<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 2073</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 31, United States Code, to require agencies to include a list of outdated or duplicative reporting requirements in annual budget justifications, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id3703e8b6-1b2e-4bdc-8081-103ae3e08745" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminate Useless Reports Act of 2023</short-title></quote>.</text></section><section id="id40c5107f-9322-49d6-a702-d64dedb60838" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sunsets for agency reports</header><subsection id="idbbbfd098-ed84-4978-839c-7a818cf62b2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1125 of title 31, United States Code, is amended—</text><paragraph id="id29276c89-7942-4799-be05-d1a764356bae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as subsection (d);</text></paragraph><paragraph id="id0fea1540-df50-43f2-849d-9985c4d6bb8d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9be06a0f-69b0-4aea-acc5-295771201840" changed="not-changed"><subsection id="idb0647e2b-7c50-4d6d-93b6-866465db8da2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id785fac84-fd75-46d7-8d28-c6ea9ca95253" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Budget justification materials</header><text display-inline="yes-display-inline">The term <term>budget justification materials</term> has the meaning given the term in section 3(b)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>).</text></paragraph><paragraph id="idcde5c7ae-551e-4994-b782-dcce5f9f4d73" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Recurring plan or report</header><text display-inline="yes-display-inline">The term <term>recurring plan or report</term>—</text><subparagraph id="id58324dda-5bbc-442f-b05b-00fda8c85c03" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">means any plan or report submitted to Congress by not less than 1 agency on a recurring basis—</text><clause id="id828ad172-cbf6-4958-ae7b-6fbbbbc6c0c3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with Federal law; or</text></clause><clause id="id8aa6511c-ed6e-4b7c-bea2-b5d4444cf0ee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">at the direction of a congressional report; and</text></clause></subparagraph><subparagraph id="idaee57486-447a-4af8-9344-039e25a1e953" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any plan or report that is required to be submitted to the Committee on Armed Services of the Senate.</text></subparagraph></paragraph><paragraph id="idc2d113a8-4df4-41f4-9585-e00d2a2c7958" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Relevant congressional committee</header><text display-inline="yes-display-inline">The term <term>relevant congressional committee</term> means a congressional committee to which a recurring plan or report is required to be submitted.</text></paragraph></subsection><subsection id="id7a59469b-9f60-4069-98c5-2e4a8fa995ac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Agency identification of unnecessary reports</header><paragraph id="id9574f692-da58-4b1f-8753-b2303a25d00a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The head of each agency shall include in the budget justification materials of the agency—</text><subparagraph id="id22cc57db-5d1e-4bd9-a0a0-089a424b4f6b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a list of each recurring plan or report submitted by the agency that the head of the agency determines to be outdated or duplicative;</text></subparagraph><subparagraph id="id8974d44c-84c2-4526-9372-942d988285f1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to each recurring plan or report described in subparagraph (A)—</text><clause id="idfc8f1d75-ed00-4b05-be71-7bebf2cb684e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a recommendation on whether to sunset, modify, consolidate, or reduce the frequency of the submission of the recurring plan or report;</text></clause><clause id="idb2547678-a5f8-415f-a068-455fbc000b96" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a citation to each provision of law or directive in a congressional report that requires or requests the submission of the recurring plan or report; and</text></clause><clause id="id11e2cc24-75a3-405a-85af-435aae2053ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a list of the relevant congressional committees for the recurring plan or report; and</text></clause></subparagraph><subparagraph id="id339f1577-cc03-4273-ab18-e13157541d4a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a justification explaining, with respect to each recommendation described in subparagraph (B)(i) relating to a recurring plan or report—</text><clause id="id611058ff-c9f8-41c1-9047-cc8dab6caf3a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">why the head of the agency made the recommendation, which may include an estimate of the resources expended by the agency to prepare and submit the recurring plan or report; and</text></clause><clause id="ida5c03b1b-ecae-4ba9-93f1-28ffb375e72a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the understanding of the head of the agency of the purpose of the recurring plan or report.