that place them on a secure pathway to enhance the capacity of the United States to compete globally.</text></paragraph></section> <section id="id91E8E41C562947049A2F20F126F6D86C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id1d2e03e0416a4c5e9d591c94fd593d2f"><enum>(1)</enum><header>Career and technical education</header><text>The term <term>career and technical education</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idbbdf5fe963aa41afb0418b8129065b9c"><enum>(2)</enum><header>Community college</header><text>The term <term>community college</term> means a public institution of higher education at which the predominant degree awarded to students is an associate’s degree, including a 2-year Tribal College or University as defined in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>) and a public 2-year State institution of higher education.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idB496D06AEE8B406DB3805085A3041C1A"><enum>(3)</enum><header>Educational service agency</header><text>The term <term>educational service agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="id9E26DD764DA4490181FF30F18D2EADDB"><enum>(4)</enum><header>Eligible agency</header><text>The term <term>eligible agency</term> means a local educational agency, a consortium of local educational agencies, or an educational service agency.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8F2B32BF9A984D6592D71B09FFFBEE1F"><enum>(5)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id5CEE2C1A06D04A8CA0F447512079F6CE"><enum>(A)</enum><text display-inline="yes-display-inline">an eligible institution;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id9EED2BE58AA041E69E330CBE9C2F0269"><enum>(B)</enum><text display-inline="yes-display-inline">a community college;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7CEC472C4A15422DA1B6A83B83D013C8"><enum>(C)</enum><text display-inline="yes-display-inline">a local educational agency or consortium of local educational agencies;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idA8BCA7C1EC5F4419BD8585EF2A0A72AC"><enum>(D)</enum><text>an educational service agency; </text></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="id18A91531918C4AC086862E7AC95B1154"><enum>(E)</enum><text>a tribal educational agency;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id0B3631E59AEE4A2B8A9F82AF1461E0C4"><enum>(F)</enum><text display-inline="yes-display-inline">an Indian Tribe;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id11FFE1F71ECB4D6E83CFE1C3FFEF3F77"><enum>(G)</enum><text display-inline="yes-display-inline">a Tribal organization; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id1D7D4BED1C8D43B08AD9977124295BF2"><enum>(H)</enum><text display-inline="yes-display-inline">another entity determined appropriate by the Secretary.</text></subparagraph></paragraph> <paragraph id="idEF43300DAB784A30B5FC8C0E715C5E64"><enum>(6)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means any of the following:</text>
<subparagraph commented="no" id="iddd5292b2ffc84f5db763f1870c10dce5"><enum>(A)</enum><text>An Alaska Native-serving institution or a Native Hawaiian-serving institution (as such terms are defined in section 317 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d</external-xref>)), a Native American-serving, nontribal institution (as defined in section 319 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059f">20 U.S.C. 1059f</external-xref>)), or an Asian American and Native American Pacific Islander-serving institution (as defined in section 320 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g</external-xref>)).</text></subparagraph> <subparagraph commented="no" id="id02568306e0de4da3819878b25e8bfd9a"><enum>(B)</enum><text>A Tribal College or University, as defined in section 316(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text></subparagraph>
<subparagraph commented="no" id="ide6e5fd35a15e4fc99edd75690ac265bf"><enum>(C)</enum><text>An 1890 Institution, as defined in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>).</text></subparagraph> <subparagraph commented="no" id="idc0c035ee04a6404c91b0db72e085ad05"><enum>(D)</enum><text>A 1994 Institution, as defined in section 2 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>).</text></subparagraph>
