which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Competitive, Special, and Facilities Research Grant Act and the Department of Agriculture Reorganization Act of 1994 to further plant cultivar and animal breed research, development, and commercialization, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seeds and Breeds for the Future Act</short-title></quote>.</text></section><section id="iddbaded6b236649fa83e84935711ff836"><enum>2.</enum><header>Public cultivar development</header><text display-inline="no-display-inline">Section 2 of the Competitive, Special, and Facilities Research Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/3157">7 U.S.C. 3157</external-xref>) is amended—</text><paragraph id="idffa8bc1961db452d994f3ed57be03d29"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9040CD64AE74A5EB50838EBC5643C97"><paragraph id="id153e7b985c754746bfe505fe279fe2f2"><enum>(3)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="id59f28dd6f1864338a690cb89aaf1c674"><enum>(A)</enum><header>Conventional breeding</header><text>The term <term>conventional breeding</term> means the development of new varieties of an organism through controlled mating and selection without the use of transgenic methods.</text></subparagraph><subparagraph id="id1ac9e201ec354870965be2d97c8fd4f2"><enum>(B)</enum><header>Cultivar</header><text>The term <term>cultivar</term> means a variety of a species of plant that has been intentionally selected for use in cultivation because of the improved characteristics of that variety of the species.</text></subparagraph><subparagraph id="id9e1c4531313f4b21a6b0144fd401e72c"><enum>(C)</enum><header>Public animal breed</header><text>The term <term>public animal breed</term> means an animal breed—</text><clause commented="no" display-inline="no-display-inline" id="id69361C2C090549B4B96C3C66432C8F4D"><enum>(i)</enum><text display-inline="yes-display-inline">that is the commercially available uniform end product of a publicly funded breeding program that has been sufficiently tested to demonstrate improved characteristics and stable performance; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id8833A3F4E42A43B4AE9461D8B4B22E2D"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to which, if intellectual property rights are asserted, the intellectual property rights are in the form of plant patents or plant variety protection and not utility patents. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f123c21b4a7499ba23787df47331806"><enum>(D)</enum><header>Public cultivar</header><text>The term <term>public cultivar</term> means a cultivar—</text><clause commented="no" display-inline="no-display-inline" id="idB3030F6633914314BF2B45AC2D6B90B1"><enum>(i)</enum><text display-inline="yes-display-inline">that is the commercially available uniform end product of a publicly funded breeding program that has been sufficiently tested to demonstrate improved characteristics and stable performance; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id427886BB25B140E89B530C1C2E695804"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to which, if intellectual property rights are asserted, the intellectual property rights are in the form of plant patents or plant variety protection and not utility patents. </text></clause></subparagraph><subparagraph id="id14e1f89379244741b6c56453a8dd0445"><enum>(E)</enum><header>Public cultivar or animal breed</header><text>The term <term>public cultivar or animal breed</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id028545fb6d00490795f6ef3f1f103d43"><enum>(i)</enum><text display-inline="yes-display-inline">a public animal breed; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3d621ce96c814e28a4d591ca9c1ca14b"><enum>(ii)</enum><text display-inline="yes-display-inline">a public cultivar.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5613784f4f3e4de98ff2379134cfebe1"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3881FE7307EE47EFBB3EBFF90016CF42"><subsection id="idf2130872a9e443c3af00aa35201657ab"><enum>(l)</enum><header>Public cultivar and animal breed development funding</header><paragraph id="id96a307668a274bf285c6fa1e8f90ef0c"><enum>(1)</enum><header>Set-aside</header><subparagraph commented="no" display-inline="no-display-inline" id="ida9b574f74fc948478f58ca96eb6ee72b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amount of grants made under the provisions of law described in subparagraph (B), the Secretary shall ensure that not less than $75,000,000 for each fiscal year is used for competitive research grants that support the development of public cultivars and animal breeds.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5fc551f1bf414701b6fa92f6c47764b1"><enum>(B)</enum><header>Provisions of law described</header><text>The provisions of law referred to in subparagraph (A) are—</text><clause id="id56bb7198af76422ebbf0ce0915d2f6ce"><enum>(i)</enum><text>subsections (b) and (c);</text></clause><clause id="idb7d1a04666d243848683178bd8e6447d"><enum>(ii)</enum><text>section 1672B(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925b">7 U.S.C. 5925b(e)</external-xref>);</text></clause><clause id="id05743b7f1d99477f8716cfb9654038d7"><enum>(iii)</enum><text>sections 1619 through 1624 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/5801">7 U.S.C. 5801 et seq.