which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide financial assistance for projects to address certain subsidence impacts in the State of California, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Canal Conveyance Capacity Restoration Act</short-title></quote>.</text></section><section id="idedf2bdcdfa094748a612b37ff031abbf"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="idc80f688ce556425ebe2a2ddd351fce9b"><enum>(1)</enum><text>to address severe subsidence impacts that have substantially reduced the carrying capacity of the water delivery system of the State; and</text></paragraph><paragraph id="id7084c25a8eaa437ab76206706451f3ed"><enum>(2)</enum><text>to provide additional water supply in the State at a relatively low cost per acre-foot to increase—</text><subparagraph id="id53ea32b74e4943dc870d7dd40a3113c7"><enum>(A)</enum><text>resiliency to increasingly severe droughts in the State; </text></subparagraph><subparagraph id="id1da9f4a522a2403ab3e83a8ce11bfad4"><enum>(B)</enum><text>groundwater recharge needed to assist in meeting groundwater sustainability goals established under State law; and</text></subparagraph><subparagraph id="id28A02FA33C90449C8C8AF1B4A801B02A"><enum>(C)</enum><text>the reliability of surface or groundwater supplies, portions of which serve disadvantaged communities.</text></subparagraph></paragraph></section><section id="ided91e8bec49c4ac584be7cd2710fdba2"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idf47acfdcac6b42fb9c20b7a5aa4267fa"><enum>(1)</enum><header>Federal pool</header><text>The term <term>Federal pool</term> means each of pools 13 through 21 of the San Luis Canal/California Aqueduct, which are owned by the United States and operated by the California Department of Water Resources under the agreement entitled <quote>Agreement Between the United States of America and the Department of Water Resources of the State of California for the Construction and Operation of the Joint-Use Facilities of the San Luis Unit</quote> and dated December 30, 1961.</text></paragraph><paragraph id="id37646eca6974454591dc748904dc50d6"><enum>(2)</enum><header>Net present value of the local contribution to reimbursable Federal funding</header><text>The term <term>net present value of the local contribution to reimbursable Federal funding</term> means, with respect to a project, the amount equal to the difference between—</text><subparagraph id="idD9464C6FEEAC4B3C88BFEA809F0F75FD"><enum>(A)</enum><text>the total amount of reimbursable Federal funds made available for a project; and </text></subparagraph><subparagraph id="id90644D432F5644F4870207B0641945B5"><enum>(B)</enum><text>the amount of the present value, as of the date of the calculation, of any interest subsidy provided through the repayment terms to the Treasury over similarly structured municipal bond financing available to the non-Federal entity on the disbursement of the reimbursable Federal funds for the project. </text></subparagraph></paragraph><paragraph id="id3d26e3660ebc4aa2842813d152f5b21c"><enum>(3)</enum><header>Non-Federal pool</header><text>The term <term>non-Federal pool</term> means each of pools 22 through 40 of the California Aqueduct, which are owned by the State and operated by the California Department of Water Resources.</text></paragraph><paragraph id="id25173dae838e424cb7455466319ce9d1"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text></paragraph><paragraph id="idc2b1d50cb19743d1b838d94c32b1bae9"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means the State of California. </text></paragraph></section><section id="idc4cf064bc07047f983be061f60aceef3"><enum>4.</enum><header>Friant-Kern Canal and Delta-Mendota Canal subsidence mitigation projects</header><subsection id="id275323346ed74120a91f6db201bb0d51"><enum>(a)</enum><header>In general</header><text>The Secretary may provide financial assistance for the design, planning, and construction of—</text><paragraph id="idf10f5b867e7f469586ff9300e34ed95f"><enum>(1)</enum><text>Federal facility improvements to the Friant Division, Central Valley Project, California, under section 10201(a)(1) of the San Joaquin River Restoration Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1365); and </text></paragraph><paragraph id="id901603aa7ac7484a9e2e68e34efeb747"><enum>(2)</enum><text>a project to restore conveyance capacity at, and to mitigate subsidence-related impacts on, the Delta-Mendota Canal, through a partnership with—</text><subparagraph id="id272627cfc1e9421d86a2b79f01911dc5"><enum>(A)</enum><text>a public water agency that contracts for the delivery of Central Valley Project water; or</text></subparagraph><subparagraph id="ide06be08fdb34406d9df3ee577d2d5a9c"><enum>(B)</enum><text>a local joint powers authority formed under State law by public water agencies that contract for the delivery of Central Valley Project water.