<section section-type="section-one" id="id0ca82b8890064b83b878b323d9dcf4e7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Agricultural Land Repurposing Act of 2023</short-title></quote>.</text></section> <section id="idAC3D44162BF44737867CCC06C120FF2B"><enum>2.</enum><header>Grants to States and Indian Tribes for multibenefit programs to voluntarily repurpose agricultural land to reduce consumptive water use</header> <subsection id="id1FE6958B5D0444F289FCB939BD0084FF"><enum>(a)</enum><header>Authorization of grants</header> <paragraph id="idE65C4B63A84C46439EC8F062489BAE14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101 of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2211">43 U.S.C. 2211</external-xref>) is amended—</text>
<subparagraph id="id4E0F6AF7257E4325B4B5C2ECE1C97EB2"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through (d) as subsections (c) through (e), respectively; and</text></subparagraph> <subparagraph id="idA427B8BC6F774B1987D0DF00187A2066"><enum>(B)</enum><text>by inserting after subsection (a) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idC91C858B9E85446F99796C7E60B1C067">
<subsection id="id39283C9B8A5247569D9A9FE8A7187D16"><enum>(b)</enum><header>Grants to States and Indian Tribes for multibenefit programs To voluntarily repurpose agricultural land</header>
<paragraph id="id23b74a0b7c4c407194e851ee3091b59a"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="iddb475f96c75b403f8e219c8050237c3e"><enum>(A)</enum><header>Basin-scale</header><text>The term <term>basin-scale</term> means an eligible landscape area or sub-basin that—</text>
<clause id="idA05904B9235E441BBAEAC6D8478A1AC0"><enum>(i)</enum><text>includes multiple water users; or </text></clause> <clause id="idE271357F948C439C96808DF3343958AD"><enum>(ii)</enum><text>aligns with the boundaries of a State, Tribal, regional, or local land or water management agency.</text></clause></subparagraph>
<subparagraph id="idbf1684b626ae43e0b1d3af7e219f48c1"><enum>(B)</enum><header>Covered program</header><text>The term <term>covered program</term> means an existing program of an eligible entity or a pilot program proposed to be carried out by an eligible entity, the purpose of which is to voluntarily repurpose or provide for the transition of, over a period of years, irrigated agricultural land to reduce consumptive water use, while providing community health, economic well-being, water supply, habitat, and climate benefits.</text></subparagraph> <subparagraph id="id04ce7543a6164263bdeb9bd6b5e0760e"><enum>(C)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
<clause id="id782e1b98da9942a2a3e08961c2ff7f37"><enum>(i)</enum><text>a State (including a designated State agency); or</text></clause> <clause id="idf94e750a03b74bbe8ff57c45fcf7c7ca"><enum>(ii)</enum><text>a Tribal government.</text></clause></subparagraph></paragraph>
<paragraph id="id1f6a2f4a4886467a9012e5a0270a1a46"><enum>(2)</enum><header>Authorization of grants</header><text>The Secretary shall carry out a program under which the Secretary shall provide competitive matching grants to eligible entities, in accordance with this subsection, to carry out covered programs.</text></paragraph> <paragraph id="idf3371baf70354b618e7e6bdd5be9f450"><enum>(3)</enum><header>Eligible programs</header><text>To be eligible for a grant under paragraph (2), a covered program shall—</text>
<subparagraph id="idfda5c8605f724dbba3c3fed9b8be1dd5"><enum>(A)</enum><text>be basin-scale; </text></subparagraph> <subparagraph id="id0c5c87c577054b26b21b7074c21a281b"><enum>(B)</enum><text>reduce consumptive water use; </text></subparagraph>
<subparagraph id="id970d432532c04afbb7d706167b1fe106"><enum>(C)</enum><text>repurpose or transition irrigated agricultural land for not less than 10 years; and</text></subparagraph> <subparagraph id="idba43a59d18174b9088d2e32712669b1b"><enum>(D)</enum><text>provide, for not less than 10 years, 1 or more other measurable benefits to the environment or community in which the program is being carried out, including—</text>
<clause id="id608cee5b21e7426c8ab65aa04772bf02"><enum>(i)</enum><text>restoring upland habitat;</text></clause> <clause id="id0835a53fb048453e8dbe92a803e7dd56"><enum>(ii)</enum><text>restoring riparian habitat;</text></clause>
<clause id="id134c3dd8181f4890ad221d1c47ae17c4"><enum>(iii)</enum><text>creating pollinator habitat;</text></clause> <clause id="id67ad6bc599a5459397ca3f4248d6e9a2"><enum>(iv)</enum><text>restoring flood plains connection to stream or river channels;</text></clause>
<clause id="idae0867983e4d4dcc94be5e80164b277b"><enum>(v)</enum><text>creating dedicated multibenefit recharge areas;</text></clause> <clause id="id084da42bcc29445699b65f410ef162db"><enum>(vi)</enum><text>dry-land farming or planting non-irrigated or water-saving cover crops;</text></clause>