<subparagraph commented="no" id="id75e6809b9c9b48f3bde623389e92b056"><enum>(E)</enum><text>A Hispanic-serving agricultural college or university, as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idC9E4F9EACD6E41529BE04302BFE18AEE"><enum>(F)</enum><text>A minority-serving institution, which shall be defined as an eligible institution under section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>). </text></subparagraph></paragraph>
<paragraph id="idD62ED623AAAF49E08B01CD3C1D336608"><enum>(7)</enum><header>Eligible school</header><text>The term <term>eligible school</term> means—</text> <subparagraph id="id81EAA75EACC94913AB9A3DB959085FCE"><enum>(A)</enum><text>a public school that—</text>
<clause id="id61C4074B737F4000B0CA2ECE4FCD0C96"><enum>(i)</enum><text>serves students in any of grades 6 through 12; and</text></clause> <clause id="id19B4596E39AB4912B4725E79BF531A40"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id5FBA07F3F5A84F0B8A685AD3E4F907C6"><enum>(I)</enum><text>is located—</text>
<item id="idFB844A19FD9F47BFAC4701E9324D4395" indent="up1"><enum>(aa)</enum><text>in a rural area, as defined in section 25.503 of title 7, Code of Federal Regulations, or any successor regulation;</text></item> <item id="id4CE1CCBA90A248388C4C1BC145E4B686" indent="up1"><enum>(bb)</enum><text>on or near trust land;</text></item>
<item id="idF521AB8409894B67A1C34614E7AAC605" indent="up1"><enum>(cc)</enum><text>on or near a substantially underserved trust area, as defined in section 306F(a) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/936f">7 U.S.C. 936f(a)</external-xref>); or</text></item> <item id="id61F06D4D32B24CB9A07207F7D2B3EA84" indent="up1"><enum>(dd)</enum><text>in an eligible community, as defined in section 1456 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-16">42 U.S.C. 300j–16</external-xref>); or </text></item></subclause>
<subclause indent="up1" id="id77BA3A4F193C4393B32D78D7256CAAF6"><enum>(II)</enum><text>is determined by an Indian Tribe or Tribal organization to serve Native American students; or</text></subclause></clause></subparagraph> <subparagraph id="id8ECA3312DFE74F1B879B7D42C51BE5AF"><enum>(B)</enum><text>a Bureau-funded school, as defined in section 1141 of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2021">25 U.S.C. 2021</external-xref>). </text></subparagraph></paragraph>
<paragraph id="idAA98F1FE8EAC48DEAA70A86C030DDCD0"><enum>(8)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> <paragraph id="id07BA6ADCE1624642BCB499AEE2977976"><enum>(9)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph>
<paragraph id="id1E771EB8C1A5406EBE418E9235807B0F"><enum>(10)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801 et seq.</external-xref>).</text></paragraph> <paragraph id="id3D73C3A5047345B8B8A1A9DEF1F19E30"><enum>(11)</enum><header>Native American</header><text>The term <term>Native American</term> has the meaning given the term in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>).</text></paragraph>
<paragraph id="id9526996160AB429DB3589F016AF3FD36"><enum>(12)</enum><header>Public-private partnership</header><text>The term <quote>public-private partnership</quote> means a partnership—</text> <subparagraph id="id4CC5778C9E6144888FE45E78F75A6776"><enum>(A)</enum><text>between a State or an eligible agency and a private entity (which may be a nonprofit organization, business, or other nongovernmental entity); and</text></subparagraph>
<subparagraph id="idE33D9C42D2414682BEC12FC92AF9FEAD"><enum>(B)</enum><text>through which the private entity will provide some or all of the required match under section 4(e).</text></subparagraph></paragraph> <paragraph id="id76D76C89A1C94B668709DB2A6FD80A08"><enum>(13)</enum><header>Qualified STEM education facility project</header><text>The term <term>qualified STEM education facility project</term> means—</text>
<subparagraph id="id9072A539CE3B4AFEB452D5D60FE29BEB"><enum>(A)</enum><text>the modernization, renovation, or repair of facilities to provide STEM classrooms or laboratories (including instrumentation and major laboratory equipment) and updates related to student and faculty health and safety, which may include—</text> <clause id="id2d8f24d640a4471894178c86a06afd2f"><enum>(i)</enum><text>improving the energy efficiency of a facility;</text></clause>
