<section id="id7fd5e641eae34f97bba35c4a7bc0d652"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idF204781ABDB94FD1B22B57316CF0F21C"><enum>(1)</enum><header>Annual report</header><text>The term <term>annual report</term> means a report required under section 102(a).</text></paragraph>
<paragraph id="id70c740fa7d654476b7303f7b06b18c4e"><enum>(2)</enum><header>Authorizing committees of Congress</header><text>The term <term>authorizing committees of Congress</term> means—</text> <subparagraph id="idb3d509623fbc45578cfc3ed2e2116e86"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph>
<subparagraph id="id6b7b721d641b41ca8a201ee514c8e972"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="idb35874d1f08e42a99a579f9614f055a4"><enum>(3)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> means a low-income community (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986). </text></paragraph>
<paragraph id="id79274F7545D34E76BF498D093CDB2FB6"><enum>(4)</enum><header>Eligible desalination project</header><text>The term <quote>eligible desalination project</quote> has the meaning given the term in paragraph (2) of section 4(a) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) (as amended by section 104(a)).</text></paragraph> <paragraph id="id225527bec3ba4b31a5f9b8bbca236f2e"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
<subparagraph id="id62075415a12a4cc6bfe712a0c0f0eb3f"><enum>(A)</enum><text>any State, political subdivision of a State, department of a State, or public agency organized pursuant to State law;</text></subparagraph> <subparagraph id="id56b9f2f32da0432d99cd9f1db9e0c537"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or an entity controlled by an Indian Tribe;</text></subparagraph>
<subparagraph id="id6458f238590147ee9cd871d8f82ce1ba"><enum>(C)</enum><text>a water users’ association;</text></subparagraph> <subparagraph id="id97306f648ac14829b1bf699788be64bb"><enum>(D)</enum><text>an agency established by an interstate compact; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id08268a70485f40b99a811f4c6647b5e5"><enum>(E)</enum><text>an agency established under State law for the joint exercise of powers. </text></subparagraph></paragraph> <paragraph id="idd9dc111c47d84c1f9cd3d0fb0fd58532"><enum>(6)</enum><header>Federal benefit</header><text>The term <term>Federal benefit</term>, with respect to a non-Federal storage project, water recycling project, or eligible desalination project, means—</text>
<subparagraph id="idaaedec372a7d426588619487aeba2e6a"><enum>(A)</enum><text>public benefits provided directly by a project;</text></subparagraph> <subparagraph id="id96bf863f8a01458e9d255431921f179d"><enum>(B)</enum><text>public benefits that—</text>
<clause id="id51f852613c204a6e9b1b2f2bc161cb30"><enum>(i)</enum><text>are—</text> <subclause id="id59FFD20BA1174B24B0721521DA397310"><enum>(I)</enum><text>fish and wildlife benefits; or</text></subclause>
<subclause id="idC8F68C84952E4008AF48BB33770BCB24"><enum>(II)</enum><text>water quality benefits; </text></subclause></clause> <clause id="id6fb2a28567394cf1b8068d320ee40bb5"><enum>(ii)</enum><text>are provided by the implementation of a watershed restoration plan approved with the project; and</text></clause>
<clause id="id6ff52335bade4a988416dbacb514bb41"><enum>(iii)</enum><text>represent an increased Federal commitment in the watershed as compared to Federal commitments before the date of approval of the project;</text></clause></subparagraph> <subparagraph id="id12a5d9a0f2b843c49e2e47008c3f3aa2"><enum>(C)</enum><text>benefits to a watershed from a water recycling project or eligible desalination project; or </text></subparagraph>
<subparagraph id="idb1b0af71b69942f395bc0bab661516fa"><enum>(D)</enum><text>water supply benefits identified in accordance with the reclamation laws. </text></subparagraph></paragraph> <paragraph id="id65a2ceca092243b1b72257470116d6f2"><enum>(7)</enum><header>Federal storage project</header><text>The term <term>Federal storage project</term> means any project constructed by the Bureau of Reclamation—</text>
<subparagraph id="id9c3559516706409798e5afee088c4f7c"><enum>(A)</enum><text>that involves the construction or expansion of—</text> <clause id="id7b0049c356b449a2bb13b9cea72e34ac"><enum>(i)</enum><text>a surface water storage facility; or</text></clause>
<clause id="id297d3a99566e432181448ee2c59fbb16"><enum>(ii)</enum><text>a facility conveying water to or from surface or groundwater storage; and</text></clause></subparagraph> <subparagraph id="id9e13b3ddcbc44c219311d1dac4be7cc2"><enum>(B)</enum><text>to which the United States holds or will hold title. </text></subparagraph></paragraph>
<paragraph id="id548EB05F5AC64AC1BB8B6AE7321CFC5B"><enum>(8)</enum><header>Natural water retention and release project</header>
<subparagraph commented="no" id="id484257B932614F4ABC90C6CEC0330AD4"><enum>(A)</enum><header>In general</header><text>The term <term>natural water retention and release project</term> means a non-Federal storage project designed and developed to increase water availability for optimal management through aquifer recharge, floodplain retention, the alteration of the timing of runoff to allow increased utilization of existing storage facilities, or another mechanism that—</text> <clause commented="no" id="id8EAAB9A023B5438CB45D4218CAEDCE43"><enum>(i)</enum><text>uses primarily natural materials appropriate to the specific site and landscape setting; and</text></clause>
<clause commented="no" id="idA7DC22AAF40C46298F15B075D7D65562"><enum>(ii)</enum><text>substantially mimics natural riverine, wetland, ecosystem, or hydrologic processes.</text></clause></subparagraph> <subparagraph commented="no" id="idC3E2D95265824F649943396D63D52895"><enum>(B)</enum><header>Inclusions</header><text>The term <term>natural water retention and release project</term> includes—</text>
<clause id="id9879436ec06244859640685cd43fcfdc"><enum>(i)</enum><text>a single natural water retention and release project;</text></clause> <clause id="id8d8cd2ffe5664432938243fbf13397a7"><enum>(ii)</enum><text>several distributed natural water retention and release projects across a watershed; and</text></clause>
<clause id="id4cf08d886d864892a70f76cd6347ca64"><enum>(iii)</enum><text>the redesign, modification, or replacement of existing infrastructure to incorporate natural water retention and release elements.</text></clause></subparagraph></paragraph> <paragraph id="id1a21b5f3b96644fca3d4ec663821e69e"><enum>(9)</enum><header>Non-Federal storage project</header><text>The term <term>non-Federal storage project</term> means any project in a Reclamation State that—</text>
<subparagraph id="id3808797bd7484f2392773c528649da29"><enum>(A)</enum><text>involves the construction, expansion, or repair by an eligible entity of—</text> <clause id="idcd05ce80a1974801a5b23ef00b2a7991"><enum>(i)</enum><text>a surface or groundwater storage project that is not federally owned; </text></clause>
<clause id="id38d27be33cdf43aebe607e0c7ddc3240"><enum>(ii)</enum><text>a facility that is not federally owned conveying water to or from surface or groundwater storage; or</text></clause> <clause id="idFE702DB6F333416C99227FE356CE5077"><enum>(iii)</enum><text>a natural water retention and release project; and </text></clause></subparagraph>
<subparagraph id="id45970f0f1a294de79e5a97ff5e6e549b"><enum>(B)</enum><text>provides a benefit in meeting any obligation under applicable Federal law (including regulations). </text></subparagraph></paragraph> <paragraph id="ida012f0c8c04b4defb98808c609739946"><enum>(10)</enum><header>Public benefit</header><text>The term <term>public benefit</term>, with respect to a non-Federal storage project or extraordinary operation and maintenance work, means—</text>
<subparagraph id="idb84c2bc0f1834376bcc04932fd5259eb"><enum>(A)</enum><text>a public benefit identified under the reclamation laws;</text></subparagraph> <subparagraph id="idf1f52e17ef184bca97f4727182dd9260"><enum>(B)</enum><text>a drinking water benefit for 1 or more disadvantaged communities, including through groundwater recharge, if—</text>
<clause id="id71ec0846c9184ffcbfe173844e0c8c42"><enum>(i)</enum><text>the drinking water meets applicable regulatory standards;</text></clause> <clause id="idf9bd93d4e80a48ceb5869fe3043c97d2"><enum>(ii)</enum><text>the drinking water benefit exceeds express mitigation or compliance requirements under Federal or State law;</text></clause>
<clause id="id2c00c4d731d84f7eb3adf180b9a259e2"><enum>(iii)</enum><text>the modified project reduces the unit cost per volume, improves water quality, or increases the reliability or quantity of the drinking water supply of the disadvantaged community as compared to the condition of the drinking water or other sources of drinking water available before the modification of the project;</text></clause> <clause id="id6f916325d9eb439b92a297a515792aa0"><enum>(iv)</enum><text>the drinking water benefit is quantified in a public process, including outreach to representatives of the affected disadvantaged community at the earliest practicable opportunity, to determine the scope of funding; and </text></clause>
<clause id="idad196af8ca494d08ad8d6c907990688b"><enum>(v)</enum><text>negative impacts on water quality for other communities are not caused as part of the modified project;</text></clause></subparagraph> <subparagraph id="id7da1406746be4057b772c60d28cef2d7"><enum>(C)</enum><text>emergency drinking water supply used in response to a disaster declaration by a Governor; and</text></subparagraph>
<subparagraph id="iddda957daedf842a3b305a58663272c87"><enum>(D)</enum><text>energy savings benefits, including—</text> <clause id="ida5b607ec626e4e02b1b68879193aadc4"><enum>(i)</enum><text>the value of associated greenhouse gas reductions; and</text></clause>
<clause id="id9bbed0a6509348639b28b36c3d107929"><enum>(ii)</enum><text>any reduction in energy costs for Federal taxpayers, such as reduced water delivery costs for water providing fish and wildlife benefits.</text></clause></subparagraph></paragraph> <paragraph id="id490088342A6F472B8BC3856DBD87FFFB"><enum>(11)</enum><header>Reclamation laws</header><text>The term <term>reclamation laws</term> means Federal reclamation law (the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>)).</text></paragraph>
<paragraph id="idfc4966d1248640f5a1d6d115bc15c9d5"><enum>(12)</enum><header>Reclamation State</header><text>The term <term>Reclamation State</term> has the meaning given the term in section 4014 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>).</text></paragraph> <paragraph id="id27eec392e94346e99a24c3324f9e7c4f"><enum>(13)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph>
<paragraph id="idb31e6cfafb28475fb03efe59578c3510"><enum>(14)</enum><header>Storage project</header><text>The term <term>storage project</term> means a Federal storage project or a non-Federal storage project.</text></paragraph> <paragraph id="id1F3BD49F92494762ACC32EEA00CF4129"><enum>(15)</enum><header>Water recycling project</header><text>The term <quote>water recycling project</quote> means a project provided a grant under section 1602(f) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(f)</external-xref>).</text></paragraph>
<paragraph id="id8493c37150ca4324bd4b473e2e008656"><enum>(16)</enum><header>Watershed</header><text>The term <term>watershed</term> includes—</text> <subparagraph id="idE63A6EE42DB54439960C4028863454A5"><enum>(A)</enum><text>an entire watershed; or </text></subparagraph>
<subparagraph id="id0B54937AA111445D980BAE34A4EFE0E9"><enum>(B)</enum><text>any portion of a watershed, including the upper or lower reaches of the watershed. </text></subparagraph></paragraph> <paragraph id="id4da244396713468995dd10dcc8b2badf"><enum>(17)</enum><header>Watershed restoration plan</header><text>The term <term>watershed restoration plan</term> means a plan approved by the Secretary that would provide benefits to the affected watershed from a non-Federal storage project and other projects and activities, including—</text>
<subparagraph id="idd924b8b71dba4fd3942d7d60bd4d6df6"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id7122C66BE49A48BF9053B6AE36EDFAC6"><enum>(i)</enum><text>restoration of fish and wildlife habitat or flows; or</text></clause> <clause id="id46222B47E70449BC874AE1FD4ABDDB9D" indent="up1"><enum>(ii)</enum><text>water quality benefits; and</text></clause></subparagraph>
<subparagraph id="id222c4a46924649c8ab98c893d964b975"><enum>(B)</enum><text>water supply benefits.</text></subparagraph></paragraph></section> <title id="ida473004cd31941c1a67cee315a27d20e"><enum>I</enum><header>Infrastructure development</header> <section id="id13b14f1262b440a3bc461a6e00ed1f8f"><enum>101.</enum><header>Storage and conveyance projects</header> <subsection id="idf1443cf8efb34cbc8ce6579e1912b365"><enum>(a)</enum><header>Storage projects</header> <paragraph id="id24C8C5A1FAB34A679A2E3B11EC55A759"><enum>(1)</enum><header>Definitions</header><text>Section 4007 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended—</text>
<subparagraph id="idF1BCD71C292747479E94AE0628895551"><enum>(A)</enum><text>by striking subsections (a) and (b) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idF73548067ADB4D38AFD4B8E65293FFD4"> <subsection id="idb1ab611846184117b7473b64d8f86555"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="idcd410d01ff7a4ba48c3843a46da97d6f" commented="no"><enum>(1)</enum><header>Design; study</header>
<subparagraph id="id13143829254f4f87b053597733b2c0c7" commented="no"><enum>(A)</enum><header>In general</header><text>The terms <term>design</term> and <term>study</term> include any design, permitting, study (including a feasibility study), materials engineering or testing, surveying, or preconstruction activity relating to a water storage facility.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id96799162b2864ed9a939f72c58449914"><enum>(B)</enum><header>Exclusions</header><text>The terms <term>design</term> and <term>study</term> do not include an appraisal study or other preliminary review intended to determine whether further study is appropriate. </text></subparagraph></paragraph>
<paragraph id="idd829288ca1714e24ac2e1eaa94a0ada0"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="id5f3172a95a8040baa03affc0630f7594"><enum>(A)</enum><text>a State, Indian Tribe, municipality, irrigation district, water district, wastewater district, or other organization with water or power delivery authority;</text></subparagraph>