<clause id="id74ea0df4dd3e4b9180ad110bb9a32594"><enum>(vii)</enum><text>switching from irrigated agriculture to non-irrigated rangeland;</text></clause> <clause id="id8d9b1cac788c4d0888e6065569dd0c3d"><enum>(viii)</enum><text>creating park or community recreation areas;</text></clause>
<clause id="id333f108a6d4648ba9b95ec590c488038"><enum>(ix)</enum><text>acquiring a conservation easement on land taken out of irrigated agricultural production to permanently protect a new use of the land; </text></clause> <clause id="id93730a7f5597480fa2962eadefaefbf6"><enum>(x)</enum><text>facilitation of renewable energy projects that have an overall greenhouse gas reduction; and</text></clause>
<clause id="idf5871a7cad954b148ab1fc32a2c698b3"><enum>(xi)</enum><text>reestablishment of Tribal land uses.</text></clause></subparagraph></paragraph> <paragraph id="idbc347d2a68d042978f3c9cd98bbc4f91"><enum>(4)</enum><header>Application</header><text>To be eligible for a grant under paragraph (2), an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary may require, including a description of the manner in which the eligible entity would use the grant funds to carry out projects under the covered program that reduce consumptive water use by converting irrigated agricultural land to a new use that—</text>
<subparagraph id="id72898f6b542c4c2ba768f4228aa7043b"><enum>(A)</enum><text>reduces groundwater withdrawals or consumptive water use for not less than 10 years; and</text></subparagraph> <subparagraph id="id226a2c9c18224c1bab282f6e265ff625"><enum>(B)</enum><text>provides other measurable benefits to the environment or communities in which the covered program is being carried out.</text></subparagraph></paragraph>
<paragraph id="iddbeb4bcfc13f404cab373912e7c4e882"><enum>(5)</enum><header>Priority</header><text>In providing grants under paragraph (2), the Secretary shall give priority to covered programs that—</text> <subparagraph id="idA56DCB1A61764C6894C3F68D951E2E57"><enum>(A)</enum><text>provide direct benefits to disadvantaged communities; or</text></subparagraph>
<subparagraph id="idBC9640DE570441F09C90556065EA2399"><enum>(B)</enum><text>were developed through a multi-stakeholder planning process.</text></subparagraph></paragraph> <paragraph id="idf8f7cbc4e55c4569803d1fec3d4a26f2"><enum>(6)</enum><header>Voluntary conservation agreements</header> <subparagraph commented="no" display-inline="no-display-inline" id="id9c1611eeaf81497f898c7a1d406643eb"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (C), the Secretary (acting through the Director of the United States Fish and Wildlife Service) or the Secretary of Commerce (acting through the Director of the National Marine Fisheries Service), as applicable, shall seek to enter into voluntary conservation agreements, with the individuals and entities described in subparagraph (B), under which the individuals and entities entering into the agreements would carry out on formerly irrigated agricultural land converted under a covered program carried out under this subsection or on associated aquatic resources actions that contribute to the recovery of species listed as endangered or threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idfb41a2b6d18b422f8bea884858785e28"><enum>(B)</enum><header>Entities and individuals described</header><text>The individuals and entities referred to in subparagraph (A) are the following:</text> <clause commented="no" display-inline="no-display-inline" id="id93becde736f34e30b441edb91b3ba4b7"><enum>(i)</enum><text>Eligible entities provided grants to carry out a covered program under paragraph (2).</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id054aac3835d448a2980f78eeac5c31fa"><enum>(ii)</enum><text display-inline="yes-display-inline">Owners of irrigated agricultural land converted under a covered program carried out under this subsection.</text></clause> <clause commented="no" display-inline="no-display-inline" id="idf400dda3d16b4ea9a0befcdd9985fbad"><enum>(iii)</enum><text display-inline="yes-display-inline">Owners of land adjacent to irrigated agricultural land converted under a covered program carried out under this subsection.</text></clause></subparagraph></paragraph>
<paragraph id="id1709e08c991f4fda90fc1906d8009d56"><enum>(7)</enum><header>Annual report to congress</header><text>Annually, the Secretary shall submit to the appropriate committees of Congress a report that describes the status of covered programs for which grant funds have been provided under this subsection during the period covered by the report, including a description of—</text> <subparagraph id="id59cdae51134e4a08a4d4710b1d1874eb"><enum>(A)</enum><text>the achievements and effectiveness of each covered program with respect to reducing groundwater withdrawals and reducing consumptive water use;</text></subparagraph>
