committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to facilitate efficient State implementation of certain national ambient air quality standards, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Ambient Air Quality Standards Implementation Act of 2023</short-title></quote>.</text></section><section id="id75bc13e676974b8dade4dc7e7f24061a"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ida8a09af7262e497c87164f3b911611e6"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id68281129cedc4924ad9fd2d00eb9ede6"><enum>(2)</enum><header>National ambient air quality standard</header><text>The term <term>national ambient air quality standard</term> means a national ambient air quality standard promulgated under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>).</text></paragraph></section><section id="id3bb2933a2f8b4e60b82b9683171c684b"><enum>3.</enum><header>Facilitating state implementation of national ambient air quality standards</header><subsection id="id48be9e11fa4c4078b8e0d11d5209a624"><enum>(a)</enum><header>Consideration of technological feasibility</header><text>Section 109(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(b)</external-xref>) is amended—</text><paragraph id="idca8f100a96cd4834b03725f4e24de7bb"><enum>(1)</enum><text>by striking <quote>(b)(1) National</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70195b8ad4444c06aa0e57c292be71c2"><subsection id="id41ba7294c7a04554b0a98d4b1368694e"><enum>(b)</enum><header>Requirements</header><paragraph id="id3dd133e7ad7045cb873d6720b7e1a250"><enum>(1)</enum><header>In general</header><subparagraph id="iddaee1bc27cab4a58b39bbc60f99e7034"><enum>(A)</enum><header>Public health</header><text>National</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id21A3B27C9B65406CAFA3509667094F55"><enum>(2)</enum><text>in paragraph (1)(A) (as so designated), in the second sentence, by striking <quote>Such primary standards</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7791A9BEF4B84BE282395417D886A099"><subparagraph id="id57cd1d90162d46c8b874dcce5bf6def9"><enum>(B)</enum><header>Technological feasibility</header><text>If the Administrator, in consultation with the independent scientific review committee appointed under subsection (d), finds that a range of levels of air quality for an air pollutant are requisite to protect public health with an adequate margin of safety, as described in subparagraph (A), the Administrator may consider, as a secondary consideration, likely technological feasibility in establishing and revising the national primary ambient air quality standard for the pollutant.</text></subparagraph><subparagraph id="id0B3011070DEB4832A9C76576971B7A53"><enum>(C)</enum><header>Revision</header><text>National primary ambient air quality standards</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida255bda6daae40578dd26062dadadd6a"><enum>(b)</enum><header>Timeline for review of national ambient air quality standards</header><paragraph id="id23bf151d194142368cac1813898b6b2c"><enum>(1)</enum><header>10-year cycle for all criteria air pollutants</header><text>Section 109(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)</external-xref>) is amended—</text><subparagraph id="idc6c9538c120a48d18c8779330de46704"><enum>(A)</enum><text>in paragraph (1), in the first sentence, by striking <quote>five-year intervals</quote> and inserting <quote>10-year intervals</quote>; and</text></subparagraph><subparagraph id="idab425b7cb9de4163abad5d309a8bac66"><enum>(B)</enum><text>in paragraph (2)(B), by striking <quote>five-year intervals</quote> and inserting <quote>10-year intervals</quote>.</text></subparagraph></paragraph><paragraph id="id4aac747a12694912869a81e9df7f884f"><enum>(2)</enum><header>Cycle for next review of ozone criteria and standards</header><text>Notwithstanding section 109(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)</external-xref>), the Administrator shall not—</text><subparagraph id="id64adeb646e274eabb4861dd0ce53f2b0"><enum>(A)</enum><text>complete, before December 31, 2030, any review of the criteria for ozone published under section 108 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7408">42 U.S.C. 7408</external-xref>) or the national ambient air quality standard for ozone promulgated under section 109 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>); or</text></subparagraph><subparagraph id="id10c65ab97e014f05abc0e2a532dc7c2d"><enum>(B)</enum><text>propose, before December 31, 2030, any revisions to those criteria or standards.