<subparagraph id="id5832f92aefe6418fabdb968c75743633"><enum>(B)</enum><text>a State, regional, or local authority, the members of which include 1 or more organizations with water or power delivery authority; or</text></subparagraph> <subparagraph id="id766ffd39bfa44e708de368baa2ca87d0"><enum>(C)</enum> <clause commented="no" display-inline="yes-display-inline" id="id964aae8350d64cbebf34bce87a50d747"><enum>(i)</enum><text>an agency established under State law for the joint exercise of powers;</text></clause>
<clause id="id04bb451ecf3b498eb0da09e733949405" indent="up1"><enum>(ii)</enum><text>a combination of entities described in subparagraphs (A) and (B); or</text></clause> <clause id="id7cbf6f43af5740e5933e046463093bce" indent="up1"><enum>(iii)</enum><text>with respect to a natural water retention and release project, a qualified partner.</text></clause></subparagraph></paragraph>
<paragraph id="id2eabc86246ff4fadaa8e26cf8ba8fca3"><enum>(3)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a project described in subsection (b).</text></paragraph> <paragraph id="idC25F4CF7EBB34EFC85F5D3F6239F9435" commented="no"><enum>(4)</enum><header>Federal benefit; natural water retention and release project; non-federal storage project; public benefit; storage project; watershed; watershed restoration plan</header><text>The terms <quote>Federal benefit</quote>, <quote>natural water retention and release project</quote>, <quote>non-Federal storage project</quote>, <quote>public benefit</quote>, <quote>storage project</quote>, <quote>watershed</quote>, and <quote>watershed restoration plan</quote> have the meanings given the terms in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>.</text></paragraph>
<paragraph id="id4F80A4DCDB9442C8B824DA733DB1DE45" commented="no"><enum>(5)</enum><header>Qualified partner</header><text>The term <term>qualified partner</term> means a nonprofit organization operating in a Reclamation State that is acting with the written support of an eligible entity.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="id2C074D45FFE04FF0902B592ECC45DE1E"><enum>(B)</enum><text> by striking subsections (e), (f), and (i); and</text></subparagraph>

<subparagraph id="id5c8e546c309346c8a416842a3d79c546"><enum>(A)</enum><text>for a project that costs not more than $10,000,000, the eligible entity demonstrates that the natural water retention and release project would help optimize the storage or delivery of water in a watershed in which a Bureau of Reclamation facility is located; and</text></subparagraph> <subparagraph id="idb431345f279d46a8bf22f11ee5cf949a"><enum>(B)</enum><text>for a project that costs more than $10,000,000—</text>
<clause id="id526f0eb6401f4408a1866a2734329fff"><enum>(i)</enum><text>the requirements described in paragraph (2) have been met; and</text></clause> <clause id="idbdad581275974231a3143c7f8f7863f2"><enum>(ii)</enum><text>the eligible entity determines, and the Secretary of the Interior concurs, that—</text>
<subclause id="id946dc5573fd145c8ad08bb6fa0cbb948"><enum>(I)</enum><text>the natural water retention and release project would produce or allow additional retention or delivery of water in a watershed in which a Bureau of Reclamation facility is located; and</text></subclause> <subclause id="id1bd1454d102e42559e66a4d94d61dfa8"><enum>(II)</enum><text>there is a credible estimate of the quantity of the storage benefit of the natural water retention and release project during each of a <quote>wet</quote> year, a <quote>normal</quote> year, and a <quote>dry</quote> year.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="id62ae53f336f14ce5b48290b616754f36"><enum>(6)</enum><header>Other authorization required</header><text>Non-Federal storage projects with a Federal cost-share exceeding $250,000,000 may not be carried out under this subsection. </text></paragraph> <paragraph id="idf323b0ea38f64205a4d06b890c66cc1f"><enum>(7)</enum><header>Federal cost share</header> <subparagraph id="iddbc4e198dbe34f038cc16c702350b8cb"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of the cost of any eligible project provided a grant under this subsection shall not exceed 25 percent of the total cost of the eligible project.</text></subparagraph>
<subparagraph id="idf1c227a2228e467e850894ee8d5e6f69"><enum>(B)</enum><header>Exception</header><text>The Federal share of the cost of a natural water retention and release project provided a grant under this subsection shall not exceed 90 percent of the total cost of the natural water retention and release project.</text></subparagraph></paragraph> <paragraph id="idf4e5bb0216494fb280c3c7a288c6129f"><enum>(8)</enum><header>Reimbursability of funds</header> <subparagraph id="id3b7dc25948fc400882a9515eef96b41a"><enum>(A)</enum><header>Nonreimbursable funds</header> <clause id="id4f28872f238d46e8976d5ac663c3fbf8"><enum>(i)</enum><header>Public benefits</header><text>Subject to paragraph (7), any funds provided by the Secretary of the Interior to an eligible entity under this subsection for the value of public benefits described in subparagraphs (A) and (B) of section 2(10) of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title> shall be considered nonreimbursable.</text></clause>
<clause id="id7330b09a3a1946b4af33f1d12bceeeb3"><enum>(ii)</enum><header>Water supply benefits of equal value to public benefits</header><text>Subject to paragraph (7), any funds provided by the Secretary of the Interior for the value of Federal benefits provided under section 2(6)(D) of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title> shall be considered nonreimbursable to the extent that the value of the Federal benefits does not exceed the value of public benefits funded under clause (i) that are fish and wildlife or water quality benefits.</text></clause></subparagraph> <subparagraph id="idce4ae76cd63f40bc82cb3942bbeaee5a"><enum>(B)</enum><header>Reimbursable funds</header><text>If funds provided to an eligible entity under subparagraph (A) are less than the amount of the maximum Federal cost share applicable to the eligible project under paragraph (7), the Secretary may provide reimbursable funds to an eligible entity for any Federal benefits provided under section 2(6)(D) of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>, subject to the limitation that the total amount of Federal funds provided to an eligible entity for the eligible project under this subsection may not exceed the amount of the maximum Federal cost share applicable under paragraph (7).</text></subparagraph></paragraph>
<paragraph id="id167abe0385ce45b4800cbb457b7d5b87"><enum>(9)</enum><header>Priority</header><text>In providing grants to eligible entities for eligible projects under this subsection, the Secretary of the Interior shall give funding priority to an eligible project that directly or through watershed restoration plans approved with the project meets 2 or more of the following criteria:</text> <subparagraph id="id971665455cb4469c9ce31671f2a2c42b"><enum>(A)</enum><text>Provides multiple benefits, including substantial quantities of each of the following:</text>
<clause id="idc6a437ec4d7e4ea895ad6d2444a62461"><enum>(i)</enum><text>Water supply reliability benefits for States and communities that are frequently drought-stricken.</text></clause> <clause id="iddd282802e54b45a4b5c162c08a1ac3cd"><enum>(ii)</enum><text>Fish and wildlife benefits.</text></clause>
<clause id="id3bcd7a5c8e314cf79d2114f9169ad228"><enum>(iii)</enum><text>Water quality improvements.</text></clause></subparagraph> <subparagraph id="idac5e912188ec4e80a5919b0e79eb670a"><enum>(B)</enum><text>Reduces impacts on environmental resources from water projects owned or operated by Federal agencies and State agencies, including through measurable reductions in water diversions from imperiled ecosystems.</text></subparagraph>
<subparagraph id="idd5f2aec691f54b3b90fa19e761c87f46"><enum>(C)</enum><text>Advances water management plans across a multi-State area, such as drought contingency plans in the Colorado River Basin.</text></subparagraph> <subparagraph id="id6dfaeb1fc70a4936992947d95f27e2f1"><enum>(D)</enum><text>Is collaboratively developed or supported by multiple stakeholders.</text></subparagraph>
<subparagraph id="idb3460dfffd2e4f36986e7089d416018c"><enum>(E)</enum><text>Is located within a watershed for which an integrated, comprehensive watershed management plan has been developed to enhance resilience of ecosystems, agricultural operations, and communities to chronic water scarcity, acute drought, and changing hydrological regimes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id0e18bfab2377498a86a1a41188183c11"><enum>(3)</enum><header>Authorization of appropriations</header><text>Section 4007(e) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) (as redesignated by paragraph (1)(C)) is amended by striking paragraphs (1) and (2) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id6ADA7274858340CDA73A5F0DB3B81FD8">
<paragraph id="idf48141d35fdf44a4abc7594ca33655cc"><enum>(1)</enum><header>In general</header><text>In addition to amounts made available under section 40901(1) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201(1)</external-xref>), there is authorized to be appropriated to the Secretary of the Interior to carry out this section $750,000,000 for the period of fiscal years 2025 through 2029, of which $50,000,000 is authorized to be appropriated during that period to carry out natural water retention and release projects under subsection (b)(5).</text></paragraph> <paragraph id="id83d01b416d9e4fd98166269994227f86"><enum>(2)</enum><header>Allocation</header><text>Subject to paragraphs (3) and (4), the Secretary of the Interior shall allocate amounts made available under paragraph (1) among—</text>
<subparagraph id="id7e765da12d154b87b6930a99f17fa9a6"><enum>(A)</enum><text>the design and study of—</text> <clause id="idafae8ad9b07a4cb0a1acd12c2432a6d1"><enum>(i)</enum><text>non-Federal storage projects, including natural water retention and release projects; and</text></clause>
<clause id="idefe75b614a0a49bca7957f7a2f79a8a4"><enum>(ii)</enum><text>storage projects that are eligible for study funding under subsection (a)(1) of section 40902 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3202">43 U.S.C. 3202</external-xref>), if the amounts made available to the storage projects under this clause are provided in accordance with subsections (b) and (c) of that section; and</text></clause></subparagraph> <subparagraph id="id20e5ddab51a94efbbece7af4730b2e99"><enum>(B)</enum><text>construction of—</text>
<clause id="id4ef772ec59e64b9ba0b2281ef007a5f7"><enum>(i)</enum><text>non-Federal storage projects, including natural water retention and release projects; and</text></clause> <clause id="id7fe170c3aafb452ca0c236977fe04e5e"><enum>(ii)</enum><text>storage projects that have received construction funding in accordance with subsection (a)(2) of section 40902 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3202">43 U.S.C. 3202</external-xref>), if the amounts made available to the storage projects under this clause are provided in accordance with subsections (b) and (c) of that section.</text></clause></subparagraph></paragraph>
<paragraph id="id6178fcea4b4e4dbc9d87ab3c820122cf"><enum>(3)</enum><header>Preliminary studies</header><text>Of the amounts made available under paragraph (1), not more than 25 percent shall be provided for appraisal studies, feasibility studies, or other preliminary studies.</text></paragraph> <paragraph id="ide519234f77df41579d1cd35d5b5eacac"><enum>(4)</enum><header>Other storage projects</header><text>The funds appropriated under paragraph (1) may not be used for storage projects other than the storage projects described in paragraph (2) unless authorized by an Act of Congress.</text></paragraph>
<paragraph id="id72793c8501094d128b22a12607b31ed7"><enum>(5)</enum><header>Use of funding for public benefits</header>
<subparagraph id="id82dcf6d2e9bc49329144b75fa2b03dda"><enum>(A)</enum><header>In general</header><text>The Federal share of the cost of public benefits provided by a storage project described in paragraph (2) may be used for the capital and operations, maintenance, and replacement costs of public benefits.</text></subparagraph> <subparagraph id="idef4f6c1148194d79bab760a6fdc0f5bf"><enum>(B)</enum><header>Effect</header><text>Nothing in this paragraph precludes the Secretary from using other authorities or appropriations for the capital and operations, maintenance, and replacement costs of a non-Federal storage project to provide public benefits.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id0cd4f528f3f14f33b9fef250aa456d68"><enum>(b)</enum><header>Duration</header><text>Section 4013(2) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended by striking <quote>projects under construction in</quote>.</text></subsection> <subsection id="id1BDDEA73EC804EB7900A32DF9F5A0682"><enum>(c)</enum><header>Amendment to the infrastructure jobs and investment act</header><text>Section 40902(a)(2)(C)(i) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3202">43 U.S.C. 3202(a)(2)(C)(i)</external-xref>) is amended by striking <quote>clause (i) or (ii)</quote> and inserting <quote>clause (i), (ii), or (iii)</quote>.</text></subsection>
<subsection id="id59dd95f614e4468aaf382e5f5693a1f1"><enum>(d)</enum><header>Authorization To complete storage projects that receive construction funding</header>
<paragraph id="id104d849d057b41008db521e877148f9b"><enum>(1)</enum><header>Definition of construction</header><text>In this subsection, the term <term>construction</term> has the meaning given the term in section 4011(f) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1881).</text></paragraph> <paragraph id="id883451f5b84d4ed386445cf6f39cfa60"><enum>(2)</enum><header>Extension of existing requirements</header><text>A storage project that has received funding for construction activities in accordance with section 40901(1) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201(1)</external-xref>) shall be eligible for funding (including funding authorized under this section or an amendment made by this section), to complete construction of the project in accordance with the standards under section 40902 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3202">43 U.S.C. 3202</external-xref>). </text></paragraph></subsection>
