which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Public Land Management Act of 2009 to authorize certain extraordinary operation and maintenance work for urban canals of concern. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id9b7a1bfd652642ba8cc2c12dfb413e67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Urban Canal Modernization Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide1f4fba58700471099ac0ed4cff221be"><enum>2.</enum><header>Extraordinary operation and maintenance work performed by the Secretary of the Interior</header><subsection id="id9235152F7A474D9E83E68FF8DB87CF8F"><enum>(a)</enum><header>Definitions</header><text>Section 9601 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510">43 U.S.C. 510</external-xref>) is amended—</text><paragraph id="id9A9A1499F5C348FA869D43C9DFF7505F"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), (6), and (7) as paragraphs (2), (3), (4), (5), (6), (7), and (1), respectively;</text></paragraph><paragraph id="id95A2F0F8EAB64EB2AF2E9D4A770C0DD8"><enum>(2)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>et seq.)</quote> and inserting <quote>et seq.))</quote>;</text></paragraph><paragraph id="idBCB370B0DD6C46449174ED85ADA8B03A"><enum>(3)</enum><text>in paragraph (4) (as so redesignated), by striking <quote>mean</quote> and inserting <quote>means</quote>; and</text></paragraph><paragraph id="idE8EADC24D83C43149999D1B13346AA08"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1722B8463EC344EAA1AF2D6F3AB29C36"><paragraph id="ida24380581c754dc5926cff136f4f5a95"><enum>(8)</enum><header>Urban canal of concern</header><text>The term <term>urban canal of concern</term> means a transferred works or segment of a transferred works—</text><subparagraph id="id89FFB38BF6C54EB48EF54115C86A7061"><enum>(A)</enum><text>that is—</text><clause id="idcb9d06565f8f4d8f81b5252f5a8b0d31"><enum>(i)</enum><text>a canal reach, the failure of which would result in—</text><subclause commented="no" display-inline="no-display-inline" id="idc9b5e8e60c0848b9a4503cc320d038ff"><enum>(I)</enum><text display-inline="yes-display-inline">an estimated at-risk population of more than 100 individuals; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ided14f68c985a4b2cae195f129ee5f6ed"><enum>(II)</enum><text display-inline="yes-display-inline">an estimated property damage of more than $5,000,000; or</text></subclause></clause><clause id="id904fce732c164721a2bda2969266b019"><enum>(ii)</enum><text>a canal reach determined by the responsible Bureau of Reclamation regional or area office to be classified as an urban canal reach; and </text></clause></subparagraph><subparagraph id="id69A24DA8FA114C6081804C5188B7F4BC"><enum>(B)</enum><text>with respect to which the Secretary determines, pursuant to the guidelines and criteria developed under section 9602(a), that if a failure were to occur, the failure would result in loss of life and property in the vicinity of the failed transferred works or segment of transferred works.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD9105444E8854E918576231961A84DF9"><enum>(b)</enum><header>Extraordinary maintenance and operation work on urban canal of concerns</header><text>Section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5B3AA3C243A04529B7695F012E8111A4"><subsection id="id76ceb4f450ea4d4f8b3da18d0d8bcfb3"><enum>(e)</enum><header>Extraordinary operation and maintenance work on urban canals of concern</header><paragraph id="id4e744e48105742b09d92bf296f210e88"><enum>(1)</enum><header>In general</header><text>The Secretary or the transferred works operating entity shall carry out any extraordinary operation and maintenance work on an urban canal of concern that the transferred works operating entity, with the concurrence of the Secretary, determines to be necessary.</text></paragraph><paragraph id="idcf138efd9aa74466899b4c9e7ef64d92"><enum>(2)</enum><header>Funding</header><text>In the case of extraordinary operation and maintenance work on an urban canal of concern authorized under paragraph (1), or if the Secretary determines that a project facility inspected and maintained pursuant to the guidelines and criteria set forth in section 9602(a) requires extraordinary operation and maintenance work pursuant to paragraph (1), the Secretary shall provide Federal funds on a nonreimbursable basis sufficient to cover 35 percent of the portion of total cost of the extraordinary operation and maintenance work allocable to the transferred works operating entity that is needed to carry out the extraordinary operation and maintenance work on the urban canal of concern, with the remaining share of any additional Federal funds advanced by the Secretary for the extraordinary operation and maintenance work to be repaid under subsection (b).</text></paragraph></subsection><subsection id="idDA57ACF0E63F4CB5B80CA2DF8435A838"><enum>(f)</enum><header>Reimbursable funds</header><text>Any reimbursable funds provided under this section shall be considered to be a non-Federal source of funds for purposes of any cost-sharing requirement for a Federal grant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
