Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the settlement of the water rights claims of the Fort Belknap Indian Community, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fort Belknap Indian Community Water Rights Settlement Act of 2023</short-title></quote>.</text></section><section id="id4ac06dbe973f41db965bcb9eac29c704"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id0bae4599ec0241aea44a3e6f6e098caf"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of claims to water rights in the State of Montana for—</text><subparagraph id="id10ba44b43e4449eea32e7e682366fcf1"><enum>(A)</enum><text>the Fort Belknap Indian Community of the Fort Belknap Reservation of Montana; and</text></subparagraph><subparagraph id="id5d625b8e24d645e3a886e84285c6952c"><enum>(B)</enum><text>the United States, acting as trustee for the Fort Belknap Indian Community and allottees;</text></subparagraph></paragraph><paragraph id="id33eeec43367f4cdf95b610b6107a9d92"><enum>(2)</enum><text>to authorize, ratify, and confirm the water rights compact entered into by the Fort Belknap Indian Community and the State, to the extent that the Compact is consistent with this Act;</text></paragraph><paragraph id="id5cfd6cbd2f184df8ad628e7fa1432e29"><enum>(3)</enum><text>to authorize and direct the Secretary—</text><subparagraph id="idd7035f77d6994e72aac34c889006ec98"><enum>(A)</enum><text>to execute the Compact; and</text></subparagraph><subparagraph id="idbb290d64499040dc8207b66b2ce3a82a"><enum>(B)</enum><text>to take any other actions necessary to carry out the Compact in accordance with this Act;</text></subparagraph></paragraph><paragraph id="idc0091621456f4a79b36952df02871f7d"><enum>(4)</enum><text>to authorize funds necessary for the implementation of the Compact and this Act; and</text></paragraph><paragraph id="id9174f9e3d7c7482baff98fb9d1972333"><enum>(5)</enum><text>to authorize the exchange and transfer of certain Federal and State land.</text></paragraph></section><section id="idc5fe76e20ac247b8b3bf7a4e5f1dfcb6"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idef1d20d001b44f95b1c1c0eedd7f352f"><enum>(1)</enum><header>Allottee</header><text>The term <term>allottee</term> means an individual who holds a beneficial real property interest in an allotment of Indian land that is—</text><subparagraph id="id5c4ed872ae9b4785803f56768ea46ae1"><enum>(A)</enum><text>located within the Reservation; and</text></subparagraph><subparagraph id="idb487ef6c81634dc6b8132d23364d084a"><enum>(B)</enum><text>held in trust by the United States.</text></subparagraph></paragraph><paragraph id="id49844a7440654afa88da52e34927645a"><enum>(2)</enum><header>Blackfeet tribe</header><text>The term <term>Blackfeet Tribe</term> means the Blackfeet Tribe of the Blackfeet Indian Reservation of Montana.</text></paragraph><paragraph id="idb0f7a3f827ee42cf9d4664454c9d4433"><enum>(3)</enum><header>Cercla</header><text>The term <term>CERCLA</term> means the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>). </text></paragraph><paragraph id="id82087a74a086460783ff4763517ded74"><enum>(4)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Reclamation.</text></paragraph><paragraph id="idc3f2120affaa4ef195f18259a3fe091b"><enum>(5)</enum><header>Compact</header><text>The term <term>Compact</term> means—</text><subparagraph id="id1b06336d8b7840daa6638f53fdc5d950"><enum>(A)</enum><text>the Fort Belknap-Montana water rights compact dated April 16, 2001, as contained in section 85–20–1001 of the Montana Code Annotated (2021); and</text></subparagraph><subparagraph id="id7ed8de1060fd468985bb537397a68bc3"><enum>(B)</enum><text>any appendix (including appendix amendments), part, or amendment to the Compact that is executed to make the Compact consistent with this Act.</text></subparagraph></paragraph><paragraph id="id187e207298aa40749b0a60534efdc357"><enum>(6)</enum><header>Enforceability date</header><text>The term <term>enforceability date</term> means the date described in section 11(f).</text></paragraph><paragraph id="idf92927df26de49dbb9472208aad486f5"><enum>(7)</enum><header>Fort belknap indian community</header><text>The term <term>Fort Belknap Indian Community</term> means the Gros Ventre and Assiniboine Tribes of the Fort Belknap Reservation of Montana, a federally recognized Indian Tribal entity included on the list published by the Secretary pursuant to section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text></paragraph><paragraph id="id3a61426c7747459189a9d96bf255cf2c"><enum>(8)</enum><header>Fort belknap indian community council</header><text>The term <term>Fort Belknap Indian Community Council</term> means the governing body of the Fort Belknap Indian Community.</text></paragraph><paragraph id="ida7772b1013754cd69a251d24d83e958b"><enum>(9)</enum><header>Fort belknap indian irrigation project</header><subparagraph id="idcf7edbed99f34335bf2bdf73d2e778c2"><enum>(A)</enum><header>In general</header><text>The term <term>Fort Belknap Indian Irrigation Project</term> means the Federal Indian irrigation project constructed and operated by the Bureau of Indian Affairs, consisting of the Milk River unit, including—</text><clause commented="no" display-inline="no-display-inline" id="idf07843643cde4ea4b4fe89669498b675"><enum>(i)</enum><text display-inline="yes-display-inline">the Three Mile unit; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4d9f8b9079b045bc82927034a0962c8f"><enum>(ii)</enum><text>the White Bear unit.</text></clause></subparagraph><subparagraph id="id2acbe2578376486b9acac8c2b2aaf6ae"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Fort Belknap Indian Irrigation Project</term> includes any addition to the Fort Belknap Indian Irrigation Project constructed pursuant to this Act, including expansion of the Fort Belknap Indian Irrigation Project, the Pumping Plant, delivery Pipe and Canal, the Fort Belknap Reservoir and Dam, and the Peoples Creek Flood Project.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id797cc4657c4e49b2abce7cb61ae954af"><enum>(10)</enum><header>Implementation Fund</header><text>The term <term>Implementation Fund</term> means the Fort Belknap Indian Community Water Settlement Implementation Fund established by section 13(a).</text></paragraph><paragraph id="id3618f252fc634e358b54253fa5582391"><enum>(11)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id4b10b304badf41afa3d0b4f9f43650c8"><enum>(12)</enum><header>Lake elwell</header><text>The term <term>Lake Elwell</term> means the water impounded on the Marias River in the State by Tiber Dam, a feature of the Lower Marias Unit of the Pick-Sloan Missouri River Basin Program authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665).<italic></italic></text></paragraph><paragraph id="id28ca1fcbed3b40bdaaec4c495bb0a58f"><enum>(13)</enum><header>Malta irrigation district</header><text>The term <term>Malta Irrigation District</term> means the public corporation—</text><subparagraph id="idd1f21b08e29d4ca9aeaa3c065ae70785"><enum>(A)</enum><text>created on December 28, 1923, pursuant to the laws of the State relating to irrigation districts; and</text></subparagraph><subparagraph id="id81ffc1c62488469d91c59faa41281cbf"><enum>(B)</enum><text>headquartered in Malta, Montana.