<clause id="id5248788dc6ad497ebb16594fd4381082"><enum>(ii)</enum><text>improving the cost-effectiveness of a facility in delivering quality education;</text></clause> <clause id="idc7cd0ef64a474e979468618aea1b77eb"><enum>(iii)</enum><text>improving student, faculty, and staff health and safety at a facility;</text></clause>
<clause id="id0d9ab94975ef4cba81729b2f6b18f498"><enum>(iv)</enum><text>improving, installing, or upgrading educational technology infrastructure;</text></clause> <clause id="id0d2812c6486e48049cbad0bf8a148ba4"><enum>(v)</enum><text>retrofitting an existing building for career and technical education purposes; or</text></clause>
<clause id="id747bcd8c5b724dae97d0e612ebae3c40"><enum>(vi)</enum><text>a one-time repair of serviceable equipment at a facility, or replacement of equipment at a facility that is at the end of its serviceable lifespan, that will be used to further educational outcomes; </text></clause></subparagraph> <subparagraph id="id35FF4B55DE3C41DBA686BF4E8D75F84F"><enum>(B)</enum><text>building new facilities to provide STEM classrooms or laboratories; or</text></subparagraph>
<subparagraph id="id72982EC33FD140B69329032993B1D55B"><enum>(C)</enum><text>supporting the establishment and maintenance of high-speed internet for a STEM classroom or laboratory.</text></subparagraph></paragraph> <paragraph id="id29D4E7EACFF34F5C8E0400A1B7FBFA47"><enum>(14)</enum><header>Qualified CTE facility project</header><text>The term <term>qualified CTE facility project</term>—</text>
<subparagraph id="id5C10ADED3CE54404AF373423A7BBA13B"><enum>(A)</enum><text>means the modernization, renovation, or repair of a facility that will be used to improve the quality and availability of STEM or career and technical education instruction to students, and that may include—</text> <clause id="id1c5efe4940a841a2b0864e4dee9c750e"><enum>(i)</enum><text>improving the energy efficiency of the facility;</text></clause>
<clause id="id29aa632df8644de58d9ac10b476e806e"><enum>(ii)</enum><text>improving the cost-effectiveness of the facility in delivering quality education;</text></clause> <clause id="id1ed07c0632d342a4ace742ec0e53f42e"><enum>(iii)</enum><text>improving student, faculty, and staff health and safety at the facility;</text></clause>
<clause id="id7c570a495f44499fa560d59f1e3ad409"><enum>(iv)</enum><text>improving, installing, or upgrading educational technology infrastructure;</text></clause> <clause id="idf8ab44f889a94bdda7689f9f825ea10f"><enum>(v)</enum><text>retrofitting an existing building for career and technical education purposes; or </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id543ff04e3b3b46599ad0ae7562ffbe4e"><enum>(vi)</enum><text>a one-time repair of serviceable equipment at the facility, or replacement of equipment at the facility that is at the end of its serviceable lifespan, that will be used to further educational outcomes; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id890E932835924E3B865FCEF8BDB78DBF"><enum>(B)</enum><text>does not include new construction or the payment of routine maintenance costs. </text></subparagraph></paragraph>
<paragraph id="idAD8095E1BE24459DBD85B8EC6B37DD97"><enum>(15)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph> <paragraph id="id2FFABAFECB8543CD99BE0DDC45EC656D"><enum>(16)</enum><header>STEM</header><text>The term <term>STEM</term>—</text>
<subparagraph id="id8FDA5C8AEA52495184CA7D2F783E2F1C"><enum>(A)</enum><text>means the fields of science, technology, engineering, and mathematics, and related fields (including computer science); and</text></subparagraph> <subparagraph id="id5EA6346236944EBD87C687E2D95D3922"><enum>(B)</enum><text>includes culturally based or traditional knowledge fields in science, technology, engineering, or mathematics.</text></subparagraph></paragraph>
<paragraph id="idb1d2835728ab46f3a0267dc3229e33c6"><enum>(17)</enum><header>Tribal educational agency</header><text>The term <term>tribal educational agency</term> has the meaning given the term in section 6132(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7452">20 U.S.C. 7452(b)(3)</external-xref>). </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id2827556AB6CD4B8D832D2F6B72AC8719"><enum>(18)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>). </text></paragraph>
