Sunsets for agency reports.</toc-entry></toc></subsection></section><title id="ide942d1285f894d27b310462bef006909" style="OLC" commented="no"><enum>I</enum><header>Keeping Kids Safe Online</header><subtitle style="OLC" id="id420F27DCCA1C41008A26D7FD3BA5AE97"><enum>A</enum><header>Kids Online Safety</header><section commented="no" display-inline="no-display-inline" id="idcb02bebf6a7f4d43b673bc4e4f675b0c"><enum>101.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id87c354f6-e5b8-4cdf-84d6-468fe9e50c69" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual who is under the age of 13.</text></paragraph><paragraph id="idad944a76-a092-44b6-acfa-3dcee3764f38"><enum>(2)</enum><header>Compulsive usage</header><text>The term <term>compulsive usage</term> means any response stimulated by external factors that causes an individual to engage in repetitive behavior reasonably likely to cause psychological distress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde646ba4-e174-4b52-bd46-994b04d05e78"><enum>(3)</enum><header>Covered platform</header><subparagraph commented="no" display-inline="no-display-inline" id="id6698062b-5120-4a78-b5e6-1269d34ea5e4"><enum>(A)</enum><header>In general</header><text>The term <term>covered platform</term> means an online platform, online video game, messaging application, or video streaming service that connects to the internet and that is used, or is reasonably likely to be used, by a minor. </text></subparagraph><subparagraph id="idbf888cc4-08e0-47d3-93a2-5be9b4a9ca80"><enum>(B)</enum><header>Exceptions</header><text>The term <term>covered platform</term> does not include—</text><clause id="id78cecdec-d8f3-467f-a183-88cfd98f5a39"><enum>(i)</enum><text>an entity acting in its capacity as a provider of—</text><subclause id="id16250a3c-1c63-4248-9055-d233d0a6bff0"><enum>(I)</enum><text>a common carrier service subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and all Acts amendatory thereof and supplementary thereto;</text></subclause><subclause id="id0b1e3f9b-cbc8-4b61-a7c8-c45caaee1acd"><enum>(II)</enum><text>a broadband internet access service (as such term is defined for purposes of section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id075cf2e0-854a-4191-9bc0-ef4748fb4eaa"><enum>(III)</enum><text display-inline="yes-display-inline">an email service; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0cfc272f67954ce394edeee153dd75f2"><enum>(IV)</enum><text display-inline="yes-display-inline">a teleconferencing or video conferencing service that allows reception and transmission of audio or video signals for real-time communication, provided that—</text><item commented="no" display-inline="no-display-inline" id="id2de154293c614bf6a508216046dff287"><enum>(aa)</enum><text display-inline="yes-display-inline">the service is not an online platform, including a social media service or social network; and</text></item><item commented="no" display-inline="no-display-inline" id="id56d33836e0ad415e8ff5954dfc2d114c"><enum>(bb)</enum><text>the real-time communication is initiated by using a unique link or identifier to facilitate access; or</text></item></subclause><subclause id="id203d5974e4ec40c5887fc03fc9b759a6"><enum>(V)</enum><text>a wireless messaging service, including such a service provided through short messaging service or multimedia messaging service protocols, that is not a component of, or linked to, an online platform and where the predominant or exclusive function is direct messaging consisting of the transmission of text, photos or videos that are sent by electronic means, where messages are transmitted from the sender to a recipient, and are not posted within an online platform or publicly; </text></subclause></clause><clause id="id28a80fbd-bfef-458f-83f2-32882a24c73f"><enum>(ii)</enum><text>an organization not organized to carry on business for its own profit or that of its members;</text></clause><clause id="id26ce8f59-350b-43b0-b743-3d38048adaf0"><enum>(iii)</enum><text>any public or private preschool, elementary, or secondary school, or any institution of vocational, professional, or higher education;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9137d27f-648e-49b8-9df2-4915b6ad3f7f"><enum>(iv)</enum><text>a library (as defined in section 213(1) of the Library Services and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9122">20 U.S.C. 9122(1)</external-xref>)); </text></clause><clause commented="no" display-inline="no-display-inline" id="iddf6ec5ddc0a84b71983eac9b40be6078"><enum>(v)</enum><text display-inline="yes-display-inline">a news or sports coverage website or app where— </text><subclause commented="no" display-inline="no-display-inline" id="idb38a8e4357b74d1aacc523eb7918681d"><enum>(I)</enum><text display-inline="yes-display-inline">the inclusion of video content on the website or app is related to the website or app's own gathering, reporting, or publishing of news content or sports coverage; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfb62258ff8ab4bb080f6db8fc98c2ea1"><enum>(II)</enum><text display-inline="yes-display-inline">the website or app is not otherwise an online platform;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idaa521062f91040ba9276ee1e213ca45e"><enum>(vi)</enum><text display-inline="yes-display-inline">a product or service that primarily functions as business-to-business software, a cloud storage, file sharing, or file collaboration service, provided that the product or service is not an online platform; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id8886f8b9d742484bb6eb7c5780df0b28"><enum>(vii)</enum><text>a virtual private network or similar service that exists solely to route internet traffic between locations.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b41d0878d884f689a420e91a4d2a5c3"><enum>(4)</enum><header>Design feature</header><text>The term <term>design feature</term> means any feature or component of a covered platform that will encourage or increase the frequency, time spent, or activity of minors on the covered platform. Design features include but are not limited to—</text><subparagraph id="id4336b8a56d4c46cb96e8b9ec0c4b2290"><enum>(A)</enum><text>infinite scrolling or auto play;</text></subparagraph><subparagraph id="id0ba74c52c443466eb6d35fb045789294"><enum>(B)</enum><text>rewards for time spent on the platform;</text></subparagraph><subparagraph id="idfd4f8b5fe7d9449ebd3b929561b78583"><enum>(C)</enum><text>notifications;</text></subparagraph><subparagraph id="id428c9b8f24a242c7b168ba149e4e621f"><enum>(D)</enum><text>personalized recommendation systems;</text></subparagraph><subparagraph id="id6bc3019e6eac47adbecfdf4af608d9ec"><enum>(E)</enum><text>in-game purchases; or</text></subparagraph><subparagraph id="id21e1e41a66544380898122b8630e53de"><enum>(F)</enum><text>appearance altering filters. </text></subparagraph></paragraph><paragraph id="idc032584c-22f6-4aa1-a37f-55978d095c2d"><enum>(5)</enum><header>Geolocation</header><text>The term <term>geolocation</term> has the meaning given the term <term>geolocation information</term> in section 1302 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>), as added by section 201(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca29d06a89ad4aa28365146e7942659e"><enum>(6)</enum><header display-inline="yes-display-inline">Know or knows</header><text>The term <term>know</term> or <term>knows</term> means to have actual knowledge or knowledge fairly implied on the basis of objective circumstances.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3ab3ce8fde740218ed2d12bd8c888cc"><enum>(7)</enum><header display-inline="yes-display-inline">Mental health disorder</header><text>The term <term>mental health disorder</term> has the meaning given the term <term>mental disorder</term> in the Diagnostic and Statistical Manual of Mental Health Disorders, 5th Edition (or the most current successor edition).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc217d2797e6c4a4898ce804f1e51302e"><enum>(8)</enum><header>Microtransaction</header><subparagraph commented="no" display-inline="no-display-inline" id="id542fee46e7a84aa99b4868aeddbc51e7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>microtransaction</term> means a purchase made in an online video game (including a purchase made using a virtual currency that is purchasable or redeemable using cash or credit or that is included as part of a paid subscription service).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idedc56f881b0446bc9ecced04a472c3ee"><enum>(B)</enum><header>Inclusions</header><text>Such term includes a purchase involving surprise mechanics, new characters, or in-game items.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d67d68568cd42048b159ca4a6069689"><enum>(C)</enum><header>Exclusions</header><text display-inline="yes-display-inline">Such term does not include—</text><clause commented="no" display-inline="no-display-inline" id="idb1da0d2b4b8a4a94bcb023920ae95487"><enum>(i)</enum><text display-inline="yes-display-inline">a purchase made in an online video game using a virtual currency that is earned through gameplay and is not otherwise purchasable or redeemable using cash or credit or included as part of a paid subscription service; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id101b17857699425ba41ab751ac2716dc"><enum>(ii)</enum><text display-inline="yes-display-inline">a purchase of additional levels within the game or an overall expansion of the game.</text></clause></subparagraph></paragraph><paragraph id="idf4bcdfae-c476-4355-baf9-b088a082c2d1"><enum>(9)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who is under the age of 17.</text></paragraph><paragraph id="id5159406b-3a94-40e1-b93e-5d8120db1ecc"><enum>(10)</enum><header>Online platform</header><text>The term <term>online platform</term> means any public-facing website, online service, online application, or mobile application that predominantly provides a community forum for user generated content, such as sharing videos, images, games, audio files, or other content, including a social media service, social network, or virtual reality environment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a72aa04312f45b397fbeef29321bb8c"><enum>(11)</enum><header>Online video game</header><text display-inline="yes-display-inline">The term <term>online video game</term> means a video game, including an educational video game, that connects to the internet and that allows a user to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id2c6b4ba0ba044516adb5b058c05977a1"><enum>(A)</enum><text display-inline="yes-display-inline">create and upload content other than content that is incidental to gameplay, such as character or level designs created by the user, preselected phrases, or short interactions with other users;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd87bb00b8ea64a538c1ac04f63764152"><enum>(B)</enum><text display-inline="yes-display-inline">engage in microtransactions within the game; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id394db00484eb4bb8965195c8cab1380d"><enum>(C)</enum><text>communicate with other users.</text></subparagraph></paragraph><paragraph id="id5ae35870-16b4-4ff9-95fe-f1a8a80ab801"><enum>(12)</enum><header>Parent</header><text>The term <term>parent</term> has the meaning given that term in section 1302 of the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph><paragraph id="id00a70c6c-a294-481a-bee1-cf0348ba45fe"><enum>(13)</enum><header>Personal data</header><text>The term <term>personal data</term> has the same meaning as the term <term>personal information</term> as defined in section 1302 of the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph><paragraph id="idb3cef12f-5fac-43af-a3e8-3cce5ddd126c"><enum>(14)</enum><header>Personalized recommendation system</header><text>The term <term>personalized recommendation system</term> means a fully or partially automated system used to suggest, promote, or rank content, including other users, hashtags, or posts, based on the personal data of users. A recommendation system that suggests, promotes, or ranks content based solely on the user’s language, city or town, or age shall not be considered a personalized recommendation system. </text></paragraph><paragraph id="idb11cc3b7-0ad9-429d-80b7-8a4de6429e95"><enum>(15)</enum><header>Sexual exploitation and abuse</header><text>The term <term>sexual exploitation and abuse</term> means any of the following:</text><subparagraph id="id9e0fc746-2212-456c-800e-f0502127fbbc"><enum>(A)</enum><text>Coercion and enticement, as described in section 2422 of title 18, United States Code. </text></subparagraph><subparagraph id="id8e9474cc-e7f2-46a0-ab45-ac41018ca829"><enum>(B)</enum><text>Child sexual abuse material, as described in sections 2251, 2252, 2252A, and 2260 of title 18, United States Code.</text></subparagraph><subparagraph id="idd60ed669-8513-4e93-96d4-f0f8aaa8829a"><enum>(C)</enum><text>Trafficking for the production of images, as described in section 2251A of title 18, United States Code.</text></subparagraph><subparagraph id="id77b30895-3ecd-4e5a-a4b7-37fc21ace1f1"><enum>(D)</enum><text>Sex trafficking of children, as described in section 1591 of title 18, United States Code.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4441d440c6334425a356e3b5c8f4414d"><enum>(16)</enum><header>User</header><text>The term <term>user</term> means, with respect to a covered platform, an individual who registers an account or creates a profile on the covered platform.</text></paragraph></section><section id="id2dcf5db8-db00-4b58-82e0-26cc87b87aad"><enum>102.</enum><header>Duty of care</header><subsection id="id44feef84-d084-43a7-8595-cbdedf4d2e0e"><enum>(a)</enum><header>Prevention of harm to minors</header><text>A covered platform shall exercise reasonable care in the creation and implementation of any design feature to prevent and mitigate the following harms to minors: </text><paragraph commented="no" display-inline="no-display-inline" id="ida8890d79-9302-40c8-9a62-2c1aed6e10c0"><enum>(1)</enum><text display-inline="yes-display-inline">Consistent with evidence-informed medical information, the following mental health disorders: anxiety, depression, eating disorders, substance use disorders, and suicidal behaviors.</text></paragraph><paragraph id="id74fd6905-b874-4e48-877e-311b9192ebe3"><enum>(2)</enum><text>Patterns of use that indicate or encourage addiction-like behaviors by minors.</text></paragraph><paragraph id="idf87b6439-d893-42e3-8d4d-eebf514ac0ec"><enum>(3)</enum><text>Physical violence, online bullying, and harassment of the minor.</text></paragraph><paragraph id="id9fcdbd92-cabf-46e2-bc9e-a5cdb5e3ce7c"><enum>(4)</enum><text>Sexual exploitation and abuse of minors.</text></paragraph><paragraph id="id69863ce0-7f17-4c11-9a58-476c47e6cc83"><enum>(5)</enum><text>Promotion and marketing of narcotic drugs (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)), tobacco products, gambling, or alcohol.</text></paragraph><paragraph id="id9d0ebc1e-43a9-466d-916b-6db4e5acb6da"><enum>(6)</enum><text>Predatory, unfair, or deceptive marketing practices, or other financial harms.</text></paragraph></subsection><subsection id="id80594449-fbd6-433a-9a2c-3b3f309b8923"><enum>(b)</enum><header>Limitation</header><text>Nothing in subsection (a) shall be construed to require a covered platform to prevent or preclude any minor from—</text><paragraph commented="no" display-inline="no-display-inline" id="idb646669e-51b4-462f-a919-055c375daa62"><enum>(1)</enum><text display-inline="yes-display-inline">deliberately and independently searching for, or specifically requesting, content; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d354754-8510-4954-8bd1-616c31494671"><enum>(2)</enum><text>accessing resources and information regarding the prevention or mitigation of the harms described in subsection (a).</text></paragraph></subsection></section><section id="id541c6e8b-6708-4d97-83e1-44abf7a184b2"><enum>103.</enum><header>Safeguards for minors</header><subsection id="id1710dc69-cadd-4b86-a2a1-bd46873161e2"><enum>(a)</enum><header>Safeguards for minors</header><paragraph id="ida49be590-ba8d-44e8-bd96-cff8aece9443"><enum>(1)</enum><header>Safeguards</header><text>A covered platform shall provide a user or visitor that the covered platform knows is a minor with readily-accessible and easy-to-use safeguards to, as applicable—</text><subparagraph id="id16ca1099-579a-42dc-a75c-d7a9d44685e2"><enum>(A)</enum><text>limit the ability of other users or visitors to communicate with the minor;</text></subparagraph><subparagraph id="ida97af87a-9e15-42e0-b59c-88348a9a7c17"><enum>(B)</enum><text>prevent other users or visitors, whether registered or not, from viewing the minor’s personal data collected by or shared on the covered platform, in particular restricting public access to personal data;</text></subparagraph><subparagraph id="id526503fa-6bcb-45d3-aa7a-ee52a3c1036d"><enum>(C)</enum><text>limit design features that encourage or increase the frequency, time spent, or activity of minors on the covered platform, such as infinite scrolling, auto playing, rewards for time spent on the platform, notifications, and other design features that result in compulsive usage of the covered platform by the minor;</text></subparagraph><subparagraph id="id7903d38b-b5e3-4b6f-96c2-9039976592b2"><enum>(D)</enum><text>control personalized recommendation systems, including the ability for a minor to have at least 1 of the following options—</text><clause id="id8c83f863-c0c0-4195-a34e-7dc5669fdfbd"><enum>(i)</enum><text>opt out of such personalized recommendation systems, while still allowing the display of content based on a chronological format; or </text></clause><clause id="id774fd16c-4fdb-4c89-9aec-3f6f3d9ff646"><enum>(ii)</enum><text>limit types or categories of recommendations from such systems; and</text></clause></subparagraph><subparagraph id="id14787feb-78bd-4106-b2f0-50e6a21796aa"><enum>(E)</enum><text>restrict the sharing of the geolocation of the minor and provide notice regarding the tracking of the minor’s geolocation.</text></subparagraph></paragraph><paragraph id="id65df1cb3-8308-4e1c-83f3-a320a163ac83"><enum>(2)</enum><header>Option</header><text>A covered platform shall provide a user that the covered platform knows is a minor with a readily-accessible and easy-to-use option to limit the amount of time spent by the minor on the covered platform.</text></paragraph><paragraph id="idfbaa1bb5-4ff4-4549-9c54-0546df7cc212"><enum>(3)</enum><header>Default safeguard settings for minors</header><text>A covered platform shall provide that, in the case of a user or visitor that the platform knows is a minor, the default setting for any safeguard described under paragraph (1) shall be the option available on the platform that provides the most protective level of control that is offered by the platform over privacy and safety for that user or visitor.</text></paragraph></subsection><subsection id="idd036393c-1462-40fb-93db-82a95b4995ef"><enum>(b)</enum><header>Parental tools</header><paragraph id="id3a86ad61-4cd3-4f67-b79d-21ce12b321fb"><enum>(1)</enum><header>Tools</header><text>A covered platform shall provide readily-accessible and easy-to-use settings for parents to support a user that the platform knows is a minor with respect to the user's use of the platform.</text></paragraph><paragraph id="id3b61623a-5b37-46ed-a1fb-8adc4ee96280"><enum>(2)</enum><header>Requirements</header><text>The parental tools provided by a covered platform shall include—</text><subparagraph id="id9fcd8ff3-a0c5-4264-b91f-12becf5649da"><enum>(A)</enum><text>the ability to manage a minor’s privacy and account settings, including the safeguards and options established under subsection (a), in a manner that allows parents to—</text><clause id="id88a690dc-6fdf-41fd-9219-ef846a7a4b32"><enum>(i)</enum><text>view the privacy and account settings; and</text></clause><clause id="idd38bb64a-9958-48f5-8029-36f6b46d0c30"><enum>(ii)</enum><text>in the case of a user that the platform knows is a child, change and control the privacy and account settings;</text></clause></subparagraph><subparagraph id="id44c55cd1-22dd-4ec5-a7cf-6347a797ef0e"><enum>(B)</enum><text>the ability to restrict purchases and financial transactions by the minor, where applicable; and</text></subparagraph><subparagraph id="id3eb4f620-506d-4cf3-a267-7082bd5093a6"><enum>(C)</enum><text>the ability to view metrics of total time spent on the covered platform and restrict time spent on the covered platform by the minor.</text></subparagraph></paragraph><paragraph id="idf28c04c6-76a4-4fb2-985e-74e4ce323274"><enum>(3)</enum><header>Notice to minors</header><text>A covered platform shall provide clear and conspicuous notice to a user when the tools described in this subsection are in effect and what settings or controls have been applied.</text></paragraph><paragraph id="id97ab0070-a077-43b1-a71a-64b81206726e"><enum>(4)</enum><header>Default tools</header><text>A covered platform shall provide that, in the case of a user that the platform knows is a child, the tools required under paragraph (1) shall be enabled by default.