</text></subparagraph></paragraph><paragraph id="ide7b3b30bfdd8421eb8fd091ea90bae4f"><enum>(14)</enum><header>Milk river</header><text>The term <term>Milk River</term> means the mainstem of the Milk River and each tributary of the Milk River between the headwaters of the Milk River and the confluence of the Milk River with the Missouri River, consisting of—</text><subparagraph id="id7e45bb54f3244df78545edcf9e552f1a"><enum>(A)</enum><text>Montana Water Court Basins 40F, 40G, 40H, 40I, 40J, 40K, 40L, 40M, 40N, and 40O; and</text></subparagraph><subparagraph id="id6f94568bd83d42559377de9b67693cfa"><enum>(B)</enum><text>the portion of the Milk River and each tributary of the Milk River that flows through the Canadian Provinces of Alberta and Saskatchewan.</text></subparagraph></paragraph><paragraph id="id9c756b3f4829446a9ee8d0ca1c3d5681"><enum>(15)</enum><header>Milk river project</header><subparagraph id="idb4d2030982394d3e876cc16f5e3dfa0d"><enum>(A)</enum><header>In general</header><text>The term <term>Milk River Project</term> means the Bureau of Reclamation project conditionally approved by the Secretary on March 14, 1903, pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093), commencing at Lake Sherburne Reservoir and providing water to a point approximately 6 miles east of Nashua, Montana.<italic></italic></text></subparagraph><subparagraph id="id0c172559261046589b035f9717abd21f"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Milk River Project</term> includes—</text><clause commented="no" display-inline="no-display-inline" id="ida4aaf94f812e4117b22cb2e1d99f4f88"><enum>(i)</enum><text display-inline="yes-display-inline">the St. Mary Unit;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd0200f366d39419181af44733d6250b2"><enum>(ii)</enum><text>the Fresno Dam and Reservoir; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd56e862871d04505b4bdc4ebe82f79d8"><enum>(iii)</enum><text>the Dodson pumping unit.</text></clause></subparagraph></paragraph><paragraph id="id926b14963da64ce3a62cef29b79ced7c"><enum>(16)</enum><header>Missouri river basin</header><text>The term <term>Missouri River Basin</term> means the hydrologic basin of the Missouri River, including tributaries.</text></paragraph><paragraph id="id84a43a87225641cbbf8ae95798fe9615" commented="no"><enum>(17)</enum><header>Operations and maintenance</header><text>The term <term>operations and maintenance</term> means the Bureau of Indian Affairs operations and maintenance activities related to costs described in section 171.500 of title 25, Code of Federal Regulations (or a successor regulation).</text></paragraph><paragraph id="idd7469f76a6a8412189204e8eede7d1fa"><enum>(18)</enum><header>Operations, maintenance, and replacement</header><text>The term <term>operations, maintenance, and replacement</term> means—</text><subparagraph id="idf3cc93bada854348b6ce1deb8377f22c"><enum>(A)</enum><text>any recurring or ongoing activity associated with the day-to-day operation of a project;</text></subparagraph><subparagraph id="id7356eea76e344578a3d606f071f732d0"><enum>(B)</enum><text>any activity relating to scheduled or unscheduled maintenance of a project; and</text></subparagraph><subparagraph id="id495795b9256b4b23a303c3488a9b19bc"><enum>(C)</enum><text>any activity relating to repairing, replacing, or rehabilitating a feature of a project.</text></subparagraph></paragraph><paragraph id="id7a6441c56fc442a68f28adf37f80801b"><enum>(19)</enum><header>Pick-sloan missouri river basin program</header><text>The term <term>Pick-Sloan Missouri River Basin Program</term> means the Pick-Sloan Missouri River Basin Program (authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665)).</text></paragraph><paragraph id="idcecf6665e73b47788f80bbc02995bfa0"><enum>(20)</enum><header>PMM</header><text>The term <term>PMM</term> means the Principal Meridian, Montana.</text></paragraph><paragraph id="id3558710ef2414a2abd20a6584b9d31b3"><enum>(21)</enum><header>Reservation</header><subparagraph id="id1eb79a2001594f698a51d86a04832587"><enum>(A)</enum><header>In general</header><text>The term <term>Reservation</term> means the area of the Fort Belknap Reservation in the State, as modified by this Act.</text></subparagraph><subparagraph id="id2831fb38e8574477a9194929ed973eab"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Reservation</term> includes—</text><clause id="id61cd586692834514977b60cea6122825"><enum>(i)</enum><text>all land and interests in land established by—</text><subclause id="id2ac24d371d974ce0920da05a05b20664"><enum>(I)</enum><text>the Agreement with the Gros Ventre and Assiniboine Tribes of the Fort Belknap Reservation, ratified by the Act of May 1, 1888 (25 Stat. 113, chapter 212), as modified by the Agreement with the Indians of the Fort Belknap Reservation of October 9, 1895 (ratified by the Act of June 10, 1896) (29 Stat. 350, chapter 398);</text></subclause><subclause id="id9ab144e450f24823a9775baabab587e6"><enum>(II)</enum><text>the Act of March 3, 1921 (41 Stat. 1355, chapter 135); and</text></subclause><subclause id="ide6d6d5d8a1db4dfd98c14ccb4ea32ebb"><enum>(III)</enum><text>Public Law 94–114 (<external-xref legal-doc="usc" parsable-cite="usc/25/5501">25 U.S.C. 5501 et seq.</external-xref>);</text></subclause></clause><clause id="id54a426e7bf9d4b6e815fa01bb3c5204a"><enum>(ii)</enum><text>the land known as the <quote>Hancock lands</quote> purchased by the Fort Belknap Indian Community pursuant to the Fort Belknap Indian Community Council Resolution No. 234–89 (October 2, 1989); and</text></clause><clause id="idd44bdab2643e459aba985d318d73a832"><enum>(iii)</enum><text>all land transferred to the United States to be held in trust for the benefit of the Fort Belknap Indian Community under section 6.</text></clause></subparagraph></paragraph><paragraph id="id90f1a64966f541178e402dd903981730"><enum>(22)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph><paragraph id="idc9f10b710ea14282b66c1f7218600d59"><enum>(23)</enum><header>St. mary unit</header><subparagraph id="id1196e0f67cb34587b04bca9808268653"><enum>(A)</enum><header>In general</header><text>The term <term>St. Mary Unit</term> means the St. Mary Storage Unit of the Milk River Project authorized by Congress on March 25, 1905.</text></subparagraph><subparagraph id="idcf543ddb54504205b3bcce872ab8985a"><enum>(B)</enum><header>Inclusions</header><text>The term <term>St. Mary Unit</term> includes—</text><clause id="id20233c1824534b909c9cdff76f18e270"><enum>(i)</enum><text>Sherburne Dam and Reservoir;</text></clause><clause id="id2779246dc590464d99e32b11d732ed18"><enum>(ii)</enum><text>Swift Current Creek Dike;</text></clause><clause id="id1681e6f6a70242148b3c595c62dff99d"><enum>(iii)</enum><text>Lower St. Mary Lake;</text></clause><clause id="id7050bdfa0baf456f833450e9972715fa"><enum>(iv)</enum><text>St. Mary Canal Diversion Dam; and</text></clause><clause id="idc81a42333d1843b797ce50713a07a71f"><enum>(v)</enum><text>St. Mary Canal and appurtenances.