<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2107</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230622">June 22, 2023</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> (for himself, <cosponsor name-id="S409">Mr. Luján</cosponsor>, and <cosponsor name-id="S380">Mr. Peters</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow grantees under the HIV Health Care Services Program to allocate a portion of such funding for services to individuals at risk of acquiring HIV.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ryan White PrEP Availability Act</short-title></quote>.</text></section><section id="id778E9FCA03A44A3193C27F25F86C4EEC"><enum>2.</enum><header>Services for individuals at risk of acquiring HIV</header><text display-inline="no-display-inline">Title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-11">42 U.S.C. 300ff–11 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4F54E148BC40432E8D9F540D831E9CD4"><part id="id5AE72E235A4746ACB4592C8322A48B34" style="OLC"><enum>H</enum><header>Services for individuals at risk of acquiring HIV</header><section id="id86629810EBCE485D9B8EB7B7798C4507"><enum>2696.</enum><header>Individuals at risk of acquiring HIV</header><subsection id="id383A8D0A1900482DAA0C5038DDCB3BCE"><enum>(a)</enum><header>In general</header><text>Any eligible area, State, or public or private nonprofit entity that receives a grant under part A, B, C, or D may use program income received from such a grant to provide to individuals who are at risk of acquiring HIV—</text><paragraph id="id44C4FCFFF0454F37B6A1896BE5354C47"><enum>(1)</enum><text>drugs and biological products for pre-exposure prophylaxis (PrEP) prescribed by a professional who is authorized under State or other applicable law to write prescriptions, consistent with Federal guidelines issued by the Centers for Disease Control and Prevention;</text></paragraph><paragraph id="id57FAE934968E40BFBCAA819920B00164"><enum>(2)</enum><text>medical, laboratory, and counseling services related to such drugs and biological products; and</text></paragraph><paragraph id="id45DAE8B09C8D4682B1301E5FE304FCC7"><enum>(3)</enum><text>referrals and linkages to appropriate services for the prevention of HIV, as prescribed to eligible individuals who are at risk of acquiring HIV.</text></paragraph></subsection><subsection id="id26C1471E7968437D9921B1DDFE6ACA3D"><enum>(b)</enum><header>Voluntary program</header><text>Nothing in this section shall be construed to permit any eligible area, State, or public or private nonprofit entity to allocate any grant funds received under this title for the purposes described in paragraph (1) or (2) of subsection (a).</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