<subparagraph id="ida98baaeba5bc416c917a82f50da8c17e"><enum>(B)</enum><text>the quantity of groundwater or surface water that was conserved; and</text></subparagraph> <subparagraph id="id06e22aa302e84b289da009d7cffa25ca"><enum>(C)</enum><text>the community agricultural sustainability or environmental benefits that were achieved under each covered program.</text></subparagraph></paragraph>
<paragraph id="ida19d446adce54ab68be65f42e97eea9c"><enum>(8)</enum><header>Authorization of appropriations</header>
<subparagraph id="id68a0444b296a4ee88dbdecceac07ba4d"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this subsection $250,000,000 for the period of fiscal years 2024 through 2028.</text></subparagraph> <subparagraph id="idbbc0b4215c60464093bc7a38800a19cf"><enum>(B)</enum><header>Reservation of funds</header><text>Of the amounts made available for a fiscal year under subparagraph (A), 50 percent shall be used—</text>
<clause id="id2e709b92db114fc4ae80265b4f469bfa"><enum>(i)</enum><text>to provide grants for covered programs that are pilot programs; or</text></clause> <clause id="id83b188c8d86c4f27bd83c3c8ab4b9b88"><enum>(ii)</enum><text>if no applications for grants for a pilot program for the applicable fiscal year are submitted, to provide grants to eligible covered programs that are existing programs.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="idE3114F692D0E4705B1543C944A285791"><enum>(2)</enum><header>Conforming amendments</header>
<subparagraph id="id76800B592ADA49D2BCC2A8452F97FD16"><enum>(A)</enum><text>Section 102(c) of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2212">43 U.S.C. 2212</external-xref>) is amended, in the first sentence of the matter preceding paragraph (1), by striking <quote>section 101(c)</quote> and inserting <quote>section 101(d)</quote>.</text></subparagraph> <subparagraph id="id37031F3E7D6445AE82F74C58015A4E21"><enum>(B)</enum><text>Section 301 of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2241">43 U.S.C. 2241</external-xref>) is amended by striking <quote>section 303 of this Act</quote> and inserting <quote>section 101(b)(7)(A) or 303</quote>.</text></subparagraph></paragraph></subsection>
<subsection id="id92CC90CCE0E349E3A6DB07E1E7FEAD08"><enum>(b)</enum><header>Applicable period of drought program</header><text display-inline="yes-display-inline">Section 104 of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2214">43 U.S.C. 2214</external-xref>) is amended by striking subsection (a) and inserting the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="id3088328499C14C91A146983679545D1C"> <subsection id="id8d483b82f8b2450a8e901a4f6f0b6b7d"><enum>(a)</enum><header>In general</header><text>The programs and authorities established under this title shall only become operative in a Reclamation State or in the State of Hawaii if—</text>
<paragraph id="ida878510942294e9cbd96dc2d468d1fb3"><enum>(1)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="idCEC4632893754A23813DC9626BBE4C7A"><enum>(A)</enum><text>the Governor of the affected State, or the governing body of the affected Indian Tribe with respect to a reservation, has made a request for temporary drought assistance; and </text></subparagraph> <subparagraph indent="up1" id="id19854FE542E94D8D90C925E47B96E955"><enum>(B)</enum><text>the Secretary has determined that the temporary assistance is merited;</text></subparagraph></paragraph>
<paragraph id="idcb14ea1d5693465792c661292179ae50"><enum>(2)</enum><text>a drought emergency has been declared by the Governor of the affected State; </text></paragraph> <paragraph id="id226fbb8132734a0dab2dfc81c5a77a5d"><enum>(3)</enum><text>a drought contingency plan has been approved in accordance with title II;</text></paragraph>
<paragraph id="id2e1069021579409bbf5abcd9c03436f1"><enum>(4)</enum><text>for purposes of subsection (b) of section 101, the affected State has implemented a covered program under that subsection; or</text></paragraph> <paragraph id="ida727c54fcd08453daf0bb76860d83c16"><enum>(5)</enum><text>in the case of a Colorado River Basin State, by operation of the Colorado River Basin Drought Contingency Plan executed in accordance with the Colorado River Drought Contingency Plan Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/14">Public Law 116–14</external-xref>; 133 Stat. 850).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="id4b854b00cbe943b88372cec36dfc6681"><enum>3.</enum><header>Grants to support agricultural sustainability to reduce reliance on groundwater and reduce consumptive water use</header><text display-inline="no-display-inline">Section 9504(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10364">42 U.S.C. 10364(a)</external-xref>) is amended—</text> <paragraph id="idC16E6A3734714D05BAB41B7B78DB58E7"><enum>(1)</enum><text>in paragraph (1)(J)—</text>