</text></paragraph><paragraph id="idf8bd8a8ac5da4dd9be56c8800e2a479b"><enum>(5)</enum><header>Application to existing accounts</header><text>If, prior to the effective date of this subsection, a covered platform provided a parent of a user that the platform knows is a child with notice and the ability to enable the parental tools described under this subsection in a manner that would otherwise comply with this subsection, and the parent opted out of enabling such tools, the covered platform is not required to enable such tools with respect to such user by default when this subsection takes effect. </text></paragraph></subsection><subsection id="idb730a82c-e5c1-4bf7-8203-69ab4005bde2"><enum>(c)</enum><header>Reporting mechanism</header><paragraph id="id75340544-e28a-404f-b1c6-6e8b85cc11ad"><enum>(1)</enum><header>Reports submitted by parents, minors, and schools</header><text>A covered platform shall provide—</text><subparagraph id="id4af78aa2-f3cc-42ad-8d30-63b9d87bec4e"><enum>(A)</enum><text>a readily-accessible and easy-to-use means to submit reports to the covered platform of harms to a minor;</text></subparagraph><subparagraph id="id2bab768c-8d93-437a-a8f5-059f12d7e33b"><enum>(B)</enum><text>an electronic point of contact specific to matters involving harms to a minor; and </text></subparagraph><subparagraph id="id0c80aaeb-2698-4b35-a208-d8cc3ff77303"><enum>(C)</enum><text>confirmation of the receipt of such a report and, within the applicable time period described in paragraph (2), a substantive response to the individual that submitted the report.</text></subparagraph></paragraph><paragraph id="id7d5f3bdf-0947-4dd6-ba42-c0b25e55432a"><enum>(2)</enum><header>Timing</header><text>A covered platform shall establish an internal process to receive and substantively respond to such reports in a reasonable and timely manner, but in no case later than—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf69e3639-b160-491d-b0a6-abd57c4bc72f"><enum>(A)</enum><text display-inline="yes-display-inline">10 days after the receipt of a report, if, for the most recent calendar year, the platform averaged more than 10,000,000 active users on a monthly basis in the United States; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9db0cf61-a9b9-4998-9739-ae5ffef9db6e"><enum>(B)</enum><text>21 days after the receipt of a report, if, for the most recent calendar year, the platform averaged less than 10,000,000 active users on a monthly basis in the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34153b6f-6328-4686-bf3d-d60dda6a2b22"><enum>(C)</enum><text>notwithstanding subparagraphs (A) and (B), if the report involves an imminent threat to the safety of a minor, as promptly as needed to address the reported threat to safety.</text></subparagraph></paragraph></subsection><subsection id="iddd366ba1-ced9-470d-9385-f172bbf74cb7"><enum>(d)</enum><header>Advertising of illegal products</header><text>A covered platform shall not facilitate the advertising of narcotic drugs (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)), tobacco products, gambling, or alcohol to an individual that the covered platform knows is a minor.</text></subsection><subsection id="id2326a747-ca1c-4204-b33f-037221aa6819"><enum>(e)</enum><header>Rules of application</header><paragraph id="idd7663872-e2b6-44b1-9576-01a4f3cd6a26"><enum>(1)</enum><header>Accessibility</header><text>With respect to safeguards and parental tools described under subsections (a) and (b), a covered platform shall provide—</text><subparagraph id="idc9e39118-bdc7-485b-bd71-14aedfe1a7fa"><enum>(A)</enum><text>information and control options in a clear and conspicuous manner that takes into consideration the differing ages, capacities, and developmental needs of the minors most likely to access the covered platform and does not encourage minors or parents to weaken or disable safeguards or parental tools;</text></subparagraph><subparagraph id="id4fc1f065-cde8-4232-86d8-158520258fa6"><enum>(B)</enum><text>readily-accessible and easy-to-use controls to enable or disable safeguards or parental tools, as appropriate; and</text></subparagraph><subparagraph id="id77f3ef4c-a87c-4f24-92da-ac2c331e09eb"><enum>(C)</enum><text>information and control options in the same language, form, and manner as the covered platform provides the product or service used by minors and their parents.</text></subparagraph></paragraph><paragraph id="id593fb4bc-515f-488e-a518-b7c9e5d6edc2"><enum>(2)</enum><header>Dark patterns prohibition</header><text>It shall be unlawful for any covered platform to design, modify, or manipulate a user interface of a covered platform with the purpose or substantial effect of subverting or impairing user autonomy, decision-making, or choice with respect to safeguards or parental tools required under this section. </text></paragraph><paragraph id="id8cf0ec3d98b34cac99528297783567fb"><enum>(3)</enum><header>Timing considerations</header><subparagraph commented="no" display-inline="no-display-inline" id="id7c819608e34448278b84b356f2744aa6"><enum>(A)</enum><header>No interruption to gameplay</header><text display-inline="yes-display-inline">Subsections (a)(1)(C) and (b)(3) shall not require an online video game to interrupt the natural sequence of game play, such as progressing through game levels or finishing a competition.</text></subparagraph><subparagraph id="id400162b8e8b24ab28eecbe5a43c817d8"><enum>(B)</enum><header>Application of changes to offline devices or accounts</header><text>If a user's device or user account does not have access to the internet at the time of a change to parental tools, a covered platform shall apply changes the next time the device or user is connected to the internet. </text></subparagraph></paragraph><paragraph id="id6854a49d-ba0b-4290-b4f7-bef9eda6d196"><enum>(4)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed to—</text><subparagraph id="idb5a347e7-13da-4566-98fb-06c6511217a2"><enum>(A)</enum><text>prevent a covered platform from taking reasonable measures to—</text><clause id="idbff1bc1e-d546-4e2d-bd65-007c5a8851f7"><enum>(i)</enum><text>block, detect, or prevent the distribution of unlawful, obscene, or other harmful material to minors as described in section 102(a); or</text></clause><clause id="ide3d8b1b9-52b7-4646-acf8-83cd5756a633"><enum>(ii)</enum><text>block or filter spam, prevent criminal activity, or protect the security of a platform or service;</text></clause></subparagraph><subparagraph id="id01b2bd16-dfc7-401c-aacf-c742e0b2a5d0"><enum>(B)</enum><text>require the disclosure of a minor's browsing behavior, search history, messages, contact list, or other content or metadata of their communications; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07A17D90672B436D91996DF17303069A"><enum>(C)</enum><text>prevent a covered platform from using a personalized recommendation system to display content to a minor if the system only uses information on—</text><clause commented="no" display-inline="no-display-inline" id="id26979f67164d47c791ee9e7ecfa3323a"><enum>(i)</enum><text display-inline="yes-display-inline">the language spoken by the minor;</text></clause><clause commented="no" display-inline="no-display-inline" id="id12ab274f58f043408142ebf26eeade10"><enum>(ii)</enum><text display-inline="yes-display-inline">the city the minor is located in; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id63bce1e17c3e4de3a01076be61a92552"><enum>(iii)</enum><text>the minor's age; or </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22fe9d59fa0c4f428b46f1fb165612c2"><enum>(D)</enum><text>prevent an online video game from disclosing a username or other user identification for the purpose of competitive gameplay or to allow for the reporting of users.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7c3cf7d32a3f47e58db97e969cfdaa82"><enum>(f)</enum><header>Device or console controls</header><paragraph commented="no" display-inline="no-display-inline" id="ida6e0111ac0e34e06851eff28ddc7373f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit a covered platform from integrating its products or service with, or duplicate controls or tools provided by, third-party systems, including operating systems or gaming consoles, to meet the requirements imposed under subsections (a) and (b) relating to safeguards for minors and parental tools, provided that—</text><subparagraph id="id572a99542c4a464f9af42011b3f1fb3a"><enum>(A)</enum><text>the controls or tools meet such requirements; and</text></subparagraph><subparagraph id="id4a0ea868816a405893052bac31c4e1b7"><enum>(B)</enum><text>the minor or parent is provided sufficient notice of the integration and use of the parental tools.</text></subparagraph></paragraph><paragraph id="id30a749de18924f39ab3f17c4929bc285"><enum>(2)</enum><header>Preservation of protections</header><text>In the event of a conflict between the controls or tools of a third-party system, including operating systems or gaming consoles, and a covered platform, the covered platform is not required to override the controls or tools of a third-party system if it would undermine the protections for minors from the safeguards or parental tools imposed under subsections (a) and (b). </text></paragraph></subsection></section><section id="id2169ca45-359e-4a3f-9f4a-68c6d569057e"><enum>104.</enum><header>Disclosure</header><subsection id="id6e59bd13-238d-4497-a0e2-7ad4d9ae61b1"><enum>(a)</enum><header>Notice</header><paragraph id="idd0b50abb-9382-41df-9f55-0d3f9a045646"><enum>(1)</enum><header>Registration or purchase</header><text>Prior to registration or purchase of a covered platform by an individual that the platform knows is a minor, the platform shall provide clear, conspicuous, and easy-to-understand—</text><subparagraph id="id4fd3e63e-cffc-40ce-9d6b-d55af32f55e5"><enum>(A)</enum><text>notice of the policies and practices of the covered platform with respect to safeguards for minors required under section 103;</text></subparagraph><subparagraph id="idbaab87b1-c769-4e31-a3fd-568822cad88f"><enum>(B)</enum><text>information about how to access the safeguards and parental tools required under section 103; and</text></subparagraph><subparagraph id="idb50eeb2a-7f14-4289-9750-bd3c93272cb9"><enum>(C)</enum><text>notice about whether the covered platform uses or makes available to minors a product, service, or design feature, including any personalized recommendation system, that poses any heightened risk of harm to minors.</text></subparagraph></paragraph><paragraph id="idea5d06e3-2c9f-4eca-9854-48ed3bdf5109"><enum>(2)</enum><header>Notification</header><subparagraph id="id9e408cd7-2ac0-495d-8157-fe3f57408e03"><enum>(A)</enum><header>Notice and acknowledgment</header><text>In the case of an individual that a covered platform knows is a child, the platform shall additionally provide information about the parental tools and safeguards required under section 103 to a parent of the child and obtain verifiable consent (as defined in section 1302(9) of the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501(9)</external-xref>)) from the parent prior to the initial use of the covered platform by the child.</text></subparagraph><subparagraph id="idb42e83ae-24a2-4883-8af1-c380be2a0a4c"><enum>(B)</enum><header>Reasonable effort</header><text>A covered platform shall be deemed to have satisfied the requirement described in subparagraph (A) if the covered platform is in compliance with the requirements of the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) to use reasonable efforts (taking into consideration available technology) to provide a parent with the information described in subparagraph (A) and to obtain verifiable consent as required.</text></subparagraph></paragraph><paragraph id="id11a213c2-5fe8-49c1-9cca-f1c2ec15e966"><enum>(3)</enum><header>Consolidated notices</header><text>For purposes of this subtitle, a covered platform may consolidate the process for providing information under this subsection and obtaining verifiable consent or the consent of the minor involved (as applicable) as required under this subsection with its obligations to provide relevant notice and obtain verifiable consent under the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>). </text></paragraph><paragraph id="id3d434d79-27c9-4fab-ac4b-98ac14a0281c" commented="no"><enum>(4)</enum><header>Guidance</header><text>The Federal Trade Commission may issue guidance to assist covered platforms in complying with the specific notice requirements of this subsection.</text></paragraph></subsection><subsection id="id35e95914-37df-4727-96e8-19e2af0ac425"><enum>(b)</enum><header>Personalized recommendation system</header><text>A covered platform that operates a personalized recommendation system shall set out in its terms and conditions, in a clear, conspicuous, and easy-to-understand manner—</text><paragraph id="idb39c38cd-189a-4777-bb8c-6a198fbc3a6a"><enum>(1)</enum><text>an overview of how such personalized recommendation system is used by the covered platform to provide information to minors, including how such systems use the personal data of minors; and</text></paragraph><paragraph id="id6178b4ea-d86a-4c05-8066-0f2250fc8a0d"><enum>(2)</enum><text>information about options for minors or their parents to opt out of or control the personalized recommendation system (as applicable).</text></paragraph></subsection><subsection id="id3251119e-df47-4abe-98aa-3b3792c68bf2"><enum>(c)</enum><header>Advertising and marketing information and labels</header><paragraph id="idb77cbbc9-db79-4d85-9c0a-e5a13095c99d"><enum>(1)</enum><header>Information and labels</header><text>A covered platform shall provide clear, conspicuous, and easy-to-understand labels and information, which can be provided through a link to another web page or disclosure, to minors on advertisements regarding—</text><subparagraph id="id44ee9939-ec75-4552-902e-4dcb44eeda0e"><enum>(A)</enum><text>the name of the product, service, or brand and the subject matter of an advertisement; and</text></subparagraph><subparagraph id="id3322c921-6013-43d7-b407-433948e9ded8"><enum>(B)</enum><text>whether particular media displayed to the minor is an advertisement or marketing material, including disclosure of endorsements of products, services, or brands made for commercial consideration by other users of the platform.</text></subparagraph></paragraph><paragraph id="idff6f3fc3-16a9-4578-8003-0b63d804c1ac" commented="no"><enum>(2)</enum><header>Guidance</header><text>The Federal Trade Commission may issue guidance to assist covered platforms in complying with the requirements of this subsection, including guidance about the minimum level of information and labels for the disclosures required under paragraph (1). </text></paragraph></subsection><subsection id="id7edbd696-5c91-4598-b92b-c89ee707a663"><enum>(d)</enum><header>Resources for parents and minors</header><text>A covered platform shall provide to minors and parents clear, conspicuous, easy-to-understand, and comprehensive information in a prominent location, which may include a link to a web page, regarding—</text><paragraph id="id2a1fe57b-2df3-49eb-a0d4-eb39e0fa3ca7"><enum>(1)</enum><text>its policies and practices with respect to safeguards for minors required under section 103; and</text></paragraph><paragraph id="id35094137-0291-407b-bafa-b3eafc851370"><enum>(2)</enum><text>how to access the safeguards and tools required under section 103.</text></paragraph></subsection><subsection id="id1bc4ae70-a3ec-4cc4-9e40-ca5d2f335f9c"><enum>(e)</enum><header>Resources in additional languages</header><text>A covered platform shall ensure, to the extent practicable, that the disclosures required by this section are made available in the same language, form, and manner as the covered platform provides any product or service used by minors and their parents. </text></subsection></section><section id="ide478f6d6-1431-4439-8447-653f62d153d8"><enum>105.</enum><header>Transparency</header><subsection id="id12b80a18-1670-49a4-a832-a93fb5873ac4"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), not less frequently than once a year, a covered platform shall issue a public report describing the reasonably foreseeable risks of harms to minors and assessing the prevention and mitigation measures taken to address such risk based on an independent, third-party audit conducted through reasonable inspection of the covered platform.</text></subsection><subsection id="id35c7de9b-ee22-4b85-b9a5-38052a309b2e"><enum>(b)</enum><header>Scope of application</header><text>The requirements of this section shall apply to a covered platform if— </text><paragraph commented="no" display-inline="no-display-inline" id="id196bf520-721b-42bd-9abd-58ed40402191"><enum>(1)</enum><text display-inline="yes-display-inline">for the most recent calendar year, the platform averaged more than 10,000,000 active users on a monthly basis in the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id377e40a0-8ba9-4ac1-b6d8-a8fecbe616b0"><enum>(2)</enum><text>the platform predominantly provides a community forum for user-generated content and discussion, including sharing videos, images, games, audio files, discussion in a virtual setting, or other content, such as acting as a social media platform, virtual reality environment, or a social network service.</text></paragraph></subsection><subsection id="id6268fa59-3bb2-4197-86b2-b073cd13fb71"><enum>(c)</enum><header>Content</header><paragraph id="ide3b6e083-612e-4757-b1ba-0981912c1213" commented="no"><enum>(1)</enum><header>Transparency</header><text>The public reports required of a covered platform under this section shall include—</text><subparagraph id="id024b96e0-f423-44bd-a46a-c9f2727c4e69"><enum>(A)</enum><text>an assessment of the extent to which the platform is likely to be accessed by minors;</text></subparagraph><subparagraph id="id3dc40a3a-ef07-4717-9f49-1ba9699d0211"><enum>(B)</enum><text>a description of the commercial interests of the covered platform in use by minors;</text></subparagraph><subparagraph id="idd6cec8d1-7349-47ea-a9a2-f8ba5ca5259c"><enum>(C)</enum><text>an accounting, based on the data held by the covered platform, of— </text><clause commented="no" display-inline="no-display-inline" id="ida341cc76-1441-4966-aaec-b6df9552ce60"><enum>(i)</enum><text display-inline="yes-display-inline">the number of users using the covered platform that the platform knows to be minors in the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="id232eecee-afc8-4e17-9669-7b2b04260fc5"><enum>(ii)</enum><text>the median and mean amounts of time spent on the platform by users known to be minors in the United States who have accessed the platform during the reporting year on a daily, weekly, and monthly basis; and</text></clause><clause id="idA5C2E9981CDC40D7BFF78555FFCF95BF"><enum>(iii)</enum><text>the amount of content being accessed by users that the platform knows to be minors in the United States that is in English, and the top 5 non-English languages used by users accessing the platform in the United States; </text></clause></subparagraph><subparagraph id="idc3619341-336c-4635-930c-f09ccdd9c3d8"><enum>(D)</enum><text>an accounting of total reports received regarding, and the prevalence (which can be based on scientifically valid sampling methods using the content available to the covered platform in the normal course of business) of content related to, the harms described in section 102(a), disaggregated by category of harm and language, including English and the top 5 non-English languages used by users accessing the platform from the United States (as identified under subparagraph (C)(iii)); and</text></subparagraph><subparagraph id="id02ab809f-7ed3-45df-8447-7dbde6390d3f"><enum>(E)</enum><text>a description of any material breaches of parental tools or assurances regarding minors, representations regarding the use of the personal data of minors, and other matters regarding non-compliance with this subtitle.