which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Federal Aviation Administration to allow a volunteer pilot organization to reimburse a volunteer pilot for certain aircraft operating expenses incurred by the pilot when making a flight in support of the volunteer pilot organization’s mission, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Volunteer Pilot Support Act</short-title></quote>.</text></section><section id="id623faf4738d94e8784355292b44850a3"><enum>2.</enum><header>Reimbursement of certain operational costs for charitable flights</header><subsection id="id7afa48b3256d400085f359fc8e8f93d5"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall issue or revise regulations as necessary to allow a volunteer pilot to accept reimbursement for a covered operational cost if—</text><paragraph id="id255ccde7b56946eb8998f712bd0e7f72"><enum>(1)</enum><text>such pilot operates a covered flight; and</text></paragraph><paragraph id="id6c5a3c3843f2461c9a053b849e83df6e"><enum>(2)</enum><text>such pilot or volunteer pilot organization notifies each passenger that the flight is for charitable purposes and is not subject to the same safety requirements as a flight operated by an air carrier or a commercial operator certified by the Administrator.</text></paragraph></subsection><subsection id="id1677c4b081e048ccb299cac6ac253b3e"><enum>(b)</enum><header>Additional requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id178938ddba8e41118b1200b4e9c17e2f"><enum>(1)</enum><header>Volunteer pilot organization</header><text display-inline="yes-display-inline">A volunteer pilot organization may impose eligibility requirements that exceed the applicable eligibility requirements described in under subsection (f)(6)(B) and the general operating rules in part 91 of title 14, Code of Federal Regulations, without being considered an air carrier, a commercial operator, or common carrier.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0c189838733448cb66c4f775ce2b123"><enum>(2)</enum><header>Requirements for regulations</header><text>In issuing or revising regulations under subsection (a), the Administrator—</text><subparagraph id="id0e009275ad3149fda92d0dc050900bd1"><enum>(A)</enum><text>shall create an exception for a volunteer pilot organization that arranges a covered flight and a volunteer pilot who receives a covered operational cost for a covered flight from—</text><clause id="idf9621c9ad35d44cb9f528dc829cdb546"><enum>(i)</enum><text>the certificate requirements under parts 119 and 125 of title 14, Code of Federal Regulations; and</text></clause><clause id="ida2ffe56ab7a84c6d969895f6fb10979d"><enum>(ii)</enum><text>the operating requirements under parts 121, 125, and 135 of title 14, Code of Federal Regulations; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75a8d66ffd7d46a2974726fb005c645b"><enum>(B)</enum><text display-inline="yes-display-inline">may not impose on a volunteer pilot or volunteer pilot organization any operating requirements, aircraft qualifications, or pilot qualifications to conduct a covered flight that are in addition to the requirements under this section and the requirements under the general operating rules in part 91 of title 14, Code of Federal Regulations.</text></subparagraph></paragraph></subsection><subsection id="idebdd0fd341a14cfdb9a31d549ccf142d"><enum>(c)</enum><header>Effect on existing regulations</header><text>For the purposes of this section: </text><paragraph commented="no" display-inline="no-display-inline" id="id4dc4cb2b8d6d46c393b879f0d95f2be5"><enum>(1)</enum><text display-inline="yes-display-inline">A volunteer pilot receiving a covered operational cost for a covered flight—</text><subparagraph id="id6b11722e651e4e24bf0194de948bb01d"><enum>(A)</enum><text>does not constitute common carriage (as such term is used in title 49, United States Code, and title 14, Code of Federal Regulations); and</text></subparagraph><subparagraph id="iddd8180f548ab43fc96d2adbecb2e87fc"><enum>(B)</enum><text>does not constitute a flight operation for compensation or hire (as such term is used in title 49, United States Code, and title 14, Code of Federal Regulations).</text></subparagraph></paragraph><paragraph id="idac517844754c4d84b84770587d471896"><enum>(2)</enum><text>A covered operational cost is not compensation (as such term is used in title 49, United States Code, and title 14, Code of Federal Regulations). </text></paragraph></subsection><subsection id="idead8cdfe1c414a078d4808be02da0f6d"><enum>(d)</enum><header>Prohibition on FAA enforcement actions</header><text>Beginning on the date that is 1 year after the date of enactment of this Act, the Administrator may not take an enforcement action against a volunteer pilot or a volunteer pilot organization if such pilot meets, through a good faith effort, the applicable eligibility requirements described in subsections (a)(2) and (f)(6)(B), unless the Administrator has published final