which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Tariff Act of 1930 relating to de minimis treatment under that Act.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6759FCFF46A7424D8C3180BDDE4C16E7"><section commented="no" section-type="section-one" id="H582667C39D644A30B12C58BFC5AF029C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Import Security and Fairness Act</short-title></quote>. </text></section><section id="HAD35E55B3008433CB77219E3AA6357D2"><enum>2.</enum><header>Additional exceptions to exemptions for de minimis treatment under the Tariff Act of 1930</header><text display-inline="no-display-inline">Section 321 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1321">19 U.S.C. 1321</external-xref>) is amended—</text><paragraph id="H286FCDC16CBE4CF09FCA6F5A93F4E6CA"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H4549A6F45B4046E7A1CFB0E87F57E74E"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>(a) The Secretary</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—The Secretary</quote>;</text></subparagraph><subparagraph id="HD2934DE5BC0147D39CF42AC3896DCA75"><enum>(B)</enum><text>in paragraph (2)(C), by striking <quote>$800</quote> and inserting <quote>except as provided in subsection (b)(1), $800</quote>; and</text></subparagraph><subparagraph id="H85852D044E5248A08A3F851AF7FA3873"><enum>(C)</enum><text display-inline="yes-display-inline">in the matter following such paragraph (2)(C), as so amended, by striking <quote>subdivision (2)</quote> each place it appears and inserting <quote>paragraph</quote>; and</text></subparagraph></paragraph><paragraph id="H1BE64391EEEC46B7B79B7ABEC7B8583C"><enum>(2)</enum><text>by striking <quote>(b) The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H55B2D74B9B6645DEBAE7D188DCDBA00B"><subsection id="HA6736A4C545C49FCA2D27FFE6F8C97EC"><enum>(b)</enum><header>Exceptions</header><paragraph id="H2B345F88F20F48D89F7969FBA91BC37C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An article may not be admitted free of duty or tax under the authority provided by subsection (a)(2)(C) if the country of origin of such article, or the country from which such article is shipped, is—</text><subparagraph id="HA27AAB1CD870413594191FA0C7E529B6"><enum>(A)</enum><text>a nonmarket economy country (as such term is defined in section 771(18)); and</text></subparagraph><subparagraph id="H6C35B293DDC3499FA615F6D877B17013"><enum>(B)</enum><text>a country included in the priority watch list (as such term is defined in section 182(g)(3) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242(g)(3)</external-xref>)).</text></subparagraph></paragraph><paragraph id="HF001BCCC5E7B4261AEC25C73C39AA823"><enum>(2)</enum><header>Other exceptions</header><text>The Secretary</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6E0EB0B2C50946E3A8C5A29CA5155287"><enum>3.</enum><header>Additional administrative provisions relating to de minimis treatment under the Tariff Act of 1930</header><subsection id="HDA15942E52494BBAB39C99626D0E718F"><enum>(a)</enum><header>Administrative exemptions</header><text display-inline="yes-display-inline">Section 321 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1321">19 U.S.C. 1321</external-xref>), as amended by section 2, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H70F5C1AA38984B898081284B47060605"><subsection id="H6C2F097B2ECC453E8D460D513DF21E09"><enum>(c)</enum><header>Submission of documentation and information</header><paragraph id="H35064978C61E4176BCC53DD7A4485D83"><enum>(1)</enum><header>In general</header><text>For any articles that may qualify for an administrative exemption pursuant to subsection (a)(2), the Secretary of the Treasury shall, not later than 180 days after the date of the enactment of the <short-title>Import Security and Fairness Act</short-title>, prescribe regulations to require the submission, transmission, or otherwise making available of such documentation or information to U.S. Customs and Border Protection as the Secretary determines is reasonably necessary for U.S. Customs and Border Protection to determine the eligibility of such articles to qualify for such exemption.