<paragraph id="id0314a98645b44ccf833865e26524b75c"><enum>(19)</enum><header>Trust land</header><text>The term <term>trust land</term> has the meaning given the term in section 3765 of title 38, United States Code.</text></paragraph></section> <section id="id32F1E07A35A649F49EB87F3991E52A71"><enum>4.</enum><header>STEM education facilities grants</header> <subsection id="id811958E004EE468EAC1E43A6CFAE944A"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to improve STEM education facilities by awarding grants, through allotments under subsection (b), to States to enable the States to award subgrants to eligible agencies or tribal educational agencies to carry out qualified STEM education facility projects at eligible schools.</text></subsection>
<subsection commented="no" id="idF1A958EFA75847D6BD36F3313C198FCB"><enum>(b)</enum><header>Allotments and use of funds for States</header>
<paragraph commented="no" id="idC6906064E82C47299BE3A1EF1DCCC2BA"><enum>(1)</enum><header>Allotments</header><text>From amounts appropriated to carry out this section for each fiscal year and not reserved under subsection (g), the Secretary shall allot to each State that has an application approved under this section an amount that bears the same relationship as the number of schools in the State that are rural schools designated with a locale code of 41, 42, or 43, as determined by the Secretary, bears to the number of all such schools in the United States and on trust lands for that fiscal year.</text></paragraph> <paragraph commented="no" id="id55744A2F3C0A42F988187380E3CA0D7C"><enum>(2)</enum><header>Use of funds</header> <subparagraph id="iddc6ccd2f51f84cc6b630b5ce03422451"><enum>(A)</enum><header>Reservation of funds for qualified STEM education facility projects at schools serving Native Americans</header><text>From amounts provided to a State under paragraph (1), each State with 1 or more eligible schools described in item (bb) or (cc) of subclause (I), or subclause (II), of section 3(7)(A)(ii) shall reserve not less than 10 percent of the State's allotment for qualified STEM education facility projects at such eligible schools.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idAF680676589F45AEB9E2E937FAC8548F"><enum>(B)</enum><header>Use of funds for qualified STEM education facility projects</header><text>A State receiving an allotment under paragraph (1) shall, use the amount of such allotment remaining after any reservation required under subparagraph (A) to award subgrants to eligible agencies to carry out qualified STEM education facility projects at eligible schools. </text></subparagraph></paragraph></subsection> <subsection commented="no" id="ide6b8c687c96743b78c1320863bcf2bc5"><enum>(c)</enum><header>Application</header> <paragraph commented="no" id="idBFE48AD28C0642CA8519B4505BCB9853"><enum>(1)</enum><header>Grant application for States</header><text display-inline="yes-display-inline">A State that desires to receive an allotment under this section shall submit an application to the Secretary at such a time, in such a manner, and containing such information as the Secretary may require. Such information shall include, at a minimum—</text>
<subparagraph commented="no" id="idAE5441D638974A4896112C8C47D5D962"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the process that the State will use in selecting and awarding subgrants to eligible agencies; </text></subparagraph> <subparagraph commented="no" id="id63BCE29A509B4C288A601FE53A0F9B0E"><enum>(B)</enum><text>an assurance that such process will meet the requirements described in paragraph (2);</text></subparagraph>
<subparagraph commented="no" id="idC5867EE375224D4E936CB0780B8B9DB7"><enum>(C)</enum><text display-inline="yes-display-inline">an assurance that in awarding subgrants to eligible agencies, the State will give priority to eligible agencies that are part of a public-private partnership; and</text></subparagraph> <subparagraph commented="no" id="id329C70454BBC4090992824EF229D1E41"><enum>(D)</enum><text display-inline="yes-display-inline">if the State has formed a public-private partnership, a description of that partnership, including how the private entity partner will contribute to the required match under subsection (e)(1).</text></subparagraph></paragraph>
