which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20241121">November 21, 2024</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to establish a pilot program for the establishment and use of a pre-fire-suppression stand density index, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Catastrophic Wildfire Prevention Act of 2023</short-title></quote>.</text></section><section id="idCC4897822F094C2BB044469BD57398E1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Pilot program</header><subsection id="idC901DFAF899D406A8C689682F0803547"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idA4629F22B1C648CA8996C87ADF47ECCF"><enum>(1)</enum><header>Area of the National Forest System</header><text>The term <term>area of the National Forest System</term> means all or a portion of a unit of the National Forest System that is located west of the 100th meridian.</text></paragraph><paragraph id="id0E18BF883F424EB6AF7B86CAC769517D"><enum>(2)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b).</text></paragraph><paragraph id="id546e0bb93c764e99a8877eaecaae8b32"><enum>(3)</enum><header>Pre-fire-suppression stand density index</header><text>The term <term>pre-fire-suppression stand density index</term> means an estimate of the naturally occurring or ecologically balanced stand density index of a forest, as developed from historical surveys or appropriate scientific inference, before fire suppression regimens became common practice.</text></paragraph><paragraph id="idAAB6D01DC1C4433A8813E134BE741CAA"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="idbf7f8b30d87d4e51963622c6e436135a"><enum>(5)</enum><header>Stand density index</header><text>The term <term>stand density index</term> means an expression of relative stand density based on the predictable relationship between average tree size and trees per unit area in dense stands. </text></paragraph><paragraph id="id8FB3F96536A342E5B62F4BCA3B08F3C9"><enum>(6)</enum><header>Treatment</header><text>The term <term>treatment</term> means—</text><subparagraph id="idB4922EE032344A5FA632345C44EDEC28"><enum>(A)</enum><text>a mechanical treatment of hazardous fuels;</text></subparagraph><subparagraph id="idFD9A6B15493F427B84CC0BD462CBACA1"><enum>(B)</enum><text>a stewardship end-result contracting project;</text></subparagraph><subparagraph id="id5CCA4D0CD47B42C5882CD09C509658E6"><enum>(C)</enum><text>restoration services; or</text></subparagraph><subparagraph id="idB21D3EC27DEA443D9A68243DA073CD08"><enum>(D)</enum><text>timber harvesting.</text></subparagraph></paragraph></subsection><subsection id="id9b19debac90946f9ba0f94643f819093"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a pilot program under which the Secretary shall—</text><paragraph id="ided45c7db570a4b698d33c12b9aabbca6"><enum>(1)</enum><text>collaborate with State or local forest management agencies—</text><subparagraph id="id06431AC8CBCB4364AA2116677A60C5A5"><enum>(A)</enum><text>to identify areas of the National Forest System for potential selection under paragraph (3) for inclusion in the pilot program; and</text></subparagraph><subparagraph id="idA97DC817135745299EF0043EB42A9806"><enum>(B)</enum><text>to research and establish a pre-fire-suppression stand density index for each area of the National Forest System identified under subparagraph (A);</text></subparagraph></paragraph><paragraph id="idab9160c7bc5742b3b4a2b2219c2dd0fa"><enum>(2)</enum><text>evaluate how closely each pre-fire-suppression stand density index established under paragraph (1)(B) reflects current forest conditions and current published resource management objectives established by the Secretary for the applicable area of the National Forest System; and</text></paragraph><paragraph id="id75d14712da1c4d17883024a2b4dec976"><enum>(3)</enum><text>select, in consultation with State or local forest management agencies, not fewer than 8 areas of the National Forest System identified under paragraph (1)(A) with respect to which the area and neighboring communities may benefit from using a pre-fire-suppression stand density index as a benchmark for treatments by— </text><subparagraph id="id69e55a7113364e27a4212c7fb20342bd"><enum>(A)</enum><text>reducing the chances of catastrophic wildfire;</text></subparagraph><subparagraph id="id584b19a22fe04c008987e56a979f2d97"><enum>(B)</enum><text>increasing forest health;</text></subparagraph><subparagraph id="idfc890722f2d944369040abaa42634d1c"><enum>(C)</enum><text>increasing forest resilience;</text></subparagraph><subparagraph id="id0c806e5573eb4ef0aa3b25639dfcaa8b"><enum>(D)</enum><text>increasing ecological diversity; or</text></subparagraph><subparagraph id="id5a37f4d0adcd407c99ead91fcdd622a3"><enum>(E)</enum><text>improving such other criteria as the Secretary, in consultation with State or local forest management agencies, determine to be appropriate. </text></subparagraph></paragraph></subsection><subsection id="idfdd265c6a6eb4e9ba70d7f2772493d89"><enum>(c)</enum><header>Implementation</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall begin to conduct treatments on areas of the National Forest System selected under subsection (b)(3), and update applicable land and resource management plans to include objectives and benchmarks, in accordance with the applicable pre-fire-suppression stand density index established under subsection (b)(1)(B).