</text></subparagraph></paragraph><paragraph id="id422cab3f49914a4caf52b76a78edb73a"><enum>(3)</enum><header>Cycle for next review of particulate matter criteria and standards</header><text>Notwithstanding section 109(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)</external-xref>), the Administrator shall not—</text><subparagraph id="idf582cfeda0f240b39b6100aca07cd523"><enum>(A)</enum><text>complete, before December 18, 2030, any review of the criteria for particulate matter published under section 108 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7408">42 U.S.C. 7408</external-xref>) or the national ambient air quality standard for particulate matter promulgated under section 109 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>); or</text></subparagraph><subparagraph id="ida076a50a7eaa40448603a38c8a9f295a"><enum>(B)</enum><text>propose, before December 18, 2030, any revisions to those criteria or standards.</text></subparagraph></paragraph></subsection><subsection id="idb16b3cfc7f7e43c7859f2d9cd03a14c4"><enum>(c)</enum><header>Consideration of adverse public health, welfare, social, economic, or energy effects</header><text>Section 109(d)(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idba624f80a4a746e2adbb3b685228496a"><subparagraph id="idc1301dfcad6b456494070e6215f5fe6f"><enum>(D)</enum><header>Advice from scientific review committee</header><text>Before establishing or revising a national ambient air quality standard, the Administrator shall request, and the scientific review committee appointed under subparagraph (A) shall provide, advice under subparagraph (C)(iv) regarding any adverse public health, welfare, social, economic, or energy effects which may result from various strategies for attainment and maintenance of the national ambient air quality standard.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5d9ccceb4fe744e3a697076179c98125"><enum>(d)</enum><header>Timely issuance of implementing regulations and guidance</header><text>Section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc5471a6482c8464c91ca1625e24b177a"><subsection id="id9130ca04a7d74371bcd10dd7950ac8e9"><enum>(e)</enum><header>Timely issuance of implementing regulations and guidance</header><paragraph id="id8f693a444e0a42e5afb487ff41d46e69"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="ida8424ae75de2438093ac0fae5f577677"><enum>(A)</enum><header>Best available control technology</header><text>The term <term>best available control technology</term> has the meaning given that term in section 169.</text></subparagraph><subparagraph id="id9a69cff194894ee093fe75b27dedf1ad"><enum>(B)</enum><header>Lowest achievable emission rate</header><text>The term <term>lowest achievable emission rate</term> has the meaning given that term in section 171.</text></subparagraph><subparagraph id="idf8f398c9f7bc42819bca360bfcda0a19"><enum>(C)</enum><header>Preconstruction permit</header><clause id="id5d9ba69ce59542918c7dd87e9e6e7b7d"><enum>(i)</enum><header>In general</header><text>The term <term>preconstruction permit</term> means a permit that is required under part C or D for the construction or modification of a major emitting facility or major stationary source.</text></clause><clause id="idcc823eb3bb694a7198ae5500827ed8ad"><enum>(ii)</enum><header>Inclusion</header><text>The term <term>preconstruction permit</term> includes any permit described in clause (i) issued by the Administrator or a State, local, or Tribal permitting authority.</text></clause></subparagraph></paragraph><paragraph id="id457a126c9a4a46af997e4851af296930"><enum>(2)</enum><header>Guidance for implementation</header><text>In publishing any final rule establishing or revising a national ambient air quality standard, the Administrator shall, as the Administrator determines necessary to assist States, permitting authorities, and permit applicants, concurrently publish final regulations and guidance for implementing the national ambient air quality standard, including information relating to submission and consideration of a preconstruction permit application under the new or revised national ambient air quality standard.