</text></clause></subparagraph></paragraph><paragraph id="id6a61eda9b8c64566a9aa0417c7d15f0e"><enum>(24)</enum><header>State</header><text>The term <term>State</term> means the State of Montana.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide23325858c74458aabe5f7d6d8809718"><enum>(25)</enum><header>Tribal water code</header><text>The term <term>Tribal water code</term> means the Tribal water code enacted by the Fort Belknap Indian Community pursuant to section 5(g).<italic></italic></text></paragraph><paragraph id="id8e38e8ffae87438e8c80c52bd500db20"><enum>(26)</enum><header>Tribal water rights</header><text>The term <term>Tribal water rights</term> means the water rights of the Fort Belknap Indian Community, as described in Article III of the Compact and this Act, including the allocation of water to the Fort Belknap Indian Community from Lake Elwell under section 7.</text></paragraph><paragraph id="id54c671b8977f47abb71fb310f362be31"><enum>(27)</enum><header>Trust fund</header><text>The term <term>Trust Fund</term> means the Aaniiih Nakoda Settlement Trust Fund established for the Fort Belknap Indian Community under section 12(a).</text></paragraph></section><section id="idfffb5ebf01c74ad19bf1c8732733a9b5"><enum>4.</enum><header>Ratification of compact</header><subsection id="idaa06fbb3742c44019fba4011af30b39c"><enum>(a)</enum><header>Ratification of compact</header><paragraph id="ideaad6a479e144298a34b3e27f1dfcf56"><enum>(1)</enum><header>In general</header><text>As modified by this Act, the Compact is authorized, ratified, and confirmed.</text></paragraph><paragraph id="idfc4394c91baf4d8d896981eee0a79509"><enum>(2)</enum><header>Amendments</header><text>Any amendment to the Compact is authorized, ratified, and confirmed to the extent that the amendment is executed to make the Compact consistent with this Act.</text></paragraph></subsection><subsection id="id479419449dba4675b14aa830787fd478"><enum>(b)</enum><header>Execution</header><paragraph id="idbb55728979864ecb8112f48fe3bf4cb0"><enum>(1)</enum><header>In general</header><text>To the extent that the Compact does not conflict with this Act, the Secretary shall execute the Compact, including all appendices to, or parts of, the Compact requiring the signature of the Secretary.</text></paragraph><paragraph id="id558761ebbac843b79ba02872f8e1e8ac"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act precludes the Secretary from approving any modification to an appendix to the Compact that is consistent with this Act, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="id54576c1a66284377a84106b6933e1057"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="idb07e2cc2509949d690fae76f565193a4"><enum>(1)</enum><header>In general</header><text>In implementing the Compact and this Act, the Secretary shall comply with all applicable provisions of—</text><subparagraph id="id50feaaa5cc3243e38d99ec164e739314"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="ide369c0dee52f484eb4becc85dd239db1"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="idd2d9226d3d014abb86a3ed3d7bd6a8e5"><enum>(C)</enum><text>other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="idb21b55805b164d6bb5f81d12801516ee"><enum>(2)</enum><header>Compliance</header><subparagraph id="id3842683870564da9bd8c2c14c24e812a"><enum>(A)</enum><header>In general</header><text>In implementing the Compact and this Act, the Fort Belknap Indian Community shall prepare any necessary environmental documents, consistent with all applicable provisions of—</text><clause id="idbad98b1b2c3e4a4bb6a624803c8ea875"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="id2c0480d6047541a5a0c955fdf56cf44b"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4231">42 U.S.C. 4231 et seq.</external-xref>), including the implementing regulations of that Act; and</text></clause><clause id="id272658cd0f0546709ffad3977078bc78"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="id61c027c04a9941538854bfba22a2acce"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="id74536308b9b241ec9b07e8e6b724eb87"><enum>(i)</enum><text>independently evaluate the documentation submitted under subparagraph (A); and</text></clause><clause id="id8c1bc4ab0c204460ba144d5b095c4471"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph></paragraph><paragraph id="id5f6d263ef421450da792a8dc0e338c37"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Compact by the Secretary under this section shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="id692187ab54b84f77898f938b25f1ad55"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance activities under this subsection shall be paid from funds deposited in the Trust Fund, subject to the condition that any costs associated with the performance of Federal approval or other review of such compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="id8ec33eb1516242a38c1ed76972796a6e"><enum>5.</enum><header>Tribal water rights</header><subsection id="id18bed4ac7c7247d7aa8d32455d4c34e3"><enum>(a)</enum><header>Confirmation of tribal water rights</header><paragraph id="id33341d923d624a89935870abbda407a0"><enum>(1)</enum><header>In general</header><text>The Tribal water rights are ratified, confirmed, and declared to be valid.</text></paragraph><paragraph id="idcd7a1786eb77483c904a7bbb4f3b8bf4"><enum>(2)</enum><header>Use</header><text>Any use of the Tribal water rights shall be subject to the terms and conditions of the Compact and this Act.</text></paragraph><paragraph id="id3c31cfc3573d45ed87fc0a59a8b87adf"><enum>(3)</enum><header>Conflict</header><text>In the event of a conflict between the Compact and this Act, this Act shall control.</text></paragraph></subsection><subsection id="id4656b15fd26442e98f6b55ef5a0af1eb"><enum>(b)</enum><header>Intent of congress</header><text>It is the intent of Congress to provide to each allottee benefits that are equivalent to, or exceed, the benefits the allottees possess on the day before the date of enactment of this Act, taking into consideration—</text><paragraph id="id9a54f9792e58427bad514698f8f31d09"><enum>(1)</enum><text>the potential risks, cost, and time delay associated with litigation that would be resolved by the Compact and this Act;</text></paragraph><paragraph id="id60cf342cbfe44502a93163229d2d3620"><enum>(2)</enum><text>the availability of funding under this Act and from other sources;</text></paragraph><paragraph id="idb3a3c571f654435b8b5ef891980a7879"><enum>(3)</enum><text>the availability of water from the Tribal water rights; and</text></paragraph><paragraph id="id2beb705ef97f4ca1a9e7f8e40e145388"><enum>(4)</enum><text>the applicability of section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), and this Act to protect the interests of allottees.</text></paragraph></subsection><subsection id="id66d72dfd82f847ebac3f76dc1c8409c0"><enum>(c)</enum><header>Trust status of tribal water rights</header><text>The Tribal water rights—</text><paragraph id="idb5b1585682754772a38885b19ec2aeb3"><enum>(1)</enum><text>shall be held in trust by the United States for the use and benefit of the Fort Belknap Indian Community and allottees in accordance with this Act; and</text></paragraph><paragraph id="idc1947b0ba5704c9b9e202260905a9ee7"><enum>(2)</enum><text>shall not be subject to loss through non-use, forfeiture, or abandonment.