which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certain flags of the United States to be made in the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H18C4BBC9D00749E3BC99DD6299B9A102"><section section-type="section-one" id="HAE663C974FFE4BF99C9CC6F497AD88CF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make American Flags in America Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="H4BA0E91051A147EDBE61CED247EA5454"><enum>2.</enum><header>Requirement for certain flags of United States to be made in United States</header><subsection id="HDD62E84C6C22485AA8CDB97C953BBD5D"><enum>(a)</enum><header>Requirement for certain flags of United States To be made in United States</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/4/1">Chapter 1</external-xref> of title 4, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H0658DB93DC9242EFB062EC90583CF307"><section id="HAFD9DD02577940F18828528FDFAFA344"><enum>11.</enum><header>Display on Federal property; procurement by Federal agencies</header><subsection id="H10DD543C2D4C46BBB51AB663ED8FB5E3"><enum>(a)</enum><header>Display on Federal property</header><text display-inline="yes-display-inline">A Federal agency may not display a flag of the United States on Federal property unless such flag has been made in the United States.</text></subsection><subsection id="H274A082F40094F1E9E3F04B6ABBD3D38"><enum>(b)</enum><header>Procurement by Federal agencies</header><text display-inline="yes-display-inline">Funds appropriated or otherwise made available to a Federal agency may not be used for the procurement of a flag of the United States unless such flag has been made in the United States.</text></subsection><subsection id="H7C771DD3686F4923A11A138CE672F50D"><enum>(c)</enum><header>International agreements</header><text display-inline="yes-display-inline">This section shall be applied in a manner consistent with the obligations of the United States under international agreements.</text></subsection><subsection id="HA2A3D5AF0FB74C0C825AA8B7AE01F404"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to apply to the display or procurement of a flag of the United States by a private actor.</text></subsection><subsection id="H5FDAD453566C4CE4AAD49C2F81E3622B"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="HC8794EB444D6483AA2B568F9CB35532B"><enum>(1)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> means—</text><subparagraph id="H9E1B0394C3924874BCB4665B0F7AD7E5"><enum>(A)</enum><text>an Executive agency;</text></subparagraph><subparagraph id="HE7D120D0C1AF4D0CB0064ED43A556FFD"><enum>(B)</enum><text>a military department;</text></subparagraph><subparagraph id="H0F0720A5934E4484A03335C483B3E352"><enum>(C)</enum><text>an office, agency, or other establishment in the legislative branch; </text></subparagraph><subparagraph id="H855E07A68838432990049B125066B066"><enum>(D)</enum><text>an office, agency, or other establishment in the judicial branch; </text></subparagraph><subparagraph id="H30913E158D174D66B140F6FF30910780"><enum>(E)</enum><text>the Government of the District of Columbia; and</text></subparagraph><subparagraph id="H72B2FFF6020747ACB96DDE9ACE8E49EF"><enum>(F)</enum><text>Government controlled corporations. </text></subparagraph></paragraph><paragraph commented="no" id="H73D87971FA6B4B5FABEA75B8A3D12B8E"><enum>(2)</enum><header>Federal property</header><text display-inline="yes-display-inline">The term <term>Federal property</term> means real property owned, leased, or occupied by a Federal agency or an instrumentality wholly owned by the United States.</text></paragraph><paragraph id="H1579DCA609F74013A88734E2BF1E1C74"><enum>(3)</enum><header>Made in the United States</header><text>The term <term>made in the United States</term> means 100 percent manufactured in the United States from articles, materials, or supplies that have been 100 percent produced or manufactured in the United States.</text></paragraph><paragraph commented="no" id="H3DFEB6E3B000411C92355A16526C69E1"><enum>(4)</enum><header>United States</header><text display-inline="yes-display-inline">The term <term>United States</term>, when used in a geographic sense, includes each of the several States, the District of Columbia, Tribal lands, and the territories or possessions of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H156196D4D459400AB8C2C30F74F8F919"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/4/1">chapter 1</external-xref> of title 4, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H410C8C59FDEC4E948EB5406BE7979B6F"><toc regeneration="no-regeneration"><toc-entry level="section">11. Display on Federal property; procurement by Federal agencies.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5926550F0AED4A949FA024F9B6A00FCF"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 11 of title 4, United States Code, as added by subsection (a), shall apply—</text><paragraph id="H5450939F53714E668A61579FD5BDF574"><enum>(1)</enum><text>with respect to the display of a flag of the United States by a Federal agency, on and after the date that is 2 years after the date of the enactment of this Act; and</text></paragraph><paragraph id="HA9AB34BFD54E4CE095AA4C210330D0F9"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the procurement of a flag of the United States by a Federal agency, on and after the date that is 90 days after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H3BD25042F16644BCB14229D69CA5B5A7"><enum>3.</enum><header>Study on country-of-origin labeling for flags of the United States</header><subsection id="HAFC33B58F0C245FA9945A5510A77D809"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Chair of the Federal Trade Commission shall conduct a study that—</text><paragraph id="H25929C9CF42644A6B95EF29873098781"><enum>(1)</enum><text>assesses and describes the enforcement scheme for country-of-origin labeling for flags of the United States;</text></paragraph><paragraph id="H939CB29AA8524F4E9B42D615E6B438CE"><enum>(2)</enum><text>determines how many fines or penalties, if any, have been imposed for violations of such enforcement scheme; and</text></paragraph><paragraph id="HE705F681933F424CB1C691658403E3B7"><enum>(3)</enum><text>identifies the percentage of violations of such enforcement scheme that are subsequent violations committed by an entity that has previously been found to have violated such scheme.</text></paragraph></subsection><subsection id="H1DAF71636E2C433E9D71CEF7F7655DBD"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Chair of the Federal Trade Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing—</text><paragraph id="H5FECDE64B59046C0891C5F068161B2CB"><enum>(1)</enum><text>the results of the study conducted under subsection (a); and</text></paragraph><paragraph id="H0C9385C7652B471AB974A802E661E378"><enum>(2)</enum><text>any recommendations to improve—</text><subparagraph id="HC8B2DB4B3D6541329C805FFDC0B6200F"><enum>(A)</enum><text>the enforcement scheme for country-of-origin labeling for flags of the United States; and</text></subparagraph><subparagraph id="H4AC50497DCB7491B85969820098AEF26"><enum>(B)</enum><text>the deterrent effect of such scheme.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