<subsection id="id641582254F0B4CA1A5F69280947E4226" commented="no"><enum>(e)</enum><header>Calfed reauthorization</header><text>The Calfed Bay-Delta Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/361">Public Law 108–361</external-xref>; 118 Stat. 1681; 136 Stat. 221) is amended by striking ‘‘2022’’ each place it appears and inserting ‘‘2028’’.</text></subsection></section> <section id="id4ac4cd6190fa48b4bc601471ef50586a"><enum>102.</enum><header>Annual report to Congress</header> <subsection id="idbf9b2799a0e9486796b44b28e048c71b"><enum>(a)</enum><header>Annual reports</header><text>Not later than February 1 of each year, the Secretary shall develop and submit to the authorizing committees of Congress an annual report, to be entitled <quote>Report to Congress on Future Storage Project Development</quote>, that identifies—</text>
<paragraph id="id41b9e6079ad948e5845d6c172647d9e5"><enum>(1)</enum><text>each Federal storage project that the Secretary—</text> <subparagraph id="idE8A416E60E5F49DE8EC2DA0F76B10BF9"><enum>(A)</enum><text>has found to be feasible; and</text></subparagraph>
<subparagraph id="id23B2796BA1904D71A5C365BE088AA82B"><enum>(B)</enum><text>recommends that Congress authorize for construction;</text></subparagraph></paragraph> <paragraph id="id115a0de553d142fbb6396d647593c163"><enum>(2)</enum><text>each non-Federal storage project that requires congressional authorization for which the Secretary—</text>
<subparagraph id="id7FC6936AAF0B4E40B1CBDB5CD1015593"><enum>(A)</enum><text>has approved feasibility determinations; and </text></subparagraph> <subparagraph id="id6563E33F264740419A761D698746DC30"><enum>(B)</enum><text>recommends that Congress authorize the project for construction; and</text></subparagraph></paragraph>
<paragraph id="id6b9b514c677a4b8989eeda60d90bfc99"><enum>(3)</enum><text>each feasibility report that the Secretary recommends that Congress authorize for proposed Federal storage projects.</text></paragraph></subsection> <subsection id="id4815248e81bb4656a76cb9bfd3b7c7d1"><enum>(b)</enum><header>Publication</header><text>On submission of an annual report to Congress, the Secretary shall make the annual report publicly available, including through publication on the internet.</text></subsection></section>
<section id="ida23fe0b5bfce4496a07de8b15824ec57"><enum>103.</enum><header>Competitive grant program for the funding of water recycling projects</header>
<subsection id="id63e88fc0570b43a98627bbabbc3a681f"><enum>(a)</enum><header>Authorization of new water recycling projects</header><text>Section 1602 of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h</external-xref>) is amended—</text> <paragraph id="id3e764d609e344df7be7876364bffdff2"><enum>(1)</enum><text>in subsection (e)(2)(B), by striking <quote>in accordance with the reclamation laws</quote>; and</text></paragraph>
<paragraph id="id33bde2a0fc4f43bbb38838c7ea53a105"><enum>(2)</enum><text>in subsection (f)—</text> <subparagraph id="id684961C0D4DF4C87BA322C1408A55CB9"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, subject to subsection (g)(2)</quote>; and</text></subparagraph>
<subparagraph id="id959E18AAEBE94D2BA7C22FC8E24EE932"><enum>(B)</enum><text>by striking paragraph (2) and all that follows through the end of subsection (g) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idc9751debae394b08847cb5c6cfbbf2fc"> <paragraph id="id7bc20965de914bc3900b9c0c181aef72"><enum>(2)</enum><header>Priorities and diversity of project types</header><text>In providing grants under paragraph (1), the Secretary shall—</text>
<subparagraph id="id7d105fc556574fc3bee4a08be031223e"><enum>(A)</enum><text>give priority to projects that—</text> <clause id="id45c1906952ab419bb5e40f75105831ba"><enum>(i)</enum><text>are likely to provide a more-reliable water supply for a unit of State or local government;</text></clause>
<clause id="id94378574947046b88a0d2240925ff5a4"><enum>(ii)</enum><text>are likely to increase the water management flexibility and reduce impacts on environmental resources; or</text></clause> <clause id="id46dc7e18b1e346658511719a070b33f0"><enum>(iii)</enum><text>provide multiple benefits, including water supply reliability, ecosystem benefits, system reliability benefits, groundwater management and enhancements, and water quality improvements; and</text></clause></subparagraph>
<subparagraph id="ida55286c08bee444084b35d4c0134b3de"><enum>(B)</enum><text>take into consideration selecting a diversity of project types, including projects that serve—</text> <clause id="id1a2d5f52504543fc8241309a009e07b8"><enum>(i)</enum><text>a region or more than 1 community;</text></clause>
<clause id="id1cefa57fc6c042c5bd62006b4a6cc144"><enum>(ii)</enum><text>a rural or small community; or</text></clause> <clause id="id9f23d9d3b4834f389c1370e852737da8"><enum>(iii)</enum><text>an urban community or city.</text></clause></subparagraph></paragraph>
<subsection commented="no" id="id117a6620b8fc4b68b7bceaa2d3c8553c"><enum>(g)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under section 40901(4)(A) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201(4)(A)</external-xref>), there is authorized to be appropriated to the Secretary to carry out subsections (e) and (f) $300,000,000 for the period of fiscal years 2025 through 2029.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="id6eae4a62f90a45f5b3d463524dbcf740"><enum>(b)</enum><header>Limitation on funding</header><text>Section 1631(d) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-13">43 U.S.C. 390h–13(d)</external-xref>) is amended—</text>

<subparagraph id="id02c8d43ff83045469434e3da33f42881"><enum>(A)</enum><header>In general</header><text>Subject to</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> <section id="ide124188fc7b94b32bd64a68b0431f191"><enum>104.</enum><header>Eligible desalination project development</header> <subsection id="id2a2f355a7af24c85b5f6bd8e7c9cd90c"><enum>(a)</enum><header>Eligible desalination projects authorization</header><text>Section 4(a) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) is amended by striking paragraph (2) and inserting the following:</text>

<paragraph id="id9850a3bae01e4ec59649a7ab0d1944d5"><enum>(2)</enum><header>Projects</header>
<subparagraph id="id9a909995163945cca07473a0caa4aef3"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="id0c5fe1d28f124742a52d0f53378c9bea"><enum>(i)</enum><header>Eligible desalination project</header><text>The term <term>eligible desalination project</term> means any project located in a Reclamation State, or for which the construction, operation, sponsorship, or funding is the responsibility of, and the primary water supply benefit accrues to, 1 or more entities in a Reclamation State, that—</text>
<subclause id="id8bb9e51283634fd6884c747bff54ae0e"><enum>(I)</enum><text>involves an ocean or brackish water desalination facility—</text> <item id="iddd539aa582bc470ea802a792b9015c2a"><enum>(aa)</enum><text>constructed, operated, and maintained by a State, Indian Tribe, irrigation district, water district, or other organization with water or power delivery authority; or</text></item>
<item id="id39df572c80b04e34b616887e83c588c6"><enum>(bb)</enum><text>sponsored or funded by any combination of a State, department of a State, political subdivision of a State, or public agency organized pursuant to State law, including through—</text> <subitem id="id96edbd0673764d98ba4a23bdf6cf14c1"><enum>(AA)</enum><text>direct sponsorship or funding; or</text></subitem>
<subitem id="idd9426c1ed0b649d38839022cd6823b8b"><enum>(BB)</enum><text>indirect sponsorship or funding, such as by paying for the water provided by the facility;</text></subitem></item></subclause> <subclause id="id2aba73540ef9475fa1acddfe2fd29a98"><enum>(II)</enum><text>provides a Federal benefit; and</text></subclause>
<subclause id="id55618dacde9042d6bf51d99a93db3016"><enum>(III)</enum><text>is consistent with applicable Federal and State resource protection laws, including any law relating to the protection of marine protected areas.</text></subclause></clause> <clause id="id3817501742554F38B5D943DB9C731D18"><enum>(ii)</enum><header>Authorizing committees of Congress; Federal benefit; reclamation State</header><text>The terms <term>authorizing committees of Congress</term>, <term>Federal benefit</term>, and <term>Reclamation State</term> have the meaning given the terms in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>.</text></clause>
<clause id="ideecf540211104b508159cb6866872173"><enum>(iii)</enum><header>Rural desalination project</header><text>The term <term>rural desalination project</term> means an eligible desalination project that is designed to serve a community or group of communities, each of which has a population of not more than 25,000 inhabitants.</text></clause></subparagraph> <subparagraph id="id99930c0843ba4aa6b0751fcba5124ea1"><enum>(B)</enum><header>Cost-sharing requirement</header> <clause id="id82c4ccf7b7314fdf8550492a811cfc20"><enum>(i)</enum><header>In general</header><text>Subject to the requirements of this subsection and notwithstanding section 7, the Federal share of an eligible desalination project carried out under this subsection shall be—</text>
<subclause id="idb205d3ce9ec0401fb669c5a77b230cac"><enum>(I)</enum><text>not more than 25 percent of the total cost of the eligible desalination project; or</text></subclause> <subclause id="id08be12e6857d48c69d05eab61dc7d977"><enum>(II)</enum><text>in the case of a rural desalination project, the applicable percentage determined in accordance with clause (ii).</text></subclause></clause>
<clause id="id5f6b829460f04cf5a8fc0be2959ccccb"><enum>(ii)</enum><header>Rural desalination projects</header>
<subclause id="id55fe207a94ee458abe40cffeb3ecfb09"><enum>(I)</enum><header>Cost-sharing requirement for appraisal studies</header><text>Subject to subclause (IV), in the case of a rural desalination project carried out under this subsection, the Federal share of the cost of appraisal studies for the rural desalination project shall be—</text> <item id="id014db5407a624b0db6b2f85f0508d152"><enum>(aa)</enum><text>75 percent of the total costs of the appraisal studies, up to $200,000; and</text></item>
<item id="id7ece4b42466043b8a136c27c2da6c968"><enum>(bb)</enum><text>if the total costs of the appraisal studies are more than $200,000, 50 percent of any amounts over $200,000.</text></item></subclause> <subclause id="id9ec29e6d81c34b27b4fc31d413e49178"><enum>(II)</enum><header>Cost-sharing requirement for feasibility studies</header><text>Subject to subclause (IV), in the case of a rural desalination project carried out under this subsection, the Federal share of the cost of feasibility studies for the rural desalination project shall be not more than 50 percent.</text></subclause>
<subclause id="id79f84ac311f4475fbc78578091e77167"><enum>(III)</enum><header>Cost-sharing requirement for construction costs</header><text>Subject to subclause (IV), in the case of a rural desalination project carried out under this subsection, the Federal share of the cost of construction of the rural desalination project shall be not more than 75 percent.</text></subclause> <subclause id="id28f758538f3f4321b1ca6a27039a854d"><enum>(IV)</enum><header>Reduction in non-federal share</header><text>The Secretary may reduce the non-Federal share of a rural desalination project required under subclause (I), (II), or (III) by not more than 10 percent if the Secretary determines, after consultation with the heads of any other Federal agencies that are partners in the rural desalination project and in accordance with applicable Reclamation standards, that the reduction is appropriate due to—</text>
<item id="id7465510cd5664189aedeb88a072969e5"><enum>(aa)</enum><text>an overwhelming Federal interest in the rural desalination project; and</text></item> <item id="id335454463212490180f52d1163deb8c4"><enum>(bb)</enum><text>the sponsor of the rural desalination project demonstrating financial hardship.</text></item></subclause></clause>
<clause id="id37fae512bf954556a4a0cb0c72f20325"><enum>(iii)</enum><header>Limitation</header><text>Funding for a rural desalination project under clause (ii) or the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901 et seq.</external-xref>) shall not be considered for purposes of the Federal share established under this subparagraph.</text></clause></subparagraph> <subparagraph id="idb9bd20db2d584520a7ff561f0fe21d67"><enum>(C)</enum><header>State role</header><text>Participation by the Secretary in an eligible desalination project under this paragraph shall not occur unless—</text>
<clause id="idc1e66994dd5f490f8a87005e7702d675"><enum>(i)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="idc1f062f32cf8440d9ab4f7cdd7414bab"><enum>(I)</enum><text>the eligible desalination project is included in a State-approved plan; or</text></subclause> <subclause indent="up1" id="id04F1185D71DF4B68897523CB24A73010"><enum>(II)</enum><text>the participation has been requested by the Governor of the State in which the eligible desalination project is located; </text></subclause></clause>
<clause id="idde59fcc557994489b20e3fdccb8d2da9"><enum>(ii)</enum><text>the State or local sponsor of the eligible desalination project determines, and the Secretary concurs, that—</text> <subclause id="id3ffafd9628104b4e85daad6deb839faf"><enum>(I)</enum><text>the eligible desalination project—</text>
<item id="id9ee2174a758a46948d7082f9766e5235"><enum>(aa)</enum><text>is technically and financially feasible;</text></item> <item id="id4dd65c34bb8a4135ba248240395e9ba6"><enum>(bb)</enum><text>provides a Federal benefit; and</text></item>
<item id="id8dab3e91b124495ca1f34bc01d383b2c"><enum>(cc)</enum><text>is consistent with applicable Federal and State laws (including regulations);</text></item></subclause> <subclause id="idfe34c92cd24b4be88cfa316d28dfd202"><enum>(II)</enum><text>sufficient non-Federal funding is available to complete the eligible desalination project; and</text></subclause>