<subparagraph id="idE6656B9C5B6F49E08A8D02B1DAD5BBDC"><enum>(A)</enum><text>in clause (ii), by striking <quote>or</quote> at the end;</text></subparagraph> <subparagraph id="idA9360974FEC44EA68A7EFF067DE414F4"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph>
<subparagraph id="id5E83A523C72F4EB79960BB409143CB57"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9502CD2CE627453B9B716F8964F0BD9A"> <clause id="idc43f9ab06daf4d6ca77f723625e28887"><enum>(iv)</enum><text>to reduce groundwater withdrawals and otherwise reduce consumptive water use to respond to drought.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id839EDC32467143189B8E3F868BB994A0"><enum>(2)</enum><text>in paragraph (2)(B)—</text> <subparagraph id="idE8611B139D824967A215F1675502C253"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end; </text></subparagraph>
<subparagraph id="idBC1ED6111A444429888BD3EAACF13FB0"><enum>(B)</enum><text>in clause (ii)(II), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="idB5CCDFB3C6A545738FAB726FD2273B2E"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id9C79A83DDD4D4BD4B947598D059FEC2D">
<clause id="idda8d434e40a84909a61c7d811b7ecba9"><enum>(iii)</enum><text>for a project to carry out on an activity described in paragraph (1)(J)(iv)—</text> <subclause id="id70432c9e801e4c36839d5e5b55c50d24"><enum>(I)</enum><text>a proposal to repurpose irrigated agricultural land for not less than 10 years to reduce consumptive water use, while providing community health, economic well-being, water supply, habitat, and climate resilience benefits, including—</text>
<item id="idfa96985439fa4004be8746d4df0c01bd"><enum>(aa)</enum><text>restoring upland habitat;</text></item> <item id="id641913c6c1c94c008135113e232c2be5"><enum>(bb)</enum><text> restoring riparian habitat;</text></item>
<item id="idad0678f943744b9bb31a4c01aedadac2"><enum>(cc)</enum><text>creating pollinator habitat;</text></item> <item id="idecafad0c530f4a13b961e6d89a0945a0"><enum>(dd)</enum><text>restoring the connection of floodplains to stream or river channels;</text></item>
<item id="id994f81ae96914d409ba85c716c2e47fc"><enum>(ee)</enum><text>creating dedicated multi-benefit recharge areas;</text></item> <item id="idecad06c97b8440ffa8e4185c1686e411"><enum>(ff)</enum><text>dry-land farming or planting nonirrigated cover crops;</text></item>
<item id="id4480b20bb372470fad742babf9e22759"><enum>(gg)</enum><text>switching from irrigated agriculture to nonirrigated rangeland;</text></item> <item id="iddcc7743a053e4382b0abbfa9d71c43b7"><enum>(hh)</enum><text>creating park or community recreation areas;</text></item>
<item id="id2184a733f466495384ae81d6057cadc3"><enum>(ii)</enum><text>acquiring a conservation easement on land taken out of irrigated agricultural production to permanently protect any of the new uses;</text></item> <item id="id03e34b74ebc745cfbe55ffe56f8a18e0"><enum>(jj)</enum><text>facilitation of renewable energy projects that have an overall greenhouse gas reduction; and</text></item>
<item id="id5d32588fd496425bb083984eb5151eb4"><enum>(kk)</enum><text>reestablishment of Tribal land uses; and</text></item></subclause> <subclause id="idf22d39fe468146f4937d16dedfcbf868"><enum>(II)</enum><text> a demonstration of the manner in which the proposed activity would—</text>
<item id="id8257f9e2a3c649a3bea872656729380c"><enum>(aa)</enum><text>reduce groundwater withdrawals or consumptive water use for not less than 10 years; and</text></item> <item id="id1ee1cb30ec094e26bbaed2ef0748712a"><enum>(bb)</enum><text>provide other measurable benefits to the environment or disadvantaged communities.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id1095597907AE47F292CEE9391655BCD6"><enum>(3)</enum><text>in paragraph (4)—</text> <subparagraph id="idBF14CFC060E74F25BEFF3E16404D9F48"><enum>(A)</enum><text>by striking <quote>In providing</quote> and inserting the following:</text>

<subparagraph id="id4119d8b3eb3249db84fcb7e1651f4e7a"><enum>(B)</enum><header>Grants to repurpose agricultural land</header><text>For purposes of evaluating applications for grants described in paragraph (2)(B)(iii), the Secretary shall give priority to applications for proposals that provide direct benefits to disadvantaged communities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> </legis-body> </bill>