</text></paragraph><paragraph id="idc068f23f561249d68255fe7b088180c7"><enum>(3)</enum><header>Applicability of national ambient air quality standard to preconstruction permitting</header><text>If the Administrator fails to publish the final regulations and guidance referred to in paragraph (2) that include information relating to submission and consideration of a preconstruction permit application under a new or revised national ambient air quality standard concurrently with the national ambient air quality standard, the new or revised national ambient air quality standard shall not apply to the review and disposition of a preconstruction permit application until the date on which the Administrator publishes the final regulations and guidance.</text></paragraph><paragraph id="idaa5093fcc1074f068866987436a007f3"><enum>(4)</enum><header>Rules of construction</header><text>Nothing in this subsection—</text><subparagraph id="idbf30a32534a34442a0baa0c6090e77fd"><enum>(A)</enum><text>precludes the Administrator from issuing regulations and guidance to assist States, permitting authorities, and permit applicants in implementing a national ambient air quality standard after the publication of final regulations and guidance for the national ambient air quality standard under paragraph (2);</text></subparagraph><subparagraph id="id681fd4dd8f8a426692c337bc29dbb777"><enum>(B)</enum><text>eliminates the obligation of a preconstruction permit applicant to install best available control technology and lowest achievable emission rate technology, as applicable; or</text></subparagraph><subparagraph id="ide7b9358dd2da4d9c8ef9f2fa28ebe93f"><enum>(C)</enum><text>limits the authority of a State, local, or Tribal permitting authority to impose more stringent emissions requirements pursuant to State, local, or Tribal law than the Federal national ambient air quality standards established by the Administrator.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb0e5e25167d6400d8d98047e846f963b"><enum>(e)</enum><header>Contingency measures for extreme ozone nonattainment areas</header><text>Section 172(c)(9) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7502">42 U.S.C. 7502(c)(9)</external-xref>) is amended—</text><paragraph id="id0f0411c8b48c4559aca349645ad87930"><enum>(1)</enum><text>in the first sentence, by striking <quote>Such</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb183f69d5ae543c8aa8eeb67cc4e9874"><subparagraph id="idf905bcf7d2954884a7ab22927c9e896d"><enum>(A)</enum><header>Specific measures</header><text>A nonattainment</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idef92288a9322474db021292bd7665ca4"><enum>(2)</enum><text>in subparagraph (A) (as so designated), in the second sentence, by striking <quote>Such measures</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1952108a4a854f2f886ff6d69742482a"><subparagraph id="idbd203cccf6e64931b28bd192f6b1925f"><enum>(B)</enum><header>Contingency measures</header><text>The specific measures referred to in subparagraph (A)</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5a83ad70cac14ec486112bff46e34c98"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd5c4639a24604403b80f38a04e485b2f"><subparagraph id="id6f1cb0dba7d745eab2b498e9ed6a90e2"><enum>(C)</enum><header>Extreme areas</header><text>Notwithstanding subparagraphs (A) and (B) and any other provision of this Act, the specific measures referred to in subparagraphs (A) and (B) shall not be required for any nonattainment area for ozone classified as an Extreme Area.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1c5bd828ce3a425b90fd0b34133433dd"><enum>(f)</enum><header>Plan submissions and requirements for ozone nonattainment areas</header><text>Section 182 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7511a">42 U.S.C. 7511a</external-xref>) is amended—</text><paragraph id="ide08a52e834c54b3584fb1b22df86a801"><enum>(1)</enum><text>in subsection (b)(1)(A)(ii)(III), by inserting <quote>and economic feasibility</quote> after <quote>technological achievability</quote>;</text></paragraph><paragraph id="idbf8ccf7721b3422791d8d134057ed746"><enum>(2)</enum><text>in subsection (c)(2)(B)(ii), by inserting <quote>and economic feasibility</quote> after <quote>technological achievability</quote>; and</text></paragraph><paragraph id="id500904d3488845d3bab25bfe02028b14"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="iddd3a2fe714bd447bb28555860ec693a9"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking the second sentence and inserting <quote>Paragraphs (6), (7), and (8) of subsection (c) (relating to de minimis rule and modification of sources) shall not apply in the case of an Extreme Area.