<paragraph commented="no" id="idCF920C7D70DB458CA7396FA14CFA605D"><enum>(2)</enum><header>Subgrant application</header><text>A State that receives an allotment under this section shall require an eligible agency that desires a subgrant to submit an application that contains, at a minimum, the following information:</text> <subparagraph commented="no" id="id8F0C4D06AD764BA28532D22244AD92D1"><enum>(A)</enum><text display-inline="yes-display-inline">A detailed description of each qualified STEM education facility project that the eligible agency will carry out with subgrant funds.</text></subparagraph>
<subparagraph commented="no" id="idBF6D8E057DF3401F971F029FCAEE0131"><enum>(B)</enum><text>A description of the need for each such qualified STEM education facility project.</text></subparagraph> <subparagraph commented="no" id="id84C2CD7B2113485AB46E371D9ABDA7F8"><enum>(C)</enum><text>A description of how the eligible agency will ensure that each qualified STEM education facility project will be adequately maintained.</text></subparagraph>
<subparagraph commented="no" id="id9A3C968974D74CCCA3E31D9CF8186FC4"><enum>(D)</enum><text>An identification of the eligible schools that will benefit from the qualified STEM education facility projects supported under the subgrant.</text></subparagraph> <subparagraph commented="no" id="id2D74C7C72263451B874EEBB6FCB61F79"><enum>(E)</enum><text>A description of how the facilities or internet supported by a qualified STEM education facility project will be used to provide educational services in STEM during the school day and the summer, and in after school programs.</text></subparagraph>
<subparagraph commented="no" id="idE825890BFE204E299AA9A3F391238F5E"><enum>(F)</enum><text>If the eligible agency has formed a public-private partnership, a description of that partnership, including how the private entity partner will contribute to the required match under subsection (e)(2).</text></subparagraph></paragraph></subsection> <subsection commented="no" id="idCF68B3DCFC9B4020B86828F70D1AFD42"><enum>(d)</enum><header>Environmental standards</header><text>The Secretary shall encourage, but not require, States receiving allotments under paragraph (1) to ensure that the modernization, renovation, repair, or building supported by the qualified STEM education facility project meets Leadership in Energy and Environmental Design (LEED) building rating standards, Energy Star standards, Collaborative for High Performance Schools (CHPS) criteria, Green Building Initiative environmental design and rating standards (Green Globes), the Living Building Challenge certification standards, or equivalent standards adopted by entities with jurisdiction over or related to the States. </text></subsection>
<subsection commented="no" id="id6F9FF554F21A4E2ABF53851163EA6AE9"><enum>(e)</enum><header>Matching funds</header>
<paragraph commented="no" id="id0BC264C08DB54CBBBEF7DED7E2AAD96B"><enum>(1)</enum><header>States</header><text>A State that receives a grant under this section shall provide, from non-Federal sources, an amount equal to 25 percent of the amount of the State's allotment under subsection (b)(1) to carry out activities supported by the grant. </text></paragraph> <paragraph commented="no" id="id53197FA2183544BFAFCB570365BDEE8D"><enum>(2)</enum><header>Eligible agencies</header><text>An eligible agency that receives a subgrant under subsection (b)(2)(B) shall provide, from non-Federal sources, an amount equal to 10 percent of the amount of the subgrant to carry out activities supported by the subgrant.</text></paragraph>
<paragraph commented="no" id="id67C5C9F073C24BC98316E0B1C5090FE1"><enum>(3)</enum><header>Type of match</header><text>A matching requirement under this subsection may be provided in cash or in-kind.</text></paragraph> <paragraph commented="no" id="id748858D508E6451AB443DE867225474B"><enum>(4)</enum><header>Waiver authority</header><text>The Secretary may waive the requirement under this subsection for a State if the Secretary determines that the State will be unable to satisfy the matching requirement.</text></paragraph></subsection>