</text></subparagraph></paragraph></subsection><subsection id="iddff7fb5824174110be1325ffa638b98d"><enum>(b)</enum><header>Cost-Sharing requirement</header><paragraph id="id25c63a4d3e0a40c3be06cb3c8bd2dcf5"><enum>(1)</enum><header>Federal share</header><text>The Federal share of the cost of carrying out a project under subsection (a) shall be not more than 33 percent of the total cost of the project, including amounts contributed after October 1, 2018.</text></paragraph><paragraph id="id95c54841bb194794acc6797799506430"><enum>(2)</enum><header>Form of non-Federal share</header><text>The non-Federal share of the cost of carrying out a project under subsection (a) may be provided in the form of cash or in-kind contributions, including the net present value of the local contribution to the reimbursable Federal funding for the project after October 1, 2018.</text></paragraph></subsection><subsection id="idf28f3ecde8b149249bfdabe32bf512d1"><enum>(c)</enum><header>Required determination by Secretary</header><text>Federal funds shall not be made available under this Act for a project under subsection (a) unless the Secretary determines that—</text><paragraph id="id40688e8fc8454dbaa8bfd36e327f3224"><enum>(1)</enum><text>there is an adequate non-Federal cost share to match the total amount of federally appropriated financial assistance made available for the project as of the date of the determination of the Secretary; and</text></paragraph><paragraph id="idfce5c2c7068b485790367e6562f5ce5d"><enum>(2)</enum><text>the project is designed in a manner—</text><subparagraph id="ida9f92ac5555f4fe5891573c6e28293cd"><enum>(A)</enum><text>to satisfy the purposes described in section 2, after taking into account anticipated future subsidence; and</text></subparagraph><subparagraph id="id4ca4254f3fca4c4b90fbbdc0c0952e70"><enum>(B)</enum><text>to comply with all applicable requirements of Federal and State law, including part 2.74 of division 6 of the California Water Code (commonly known as the <quote>California Sustainable Groundwater Management Act</quote>).</text></subparagraph></paragraph></subsection></section><section id="id912d787e7f0e4c5b8bd511f12470ddaa"><enum>5.</enum><header>California aqueduct subsidence mitigation project</header><subsection id="idf511dd523f2f46949f85722374006718"><enum>(a)</enum><header>In general</header><text>The Secretary may provide financial assistance for the design, planning, and construction of projects to restore conveyance capacity at, and to mitigate subsidence-related impacts on, the Federal pool and non-Federal pool.</text></subsection><subsection id="idbdec7369453e4a0688f0bb30e36f1f76"><enum>(b)</enum><header>Non-Federal partners</header><text>To carry out this section, the Secretary may enter into partnerships with—</text><paragraph id="id154c42fa58e24539b9cd9bbac369334b"><enum>(1)</enum><text>the State; or</text></paragraph><paragraph id="idd86accdec1c844e9a491705deb4de8cf"><enum>(2)</enum><text>a local joint powers authority formed under State law by public water agencies that contract for delivery of water from the Central Valley Project or the State Water Project.</text></paragraph></subsection><subsection id="id79abbcd95f3b4329a32d6a420ede589f"><enum>(c)</enum><header>Cost-Sharing requirement</header><paragraph id="id413eefa576294747900fe2d3a087446e"><enum>(1)</enum><header>Federal share</header><text>The Federal share of the cost of carrying out a project under subsection (a) shall be not more than 33 percent of the total cost of the project, including any amounts expended by the State for subsidence repairs in the Federal pool and non-Federal pool for the project after October 1, 2018.</text></paragraph><paragraph id="id7c9c5584f15d4c7d8095a45a6195ae06"><enum>(2)</enum><header>Form of non-Federal share</header><text>The non-Federal share of the cost of a project provided financial assistance under subsection (a) may be in the form of cash or in-kind contributions.</text></paragraph></subsection><subsection id="idac49bdaffff948e2a3bb51f87daebd74"><enum>(d)</enum><header>Required determination by Secretary</header><text>Federal funds shall not be made available under this Act for a project under subsection (a) unless the Secretary determines, with the concurrence of the Governor of the State, that—</text><paragraph id="id227089815b64414a944926be893e57b5"><enum>(1)</enum><text>there is an adequate non-Federal cost share to match the total amount of federally appropriated financial assistance made available for the project as of the date of the determination of the Secretary; and</text></paragraph><paragraph id="id9865bbcc11cb4618a13eb5b88624780d"><enum>(2)</enum><text>the project is designed in a manner—</text><subparagraph id="id7242893e6f9d41e1b1a2a72d321c8021"><enum>(A)</enum><text>to satisfy the purposes described in section 2, after taking into account anticipated future subsidence; and</text></subparagraph><subparagraph id="id4da1d792223c461883cb4287595bcb75"><enum>(B)</enum><text>to comply with all applicable requirements of Federal and State law, including part 2.74 of division 6 of the California Water Code (commonly known as the <quote>California Sustainable Groundwater Management Act</quote>).