</text></paragraph></subsection><subsection id="id88efd0bfbad6497ea1a909e810a9dd05"><enum>(d)</enum><header>Allottees</header><paragraph id="id92ed56d4a7944ae48839d51a15fa4707"><enum>(1)</enum><header>Applicability of the act of february 8, 1887</header><text>The provisions of section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), relating to the use of water for irrigation purposes, shall apply to the Tribal water rights.</text></paragraph><paragraph id="ide1eacc129e9d4d87922cf93fe0a6f09d"><enum>(2)</enum><header>Entitlement to water</header><text>Any entitlement to water of an allottee under Federal law shall be satisfied from the Tribal water rights.</text></paragraph><paragraph id="id5a8693d6f82546ac807721ddfc531eb1"><enum>(3)</enum><header>Allocations</header><text>An allottee shall be entitled to a just and equitable allocation of water for irrigation purposes.</text></paragraph><paragraph id="id044d516b2e884e3fb5e7169c54629444"><enum>(4)</enum><header>Claims</header><subparagraph id="id2a46488b2d3744f2b2f7b8dabb551ee6"><enum>(A)</enum><header>Exhaustion of remedies</header><text>Before asserting any claim against the United States under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or any other applicable law, an allottee shall exhaust remedies available under the Tribal water code or other applicable Tribal law.</text></subparagraph><subparagraph id="idc48a18494ef94a01afd835416341f6ea"><enum>(B)</enum><header>Action for relief</header><text>After the exhaustion of all remedies available under the Tribal water code or other applicable Tribal law, an allottee may seek relief under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or other applicable law.</text></subparagraph></paragraph><paragraph id="ida150aea4058d4e58b174ca31ffb26ef2"><enum>(5)</enum><header>Authority of the secretary</header><text>The Secretary shall have the authority to protect the rights of allottees in accordance with this section.</text></paragraph></subsection><subsection id="id97b524d30522483ea772231b9819e49d"><enum>(e)</enum><header>Authority of the fort belknap indian community</header><paragraph id="idbed59889f0fb4bff9f9cd9065a1cdaa0"><enum>(1)</enum><header>In general</header><text>The Fort Belknap Indian Community shall have the authority to allocate, distribute, and lease the Tribal water rights for use on the Reservation in accordance with the Compact, this Act, and applicable Federal law.</text></paragraph><paragraph id="id569b875a49584eb3b3b213e1810b907d"><enum>(2)</enum><header>Off-reservation use</header><text>The Fort Belknap Indian Community may allocate, distribute, and lease the Tribal water rights for off-Reservation use in accordance with the Compact, this Act, and applicable Federal law—</text><subparagraph id="id3bc0e93ef7b648fbb7cae942b33b9133"><enum>(A)</enum><text>subject to the approval of the Secretary; or</text></subparagraph><subparagraph id="id5b4837bb3d9141c6915c816a013171b7"><enum>(B)</enum><text>pursuant to Tribal water leasing regulations consistent with the requirements of subsection (f).</text></subparagraph></paragraph><paragraph id="id91dc4fc6057341f0ba8736453a39b5e5"><enum>(3)</enum><header>Land leases by allottees</header><text>Notwithstanding paragraph (1), an allottee may lease any interest in land held by the allottee, together with any water right determined to be appurtenant to the interest in land, in accordance with the Tribal water code.</text></paragraph></subsection><subsection id="id119da8516414410c86000e35f59594b8"><enum>(f)</enum><header>Tribal water leasing regulations</header><paragraph id="id054cec7c485b4e0389934ca320533eab"><enum>(1)</enum><header>In general</header><text>At the discretion of the Fort Belknap Indian Community, any water lease of the Fort Belknap Indian Community of the Tribal water rights for use on or off the Reservation shall not require the approval of the Secretary if the lease—</text><subparagraph commented="no" display-inline="no-display-inline" id="idef20bce82ca94aecbfd15d6c21542419"><enum>(A)</enum><text display-inline="yes-display-inline">is executed under tribal regulations, approved by the Secretary under this subsection;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f4f54d299974986ac034667d1ac108a"><enum>(B)</enum><text>is in accordance with the Compact; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ee7f0704fcd416baf4d866a50f83747"><enum>(C)</enum><text>does not exceed a term of 100 years, except that a lease may include an option to renew for 1 additional term of not to exceed 100 years.</text></subparagraph></paragraph><paragraph id="idce68add804f24088856c3c657fadb778"><enum>(2)</enum><header>Authority of the secretary over tribal water leasing regulations</header><subparagraph id="id6bc035aec3f3441ca996bb56b84c63ef"><enum>(A)</enum><header>In general</header><text>The Secretary shall have the authority to approve or disapprove any Tribal water leasing regulations issued in accordance with paragraph (1).</text></subparagraph><subparagraph id="id77e60c2acd6c45248896973c113af27f"><enum>(B)</enum><header>Considerations for approval</header><text>The Secretary shall approve any Tribal water leasing regulations issued in accordance with paragraph (1) if the Tribal water leasing regulations—</text><clause id="id9e72a0fadc9441e589261b99715564e9"><enum>(i)</enum><text>provide for an environmental review process that includes—</text><subclause id="id37ddb88d49bd4187b23ea569a14281eb"><enum>(I)</enum><text>the identification and evaluation of any significant effects of the proposed action on the environment; and</text></subclause><subclause id="id2607992777e94cc6a97420ef3ae4f039"><enum>(II)</enum><text>a process for ensuring that—</text><item id="id99f5a056f5964b9381e62b3151b3834b"><enum>(aa)</enum><text>the public is informed of, and has a reasonable opportunity to comment on, any significant environmental impacts of the proposed action identified by the Fort Belknap Indian Community; and</text></item><item id="id349d2ee0f40247afbf94ea57db3b448c"><enum>(bb)</enum><text>the Fort Belknap Indian Community provides responses to relevant and substantive public comments on those impacts prior to its approval of a water lease; and</text></item></subclause></clause><clause id="id36c253b0f8dd4a90be1f5e2db350d7da"><enum>(ii)</enum><text>are consistent with this Act and the Compact.</text></clause></subparagraph></paragraph><paragraph id="idf13e3ed5e7a04e6498e188f4b3449612"><enum>(3)</enum><header>Review process</header><subparagraph id="id30122478b32c4bcfbc84ef985815a2ad"><enum>(A)</enum><header>In general</header><text>Not later than 120 days after the date on which Tribal water leasing regulations under paragraph (1) are submitted to the Secretary, the Secretary shall review and approve or disapprove the regulations.