<official-title>To direct the Secretary of Labor to enter into contracts with industry intermediaries for purposes of promoting the development of and access to apprenticeships and related pre-apprenticeships for secondary school students.</official-title>

<section section-type="section-one" id="HA8288EF43F1841FBA0B017657A70D873"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Apprenticeship Pathways Act of 2023</short-title></quote>.</text></section> <section display-inline="no-display-inline" id="id1534DFB8145A48969A506C468AA66515"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="id43B177FC89114D248F3CE26CF2D50320"><enum>(1)</enum><header display-inline="yes-display-inline">Apprenticeship</header><text display-inline="yes-display-inline">The term <term>apprenticeship</term> means an apprenticeship registered under the National Apprenticeship Act.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ideec30d47c87c4b56a65ed2c80b500dca"><enum>(2)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given such term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id157a4f96ae3245be943ea189e358250f"><enum>(3)</enum><header>Disconnected youth</header><text display-inline="yes-display-inline">The term <term>disconnected youth</term> means any individual who—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2563841211a84007a41da578ab500920"><enum>(A)</enum><text display-inline="yes-display-inline">has attained age 16 but not age 25 on the date of selection for an apprenticeship;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id19c22eceb6ff44a08ee7bcf832cfb123"><enum>(B)</enum><text display-inline="yes-display-inline">is not regularly attending any secondary school, area career and technical education school (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/29/2302">29 U.S.C. 2302</external-xref>)), or postsecondary school during the 6-month period preceding the date of selection for the apprenticeship; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ide7981a4b5b9f4d0f99521cf982da12e0"><enum>(C)</enum><text display-inline="yes-display-inline">is not regularly employed during such 6-month period.</text></subparagraph></paragraph>
<paragraph id="idD644B276EFD14BC4AF78CD73290579D5"><enum>(4)</enum><header>Early college high school</header><text>The term <term>early college high school</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="id3DBE46EA22E54185A2435C1539591898" commented="no"><enum>(5)</enum><header>Educational service agency</header><text>The term <term>educational service agency</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph>
<paragraph id="idC52FFA612462409B8887D1C9B98FFDE2"><enum>(6)</enum><header>High school</header><text>The term <term>high school</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="idBDF179C007E54ECD8625CB79FD61882B"><enum>(7)</enum><header>Industry intermediary</header><text>The term <term>industry intermediary</term> means an entity that—</text>
<subparagraph id="idfd93781313fe4b6dad4245966e25017f"><enum>(A)</enum><text>in order to accelerate apprenticeship program development, to help establish new apprenticeship partnerships at the national, State, or regional level, and to promote access to apprenticeships for secondary school students, serves as a conduit between—</text> <clause commented="no" display-inline="no-display-inline" id="id601bd9d71bbe4204af6a02c5c48e7559"><enum>(i)</enum><text display-inline="yes-display-inline">an employer; and </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id7e1a6ee478794866a441ef74f1a4390a"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity such as—</text> <subclause id="idD83289B500544BBCB5766754351282F5"><enum>(I)</enum><text>an industry partner;</text></subclause>
<subclause id="id6CDE2A528F6049ACB84C8144F809E77F"><enum>(II)</enum><text>the Department of Labor; and</text></subclause> <subclause id="id6CEC4E71CF2D419A864AE33BC0058437"><enum>(III)</enum><text>a State agency responsible for workforce investment activities;</text></subclause></clause></subparagraph>