<subclause id="id52187860edf24638bc135989de5ab63d"><enum>(III)</enum><text>the non-Federal project sponsor is financially capable of funding the non-Federal share of the project costs; and</text></subclause></clause> <clause id="id1eca94ae5afd4352a76520170032213a"><enum>(iii)</enum><text>the Secretary submits to the authorizing committees of Congress and makes publicly available on the internet a written notification of the determinations under clause (ii) by not later than 30 days after the date of the determinations.</text></clause></subparagraph>
<subparagraph id="idbcd81f3e9fa34dcfb5b0fc11a522e6e4"><enum>(D)</enum><header>Environmental laws</header><text>To be eligible to receive a grant under this subsection, a desalination project shall comply with—</text> <clause id="id7C41A06FC09E4731B91DEDEA69A6E637"><enum>(i)</enum><text>applicable Federal environmental laws, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and </text></clause>
<clause id="id48D10AE4BE424A01A884C61DA586E7AB"><enum>(ii)</enum><text>applicable State environmental laws.</text></clause></subparagraph> <subparagraph id="id38135813ddd441dba4b1ce8ea9939e69"><enum>(E)</enum><header>Information</header><text>In participating in an eligible desalination project under this subsection, the Secretary—</text>
<clause id="id5bf21a33fa7a4afa83ae6cc89223dcf2"><enum>(i)</enum><text>may rely on reports prepared by the sponsor of the eligible desalination project, including feasibility or equivalent studies, environmental analyses, and other pertinent reports and analyses; but</text></clause> <clause id="id6ad5a05c5af149729c42ad980935a395"><enum>(ii)</enum><text>shall retain responsibility for making the independent determinations described in subparagraph (C).</text></clause></subparagraph>
<subparagraph id="idd44bf30bdf7542649c787eb41d6d15cb"><enum>(F)</enum><header>Funding</header>
<clause id="idbc7cd0c2212e4133ab1de0a16ccaf2bf"><enum>(i)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under section 40901(5) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201(5)</external-xref>), there is authorized to be appropriated to carry out this paragraph $150,000,000 for the period of fiscal years 2025 through 2029, of which not less than $10,000,000 shall be made available during the period for rural desalination projects.</text></clause> <clause id="id24a41e7b27c94e00a2405c32ec484920"><enum>(ii)</enum><header>Funding opportunity announcement</header><text>The Commissioner of Reclamation shall release a funding opportunity announcement for a grant program under this paragraph by not later than 75 days after the date of enactment of an Act that provides funding for the program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="idCA125F51847D4185A5B17A316A0C5D8D"><enum>(b)</enum><header>Prioritization of projects</header><text>Section 4 of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) is amended by striking subsection (c) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idbf28d5968b0d4feda4304c51d7f2e62a"> <subsection id="iddd8878f23d8a4d6bb0c6d3527a9087c5"><enum>(c)</enum><header>Prioritization</header><text>In carrying out demonstration and development activities under this section, the Secretary shall prioritize projects—</text>
<paragraph id="id77b8ab5ccb2a45deaa5df0a97fcd3865"><enum>(1)</enum><text>for the benefit of drought-stricken States and communities;</text></paragraph> <paragraph id="idb689548f866a4f99b16899eb467018ef"><enum>(2)</enum><text>for the benefit of States that have authorized funding for research and development of desalination technologies and projects;</text></paragraph>
<paragraph id="id5a921c592bee478ea3050637acd3f82c"><enum>(3)</enum><text>that demonstrably improve self-reliance on local or regional water supplies in the case of any project sponsors that rely on imported water supplies that have an impact on species listed under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></paragraph> <paragraph id="ida38881627ece4af880507a4975ad0f4f"><enum>(4)</enum><text>that demonstrably leverage the experience of or partner with—</text>
<subparagraph id="id36ebff2426544891b15f8c317bdbdf62"><enum>(A)</enum><text>international entities with considerable expertise in desalination, such as Israel; or</text></subparagraph> <subparagraph id="ida638d6ef4c224443be657b813546db0e"><enum>(B)</enum><text>nonprofit water research foundations or institutions with expertise in technology innovation to advance sustainable desalination processes or brine management;</text></subparagraph></paragraph>
<paragraph id="id6fcac0d4aff24614a2c82b7a2dd4cd8c"><enum>(5)</enum><text>located in a region that—</text> <subparagraph id="idA411217EE86648CB827201B2143A55B5"><enum>(A)</enum><text>is impacted by salinity or brackish groundwater; and</text></subparagraph>
<subparagraph id="id4C4D94743B40437CA3015BAE6CFE0112"><enum>(B)</enum><text>has agricultural production of national importance;</text></subparagraph></paragraph> <paragraph id="idb26ea6e30a4c42d58290fa029bf835f2"><enum>(6)</enum><text>that support regional stakeholder-based planning and implementation efforts to manage brine and salinity for sustainability and improvement of groundwater quality within an approved basin plan;</text></paragraph>
<paragraph id="idfebd887a584a4a8c90520595287f86f3"><enum>(7)</enum><text>that maximize the use of renewable energy to power desalination facilities;</text></paragraph> <paragraph id="id3412359914264dbd9ead2556c2063b82"><enum>(8)</enum><text>that maximize energy efficiency so that the lifecycle energy demands of desalination are minimized;</text></paragraph>
<paragraph id="idcc22d85d242b49a6a21d9611807ebc8d"><enum>(9)</enum><text>located in a region that has employed strategies to increase water conservation and the capture and recycling of wastewater and stormwater; and</text></paragraph> <paragraph id="id7334d32fa9ce40878a5b7a3b4224197e"><enum>(10)</enum><text>that, in the case of ocean desalination facilities—</text>
<subparagraph id="id79e7bd19b26f4cd98927cdabe3367cfd"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="idF92A4BA6B0954A3DAC5F58887B698C35"><enum>(i)</enum><text>use a subsurface intake; or</text></clause> <clause id="id218888232CD443AC90D1C4A68FA3B177" indent="up1"><enum>(ii)</enum><text>if a subsurface intake is not feasible, use an intake that uses the best available site, design, technology, and mitigation measures to minimize the mortality of all forms of marine life and impacts to coastal-dependent resources; </text></clause></subparagraph>
<subparagraph id="id1d3b3132f9244443afa0be3d56db315b"><enum>(B)</enum><text>are sited and designed to ensure that the disposal of wastewater (including brine from the desalination process)—</text> <clause id="idca43e9dda6074d76b38628019e4516ca"><enum>(i)</enum><text>is not discharged in a manner that increases salinity levels in Federal or State marine protected areas; and</text></clause>
<clause id="id9962100f013745f8be1d4a4962e216d1"><enum>(ii)</enum><text>achieves ambient salinity levels within a reasonable distance from the discharge point;</text></clause></subparagraph> <subparagraph id="idca0a26ca35414720b2e56b0ce5f69cf9"><enum>(C)</enum><text>are sited, designed, and operated in a manner that maintains indigenous marine life and a healthy and diverse marine community within a reasonable distance from the discharge point;</text></subparagraph>
<subparagraph id="ide2eac9f98dbc4fb786f8bb82cb225956"><enum>(D)</enum><text>do not cause significant unmitigated harm to aquatic life; and</text></subparagraph> <subparagraph id="idc90eb6ac92b046bfb1be8e3da3da156f"><enum>(E)</enum><text>include a construction and operation plan designed to minimize loss of coastal habitat as well as aesthetic, noise, and air quality impacts.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" id="id2280f63952054a5890cc843436549157"><enum>(c)</enum><header>Priority scoring system</header><text>As soon as practicable after the date of enactment of this Act, for purposes of making recommendations to Congress for projects to be carried out under section 4 of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>), the Commissioner of Reclamation shall establish a priority scoring system that provides for the assignment of priority scores for the projects based on the prioritization criteria established under subsection (c) of that section.</text></subsection> <subsection commented="no" id="id86E6216BBB4A4A118124DF8C4177A105"><enum>(d)</enum><header>Other requirements</header><text>Non-Federal entities that receive Federal assistance for projects or facilities authorized under this Act shall implement the projects or facilities consistent with the standards for activities assisted under section 401 of the Safe Drinking Water Act Amendments of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-3c">42 U.S.C. 300j–3c</external-xref>).</text></subsection>
<subsection id="id423961b41842402bac2a9ccc57f0d205"><enum>(e)</enum><header>Research authority</header><text>Section 8(a) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) is amended—</text> <paragraph id="ida96b98c927554669adab8007e555446d"><enum>(1)</enum><text>in the first sentence, by striking <quote>2021</quote> and inserting <quote>2028</quote>; and</text></paragraph>
<paragraph id="id3438b8a38a5e4bfd89b320ac32dc2966"><enum>(2)</enum><text>in the second sentence, by striking <quote>$1,000,000</quote> and inserting <quote>$3,000,000</quote>. </text></paragraph></subsection></section> <section id="id2862e5e4aa85429887175e2499515dbc"><enum>105.</enum><header>Drinking water assistance for disadvantaged communities</header> <subsection id="id120b8617fe84480c8ffc10aef792906f"><enum>(a)</enum><header>In general</header><text>In addition to any amounts appropriated under section 50231 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (136 Stat. 2053) or any amounts made available to carry out that section under any other law, there is authorized to be appropriated to the Secretary to carry out that section $100,000,000 for the period of fiscal years 2025 through 2029.</text></subsection>
<subsection id="ided5150e541f94641b9b6b3ce6d380f4f"><enum>(b)</enum><header>Multiple benefit projects</header><text>The Secretary is encouraged to use all or a portion of the funds made available under subsection (a) to incorporate into multiple benefit projects features or facilities to assist in providing domestic water supplies to disadvantaged communities. </text></subsection></section> <section id="id9bf508d150ef40a4a5ab3236e5d460de"><enum>106.</enum><header>Extraordinary operation and maintenance work; project modification</header> <subsection id="idf11ef6ee374b4264b52dea6e0703755f"><enum>(a)</enum><header>Definitions</header><text>Section 9601 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510">43 U.S.C. 510</external-xref>) is amended—</text>
<paragraph id="id1a036aec634841b385cdcf8f6d617d4c"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), (6), and (7) as paragraphs (4), (7), (9), (10), (11), (12), and (3), respectively, and moving the paragraphs so as to appear in numerical order;</text></paragraph> <paragraph id="id7fa2a68b9ce24957970113e41d76cc91"><enum>(2)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text>

<paragraph id="id97c511d30ba54e6ea0750536cf7c710d"><enum>(1)</enum><header>Adverse impact</header><text>The term <term>adverse impact</term> means, with respect to a project modification, a reduction in water quantity or quality or a change in the timing of water deliveries available to a project beneficiary from the modified project as compared to the water quantity or quality or timing of water deliveries from—</text> <subparagraph id="id8f2bb0b36ea44f91bcc1e82a8602c45a"><enum>(A)</enum><text>the project with the restored capacity, if the extraordinary operation and maintenance work under section 9603 is intended to restore lost project capacity;</text></subparagraph>
<subparagraph id="idf009e2c27981456782f4beba9e00e5d6"><enum>(B)</enum><text>the project prior to undertaking the extraordinary operation and maintenance work under section 9603, if the extraordinary operation and maintenance work is for any purpose other than to restore lost project capacity; or</text></subparagraph> <subparagraph id="id842a8c0e4b3348be8ba01d00411174a8"><enum>(C)</enum><text>project operations of the modified project without an increase in benefits for a new project beneficiary under section 9603(e)(1)(E).</text></subparagraph></paragraph>
<paragraph id="ida867b965a3aa46d3828ee30825d40d90"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> has the meaning given the term <term>low-income community</term> in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="ida35eba995b6a4094a6b153e4338b9bee"><enum>(3)</enum><text>in paragraph (3) (as so redesignated)—</text>
<subparagraph id="ide2d35b58dd8e402fa27785439fde63e7"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="id38a23605e0dd43169766a2bde895b288"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="idc987fa69418041b49679a8d322f2a468" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idA5DCD40099A8473FA5AA202B87E701B1"> <subparagraph commented="no" display-inline="no-display-inline" id="idb3a52ff1382e4f8d82c6305080513c7d"><enum>(C)</enum><text display-inline="yes-display-inline">inclusive of any modifications to the facilities or facility components authorized under section 9603(e).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="ided7cabf3dce5458e92ea964d3acbeed4"><enum>(4)</enum><text>by inserting after paragraph (4) (as so redesignated) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id814fe52464ab433f85dad75efacbfff8"> <paragraph id="iddb8423cd79b7407c9892e66495dd6447"><enum>(5)</enum><header>New benefit</header><text>The term <term>new benefit</term> means the increase in benefits of the modified project compared to the benefits provided by—</text>
<subparagraph id="id7c48e799f1c446af95531d0546cf746e"><enum>(A)</enum><text>the project with restored capacity, if the extraordinary operation and maintenance work under section 9603 is intended to restore lost project capacity; or</text></subparagraph> <subparagraph id="id2da07c4769b749d8a002d0ffe01863e4"><enum>(B)</enum><text>the project as the project existed prior to undertaking the extraordinary operation and maintenance work under section 9603, if the extraordinary operation and maintenance work is for any purpose other than to restore lost project capacity.</text></subparagraph></paragraph>