</text></subparagraph><subparagraph id="id42f03fcb876749f58a562cb2d6ea123a"><enum>(B)</enum><header>Written documentation</header><text>If the Secretary disapproves the Tribal water leasing regulations described in subparagraph (A), the Secretary shall include written documentation with the disapproval notification that describes the basis for this disapproval.</text></subparagraph><subparagraph id="id488cdfd38a2c467e97406015694e4789"><enum>(C)</enum><header>Extension</header><text>The deadline described in subparagraph (A) may be extended by the Secretary, after consultation with the Fort Belknap Indian Community.</text></subparagraph></paragraph><paragraph id="id92b517514d2f4230ae989d2f4ce22260"><enum>(4)</enum><header>Federal environmental review</header><text>Notwithstanding paragraphs (2) and (3), if the Fort Belknap Indian Community carries out a project or activity funded by a Federal agency, the Fort Belknap Indian Community—</text><subparagraph commented="no" display-inline="no-display-inline" id="idacae3c465d4d4a4987d7d1bb9698abd2"><enum>(A)</enum><text display-inline="yes-display-inline">shall have the authority to rely on the environmental review process of the applicable Federal agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33edae5e5ec949ae8561a6362d6b5212"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be required to carry out a tribal environmental review process under this subsection.</text></subparagraph></paragraph><paragraph id="idcd5795fb75f4464b8c36f3618ec4099f"><enum>(5)</enum><header>Documentation</header><text>If the Fort Belknap Indian Community issues a lease pursuant to Tribal water leasing regulations under paragraph (1), the Fort Belknap Indian Community shall provide the Secretary and the State a copy of the lease, including any amendments or renewals to the lease.</text></paragraph><paragraph id="iddd706f75412543abbc781a75a57b6398"><enum>(6)</enum><header>Limitation of liability</header><subparagraph id="id329babce4e624168b5f3b7c7237c87a8"><enum>(A)</enum><header>In general</header><text>The United States shall not be liable in any claim relating to the negotiation, execution, or approval of any lease or exchange agreement or storage agreement, including any claims relating to the terms included in such an agreement, made pursuant to Tribal water leasing regulations under paragraph (1).</text></subparagraph><subparagraph id="id08603d34bfda49f7b6bc022876ac0f70"><enum>(B)</enum><header>Obligations</header><text>The United States shall have no trust obligation or other obligation to monitor, administer, or account for—</text><clause id="id37be3ca15a634eac8ba6101fd9ca28ea"><enum>(i)</enum><text>any funds received by the Fort Belknap Indian Community as consideration under any lease or exchange agreement or storage agreement; or</text></clause><clause id="id510147efcaf94cc3bfbbe146297f1872"><enum>(ii)</enum><text>the expenditure of those funds.</text></clause></subparagraph></paragraph></subsection><subsection id="id123712da892f4ac7aac882026642678e"><enum>(g)</enum><header>Tribal water code</header><paragraph id="id29ca6c423e5e4784baee537138cb1626"><enum>(1)</enum><header>In general</header><text>Notwithstanding Article IV.A.2. of the Compact, not later than 4 years after the date on which the Fort Belknap Indian Community approves the Compact in accordance with section 11(f)(1), the Fort Belknap Indian Community shall enact a Tribal water code that provides for—</text><subparagraph id="idc2ec50e6b7654b11930b59187e271f14"><enum>(A)</enum><text>the management, regulation, and governance of all uses of the Tribal water rights in accordance with the Compact and this Act; and</text></subparagraph><subparagraph id="id20543dbc48fc4f239c9d3c128d4e9095"><enum>(B)</enum><text>the establishment by the Fort Belknap Indian Community of the conditions, permit requirements, and other requirements for the allocation, distribution, or use of the Tribal water rights in accordance with the Compact and this Act.</text></subparagraph></paragraph><paragraph id="ideb005c8ccb0e4c019ac37f90bd077117"><enum>(2)</enum><header>Inclusions</header><text>Subject to the approval of the Secretary, the Tribal water code shall provide—</text><subparagraph id="id21953af74da24f08a70b4c0f8365548a"><enum>(A)</enum><text>that use of water by allottees shall be satisfied with water from the Tribal water rights;</text></subparagraph><subparagraph id="id0236515702e64c2689faab43d86d5e45"><enum>(B)</enum><text>a process by which an allottee may request that the Fort Belknap Indian Community provide water for irrigation use in accordance with this Act, including the provision of water under any allottee lease under section 4 of the Act of June 25, 1910 (36 Stat. 856, chapter 431; <external-xref legal-doc="usc" parsable-cite="usc/25/403">25 U.S.C. 403</external-xref>);</text></subparagraph><subparagraph id="idc2b4a7c7e01445cfa082363cdb0914b4"><enum>(C)</enum><text>a due process system for the consideration and determination by the Fort Belknap Indian Community of any request of an allottee (or a successor in interest to an allottee) for an allocation of water for irrigation purposes on allotted land, including a process for—</text><clause id="id476347d1b528463a926ebbed090ff87d"><enum>(i)</enum><text>appeal and adjudication of any denied or disputed distribution of water; and</text></clause><clause id="id10d94943511c4e50b4232dbd690545c9"><enum>(ii)</enum><text>resolution of any contested administrative decision;</text></clause></subparagraph><subparagraph id="idcc26b8c1438a42ed8cecebd1bbef6e47"><enum>(D)</enum><text>a requirement that any allottee asserting a claim relating to the enforcement of rights of the allottee under the Tribal water code, including to the quantity of water allocated to land of the allottee, shall exhaust all remedies available to the allottee under Tribal law before initiating an action against the United States or petitioning the Secretary pursuant to subsection (d)(4)(B);</text></subparagraph><subparagraph id="id6be68f4bef98493793dba4c2d682bc2d"><enum>(E)</enum><text>a process by which an owner of fee land within the boundaries of the Reservation may apply for use of a portion of the Tribal water rights; and</text></subparagraph><subparagraph id="id642802321a8d4e4db782f381c2c74c28"><enum>(F)</enum><text>a process for the establishment of a controlled Groundwater area and for the management of that area in cooperation with establishment of a contiguous controlled Groundwater area off the Reservation established pursuant to Section B.2. of Article IV of the Compact and State law. </text></subparagraph></paragraph><paragraph id="id735702ffa4e247f2aad7d4630d4fa965"><enum>(3)</enum><header>Action by secretary</header><subparagraph id="idea7d8bf1740a4394899fd4a52f5eed87"><enum>(A)</enum><header>In general</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which a Tribal water code described in paragraphs (1) and (2) is enacted, the Secretary shall administer, with respect to the rights of allottees, the Tribal water rights in accordance with the Compact and this Act.