</text></subparagraph></paragraph></subsection></section><section id="idae5a5d28543f43c0aad9ad25b17bd5cf"><enum>6.</enum><header>Prepayment of certain water contracts</header><text display-inline="no-display-inline">Section 4013 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idda0184c28f7b46d9bd2fb191ffc989c4"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id327d29946a0d4de39a73e29b1d484805"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1da7678135c419386ca8331e0e25b28"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id07d395918ed74425a19277fd9bf2e6ab"><paragraph id="idf5504289f25343bc896969e42b9c3f9f"><enum>(3)</enum><text>subsections (a), (b), (c), (d), and (f) of section 4011, which shall expire on December 31, 2033.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id22dd913d66984f4b9c48b8f40cb5f93c"><enum>7.</enum><header>Environmental compliance</header><text display-inline="no-display-inline">In carrying out a project under this Act, the Secretary shall comply with applicable environmental laws, including—</text><paragraph id="idb42745b7fd964c8a990a624d86519940"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); </text></paragraph><paragraph id="idab7b3b7751f7414a9b2d9f8b36cdfc33"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></paragraph><paragraph id="id7bcabbabe5b04d4d8e14742e861a5648"><enum>(3)</enum><text>applicable State law.</text></paragraph></section><section id="id5c8aa36d5a7c47b380be5e7ffa73b832"><enum>8.</enum><header>Authorization of appropriations</header><subsection id="id82f5705a9a174ac689d96712a46e57a7"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary, as adjusted annually to reflect changes since March 2021 in the Bureau of Reclamation Construction Cost Trends Index applicable to the types of construction involved—</text><paragraph id="idbf792276a897455ab136243f3161a440"><enum>(1)</enum><text>$180,000,000 to carry out section 4(a)(1), consistent with, and in addition to funding authorized under, section 10203(c) of the San Joaquin River Restoration Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1367);</text></paragraph><paragraph id="id8106f3b98de849bfbdb840ba27713440"><enum>(2)</enum><text>$183,900,000 to carry out section 4(a)(2);</text></paragraph><paragraph id="id29325846472d4c87bb3495bdce019e33"><enum>(3)</enum><text>$194,000,000 to pay the Federal share for the Federal pool under section 5;</text></paragraph><paragraph id="id446b75519872472db4fd87817581b7e0"><enum>(4)</enum><text>$95,500,000 to pay the Federal share for the non-Federal pool under section 5; and</text></paragraph><paragraph id="id2a69cbc4b6c54d8583e4bfb6e511b0e1"><enum>(5)</enum><text>$180,000,000 to implement the Restoration Goal of the settlement described in section 10004 of the San Joaquin River Restoration Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1350), in addition to the funding authorized under section 10009 of that Act.</text></paragraph></subsection><subsection id="id2b8e8d23d93e464fbd0da04a1f2e29f2"><enum>(b)</enum><header>Limitations</header><text>Amounts made available under subsection (a) may not be used—</text><paragraph id="id4bcb6e5a5c474d8ba131a04be52610b6"><enum>(1)</enum><text>to build new surface storage;</text></paragraph><paragraph id="ida3c352c74dc04af49932beb93ff04191"><enum>(2)</enum><text>to raise existing reservoirs; or</text></paragraph><paragraph id="id33b6634453ea4917b15d5b816dc0fbfe"><enum>(3)</enum><text>to enlarge the carrying capacity of a canal constructed by the Bureau of Reclamation, except for a temporary increase in carrying capacity that is intended—</text><subparagraph id="id0004b0e4c5964d00ae0221658aba20bb"><enum>(A)</enum><text>to mitigate anticipated future subsidence; and</text></subparagraph><subparagraph id="id0fe516d5537046bd877d4b42a05cb88b"><enum>(B)</enum><text>to avoid an increase in carrying capacity that would otherwise be required on the occurrence of anticipated future subsidence.</text></subparagraph></paragraph></subsection><subsection id="id1698b3524eb94ea1b0f83648b30750c2"><enum>(c)</enum><header>Additional amounts</header><text>Amounts made available under subsection (a) shall be—</text><paragraph id="idCC291CAF8EBA4275A4DCAF0F1B884F26"><enum>(1)</enum><text>in addition to any other amounts made available for the purposes described in that subsection; and </text></paragraph><paragraph id="id4A4BDAB87B0D43F1A8735477A3ADB247"><enum>(2)</enum><text>nonreimbursable. </text></paragraph></subsection></section></legis-body></bill>