regulations in the Federal Register as required by subsection (a). </text></subsection><subsection id="id88f76bf1aee740a197a5376832df2286"><enum>(e)</enum><header>Effect on other FAA authority</header><paragraph id="iddbb04cdd9c8549d5b3e03f8407d7bdff"><enum>(1)</enum><header>Effect on existing exemption authority</header><text>Except as provided in paragraph (2), nothing in this section shall—</text><subparagraph id="id75153fb9132b4936acfceb294bcfd4c3"><enum>(A)</enum><text>affect the authority of the Administrator to exempt a pilot (exercising the privilege of a private pilot certificate issued under part 61 of title 14, Code of Federal Regulations) from a restriction on receiving reimbursement; or </text></subparagraph><subparagraph id="id10a04f5f1c7c4d168ad1b3441ff68e27"><enum>(B)</enum><text>affect any such exemptions existing before the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id7f9892068d08413d93505413209510d6"><enum>(2)</enum><header>No changes to existing FAA exemptions; exception</header><subparagraph id="id20fade5e73ae4aa08ebf9b7c51c12626"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Administrator may not modify or revoke a covered exemption during the period described in subparagraph (D) without the consent of the person holding the covered exemption.</text></subparagraph><subparagraph id="id27d6b258628b43408bc2d343bb6c8ab5"><enum>(B)</enum><header>Expiration date</header><text>The expiration date of a covered exemption shall be extended through the date that is 30 days after the end of the period described in subparagraph (D).</text></subparagraph><subparagraph id="ideb26fed96c76495db145a02e1b93e605"><enum>(C)</enum><header>Exception</header><text>The Administrator may modify or revoke a covered exemption after the Administrator brings an administrative or legal enforcement action against a person operating a flight under such exemption for—</text><clause id="id3d8bc2ff290b416182d24659326e371a"><enum>(i)</enum><text>violating the terms of such exemption; or</text></clause><clause id="id58d2bb8ee48b424fb18e64edccb6312d"><enum>(ii)</enum><text>in the course of a flight operating under such exemption, violating any other law or regulation.</text></clause></subparagraph><subparagraph id="idcfc3bfc3c9ec4ff09ac477146accbe8f"><enum>(D)</enum><header>Period described</header><text>The period described in this subparagraph is the period beginning on the date of enactment of this Act and ending on the date the Administrator publishes final regulations in the Federal Register as required by subsection (a).</text></subparagraph><subparagraph id="id0fc9b1fdcfbb45f7a7ae7be70ff8730b"><enum>(E)</enum><header>Covered exemption defined</header><text>In this paragraph, the term <term>covered exemption</term> means an exemption issued before the date of enactment of this Act by the Administrator to a volunteer pilot organization that provides an exemption from the applicability of section 61.113(c) of title 14, Code of Federal Regulations, and expressly includes an exemption described on page 12233 of volume 78 of the Federal Register and published on February 22, 2013. </text></subparagraph></paragraph><paragraph id="idf08e9df98c584db29773c646160c9a71"><enum>(3)</enum><header>Effect on other volunteer flights</header><text>Nothing in this section shall impose or authorize the imposition of any additional requirements on a flight that is arranged by a volunteer pilot organization in which the pilot in command is not reimbursed or the pilot in command pays a pro rata share of expenses as described under section 61.113(c) of title 14, Code of Federal Regulations. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id84ad390709da4627844ad8a7b74b38b4"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id36C77AEAD86C435995ECBEAE91DCE46B"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Aviation Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7bb76091669e45d7a9e6546380b649c6"><enum>(2)</enum><header>Air carrier; aircraft; airport</header><text>The terms <term>air carrier</term>, <term>aircraft</term>, and <term>airport</term> have the meanings given those terms in section 40102 of title 49, United States Code.</text></paragraph><paragraph id="id20A2BF0F060C4BB58624A142E8921D87"><enum>(3)</enum><header>Commercial operator</header><text>The term <term>commercial operator</term> has the meaning given such term in section 1.1 of title 14, Code of Federal Regulations.</text></paragraph><paragraph id="idB81BDA099937483994B3885B27DECE69"><enum>(4)</enum><header>Covered flight</header><text>The term <term>covered flight</term>—</text><subparagraph id="id2A8A864405504A5099646E41D5F4E746"><enum>(A)</enum><text>means a flight that is operated by a volunteer pilot in any airworthy aircraft in support of the mission of a volunteer pilot organization; and </text></subparagraph><subparagraph id="idADF2751B24B240F18ED8F33940091B96"><enum>(B)</enum><text>includes any flight or flight segment that is between the airport in which the aircraft for the covered flight is based and the airport the passengers of a flight described in subparagraph (A) board or disembark.