</text></subparagraph><subparagraph id="idfc952c5a9af9449393c29633c8b3aa2c"><enum>(B)</enum><header>Approval</header><text>The Tribal water code described in paragraphs (1) and (2) shall not be valid unless—</text><clause id="idb95d01ddcbc4400c96f6352406d4e3c2"><enum>(i)</enum><text>the provisions of the Tribal water code required by paragraph (2) are approved by the Secretary; and</text></clause><clause id="ide78009756833499092d57fac27c78336"><enum>(ii)</enum><text>each amendment to the Tribal water code that affects a right of an allottee is approved by the Secretary.</text></clause></subparagraph><subparagraph id="id1490324d169b4cbe895f868930b32cb3"><enum>(C)</enum><header>Approval period</header><clause id="idfc944580da41460d84de1bb5381f9ddf"><enum>(i)</enum><header>In general</header><text>The Secretary shall approve or disapprove the Tribal water code or an amendment to the Tribal water code by not later than 180 days after the date on which the Tribal water code or amendment to the Tribal water code is submitted to the Secretary.</text></clause><clause id="id0b265139e875441a866615f8f8490b0c"><enum>(ii)</enum><header>Extensions</header><text>The deadline described in clause (i) may be extended by the Secretary, after consultation with the Fort Belknap Indian Community.</text></clause></subparagraph></paragraph></subsection><subsection id="id776e8edb8ebe451da4e9b754b5d8965f"><enum>(h)</enum><header>Administration</header><paragraph id="id8a91d053375d45948ecc3a8c0cead4e8"><enum>(1)</enum><header>No alienation</header><text>The Fort Belknap Indian Community shall not permanently alienate any portion of the Tribal water rights.</text></paragraph><paragraph id="id8f7c85d2d47f47b397b7a34fea402bc4"><enum>(2)</enum><header>Purchases or grants of land from indians</header><text>An authorization provided by this Act for the allocation, distribution, leasing, or other arrangement entered into pursuant to this Act shall be considered to satisfy any requirement for authorization of the action required by Federal law.</text></paragraph><paragraph id="ida50cf49cdf9c40b8b055a53130911311"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Tribal water rights by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Tribal water rights.</text></paragraph></subsection><subsection id="id607eea87c8d541688c93a94f1be26672"><enum>(i)</enum><header>Effect</header><text>Except as otherwise expressly provided in this section, nothing in this Act—</text><paragraph id="id1389ef6e61ae4461834ffdedb2ec5472"><enum>(1)</enum><text>authorizes any action by an allottee against any individual or entity, or against the Fort Belknap Indian Community, under Federal, State, Tribal, or local law; or</text></paragraph><paragraph id="idd8e1215e0a3f4b7a9f8e1048d3efae8f"><enum>(2)</enum><text>alters or affects the status of any action brought pursuant to section 1491(a) of title 28, United States Code.</text></paragraph></subsection><subsection id="id5cc86aec957847a69a8c0db6f960606f"><enum>(j)</enum><header>Pick-Sloan missouri river basin program power rates</header><paragraph commented="no" display-inline="no-display-inline" id="id2617e56971cc48e29ba6d9e734ce3401"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary, in cooperation with the Secretary of Energy, shall make available the Pick-Sloan Missouri River Basin Program irrigation project pumping power rates to the Fort Belknap Indian Community, the Fort Belknap Indian Irrigation Project, and any projects funded under this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4dd41b9b38e405fb91913e9f8d01281"><enum>(2)</enum><header>Authorized purposes</header><text display-inline="yes-display-inline">The power rates made available under paragraph (1) shall be authorized for the purposes of wheeling, administration, and payment of irrigation project pumping power rates, including project use power for gravity power.</text></paragraph></subsection></section><section id="id4eacf020d9b94a6da86dabe5e4e5314d"><enum>6.</enum><header>Exchange and transfer of public land into trust</header><subsection id="id14e7e711bc0a4d1c953f4fb60f8d0fbf"><enum>(a)</enum><header>Exchange of federal and state land</header><paragraph commented="no" display-inline="no-display-inline" id="id7db4ca9f382b40289a686db1e865236d"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id760547a5109e480fb4674c3472b45bef"><enum>(A)</enum><header>Public land</header><text>The term <term>public land</term> means, as applicable—</text><clause commented="no" display-inline="no-display-inline" id="idd7dc4538707a4f8bbdff0cfe339f8a94"><enum>(i)</enum><text display-inline="yes-display-inline">public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); and</text></clause><clause id="idd841e1e9889e4365bff34af76058ee4a"><enum>(ii)</enum><text>land managed by the Secretary of Agriculture under the jurisdiction of the Forest Service.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf9415d9031bd4db780db38fe41b56851"><enum>(B)</enum><header>Secretary concerned</header><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means, as applicable—</text><clause commented="no" display-inline="no-display-inline" id="id59dfa63e556c4e8f9956c756f161467c"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary, with respect to the public land managed by the Department of the Interior; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc57adb68c6744e519d48b33324f53822"><enum>(ii)</enum><text>the Secretary of Agriculture, with respect to land managed by the Forest Service.</text></clause></subparagraph></paragraph><paragraph id="id0fbae255139e4a9a86c3ee01190c4eaa"><enum>(2)</enum><header>Negotiations authorized</header><subparagraph commented="no" display-inline="no-display-inline" id="id4c0792839f7c4b6a9d7fa32ecc33b54b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned shall offer to enter into negotiations with the State for the purpose of exchanging Federal land described in paragraph (4) for the State land described in paragraph (3). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25e503a618d447cf88eab18ef0b047c9"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">Any exchange of land made pursuant to this subsection shall be subject to the requirements of this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1b461cd56704c889671a79b7fd82c0f"><enum>(C)</enum><header>Priority</header><text>In carrying out this paragraph, the Secretary concerned shall, during the 5-year period beginning on the date of enactment of this Act, give priority to an exchange of public land located within the State for trust land owned by the State.</text></subparagraph></paragraph><paragraph id="id4c72c6bc1efc4cf49a111a95c9b65809"><enum>(3)</enum><header>State land</header><text>The Secretary concerned is authorized to accept the following parcels of land owned by the State located on and off of the Reservation:</text><subparagraph id="ideeacfd34b09c45b3ab86a4dfac55240d"><enum>(A)</enum><text>717.56 acres in T. 26 N., R. 22 E., sec. 16.</text></subparagraph><subparagraph id="id3323740ce95b402d8c6ca8cbdcba0be2"><enum>(B)</enum><text>707.04 acres in T. 27 N., R. 22 E., sec. 16.</text></subparagraph><subparagraph id="id3f02002ef9d34b798bb733b3fd0764b6"><enum>(C)</enum><text>640 acres in T. 27 N., R. 21 E., sec. 36.