</text></paragraph><paragraph id="H70F2F9C6C3D84E2F96A395370EA06355"><enum>(2)</enum><header>Matters to be included</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbc6c076b74c64eb78dee9a5949c2a6dc"><enum>(A)</enum><text>shall require that documentation or information with respect to an article described in that paragraph include, at a minimum—</text><clause commented="no" display-inline="no-display-inline" id="id6856fcb672884cc8890ba57108b127fb"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the article; </text></clause><clause commented="no" display-inline="no-display-inline" id="id4b168554ed294d86a4d2e67b7e9fc02d"><enum>(ii)</enum><text display-inline="yes-display-inline">the appropriate classification of the article under the Harmonized Tariff Schedule of the United States; </text></clause><clause commented="no" display-inline="no-display-inline" id="idbb8ed42eb9644e2995cc41b6d47cc306"><enum>(iii)</enum><text display-inline="yes-display-inline">the country of origin of the article; </text></clause><clause commented="no" display-inline="no-display-inline" id="id40aba9a61f4e4284a3776c9827e9f41d"><enum>(iv)</enum><text display-inline="yes-display-inline">the country from which the article is shipped; </text></clause><clause commented="no" display-inline="no-display-inline" id="id5f4af1468ec44077951d48f3c6fb8bd8"><enum>(v)</enum><text display-inline="yes-display-inline">the identity of the shipper; </text></clause><clause commented="no" display-inline="no-display-inline" id="id69567a82763f4498a3af14da533c56bc"><enum>(vi)</enum><text display-inline="yes-display-inline">the identity of the importer; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5b3b1f0383b7431d9f62f67c124a4a09"><enum>(vii)</enum><text display-inline="yes-display-inline">the transaction value of the article in the United States; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide076a8df6411401d97a326e033c21ca3"><enum>(B)</enum><text display-inline="yes-display-inline">may provide that such documentation or information include other documentation or information regarding the offer for sale or purchase, or the subsequent sale, purchase, transportation, importation or warehousing of an article described in paragraph (1), including such documentation or information relating to the offering of the article for sale or purchase in the United States through a commercial or marketing platform, including an electronic commercial or marketing platform.</text></subparagraph></paragraph><paragraph id="HF45A8CA3F7A4419EA5056E96B8E19A36"><enum>(3)</enum><header>Veracity of documentation and information</header><subparagraph id="HB5F31C91AC464CFDA86C05104C025AA7"><enum>(A)</enum><header>In general</header><text>The regulations prescribed pursuant to paragraph (1) shall provide that—</text><clause id="H4CBE2AFD5FCB4143A8CCBDB98724FE93"><enum>(i)</enum><text>the documentation or information described in that paragraph is true and correct to the best of the knowledge and belief of the party submitting, transmitting, or otherwise making available such documentation or information, subject to any penalties authorized by law; or</text></clause><clause id="HAADC211D60914D4B8898AACB7972C78D"><enum>(ii)</enum><text> if such party is not able to reasonably verify whether such documentation or information is true and correct to the best of the knowledge and belief of the party, such documentation or information may be submitted, transmitted, or otherwise made available on the basis of what the party reasonably believes to be true and correct.</text></clause></subparagraph><subparagraph id="H4AC509C6734C4E2197E588B47B63A95F"><enum>(B)</enum><header>Use for any lawful purpose</header><text>Such documentation or information may be used by U.S. Customs and Border Protection for any lawful purpose.</text></subparagraph></paragraph><paragraph id="HAF680CB0010E480F9D0C26A7253FA779"><enum>(4)</enum><header>Civil penalties</header><text>Any person who violates the regulations prescribed pursuant to paragraph (1) is liable for a civil penalty of $5,000 for the first violation, and $10,000 for each subsequent violation. A penalty imposed under this paragraph is in addition to any other penalty provided by law.