</text></subparagraph></paragraph><paragraph id="id544ba887-2520-45b3-95ab-c752fabada7e" commented="no"><enum>(2)</enum><header>Reasonably foreseeable risk of harm to minors</header><text>The public reports required of a covered platform under this section shall include—</text><subparagraph id="ide005201b-1daa-4a2a-b492-19df5ccaef99"><enum>(A)</enum><text>an assessment of the reasonably foreseeable risk of harms to minors posed by the covered platform, specifically identifying those physical, mental, developmental, or financial harms described in section 102(a);</text></subparagraph><subparagraph id="id0db3d350-afeb-4cbd-87bc-2d88f7154696"><enum>(B)</enum><text>a description of whether and how the covered platform uses design features that encourage or increase the frequency, time spent, or activity of minors on the covered platform, such as infinite scrolling, auto playing, rewards for time spent on the platform, notifications, and other design features that result in compulsive usage of the covered platform by the minor; </text></subparagraph><subparagraph id="id11334241-b56d-4f39-8359-1a88ec472782"><enum>(C)</enum><text>a description of whether, how, and for what purpose the platform collects or processes categories of personal data that may cause reasonably foreseeable risk of harms to minors;</text></subparagraph><subparagraph id="idb6f018f6-dec2-4928-8aec-fc8dad963ef9"><enum>(D)</enum><text>an evaluation of the efficacy of safeguards for minors and parental tools under section 103, and any issues in delivering such safeguards and the associated parental tools;</text></subparagraph><subparagraph id="id8a646e6d-0a10-4d8c-942c-64e56aaf2c11"><enum>(E)</enum><text>an evaluation of any other relevant matters of public concern over risk of harms to minors associated with the use of the covered platform; and</text></subparagraph><subparagraph id="idc5ab07e708de41c68b284250116e2012"><enum>(F)</enum><text>an assessment of differences in risk of harm to minors across different English and non-English languages and efficacy of safeguards in those languages. </text></subparagraph></paragraph><paragraph id="id9ab33d8b-cc8b-4509-96e3-453319215c49" commented="no"><enum>(3)</enum><header>Mitigation</header><text>The public reports required of a covered platform under this section shall include, for English and the top 5 non-English languages used by users accessing the platform from the United States (as identified under paragraph (2)(C)(iii)))—</text><subparagraph id="idffdf18e8-e9bf-4bd5-b6fe-e48886f95e07"><enum>(A)</enum><text>a description of the safeguards and parental tools available to minors and parents on the covered platform;</text></subparagraph><subparagraph id="id3f66b662-37c7-41ae-b0b2-441e65d4addb"><enum>(B)</enum><text>a description of interventions by the covered platform when it had or has reason to believe that harms to minors could occur;</text></subparagraph><subparagraph id="id9e7c5405-6b86-4c49-b1a5-b5387832b90b"><enum>(C)</enum><text>a description of the prevention and mitigation measures intended to be taken in response to the known and emerging risks identified in its assessment of reasonably foreseeable risks of harms to minors, including steps taken to—</text><clause id="id239ecd2e-54ec-4a38-949c-b43743f06bfb"><enum>(i)</enum><text>prevent harms to minors, including adapting or removing design features or addressing through parental tools;</text></clause><clause id="id8a5909a3-b516-45cf-89f0-2eef07ee544e"><enum>(ii)</enum><text>provide the most protective level of control over privacy and safety by default; and</text></clause><clause id="idc4151a79-93b1-4bc9-a44e-e8359cebbb98"><enum>(iii)</enum><text>adapt recommendation systems to mitigate reasonably foreseeable risk of harms to minors, as described in section 102(a); </text></clause></subparagraph><subparagraph id="idaef0f3b8-598d-4bef-8b6b-e48e72c52a40"><enum>(D)</enum><text>a description of internal processes for handling reports and automated detection mechanisms for harms to minors, including the rate, timeliness, and effectiveness of responses under the requirement of section 103(c);</text></subparagraph><subparagraph id="id5dfcc648-2cf4-4cf7-a2e0-a5bb3cf6e933"><enum>(E)</enum><text>the status of implementing prevention and mitigation measures identified in prior assessments; and</text></subparagraph><subparagraph id="idff4ffbbf-7b8d-432c-9c13-d22d2de5f168"><enum>(F)</enum><text>a description of the additional measures to be taken by the covered platform to address the circumvention of safeguards for minors and parental tools. </text></subparagraph></paragraph></subsection><subsection id="id32bc0179-100b-45f5-bf1c-86c6f4a3be51"><enum>(d)</enum><header>Reasonable inspection</header><text>In conducting an inspection of the reasonably foreseeable risk of harm to minors under this section, an independent, third-party auditor shall—</text><paragraph id="iddb79e2f1-e308-4aa2-9fd9-0ac2e3a74422"><enum>(1)</enum><text>take into consideration the function of personalized recommendation systems;</text></paragraph><paragraph id="id405fe900-763c-4ee3-a2bc-b8b4d8f121b4"><enum>(2)</enum><text>consult parents and youth experts, including youth and families with relevant past or current experience, public health and mental health nonprofit organizations, health and development organizations, and civil society with respect to the prevention of harms to minors;</text></paragraph><paragraph id="idc695bc45-b95d-486b-b878-f75b78344a29"><enum>(3)</enum><text>conduct research based on experiences of minors that use the covered platform, including reports under section 103(c) and information provided by law enforcement;</text></paragraph><paragraph id="ida3bbb797-a7ea-46b0-8fa1-4f14062526d8"><enum>(4)</enum><text>take account of research, including research regarding design features, marketing, or product integrity, industry best practices, or outside research;</text></paragraph><paragraph id="id6225d078-aa85-4421-8b13-e441783c76b1"><enum>(5)</enum><text>consider indicia or inferences of age of users, in addition to any self-declared information about the age of users; and</text></paragraph><paragraph id="id93AD2F160E2E4600A575A59FF12E898C"><enum>(6)</enum><text>take into consideration differences in risk of reasonably foreseeable harms and effectiveness of safeguards across English and non-English languages. </text></paragraph></subsection><subsection id="id2aaff02d-547e-465a-be6e-3606bf5b306a"><enum>(e)</enum><header>Cooperation with independent, third-party audit</header><text>To facilitate the report required by subsection (c), a covered platform shall—</text><paragraph id="idd52b0dd0-43e4-4e97-874e-83963e9bdf86"><enum>(1)</enum><text>provide or otherwise make available to the independent third-party conducting the audit all information and material in its possession, custody, or control that is relevant to the audit;</text></paragraph><paragraph id="id23fa62b1-c886-4c13-a591-60019284b92e"><enum>(2)</enum><text>provide or otherwise make available to the independent third-party conducting the audit access to all network, systems, and assets relevant to the audit; and</text></paragraph><paragraph id="id53b93b99-390c-402d-96d0-02f75ad4cc42"><enum>(3)</enum><text>disclose all relevant facts to the independent third-party conducting the audit, and not misrepresent in any manner, expressly or by implication, any relevant fact.</text></paragraph></subsection><subsection id="ida00c2386-c4ed-4885-acf9-228b0f940d85"><enum>(f)</enum><header>Privacy safeguards</header><paragraph id="id27268811-e58e-449d-8783-021ef9da6921"><enum>(1)</enum><header>In general</header><text>In issuing the public reports required under this section, a covered platform shall take steps to safeguard the privacy of its users, including ensuring that data is presented in a de-identified, aggregated format such that it is not reasonably linkable to any user.</text></paragraph><paragraph id="idb46a15d2-eb2f-402d-9a78-721fb8778a55"><enum>(2)</enum><header>Rule of construction</header><text>This section shall not be construed to require the disclosure of information that will lead to material vulnerabilities for the privacy of users or the security of a covered platform's service or create a significant risk of the violation of Federal or State law.</text></paragraph><paragraph id="id05073e8288024fb6ab360ebc6eede603"><enum>(3)</enum><header>Definition of de-identified</header><text>As used in this subsection, the term <term>de-identified</term> means data that does not identify and is not linked or reasonably linkable to a device that is linked or reasonably linkable to an individual, regardless of whether the information is aggregated </text></paragraph></subsection><subsection id="id8fe4ee33-8850-4b2d-819a-7ea7c4af5f0a"><enum>(g)</enum><header>Location</header><text>The public reports required under this section should be posted by a covered platform on an easy to find location on a publicly-available website.</text></subsection></section><section id="ide3d6a9ca-ea92-4b03-9ebb-8f44c8ef6776"><enum>106.</enum><header>Research on social media and minors</header><subsection id="id768697a5-38b4-4302-9ad8-d33912883e86"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6a8eb54b-06c3-4d51-ad03-2059e8fd2690"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67a2bf7f3e6748f697751a6227d7cedd"><enum>(2)</enum><header>National Academy</header><text>The term <term>National Academy</term> means the National Academy of Sciences.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02baabf5bc684ecbbf4f01195fc39a87"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id856540475ea648148031fa3374b7f9f6"><enum>(b)</enum><header>Research on social media harms</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Commission shall seek to enter into a contract with the National Academy, under which the National Academy shall conduct no less than 5 scientific, comprehensive studies and reports on the risk of harms to minors by use of social media and other online platforms, including in English and non-English languages.</text></subsection><subsection id="idc1ce10240a8c42bf8b4243211fd98890"><enum>(c)</enum><header>Matters to be addressed</header><text>In contracting with the National Academy, the Commission, in consultation with the Secretary, shall seek to commission separate studies and reports, using the Commission's authority under section 6(b) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(b)</external-xref>), on the relationship between social media and other online platforms as defined in this subtitle on the following matters:</text><paragraph id="idd407f698e346403c84868cd382476f37"><enum>(1)</enum><text>Anxiety, depression, eating disorders, and suicidal behaviors.</text></paragraph><paragraph id="ide09351ffe3524d0a8e753b837cb3ff63"><enum>(2)</enum><text>Substance use disorders and the use of narcotic drugs, tobacco products, gambling, or alcohol by minors.</text></paragraph><paragraph id="id3e1ee9c968e54af9a509a4c88aa0f372"><enum>(3)</enum><text>Sexual exploitation and abuse.</text></paragraph><paragraph id="iddbb3b6724a2c4df6a2385e575326a9d8"><enum>(4)</enum><text>Addiction-like use of social media and design factors that lead to unhealthy and harmful overuse of social media.</text></paragraph></subsection><subsection id="id121fb701c0fd4e7da373c18c77c61b01"><enum>(d)</enum><header>Additional study</header><text>Not earlier than 4 years after enactment, the Commission shall seek to enter into a contract with the National Academy under which the National Academy shall conduct an additional study and report covering the matters described in subsection (c) for the purposes of providing additional information, considering new research, and other matters. </text></subsection><subsection id="idb4402bb9e09541d9b11441fc4f67e2c4"><enum>(e)</enum><header>Content of reports</header><text> The comprehensive studies and reports conducted pursuant to this section shall seek to evaluate impacts and advance understanding, knowledge, and remedies regarding the harms to minors posed by social media and other online platforms, and may include recommendations related to public policy.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd787a6b976b4cd5a7c9b44c778ed8b9"><enum>(f)</enum><header>Active studies</header><text>If the National Academy is engaged in any active studies on the matters described in subsection (c) at the time that it enters into a contract with the Commission to conduct a study under this section, it may base the study to be conducted under this section on the active study, so long as it otherwise incorporates the requirements of this section.</text></subsection><subsection id="id0bfeb8b6fa88463cb4bdb12b31c76120"><enum>(g)</enum><header>Collaboration</header><text>In designing and conducting the studies under this section, the Commission, the Secretary, and the National Academy shall consult with the Surgeon General and the Kids Online Safety Council.</text></subsection><subsection id="idf1f04ff3c8d942598cfc27b996bc3058"><enum>(h)</enum><header>Access to Data</header><paragraph id="id9e3cb383d3344eaabc4de3112f8eb0fe"><enum>(1)</enum><header>Fact-finding authority</header><text>The Commission may issue orders under section 6(b) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(b)</external-xref>) to require covered platforms to provide reports, data, or answers in writing as necessary to conduct the studies required under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb576ce6f71394343ad247aec41546818"><enum>(2)</enum><header>Scope</header><text>In exercising its authority under paragraph (1), the Commission may issue orders to no more than 5 covered platforms per study under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4205ecc92da43b9a85a2448b5150b5f"><enum>(3)</enum><header>Confidential access</header><text>Notwithstanding section 6(f) or 21 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46</external-xref>, 57b–2), the Commission shall enter in agreements with the National Academy to share appropriate information received from a covered platform pursuant to an order under such subsection (b) for a comprehensive study under this section in a confidential and secure manner, and to prohibit the disclosure or sharing of such information by the National Academy. Nothing in this paragraph shall be construed to preclude the disclosure of any such information if authorized or required by any other law. </text></paragraph></subsection></section><section id="idcb7bc204-1e86-40f3-9c7d-8535a6730840"><enum>107.</enum><header>Market research</header><subsection id="id55d95d86-48cb-452c-a39a-dcbd78e8ead6"><enum>(a)</enum><header>Market research by covered platforms</header><text>The Federal Trade Commission, in consultation with the Secretary of Commerce, shall issue guidance for covered platforms seeking to conduct market- and product-focused research on minors. Such guidance shall include—</text><paragraph id="idc1c535fa-18b0-4062-8733-2631b76621a7"><enum>(1)</enum><text>a standard consent form that provides minors and their parents a clear, conspicuous, and easy-to-understand explanation of the scope and purpose of the research to be conducted that is available in English and the top 5 non-English languages used in the United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84058a5a4bd6458284f407c00fc07390"><enum>(2)</enum><text display-inline="yes-display-inline">information on how to obtain informed consent from the parent of a minor prior to conducting such market- and product-focused research; and</text></paragraph><paragraph id="ida5654090-b10c-42a5-961a-b96cc6057e96"><enum>(3)</enum><text>recommendations for research practices for studies that may include minors, disaggregated by the age ranges of 0-5, 6-9, 10-12, and 13-16.</text></paragraph></subsection><subsection id="id249f883d-ff66-4b74-9847-db52c6778757"><enum>(b)</enum><header>Timing</header><text>The Federal Trade Commission shall issue such guidance not later than 18 months after the date of enactment of this Act. In doing so, they shall seek input from members of the public and the representatives of the Kids Online Safety Council established under section 111.</text></subsection></section><section id="id43fe8c4d-e881-41b0-819c-a88c54ed5043"><enum>108.</enum><header>Age verification study and report</header><subsection id="idcf4f5fdf-6bd7-46c1-ab08-b3a4993ef449"><enum>(a)</enum><header>Study</header><text>The Secretary of Commerce, in coordination with the Federal Communications Commission and the Federal Trade Commission, shall conduct a study evaluating the most technologically feasible methods and options for developing systems to verify age at the device or operating system level.</text></subsection><subsection id="idb0fd400a-05ae-455c-9e18-84c7e92df45e"><enum>(b)</enum><header>Contents</header><text>Such study shall consider —</text><paragraph id="idab6035ad-4e0c-4360-8acd-c3a3f97ebbee"><enum>(1)</enum><text>the benefits of creating a device or operating system level age verification system;</text></paragraph><paragraph id="id1c0aacbc-dbdb-4ae4-acee-a0e1bed5b10d"><enum>(2)</enum><text>what information may need to be collected to create this type of age verification system;</text></paragraph><paragraph id="ided3cf78f-5e9d-4202-8cbc-10e217bb742a"><enum>(3)</enum><text>the accuracy of such systems and their impact or steps to improve accessibility, including for individuals with disabilities;</text></paragraph><paragraph id="id7f4823b1-c866-40a4-8f70-4a91a790e9f6"><enum>(4)</enum><text>how such a system or systems could verify age while mitigating risks to user privacy and data security and safeguarding minors' personal data, emphasizing minimizing the amount of data collected and processed by covered platforms and age verification providers for such a system;</text></paragraph><paragraph id="id6024f8cb-b5c0-4b08-a9a1-a8a07fcbb40e"><enum>(5)</enum><text>the technical feasibility, including the need for potential hardware and software changes, including for devices currently in commerce and owned by consumers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30b06bf2b5214ae2b4146d9e5ea6ae25"><enum>(6)</enum><text>the impact of different age verification systems on competition, particularly the risk of different age verification systems creating barriers to entry for small companies.</text></paragraph></subsection><subsection id="id5b56ccb4-5e4a-47e9-9138-a2dd83862c4b"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the agencies described in subsection (a) shall submit a report containing the results of the study conducted under such subsection to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives.</text></subsection></section><section id="id40b445c0-5088-434b-96f5-e7cb441ed138"><enum>109.</enum><header>Guidance</header><subsection commented="no" display-inline="no-display-inline" id="idd8e0e2f5-0788-46e7-8a50-e98e5ef2c19b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Federal Trade Commission, in consultation with the Kids Online Safety Council established under section 111, shall issue guidance to—</text><paragraph id="id54bd26a0-4594-48da-b622-bb59f3b859a5"><enum>(1)</enum><text>provide information and examples for covered platforms and auditors regarding the following, with consideration given to differences across English and non-English languages—</text><subparagraph id="idc04af779-5834-4260-8713-3ba64f1e864f"><enum>(A)</enum><text>identifying design features that encourage or increase the frequency, time spent, or activity of minors on the covered platform; </text></subparagraph><subparagraph id="idebde5db4-786d-4ee1-a00d-35500f386b3a"><enum>(B)</enum><text>safeguarding minors against the possible misuse of parental tools;</text></subparagraph><subparagraph id="iddc6fb2c9-404f-4aa2-a4d7-c562674cb18f"><enum>(C)</enum><text>best practices in providing minors and parents the most protective level of control over privacy and safety;</text></subparagraph><subparagraph id="id10e438d4-d9c9-494d-a4b3-e5ee41676bb2"><enum>(D)</enum><text>using indicia or inferences of age of users for assessing use of the covered platform by minors;</text></subparagraph><subparagraph id="idecf0d308-5eeb-4790-a8e5-c2460790d8e4"><enum>(E)</enum><text>methods for evaluating the efficacy of safeguards set forth in this subtitle; and</text></subparagraph><subparagraph id="id793db100-2f4a-4a1b-9c2c-e0823a5d1522"><enum>(F)</enum><text>providing additional parental tool options that allow parents to address the harms described in section 102(a); and</text></subparagraph></paragraph><paragraph id="ida5042a93-41fa-493a-9428-94fcfe27bc0b"><enum>(2)</enum><text>outline conduct that does not have the purpose or substantial effect of subverting or impairing user autonomy, decision-making, or choice, or of causing, increasing, or encouraging compulsive usage for a minor, such as—</text><subparagraph id="id47544f38-d1c0-4a75-a724-6571067c7ff4"><enum>(A)</enum><text>de minimis user interface changes derived from testing consumer preferences, including different styles, layouts, or text, where such changes are not done with the purpose of weakening or disabling safeguards or parental tools;</text></subparagraph><subparagraph id="id7f07861a-138b-4e99-a186-cfea12e80c2d"><enum>(B)</enum><text>algorithms or data outputs outside the control of a covered platform; and</text></subparagraph><subparagraph id="id48bff3e1-b992-4a23-bffa-2f45f55da940"><enum>(C)</enum><text>establishing default settings that provide enhanced privacy protection to users or otherwise enhance their autonomy and decision-making ability. </text></subparagraph></paragraph></subsection><subsection id="id7fd1552c47704efcb80a72323c7818d3"><enum>(b)</enum><header>Guidance on knowledge standard</header><text>Not later than 18 months after the date of enactment of this Act, the Federal Trade Commission shall issue guidance to provide information, including best practices and examples, for covered platforms to understand how the Commission would determine whether a covered platform <quote>had knowledge fairly implied on the basis of objective circumstances</quote> for purposes of this subtitle.