</text></subsection><subsection id="id1f48bc317401403797634ee6b1cf289f"><enum>(d)</enum><header>Selection of areas</header><text>In selecting areas of the National Forest System for inclusion in the pilot program under subsection (b)(3) and conducting treatments under subsection (c), the Secretary shall—</text><paragraph id="idD949BBBECE324F758C22A32B87C7C9A4"><enum>(1)</enum><text>give priority to an area—</text><subparagraph id="id1e4a5f8ae3c04931a6891e6e27130227"><enum>(A)</enum><text>within the wildland-urban interface (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></subparagraph><subparagraph id="ide38adddd523c479ea489f5dd4881dd3d"><enum>(B)</enum><text>constituting a community watershed;</text></subparagraph><subparagraph id="ide1b896273acd4a17a586f487836ecb6a"><enum>(C)</enum><text>vulnerable to erosion;</text></subparagraph><subparagraph id="idaedab9e9f944481eaaa5f4712fd61845"><enum>(D)</enum><text>hosting multiple-use activities;</text></subparagraph><subparagraph id="iddca0ec32bc9647e7bb116c32667bf149"><enum>(E)</enum><text>critical to supporting wildlife or plant species health; or</text></subparagraph><subparagraph id="id524AB35725754AFCBB63BE1995B05A6A"><enum>(F)</enum><text>with respect to which a treatment is necessary to prevent catastrophic wildfire; and</text></subparagraph></paragraph><paragraph id="id4a2ed7c0625448bd8dea3b85d34d0259"><enum>(2)</enum><text>select a geographically diverse sample of areas of the National Forest System, which shall include not fewer than 3 areas of the National Forest System in the southwest United States. </text></paragraph></subsection><subsection id="idd53a77c747c64c3d8376e24fac9e128e"><enum>(e)</enum><header>Funding</header><text>The Secretary shall carry out this section using funds otherwise made available to the Secretary for fuels reduction treatments.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="idcf9e50cafcfa482f8b5ac0b2b05c2da5" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Catastrophic Wildfire Prevention Act of 2024</short-title></quote>.</text></section><section id="id42b2d60e956942f19c30bc6836d0484b" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Pilot program</header><subsection id="id9888cd023e9a4d3fa7c082f5647f86e2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9bc20d0fd4844b7698278ea975bef508"><enum>(1)</enum><header>Historical stand density index</header><text>The term <term>historical stand density index</term> means an estimate of the naturally occurring or ecologically balanced stand density index of a forest, as developed from historical surveys or appropriate scientific inference of data collected not more recently than 1915. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id228d0fa0796842ad90c3f38c1f76b885"><enum>(2)</enum><header>National Forest System</header><subparagraph commented="no" display-inline="no-display-inline" id="id88c7c72839674fe8828be2e4766c5460"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>National Forest System</term> means land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)) administered by the Secretary.</text></subparagraph><subparagraph id="idfab999daaa2b4d8d83102436bec7d971"><enum>(B)</enum><header>Exclusion</header><text>The term <term>National Forest System</term> does not include any forest reserve not created from the public domain. </text></subparagraph></paragraph><paragraph id="id14f8299a7b624a4f9733c88baa8db547"><enum>(3)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b).</text></paragraph><paragraph id="id1fdaa88a0f4442e0a02babef20cc2f48"><enum>(4)</enum><header>Resource management plan</header><text>The term <term>resource management plan</term> means a land and resource management plan prepared for 1 or more units of the National Forest System under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></paragraph><paragraph id="id5e8e1ce077b6489299ce42ed6cc686d6"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="idf2f417f04868455e90851e71cbe41f78"><enum>(6)</enum><header>Stand density index</header><text>The term <term>stand density index</term> means an expression of relative stand density based on the predictable relationship between average tree size and trees per unit area in dense stands.</text></paragraph><paragraph id="id8007601581e14e5c81a47a383ce09911"><enum>(7)</enum><header>Treatment</header><text>The term <term>treatment</term> means—</text><subparagraph id="id599234a37f9045378ada9ef75b3ce22d"><enum>(A)</enum><text>a mechanical treatment of hazardous fuels;</text></subparagraph><subparagraph id="idbfddfce7b9e34e198bee4d28819d3423"><enum>(B)</enum><text>a stewardship end-result contracting project;</text></subparagraph><subparagraph id="id6b78286a9bca4b7795a693e45b0953a7"><enum>(C)</enum><text>restoration services;</text></subparagraph><subparagraph id="id82e957f02a6a43e18c09f07bf7b196cb"><enum>(D)</enum><text>timber harvesting; or</text></subparagraph><subparagraph id="id7c264cf32dba4c77b7c0d05c1c819da2"><enum>(E)</enum><text>other forest stand improvement activities, as determined by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="id899e1f0759464f0a9b1ef8c40f060120"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a pilot program under which the Secretary shall—</text><paragraph id="id6795aa8eb488473eae91bb408f9f5c16"><enum>(1)</enum><text>collaborate with State, local, and Tribal forest management agencies—</text><subparagraph id="id8ef839bf6fcc4582b52d92bd27616146"><enum>(A)</enum><text>to identify areas of the National Forest System