<paragraph id="idb17383a27e4a4507ba70dad642b15a9f"><enum>(6)</enum><header>Project beneficiary</header><text>The term <term>project beneficiary</term> means any entity that has a repayment, long-term water service, or other form of long-term contract or agreement executed pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>), for water supply from the project.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="id2b804f76494e4b14811ea69f8dffddb0"><enum>(5)</enum><text>by inserting after paragraph (7) (as so redesignated) the following:</text>

<paragraph id="id59230ea10c274154b0f41fd84364e96c"><enum>(8)</enum><header>Public benefit</header><text>The term <term>public benefit</term> has the meaning given the term in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id7d6328839bba4a45a5fbd8e048a12846"><enum>(b)</enum><header>Reimbursement of costs</header><text>Section 9603(b) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b(b)</external-xref>) is amended—</text>
<paragraph id="ide2c24eeafe4944808238e804c2550a36"><enum>(1)</enum><text>in paragraph (2), by striking <quote>the costs</quote> and inserting <quote>from the Aging Infrastructure Account established by subsection (d)(1) or any other applicable available account the costs, including reimbursable costs and nonreimbursable costs,</quote>; and</text></paragraph> <paragraph id="id1ef322a81b574e0d90c43854c7f316e0"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="id0a88a94359294efb8357a6b2385bdac2"><enum>(4)</enum><header>Determination of nonreimbursable costs</header><text>Any costs advanced under paragraph (2) that are allocated to nonreimbursable purposes of the project, including public benefits described in section 2(10)(B) of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>, shall be considered to be nonreimbursable costs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idd198ca6acc334bcdb9970f24005884d0"><enum>(c)</enum><header>Aging infrastructure account conforming amendments</header><text>Section 9603(d) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b(d)</external-xref>) is amended—</text>

<subsection id="idd5f706ee0dd740d5b341b0c6dd2062dc"><enum>(d)</enum><header>Authorization To modify transferred works To increase public benefits and other project benefits as part of extraordinary operation and maintenance work</header><text>Section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id4ca981fe87744858b927f9ef6d34a3eb"> <subsection id="id861ba0770c2242908e16699a642f3099"><enum>(e)</enum><header>Authorization To modify transferred works To increase public benefits and other project benefits as part of extraordinary operation and maintenance work</header> <paragraph id="id21d428de3b29471082137f5818964eec"><enum>(1)</enum><header>Authorization; requirements</header> <subparagraph id="id8fa148c049a844a699378f7e966f32ee"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with any transferred works operating entity and any project beneficiaries and as part of extraordinary operation and maintenance work under this section, may develop and carry out a proposal to modify project features for transferred works to increase public benefits and other project benefits, including carrying out a feasibility study and conducting any applicable environmental analysis required for the proposal, subject to subparagraphs (B) through (F).</text></subparagraph>
<subparagraph id="id0ae8238e836549a7b5e44863b85751b0"><enum>(B)</enum><header>Maximum cost</header><text>The maximum amount that may be added to the original project cost as a result of a project modification under subparagraph (A) shall not exceed—</text> <clause id="idca586c123ecc44ce8065e41c70738520"><enum>(i)</enum><text>an amount equal to 25 percent of the original cost of the planned extraordinary operation and maintenance work, in the case of a project for which the original cost of the planned extraordinary operation and maintenance work exceeds $100,000,000; or</text></clause>
<clause id="id1726cb2b79c44e88a297bae4ece06933"><enum>(ii)</enum><text>$25,000,000, in the case of a project for which the original cost of the planned extraordinary operation and maintenance work is not more than $100,000,000.</text></clause></subparagraph> <subparagraph id="id470183b0f5ff4e9c80b7aa0acec3a05e"><enum>(C)</enum><header>Public benefits</header><text>In the case of a project modification under subparagraph (A), not less than 50 percent of the new benefits provided by the modification of the project, as compared to the original planned extraordinary operation and maintenance work, shall be public benefits.</text></subparagraph>
<subparagraph id="ide60db849fb3e4f16b81e3211ee1b5017"><enum>(D)</enum><header>Written consent required</header><text>A project modification under subparagraph (A) shall not be constructed until the date on which the Secretary has obtained the written consent of—</text> <clause id="idc31e87e9eb534a8fbaf078e5e6a3126e"><enum>(i)</enum><text>the transferred works operating entity; and</text></clause>
<clause id="idd3783a0e44184c01abb6958b19a82f65"><enum>(ii)</enum><text>consistent with paragraph (2), any project beneficiary that would experience an adverse impact as a result of the modification of the project.</text></clause></subparagraph> <subparagraph id="id8f1f8a22ec0b4cfd9f6e69ed67cdacac"><enum>(E)</enum><header>Adverse impact</header><text>Any benefits that accrue to a new project beneficiary resulting from operations of the modified project shall not be increased without the consent of existing project beneficiaries that would experience an adverse impact as a result of the modification of the project.</text></subparagraph>
<subparagraph id="idb593f1acedf44bd2af59d74f45ec7e1d"><enum>(F)</enum><header>Reimbursement of costs</header><text>The costs of planning, design, and environmental compliance for a project modification under subparagraph (A) shall be reimbursed in accordance with subsection (b), except that any of the costs that would otherwise be allocated to a project beneficiary shall be considered nonreimbursable if the project beneficiary does not receive any increase in long-term average annual water deliveries as a result of the modification.</text></subparagraph> <subparagraph id="id12a865910b914141a3a4fff77c3b4918"><enum>(G)</enum><header>Eligibility of certain project modifications</header><text>If a project modification that is otherwise eligible under subparagraph (A) was in the planning, design, or construction phase as of December 31, 2022, the project modification shall remain eligible to be developed under that subparagraph. </text></subparagraph></paragraph>
<paragraph id="id445ee3b73c9d4edabd99e75a25a295c6"><enum>(2)</enum><header>Procedure for obtaining consent and time limitation</header>
<subparagraph id="id725b7ca547d541709c7b3cde83c26273"><enum>(A)</enum><header>Initial determination</header><text>The Secretary shall initially determine whether the consent of a project beneficiary is required prior to construction under paragraph (1)(D) based on whether the modification or subsequent operations of the modified project would have any adverse impacts on a project beneficiary.</text></subparagraph> <subparagraph id="ide6ddadc8c5e74fa793a9c1ede454acd1"><enum>(B)</enum><header>Written request for consent</header><text>The Secretary shall provide to the transferred works operating entity and any project beneficiaries, in writing—</text>
<clause id="idB8EC0F0CF07343D1B680231CFFEAB646"><enum>(i)</enum><text>a description of the proposed modification and subsequent operations of the project; and</text></clause> <clause id="id48b888612b694b7a9b156de00d7d6dab"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="idEB1D8DB8CAD744F1A7F6F29280340500"><enum>(I)</enum><text>a request for consent under paragraph (1)(D); or</text></subclause>
<subclause indent="up1" id="id781C7EF00257477589F58A580129863C"><enum>(II)</enum>
<item commented="no" display-inline="yes-display-inline" id="id74D8F5E72D2E40DAB701BC0501AFD36A"><enum>(aa)</enum><text>an explanation that the Secretary has determined that no consent is required under paragraph (1)(D); and</text></item> <item indent="up1" id="idCBB3E7F3A61E4CDDB7BE6976F19B17A0"><enum>(bb)</enum><text>a statement that if the project beneficiary believes that the consent of the project beneficiary is required, the project beneficiary shall send to the Secretary a reply not later than 30 days after the date of receipt of the notice that includes an explanation of the reasons that the project beneficiary would experience adverse impacts as a result of the project modification.</text></item></subclause></clause></subparagraph>
<subparagraph id="id8adcc0dabe174dab9d3d75ae708c1cf8"><enum>(C)</enum><header>Final determination</header>
<clause id="id72177d2d701d4295b86899bf64bc2404"><enum>(i)</enum><header>Written response</header><text>The Secretary shall respond in writing to any reply from a project beneficiary under subparagraph (B)(ii)(II)(bb) stating whether or not the Secretary determines that the project beneficiary would experience adverse impacts as a result of the project modification.</text></clause> <clause id="idC04868FB8F584B4BA19550A1F3FB470C"><enum>(ii)</enum><header>Final agency action</header><text>A written determination by the Secretary under clause (i) shall be considered to be a final agency action for purposes of section 704 of title 5, United States Code. </text></clause>
<clause id="ida8713efc30554af191addbbea0b98122"><enum>(iii)</enum><header>Written request</header><text>If the Secretary determines under clause (i) that the project beneficiary would experience adverse impacts as a result of the project modification, the Secretary shall send to the project beneficiary a written request for consent in accordance with subparagraph (B)(ii).</text></clause></subparagraph> <subparagraph id="id7131d66d75cb4f4d9fd308a0a544c3e0"><enum>(D)</enum><header>Time period for consent</header> <clause id="idf02e3eb5093b49b7bde52af84d2770ee"><enum>(i)</enum><header>In general</header><text>If written consent required under paragraph (1)(D) is not obtained by the date that is 1 year after the date on which written consent is requested under subparagraph (B)(ii), the transferred works operating entity shall proceed with extraordinary operation and maintenance work of the project without the modification, unless the Secretary extends the time for consent under clause (ii).</text></clause>
<clause id="id6633c743335f402f84707fc9cafc29e0"><enum>(ii)</enum><header>Extension</header><text>At the discretion of the Secretary, the Secretary may elect to extend the time for obtaining consent under paragraph (1)(D) by 1 year.</text></clause></subparagraph></paragraph> <paragraph id="id7440d818c3c84d86b22d87b186a1a7fb"><enum>(3)</enum><header>Reallocation of costs based on project changes and increased public benefits</header><text>The Secretary shall allocate costs, including capital repayment costs and operation and maintenance costs, for a project modification under paragraph (1), to provide that—</text>
<subparagraph id="ida2b5a5e1c97646b9b41c608b97eb4a66"><enum>(A)</enum><text>annual operation and maintenance costs associated with nonreimbursable purposes of the project shall be nonreimbursable; and</text></subparagraph> <subparagraph id="idfb5cb8f99eca48d0a81316a2de338068"><enum>(B)</enum><text>the cost allocation of reimbursable costs to each project beneficiary reflects any changes in the benefits that the modified project is providing to the project beneficiary.</text></subparagraph></paragraph>
<paragraph id="id7e7a5b237973434fa5e777c2843bc524"><enum>(4)</enum><header>Incentive for benefitting entities to participate in projects with increased public benefits</header>
<subparagraph id="id9711832311b3426088780a88b857b48d"><enum>(A)</enum><header>In general</header><text>The total amount of reimbursable capital costs, as determined under paragraph (3), for extraordinary operation and maintenance work described in subparagraph (B) shall be reduced by 15 percent, with each project beneficiary to be responsible for 85 percent of the reimbursable costs that would otherwise be allocated to the project beneficiary. </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id4262ac3e10dd411f9bf3a62cfc61fc1c"><enum>(B)</enum><header>Description of extraordinary operation and maintenance work</header><text>The extraordinary operation and maintenance work referred to in subparagraph (A) is extraordinary operation and maintenance work involving a project modification that would increase nonreimbursable public benefits without increasing reimbursable municipal, industrial, or irrigation benefits from the original design of the planned extraordinary operation and maintenance work.</text></subparagraph></paragraph>
<paragraph id="id4d369019fc254fb5a34b6d14d3669322"><enum>(5)</enum><header>Reimbursable funds</header><text>All reimbursable costs under this subsection shall be repaid in accordance with subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="idc1e3b1ad08f143bfa7490e22e5398c1f"><enum>107.</enum><header>Use of revenue to improve drought resilience or dam safety</header> <subsection id="idb58c92b391df4d3a8f21d5c3978ceb19"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="id67533aaeba7041729a512f6e4a4e902f"><enum>(1)</enum><header>Dam safety investment</header><text>The term <term>dam safety investment</term> means a project to satisfy dam safety standards—</text> <subparagraph id="ide28f2bd630f44b01bfd1c89aee62d69a"><enum>(A)</enum><text>under the Federal Guidelines for Dam Safety issued by the Federal Emergency Management Agency or the Interagency Committee on Dam Safety;</text></subparagraph>
<subparagraph id="id6708818f2eb545c8ae6f801c2beda26e"><enum>(B)</enum><text>under the Bureau of Reclamation Dam Safety Program, including repayment of an obligation for a corrective action taken pursuant to that program; or</text></subparagraph> <subparagraph id="id74caacb3ff9641eda138ca0fd7e30409"><enum>(C)</enum><text>required by the State in which a Bureau of Reclamation project or facility is located. </text></subparagraph></paragraph>
<paragraph commented="no" id="ideb7d3987e7584562b2f9520ba2f72318"><enum>(2)</enum><header>Drought Resilience Investment</header><text>The term <term>drought resilience investment</term> means—</text> <subparagraph commented="no" id="id53a342d2f1f64a44b7cf399e3eb967ae"><enum>(A)</enum><text>an improvement or addition to an eligible facility that will increase drought resilience in a Reclamation State; or</text></subparagraph>
