which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Sloan Canyon National Conservation Area Act to adjust the boundary of the Sloan Canyon National Conservation Area, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sloan Canyon Conservation and Horizon Lateral Water Pipeline Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id258d8759aeb141549c1d15aa8d8cc440"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id7f2c3743e5e74992a26db722a3b2ee15"><enum>(1)</enum><header>Conservation Area</header><text>The term <quote>Conservation Area</quote> means the Sloan Canyon National Conservation Area.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id191310f43d14415f80acdb337368adad"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior (acting through the Director of the Bureau of Land Management).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idb9d1b4b49f954be78afc83a03b65f918"><enum>3.</enum><header>Sloan Canyon National Conservation Area boundary adjustment</header><subsection commented="no" display-inline="no-display-inline" id="id0289d3cf155b442e996c3f1d71a304e5"><enum>(a)</enum><header display-inline="yes-display-inline">Boundary adjustment</header><paragraph id="id7e258bbef2ed41979302e6b48d7c8ea9"><enum>(1)</enum><header>Map</header><text>Section 603(4) of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-1">16 U.S.C. 460qqq–1(4)</external-xref>) is amended by striking <quote>map entitled <quote>Southern Nevada Public Land Management Act</quote> and dated October 1, 2002</quote> and inserting <quote>map entitled <quote>Proposed Sloan Canyon Expansion</quote> and dated June 7, 2023</quote>.</text></paragraph><paragraph id="id9a6a744391484690b3234bbb0ff5801d"><enum>(2)</enum><header>Acreage</header><text>Section 604(b) of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-2">16 U.S.C. 460qqq–2(b)</external-xref>) is amended by striking <quote>48,438</quote> and inserting <quote>57,728</quote>. </text></paragraph></subsection><subsection id="id518db13a89e1480490a1ea79eacbb93e"><enum>(b)</enum><header>Right-of-Way</header><text>Section 605 of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-3">16 U.S.C. 460qqq–3</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00cbaeee583e40e5abcfa6245a600bd4"><subsection id="id0495aec61e604b998aeed932d6cb7d01"><enum>(h)</enum><header>Horizon lateral pipeline right-of-Way</header><paragraph id="id9ccb95874d2e401087ff2ae282e4c9c4"><enum>(1)</enum><header>In general</header><text>Notwithstanding sections 202 and 503 of the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1763) and subject to valid existing rights, the Secretary of the Interior, acting through the Director of the Bureau of Land Management (referred to in this subsection as the <quote>Secretary</quote>), shall, not later than 1 year after the date of enactment of this subsection, grant to the Southern Nevada Water Authority (referred to in this subsection as the <quote>Authority</quote>), not subject to the payment of rents or other charges, the temporary and permanent pipeline, powerline, facility, and access road rights-of-way depicted on the map for the purposes of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf31e965030ab4e6a97c47da517f6260a"><enum>(A)</enum><text display-inline="yes-display-inline">performing geotechnical investigations within the rights-of-way; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf513adabfc8a407fb8fce4e8ffac6dae"><enum>(B)</enum><text display-inline="yes-display-inline">constructing and operating water transmission and related facilities.</text></subparagraph></paragraph><paragraph id="id14ee0fa9001740508337fdbca7707bba"><enum>(2)</enum><header>Excavation and disposal</header><subparagraph commented="no" display-inline="no-display-inline" id="id56e1acb002df435c9533bae075bd883e"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Authority may, without consideration, excavate and use or dispose of sand, gravel, minerals, or other materials necessary to fulfill the purpose of the rights-of-way granted under paragraph (1). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a4880986d3f4a5a8800079e7028db6d"><enum>(B)</enum><header>Memorandum of understanding</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the rights-of-way are granted under paragraph (1), the Secretary and the Authority shall enter into a memorandum of understanding identifying Federal land on which the Authority may dispose of materials under subparagraph (A) to further the interests of the Bureau of Land Management.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9838e1f5488f48da9004dfbccd590bec"><enum>(c)</enum><header>Preservation of Transportation, Utility Corridors, and Management of Conservation Area</header><text>Nothing in this Act (including an amendment made by this Act)—</text><paragraph id="id696a286ecb464e1aba2190313df5a038"><enum>(1)</enum><text>includes in the expanded boundary of the Conservation Area under the amendments made by subsection (a) land within a designated utility transmission corridor or a transmission line right-of-way grant approved by the Secretary in a record of decision issued before the date of enactment of this Act;</text></paragraph><paragraph id="id52c43f1f066d4fb6baaa7bcad5cc6179"><enum>(2)</enum><text>affects the existence, use, operation, maintenance, repair, construction, reconfiguration, expansion, inspection, renewal, reconstruction, alteration, addition, relocation improvement funding, removal, or replacement of any utility facility or appurtenant right-of-way within an existing designated transportation and utility corridor within the expanded boundary of the Conservation Area under the amendments made by subsection (a);</text></paragraph><paragraph id="idc94597e45b4b498faa0084ab3a5b957b"><enum>(3)</enum><text>precludes the Secretary from authorizing the establishment of a new utility facility right-of-way within an existing designated transportation and utility corridor within the expanded boundary of the Conservation Area under the amendments made by subsection (a)—</text><subparagraph id="id7ed5ebc4cf31440d813fa7861d995f91"><enum>(A)</enum><text>in accordance with—</text><clause id="id357ba967eaa14573bfac3138581ea5f0"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></clause><clause id="idcaafed651824424594c32d64f955d331"><enum>(ii)</enum><text>any other applicable law; and</text></clause></subparagraph><subparagraph id="id50bb81a8b70b4d55a31c21955abe6dc1"><enum>(B)</enum><text>subject to such terms and conditions as the Secretary determines to be appropriate; </text></subparagraph></paragraph><paragraph id="id696db8e3aa9d43fab1205b655f794c4d"><enum>(4)</enum><text>prohibits access to, or the repair or replacement of, a transmission line within a right-of-way within the expanded boundary of the Conservation Area under the amendments made by subsection (a) that was issued before the date of enactment of this Act; or</text></paragraph><paragraph id="idbabd2f3fa89d46f7a8a36b9b70253703"><enum>(5)</enum><text>except as provided in the amendment made by subsection (b), modifies the management of the Conservation Area pursuant to section 605 of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-3">16 U.S.C. 460qqq–3</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