for potential selection under paragraph (2) for inclusion in the pilot program; and</text></subparagraph><subparagraph id="id7d5a35cf4ccc4649b45c1867640b5df8"><enum>(B)</enum><text>to research and determine an historical stand density index for each area of the National Forest System identified under subparagraph (A);</text></subparagraph></paragraph><paragraph id="id653d29e374cd4988b552917828fefd8b"><enum>(2)</enum><text>select, in consultation with State, local, and Tribal forest management agencies, as necessary, projects in areas of the National Forest System identified under paragraph (1)(A) for implementation of treatments under subsection (c), in accordance with the selection criteria under subsection (d);</text></paragraph><paragraph id="ida7ea6ab985064c0fabe66ecf38052c5b"><enum>(3)</enum><text>evaluate the implementation of treatments conducted on areas of the National Forest System selected under paragraph (2), with respect to the efficacy of the treatments in—</text><subparagraph id="id5c118f4df6954d6f85b9e7510c82721d"><enum>(A)</enum><text>reducing catastrophic wildfire risk;</text></subparagraph><subparagraph id="id94e3bb8708cb44ac8925dd2d04e577c5"><enum>(B)</enum><text>increasing forest health;</text></subparagraph><subparagraph id="id0a0600fa224248a0bf3ba84ec5d544b6"><enum>(C)</enum><text>increasing forest resilience;</text></subparagraph><subparagraph id="idc9357c4671944328b716f6c7a400f496"><enum>(D)</enum><text>increasing ecological diversity; or</text></subparagraph><subparagraph id="id0a45fca1f31a4a33bd31721d138b8ebf"><enum>(E)</enum><text>improving such other criteria as the Secretary determines to be appropriate; and</text></subparagraph></paragraph><paragraph id="id20b59ea839724862a3115b1b1077cb31"><enum>(4)</enum><text>as practicable, compare and update the resource management plans for areas of the National Forest System selected under paragraph (2) in accordance with any findings resulting from the evaluations under paragraph (3).</text></paragraph></subsection><subsection id="id4af1eefab1ee456bbc10ebe07f70a79f"><enum>(c)</enum><header>Implementation</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall begin implementation of treatments on areas of the National Forest System selected under subsection (b)(2) to achieve the historical stand density index established under subsection (b)(1)(B) for those areas of the National Forest System.</text></subsection><subsection id="idcc10465bbd4742dd89b08aeb31f3fa65"><enum>(d)</enum><header>Selection of areas</header><text>In selecting areas of the National Forest System for inclusion in the pilot program under subsection (b)(2) and implementing treatments under subsection (c), the Secretary shall—</text><paragraph id="id6ed389b1de3e4cacaa904aeec9b3d795"><enum>(1)</enum><text>give priority to an area—</text><subparagraph id="idbcef791ac1904aa8a6a5f5201a274e09"><enum>(A)</enum><text>within the wildland-urban interface (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></subparagraph><subparagraph id="idd1f402f8c5d14fa3a12f8ce05a8b3a02"><enum>(B)</enum><text>constituting a municipal watershed;</text></subparagraph><subparagraph id="id66a0954b36ed478682b56c8eef278ed6"><enum>(C)</enum><text>critical to maintaining water quality and yield;</text></subparagraph><subparagraph id="id6a491de335fd45bea08784b47f661e46"><enum>(D)</enum><text>vulnerable to erosion, flooding, landslides, or other post-fire impacts;</text></subparagraph><subparagraph id="id0f8e5940f7ed4dab9487bd3e985e8356"><enum>(E)</enum><text>hosting multiple-use activities;</text></subparagraph><subparagraph id="id083df38b42694bdc9973eb13862a37c3"><enum>(F)</enum><text>critical to supporting wildlife or plant species health;</text></subparagraph><subparagraph id="ida7265704d206436a90f2eb8b1808d413"><enum>(G)</enum><text>with respect to which a treatment is necessary to prevent catastrophic wildfire; or</text></subparagraph><subparagraph id="idb864e3d0f9a040779516340587f602c1"><enum>(H)</enum><text>for which the comparison of forest resilience under an historical stand density index with the contemporary stand density index would best inform forest ecology and wildland fire research; and</text></subparagraph></paragraph><paragraph id="id4f7c0f8daa734ce1ba960a0dfefe12b4"><enum>(2)</enum><text>select a geographically diverse sample of areas of the National Forest System with various forest cover types; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec2a33486239455fac939c92a0bea4cd"><enum>(3)</enum><text>select not less than 1 area of the National Forest System in each region of the National Forest System.</text></paragraph></subsection><subsection id="idca7d1f48be264a6989530233159731dd"><enum>(e)</enum><header>Funding</header><text>The Secretary shall carry out this section using funds otherwise made available to the Secretary for—</text><paragraph id="id1a0c0bca715243ffa2cb5f70fbdc31e1"><enum>(1)</enum><text>research and development, with respect to the requirements under paragraphs (1), (2), and (4) of subsection (b); and</text></paragraph><paragraph id="id2bd648aff60144c48f77e43249ae9dd0"><enum>(2)</enum><text>fuels reduction treatments, with respect to the implementation of treatments described in subsection (c) and the other requirements under this section.</text></paragraph></subsection></section></legis-body><endorsement><action-date date="20241121">November 21, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