<subparagraph commented="no" id="idce9ef8f960974b228cce61f0e0c4f124"><enum>(B)</enum><text>annual payments on repayment obligations incurred under section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" id="id1511b07908c047cd8622cbcff0ddd35f"><enum>(3)</enum><header>Eligible facility</header><text>The term <term>eligible facility</term> means—</text>
<subparagraph commented="no" id="idcfac61558cd240a08df0e2cfd981cfb5"><enum>(A)</enum><text>a project or facility owned by the Bureau of Reclamation; and</text></subparagraph> <subparagraph commented="no" id="id3c0744182d6b420788b666cf3a9510bd"><enum>(B)</enum><text>a non-Federal facility that stores, transports, or delivers water to or from a Bureau of Reclamation project or facility.</text></subparagraph></paragraph>
<paragraph commented="no" id="id58610cf7f5e7422fa33b85126e3f590f"><enum>(4)</enum><header>Eligible Temporary Transfer</header><text>The term <term>eligible temporary transfer</term> means the temporary and voluntary selling, leasing, or exchanging of water or water rights among individuals or agencies that is allowable under the reclamation laws and the water law of the applicable State.</text></paragraph> <paragraph commented="no" id="id037f75c70c3946e4acd16ebf0f17b73c"><enum>(5)</enum><header>Transferor</header><text>The term <term>transferor</term> means the holder of a water service, transferred works, water repayment, or other contract that entitles the holder to water from a Bureau of Reclamation project or facility that undertakes an eligible temporary transfer.</text></paragraph></subsection>
<subsection id="idae30c68be0904c5eacbf54ada1bcbffc"><enum>(b)</enum><header>Use of revenue for drought resilience investments or dam safety investments</header>
<paragraph id="id2e1ad5b527144681b72b810465887a8e"><enum>(1)</enum><header>In general</header><text>Notwithstanding the Act of February 25, 1920 (41 Stat. 451, chapter 86; <external-xref legal-doc="usc" parsable-cite="usc/43/521">43 U.S.C. 521</external-xref>), or subsection J of section 4 of the Act of December 5, 1924 (43 Stat. 703, chapter 4; <external-xref legal-doc="usc" parsable-cite="usc/43/526">43 U.S.C. 526</external-xref>), all amounts derived from an eligible temporary transfer that would otherwise be deposited in the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093; <external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>), shall remain available to the transferor. </text></paragraph> <paragraph id="id1d58c92c52904f40b89b013da27788d8"><enum>(2)</enum><header>Use of funds</header><text>Any funds retained by a transferor under paragraph (1) may be—</text>
<subparagraph id="idbc63eafe1dfa485da56dfa2e656792c2"><enum>(A)</enum><text>used for a drought resilience investment or dam safety investment; or</text></subparagraph> <subparagraph id="id39b37a83e1ca492dabdc0c5a3566d52b"><enum>(B)</enum><text>placed in the reserve account of the transferor, to be used for future drought resilience investments or dam safety investments, subject to paragraph (3).</text></subparagraph></paragraph>
<paragraph id="idc96b841a651d4786969dfb5a734cbde7"><enum>(3)</enum><header>Transfer of unused funds to reclamation fund</header><text>Any funds placed in the reserve account of the transferor pursuant to paragraph (2)(B) that are not used for drought resilience investments or dam safety investments by the date that is 10 years after the date of the placement shall be transferred to the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093).</text></paragraph> <paragraph id="id05d7a7823bff4169bb8e0b4cbd336cf1"><enum>(4)</enum><header>Reporting</header><text>The transferor shall report to the Commissioner of Reclamation on the use of any uses of funds derived from an eligible temporary transfer.</text></paragraph>
<paragraph id="ida7a6fd13a22e47998ddba865ae85a542"><enum>(5)</enum><header>Effect of section</header>
<subparagraph id="id936c44c059a942b4bd621708fcd6cecd"><enum>(A)</enum><header>In general</header><text>Nothing in this section—</text> <clause id="id7889921d22a2417b90053734cea4ab78"><enum>(i)</enum><text>affects any other authority of the Secretary to use amounts derived from revenues from a Bureau of Reclamation project; or</text></clause>
<clause id="idc821d0a1e9af4c76a3855f6852d9514e"><enum>(ii)</enum><text>creates, impairs, alters, or supersedes a State water right.</text></clause></subparagraph> <subparagraph id="id43125e35fd2a4432b32cc8fe08cf4529"><enum>(B)</enum><header>Applicable law</header><text>Any eligible temporary transfer shall comply with all applicable—</text>
<clause id="idaf6562fa0ab64c9681eaf193c151da6a"><enum>(i)</enum><text>State water laws;</text></clause> <clause id="idd5f2059a01b140d88d3d3a5e897017ce"><enum>(ii)</enum><text>Federal laws and policies; and</text></clause>
<clause id="id7bd69b9dbac8493896bb8256608d66b6"><enum>(iii)</enum><text>interstate water compacts.</text></clause></subparagraph></paragraph></subsection> <subsection id="id74ff9dc79f194777be74e517cafdd7d0"><enum>(c)</enum><header>Reclamation laws</header><text>This section supplements and amends the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>). </text></subsection></section></title>

<subsection id="id60279a32d844467ebf9ea91850da38ac"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7aacfc7d3ce245f2bb069e86b56f9205"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the Integrated Water Management Federal Leadership Committee established under subsection (f)(1).</text></paragraph>
<paragraph id="id274c3b48e80a4a44a4f18738e65a71f7"><enum>(2)</enum><header>Eligible applicant</header><text>The term <term>eligible applicant</term> means—</text> <subparagraph id="ide53aae6fc7d046f2b0c39098355330a6"><enum>(A)</enum><text>a State;</text></subparagraph>
<subparagraph id="id5bf093cbb96345f382b952fa8b88fb73"><enum>(B)</enum><text>a Tribal or local government;</text></subparagraph> <subparagraph id="idf4212f5314ac4c50ad554140043b88ff"><enum>(C)</enum><text>an organization with power, water delivery, or water storage authority;</text></subparagraph>
<subparagraph id="id2273e6da08af4645971edf4c3f85bce6"><enum>(D)</enum><text>a regional authority; or</text></subparagraph> <subparagraph id="id0424299e39bb4893bb89bb189c20b6bd"><enum>(E)</enum><text>a nonprofit conservation organization.</text></subparagraph></paragraph>
<paragraph id="ida757fe567e0147b8b192e1ae94db2fb7"><enum>(3)</enum><header>Project</header><text>The term <term>project</term> includes—</text> <subparagraph id="id3a370395e9a04dfe8af85a6badbc5741"><enum>(A)</enum><text>planning, design, permitting, and preconstruction activities;</text></subparagraph>
<subparagraph id="id80cb623dd41640bf83a17176496268e1"><enum>(B)</enum><text>construction, construction management, replacement, and other similar activities;</text></subparagraph> <subparagraph id="id2fb6d064b1164d72b3b276f16ad4ea41"><enum>(C)</enum><text>management activities, including the acquisition of an interest in land or water, including the acquisition of a conservation easement;</text></subparagraph>
<subparagraph id="ida9ba876d0d3b4884afade7d8f6ae18f2"><enum>(D)</enum><text>research, development, demonstration (including the demonstration of the scalability of a project or activity), and monitoring; and</text></subparagraph> <subparagraph id="idf9c31c089f984a658b976174286fc3c0"><enum>(E)</enum><text>project administration activities, including the payment of fees associated with implementing the project or activity.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id18d56fcda38e43e5b8b4d27a06f86ce6"><enum>(b)</enum><header>Requirements</header><text>Section 40907(c)(1) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3207">43 U.S.C. 3207(c)(1)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idA9E1CB6A34D147CCBEC8D196471BF74B"> <subparagraph id="idb9c967b3d3fa4b1380a8783be189d1be"><enum>(B)</enum><text>may not provide a grant to carry out a habitat restoration project the purpose of which is to meet existing environmental mitigation or compliance obligations that are express requirements of a permit or order issued under Federal or State law, unless such requirements expressly contemplate reliance on Federal funding in performance of the requirements.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subsection>
<subsection id="id6756c2cc8fee42f395fbb5b1b1d45644"><enum>(c)</enum><header>Other amendments</header><text>Section 40907 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3207">43 U.S.C. 3207</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idbaea464ed7d24a10a4bc0f0efd1b38cd"> <subsection id="idae46b87f33524913806a3762b659ef33"><enum>(e)</enum><header>Other actions</header> <paragraph id="id36de275a1ad24fe0ad2f8106c8f1f837"><enum>(1)</enum><header>In general</header><text>In addition to other activities authorized under this section, the Secretary may undertake actions and enter into contracts and agreements to implement projects that implement watershed health, including projects described in subsection (b)(3), that—</text>
<subparagraph id="id7b12ba08e21a4cdd824a034de0e05830"><enum>(A)</enum><text>accomplish 1 or more of the purposes described in subsection (b); and</text></subparagraph> <subparagraph id="id19d545da84f540e882fb1431b92f1641"><enum>(B)</enum><text>are consistent with the requirements described in subsection (c).</text></subparagraph></paragraph>
<paragraph id="id065cdb7d4751448fb19fa14b4d8c81fb"><enum>(2)</enum><header>Reimbursability</header><text>The expenditures of the Secretary under this subsection and subsection (f) shall be nonreimbursable.</text></paragraph></subsection> <subsection id="id5e9d0722c3c64e5f8a7348cbf1813a1f"><enum>(f)</enum><header><quote>Leave behind</quote> water transfers</header> <paragraph id="id98c68780596c46168d70eb77ab353ad7"><enum>(1)</enum><header>Purpose</header><text>The purpose of this subsection is to authorize the Secretary to address habitat needs and promote collaborative, multi-benefit water management through water sharing arrangements that incorporate habitat and other public benefits into voluntary crop idling water transfers.</text></paragraph>
<paragraph id="idf2850b360a9e4d16ab6ae1c8dcf97480"><enum>(2)</enum><header>Authorization of acquisition</header><text>In approving a water transfer within a Federal reclamation project that results in voluntary fallowing of crop land in the Sacramento Valley or Sacramento-San Joaquin River Delta, the Secretary may acquire a portion of the volume of water made available for transfer if the Secretary determines that crop land idled because of the transfer would create temporary wildlife habitat with the application of the acquired water, subject to paragraph (3).</text></paragraph> <paragraph id="id1add4cab22914e8a98302e275ee8e8f3"><enum>(3)</enum><header>Requirements</header><text>In acquiring water pursuant to paragraph (2), the Secretary shall—</text>
<subparagraph id="id9ceb77f68aee400ba94df6fb8bcc7ade"><enum>(A)</enum><text>develop implementation guidelines in consultation with relevant stakeholders;</text></subparagraph> <subparagraph id="id9d69f4952b2d4f79b1dad4e7a12f116a"><enum>(B)</enum><text>only acquire a portion of the volume of water made available for transfer if the transferor and the transferee agree to the acquisition;</text></subparagraph>
<subparagraph id="idef3d7b33dd0440efb8e77bec4be86a36"><enum>(C)</enum><text>negotiate a mutually agreeable volume of water for acquisition with the transferor and the transferee;</text></subparagraph> <subparagraph id="idee99643933994302b2c8750c170fc045"><enum>(D)</enum><text>pay not more per volume of water than the price negotiated between the transferor and transferee for the water to be transferred;</text></subparagraph>
<subparagraph id="ida30df80db7b84838b5a7e87dd8bbe8a7"><enum>(E)</enum><text>compensate the transferor for any reasonable incremental costs associated with managing the water acquired to create temporary wildlife habitat; and</text></subparagraph> <subparagraph id="idaf025bb522a24160a2e957a6ca742c80"><enum>(F)</enum><text>apply the acquired water to idled crop land to create temporary wildlife habitat.</text></subparagraph></paragraph>
<paragraph id="id53e96064ce5c4a80b2ca006654e1d52a"><enum>(4)</enum><header>Prioritization</header><text>The Secretary shall give priority to approving and facilitating transfers under this subsection that incorporate voluntary habitat and other public benefits that exceed the benefits provided under regulatory requirements.</text></paragraph> <paragraph id="id03fa3a335d324df19ecd3730196d120b"><enum>(5)</enum><header>Treatment</header><text>Water acquired by the Secretary under paragraph (2) shall be in addition to, and not a substitute for, actions required to meet obligations under existing law, including—</text>
<subparagraph id="idC3250BFC2A7742BA8249B5F0F90DF8AB"><enum>(A)</enum><text>the Central Valley Project Improvement Act (title XXXIV of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; 106 Stat. 4706); and</text></subparagraph> <subparagraph id="idAC5E520161D8474B83B4BF27C20ED29E"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="idcedeba913e5c4019957d653bcd1b3933"><enum>(6)</enum><header>Reporting</header><text>The Secretary shall annually submit to the authorizing committees of Congress (as defined in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>) a report that describes, for the period covered by the report—</text> <subparagraph id="idB4A326D6EBB24227800D9B226BEBBD27"><enum>(A)</enum><text>the volume of water acquired under paragraph (2); and </text></subparagraph>
<subparagraph id="idFA5C40658A654775AAC5A75F6DE16D63"><enum>(B)</enum><text>the extent and duration of temporary wildlife habitat created under that paragraph. </text></subparagraph></paragraph></subsection> <subsection id="id37A4E4288551447AB2F22A9A2BA4CA7D"><enum>(g)</enum><header>Integrated water management Federal leadership committee for assisting projects at the request of a sponsor</header> <paragraph id="idf62af1965714434a96e0fcdf01a4ae1d"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date on which an eligible entity or qualified partner sponsoring a habitat restoration project that receives a grant under this section submits to the Secretary a request for the establishment of the Integrated Water Management Federal Leadership Committee, the Secretary shall establish the Integrated Water Management Federal Leadership Committee.</text></paragraph>