</quote>;</text></subparagraph><subparagraph id="id7f651a6046c042a4b17f067f4d3b5a67"><enum>(B)</enum><text>in paragraph (5), in the matter preceding subparagraph (A), by striking <quote>, if the State demonstrates to the satisfaction of the Administrator that—</quote> and all that follows through <quote>compliance with subsections (b)(1) and (c)(2)</quote> in the undesignated matter following subparagraph (B); and</text></subparagraph><subparagraph id="id5488B7C7825C4265A066F10F1CF25616"><enum>(C)</enum><text>in the undesignated matter following paragraph (5), by striking <quote>Any reference to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3a1a14f5fd0f43f290b21527a9f1c2f5"><paragraph id="id96d6b0449968427992827c28e5d99041"><enum>(6)</enum><header>References</header><text>Any reference to</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idefc5a144afbc4da8a8c59fac09ce3910"><enum>(g)</enum><header>Plan revisions for milestones for particulate matter nonattainment areas</header><text>Section 189(c)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7513a">42 U.S.C. 7513a(c)(1)</external-xref>) is amended by inserting <quote>, which take into account technological achievability and economic feasibility,</quote> after <quote>redesignated attainment</quote>.</text></subsection><subsection id="id9e4a33bbc6a24c6992fb185e9b46f1fa"><enum>(h)</enum><header>Exceptional events</header><text>Section 319(b)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)(1)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1c15ae37393e4655a8f4ebc5052d91dc"><subparagraph id="ide3c8087c075543afb779918fe227e4d3"><enum>(B)</enum><header>Exclusions</header><text>In this subsection, the term <term>exceptional event</term> does not include—</text><clause id="idb2f5a7c2360f4f8b81bb14c4a70d728c"><enum>(i)</enum><text>ordinarily occurring stagnation of air masses;</text></clause><clause id="id5b96ab743b8c42c28c67fa2feef2b6c0"><enum>(ii)</enum><text>meteorological inversions; or</text></clause><clause id="id1b9286e4be6e4b9ea625f7409a33e1f1"><enum>(iii)</enum><text>air pollution relating to source noncompliance.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2d45251ed4f341f585d463038f500a3d"><enum>(i)</enum><header>Report on emissions emanating from outside the United States</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in consultation with States, shall submit to Congress a report that describes—</text><paragraph id="ida801c360a2b54fff85ebc96a12b96caa"><enum>(1)</enum><text>the extent to which foreign sources of air pollution, including emissions from sources located outside North America, impact—</text><subparagraph id="id970d637acad4429ba7ec24d8fb17cac4"><enum>(A)</enum><text>designations of areas (or portions of areas) as nonattainment, attainment, or unclassifiable under section 107(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7407">42 U.S.C. 7407(d)</external-xref>); and</text></subparagraph><subparagraph id="idb978529890344a0697f365400c73e0d7"><enum>(B)</enum><text>attainment and maintenance of national ambient air quality standards;</text></subparagraph></paragraph><paragraph id="id612cf732341d4eb19d9fe666e311ab0a"><enum>(2)</enum><text>the procedures and timelines of the Administrator for the disposition of petitions submitted under subsection (b) of section 179B of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7509a">42 U.S.C. 7509a</external-xref>);</text></paragraph><paragraph id="idc0a2ecbd24bd4a5a84066b29caa99ebf"><enum>(3)</enum><text>the total number of petitions received by the Administrator under that section (<external-xref legal-doc="usc" parsable-cite="usc/42/7509a">42 U.S.C. 7509a</external-xref>) and, for each petition—</text><subparagraph id="id4369dfb54bd846a9b84d6dd33f9fed75"><enum>(A)</enum><text>the date on which the petition was initially submitted to the Administrator; and</text></subparagraph><subparagraph id="idc2fa012a8d864468b5721208dbcee981"><enum>(B)</enum><text>the date of final disposition by the Administrator; and</text></subparagraph></paragraph><paragraph id="id07d4416c16b946b1828811311a333154"><enum>(4)</enum><text>whether the Administrator recommends any statutory changes to facilitate the more efficient review and disposition of petitions submitted under that section (<external-xref legal-doc="usc" parsable-cite="usc/42/7509a">42 U.S.C. 7509a</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