</text></clause></subparagraph></paragraph><paragraph id="idb9a19453-2560-4c04-8ba7-25f4ffe07d68" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agency consultation</header><subparagraph id="id2aaa01bf-0db8-4c49-83dc-57ac26ad43f7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In preparing the list required under paragraph (1)(A), if, in submitting a recurring plan or report, an agency is required to coordinate or consult with another agency or entity, the head of the agency submitting the recurring plan or report shall consult with the head of each agency or entity with whom consultation or coordination is required.</text></subparagraph><subparagraph id="idbeefec1c-e52c-4887-98f0-6c86a3922cd5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion in list</header><text display-inline="yes-display-inline">If, after a consultation under subparagraph (A), the head of each agency or entity consulted under that subparagraph agrees that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring plan or report shall—</text><clause id="idb0db7da2-b582-419f-9f18-4fc44b2f73ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">include the recurring plan or report in the list described in paragraph (1)(A); and</text></clause><clause id="id585e2843-a336-4497-b6f6-f952bd12aa0a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">identify each agency or entity with which the head of the agency is required to coordinate or consult in submitting the recurring plan or report.</text></clause></subparagraph><subparagraph id="id9bb73e3c-cdb1-4530-98f1-0b990890aacb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Disagreement</header><text display-inline="yes-display-inline">If the head of any agency or entity consulted under subparagraph (A) does not agree that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring plan or report shall not include the recurring plan or report in the list described in paragraph (1)(A). </text></subparagraph></paragraph><paragraph id="id4d587e6946464cdf8df547c56e052594" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Government-wide or multi-agency plan and report submissions</header><text display-inline="yes-display-inline">With respect to a recurring plan or report required to be submitted by not less than 2 agencies, the Director of the Office of Management and Budget shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb9e88f23ed644d2fabe94bb6cec86c78" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the requirement to submit the recurring plan or report is outdated or duplicative; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e8eb705f57c4c3880653d1054b75e82" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations to Congress accordingly.</text></subparagraph></paragraph></subsection><subsection id="idaae5eb2a-0ac0-4c85-ada3-601e6b96abda" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Disposition of recommendations</header><paragraph id="idb4ef9f55-c55b-46dc-8db9-456f2713c85e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to a recommendation on a recurring plan or report included in budget justification materials by the head of an agency under subsection (b)(1)(B)(i), the chair and ranking member of each relevant congressional committee may—</text><subparagraph id="ida260ce6f-2679-42ef-878b-a72e4708a5fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in coordination with any other relevant congressional committee, as necessary, agree or disagree with the recommendation or postpone a decision on the recommendation; and</text></subparagraph><subparagraph id="id2d1dd115-f7f8-4f17-9a68-a0e489382c41" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">notify each agency that submits a recommendation of the disposition of the recommendation under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id80fa0857-93e1-4528-9f6f-b15f807f16bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Legislative steps</header><text display-inline="yes-display-inline">If a relevant congressional committee agrees with an agency recommendation submitted under subsection (b)(1)(B)(i), the relevant congressional committee may take the necessary legislative steps to accomplish the recommendation, which may include consulting with the agency that submits the recurring plan or report that is the subject of the recommendation to prepare appropriate legislation.</text></paragraph><paragraph id="idade4501e-3c3d-4ff6-b296-e2b6aa278265" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Agency requirements</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to relieve the head of an agency from a requirement to submit a recurring plan or report.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="idac8c453e-b625-4d8f-925b-311a49e86d76" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d), as so redesignated, by striking <quote>in the budget of the United States Government, as provided by section 1105(a)(37)</quote> and inserting <quote>in the budget justification materials of each agency</quote>.</text></paragraph></subsection><subsection id="id34a24b3f-7c4f-458b-b203-a41b4e5ba696" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Budget contents</header><text display-inline="yes-display-inline">Section 1105(a) of title 31, United States Code, is amended by striking paragraph (39). </text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20231218" chamber="Senate">Passed the Senate December 18, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