<paragraph id="id74321813cefa4c0fa779b4789d95ffb9"><enum>(2)</enum><header>Chairperson</header><text>The Assistant Secretary for Water and Science of the Department of the Interior shall—</text> <subparagraph id="id505c6b9ae4544637870a0d75018e64c7"><enum>(A)</enum><text>serve as the chairperson of the Committee; and</text></subparagraph>
<subparagraph id="id82ad5134a67c406aac5d14fbd9281b08"><enum>(B)</enum><text>coordinate the activities of, and communication among, members of the Committee.</text></subparagraph></paragraph> <paragraph id="idba1bdbf97f6449a49bfae1dd18874db5"><enum>(3)</enum><header>Membership</header><text>The Committee shall include representatives of Federal agencies with responsibility for water and natural resource issues, including representatives of—</text>
<subparagraph id="id2bc98ea306cf444b8ee1535852b2212f"><enum>(A)</enum><text>the Bureau of Reclamation;</text></subparagraph> <subparagraph id="id91c214b57aba4da08173dccdb4505119"><enum>(B)</enum><text>the United States Fish and Wildlife Service;</text></subparagraph>
<subparagraph id="ida36d94cdca8d43208aa0c16c2c325013"><enum>(C)</enum><text>the National Marine Fisheries Service;</text></subparagraph> <subparagraph id="id9c877b0077b1445b902f15a4b7657b70"><enum>(D)</enum><text>the Corps of Engineers;</text></subparagraph>
<subparagraph id="id7dea094a113c4f408b0e75b9c8b89783"><enum>(E)</enum><text>the Environmental Protection Agency; and</text></subparagraph> <subparagraph id="ide35433fc02324117b3e1688217c35ad9"><enum>(F)</enum><text>the Department of Agriculture.</text></subparagraph></paragraph>
<paragraph id="idc2e764de60cb4d809975ee00a01c4dab"><enum>(4)</enum><header>Duties and responsibilities</header><text>The members of the Committee shall establish the duties and responsibilities of the Committee, including—</text> <subparagraph id="id88c32c1e33ac40cba475c369f882ac62"><enum>(A)</enum><text>facilitating communication and collaboration among Federal agencies to support and advance any projects for which an eligible entity or qualified partner requests the assistance of the Committee;</text></subparagraph>
<subparagraph id="id259ed80486294d5b900c086cf719d7c0"><enum>(B)</enum><text>ensuring the effective coordination among relevant Federal agencies and departments to ensure accelerated implementation of any projects for which an eligible entity or qualified partner requests the assistance of the Committee; and</text></subparagraph> <subparagraph id="id26307a1972aa466aa27bd8d3ed890986"><enum>(C)</enum><text>making policy and budgetary recommendations, if determined to be appropriate by the Committee, to support the implementation of projects.</text></subparagraph></paragraph>
<paragraph id="idef0963a4b8c7439bb8c44e2204872105"><enum>(5)</enum><header>Project assistance</header><text>On request of an eligible entity or a qualified partner for a habitat restoration project, the Committee shall assist that project with permit processing and interagency coordination.</text></paragraph></subsection> <subsection id="id2a78f394865040aab0d12888bf8d21b8"><enum>(h)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under section 40901(11), there is authorized to be appropriated to the Secretary $250,000,000 to carry out this section for the period of fiscal years 2025 through 2029, of which—</text>
<paragraph id="idf14b098a240d44368e9c8f78ba7de0b4"><enum>(1)</enum><text>$150,000,000 shall be made available for the competitive grant program described in subsection (b); and</text></paragraph> <paragraph id="id9441bf2ffb29445aa2a9dbd7dc35d690"><enum>(2)</enum><text>$100,000,000 shall be made available for other actions described in subsection (e) and to carry out subsection (f).</text></paragraph></subsection>
<subsection id="id17590d0235444cafbc2e2c4516b2b381"><enum>(i)</enum><header>Applicable law</header><text>Nothing in this section affects or modifies—</text> <paragraph id="idad4acfe9b47e41eea559b2a56b07bee3"><enum>(1)</enum><text>the obligations of the Secretary under—</text>
<subparagraph id="id558d46c214864d1ea2a7fcd36d188c08"><enum>(A)</enum><text>the reclamation laws; or</text></subparagraph> <subparagraph id="id911aa8931c5a4fb29cab6639dae94f3b"><enum>(B)</enum><text>Federal environmental laws, including—</text>
<clause id="iddb6e10a91bb74e51b64dfc4eb2b54eef"><enum>(i)</enum><text>the Central Valley Project Improvement Act (title XXXIV of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; 106 Stat. 4706); and</text></clause> <clause id="id3e401fd98f7c47db9033afe4986a28f2"><enum>(ii)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause></subparagraph></paragraph>
<paragraph id="id366fdf04c3ef4ff39ca614219a59f5d5"><enum>(2)</enum><text>the obligations of a non-Federal party to comply with applicable Federal and State laws.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="id47d8cd67c5104f09b4b7aeab4856173b"><enum>302.</enum><header>Performance-based restoration authority</header> <subsection id="ide895d1aa32dd4ab28b0af7d05c7fe108"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="idafb3d2896e0b4d3bbb6e3e6fcea49072"><enum>(1)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a habitat or ecosystem restoration, mitigation, or enhancement project or activity authorized individually or through an existing Federal program. </text></paragraph> <paragraph id="id5c6bafec88594505ba997d9f5c27e08d"><enum>(2)</enum><header>Eligible restoration provider</header><text>The term <term>eligible restoration provider</term> means a non-Federal for-profit or nonprofit organization, company, or corporation, or a State, Tribal, or local government, that is bonded, insured, and experienced in financing and completing successful habitat and restoration, mitigation, and enhancement activities. </text></paragraph>
<paragraph id="id298306433fd549f4b52c17bb97e72841"><enum>(3)</enum><header>Performance-based</header><text>The term <term>performance-based</term> means, with respect to a contract, grant agreement, cooperative agreement, or fixed amount award, a pay-for-performance, pay-for-success, pay-for-results, or similar model by which the restoration provider agrees to finance and complete habitat or ecosystem restoration, mitigation, or enhancement activities, with payment to the restoration provider linked to delivery of verifiable and successful ecological performance, based on metrics and the timeframe established in advance by the Secretary.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idb1aa02726e55426fb605e88271c808a6"><enum>(4)</enum><header>Restoration provider</header><text>The term <term>restoration provider</term> means a non-Federal organization that performs restoration services contracted for, agreed to, or awarded under a contract or agreement entered into under subsection (b)(1).</text></paragraph></subsection>
<subsection id="id24bc36e819574b2c8064c5c451a07cb2"><enum>(b)</enum><header>Authorization</header>
<paragraph id="id4f9e32523cd340ca9ee79e404a96811d"><enum>(1)</enum><header>In general</header><text>Subject to subsection (j), in implementing existing authorities under Federal law related to habitat and ecosystem restoration, mitigation, or enhancement, the Secretary may enter into performance-based contracts, grant agreements, and cooperative agreements, including providing funding through fixed amount awards, with eligible restoration providers for the conduct of eligible projects for which ecological targets and outcomes are—</text> <subparagraph id="idf1e8225f951144a8a9e0667b056588f0"><enum>(A)</enum><text>clearly defined;</text></subparagraph>
<subparagraph id="iddf10bdf9e2b944fa8d863ff1de5e6abb"><enum>(B)</enum><text>agreed to in advance; and</text></subparagraph> <subparagraph id="id6532f36b8c4b43b5a231a8abd348730a"><enum>(C)</enum><text>capable of being successfully achieved.</text></subparagraph></paragraph>
<paragraph id="idad5607abe9224b80a86f1540ef1f2177"><enum>(2)</enum><header>Performance-based contracts</header><text>For purposes of paragraph (1), the Secretary may enter into performance-based contracts with eligible restoration providers experienced in financing and completing successful ecological habitat and restoration, mitigation, and enhancement activities. </text></paragraph> <paragraph id="id11db1db8e2e84b10b88677e162128e18"><enum>(3)</enum><header>Grants and awards</header><text>For purposes of paragraph (1), the Secretary—</text>
<subparagraph id="id1B8B20E770114C7FBE65665FC747CAAB"><enum>(A)</enum><text>may provide funding through grant agreements and cooperative agreements, including fixed amount awards, for eligible projects; and</text></subparagraph> <subparagraph id="id33D29A89FCA64489A9C4B5660B6F7DC8"><enum>(B)</enum><text> shall allow for the use of performance-based tools in the agreements and awards described in subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="idb6de0e6b2e2d4788b6677c428ae13e31"><enum>(4)</enum><header>Pass-through grants and awards</header><text>For purposes of paragraph (1), the Secretary—</text> <subparagraph id="idB2921FD5C77C41C188809B9CB5F4609A"><enum>(A)</enum><text>may allow funding provided to States, local governments, Indian Tribes, and nonprofit organizations to be passed through to third-party eligible restoration providers under a contract or agreement entered into under that paragraph; and</text></subparagraph>
<subparagraph id="id343C8D42731845C38A8D5680DDE98819"><enum>(B)</enum><text>shall allow for the use of performance-based tools in grant and cooperative agreements entered into with eligible restoration providers under that paragraph.</text></subparagraph></paragraph> <paragraph id="id84b4ab1f675141ceab3a00e3a7ef739c"><enum>(5)</enum><header>Multi-year agreements</header><text>The Secretary may use performance-based contracts, grant agreements, and cooperative agreements, including fixed amount awards, issued under this section for multi-year agreements, including capacity for multi-year payment schedules for professional services, subject to appropriations prior to obligation.</text></paragraph></subsection>
<subsection id="id18715c99a19b4aeda729542f0cb77f4a"><enum>(c)</enum><header>Guidelines</header>
<paragraph id="idA3A14BA32BDE4327940C41AC9C4E7557"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall develop programmatic guidelines for the use of performance-based contracts, grant agreements, and cooperative agreements for eligible projects authorized under subsection (b)(1). </text></paragraph> <paragraph id="id21DC43970DAF4DBD971EEC84BA4AD19F"><enum>(2)</enum><header>Consultation required</header> <subparagraph id="id7E4BE1F3987947FAA09CCED37B94F15A"><enum>(A)</enum><header>In general</header><text>In developing the guidelines under paragraph (1), the Secretary shall consult with external organizations and other appropriate entities with experience in performance-based contracts, agreements, or awards, consistent with sections 6302 through 6305 of title 31, United States Code. </text></subparagraph>
<subparagraph id="id5A84B01754464072BAF89B51F07A3AD3"><enum>(B)</enum><header>Limitation</header><text>Consultation with the organizations and entities described in subparagraph (A) shall not constitute or necessitate establishment of an advisory committee under the Federal Advisory Committee Act (5 U.S.C. App.). </text></subparagraph></paragraph> <paragraph id="id48E5E382DE9944E4A9BE924BFD0F1ABD"><enum>(3)</enum><header>Requirements</header><text>At a minimum, guidelines developed under paragraph (1) shall include guidance on—</text>
<subparagraph id="idf03819028de34108a520a818e51b923f"><enum>(A)</enum><text>appropriate proposal and evaluation criteria for eligible projects;</text></subparagraph> <subparagraph id="idef6609e2c9e14acc8b9f0ceda110b74d"><enum>(B)</enum><text>eligibility criteria for restoration providers;</text></subparagraph>
<subparagraph id="idf7f0dac60a014c339dc4a792382a42c8"><enum>(C)</enum><text>criteria for defining achievable ecological outcomes; and</text></subparagraph> <subparagraph id="id218414bfa4fc49a4bbc9ee36d4142d5a"><enum>(D)</enum><text>determination of restoration provider financial assurances sufficient to ensure ecological outcomes will be successfully achieved.</text></subparagraph></paragraph></subsection>
<subsection id="ided2b18912eff42448373814d638180c3"><enum>(d)</enum><header>Identification of eligible projects</header><text>The Secretary shall—</text> <paragraph id="id3DEBD35B909A46E4A8CFAFA37C54BB1E"><enum>(1)</enum><text>identify eligible projects for the use of contracts and agreements under subsection (b)(1); and </text></paragraph>
<paragraph id="id248A282E23254D03A2B1C0020572F2F4"><enum>(2)</enum><text>issue a request for proposals from eligible restoration providers to meet the ecological requirements of habitat and ecosystem restoration, mitigation, and enhancement for the eligible projects identified under paragraph (1).</text></paragraph></subsection> <subsection id="id619e56ee983146748fbb98add8437adb"><enum>(e)</enum><header>Certification</header><text>After the date on which an eligible project identified under subsection (d)(1) is completed, the Secretary shall certify that the work on the eligible project was completed in accordance with the ecological requirements and outcomes defined in advance in the applicable contract or agreement.</text></subsection>
<subsection id="id2308ffe0d7c948ebae62413d24e377ab"><enum>(f)</enum><header>Technical assistance</header><text>At the request of an eligible restoration provider entering into a contract or agreement with the Secretary under subsection (b)(1), the Secretary may provide to the eligible restoration provider technical assistance with respect to—</text> <paragraph id="id58af7b78e34846a2bd8d805ab112f976"><enum>(1)</enum><text>conducting a study, engineering activity, or design activity related to an eligible project carried out by the eligible restoration provider under this section; and</text></paragraph>
<paragraph id="id860b653915ac484891e2d449ae2d9a8d"><enum>(2)</enum><text>obtaining permits necessary for the eligible project.</text></paragraph></subsection> <subsection id="id0cedc3f75cd44aa0a48b98e2fa92e8ae"><enum>(g)</enum><header>Effect</header><text>Nothing in this section authorizes the Secretary to waive—</text>