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaedf79b4-f1d6-4ca4-95ef-c79df58ddc13"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation on Federal Trade Commission guidance</header><paragraph commented="no" display-inline="no-display-inline" id="idf40b0c10-46b3-4344-ab7f-b8b417d0b20e"><enum>(1)</enum><header>Effect of guidance</header><text display-inline="yes-display-inline">No guidance issued by the Federal Trade Commission with respect to this subtitle shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="id63e3d54a-3c63-43a1-9e2c-bf2c8da696d1"><enum>(A)</enum><text display-inline="yes-display-inline">confer any rights on any person, State, or locality; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09920f39-a756-4a58-91ab-39ae318fbb8b"><enum>(B)</enum><text display-inline="yes-display-inline">operate to bind the Federal Trade Commission or any court, person, State, or locality to the approach recommended in such guidance. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a3b95dd-dcec-457e-881c-c5bc55deb608"><enum>(2)</enum><header>Use in enforcement actions</header><text display-inline="yes-display-inline">In any enforcement action brought pursuant to this subtitle, the Federal Trade Commission or a State attorney general, as applicable— </text><subparagraph commented="no" display-inline="no-display-inline" id="id41b3d148-1e1f-4f67-9954-ddc8e77a63c3"><enum>(A)</enum><text display-inline="yes-display-inline">shall allege a violation of a provision of this subtitle; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52fbd316-c983-4a5c-ad9f-0a3f63c0914a"><enum>(B)</enum><text display-inline="yes-display-inline">may not base such enforcement action on, or execute a consent order based on, practices that are alleged to be inconsistent with guidance issued by the Federal Trade Commission with respect to this subtitle, unless the practices are alleged to violate a provision of this subtitle.</text></subparagraph><continuation-text continuation-text-level="paragraph">For purposes of enforcing this subtitle, State attorneys general shall take into account any guidance issued by the Commission under subsection (b).</continuation-text></paragraph></subsection></section><section id="iddab2bfcc-2bf2-4548-87dd-edd2cff4c0ec"><enum>110.</enum><header>Enforcement</header><subsection id="id68a54e15-20f6-4cf7-8d14-53abb8a050d5"><enum>(a)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="ideb1152e8-ae1f-4212-b4a4-c064ad6d91e4"><enum>(1)</enum><header>Unfair and deceptive acts or practices</header><text>A violation of this subtitle shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="idc691f5fe-ef5c-4072-a2e5-abad657f8cf9"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="id17231a5c-b407-4786-ae7a-eaa97d437bb2"><enum>(A)</enum><header>In general</header><text>The Federal Trade Commission (referred to in this section as the <term>Commission</term>) shall enforce this subtitle in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this subtitle.</text></subparagraph><subparagraph id="id57876c54-1e7d-4376-b46e-397d6ab9fdbd"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person that violates this subtitle shall be subject to the penalties, and entitled to the privileges and immunities, provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="ida846b8a2-a919-4b97-8b37-12fe3c4be155"><enum>(3)</enum><header>Authority preserved</header><text>Nothing in this subtitle shall be construed to limit the authority of the Commission under any other provision of law.</text></paragraph></subsection><subsection id="id4343924b-f1cd-485d-8a3c-028f319c790c"><enum>(b)</enum><header>Enforcement by State attorneys general</header><paragraph id="idfbfefcf8-3a52-4302-ad7f-c8ed667fd2e9"><enum>(1)</enum><header>In general</header><subparagraph id="ide4a2a6e6-c69e-4bb5-9e9c-9b406ac9bb35"><enum>(A)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that a covered platform has violated or is violating section 103, 104, or 105, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States or a State court of appropriate jurisdiction to—</text><clause id="id1d5d996a-bcdc-4b34-998b-b622373a6831"><enum>(i)</enum><text>enjoin any practice that violates section 103, 104, or 105;</text></clause><clause id="id93a3a01a-6f0f-41e2-9bfa-b40b18611577"><enum>(ii)</enum><text>enforce compliance with section 103, 104, or 105;</text></clause><clause id="id16f4d3bf-d87e-4e2f-bc98-8be00aa5daa2"><enum>(iii)</enum><text>on behalf of residents of the State, obtain damages, restitution, or other compensation, each of which shall be distributed in accordance with State law; or</text></clause><clause id="iddd1d6fa6-89a8-4c49-bf1f-3c60065f4e14"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></clause></subparagraph><subparagraph id="id8d3b2039-724b-4048-b369-56c315c34354"><enum>(B)</enum><header>Notice</header><clause id="id8fd6acbc-9c73-4444-a7b5-bb82ee7f9e6f"><enum>(i)</enum><header>In general</header><text>Before filing an action under subparagraph (A), the attorney general of the State involved shall provide to the Commission—</text><subclause id="idd2c40efb-7778-4101-b0a4-2325decf9227"><enum>(I)</enum><text>written notice of that action; and</text></subclause><subclause id="ida7aa8713-7ec3-4320-93b9-4d53940e6e22"><enum>(II)</enum><text>a copy of the complaint for that action.</text></subclause></clause><clause id="id2d3f9b61-34bc-4df0-995a-95b1becb5d8e"><enum>(ii)</enum><header>Exemption</header><subclause id="id530fce9b-7725-442d-b340-9c90ce5a569e"><enum>(I)</enum><header>In general</header><text>Clause (i) shall not apply with respect to the filing of an action by an attorney general of a State under this paragraph if the attorney general of the State determines that it is not feasible to provide the notice described in that clause before the filing of the action.</text></subclause><subclause id="ida320fb3f-8708-4d24-bd86-f148431b1019"><enum>(II)</enum><header>Notification</header><text>In an action described in subclause (I), the attorney general of a State shall provide notice and a copy of the complaint to the Commission at the same time as the attorney general files the action.</text></subclause></clause></subparagraph></paragraph><paragraph id="idf3d865dd-94a2-45d0-b0f4-d5fb27379f81"><enum>(2)</enum><header>Intervention</header><subparagraph id="idaef609b3-1ba1-49b3-af81-91527d23bf86"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (1)(B), the Commission shall have the right to intervene in the action that is the subject of the notice.</text></subparagraph><subparagraph id="idf87bc664-fc0a-4156-863c-47da03f2996e"><enum>(B)</enum><header>Effect of intervention</header><text>If the Commission intervenes in an action under paragraph (1), it shall have the right—</text><clause id="idbf8eff91-de4c-4667-8e1c-0243ba990e24"><enum>(i)</enum><text>to be heard with respect to any matter that arises in that action; and</text></clause><clause id="id56fbe7dc-fbb2-491f-ac80-b21a4a0c4c1a"><enum>(ii)</enum><text>to file a petition for appeal.</text></clause></subparagraph></paragraph><paragraph id="idc95ce1f0-b257-4cf4-b98b-2fae7e2be5b3"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this subtitle shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text><subparagraph id="id72743a6a-18d8-4d3c-ab81-834e5d7517f2"><enum>(A)</enum><text>conduct investigations;</text></subparagraph><subparagraph id="id575a2413-543d-47c7-a2f7-f651c8861fa0"><enum>(B)</enum><text>administer oaths or affirmations; or</text></subparagraph><subparagraph id="idc8d4112a-ccd7-4246-a8f4-e3a5ded2257b"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary and other evidence.</text></subparagraph></paragraph><paragraph id="id0bb90f0a-6637-4fe3-882e-97aaa4307c03"><enum>(4)</enum><header>Actions by the commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for violation of this subtitle, no State may, during the pendency of that action, institute a separate action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the Commission for that violation.</text></paragraph><paragraph id="id8eb60c66-74fc-4508-a4f3-3cb089f97006"><enum>(5)</enum><header>Venue; service of process</header><subparagraph id="id0fe6d0bc-267a-4339-9328-a15e6efb57ce"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in—</text><clause id="idf2593ac2-d799-40ca-a9bd-abf06bb870a0"><enum>(i)</enum><text>the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause id="idd41c08dc-2135-4c22-93a7-7733b7174041"><enum>(ii)</enum><text>a State court of competent jurisdiction.</text></clause></subparagraph><subparagraph id="ida28ff6ef-b62d-444b-83c3-029975f8e8c7"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1) in a district court of the United States, process may be served wherever defendant—</text><clause id="id07c775fe-82e8-4579-a645-9fb8b82c2f2e"><enum>(i)</enum><text>is an inhabitant; or</text></clause><clause id="id6a045cc4-350d-40f0-92b5-5650c5af1804"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc67f6cf8f24c4e00be3c53b25a62f7b7"><enum>(6)</enum><header>Limitation</header><text>A violation of section 102 shall not form the basis of liability in any action brought by the attorney general of a State under a State law.</text></paragraph></subsection></section><section id="id593a8ef1-2e68-4c53-8753-59a311137591"><enum>111.</enum><header>Kids online safety council</header><subsection id="id616126bb-9b7e-4416-bf0b-ef0b1b166083"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Commerce shall establish and convene the Kids Online Safety Council for the purpose of providing advice on matters related to this subtitle.</text></subsection><subsection id="idb0011072-0475-4b86-b549-ff686fef2beb"><enum>(b)</enum><header>Participation</header><text>The Kids Online Safety Council shall include diverse participation from—</text><paragraph id="id0c8fe6ed-32d4-47da-84fe-8aa080370f12"><enum>(1)</enum><text>academic experts, health professionals, and members of civil society with expertise in mental health, substance use disorders, and the prevention of harms to minors;</text></paragraph><paragraph id="id3dfe347b-50a0-4013-b4cc-a8d7f74f957e"><enum>(2)</enum><text>representatives in academia and civil society with specific expertise in privacy, free expression, access to information, and civil liberties;</text></paragraph><paragraph id="id4955234c-1469-4549-bffd-e2aace9ca7fd"><enum>(3)</enum><text>parents and youth representation;</text></paragraph><paragraph id="idfd45c1c3-fe23-40e9-9faa-b34460170734"><enum>(4)</enum><text>representatives of covered platforms;</text></paragraph><paragraph id="id5437095c-444f-457e-a1ea-f475299201de"><enum>(5)</enum><text>representatives of the National Telecommunications and Information Administration, the National Institute of Standards and Technology, the Federal Trade Commission, the Department of Justice, and the Department of Health and Human Services;</text></paragraph><paragraph id="id7359033e-c2c1-4fe5-b866-0fcf81933b15"><enum>(6)</enum><text>State attorneys general or their designees acting in State or local government;</text></paragraph><paragraph id="id1afc9731-351a-4c26-9d0a-e80d8b10b089"><enum>(7)</enum><text>educators; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44729d17dd0d4f8ca69cb0ce265b7590"><enum>(8)</enum><text display-inline="yes-display-inline">representatives of communities of socially disadvantaged individuals (as defined in section 8 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637</external-xref>)).</text></paragraph></subsection><subsection id="id3587f290-d90d-436c-bb14-d15b347faa7d"><enum>(c)</enum><header>Activities</header><text>The matters to be addressed by the Kids Online Safety Council shall include—</text><paragraph id="idfebfb57e-5963-438e-843d-14abf6ac8bfc"><enum>(1)</enum><text>identifying emerging or current risks of harms to minors associated with online platforms;</text></paragraph><paragraph id="idffe1113f-7fa3-4f01-ac06-6e8b5a376cd5"><enum>(2)</enum><text>recommending measures and methods for assessing, preventing, and mitigating harms to minors online;</text></paragraph><paragraph id="id7b51fe3e-7424-4ab7-86e0-0b3ef3b0351c"><enum>(3)</enum><text>recommending methods and themes for conducting research regarding online harms to minors, including in English and non-English languages; and</text></paragraph><paragraph id="id1a2145da-f8c5-406c-8f39-ef466235c5f7"><enum>(4)</enum><text>recommending best practices and clear, consensus-based technical standards for transparency reports and audits, as required under this subtitle, including methods, criteria, and scope to promote overall accountability.</text></paragraph></subsection><subsection id="id11a51cfd4a344787b419676a037ec1c7"><enum>(d)</enum><header>Non-applicability of FACA</header><text>The Kids Online Safety Council shall not be subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>). </text></subsection></section><section id="id180a6eec-a692-4be6-8e35-c415e21736b3"><enum>112.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided in this subtitle, this subtitle shall take effect on the date that is 18 months after the date of enactment of this Act.</text></section><section id="ida87e48de-4b93-4a7a-8b75-b35dffff8fae"><enum>113.</enum><header>Rules of construction and other matters</header><subsection id="id8430436b-4b1e-4925-b029-2c944531ae94"><enum>(a)</enum><header>Relationship to other laws</header><text display-inline="yes-display-inline">Nothing in this subtitle shall be construed to—</text><paragraph id="ide7332b95-28ec-4aee-9a0d-495f2114f05f"><enum>(1)</enum><text display-inline="yes-display-inline">preempt section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>, commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) or other Federal or State laws governing student privacy;</text></paragraph><paragraph id="id3667f69b-a102-4b05-baba-047ecf836a7e" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>preempt the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) or any rule or regulation promulgated under such Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd3bdf59-7dd1-48ec-83b7-52baebddddad"><enum>(3)</enum><text display-inline="yes-display-inline">authorize any action that would conflict with section 18(h) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(h)</external-xref>); or</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4F88DFE20B654E4DAC7229646F7ED171"><enum>(4)</enum><text>expand or limit the scope of section 230 of the Communications Act of 1934 (commonly known as <quote>section 230 of the Communications Decency Act of 1996</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>).</text></paragraph></subsection><subsection id="id608457ac96364c45a204283e4cc4d863"><enum>(b)</enum><header>Determination of <quote>fairly implied on the basis of objective circumstances</quote></header><text>For purposes of enforcing this subtitle, in making a determination as to whether covered platform has knowledge fairly implied on the basis of objective circumstances that a specific user is a minor, the Federal Trade Commission or a State attorney general shall rely on competent and reliable evidence, taking into account the totality of the circumstances, including whether a reasonable and prudent person under the circumstances would have known that the user is a minor. </text></subsection><subsection display-inline="no-display-inline" commented="no" id="id231cd811-b4d6-4793-b59c-0c1e88c247dd"><enum>(c)</enum><header>Protections for privacy</header><text>Nothing in this subtitle, including a determination described in subsection (b), shall be construed to require—</text><paragraph display-inline="no-display-inline" commented="no" id="idc73bea72-c19c-4e04-ae7f-fcbc60795c0d"><enum>(1)</enum><text>the affirmative collection of any personal data with respect to the age of users that a covered platform is not already collecting in the normal course of business; or</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4edb0f78-79d5-4fa6-bd72-d38384266f49"><enum>(2)</enum><text>a covered platform to implement an age gating or age verification functionality.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id0fb9b5ce-f817-43da-b25a-31ca96f96e6a"><enum>(d)</enum><header>Compliance</header><text>Nothing in this subtitle shall be construed to restrict a covered platform's ability to—</text><paragraph id="id214af182-c8e7-466c-ba84-c1407c172c68"><enum>(1)</enum><text>cooperate with law enforcement agencies regarding activity that the covered platform reasonably and in good faith believes may violate Federal, State, or local laws, rules, or regulations;</text></paragraph><paragraph id="id4ea7ae4d-10bd-4986-acd5-721f9df07549"><enum>(2)</enum><text>comply with a lawful civil, criminal, or regulatory inquiry, subpoena, or summons by Federal, State, local, or other government authorities; or</text></paragraph><paragraph id="ide35dba68-0792-4d26-a2df-2959dae3093e"><enum>(3)</enum><text>investigate, establish, exercise, respond to, or defend against legal claims. </text></paragraph></subsection><subsection id="id60ccb9c0d56c4147bf225c374f02240e"><enum>(e)</enum><header>Application to video streaming services</header><text>A video streaming service shall be deemed to be in compliance with this subtitle if it predominantly consists of news, sports, entertainment, or other video programming content that is preselected by the provider and not user-generated, and—</text><paragraph id="ide9d86c202f8c4afe99d4eb93c5e1d5c8"><enum>(1)</enum><text>any chat, comment, or interactive functionality is provided incidental to, directly related to, or dependent on provision of such content;</text></paragraph><paragraph id="id83d042852ceb4c589827246d103838c4"><enum>(2)</enum><text>if such video streaming service requires account owner registration and is not predominantly news or sports, the service includes the capability—</text><subparagraph id="idb56375e1e44547619c8cd47082b0e6d0"><enum>(A)</enum><text>to limit a minor’s access to the service, which may utilize a system of age-rating;</text></subparagraph><subparagraph id="idfdbbc904299145bb9636e21a2be83163"><enum>(B)</enum><text>to limit the automatic playing of on-demand content selected by a personalized recommendation system for an individual that the service knows is a minor;</text></subparagraph><subparagraph id="id72e1bbc2ba2e4274bd4f03783854dff7"><enum>(C)</enum><text>for a parent to manage a minor’s privacy and account settings, and restrict purchases and financial transactions by a minor, where applicable;</text></subparagraph><subparagraph id="idbe932d01971e498c9f86b49367579b8e"><enum>(D)</enum><text>to provide an electronic point of contact specific to matters described in this paragraph;</text></subparagraph><subparagraph id="id0608475a536044ea80ca48ac6b7e1fa9"><enum>(E)</enum><text>to offer a clear, conspicuous, and easy-to-understand notice of its policies and practices with respect to the capabilities described in this paragraph; and</text></subparagraph><subparagraph id="ide528bb86fbe44db791748efc8877bad6"><enum>(F)</enum><text>when providing on-demand content, to employ measures that safeguard against serving advertising for narcotic drugs (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)), tobacco products, gambling, or alcohol directly to the account or profile of an individual that the service knows is a minor. </text></subparagraph></paragraph></subsection></section></subtitle><subtitle id="id06a6d341c46245f28ddb1b3095ed96ff" style="OLC"><enum>B</enum><header>Filter Bubble Transparency</header><section commented="no" display-inline="no-display-inline" id="id9cae1de9df914545b7690d953790a301"><enum>120.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="idE4C1747DA88E4E30B7DEB4441B896736"><enum>(1)</enum><header>Algorithmic ranking system</header><text>The term <term>algorithmic ranking system</term> means a computational process, including one derived from algorithmic decision-making, machine learning, statistical analysis, or other data processing or artificial intelligence techniques, used to determine the selection, order, relative prioritization, or relative prominence of content from a set of information that is provided to a user on an online platform, including the ranking of search results, the provision of content recommendations, the display of social media posts, or any other method of automated content selection. </text></paragraph><paragraph id="id20e9df0fc5c34b4d92ed29691378a353"><enum>(2)</enum><header>Approximate geolocation information</header><text>The term <term>approximate geolocation information</term> means information that identifies the location of an individual, but with a precision of less than 5 miles.</text></paragraph><paragraph id="id18E4068C220A4C09A3A38D5C7F35DAC1"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id189d9e4dd9804c708bee8da1fb26532d"><enum>(4)</enum><header>Connected device</header><text>The term <term>connected device</term> means an electronic device that—</text><subparagraph id="id167a1348eaef420b9b0fc717fa2bbdb4"><enum>(A)</enum><text>is capable of connecting to the internet, either directly or indirectly through a network, to communicate information at the direction of an individual;</text></subparagraph><subparagraph id="id99d7c89ae4af4a49844f2763a5b46e45"><enum>(B)</enum><text>has computer processing capabilities for collecting, sending, receiving, or analyzing data; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74ced0fbe2b44fb19e7ab66d28c5fd9c"><enum>(C)</enum><text>is primarily designed for or marketed to consumers.