</external-xref>); </text></clause><clause id="idf2efda5872824dada2f5250040967da2"><enum>(iv)</enum><text>any relevant competitive grant program authorized by section 406 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7626">7 U.S.C. 7626</external-xref>), as determined by the Secretary; and</text></clause><clause id="id354bc5bf92e04424abba75c82d2d66aa"><enum>(v)</enum><text>section 412 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7632">7 U.S.C. 7632</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id1f9812ce0a4e4c9b8678fc386ba77cc9"><enum>(2)</enum><header>Priority</header><text>In making grants under paragraph (1), the Secretary shall give priority to high-potential research projects that lead to the release of public cultivars and animal breeds, including—</text><subparagraph id="idae167ba393e7442fa9572114ce9d9a2f"><enum>(A)</enum><text>regionally adapted public cultivars and animal breeds;</text></subparagraph><subparagraph id="id4181b2dd8a43415bbf1ea2881e4e3c63"><enum>(B)</enum><text>public cultivars and animal breeds bred for environmental resilience, including resilience to changing climates;</text></subparagraph><subparagraph id="idb7e9f186a73643a9915c2372d9f86f98"><enum>(C)</enum><text>public animal breeds adapted to grazing and overwintering as appropriate for the applicable production region;</text></subparagraph><subparagraph id="id5cd6963cd33541ef8f5465922836ed6c"><enum>(D)</enum><text>public cultivars and animal breeds bred to enhance the nutritional and health outcomes of local and Indigenous populations;</text></subparagraph><subparagraph id="id39233215512c4e29a24d707b8a42a0be"><enum>(E)</enum><text>public cultivars and animal breeds of Indigenous and place-based importance that are endangered; and</text></subparagraph><subparagraph id="id8497d90a67c14fee8c314a6be744e270"><enum>(F)</enum><text>public cultivars and animal breeds with beneficial and compatible characteristics and behaviors for dual-use renewable energy-agricultural systems.</text></subparagraph></paragraph><paragraph id="id325ef295d0e1403ea9cd8e5de32355bf"><enum>(3)</enum><header>Grants</header><text>The Secretary shall ensure that the terms and renewal process for any competitive grants made under subsection (b) in accordance with paragraph (1) facilitate the development and commercialization of public cultivars and animal breeds through long-term grants not less than 5 years in length.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12b452b5684d47ce97532e5ed8b8e14e"><enum>(4)</enum><header>Requirement for domestic production</header><text>No person that receives title to a plant patent or plant variety protection relating to any public cultivar or animal breed developed using funds received under this subsection, and no assignee of any such person, shall grant to any person the exclusive right to use or sell that public cultivar or animal breed unless that person agrees that any cultivars or animals embodying the public cultivar or animal breed or produced through the use of the public cultivar or animal breed will be produced substantially in the United States. </text></paragraph><paragraph id="id203f8a67f2924f35ab5abf6b6136331e"><enum>(5)</enum><header>Report</header><text>Not later than October 1 of each year, the Secretary shall submit to Congress a report that provides information on all public cultivar and animal breeding research funded by the Department of Agriculture, including—</text><subparagraph id="id681f760b54d84a68b54cf95064d74127"><enum>(A)</enum><text>a list of public cultivars and animal breeds developed and released in a commercially available form;</text></subparagraph><subparagraph id="idc28aca474377412e9e264e4e65a6c21f"><enum>(B)</enum><text>areas of high-priority research;</text></subparagraph><subparagraph id="idcec8d2252f6b47d4b3c3a90922749615"><enum>(C)</enum><text>identified research gaps relating to public cultivar and animal breed development; and</text></subparagraph><subparagraph id="id7411d060c49f4a8587aff2cfb9b3a283"><enum>(D)</enum><text>an assessment of the state of commercialization for public cultivars and animal breeds that have been developed.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id6aa223af6aa9432683b2cfd98bd3993b"><enum>3.</enum><header>Public cultivar and animal breed research coordination</header><subsection id="id75b1969caeee4de69a268d260ad121a6"><enum>(a)</enum><header>In general</header><text>Section 251 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6971">7 U.S.C. 6971</external-xref>) is amended—</text><paragraph id="id706465a2c5fd4d5d9b7a9e44e9cac412"><enum>(1)</enum><text>in subsection (e), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02f79dd5cdb74f9e924a13820c48eae1"><paragraph id="id97e8d49fc6c945f7870af355d3a533a4"><enum>(7)</enum><header>Public cultivar and animal breed research activities coordinator</header><subparagraph id="id8f8a9f9a92a947cd9177c90f6448c58c"><enum>(A)</enum><header>In general</header><text>The Under Secretary shall appoint a coordinator within the Research, Education, and Extension Office that reports to the Under Secretary to coordinate research activities at the Department relating to the breeding of public cultivars and animal breeds (as defined in paragraph (3) of section 2(a) of the Competitive, Special, and Facilities Research Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/3157">7 U.S.C. 3157(a)</external-xref>)).