</text></subparagraph></paragraph><paragraph id="idE231C8E52D874805BC97095BB2BD0C0C"><enum>(5)</enum><header>Covered operational cost</header><text>The term <term>covered operational cost</term> means the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id7d4a6dbcaeab4eedaa821c02b3becfca"><enum>(A)</enum><text display-inline="yes-display-inline">A cost that is actually incurred in connection with a covered flight, including the following:</text><clause id="id2CCD032BBD92478DAB0B82F25E34A400"><enum>(i)</enum><text>In the case of a volunteer pilot who rents the aircraft used for a covered flight, the cost of rental fees and other operating expenses not included in the rental fees that are incurred by such pilot for a covered flight, except that such costs may not unreasonably exceed the cost of owning and operating the aircraft, which includes maintenance costs, storage fees, airport expenditures, and, for an owner that is in the business of renting aircraft, the cost of doing business and making a reasonable profit.</text></clause><clause id="id9E44015D990B400491914F7922AE1124"><enum>(ii)</enum><text>In the case of a volunteer pilot who does not rent the aircraft used for a covered flight, the cost of fuel, oil, and airport expenditures incurred by such pilot for a covered flight.</text></clause><clause id="id8d40acc2c9ef49a0b2f929c770d0003f"><enum>(iii)</enum><text>Meals, lodging, and related expenses.</text></clause></subparagraph><subparagraph id="id4473450a374f4a5da8b4c9283d2b2672"><enum>(B)</enum><text>Any nonmonetary benefit that may be considered compensation (as such term is used in title 49, United States Code, and title 14, Code of Federal Regulations), including logged flight hours, goodwill, any applicable tax deduction permitted under the Internal Revenue Code of 1986, and any other indirect economic benefit.</text></subparagraph></paragraph><paragraph id="idA8F6A6FBD8E6418CA4689BABC8DE7555"><enum>(6)</enum><header>Volunteer pilot</header><subparagraph commented="no" display-inline="no-display-inline" id="id1b6972433c0c4d5a885fc452be354519"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>volunteer pilot</term> means a person who—</text><clause commented="no" display-inline="no-display-inline" id="idbc6db2f2018640c98e74f54946207713"><enum>(i)</enum><text display-inline="yes-display-inline">acts as pilot in command of a covered flight; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5a5dd288979f4f05b7911eeb8a37ace4"><enum>(ii)</enum><text>meets each applicable eligibility requirement described in subparagraph (B).</text></clause></subparagraph><subparagraph id="idB829D818D72B446D8E746AEC4A63483E"><enum>(B)</enum><header>Eligibility requirements described</header><text>The applicable eligibility requirements described in this subparagraph are the following:</text><clause id="id1DD0F3297A774CDDA4D2629094E9FB26"><enum>(i)</enum><text>The volunteer pilot holds at least a private pilot certificate with appropriate category, class, and type rating (if a type rating is applicable) issued under part 61 of title 14, Code of Federal Regulations.</text></clause><clause id="id82A7AFB690B84C689762F7A0D18DF568"><enum>(ii)</enum><text>The volunteer pilot holds an instrument rating or airline transport pilot certificate for the category of aircraft used for a covered flight issued under such part 61.</text></clause><clause id="id8D2A7E0B504145D0A2BA8960B63D96A7"><enum>(iii)</enum><text>The volunteer pilot logged at least 500 hours as pilot in command in the category of aircraft used for a covered flight.</text></clause><clause id="id2bb2122286f649e9a91c876c69a65b40"><enum>(iv)</enum><text>The volunteer pilot—</text><subclause id="id553923ab46624af392a133f6fe794246"><enum>(I)</enum><text>holds a valid medical certificate issued under part 67 of title 14, Code of Federal Regulations; or</text></subclause><subclause id="ide8983fed99ea459a9ada8c45b56a451f"><enum>(II)</enum><text>complies with the requirements of section 61.113(i) of title 14, Code of Federal Regulations. </text></subclause></clause></subparagraph></paragraph><paragraph id="idF1A776EB29D7478CAF39271B1003719D"><enum>(7)</enum><header>Volunteer pilot organization</header><text>The term <term>volunteer pilot organization</term> means an organization that—</text><subparagraph id="id87F2FDE12A4448E3AFC7879A2E348D64"><enum>(A)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>) and is exempt from taxation under section 501(a) of such Code; and</text></subparagraph><subparagraph id="id9C67BB4E4E974E27941890F1311542CA" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>arranges or coordinates flights by volunteer pilots for purposes described in such section 501(c)(3).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