<subparagraph id="idCE680C289A0E438185F803345A189503"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates a capacity to work with employers and other key partners to identify workforce trends and foster public-private funding to establish new apprenticeship programs; and</text></subparagraph> <subparagraph id="idAF749B34AC124A4288DCEFFA71437D74"><enum>(C)</enum><text>is an entity such as—</text>
<clause id="id57971F6019014169BE9AFE8A35487741"><enum>(i)</enum><text>a business;</text></clause> <clause id="idE13F7E4E5B4C44EAB56CAEDC606BC55B"><enum>(ii)</enum><text>a business-related nonprofit organization, including industry associations and business federations;</text></clause>
<clause id="idD558CC56D65B492B9ABB1E1636BB4EDC"><enum>(iii)</enum><text>a private organization functioning as a workforce intermediary for the express purpose of serving the needs of businesses, including community-based nonprofit service providers and industry-aligned training providers; or</text></clause> <clause id="id00398C5DB9194A0B841EDCA174A3AAE3"><enum>(iv)</enum><text>a consortium of any of the entities described in clauses (i) through (iii).</text></clause></subparagraph></paragraph>
<paragraph id="id7FB01DA77BAD4ED68F66224E25BDA577"><enum>(8)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id7515a38e240245579340fc5e215e742b"><enum>(9)</enum><header>National apprenticeship Act</header><text>The term <term>National Apprenticeship Act</term> means the Act of August 16, 1937 (commonly known as the “National Apprenticeship Act”; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph>
<paragraph id="id87852ad6cf3a45beb45733f1d1a44abc"><enum>(10)</enum><header>Pre-apprenticeship program</header><text>The term <term>pre-apprenticeship program</term> means a training model or program that—</text> <subparagraph id="id913c32efa9cd4ff8beb7f8678e2da5b7"><enum>(A)</enum><text>prepares individuals for acceptance into an apprenticeship program;</text></subparagraph>
<subparagraph id="id24d967f01c154e758159634cf0f1b28f"><enum>(B)</enum><text>meets the standards, for such a model or program, established under the National Apprenticeship Act; and</text></subparagraph> <subparagraph id="idb0cc502710554f06b2f963d58d0cd381"><enum>(C)</enum><text>is registered under the National Apprenticeship Act.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id34326d048e94497c851bc26079fc3c86"><enum>(11)</enum><header>Region</header><text>The term <term>region</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph> <paragraph id="idAE282984F26F440B84E0B93BBA9572F8"><enum>(12)</enum><header>Secondary school</header><text>The term <term>secondary school</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph>
<paragraph id="idF5ED319333E14702846F3B46587C5EA0" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header>STEM</header><text>The term <term>STEM</term> means science, technology, engineering, and mathematics. </text></paragraph></section> <section id="idC345BE5E18CA4EAAACFA2EF49DC8A57F"><enum>3.</enum><header>Secondary education apprenticeship contracts</header> <subsection id="ide2afe380c1694ebdafacdb9e0cfb06cf"><enum>(a)</enum><header>In general</header><text>The Secretary of Labor (referred to in this section as <quote>the Secretary</quote>), in consultation with the Secretary of Education, shall enter into contracts with industry intermediaries for the purpose of promoting the development of and access to apprenticeships for secondary school students, from amounts appropriated under subsection (f).</text></subsection>
<subsection id="idCBDFF96A958D466BA5168B4D48E2EA7D"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to be awarded a contract under this section, an industry intermediary shall submit an application to the Secretary, at such time and in such manner as may be required by the Secretary, that identifies proposed activities designed to further the purpose described in subsection (a).</text></subsection> <subsection id="idC1CAE92EDA5C4CD2874D15CB5E7B6240"><enum>(c)</enum><header>Selection</header> <paragraph commented="no" display-inline="no-display-inline" id="id764ff94457164132ad3870b5f014f42f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall award contracts under this section based on competitive criteria to be prescribed by the Secretary.</text></paragraph>