<subsection id="id296FBB37A4B34160B33251C71BDF94F5"><enum>(f)</enum><header>Supplement not supplant</header><text>Funds made available under this section shall be used to supplement, and not supplant, other Federal and State funds available to carry out the activities supported under this section.</text></subsection> <subsection id="id2492deea5b55449aa572d6326f00342a"><enum>(g)</enum><header>Technical assistance and administrative costs</header><text>The Secretary may reserve not more than 3 percent of funds appropriated to carry out this section for the administrative costs of this section and to provide technical assistance to States and eligible agencies concerning best practices in carrying out qualified STEM education facility projects.</text></subsection>
<subsection id="idaa32f2b1182a445b9ac4e51d3f716002"><enum>(h)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Not later than 1 year after funds are appropriated to carry out this section, and every 2 years thereafter, the Secretary shall prepare and submit to the appropriate committees of Congress a report on the effect of the qualified STEM education facility projects supported under this section on improving academic achievement.</text></subsection></section> <section id="id1C624BA2F19D4850882685B85FDD92A7"><enum>5.</enum><header>Career and technical education facilities improvement</header> <subsection id="idB5892E269B824A858CD290B58B7F8AFB"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">From amounts appropriated to carry out this section, the Secretary shall carry out a program to improve career and technical education facilities by—</text>
<paragraph id="idD0B1C67ADBB141ADA572004582ECB463"><enum>(1)</enum><text display-inline="yes-display-inline">awarding grants to eligible entities to enable the eligible entities to carry out qualified CTE facility projects;</text></paragraph> <paragraph id="id2C27178991A440A597BA9EA5E88CB9E8"><enum>(2)</enum><text display-inline="yes-display-inline">guaranteeing loans made to eligible entities for qualified CTE facility projects; or</text></paragraph>
<paragraph id="idE02E4BCC61C44F99B3AFC1925944850C"><enum>(3)</enum><text display-inline="yes-display-inline">making payments of interest on bonds, loans, or other financial instruments (other than a refinancing) that are issued to eligible entities for qualified CTE facility projects.</text></paragraph></subsection> <subsection id="idD0DDEB2D9DD8464AAAC68B3B196D860A"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires to receive a grant, loan guarantee, or payment of interest under this section shall submit an application to the Secretary at such a time, in such manner, and containing such information as the Secretary may require. The application shall include—</text>
<paragraph id="id6e7404b0e71c4b6ab514ec68c8887060"><enum>(1)</enum><text>a detailed description of the qualified CTE facility project;</text></paragraph> <paragraph id="id47A844FBAFAE470E9BB2C51E936FCE81"><enum>(2)</enum><text>in the case of a qualified CTE facility project described in section 3(14)(A)(vi), a description of the educational outcomes to be furthered by the one-time repair of serviceable equipment or replacement of equipment;</text></paragraph>
<paragraph id="id053391ee261f46d1bf2e23cd7c345d78"><enum>(3)</enum><text>an indication as to whether the eligible entity prefers to receive a grant, loan guarantee, or payment of interest;</text></paragraph> <paragraph id="id9c8193b535f14293a50813f8095b8047"><enum>(4)</enum><text>a description of the need for the qualified CTE facility project;</text></paragraph>
<paragraph id="id32113f6be3d04ecbbe9fa68300dee3dc"><enum>(5)</enum><text>a description of how the eligible entity will ensure that the qualified CTE facility project will be adequately maintained;</text></paragraph> <paragraph id="iddd8a1c281b7649b1978ec900515d390b"><enum>(6)</enum><text>a description of how the qualified CTE facility project will improve instruction and educational outcomes at the facility, including any opportunities to integrate project activities within the curriculum of a school or institution;</text></paragraph>