</text></subparagraph></paragraph><paragraph id="id392BC67482644F5292D2868703A88BE5"><enum>(5)</enum><header>Input-transparent algorithm</header><subparagraph id="id35F0B6A7C4B04D2A81809E2A1A40F8E4"><enum>(A)</enum><header>In general</header><text>The term <term>input-transparent algorithm</term> means an algorithmic ranking system that does not use the user-specific data of a user to determine the selection, order, relative prioritization, or relative prominence of information that is furnished to such user on an online platform, unless the user-specific data is expressly provided to the platform by the user for such purpose. </text></subparagraph><subparagraph id="idDDD2798F08CA42DBA985CD5FD24ED9A9"><enum>(B)</enum><header>Data expressly provided to the platform</header><text>For purposes of subparagraph (A), user-specific data that is provided by a user for the express purpose of determining the selection, order, relative prioritization, or relative prominence of information that is furnished to such user on an online platform—</text><clause id="idD6804C236159427F9B887A1BED085E70"><enum>(i)</enum><text>shall include user-supplied search terms, filters, speech patterns (if provided for the purpose of enabling the platform to accept spoken input or selecting the language in which the user interacts with the platform), saved preferences, the resumption of a previous search, and the current precise geolocation information that is supplied by the user;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb7a2d6580ae54c1eb2bc8d63aef96b1a"><enum>(ii)</enum><text>shall include the user's current approximate geolocation information;</text></clause><clause id="idA04CA0BA17EC41FAB9F74D843CF3FAC0"><enum>(iii)</enum><text>shall include data submitted to the platform by the user that expresses the user's desire to receive particular information, such as the social media profiles the user follows, the video channels the user subscribes to, or other content or sources of content on the platform the user has selected;</text></clause><clause id="idD3CB04E3510E43FD92B84181E53DFCF6"><enum>(iv)</enum><text>shall not include the history of the user's connected device, including the user's history of web searches and browsing, previous geographical locations, physical activity, device interaction, and financial transactions; and</text></clause><clause id="idE6298D8B891E4E01B30A82A085545183"><enum>(v)</enum><text>shall not include inferences about the user or the user's connected device, without regard to whether such inferences are based on data described in clause (i) or (iii).</text></clause></subparagraph></paragraph><paragraph id="id4fa5f8412e8948d9a6483915fd6053e4"><enum>(6)</enum><header>Online platform</header><text>The term <term>online platform</term> means any public-facing website, online service, online application, or mobile application that predominantly provides a community forum for user-generated content, such as sharing videos, images, games, audio files, or other content, including a social media service, social network, or virtual reality environment. </text></paragraph><paragraph id="idFD898DA770424DDAA9313C6427549BE5"><enum>(7)</enum><header>Opaque algorithm</header><subparagraph id="idD1F77E29712542BF89DB724E4ED470FC"><enum>(A)</enum><header>In general</header><text>The term <term>opaque algorithm</term> means an algorithmic ranking system that determines the selection, order, relative prioritization, or relative prominence of information that is furnished to such user on an online platform based, in whole or part, on user-specific data that was not expressly provided by the user to the platform for such purpose.</text></subparagraph><subparagraph commented="no" id="id13ED04C557F34F929EF3E27CB1A73A00"><enum>(B)</enum><header>Exception for age-appropriate content filters</header><text>Such term shall not include an algorithmic ranking system used by an online platform if—</text><clause commented="no" id="idD093D0DD698345D2B14693F74799C0A5"><enum>(i)</enum><text>the only user-specific data (including inferences about the user) that the system uses is information relating to the age of the user; and</text></clause><clause commented="no" id="id35556E4E1E05416EB17142CF2494139B"><enum>(ii)</enum><text>such information is only used to restrict a user's access to content on the basis that the individual is not old enough to access such content.</text></clause></subparagraph></paragraph><paragraph id="idbc124e49abf643deb917738c46b860df"><enum>(8)</enum><header>Precise geolocation information</header><text>The term <term>precise geolocation information</term> means geolocation information that identifies an individual’s location to within a range of 5 miles or less. </text></paragraph><paragraph commented="no" id="id8104EA76C4E045D5A57384B33130A30C"><enum>(9)</enum><header>User-specific data</header><text>The term <term>user-specific data</term> means information relating to an individual or a specific connected device that would not necessarily be true of every individual or device.</text></paragraph></section><section id="id48FF5A1D7E4A49D391C19B7A3B70B7D7"><enum>121.</enum><header>Requirement to allow users to see unmanipulated content on internet platforms</header><subsection id="idDB6692F9162341BF9C4BB0D8DF901227"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 1 year after the date of enactment of this Act, it shall be unlawful for any person to operate an online platform that uses an opaque algorithm unless the person complies with the requirements of subsection (b).</text></subsection><subsection id="id1DF0303BA82E4ED2AE83CB2FA79A8A49"><enum>(b)</enum><header>Opaque algorithm requirements</header><paragraph id="id54E77957AC7D4CE78751E94731B6D6A3"><enum>(1)</enum><header>In general</header><text>The requirements of this subsection with respect to a person that operates an online platform that uses an opaque algorithm are the following:</text><subparagraph id="id6CD67BB003D04EF58FE51F7278703276"><enum>(A)</enum><text>The person provides users of the platform with the following notices:</text><clause commented="no" display-inline="no-display-inline" id="id672b9167ca284d3ea2f54954de949d9b"><enum>(i)</enum><text display-inline="yes-display-inline">Notice that the platform uses an opaque algorithm that uses user-specific data to select the content the user sees. Such notice shall be presented in a clear and conspicuous manner on the platform whenever the user interacts with an opaque algorithm for the first time, and may be a one-time notice that can be dismissed by the user.</text></clause><clause commented="no" display-inline="no-display-inline" id="idfecffb0fd3854bcb98ad4f6749c96042"><enum>(ii)</enum><text>Notice, to be included in the terms and conditions of the online platform, in a clear, accessible, and easily comprehensible manner that is to be updated whenever the online platform makes a material change, of—</text><subclause id="id0d46625dda464e5d88c7347b5f8cc7f1"><enum>(I)</enum><text>the most salient features, inputs, and parameters used by the algorithm;</text></subclause><subclause id="ida588ec35ec5c4923a73d846db0c74b3a"><enum>(II)</enum><text>how any user-specific data used by the algorithm is collected or inferred about a user of the platform, and the categories of such data;</text></subclause><subclause id="ida5d8a56688b14c338122d43774df8c64"><enum>(III)</enum><text>any options that the online platform makes available for a user of the platform to opt out or exercise options under subparagraph (B), modify the profile of the user or to influence the features, inputs, or parameters used by the algorithm; and</text></subclause><subclause id="id6c3d45b65e584230ab4c6002e9667108"><enum>(IV)</enum><text>any quantities, such as time spent using a product or specific measures of engagement or social interaction, that the algorithm is designed to optimize, as well as a general description of the relative importance of each quantity for such ranking. </text></subclause></clause></subparagraph><subparagraph id="id30A6D65CC3CB4F339561DE38E68D621D"><enum>(B)</enum><text>The online platform enables users to easily switch between the opaque algorithm and an input-transparent algorithm in their use of the platform.</text></subparagraph></paragraph><paragraph id="id9eaab2217bb64802b04d57cf9d372d75"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to require an online platform to disclose any information, including data or algorithms—</text><subparagraph id="id08214c41efcb4b468d202d75da043a53"><enum>(A)</enum><text>relating to a trade secret or other protected intellectual property;</text></subparagraph><subparagraph id="id582e2728774d4438af220b4ebd5bd26c"><enum>(B)</enum><text>that is confidential business information; or</text></subparagraph><subparagraph id="idbb3be26961554a26997853b18d51f86d"><enum>(C)</enum><text>that is privileged. </text></subparagraph></paragraph><paragraph id="idf72197c9098a4eadac904b47dea05319"><enum>(3)</enum><header>Prohibition on differential pricing</header><text>An online platform shall not deny, charge different prices or rates for, or condition the provision of a service or product to a user based on the user’s election to use an input-transparent algorithm in their use of the platform, as provided under paragraph (1)(B). </text></paragraph></subsection><subsection id="idC86D8420AC2E434BB48D79916981ED7E"><enum>(c)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="ida020661ec3ce48b3a54cf51295222fff"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section by an operator of an online platform shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="idf123071331364e8597b5d1683eda6ae0"><enum>(2)</enum><header>Powers of commission</header><subparagraph id="ida3baa2fdeba64e19ba4cca5506e8e37a"><enum>(A)</enum><header>In general</header><text>The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0b6dbb831e34211bed83ed40bdb02af"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="idbc0e6b8dd71b41b487e34b50fa58a185" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph></paragraph></subsection><subsection id="idc8b2c3443974401fb1d1aeee4711de0a"><enum>(d)</enum><header>Rule of construction to preserve personalized blocks</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit or prohibit an online platform’s ability to, at the direction of an individual user or group of users, restrict another user from searching for, finding, accessing, or interacting with such user’s or group’s account, content, data, or online community.</text></subsection></section></subtitle><subtitle id="id2b40278570bb4e8c9675f97537351b7e" style="OLC"><enum>C</enum><header>Relationship to State laws; severability</header><section id="idbef6df2d8ce8490eaabfb6b4379b4d98"><enum>130.</enum><header>Relationship to State laws</header><text display-inline="no-display-inline">The provisions of this title shall preempt any State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this title. Nothing in this title shall be construed to prohibit a State from enacting a law, rule, or regulation that provides greater protection to minors than the protection provided by the provisions of this title.</text></section><section id="idD501126FE2654006BE095E002F4AB111" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>131.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title, or an amendment made by this title, is determined to be unenforceable or invalid, the remaining provisions of this title and the amendments made by this title shall not be affected. </text></section></subtitle></title><title id="id05651FA998A7417EAC194905891FB3D4" style="OLC"><enum>II</enum><header>Children and Teen's Online Privacy</header><section id="idf2f4c3fa-9d59-491f-9380-c1896ce677a0"><enum>201.</enum><header>Online collection, use, disclosure, and deletion of personal information of children and teens</header><subsection id="idae33d55f-4216-419c-bc9f-3b4b4a52d857"><enum>(a)</enum><header>Definitions</header><text>Section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) is amended—</text><paragraph id="id184b2385-f2be-4602-8f39-38eba4732319"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd4cf3c4d-d56b-4fec-8a0e-beb509ab34b4" changed="added" reported-display-style="italic"><paragraph id="id5f74dc5d-01d8-4c59-a474-eb8f04443031"><enum>(2)</enum><header>Operator</header><text>The term <term>operator</term>—</text><subparagraph id="id1a6f17fb-cbc7-4621-805f-74c61261e394"><enum>(A)</enum><text>means any person—</text><clause id="id4dd55a59-5e5c-4e6c-b4dd-3a12e76c5b76"><enum>(i)</enum><text>who, for commercial purposes, in interstate or foreign commerce operates or provides a website on the internet, an online service, an online application, or a mobile application; and</text></clause><clause id="id6cc8394a-2053-4b90-aa32-9d0be5d73acb"><enum>(ii)</enum><text>who—</text><subclause id="id5592ab2c-9f0e-49af-b394-e6f802cb351a"><enum>(I)</enum><text>collects or maintains, either directly or through a service provider, personal information from or about the users of that website, service, or application;</text></subclause><subclause id="idbe2a18ae-627a-4a08-a29c-d4ec9b492cb6"><enum>(II)</enum><text>allows another person to collect personal information directly from users of that website, service, or application (in which case, the operator is deemed to have collected the information); or</text></subclause><subclause id="id88cc9f81-281c-4aa1-afb5-7e8e822fae48"><enum>(III)</enum><text>allows users of that website, service, or application to publicly disclose personal information (in which case, the operator is deemed to have collected the information); and</text></subclause></clause></subparagraph><subparagraph id="idd8aebbae-fab3-4610-a18b-dc40ff582a8c"><enum>(B)</enum><text>does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ida55fd46f-ec0c-45e0-8e01-52bdd80fb31f"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph id="id312bb945-0316-4cfe-94a9-4b041815e17b"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id549fd425-14ba-456c-9825-6655f94f3ace" changed="added" reported-display-style="italic"><subparagraph id="id5f1e7ff6-d118-400e-b77e-68eb4e6b1bb7"><enum>(A)</enum><text>the release of personal information collected from a child or teen by an operator for any purpose, except where the personal information is provided to a person other than an operator who—</text><clause id="id19dacc2d-faae-40b5-892b-f8ae8d32eb83"><enum>(i)</enum><text>provides support for the internal operations of the website, online service, online application, or mobile application of the operator, excluding any activity relating to individual-specific advertising to children or teens; and</text></clause><clause id="idb0f297c7-daa0-4ab6-b469-f1f4b559b575"><enum>(ii)</enum><text>does not disclose or use that personal information for any other purpose; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id316f1ef4-da80-4baa-9632-808409b01ec1"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id023900ec-0a99-4273-84fa-012eb5343852"><enum>(i)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></clause><clause id="id24588653-af8b-483a-ab5d-610932a6b8b8"><enum>(ii)</enum><text>by striking <quote>website or online service</quote> and inserting <quote>website, online service, online application, or mobile application</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1fdb8a6a494544c9bd1fd071122ba69b"><enum>(iii)</enum><text>by striking <quote>actual knowledge</quote> and inserting <quote>actual knowledge or knowledge fairly implied on the basis of objective circumstances</quote>;</text></clause></subparagraph></paragraph><paragraph id="id3ff23c7d-7bb4-4c6e-bc47-57c8735d87ad"><enum>(3)</enum><text>by striking paragraph (8) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idca2a94e9-d8fe-4474-8313-0560ca7eb490" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id9ed1b208545c4586b7a7b6d416af6ba2"><enum>(8)</enum><header>Personal information</header><subparagraph commented="no" display-inline="no-display-inline" id="idccef27dcbdee4ee7b7a3c8be819c9e15"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>personal information</term> means individually identifiable information about an individual collected online, including—</text><clause commented="no" display-inline="no-display-inline" id="id9EFBDE9FCC614693A5048E4433C65745"><enum>(i)</enum><text>a first and last name;</text></clause><clause commented="no" display-inline="no-display-inline" id="id26FC927B974B47009EBFBAECB7714A62"><enum>(ii)</enum><text>a home or other physical address including street name and name of a city or town;</text></clause><clause commented="no" display-inline="no-display-inline" id="idDFDB53B940F44139AF3345BB13634775"><enum>(iii)</enum><text>an e-mail address;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9F37629422774509BC112BCD355DDB7A"><enum>(iv)</enum><text>a telephone number;</text></clause><clause commented="no" display-inline="no-display-inline" id="id72534536058B4BC6ACB874176F4E7121"><enum>(v)</enum><text>a Social Security number;</text></clause><clause commented="no" display-inline="no-display-inline" id="idF5A7149A75D74160AC1E997AB7D546B1"><enum>(vi)</enum><text>any other identifier that the Commission determines permits the physical or online contacting of a specific individual;</text></clause><clause id="id7514087068c7475c8886672ead13b6da"><enum>(vii)</enum><text>a persistent identifier that can be used to recognize a specific child or teen over time and across different websites, online services, online applications, or mobile applications, including but not limited to a customer number held in a cookie, an Internet Protocol (IP) address, a processor or device serial number, or unique device identifier, but excluding an identifier that is used by an operator solely for providing support for the internal operations of the website, online service, online application, or mobile application; </text></clause><clause id="id4ef702bce96548b398756f0ef29b97a5"><enum>(viii)</enum><text>a photograph, video, or audio file where such file contains a specific child's or teen's image or voice; </text></clause><clause commented="no" display-inline="no-display-inline" id="id4363c791c0cb4e27b85cb3df8be56930"><enum>(ix)</enum><text display-inline="yes-display-inline"> geolocation information;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3da5d6cf6f954b1da6814c38c91722a6"><enum>(x)</enum><text>information generated from the measurement or technological processing of an individual's biological, physical, or physiological characteristics that is used to identify an individual, including—</text><subclause commented="no" display-inline="no-display-inline" id="id6bf250168e33447b894fc2eaacd89370"><enum>(I)</enum><text display-inline="yes-display-inline">fingerprints;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc2490df217824c618fcbe95ecaba8b46"><enum>(II)</enum><text display-inline="yes-display-inline">voice prints;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8b67e53b9568491793325cfe5117bbf3"><enum>(III)</enum><text>iris or retina imagery scans;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc8a1ea30233f4872afed1776fb122c6b"><enum>(IV)</enum><text>facial templates;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0e00a32e16c54257ad5678671d5501d3"><enum>(V)</enum><text>deoxyribonucleic acid (DNA) information; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id43731c0473274a15a34f76028ed14c42"><enum>(VI)</enum><text>gait; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7126a02465184085baa87b7d6537564f"><enum>(xi)</enum><text>information linked or reasonably linkable to a child or teen or the parents of that child or teen (including any unique identifier) that an operator collects online from the child or teen and combines with an identifier described in this subparagraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d6d816b65c64f1e89e16247e85eaf0f"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>personal information</term> shall not include an audio file that contains a child's or teen’s voice so long as the operator—</text><clause commented="no" display-inline="no-display-inline" id="id5268afc8f66f42c4b6c664a604dcfcf3"><enum>(i)</enum><text display-inline="yes-display-inline">does not request information via voice that would otherwise be considered personal information under this paragraph;</text></clause><clause commented="no" display-inline="no-display-inline" id="id18840cad9f27401188879e9ca572a34c"><enum>(ii)</enum><text display-inline="yes-display-inline">provides clear notice of its collection and use of the audio file and its deletion policy in its privacy policy;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb476888c3a8a4016a4d50f5caf95f986"><enum>(iii)</enum><text display-inline="yes-display-inline">only uses the voice within the audio file solely as a replacement for written words, to perform a task, or engage with a website, online service, online application, or mobile application, such as to perform a search or fulfill a verbal instruction or request; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id60d6f5133ce44a89abbb7a7f628f4b64"><enum>(iv)</enum><text display-inline="yes-display-inline">only maintains the audio file long enough to complete the stated purpose and then immediately deletes the audio file and does not make any other use of the audio file prior to deletion.