<official-title>To provide urgent acquisition and deployment authority for purposes of replenishing United States stockpiles.</official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing American Acquisitions, Readiness, and Military Stockpiles Act of 2023</short-title></quote> or the <quote><short-title>Securing American ARMS Act of 2023</short-title></quote>.</text></section> <section id="id758E1D56E0C2414AB52E1C247B30F17A"><enum>2.</enum><header>Emergency acquisition authority</header><text display-inline="no-display-inline">Section 3601(a)(1) of title 10, United States Code, is amended—</text>
<paragraph id="id5095BE99DD3C426D8F8D5331EDC60A57"><enum>(1)</enum><text>in subparagraph (A)(iv), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph> <paragraph id="idB6C9C0AC5B9E4081A299DCE65E6375B2"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph>
<paragraph id="id3830E8A86F0041CFA372E16B70FF8F58"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="idF3F5BA00EAFF42FC999D848C52D88EB1" act-name=""> <subparagraph id="id43612987B196431B815F126025087C72"><enum>(C)</enum><text>for purposes of—</text>
<clause commented="no" display-inline="no-display-inline" id="ida2a04d9881ff436bb3aacc6376824459"><enum>(i)</enum><text display-inline="yes-display-inline">replenishing United States stockpiles with like defense articles when those stockpiles are diminished as a result of the United States providing defense articles in response to an armed attack by a country of concern (as that term is defined in section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>)) against—</text> <subclause id="idBF2433261B814A4EA7BA21BEC1E75514"><enum>(I)</enum><text>a United States ally (as that term is defined in section 201(d) of the Act of December 2, 1942, entitled, <quote>To provide benefits for the injury, disability, death, or enemy detention of employees of contractors with the United States, and for other purposes</quote> (56 Stat. 1028, chapter 668; <external-xref legal-doc="usc" parsable-cite="usc/42/1711">42 U.S.C. 1711(d)</external-xref>)); or</text></subclause>
<subclause id="idE6106851F9A94DDCAC814AD8702A5269"><enum>(II)</enum><text>a United States partner; or</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="id1f8243c8748d4ccc8bc015840eab89c4"><enum>(ii)</enum><text display-inline="yes-display-inline">contracting for the movement or delivery of defense articles transferred to such ally or partner through the President's drawdown authorities in connection with such response,</text></clause><continuation-text continuation-text-level="subparagraph">provided that the United States is not a party to the hostilities.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