</text></subparagraph><subparagraph id="id7f6b92cb579f4c4295ccafb9f49d6db8"><enum>(B)</enum><header>Duties of coordinator</header><text>The coordinator appointed under subparagraph (A) shall—</text><clause id="ideb35b017844644be86bbe04461017c1a"><enum>(i)</enum><text>coordinate plant and animal breeding research activities funded by the Department relating to the development of public cultivars and animal breeds;</text></clause><clause id="id957ae4066b984fd3a8d31830c273391b"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id5a67b6e31228453799d60d8752540b90"><enum>(I)</enum><text>carry out ongoing analysis and track activities for any Federal research funding supporting plant and animal breeding (including any public cultivars and animal breeds developed with Federal funds); and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idc11c5f22139545438f01a87c128dd9da"><enum>(II)</enum><text>ensure that the analysis and activities are made available to the public not later than 60 days after the last day of each fiscal year;</text></subclause></clause><clause id="id4b14180c34fc4d459643e25f840d4052"><enum>(iii)</enum><text>develop a strategic plan that establishes targets for public cultivar and animal breed research investments across the Department to ensure that a diverse range of crop and animal needs are being met in a timely and transparent manner;</text></clause><clause id="idd1f69bc1825a4941b691d6eb83994c6b"><enum>(iv)</enum><text>convene a working group in order to carry out the coordination functions described in this subparagraph comprised of individuals who are responsible for the management, administration, or analysis of public cultivar and animal breeding programs within the Department from—</text><subclause id="idf0444f6754c548df9f2334e38bf89ca1"><enum>(I)</enum><text>the National Institute of Food and Agriculture;</text></subclause><subclause id="id43f22fe4201a4ba0940b5ac86cc4ec1b"><enum>(II)</enum><text>the Agricultural Research Service; and</text></subclause><subclause id="ida82460c66d2b45769821635bda59b473"><enum>(III)</enum><text>the Economic Research Service;</text></subclause></clause><clause id="id7b9b24fc80614376a0ded3242aa63e42"><enum>(v)</enum><text>in order to maximize delivery of public cultivars and animal breeds, promote collaboration among—</text><subclause id="iddddf1863d01f4726998ae06359527b45"><enum>(I)</enum><text>the coordinator;</text></subclause><subclause id="idcc436975353f4ab48d87fac4462361a7"><enum>(II)</enum><text>the working group convened under clause (iv);</text></subclause><subclause id="id9f5d366f6f0a4c489bd48960cf8be8ee"><enum>(III)</enum><text>the advisory council established under section 1634 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5843">7 U.S.C. 5843</external-xref>);</text></subclause><subclause id="idf4824e09fcda421bb8c756440551bedb"><enum>(IV)</enum><text>genetic resource conservation centers;</text></subclause><subclause id="idc44c2669c82a457996eb556714fbad8d"><enum>(V)</enum><text>land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>));</text></subclause><subclause id="ide6d9860b001f42baaba3e8cac2682c62"><enum>(VI)</enum><text>Hispanic-serving institutions (as defined in section 502(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>));</text></subclause><subclause id="id5939425c47a5401e9027a8bdc7094e64"><enum>(VII)</enum><text>Native American-serving nontribal institutions (as defined in section 371(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>));</text></subclause><subclause id="id6679e6f4f8724019ae11bf47761e9f3c"><enum>(VIII)</enum><text>nongovernmental organizations with interest or expertise in public breeding; and</text></subclause><subclause id="idb4001835f6fb41e686a6c33bedb624fe"><enum>(IX)</enum><text>public and private plant and animal breeders, including small-scale organic breeders;</text></subclause></clause><clause id="idc64eccefea6f46218533a40513f3d42c"><enum>(vi)</enum><text>convene regular stakeholder listening sessions to provide input on national and regional priorities for public cultivar and animal breeding research activities across the Department; and</text></clause><clause id="id0b4c39e7718249a3b5261136e7560f1d"><enum>(vii)</enum><text>evaluate and make recommendations to the Under Secretary on training and resource needs to meet future breeding challenges.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idc9b4334057554c16a9b502a095de7ef3"><enum>(2)</enum><text>in subsection (f)(1)(D)(i), by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/450i">7 U.S.C. 450i(b)</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/3157">7 U.S.C. 3157(b)</external-xref>)</quote>.</text></paragraph></subsection><subsection id="id87147c63ca504bf08066d5372e32c40c"><enum>(b)</enum><header>Conforming amendment</header><text>Section 296(b)(6)(B) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)(6)(B)</external-xref>) is amended by striking <quote>Scientist; and</quote> and inserting <quote>Scientist (including the public cultivar and animal breed research activities coordinator under subsection (e)(7) of that section); and</quote>. </text></subsection></section></legis-body></bill>