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8f4f5d3795142f292b8349fbda9ded5"><enum>(C)</enum><header>Support for the internal operations of a website, online service, online application, or mobile application</header><clause commented="no" display-inline="no-display-inline" id="id1d502c3505f34acba6e25e0f9f43e65b"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(vii), the term <term>support for the internal operations of a website, online service, online application, or mobile application</term> means those activities necessary to—</text><subclause id="id17be56086a6e426ca355564d68984514"><enum>(I)</enum><text>maintain or analyze the functioning of the website, online service, online application, or mobile application;</text></subclause><subclause id="id2cdc58f098694200a04f4c2deee0d391"><enum>(II)</enum><text>perform network communications;</text></subclause><subclause id="id272ecd1150074a1389322fd83c73b9a1" commented="no"><enum>(III)</enum><text>authenticate users of, or personalize the content on, the website, online service, online application, or mobile application;</text></subclause><subclause id="id57825a162e8f4263a8cc35ddc66ad2f3"><enum>(IV)</enum><text>serve contextual advertising, provided that any persistent identifier is only used as necessary for technical purposes to serve the contextual advertisement, or cap the frequency of advertising;</text></subclause><subclause id="idda24a92d87ca4ec9ac356c12cafdb0fd"><enum>(V)</enum><text>protect the security or integrity of the user, website, online service, online application, or mobile application;</text></subclause><subclause id="iddc673e0fab434c3785cf349df8a85057"><enum>(VI)</enum><text>ensure legal or regulatory compliance, or</text></subclause><subclause id="id4ab6772675a045bdb1b09968f8386ea4"><enum>(VII)</enum><text>fulfill a request of a child or teen as permitted by subparagraphs (A) through (C) of section 1303(b)(2).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idfef7c69204d94e6ab3a76937767dbf8a"><enum>(ii)</enum><header>Condition</header><text>Except as specifically permitted under clause (i), information collected for the activities listed in clause (i) cannot be used or disclosed to contact a specific individual, including through individual-specific advertising to children or teens, to amass a profile on a specific individual, in connection with processes that encourage or prompt use of a website or online service, or for any other purpose.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id973b3ad4-6800-4456-b57d-c4070de57bf6"><enum>(4)</enum><text>by amending paragraph (9) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7d5669ae-37c5-4c07-82ad-1b7d5da8f537" changed="added" reported-display-style="italic"><paragraph id="idcd6918d3-9670-4553-8c43-b1dbb99bf970"><enum>(9)</enum><header>Verifiable consent</header><text>The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology), including a request for authorization for future collection, use, and disclosure described in the notice, to ensure that, in the case of a child, a parent of the child, or, in the case of a teen, the teen—</text><subparagraph id="idb0044369-fa48-466b-8598-03d738fcbf14"><enum>(A)</enum><text>receives direct notice of the personal information collection, use, and disclosure practices of the operator; and</text></subparagraph><subparagraph id="idec0ef9fa-722e-4c73-aab3-a6d537589ab2"><enum>(B)</enum><text>before the personal information of the child or teen is collected, freely and unambiguously authorizes—</text><clause id="idcc0d69da-4b07-46d2-8ffd-cff2f8fedcd1"><enum>(i)</enum><text>the collection, use, and disclosure, as applicable, of that personal information; and</text></clause><clause id="id63b626f0-98d5-41bb-a345-c29cb2d731b4"><enum>(ii)</enum><text>any subsequent use of that personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4fbdfc21-7c56-4481-be19-544e5c99ca65"><enum>(5)</enum><text>in paragraph (10)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id546bf6dab22c424f824f1521bf740d27"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph header, by striking <quote><header-in-text style="OLC" level="paragraph">Website or online service directed to children</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Website, online service, online application, or mobile application directed to children</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde81ac2d73924212a4f24e90d151ad99"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>website or online service</quote> each place it appears and inserting <quote>website, online service, online application, or mobile application</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf200c8e55a46420bb5c95217b88fbf3e"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7FCB8B3B1A584CA09EA2290383AF8FBA" changed="added" reported-display-style="italic"><subparagraph id="id85ca46bea3f2482fa64de27642840675" commented="no"><enum>(C)</enum><header>Rule of construction</header><text>In considering whether a website, online service, online application, or mobile application, or portion thereof, is directed to children, the Commission shall apply a totality of circumstances test and will also consider competent and reliable empirical evidence regarding audience composition and evidence regarding the intended audience of the website, online service, online application, or mobile application.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idec26f1dd-6249-4518-a92c-d14323264731"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0cec6928-e388-4e9b-8e45-acab825ec472" changed="added" reported-display-style="italic"><paragraph id="idfb77a601-3021-4898-9e56-e1f2c8500dc3" commented="no"><enum>(13)</enum><header>Connected device</header><text>The term <term>connected device</term> means a device that is capable of connecting to the internet, directly or indirectly, or to another connected device.</text></paragraph><paragraph id="id066c7bd8-ca29-461d-acf8-ed42b88e3d61" commented="no"><enum>(14)</enum><header>Online application</header><text>The term <term>online application</term>—</text><subparagraph id="id5e21c5b0-876a-48b7-9233-ac3e751c01e0" commented="no"><enum>(A)</enum><text>means an internet-connected software program; and</text></subparagraph><subparagraph id="id2172dfc6-7239-4453-a533-55642be02ed6" commented="no"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="idadd87f99-4dd7-40b8-afbe-ef1255c7cf95" commented="no"><enum>(15)</enum><header>Mobile application</header><text>The term <term>mobile application</term>—</text><subparagraph id="idd2af4f4f-dfef-41c9-9300-a0896240cf74" commented="no"><enum>(A)</enum><text>means a software program that runs on the operating system of—</text><clause id="idbd3768cb-a8db-4d76-acf9-937da0f98af2" commented="no"><enum>(i)</enum><text>a cellular telephone;</text></clause><clause id="id8bdedf1d-54c5-4795-aa41-6f74bb71eed7" commented="no"><enum>(ii)</enum><text>a tablet computer; or</text></clause><clause id="id20ca23b9-53b5-46fe-a692-7b04f61e12f3" commented="no"><enum>(iii)</enum><text>a similar portable computing device that transmits data over a wireless connection; and</text></clause></subparagraph><subparagraph id="id2511c2f9-384b-4ba2-a7b4-6a22975baf79" commented="no"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="id754e3a63-dadb-4c0a-97fb-b14642e81d1f" commented="no"><enum>(16)</enum><header>Geolocation information</header><text>The term <term>geolocation information</term> means information sufficient to identify a street name and name of a city or town.</text></paragraph><paragraph id="idcbe821b8-12ca-44f8-9a9f-5c524867bb87" commented="no"><enum>(17)</enum><header>Teen</header><text>The term <term>teen</term> means an individual who has attained age 13 and is under the age of 17.</text></paragraph><paragraph id="id9f9183fe-1fa4-4200-85bb-ee95a6a836a1" commented="no"><enum>(18)</enum><header>Individual-specific advertising to children or teens</header><subparagraph id="idb6e15a49-323c-4752-95f2-3afa39789922" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>individual-specific advertising to children or teens</term> means advertising or any other effort to market a product or service that is directed to a specific child or teen or a connected device that is linked or reasonably linkable to a child or teen based on—</text><clause id="ide6cf89dd-65b5-40db-bcfe-cdaaa98f1ef9" commented="no"><enum>(i)</enum><text>the personal information from—</text><subclause id="id66780002-08e5-4f9c-9db3-d79773a5262f" commented="no"><enum>(I)</enum><text>the child or teen; or</text></subclause><subclause id="idc9a443e2-cebd-40fb-acae-3e56ff19daae" commented="no"><enum>(II)</enum><text>a group of children or teens who are similar in sex, age, household income level, race, or ethnicity to the specific child or teen to whom the product or service is marketed;</text></subclause></clause><clause id="idb85bb69b-89e7-4792-8f86-60db4a701207" commented="no"><enum>(ii)</enum><text>profiling of a child or teen or group of children or teens; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id277330d789934579a6d3312aa27de56e"><enum>(iii)</enum><text>a unique identifier of the connected device.</text></clause></subparagraph><subparagraph id="id1911d5ff-f873-45d6-94e8-28389288ea8b" commented="no"><enum>(B)</enum><header>Exclusions</header><text>The term <term>individual-specific advertising to children or teens</term> shall not include—</text><clause id="id384ac05d-0976-4ef2-a251-8ab193dfb7c7" commented="no"><enum>(i)</enum><text>advertising or marketing to an individual or the device of an individual in response to the individual’s specific request for information or feedback, such as a child's or teen's current search query;</text></clause><clause id="id396de51c-f10d-4034-be92-5208e38dc8b3" commented="no"><enum>(ii)</enum><text>contextual advertising, such as when an advertisement is displayed based on the content of the website, online service, online application, mobile application, or connected device in which the advertisement appears and does not vary based on personal information related to the viewer; or</text></clause><clause id="iddb4884e4-46f5-4760-80a3-a3279027ef0b" commented="no"><enum>(iii)</enum><text>processing personal information solely for measuring or reporting advertising or content performance, reach, or frequency, including independent measurement.</text></clause></subparagraph><subparagraph id="id78893508-5a4f-4f05-bd00-adbfd17f9171" commented="no"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to prohibit an operator with actual knowledge or knowledge fairly implied on the basis of objective circumstances that a user is under the age of 17 from delivering advertising or marketing that is age-appropriate and intended for a child or teen audience, so long as the operator does not use any personal information other than whether the user is under the age of 17.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida108766b-7f5b-4e12-8b11-7cc186510236"><enum>(b)</enum><header>Online collection, use, disclosure, and deletion of personal information of children and teens</header><text>Section 1303 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text><paragraph id="idc22f6c29-4cb9-48a4-9e01-c26e71ec2a30"><enum>(1)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="section" style="OLC">Online collection, use, disclosure, and deletion of personal information of children and teens.</header-in-text></quote>;</text></paragraph><paragraph id="idb7f3857e-1604-41c0-85b8-53f4705ec89a"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id880b6593-4d24-44bf-a026-c0bb0dff4173"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6b5989da-4bc3-44b4-be11-5c9e6a6536d9" changed="added" reported-display-style="italic"><paragraph id="id510569c7-d601-4d62-a723-13370f0c4dea"><enum>(1)</enum><header>In general</header><text>It is unlawful for an operator of a website, online service, online application, or mobile application directed to children or for any operator of a website, online service, online application, or mobile application with actual knowledge or knowledge fairly implied on the basis of objective circumstances that a user is a child or teen—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3ab5f753f9654248b9639e2d0838af5e"><enum>(A)</enum><text display-inline="yes-display-inline">to collect personal information from a child or teen in a manner that violates the regulations prescribed under subsection (b);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a96bb6ba71646b4bbd6feeceac25e67"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in subparagraphs (B) and (C) of section 1302(18), to collect, use, disclose to third parties, or maintain personal information of a child or teen for purposes of individual-specific advertising to children or teens (or to allow another person to collect, use, disclose, or maintain such information for such purpose);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3b750a2017a4e1881e9c6a35bbbfc96"><enum>(C)</enum><text display-inline="yes-display-inline">to collect the personal information of a child or teen except when the collection of the personal information is—</text><clause id="id4f6dcb50898a4102a482fda01208d7c2"><enum>(i)</enum><text>consistent with the context of a particular transaction or service or the relationship of the child or teen with the operator, including collection necessary to fulfill a transaction or provide a product or service requested by the child or teen; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idd1495a32299b4f18b502c0bce27b3c9c"><enum>(ii)</enum><text display-inline="yes-display-inline">required or specifically authorized by Federal or State law; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6789bd68af124f28aa3d21980113d400"><enum>(D)</enum><text display-inline="yes-display-inline">to store or transfer the personal information of a child or teen outside of the United States unless the operator provides direct notice to the parent of the child, in the case of a child, or to the teen, in the case of a teen, that the child's or teen's personal information is being stored or transferred outside of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66d6148f05754eff83a21086be464399"><enum>(E)</enum><text display-inline="yes-display-inline">to retain the personal information of a child or teen for longer than is reasonably necessary to fulfill a transaction or provide a service requested by the child or teen except as required or specifically authorized by Federal or State law.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0cde7243-5c63-4124-a6c9-6ad01af77b76"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idbb3664e8-7b38-4d53-a1dd-31d86a948f27"><enum>(i)</enum><text>in the header, by striking <quote><header-in-text style="OLC" level="paragraph">parent</header-in-text></quote> and inserting <quote><quote><header-in-text style="OLC" level="paragraph">parent or teen</header-in-text></quote></quote></text></clause><clause commented="no" display-inline="no-display-inline" id="id7899b0a71c0341428a3cc75e4e937f56"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>Notwithstanding paragraph (1)</quote> and inserting <quote>Notwithstanding paragraph (1)(A)</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd6c8bef5b0384eaaa189ae78bca886fe"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>of such a website or online service</quote>; and</text></clause><clause id="idbc546e7a-77f4-4f00-9f3e-5552d138371d"><enum>(iv)</enum><text>by striking <quote>subsection (b)(1)(B)(iii) to the parent of a child</quote> and inserting <quote>subsection (b)(1)(B)(iv) to the parent of a child or under subsection (b)(1)(C)(iv) to a teen</quote>;</text></clause></subparagraph></paragraph><paragraph id="id29f5130a-f4d4-4d72-ae5c-77998d49fa98"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="id67eb8517-090f-460d-836a-fef88804983b"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id359e82f6-07f3-4f5b-bdb5-b6fdc03f4f62"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="ida3bd587c-4c42-49b0-a387-07a8c0803f4c"><enum>(I)</enum><text>by striking <quote>operator of any website</quote> and all that follows through <quote>from a child</quote> and inserting <quote>operator of a website, online service, online application, or mobile application directed to children or that has actual knowledge or knowledge fairly implied on the basis of objective circumstances that a user is a child or teen</quote>;</text></subclause><subclause id="idbff79a84-8427-4c6f-9784-86b7f64d8bcc"><enum>(II)</enum><text>in clause (i)— </text><item id="id9cfc6683-78b3-407b-b3fc-7d49c47fea83"><enum>(aa)</enum><text>by striking <quote>notice on the website</quote> and inserting <quote>clear and conspicuous notice on the website</quote>;</text></item><item id="id6e1b6914-a374-46c9-ab77-b02a217b4572"><enum>(bb)</enum><text>by inserting <quote>or teens</quote> after <quote>children</quote>;</text></item><item id="ida7823601-d393-499b-8022-885f9bb1fbb9"><enum>(cc)</enum><text>by striking <quote>, and the operator's</quote> and inserting <quote>, the operator's</quote>; and</text></item><item id="id3aa2fcaf-ce89-4e02-b849-4385f211a944"><enum>(dd)</enum><text>by striking <quote>; and</quote> and inserting <quote>, the rights and opportunities available to the parent of the child or teen under subparagraphs (B) and (C), and the procedures or mechanisms the operator uses to ensure that personal information is not collected from children or teens except in accordance with the regulations promulgated under this paragraph;</quote>;</text></item></subclause><subclause id="id07d420e7-41df-4e11-a54c-0ca25888ac2f"><enum>(III)</enum><text>in clause (ii)— </text><item id="idf4283174-369b-4500-b1ea-b00a93d4092d" commented="no"><enum>(aa)</enum><text>by striking <quote>parental</quote>;</text></item><item id="id1835abfd-6b27-468f-a2ec-0513aab697dd"><enum>(bb)</enum><text>by inserting <quote>or teens</quote> after <quote>children</quote>;</text></item><item commented="no" display-inline="no-display-inline" id="id37c4b0aee93a49bdae7f17b64ffaeb2d"><enum>(cc)</enum><text display-inline="yes-display-inline">by striking the semicolon at the end and inserting <quote>; and</quote>; and</text></item></subclause><subclause id="id879564d1aea3442dae40d9b67b0338cc"><enum>(IV)</enum><text>by inserting after clause (ii) the following new clause:</text><quoted-block id="id86AF340A09CD4001AA39FC316F053CD2" style="OLC" act-name="" changed="added" reported-display-style="italic"><clause id="id87A3A528E6FF4A9991207DAAACCC9DFA"><enum>(iii)</enum><text>to obtain verifiable consent from a parent of a child or from a teen before using or disclosing personal information of the child or teen for any purpose that is a material change from the original purposes and disclosure practices specified to the parent of the child or the teen under clause (i);</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id243b2bd1-2e8a-4fc6-ae09-c7feaf17530f"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="iddc5e816c-8393-43ef-99c1-0afbc1715412"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>website or online service</quote> and inserting <quote>operator</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idac87eec083954773984471e24ff6647e"><enum>(II)</enum><text>in clause (i), by inserting <quote>and the method by which the operator obtained the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information</quote> before the semicolon; </text></subclause><subclause id="idbe5d038c-928a-4553-abbd-567f5fa86723"><enum>(III)</enum><text>in clause (ii)—</text><item commented="no" display-inline="no-display-inline" id="id6ae09cd5e5b240708898e3f1e1a6c449"><enum>(aa)</enum><text display-inline="yes-display-inline">by inserting <quote>to delete personal information collected from the child or content or information submitted by the child to a website, online service, online application, or mobile application and</quote> after <quote>the opportunity at any time</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="id3df3ee9c65d647cd8a28ea4c43f25ed7"><enum>(bb)</enum><text>by striking <quote>; and</quote> and inserting a semicolon;</text></item></subclause><subclause id="id55e5b920-1562-403c-8cd1-a636972c800a" commented="no"><enum>(IV)</enum><text>by redesignating clause (iii) as clause (iv) and inserting after clause (ii) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE5CBBFE0EEC4AEB9515B031EC1E0F4D" changed="added" reported-display-style="italic"><clause commented="no" display-inline="no-display-inline" id="id8564456388274624b8022a94ef7e4b0f"><enum>(iii)</enum><text>the opportunity to challenge the accuracy of the personal information and, if the parent of the child establishes the inaccuracy of the personal information, to have the inaccurate personal information corrected;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="id762de141d0bc4def9dd7c016240c1965"><enum>(V)</enum><text display-inline="yes-display-inline">in clause (iv), as so redesignated, by inserting <quote>, if such information is available to the operator at the time the parent makes the request</quote> before the semicolon;</text></subclause></clause><clause commented="no" id="id1a354254-39ac-478a-85c5-e78d9de6dbe1"><enum>(iii)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text></clause><clause commented="no" id="id1a70c254-1cb6-472a-b646-abcd4e734ea9"><enum>(iv)</enum><text>by inserting after subparagraph (B) the following new subparagraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d595478-aa64-4851-8757-326c72934d8b" changed="added" reported-display-style="italic"><subparagraph id="idffd66478-0b73-4791-8468-3ec5b31dc00f"><enum>(C)</enum><text>require the operator to provide, upon the request of a teen under this subparagraph who has provided personal information to the operator, upon proper identification of that teen—</text><clause id="id5efde241-7403-433c-9235-bb565e62f32e"><enum>(i)</enum><text>a description of the specific types of personal information collected from the teen by the operator, the method by which the operator obtained the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information;</text></clause><clause id="id0551c3b3-c036-4a9f-b72c-60cae0f66b96"><enum>(ii)</enum><text>the opportunity at any time to delete personal information collected from the teen or content or information submitted by the teen to a website, online service, online application, or mobile application and to refuse to permit the operator's further use or maintenance in retrievable form, or online collection, of personal information from the teen;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide8280ff92efa4083a6c10c8c62eafff0"><enum>(iii)</enum><text display-inline="yes-display-inline">the opportunity to challenge the accuracy of the personal information and, if the teen establishes the inaccuracy of the personal information, to have the inaccurate personal information corrected; and</text></clause><clause id="id38d5b9ea-3989-4f8c-b4e8-45e106caaef9"><enum>(iv)</enum><text>a means that is reasonable under the circumstances for the teen to obtain any personal information collected from the teen, if such information is available to the operator at the time the teen makes the request;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" id="id3ed77111-1b47-4f0d-ab3c-11b4e626af4c"><enum>(v)</enum><text>in subparagraph (D), as so redesignated— </text><subclause commented="no" display-inline="no-display-inline" id="id63d87dce8ed84c43ac3cc1a3fe2d47b9"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>a child's</quote> and inserting <quote>a child's or teen's</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idcad3272d2c4245f2b841db30bc111bca"><enum>(II)</enum><text>by inserting <quote>or teen</quote> after <quote>the child</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id26fff91fb7b149d2a3da57156a92abb2"><enum>(vi)</enum><text display-inline="yes-display-inline">by amending subparagraph (E), as so redesignated, to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9031cb9d9244df2a64e7ada4623c0f9" changed="added" reported-display-style="italic"><subparagraph id="id04fec9155ae54cb2be6fbbb71e40418a"><enum>(E)</enum><text>require the operator to establish, implement, and maintain reasonable security practices to protect the confidentiality, integrity, and accessibility of personal information of children or teens collected by the operator, and to protect such personal information against unauthorized access.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idea90cab1-53d6-4443-988e-fe9ce859d62a"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="ide9754f69-0b66-474f-9f77-1673e486125d"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>verifiable parental consent</quote> and inserting <quote>verifiable consent</quote>;</text></clause><clause id="iddb9c95ca-d1ac-47e0-9cbd-f619a4ead768"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="idc5752a6d-8e14-453f-a036-089dcd760aca"><enum>(I)</enum><text>by inserting <quote>or teen</quote> after <quote>collected from a child</quote>;</text></subclause><subclause id="idb6d0c8f8-8cf8-4c73-95c8-cf8a6726a8b9"><enum>(II)</enum><text>by inserting <quote>or teen</quote> after <quote>request from the child</quote>; and</text></subclause><subclause id="id000f450c-00e6-4d11-9b62-50f352b67e2b"><enum>(III)</enum><text>by inserting <quote>or teen or to contact another child or teen</quote> after <quote>to recontact the child</quote>;</text></subclause></clause><clause id="idd9de484e-b867-4686-a607-7eb608760a3d"><enum>(iii)</enum><text>in subparagraph (B)—</text><subclause id="idf51403a6-6d27-41b2-ab9c-8e2e7e9a24a4"><enum>(I)</enum><text>by striking <quote>parent or child</quote> and inserting <quote>parent or teen</quote>; and</text></subclause><subclause id="id5cfa2045-5575-4d92-b3af-3433a659d4a0"><enum>(II)</enum><text>by striking <quote>parental consent</quote> each place the term appears and inserting <quote>verifiable consent</quote>;</text></subclause></clause><clause id="idd0ecf3a7-6c4a-41f5-9f8b-a8abd95a7880"><enum>(iv)</enum><text>in subparagraph (C)—</text><subclause id="id1063e99f-ea97-4d46-957d-c849ad0c3980"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></subclause><subclause id="id044cb261-1e43-4b5e-8900-52d1062467d6"><enum>(II)</enum><text>in clause (i)—</text><item id="idef6dc2b9-24c1-48a2-bf9a-7dd97e9de95e"><enum>(aa)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears; and</text></item></subclause></clause><clause id="id390084d2-ad99-4088-951f-18a605c46e7d"><enum>(v)</enum><text>in subparagraph (D)—</text><subclause id="id4c4fc1ac-3052-42f0-9e5f-5c155a9e62ee"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></subclause><subclause id="id73667dea-7485-4394-9ca6-2f559a8c0d62"><enum>(II)</enum><text>in clause (ii), by inserting <quote>or teen</quote> after <quote>child</quote>; and</text></subclause><subclause id="id0273c52d-f105-49a3-b6d6-da54b6afada7"><enum>(III)</enum><text>in the flush text following clause (iii)—</text><item id="id76bdc4ce-51fe-4749-916a-60b41732a100"><enum>(aa)</enum><text>by inserting <quote>or teen, as applicable,</quote> after <quote>parent</quote> each place the term appears; and</text></item><item id="id13ec7cab-0d2b-4da3-8755-23a4968a6cea"><enum>(bb)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote>;</text></item></subclause></clause></subparagraph><subparagraph id="id77b9d994-af2f-448c-b7eb-2d5e4379cca2"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (4) and inserting after paragraph (2) the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3CAE92096A414F60A3F39C0F58834D94" changed="added" reported-display-style="italic"><paragraph id="id1e4495cd8a7741faab22d963492cccf0" commented="no"><enum>(3)</enum><header>Application to operators acting under agreements with educational agencies or institutions</header><text>The regulations may provide that verifiable consent under paragraph (1)(A)(ii) is not required for an operator that is acting under a written agreement with an educational agency or institution (as defined in section 444 of the General Education Provisions Act (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g(a)(3)</external-xref>) that, at a minimum, requires the—</text><subparagraph id="id334e9fac892e47009c4f9eb855340591" commented="no"><enum>(A)</enum><text>operator to—</text><clause id="id30963024602047f28f8a1e558e9cceb5" commented="no"><enum>(i)</enum><text>limit its collection, use, and disclosure of the personal information from a child or teen to solely educational purposes and for no other commercial purposes;</text></clause><clause id="idc29d8d05d9634f09a8d2448268f67b2f" commented="no"><enum>(ii)</enum><text>provide the educational agency or institution with a notice of the specific types of personal information the operator will collect from the child or teen, the method by which the operator will obtain the personal information, and the purposes for which the operator will collect, use, disclose, and retain the personal information;</text></clause><clause id="id683c094439254ac7bfadec976df43a46" commented="no"><enum>(iii)</enum><text>provide the educational agency or institution with a link to the operator’s online notice of information practices as required under subsection (b)(1)(A)(i); and</text></clause><clause id="id3b29b31dad6f4addac13565d9901a496" commented="no"><enum>(iv)</enum><text>provide the educational agency or institution, upon request, with a means to review the personal information collected from a child or teen, to prevent further use or maintenance or future collection of personal information from a child or teen, and to delete personal information collected from a child or teen or content or information submitted by a child or teen to the operator’s website, online service, online application, or mobile application;</text></clause></subparagraph><subparagraph id="idf0acd9056cde405889eea276de5c14a6" commented="no"><enum>(B)</enum><text>representative of the educational agency or institution to acknowledge and agree that they have authority to authorize the collection, use, and disclosure of personal information from children or teens on behalf of the educational agency or institution, along with such authorization, their name, and title at the educational agency or institution; and</text></subparagraph><subparagraph id="idaa9aabf855004853b0729c39ffaef785" commented="no"><enum>(C)</enum><text>educational agency or institution to—</text><clause id="ide2379b1303334f75bc7f35984d952ce7" commented="no"><enum>(i)</enum><text>provide on its website a notice that identifies the operator with which it has entered into a written agreement under this subsection and provides a link to the operator’s online notice of information practices as required under paragraph (1)(A)(i);</text></clause><clause id="id5f67eab11d06494e9c3786754c19f28b" commented="no"><enum>(ii)</enum><text>provide the operator’s notice regarding its information practices, as required under subparagraph (A)(ii), upon request, to a parent, in the case of a child, or a parent or teen, in the case of a teen; and</text></clause><clause id="ida270740acb75492d828528829de8037a" commented="no"><enum>(iii)</enum><text>upon the request of a parent, in the case of a child, or a parent or teen, in the case of a teen, request the operator provide a means to review the personal information from the child or teen and provide the parent, in the case of a child, or parent or teen, in the case of the teen, a means to review the personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc873b322b24743acac7c80d7fdb03745"><enum>(D)</enum><text display-inline="yes-display-inline">by amending paragraph (4), as so redesignated, to read as follows:</text><quoted-block id="id113E3CC53A6C496DBB9A97ACA344F5E1" style="OLC" act-name="" changed="added" reported-display-style="italic"><paragraph id="id732D5E7DE7C643E09AC3D9A2C9ADD9B6"><enum>(4)</enum><header>Termination of service</header><text>The regulations shall permit the operator of a website, online service, online application, or mobile application to terminate service provided to a child whose parent has refused, or a teen who has refused, under the regulations prescribed under paragraphs (1)(B)(ii) and (1)(C)(ii), to permit the operator’s further use or maintenance in retrievable form, or future online collection of, personal information from that child or teen.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb529a5f3ffdb40228db2382e5b200d72"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02174ae1-5c98-4608-8fc5-9dd147c5933c" changed="added" reported-display-style="italic"><paragraph id="id34cf7a8a-e254-46f4-8a73-42ae429efaaf" commented="no"><enum>(5)</enum><header>Continuation of service</header><text>The regulations shall prohibit an operator from discontinuing service provided to a child or teen on the basis of a request by the parent of the child or by the teen, under the regulations prescribed under subparagraph (B) or (C) of paragraph (1), respectively, to delete personal information collected from the child or teen, to the extent that the operator is capable of providing such service without such information.</text></paragraph><paragraph id="idda71d739b0e04e2694fe766506eedca6"><enum>(6)</enum><header>Rule of construction</header><text>A request made pursuant to subparagraph (B) or (C) of paragraph (1) to delete or correct personal information of a child or teen shall not be construed—</text><subparagraph id="id1fb18b81cb004b0695f6587334ddb1d1"><enum>(A)</enum><text>to limit the authority of a law enforcement agency to obtain any content or information from an operator pursuant to a lawfully executed warrant or an order of a court of competent jurisdiction;</text></subparagraph><subparagraph id="id7be2cb93437c48b692aa627740ca1c80"><enum>(B)</enum><text>to require an operator or third party delete or correct information that—</text><clause id="idbeb3661ee4584effbd63bd9c790dc4dc"><enum>(i)</enum><text>any other provision of Federal or State law requires the operator or third party to maintain; or</text></clause><clause id="id827e9bad0bf740b79734144b81140038"><enum>(ii)</enum><text>was submitted to the website, online service, online application, or mobile application of the operator by any person other than the user who is attempting to erase or otherwise eliminate the content or information, including content or information submitted by the user that was republished or resubmitted by another person; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9389ffd6ca7d4702b60e250690f6856c"><enum>(C)</enum><text display-inline="yes-display-inline">to prohibit an operator from—</text><clause commented="no" display-inline="no-display-inline" id="ide25e39c85f364db2bf825aa7c7ca9b99"><enum>(i)</enum><text display-inline="yes-display-inline">retaining a record of the deletion request and the minimum information necessary for the purposes of ensuring compliance with a request made pursuant to subparagraph (B) or (C);</text></clause><clause id="ida1a05a34a08a475b89ad54965d62f63f"><enum>(ii)</enum><text>preventing, detecting, protecting against, or responding to security incidents, identity theft, or fraud, or reporting those responsible for such actions;</text></clause><clause id="ida7831609d33048d4808e1d9573d2c59e"><enum>(iii)</enum><text>protecting the integrity or security of a website, online service, online application or mobile application; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5b879580ed54e86bdfd083bc0790101"><enum>(iv)</enum><text display-inline="yes-display-inline">ensuring that the child's or teen's information remains deleted.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8eb81e849a504d6dba3347de5a7b2f29"><enum>(7)</enum><header>Common verifiable consent mechanism</header><subparagraph commented="no" display-inline="no-display-inline" id="ide6a3c20f7e3245cea63d9febdb4e524f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><clause commented="no" display-inline="no-display-inline" id="ide78f217f78124b8e9652ac151f0e3bc1"><enum>(i)</enum><header display-inline="yes-display-inline">Feasibility of mechanism</header><text display-inline="yes-display-inline">The Commission shall assess the feasibility, with notice and public comment, of allowing operators the option to use a common verifiable consent mechanism that fully meets the requirements of this title. </text></clause><clause commented="no" display-inline="no-display-inline" id="idf092b14d9dc945e5b8b062ddc4c01433"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">The feasibility assessment described in clause (i) shall consider whether a single operator could use a common verifiable consent mechanism to obtain verifiable consent, as required under this title, from a parent of a child or from a teen on behalf of multiple, listed operators that provide a joint or related service.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf7f1366fa64405490ce3d2fb1cd3303"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this paragraph, the Commission shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives with the findings of the assessment required by subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f87ff65d1b84bf2bd0bc259fd7a18be"><enum>(C)</enum><header>Regulations</header><text display-inline="yes-display-inline">If the Commission finds that the use of a common verifiable consent mechanism is feasible and would meet the requirements of this title, the Commission shall issue regulations to permit the use of a common verifiable consent mechanism in accordance with the findings outlined in such report. </text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3a1170a509a34b909f17a4679ff2cde3"><enum>(4)</enum><text>in subsection (c), by striking <quote>a regulation prescribed under subsection (a)</quote> and inserting <quote>subparagraph (B), (C), (D), or (E) of subsection (a)(1), or of a regulation prescribed under subsection (b),</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e39a673e0ab4c80b723b8865d7d3aa1"><enum>(5)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block id="idBFB455EDA52F4D38A28F92C3F2F0ED3A" style="OLC" act-name="" changed="added" reported-display-style="italic"><subsection id="id19079AAD86BD44E396799297697E9123"><enum>(d)</enum><header>Relationship to State law</header><text>The provisions of this title shall preempt any State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this title. Nothing in this title shall be construed to prohibit any State from enacting a law, rule, or regulation that provides greater protection to children or teens than the provisions of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf4c2ee78-27cb-405c-8e65-7f0fb1fb8219"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text><paragraph id="id825a416e-d28b-43fc-a66f-082c52079116"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and teens</quote> after <quote>children</quote>; and</text></paragraph><paragraph id="idef7296cd-607b-4329-8d03-359c743bd3c8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id916b9fe7-8c11-4eaf-afcc-04a59fe23d7c" changed="added" reported-display-style="italic"><subsection id="id32e3775e-8956-4b0c-967f-29477e0d8db8"><enum>(d)</enum><header>Publication</header><paragraph id="id7f999122-fe26-4805-bb47-41429ec8b06e"><enum>(1)</enum><header>In general</header><text>Subject to the restrictions described in paragraph (2), the Commission shall publish on the internet website of the Commission any report or documentation required by regulation to be submitted to the Commission to carry out this section.