<paragraph id="idab4f31ef0d0e406b93ff068b2af41e4f" commented="no"><enum>(2)</enum><header>Priority consideration for contracts</header><text>In awarding contracts under this section, the Secretary shall give priority consideration to intermediaries proposing contracts targeting— </text> <subparagraph id="id9fa568f7076e470b81ee80b3450e7075" commented="no"><enum>(A)</enum><text>engagement with students from secondary schools in which 40 percent of the students the local educational agency serves are eligible for free or reduced price lunches under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="id0129b310abe346d68ee1841c98fcf6b6" commented="no"><enum>(B)</enum><text>engagement with students served by—</text> <clause id="iddf392d14467946b58d7ae80ba35c2fd6"><enum>(i)</enum><text>rural high-need local educational agencies with locale codes of 32, 33, 41, 42, or 43; or</text></clause>
<clause id="idfd01692db638415e856592ad5d09089e"><enum>(ii)</enum><text>educational service agencies serving rural high-need local educational agencies with locale codes of 32, 33, 41, 42, or 43;</text></clause></subparagraph> <subparagraph id="id5959c6438e644cbf9374fb5ae4fbe95b"><enum>(C)</enum><text>engagement with students residing in a Census tract that is a high-poverty area, as defined in section 681.260 of title 20, Code of Federal Regulations, or a successor regulation;</text></subparagraph>
<subparagraph id="id1d701134e37c473094123d90df5cd880"><enum>(D)</enum><text>engagement with disconnected youth;</text></subparagraph> <subparagraph id="id1a31c02cb7c34ab19cd41b5ecbc97c94"><enum>(E)</enum><text>engagement with an Indian child, as defined in section 4 of the Indian Child Welfare Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1903">25 U.S.C. 1903</external-xref>); </text></subparagraph>
<subparagraph id="id7ac18a2b4dfa441d9479d759c19f91d6" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>increasing participation of women in building trades and technology; and</text></subparagraph> <subparagraph id="iddad12586519d4c2ba1d36d595b1cb330"><enum>(G)</enum><text>engagement with individuals with disabilities.</text></subparagraph></paragraph></subsection>
<subsection id="id928A4E62B43C4162813E09507311A4E1"><enum>(d)</enum><header>Use of funds</header>
<paragraph commented="no" display-inline="no-display-inline" id="id63b9c1d375be4a628d66b9987330d950"><enum>(1)</enum><header display-inline="yes-display-inline">General activities</header><text>An industry intermediary that is awarded a contract under this section may only use the funds made available through such contract to carry out activities designed to further the purpose described in subsection (a), including—</text> <subparagraph id="id8DC294B01BFA4E9689388222BF45A15F"><enum>(A)</enum><text>facilitating the development and provision of apprenticeships and related pre-apprenticeships, in the occupations of high need listed in subsection (e), through collaborations with public and private entities that provide job-related instruction, such as on-the-job training, pre-apprenticeship training, and technical training;</text></subparagraph>
<subparagraph id="id52114F2221484534AC8541C0E2053347"><enum>(B)</enum><text>encouraging entities to establish such apprenticeships and related pre-apprenticeships;</text></subparagraph> <subparagraph id="idBC51793414D7498BAC0FF50DC9820B5F"><enum>(C)</enum><text>identifying, assessing, and training applicants for such apprenticeships and pre-apprenticeships who are—</text>
<clause id="id4C4EA293479D4BCCA02FD07941941F35"><enum>(i)</enum><text>enrolled in secondary school;</text></clause> <clause id="idA3918A657A1E4E77B3629C4426F84798"><enum>(ii)</enum><text>enrolled in an early college high school that focuses on education in STEM subjects;</text></clause>