<paragraph id="id4053E9CB46DF4DB29D4EA6BCDA182793"><enum>(1)</enum><text>the obligations of the Secretary under—</text> <subparagraph id="ide4c78246c73e48e1986e6cd23bbcaa28"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="id1afde56c7fc74630b820c6bae54ba881"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); </text></subparagraph> <subparagraph id="id1b709d13758e45fbbfb00422ec17a939"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); or</text></subparagraph>
<subparagraph id="idc769ea9a52d9405cb8b474f685139088"><enum>(D)</enum><text>any other provision of Federal environmental law; or</text></subparagraph></paragraph> <paragraph id="idCD87D30D6C204D0AAB750B52734AF4D8"><enum>(2)</enum><text>the obligations of a non-Federal party to comply with applicable Federal and State laws.</text></paragraph></subsection>
<subsection id="id1910f77d60fa489096515abd2ab8119c"><enum>(h)</enum><header>Non-Federal funding</header><text>The restoration provider may finance the applicable non-Federal share of an eligible project carried out under the authority provided under subsection (b)(1), on the condition that the non-Federal cost-share responsibility remains with the non-Federal party. </text></subsection> <subsection id="id6ab59c3027554c929c2ccd305603eb43"><enum>(i)</enum><header>Cost share</header><text>Nothing in this section affects a cost-sharing requirement under Federal law that is applicable to an eligible project carried out under the authority provided under subsection (b)(1).</text></subsection>
<subsection id="id12682b01210d42ac9ab9b57bdaf8cfb5"><enum>(j)</enum><header>Mitigation</header><text>Nothing in this section authorizes Federal funding to meet existing environmental mitigation or compliance obligations that are express requirements of a permit or order issued under Federal or State law, unless the requirements expressly contemplate reliance on Federal funding for the performance of the requirements. </text></subsection> <subsection id="id1d1df28e12564e8f87515ea357b84e5c"><enum>(k)</enum><header>Report</header> <paragraph id="id445e3be027434605b9e0493812f58f89"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall—</text>
<subparagraph id="id8d74529ef0e242378311f93215e96caa"><enum>(A)</enum><text>submit to the authorizing committees of Congress and make publicly available a report describing the results of activities carried out under the authority established under subsection (b)(1), including any recommendations of the Secretary on whether the authority or any component of the authorized activities should be implemented on a national basis; and</text></subparagraph> <subparagraph id="idaf9c484136084e919910ea2e5284b5cd"><enum>(B)</enum><text>except as provided in subsection (g), identify any procedural requirements that impede the use of performance-based contracts, grants, and cooperative agreements, including fixed amount awards, for the development and completion of eligible projects.</text></subparagraph></paragraph>
<paragraph id="ida1f30dae1b0548c6bf1d4179d4b0d87d"><enum>(2)</enum><header>Addressing impediments</header><text>Not later than 1 year after the date on which the Secretary identifies impediments, if any, under paragraph (1)(B), the Secretary shall develop and implement programmatic procedures and approaches, including recommendations to the authorizing committees of Congress on legislation, that would—</text> <subparagraph id="id4f3009ebdcbc4f3b9a9913324947eeef"><enum>(A)</enum><text>to the extent practicable, address the impediments; and</text></subparagraph>
<subparagraph id="idc110940f7e824fd38f7974bbdaa374f6"><enum>(B)</enum><text>protect the public interest and any public investment in eligible projects carried out under this section.</text></subparagraph></paragraph></subsection></section></title> <title id="id7ede793a2b5846d1864d71b30c505acf"><enum>IV</enum><header>Miscellaneous</header> <section id="id4551658e4d7d4ba1ade5f97f5547c022"><enum>401.</enum><header>Modifications to drought program under the Reclamation States Emergency Drought Relief Act of 1991</header> <subsection id="id1122268BB6BA4A1BA451014CD441BB08"><enum>(a)</enum><header>Assistance during drought; water purchases</header><text display-inline="yes-display-inline">Section 101 of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2211">43 U.S.C. 2211</external-xref>) is amended—</text>
<paragraph id="id5F571CAB5DED4530A67CC77737213EBE"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="id7D2288B7AA2C4038ADC81E2A876037F1"><enum>(A)</enum><text>in the first sentence, by striking <quote>Consistent</quote> and inserting the following:</text>

<paragraph id="id86D3970AEA8C4A8FBC0D54A573A0A148"><enum>(2)</enum><header>Limitation</header><text>Any construction activities</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="id5BFF28A5BF16479C812BF1CD7F574ED8"><enum>(C)</enum><text>in paragraph (2) (as so designated), by striking <quote>except that</quote> and all that follows through the period at the end and inserting the following:</text>
<quoted-block style="OLC" display-inline="yes-display-inline" id="id49C96F2A92654020B8F095055A33C10D"><text>except that the following may be permanent facilities:</text> <subparagraph id="id84e5c2ee7d904213ba0dd519eeb5928d"><enum>(A)</enum><text>A construction project—</text>
<clause id="id8868E515F3D045D9B33C3E8213296C60"><enum>(i)</enum><text>for which Federal expenditures are not more than $30,000,000; and</text></clause> <clause id="id055F151F57B74A0883FB7DA71535FB6D"><enum>(ii)</enum><text>that is supported by—</text>
<subclause id="id778D285259864E308612B493E231E72D"><enum>(I)</enum><text>the Governor or the relevant agency head of the affected State; or </text></subclause> <subclause id="idE566C50EE87F4CE88971F4F44FEF3160"><enum>(II)</enum><text>if the construction project is on a reservation, by the affected Indian Tribe.</text></subclause></clause></subparagraph>
<subparagraph id="id7fefa4aaedda4d1f9589f0b36ce12133"><enum>(B)</enum><text>A well drilled to minimize losses and damages from drought conditions that—</text> <clause id="id4A86A0B149A34C7FB2F441E95D8CA100"><enum>(i)</enum><text>aligns with applicable local, State, or regional groundwater sustainability goals; or </text></clause>
<clause id="id14944B38CB0F4FF39C0B52A1005C7F33"><enum>(ii)</enum><text>supports drinking water supplies for a disadvantaged community (as defined in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>) or Indian Tribe.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id70d1bf32664a4a31ba138bef449edc73"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="idd555d0ad86d649d28f3ee5b08c66e101"><enum>(e)</enum><header>Funding for fee-Based environmental programs</header>
<paragraph id="ide3d7006956e34a6faa301870ae7fe3cb"><enum>(1)</enum><header>In general</header><text>For any fiscal year for which, due to a drought, as determined by the Secretary, there are insufficient funds to carry out any environmental program that is funded in whole or in part by fees based on the water volume of water delivered by a Federal reclamation project (including fees collected under section 3407(c) of the Reclamation Projects Authorization and Adjustment Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; 106 Stat. 4726)), the Secretary may use other unobligated amounts made available to the Secretary to carry out the environmental program for the fiscal year.</text></paragraph> <paragraph id="idab8707c173994aff9e267ad233bdcf50"><enum>(2)</enum><header>Nonreimbursable funds</header><text>Notwithstanding any other provision of law, amounts made available under paragraph (1) shall be nonreimbursable.</text></paragraph>
<paragraph id="idccac35bf311d4730a49e2d6d5d417066"><enum>(3)</enum><header>Effect</header><text>Nothing in this subsection affects—</text> <subparagraph id="id20D20EACEAB943889877E1722A82B60C"><enum>(A)</enum><text>the authority of the Secretary to address insufficient funding for an environmental program described in paragraph (1) that is not a result of a drought; or</text></subparagraph>
<subparagraph id="id2be8dedec5e54eb496caf47185a13419"><enum>(B)</enum><text>the obligations of the Secretary to the environment under Federal law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id00CFC71E210D48FE9B2438EAA56EB841"><enum>(b)</enum><header>Applicable period of drought program</header><text>Section 104 of the Reclamation States Emergency Drought Relief Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/43/2214">43 U.S.C. 2214</external-xref>) is amended—</text>
<paragraph id="id71BE4DB024014FA282935CEA02AC7D04"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ide0436a51913b489eaa662b2cf79634bc"> <subsection id="idd0b5e17a58374744ae4f1aab709db60a"><enum>(a)</enum><header>In general</header><text>The programs and authorities established under this title shall not become operative in any Reclamation State or in the State of Hawaii until the date on which—</text>
<paragraph id="idf3119ec6eb314b889e607af354579f5f"><enum>(1)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id50B49182E77A4AD593DD8C331F796303"><enum>(A)</enum><text>the Governor of the affected State, and the governing body of the affected Indian Tribe with respect to a reservation, has made a request for temporary drought assistance; and </text></subparagraph> <subparagraph id="id2806D05B9A6A4EE29F96C74204E53663" indent="up1"><enum>(B)</enum><text>the Secretary has determined that the temporary assistance is merited;</text></subparagraph></paragraph>
<paragraph id="id2b610e4c81c5445592f21a159ad6b355"><enum>(2)</enum><text> a drought emergency has been declared for a State or portion of a State by the Governor of each affected State; or</text></paragraph> <paragraph id="ided835eda65ea42369bfdef1958a3ddba"><enum>(3)</enum><text> a drought contingency plan is approved in accordance with title II.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="idE9FAC7B6DC1F46F7B38639E827E8E64E"><enum>(2)</enum><text>in subsection (c), by striking <quote>2021</quote> and inserting <quote>2031</quote>.</text></paragraph></subsection> <subsection id="id7470e03e8561407a9808a3507f181cc2"><enum>(c)</enum><header>Municipal wells; funding under the Infrastructure Investment and Jobs Act</header><text>Section 9504(a)(3) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10364">42 U.S.C. 10364(a)(3)</external-xref>) is amended by adding at the end the following: </text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idefa6c1cbad0d47c898b4031aeda498e1">
<subparagraph id="ide99881cc9e0a4d7c95486a80680f923e"><enum>(G)</enum><header>Municipal wells</header><text>A grant or agreement entered into by the Secretary with any eligible applicant under paragraph (1) to drill a groundwater well for municipal supply to minimize losses and damages from drought conditions, including construction activities to transport or otherwise convey groundwater pumped from the well, shall not contribute to an increase in the net water use of the eligible applicant beyond the period of any drought emergency, except if—</text> <clause id="id376F91068FD94ADEB1A2067325A34D3D"><enum>(i)</enum><text>the groundwater well is for the purpose of supplying drinking water for a disadvantaged community (as defined in section 2 of the <short-title>Support To Rehydrate the Environment, Agriculture, and Municipalities Act</short-title>) or Indian Tribe; or </text></clause>
<clause id="id89DDDD7954974C14B19A2DDC6A0E31BC"><enum>(ii)</enum><text>the new groundwater use is partially offset by aquatic habitat enhancement—</text> <subclause id="idB0BE0C5CA8464E53B73AC0B6E9236BED"><enum>(I)</enum><text>during the drought period; or</text></subclause>
<subclause id="id79CCC8A876334A49A39C3B9DAE12D9FF"><enum>(II)</enum><text>over the long-term, including a future drought period.</text></subclause></clause></subparagraph> <subparagraph id="ide32eca8f57b14a1b89c3b06f40b8658c"><enum>(H)</enum><header>Funding under the Infrastructure Investment and Jobs Act</header><text>For purposes of amounts made available to carry out this section under paragraph (7) of section 40901 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201</external-xref>) for each of fiscal years 2025 and 2026, projects or activities eligible for funding under that paragraph may include a combination of proposed planning activities, actions, or projects within a basin, with the maximum amount of the combined activities not to exceed the maximum amount established under subparagraph (E)(iii).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="idae5a5d28543f43c0aad9ad25b17bd5cf"><enum>402.</enum><header>Offset</header><text display-inline="no-display-inline">Section 4013 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idda0184c28f7b46d9bd2fb191ffc989c4"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id327d29946a0d4de39a73e29b1d484805"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ida1da7678135c419386ca8331e0e25b28"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id07d395918ed74425a19277fd9bf2e6ab">
<paragraph id="idf5504289f25343bc896969e42b9c3f9f"><enum>(3)</enum><text>subsections (a), (b), (c), (d), and (f) of section 4011, which shall expire on December 31, 2028.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id560b218047d5429a91f48face8a828e5"><enum>403.</enum><header>Environmental compliance</header><text display-inline="no-display-inline">No water recycling project, non-Federal storage project, eligible desalination project, or a project eligible for amounts made available under section 105 shall receive Federal funding under this Act unless the applicable project complies with— </text>
<paragraph id="idd5a581b4d90a4598bd61f018862d0a92"><enum>(1)</enum><text>applicable Federal environmental laws; and</text></paragraph> <paragraph id="id1761cae16965481cafa12e22e5452883"><enum>(2)</enum><text>applicable State environmental laws.</text></paragraph></section>
<section id="id10ab370f67c84b07b7415ef18cbea4f7"><enum>404.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act shall be interpreted or implemented in a manner that interferes with any obligation of a State under the Rio Grande Compact or any other compact approved by Congress under the Act of May 31, 1939 (53 Stat. 785, chapter 155), or any litigation relating to the Rio Grande Compact or other compact.</text></section></title> </legis-body> </bill>