</text></paragraph><paragraph id="id545a2ecd-74ba-4b0c-b116-787de7647182"><enum>(2)</enum><header>Restrictions on publication</header><text>The restrictions described in section 6(f) and section 21 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(f)</external-xref>, 57b–2) applicable to the disclosure of information obtained by the Commission shall apply in same manner to the disclosure under this subsection of information obtained by the Commission from a report or documentation described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2f66b7c6-7c53-4888-8bac-945105ab7727"><enum>(d)</enum><header>Actions by States</header><text>Section 1305 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6504">15 U.S.C. 6504</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id530937cf45e8481aa1686b93613c586e"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id124cacbf68af4d94b1a0df81c51c23e3"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>section 1303(a)(1) or</quote> before <quote>any regulation</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b1e29a41222492ba9c8a37919e3f8f3"><enum>(B)</enum><text>by inserting <quote>section 1303(a)(1) or</quote> before <quote>that regulation</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4f6031d24c084b7fa3043095a5e9acb0"><enum>(e)</enum><header display-inline="yes-display-inline">Administration and applicability of Act</header><text>Section 1306 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6505">15 U.S.C. 6505</external-xref>) is amended—</text><paragraph id="id8e8646db-6641-4149-893a-fde7b77fd7e3"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id6fc86d4f-6adf-4e28-afd5-d27d80f796d2"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, in the case of</quote> and all that follows through <quote>the Board of Directors of the Federal Deposit Insurance Corporation;</quote> and inserting the following: <quote>by the appropriate Federal banking agency, with respect to any insured depository institution (as those terms are defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>));</quote>; and</text></subparagraph><subparagraph id="id933c34a5-1e88-4aaf-9587-e88ab8eeb00a"><enum>(B)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (6) as paragraphs (2) through (5), respectively;</text></subparagraph></paragraph><paragraph id="id701b4b3f-954b-41fb-8616-79e8452b69ff"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7da1083412104e71ac5ce4bcb4c73631"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>section 1303(a)(1) or</quote> before <quote>a rule</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4e4a80eeef94ae1ae46ff5603756d90"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id873559390A014A10B85E7814AE5E28EE" changed="added" reported-display-style="italic"><subsection id="id817f9e94e50d43dca08c364b12b1a6d3"><enum>(f)</enum><header>Determination of whether an operator has knowledge fairly implied on the basis of objective circumstances</header><paragraph id="idc7b673703fc84141bab03ad2c2e29810" commented="no"><enum>(1)</enum><header>Rule of construction</header><text>For purposes of enforcing this title or a regulation promulgated under this title, in making a determination as to whether an operator has knowledge fairly implied on the basis of objective circumstances that a specific user is a child or teen, the Commission or State attorneys general shall rely on competent and reliable evidence, taking into account the totality of the circumstances, including whether a reasonable and prudent person under the circumstances would have known that the user is a child or teen. Nothing in this title, including a determination described in the preceding sentence, shall be construed to require an operator to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaad93a373fd84e0d9f8fd74a860b1cc3"><enum>(A)</enum><text>affirmatively collect any personal information with respect to the age of a child or teen that an operator is not already collecting in the normal course of business; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id236ec3a4428c43a2bf112d640edaa9a4"><enum>(B)</enum><text>implement an age gating or age verification functionality.</text></subparagraph></paragraph><paragraph id="id0dccab47a1a149e4a0dad4f9e99a572e"><enum>(2)</enum><header>Commission guidance</header><subparagraph commented="no" display-inline="no-display-inline" id="idbd7db0cee2374776a4301f2bc2cc7afe"><enum>(A)</enum><header>In general</header><text>Within 180 days of enactment, the Commission shall issue guidance to provide information, including best practices and examples for operators to understand the Commission’s determination of whether an operator has knowledge fairly implied on the basis of objective circumstances that a user is a child or teen.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc0967ccbde247dc8072b1d5149b8b8b"><enum>(B)</enum><header>Limitation</header><text>No guidance issued by the Commission with respect to this title shall confer any rights on any person, State, or locality, nor shall operate to bind the Commission or any person to the approach recommended in such guidance. In any enforcement action brought pursuant to this title, the Commission or State attorney general, as applicable, shall allege a specific violation of a provision of this title. The Commission or State attorney general, as applicable, may not base an enforcement action on, or execute a consent order based on, practices that are alleged to be inconsistent with any such guidance, unless the practices allegedly violate this title. For purposes of enforcing this title or a regulation promulgated under this title, State attorneys general shall take into account any guidance issued by the Commission under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="ide5045297538247198782568dffc821e9"><enum>(g)</enum><header>Additional requirement</header><text>Any regulations issued under this title shall include a description and analysis of the impact of proposed and final Rules on small entities per the Regulatory Flexibility Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idc9829a83-1ea2-497c-a6d6-104857548209"><enum>202.</enum><header>Study and reports of mobile and online application oversight and enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idb8cbeb26dc9e4973988abbc2c1456513"><enum>(a)</enum><header display-inline="yes-display-inline">Oversight report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the processes of platforms that offer mobile and online applications for ensuring that, of those applications that are websites, online services, online applications, or mobile applications directed to children, the applications operate in accordance with—</text><paragraph id="id5fdfcdf4-f8e0-4770-9d01-6b890870e287"><enum>(1)</enum><text>this title, the amendments made by this title, and rules promulgated under this title; and</text></paragraph><paragraph id="id87afbc84-1d92-4a7f-a0e0-07044c44568e"><enum>(2)</enum><text>rules promulgated by the Commission under section 18 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a</external-xref>) relating to unfair or deceptive acts or practices in marketing.</text></paragraph></subsection><subsection id="id7bb3e4a01dfa4d47816de4c63ed1656c"><enum>(b)</enum><header>Enforcement report</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that addresses, at a minimum—</text><paragraph id="idcb9a46b2f3c949cfb0f80005db8bfbd0"><enum>(1)</enum><text>the number of actions brought by the Commission during the reporting year to enforce the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) (referred to in this subsection as the <term>Act</term>) and the outcome of each such action;</text></paragraph><paragraph id="id726cac6970e54b02bdc6168c5b30cf9a"><enum>(2)</enum><text>the total number of investigations or inquiries into potential violations of the Act; during the reporting year;</text></paragraph><paragraph id="idfcce35a3cf4847d1af7f8da08a2ae880"><enum>(3)</enum><text>the total number of open investigations or inquiries into potential violations of the Act as of the time the report is submitted;</text></paragraph><paragraph id="id730858880c8b4d308ca9c195664fe95a"><enum>(4)</enum><text>the number and nature of complaints received by the Commission relating to an allegation of a violation of the Act during the reporting year; and</text></paragraph><paragraph id="id26f5cf56dccf4cee887613cca1a072c2"><enum>(5)</enum><text>policy or legislative recommendations to strengthen online protections for children and teens. </text></paragraph></subsection></section><section id="id829a3662-af72-497d-b94f-ec86837fed91"><enum>203.</enum><header>GAO study</header><subsection id="idf4a12f62-94cb-41f6-b61e-f96d90da8ef0"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <term>Comptroller General</term>) shall conduct a study on the privacy of teens who use financial technology products. Such study shall—</text><paragraph id="idc02dd7ab-e374-4d7e-bca2-65502df4caa8"><enum>(1)</enum><text>identify the type of financial technology products that teens are using;</text></paragraph><paragraph id="ida10778f8-85cb-4b53-9fa4-f4691b70ead6"><enum>(2)</enum><text>identify the potential risks to teens' privacy from using such financial technology products; and</text></paragraph><paragraph id="idf445c2f5-f131-4cb3-9b95-00d187454f89"><enum>(3)</enum><text>determine whether existing laws are sufficient to address such risks to teens' privacy.</text></paragraph></subsection><subsection id="idaa96650a-e270-4a87-b83e-13c3b757ae18" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Comptroller General shall submit to Congress a report containing the results of the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate. </text></subsection></section><section id="ide3202b2031904452ba1807f7adda7cb0" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>204.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title, or an amendment made by this title, is determined to be unenforceable or invalid, the remaining provisions of this title and the amendments made by this title shall not be affected. </text></section></title><title style="OLC" id="idA7F74D2ACDF9446088604234468DBB76"><enum>III</enum><header>Eliminating Useless Reports</header><section id="H718A807512DF499F8054F0FAEB5ED1DF"><enum>301.</enum><header>Sunsets for agency reports</header><subsection id="HE32B2175B38241BAB064006223A48D33"><enum>(a)</enum><header>In general</header><text>Section 1125 of title 31, United States Code, is amended—</text><paragraph id="H6760E1709BA54242B5B5A37F30354A7C"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d);</text></paragraph><paragraph id="H78DCB1436FE34472834DFCF7D6F17488"><enum>(2)</enum><text>by striking subsections (a) and (b) and inserting the following:</text><quoted-block id="HB0210AB8B053456BBC3152FD8F3DA0BA" style="OLC" changed="added" reported-display-style="italic"><subsection id="H26402F90841648A187134C40A24C79F0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBC81796D7A6F483E91845CDD43DF6E74"><enum>(1)</enum><header>Budget justification materials</header><text>The term <term>budget justification materials</term> has the meaning given the term in section 3(b)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>).</text></paragraph><paragraph id="HCDFC9A889CC94CF9A4F21F476239C898"><enum>(2)</enum><header>Plan or report</header><text>The term <term>plan or report</term> means any plan or report submitted to Congress, any committee of Congress, or subcommittee thereof, by not less than 1 agency—</text><subparagraph id="H54FC8F0B506C48D6A243B2F200A42468"><enum>(A)</enum><text>in accordance with Federal law; or</text></subparagraph><subparagraph id="H3478A32D2C4F4E44B4B0988A5B4049DC"><enum>(B)</enum><text>at the direction or request of a congressional report.</text></subparagraph></paragraph><paragraph id="H19E94945083F43EEAA0326467DCE4386"><enum>(3)</enum><header>Recurring plan or report</header><text>The term <term>recurring plan or report</term> means a plan or report submitted on a recurring basis.</text></paragraph><paragraph id="HF50C2DD1A2C045FEBF0297227E86C4E8"><enum>(4)</enum><header>Relevant congressional committee</header><text>The term <term>relevant congressional committee</term>—</text><subparagraph id="H5F217DF119494DC4A17B55C8B057EBF0"><enum>(A)</enum><text>means a congressional committee to which a recurring plan or report is required to be submitted; and</text></subparagraph><subparagraph id="HB8CB305948B04538B1FA715A463DCA22"><enum>(B)</enum><text>does not include any plan or report that is required to be submitted solely to the Committee on Armed Services of the House of Representatives or the Senate.</text></subparagraph></paragraph></subsection><subsection id="H1D8A837DBC5C4AC78357B581AC5FA2C3"><enum>(b)</enum><header>Agency identification of unnecessary reports</header><paragraph id="H9BA8242CF1F34E27A05039E35FFFAD32"><enum>(1)</enum><header>In general</header><text>The head of each agency shall include in the budget justification materials of the agency the following:</text><subparagraph id="HC8E7CF6220EE4785A88FFA43C0366DA1"><enum>(A)</enum><text>Subject to paragraphs (2) and (3), the following:</text><clause id="H3C01D1772C2145D987F010285EBA47DF"><enum>(i)</enum><text>A list of each recurring plan or report submitted by the agency.</text></clause><clause id="H0DD1DE047FC248F49A3272488EDB1A86"><enum>(ii)</enum><text display-inline="yes-display-inline">An identification of whether the recurring plan or report listed in clause (i) was included in the most recent report issued by the Clerk of the House of Representatives concerning the reports that any agency is required by law or directed or requested by a committee report to make to Congress, any committee of Congress, or subcommittee thereof.</text></clause><clause id="H098D28DAFA194E0785B591BDA11A75F6"><enum>(iii)</enum><text>If applicable, the unique alphanumeric identifier for the recurring plan or report as required by section 7243(b)(1)(C)(vii) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>).</text></clause><clause id="HA8EC4771C26B446D974D13ADF103D0A8"><enum>(iv)</enum><text>The identification of any recurring plan or report the head of the agency determines to be outdated or duplicative.</text></clause></subparagraph><subparagraph id="H4CDDA94CC23A4D4B84C8DC9C0BAE159C"><enum>(B)</enum><text>With respect to each recurring plan or report identified in subparagraph (A)(iv), the following:</text><clause id="H3456BD058DCC4B84AFA9D27E793CC1D5"><enum>(i)</enum><text>A recommendation on whether to sunset, modify, consolidate, or reduce the frequency of the submission of the recurring plan or report.</text></clause><clause id="H87CFD7621C6D4B32BB00D4A56BCF200F"><enum>(ii)</enum><text>A citation to each provision of law or directive or request in a congressional report that requires or requests the submission of the recurring plan or report.</text></clause><clause id="H2269356B3A034F29849781F89A6BE29F"><enum>(iii)</enum><text>A list of the relevant congressional committees for the recurring plan or report.</text></clause></subparagraph><subparagraph id="H38697F1D27C642A1A55FA5B860749B29"><enum>(C)</enum><text>A justification explaining, with respect to each recommendation described in subparagraph (B)(i) relating to a recurring plan or report—</text><clause id="H0653096449ED44929800DF0C8F8A780C"><enum>(i)</enum><text>why the head of the agency made the recommendation, which may include an estimate of the resources expended by the agency to prepare and submit the recurring plan or report; and</text></clause><clause id="H75B7D9EB030245E6A0650CCF1BFC2113"><enum>(ii)</enum><text>the understanding of the head of the agency of the purpose of the recurring plan or report.</text></clause></subparagraph></paragraph><paragraph id="HE87512CA1DF44388913D24A550FD0093"><enum>(2)</enum><header>Agency consultation</header><subparagraph id="HCDC1634B231E418180D3D04AE6B61B34"><enum>(A)</enum><header>In general</header><text>In preparing the list required under paragraph (1)(A), if, in submitting a recurring plan or report, an agency is required to coordinate or consult with another agency or entity, the head of the agency submitting the recurring plan or report shall consult with the head of each agency or entity with whom consultation or coordination is required.</text></subparagraph><subparagraph id="H30703161229B4D078914DF8F9CED891A"><enum>(B)</enum><header>Inclusion in list</header><text>If, after a consultation under subparagraph (A), the head of each agency or entity consulted under that subparagraph agrees that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring plan or report shall—</text><clause id="H39A8FC97BC89480DB07874BA1DF43BDD"><enum>(i)</enum><text>include the recurring plan or report in the list described in paragraph (1)(A); and</text></clause><clause id="HA1A2C02FD45B4E4581589DA22B1EC43B"><enum>(ii)</enum><text>identify each agency or entity with which the head of the agency is required to coordinate or consult in submitting the recurring plan or report.</text></clause></subparagraph><subparagraph id="HAEBE6D13B8314DF4B0D6C02A996B3B01"><enum>(C)</enum><header>Disagreement</header><text>If the head of any agency or entity consulted under subparagraph (A) does not agree that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring plan or report shall not include the recurring plan or report in the list described in paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="H87D242E51D9444F1A06900E79084ED3F"><enum>(3)</enum><header>Government-wide or multi-agency plan and report submissions</header><text>With respect to a recurring plan or report required to be submitted by not less than 2 agencies, the Director of the Office of Management and Budget shall—</text><subparagraph id="H88012040C0A943388530EF29A65B041E"><enum>(A)</enum><text>determine whether the requirement to submit the recurring plan or report is outdated or duplicative; and</text></subparagraph><subparagraph id="H40527D40C53441A2A8A2CA88A4852993"><enum>(B)</enum><text>make recommendations to Congress accordingly.</text></subparagraph></paragraph><paragraph id="H48486766B0CB413C911EFF1107E20AFC"><enum>(4)</enum><header>Plan and report submissions conformity to the access to congressionally mandated reports act</header><text>With respect to an agency recommendation, citation, or justification made under subparagraph (B) or (C) of paragraph (1) or a recommendation by the Director of the Office of Management and Budget under paragraph (3), the agency or Director, as applicable, shall also provide this information to the Director of the Government Publishing Office in conformity with the agency submission requirements under section 7244(a) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/41">chapter 41</external-xref> of title 44 note) in conformity with guidance issued by the Director of the Office of Management and Budget under section 7244(b) of such Act. </text></paragraph></subsection><subsection id="H6D79D02A3DAC4596BA92B494408B8821"><enum>(c)</enum><header>Rule of construction on agency requirements</header><text>Nothing in this section shall be construed to exempt the head of an agency from a requirement to submit a recurring plan or report.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H44269A721E1D4299B5CC74111F55F25F"><enum>(3)</enum><text>in subsection (d), as so redesignated, by striking <quote>in the budget of the United States Government, as provided by section 1105(a)(37)</quote> and inserting <quote>in the budget justification materials of each agency</quote>.</text></paragraph></subsection><subsection id="H848701897C9B4E2EAA597DA8997E8B5F"><enum>(b)</enum><header>Budget contents</header><text>Section 1105(a) of title 31, United States Code, is amended by striking paragraph (39).</text></subsection><subsection id="H6D0CC7C7E9B540F2BE43E7A8333DB9AC"><enum>(c)</enum><header>Conformity to the access to Congressionally Mandated Reports Act</header><paragraph id="H83FA74101EEC4A89B6880552A96C9F5B"><enum>(1)</enum><header>Amendment</header><text>Subsections (a) and (b) of section 7244 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/41">chapter 41</external-xref> of title 44, United States Code, note), are amended to read as follows:</text><quoted-block id="H1FAC419B5CE6453195C4136B23F3736F" style="OLC" changed="added" reported-display-style="italic"><subsection id="H6C1A82C9A0A343BA96D2BD0E25F4FBBD"><enum>(a)</enum><header>Submission of electronic copies of reports</header><text display-inline="yes-display-inline">Not earlier than 30 days or later than 60 days after the date on which a congressionally mandated report is submitted to either House of Congress or to any committee of Congress or subcommittee thereof, the head of the Federal agency submitting the congressionally mandated report shall submit to the Director the information required under subparagraphs (A) through (D) of section 7243(b)(1) with respect to the congressionally mandated report. Notwithstanding section 7246, nothing in this subtitle shall relieve a Federal agency of any other requirement to publish the congressionally mandated report on the online portal of the Federal agency or otherwise submit the congressionally mandated report to Congress or specific committees of Congress, or subcommittees thereof.</text></subsection><subsection id="H67574748A2CD4AEFA1B1AA404BF7655B"><enum>(b)</enum><header>Guidance</header><text>Not later than 180 days after the date of the enactment of this subsection and periodically thereafter as appropriate, the Director of the Office of Management and Budget, in consultation with the Director, shall issue guidance to agencies on the implementation of this subtitle as well as the requirements of section 1125(b) of title 31, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC64CCA127E7A48A4A996A9DD3A0726DC"><enum>(2)</enum><header>Updated OMB Guidance</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall issue updated guidance to agencies to ensure that the requirements under subsections (a) and (b) of section 1125 of title 31, United States Code, as amended by this Act, for agency submissions of recommendations and justifications for plans and reports to sunset, modify, consolidate, or reduce the frequency of the submission of are also submitted as a separate attachment in conformity with the agency submission requirements of electronic copies of reports submitted by agencies under section 7244(a) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/41">chapter 41</external-xref> of title 44, United States Code, note) for publication on the online portal established under section 7243 of such Act.</text></paragraph></subsection></section></title></amendment-block></amendment></engrossed-amendment-body><title-amends><official-title-amendment>Amend the title so as to read: <quote>An Act to protect the safety and privacy of children on the internet.</quote>.</official-title-amendment></title-amends><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