<clause id="id70D10AE856864C12916AB6BF90AC1462"><enum>(iii)</enum><text>individuals age 18 or older who meet appropriate qualification standards; or</text></clause> <clause id="idcb5b55ff8c074424a267a55401b33d76"><enum>(iv)</enum><text>enrolled in a pre-apprenticeship, or a training initiative for an apprenticeship, that allow adults to concurrently increase academic and workforce skills through proven, evidence-based models that connect all learning to the specific apprenticeship involved and significantly accelerate completion of preparation for the apprenticeship;</text></clause></subparagraph>
<subparagraph id="id87af67bb025a434fb08207407a017adb"><enum>(D)</enum><text>tracking the progress of such applicants who participate in such apprenticeships;</text></subparagraph> <subparagraph id="id2e8c6f7afc9240f1bc853689a19c2284"><enum>(E)</enum><text>orientation and training prior to the apprenticeship, and ongoing support;</text></subparagraph>
<subparagraph id="id1000b2ec7dc644dc859828fab3b46b0b"><enum>(F)</enum><text>recruitment and retention of employer partners;</text></subparagraph> <subparagraph id="id5ebd55b922d044ee9cc3145096d5d8e8"><enum>(G)</enum><text>administrative and operational activities;</text></subparagraph>
<subparagraph id="id487fe20852b64627b10ad847d7b15d47"><enum>(H)</enum><text>coaching, including development of life skills, social-emotional skills, soft skills, employability skills, and workforce readiness;</text></subparagraph> <subparagraph id="id9ac510682aba4ed7929a836356803c50"><enum>(I)</enum><text>wraparound support services, including monitoring of academic progress of the apprentice, and provision to the apprentice of financial incentives of payments for child and family care costs (such as transportation assistance or a gas card), and of free tutoring and career services (which may include benefit counseling), in order to create a community of apprentices participating in the activities described in subsection (b); and</text></subparagraph>
<subparagraph id="idcab98b5ac5844cc68f0dbbbc0f1fd6d9"><enum>(J)</enum><text>paying 50 percent of the wages of an apprentice for the duration of the apprenticeship involved. </text></subparagraph></paragraph> <paragraph id="id031882f33d8f43efb2e4540b700b57f6"><enum>(2)</enum><header>Goods and services</header><text>An industry intermediary that receives a contract under this section may use the funds made available through such contract for goods and services, including—</text>
<subparagraph id="id2abb9a8ce876400a924f2158601a85d7"><enum>(A)</enum><text>related educational goods and services, including provision of tuition assistance, books, and fees associated with any related instruction;</text></subparagraph> <subparagraph id="idee062c27e7f246b68c562271f529d08f"><enum>(B)</enum><text>equipment and tools related to the apprenticeship occupation;</text></subparagraph>
<subparagraph id="ida05752dc54a7458590c9ec8f46e77a87"><enum>(C)</enum><text>clothing, including construction boots, kneepads, hard hats, and visibility vests, related to the apprenticeship occupation; and</text></subparagraph> <subparagraph id="idfbe979425e3c427b9a20f7190944b632"><enum>(D)</enum><text>technology and internet access.</text></subparagraph></paragraph></subsection>
<subsection id="id9c06cb9687a044c4911dd0e8d1092414" commented="no"><enum>(e)</enum><header>Occupations of high need</header><text>The occupations of high need referred to in subsection (d)(1)(A) are occupations that relate to—</text> <paragraph id="id0d1940a1aefa4995be441ac1fc4560f9" commented="no"><enum>(1)</enum><text>building trades, including—</text>
<subparagraph id="idbda4996df6a0499987feb87108b23049" commented="no"><enum>(A)</enum><text>carpentry;</text></subparagraph> <subparagraph id="idf43107f086e3409c8750c0a54619503e" commented="no"><enum>(B)</enum><text>plumbing;</text></subparagraph>
<subparagraph id="id785f6a136c594c67b21e61eed3658b92" commented="no"><enum>(C)</enum><text>welding;</text></subparagraph> <subparagraph id="id9836271dc39940f7a8456bb9f1d9a768" commented="no"><enum>(D)</enum><text>electrician occupations;</text></subparagraph>