</text></paragraph></subsection><subsection id="HEAB596A891BC4805A9F2C5B2DD270487"><enum>(d)</enum><header>Importations involving suspended or debarred persons</header><text display-inline="yes-display-inline">The Secretary of the Treasury is authorized to prescribe regulations to authorize exceptions to any administrative exemption pursuant to subsection (a) for any articles the importation of which is caused or otherwise facilitated by any person suspended or debarred from doing business with the Federal Government at the time of the importation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6EB3EC7385DE4BB3A0566629395399CE"><enum>(b)</enum><header>Examination of merchandise</header><text>Section 499(c) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1499">19 U.S.C. 1499(c)</external-xref>) is amended—</text><paragraph id="H1BA5BCD8F5F446F0B79D7C1A78A5FD09"><enum>(1)</enum><text>by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>; and </text></paragraph><paragraph id="HCBCA7CAABA2A421D9BDE03E41CC5A694"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H1F884B56F2504DE79B6C82961864F5DB"><enum>(A)</enum><text>in the first sentence, by striking <quote>The Customs Service</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H24E0BE497601498F82551262514805AC"><subparagraph id="H74DCDF8954AC4B57BD066F32B52F1191"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB81AB532759449D28BA890CCC5B2F922"><enum>(B)</enum><text>in the second sentence—</text><clause id="H0FFA62A9708749B48A70457F1746830A"><enum>(i)</enum><text>by striking <quote>The</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H915F5A03EF934B9FB776747933CE2978"><subparagraph id="H7ED64D1EC44848EDAA295AF9481BBEC7"><enum>(B)</enum><header>Information to be included</header><text display-inline="yes-display-inline">The</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H13ACDAF714A84B83BF4FF6A1B1916DEA"><enum>(ii)</enum><text>by redesignating the subsequent subparagraphs (A), (B), (C), (D), and (E) as clauses (i), (ii), (iii), (iv), and (v), respectively, and moving such clauses, as redesignated, 2 ems to the right; and</text></clause></subparagraph><subparagraph id="H0CA3FE02324045A1BE609DB2510597FA"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6A0475B7E1C74B5CA5B88BF243328BC0"><subparagraph id="H95D59EB32FE44B7EB6479B403601BF6D"><enum>(C)</enum><header>Additional requirements relating to merchandise that may qualify for certain administrative exemptions</header><clause id="H8798A1A592F049C8A30940C4133AC539"><enum>(i)</enum><header>In general</header><text>In a case in which U.S. Customs and Border Protection has made a decision to detain merchandise that may qualify for an administrative exemption pursuant to section 321(a)(2)(C), U.S. Customs and Border Protection shall issue such notice to each party that U.S. Customs and Border Protections determines may have an interest in the detained merchandise, based on information reasonably available to U.S. Customs and Border Protection, in such form and manner as the Secretary of the Treasury shall by regulation prescribe. </text></clause><clause commented="no" id="HFC6FC5EFA2D6428BA914F624F259EA34"><enum>(ii)</enum><header>Voluntary abandonment of merchandise</header><text display-inline="yes-display-inline">In the case of merchandise described in clause (i), such notice shall also advise each such interested party that, in lieu of supplying information to U.S. Customs and Border Protection in accordance with subparagraph (B)(v), the interested parties may voluntarily abandon the merchandise. </text></clause><clause id="H6FAB1474EC8B4305A131FD8E6D1BF133"><enum>(iii)</enum><header>Abandonment or export due to lack of response</header><text display-inline="yes-display-inline">If U.S. Customs and Border Protection does not receive a response from each interested party in merchandise described in clause (i) within 30 days of the date on which such notice is issued to the interested parties, the merchandise may—</text><subclause id="id6f61a7cab43145309fa3a13ea55d3735"><enum>(I)</enum><text>be denied entry and be permitted to be exported, with the importer responsible for paying all expenses of exportation; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id61a64b5e9545416bba735b74f8ab50f5"><enum>(II)</enum><text display-inline="yes-display-inline">be deemed to be abandoned, in which case title to such merchandise shall be vested in the United States and the merchandise shall be disposed of in accordance with law.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="H7257114ECE904E558EEB1728E2CA1D3B"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to articles entered, or withdrawn from warehouse for consumption, on or after the 180th day after the date of the enactment of this Act.</text></section></legis-body></bill>