<paragraph id="id693ccc858d7841588cb6d63784acbd00"><enum>(7)</enum><text>a description of how the facility supported by the qualified CTE facility project will be used for providing educational services in STEM, or career and technical education;</text></paragraph> <paragraph id="id1a2fac9470464759b58c9ff3cddef648"><enum>(8)</enum><text>if the qualified CTE facility project will seek sustainability certifications, then a description of how the modernization, renovation, or repair supported by the qualified CTE facility project meets Leadership in Energy and Environmental Design (LEED) building rating standards, Energy Star standards, Collaborative for High Performance Schools (CHPS) criteria, Green Building Initiative environmental design and rating standards (Green Globes), the Living Building Challenge certification standards, or equivalent standards adopted by entities with jurisdiction over or related to the eligible entity; </text></paragraph>
<paragraph id="idfa7bc368730f455eb9070692f80ed023"><enum>(9)</enum><text>a description of the fiscal capacity of the eligible entity;</text></paragraph> <paragraph id="id701297c043b34458911088ab4254ab88"><enum>(10)</enum><text>the percentage of students enrolled in the eligible entity or a school or institution served by the eligible entity to be served by the qualified CTE facility project who are from low-income families;</text></paragraph>
<paragraph commented="no" id="id92da76025fef44dbb2cc6f69bf0ae8d2"><enum>(11)</enum><text>in the case of a qualified CTE facility project at a facility that is used by students in a secondary school (as such term is defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), the secondary school graduation rates; </text></paragraph> <paragraph commented="no" id="idC64634C033514AA58ECAA4AE64668153"><enum>(12)</enum><text>in the case of an eligible entity that has formed a partnership with a private entity (which may include a nonprofit organization, business, or other nongovernmental entity), a description of that partnership, including how the private entity partner will contribute to the qualified CTE facility project; and</text></paragraph>
<paragraph id="id94d5368a087847c784452481e7b0dfb5"><enum>(13)</enum><text>such additional information and assurances as the Secretary may require.</text></paragraph></subsection> <subsection id="id0D2C1765E51144899770068B44EE453B"><enum>(c)</enum><header>Priority</header><text>In awarding grants, guaranteeing loans, or making payments under subsection (a), the Secretary shall give priority to eligible entities that have a partnership described in subsection (b)(12). </text></subsection>
<subsection id="id7ec6acc011624660bdd89ec2f7e9ac9c"><enum>(d)</enum><header>Supplement not supplant</header><text>Funds made available under this section shall be used to supplement, and not supplant, other Federal and State funds available to carry out the activities supported under this section.</text></subsection> <subsection id="idCCB7D02E70A5458C83F6792556EB884D"><enum>(e)</enum><header>Technical assistance and administrative costs</header><text>The Secretary may reserve a total of not more than 3 percent of funds appropriated to carry out this section—</text>
<paragraph id="id02290F1247B442FCBB6441E5A5858792"><enum>(1)</enum><text>for the administrative costs of this section; and </text></paragraph> <paragraph id="idBDCD1DEE80B44600B6E3782C06FEFB3B"><enum>(2)</enum><text>to provide technical assistance to eligible entities concerning best practices in school facility renovation, repair, and modernization.</text></paragraph></subsection>
<subsection id="id37C0C5697FB542938C260274C45649E6"><enum>(f)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Not later than 1 year after funds are appropriated to carry out this section, and every 2 years thereafter, the Secretary shall prepare and submit to the appropriate committees of Congress a report on the effect of the qualified CTE facility projects supported under this section on improving academic achievement.</text></subsection></section> <section id="id96B128BA2A644CE48555C5109BDFC664"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text>
<paragraph id="idBB0EEA6103DD4FDA8F4BA4F0AC8129A9"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out section 4, not less than $25,000,000 for fiscal year 2024 and each succeeding fiscal year; and</text></paragraph> <paragraph id="idB31D7E78BB0745798F6254032E3F954A"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out section 5, not less than $25,000,000 for fiscal year 2024 and each succeeding fiscal year.</text></paragraph></section>