<subparagraph id="id1b1c04599b6543b28afed8536c95ea38" commented="no"><enum>(E)</enum><text>machinist occupations;</text></subparagraph> <subparagraph id="idf50f328233414076906d7218f5e028e8" commented="no"><enum>(F)</enum><text>mechanic occupations;</text></subparagraph>
<subparagraph id="idb8408485c52d401ab0c20e529d867595" commented="no"><enum>(G)</enum><text>pipe fitting;</text></subparagraph> <subparagraph id="idaaab43caf10d4b2b9b85b6f1becf9e43" commented="no"><enum>(H)</enum><text>heating, ventilation, and air conditioning occupations;</text></subparagraph>
<subparagraph id="id2b382231f2034be58a6bf046fb3b68fd"><enum>(I)</enum><text>operating engineer and equipment operator occupations;</text></subparagraph> <subparagraph id="id4a71db99528f41e18342d532a7b8611b"><enum>(J)</enum><text>cement mason occupations;</text></subparagraph>
<subparagraph id="id5ca39e28d4114f8a9807c2d63f53b2fc"><enum>(K)</enum><text>sheet metal work occupations;</text></subparagraph> <subparagraph id="idcc3bce3d02f94159a6e3046f9f6993fc"><enum>(L)</enum><text>boilermaker occupations; </text></subparagraph>
<subparagraph id="id53e3c3a565b34b92af9e6d5ae9712eaa" commented="no"><enum>(M)</enum><text>solar installation; and</text></subparagraph> <subparagraph id="id4de00a842dea4525bbb120ca411333df" commented="no"><enum>(N)</enum><text>roofing;</text></subparagraph></paragraph>
<paragraph id="ida0d6481d5acd4d8e8327a044b71ffdee"><enum>(2)</enum><text>architectural and engineering drafting and design;</text></paragraph> <paragraph id="idfa54d3c5e19f42268f55e8803749a2f7" commented="no"><enum>(3)</enum><text>healthcare, including the occupations of—</text>
<subparagraph id="id88c920ed20e94a20a33a8ff172974d69" commented="no"><enum>(A)</enum><text>emergency medical technicians;</text></subparagraph> <subparagraph id="id3910e1d408e046a1bc3b4ce171c9c16b" commented="no"><enum>(B)</enum><text>phlebotomists;</text></subparagraph>
<subparagraph id="idfa1c2e943518412699db78456a7d908b" commented="no"><enum>(C)</enum><text>pharmacy technicians;</text></subparagraph> <subparagraph id="id36ceafb6e1514548b4d7b8019f92099e" commented="no"><enum>(D)</enum><text>respiratory therapists; </text></subparagraph>
<subparagraph id="id6d4a8009cb314dfa86c94c1607cb397f" commented="no"><enum>(E)</enum><text>home health aides;</text></subparagraph> <subparagraph id="id05e08a225045441cbd1fe0c3b577d58c"><enum>(F)</enum><text>radiologic technologists;</text></subparagraph>
<subparagraph id="ida7caa90639394c238c6dbab25ddd98fb"><enum>(G)</enum><text>licensed practical nurses;</text></subparagraph> <subparagraph id="id72909d33160c4effbe397397e94ad4c2"><enum>(H)</enum><text>nurse technicians; and</text></subparagraph>
<subparagraph id="id58b18f8eec20451ebd87f7247bbb3a07"><enum>(I)</enum><text>laboratory technicians;</text></subparagraph></paragraph> <paragraph id="id7736ec49a5e049e19389a355654cf913" commented="no"><enum>(4)</enum><text>teaching, including early childhood educators;</text></paragraph>
<paragraph id="id9f4818eae7984f0688c3c3a46cdad350" commented="no"><enum>(5)</enum><text>technology, including—</text> <subparagraph id="id4f9a316ff14840c78aadea0e9480dddc"><enum>(A)</enum><text>computer science occupations;</text></subparagraph>
<subparagraph id="id9baee79e1df9458f9572d515d497bff2"><enum>(B)</enum><text>fabrication laboratory technician;</text></subparagraph> <subparagraph id="ide3b5a53a3fc54dd580274df4b1b35a5e"><enum>(C)</enum><text>telecommunications occupations;</text></subparagraph>
<subparagraph id="idd7405c5691fd41b7ad3639fc2ef4d562"><enum>(D)</enum><text>data science occupations; and</text></subparagraph> <subparagraph id="id3f7df236b50d4ce2a0f8654d468f0782"><enum>(E)</enum><text>product management; and</text></subparagraph></paragraph>
<paragraph id="id3c3fa19c38854cf7ac6f393d73e61d38" commented="no"><enum>(6)</enum><text>manufacturing.</text></paragraph></subsection> <subsection id="id5EA22DBA0D44453EBA3DDC97C92A8B6B"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary for the purposes of carrying out this section.</text></subsection></section>