</text></subparagraph><subparagraph id="idc8688006bda940db97ab63d9b16d21d9"><enum>(D)</enum><text>640 acres in T. 26 N., R. 23 E., sec. 16.</text></subparagraph><subparagraph id="idd4ac8f9fd82f4db982660ff57ebfc23c"><enum>(E)</enum><text>640 acres in T. 26 N., R. 23 E., sec. 36.</text></subparagraph><subparagraph id="id4ffa3513debb4052acdb4768e2e5961b"><enum>(F)</enum><text>640 acres in T. 26 N., R. 26 E., sec. 16.</text></subparagraph><subparagraph id="idc4dc2de8ba864b0b9c86b2a7c6b61fad"><enum>(G)</enum><text>640 acres in T. 26 N., R. 22 E., sec. 36.</text></subparagraph><subparagraph authorized by this subsection, the Secretary shall, as soon as practicable after the enforceability date, take the land received by the United States pursuant to this subsection into trust for the benefit of the Fort Belknap Indian Community.</text></paragraph><paragraph id="id9cd54e98508a4f47861f8db64a43fdaa"><enum>(6)</enum><header>Terms and conditions</header><subparagraph id="id87ab40aceed54a1d8c22f0738cf0ef62"><enum>(A)</enum><header>Equal value</header><text>The values of the Federal land and State land exchanged under this subsection shall be equal, except that the Secretary concerned may—</text><clause id="id6d065fb125544e68856a8eea45b5f6a9"><enum>(i)</enum><text>exchange land that is of approximately equal value if such an exchange complies with the requirements of section 206(h) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(h)</external-xref>) (and any regulations implementing that section) without regard to the monetary limitation described in paragraph (1)(A) of that section; and</text></clause><clause id="id6833cb9373854dce97ae4a44448e94f6"><enum>(ii)</enum><text>make or accept an equalization payment, or waive an equalization payment, if such a payment or waiver of a payment complies with the requirements of section 206(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>) (and any regulations implementing that section).</text></clause></subparagraph><subparagraph id="id58204e49f3e74028a67d42aca13ca8ad"><enum>(B)</enum><header>Impacts on local governments</header><text>In selecting public land to offer to the State, the Secretary concerned may—</text><clause id="idd01c89429cbe463da4d3afb89e590bf2"><enum>(i)</enum><text>consider the financial impacts of exchanging specific Federal land on local governments; and</text></clause><clause id="id8153b9d838da44a28f5bfddad0a579cc"><enum>(ii)</enum><text>attempt to minimize the financial impact of the exchange on local governments.</text></clause></subparagraph><subparagraph id="id448444358f1a41d393a4a0ca214a6323"><enum>(C)</enum><header>Existing authorizations</header><clause id="id71b06f41d741445f902897d441cc2f9d"><enum>(i)</enum><header>Federal land transferred to the state</header><subclause commented="no" display-inline="no-display-inline" id="id2cf05c4ab66940c1b404e90cba083e56"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Any Federal land transferred to the State under this subsection shall be conveyed subject to any valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests an earlier termination in accordance with existing law. </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9031a401c18f462c9eb4de069d858cb8"><enum>(II)</enum><header>Assumption by State</header><text display-inline="yes-display-inline">The State shall assume all benefits and obligations of the Forest Service or the Bureau of Land Management, as applicable, under the existing rights, contracts, leases, permits, and rights-of-way described in subclause (I).</text></subclause></clause><clause id="id602db4b61e534ead9e0bf3b8a8f012dc"><enum>(ii)</enum><header>State land transferred to the united states</header><subclause commented="no" display-inline="no-display-inline" id="ide4822f35e57148ab803e3e9c7ac465ec"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Any State land transferred to the United States under this subsection shall be conveyed and taken into trust for the benefit of the Fort Belknap Indian Community subject to any valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests an earlier termination in accordance with existing law. </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4b5c9f4454c646f3833a5a07192f3746"><enum>(II)</enum><header>Assumption by BIA</header><text display-inline="yes-display-inline">The Bureau of Indian Affairs shall—</text><item commented="no" display-inline="no-display-inline" id="id36309d499b3d4c998df8a8f2210d6cb1"><enum>(aa)</enum><text display-inline="yes-display-inline">assume all benefits and obligations of the State under the existing rights, contracts, leases, permits, and rights-of-way described in subclause (I); and </text></item><item commented="no" display-inline="no-display-inline" id="id08947855c98942f1baeec3571c20cffe"><enum>(bb)</enum><text display-inline="yes-display-inline">disburse to the Fort Belknap Indian Community any amounts that accrue to the United States from those rights, contracts, leases, permits, and rights-of-way, after the date of transfer from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the benefit of the Fort Belknap Indian Community.</text></item></subclause></clause></subparagraph><subparagraph id="id2f3081cd0bfe4165986ddaedfeebe173"><enum>(D)</enum><header>Personal property</header><clause commented="no" display-inline="no-display-inline" id="ida22f8a6a09404f5ca2befcccfd6ef7b3"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any improvements constituting personal property, as defined by State law, belonging to the holder of a right, contract, lease, permit, or right-of-way on land transferred to the United States under this subsection shall—</text><subclause commented="no" display-inline="no-display-inline" id="ida21a73131f0e4a9eb4aa2eef380a6509"><enum>(I)</enum><text display-inline="yes-display-inline">remain the property of the holder; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id65978be924b947e7ad2fc9f6d165caf8"><enum>(II)</enum><text display-inline="yes-display-inline">be removed not later than 90 days after the date on which the right, contract, lease, permit, or right-of-way expires, unless the Fort Belknap Indian Community and the holder agree otherwise. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id35d00a668f514b85b7b13da323a7933b"><enum>(ii)</enum><header>Remaining property</header><text display-inline="yes-display-inline">Any personal property described in clause (i) remaining with the holder described in that clause beyond the 90-day period described in subclause (II) of that clause shall—</text><subclause commented="no" display-inline="no-display-inline" id="ide81c8c45779a4dc3820096e68111244d"><enum>(I)</enum><text display-inline="yes-display-inline">become the property of the Fort Belknap Indian Community; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id58372f2959f44d4f93bcefb837810941"><enum>(II)</enum><text display-inline="yes-display-inline">be subject to removal and disposition at the discretion of the Fort Belknap Indian Community. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6574929920634fb38bae9af501de8037"><enum>(iii)</enum><header>Liability of previous holder</header><text display-inline="yes-display-inline">The holder of personal property described in clause (i) shall be liable for costs incurred by the Fort Belknap Indian Community in removing and disposing of the personal property under clause (ii)(II).</text></clause></subparagraph></paragraph><paragraph id="id913e8f0c63214c75972847be161feb73"><enum>(7)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of land owned by the State under paragraph (3), the State may, with the consent of the Fort Belknap Indian Community, make technical corrections to the legal land descriptions to more specifically identify the State parcels to be exchanged.</text></paragraph><paragraph id="id7e85994644904e779b4124e5c2f771ad"><enum>(8)</enum><header>Assistance</header><text>The Secretary shall provide $10,000,000 of financial or other assistance to the State and the Fort Belknap Indian Community as may be necessary to obtain the appraisals, and to satisfy administrative requirements, necessary to accomplish the exchanges under paragraph (2).</text></paragraph></subsection><subsection id="id66b439e703d24e4f8e5e2e2a4981c5e9"><enum>(b)</enum><header>Federal land transfers</header><paragraph id="id8f7c77db3b134eabbd83d8e0d2e7500d"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and the requirements of this subsection, all right, title, and interest of the United States in and to the land described in paragraph (2) shall be held by the United States in trust for the benefit of the Fort Belknap Indian Community as part and</text></item></subclause><subclause id="id8b7061f322ad46dd8f3b95003d93a851" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text>40 acres in T. 31 N., R. 26 E., PMM, the NW<fraction>1/4</fraction> of the SE<fraction>1/4</fraction> of sec. 31.</text></subclause></clause></subparagraph><subparagraph id="id5cf7e6e3bcb74ab99cec4c1fe85a7e7b"><enum>(C)</enum><header>Foreclosed department of agriculture land</header><text>Any Department of Agriculture trust land within the Reservation that has been or is converted to fee land, judicially foreclosed on, and acquired by the United States.</text></subparagraph></paragraph><paragraph id="id77fed94751624b54b4458e98973a9395"><enum>(3)</enum><header>Terms and conditions</header><subparagraph id="ide8e8c87a7d584c2e980ee907066c0612"><enum>(A)</enum><header>Existing authorizations</header><clause commented="no" display-inline="no-display-inline" id="idd078c909712548e38c593a352f59e10d"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Federal land transferred under this subsection shall be conveyed and taken into trust subject to valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, and rights-of-way requests an earlier termination in accordance with existing law. </text></clause><clause commented="no" display-inline="no-display-inline" id="idbdbfe446b03149c0853e45436c6bfb69"><enum>(ii)</enum><header>Assumption by BIA</header><text display-inline="yes-display-inline">The Bureau of Indian Affairs shall—</text><subclause commented="no" display-inline="no-display-inline" id="id1db96902d3e245de816acaa07468dfc1"><enum>(I)</enum><text display-inline="yes-display-inline">assume all benefits and obligations of the previous land management agency under the existing rights, contracts, leases, permits, and rights-of-way described in clause (i); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9e5053c3316e43b09febebbc7de320a4"><enum>(II)</enum><text display-inline="yes-display-inline">disburse to the Fort Belknap Indian Community any amounts that accrue to the United States from those rights, contracts, leases, permits, and rights-of-ways after the date of transfer from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the Fort Belknap Indian Community.</text></subclause></clause></subparagraph><subparagraph id="idec63ff383cc6447d82ae6fa4d796e1e2"><enum>(B)</enum><header>Personal property</header><clause commented="no" display-inline="no-display-inline" id="idb6032a6660844002a8cca30723daaebd"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any improvements constituting personal property, as defined by State law, belonging to the holder of a right, contract, lease, permit, or right-of-way on land transferred under this subsection shall—</text><subclause commented="no" display-inline="no-display-inline" id="id30b7e2e3f41541ebab4c2adbfa9774b8"><enum>(I)</enum><text display-inline="yes-display-inline">remain the property of the holder; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3917136c1697494981c97b0deaa88a31"><enum>(II)</enum><text display-inline="yes-display-inline">be removed from the land not later than 90 days after the date on which the right, contract, lease, permit, or right-of-way expires, unless the Fort Belknap Indian Community and the holder agree otherwise. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbafcaaad7786484390d5f9d3619fe01d"><enum>(ii)</enum><header>Remaining property</header><text display-inline="yes-display-inline">Any personal property described in clause (i) remaining with the holder described in that clause beyond the 90-day period described in subclause (II) of that clause shall—</text><subclause commented="no" display-inline="no-display-inline" id="iddfb8a620d3224f56ae9d8b03d48a6c77"><enum>(I)</enum><text display-inline="yes-display-inline">become the property of the Fort Belknap Indian Community; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id04b5895e97ed42b693de67342c9c504a"><enum>(II)</enum><text display-inline="yes-display-inline">be subject to removal and disposition at the discretion of the Fort Belknap Indian Community. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7521BF7877694B41AD9C10BE4B8ED640"><enum>(iii)</enum><header>Liability of previous holder</header><text display-inline="yes-display-inline">The holder of personal property described in clause (i) shall be liable to the Fort Belknap Indian Community for costs incurred by the Fort Belknap Indian Community in removing and disposing of the property under clause (ii)(II). </text></clause></subparagraph><subparagraph id="ida5c2cc0c4c4f4fe6af8928e175716a54"><enum>(C)</enum><header>Existing roads</header><text>If any road within the Federal land transferred under this subsection is necessary for customary access to private land, the Bureau of Indian Affairs shall offer the owner of the private land to apply for a right-of-way along the existing road, at the expense of the landowner.</text></subparagraph><subparagraph id="id069d958d02884021834258cab6027ae6"><enum>(D)</enum><header>Limitation on the transfer of water rights</header><text>Water rights that transfer with the land described in paragraph (2) shall not become part of the Tribal water rights. </text></subparagraph></paragraph><paragraph id="id4ebeb546a1b84e3fa81feb49e59f662d"><enum>(4)</enum><header>Withdrawal of Federal land</header><subparagraph id="id52527ccf23eb43838ae4be8fccac9304"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights, effective on the date of enactment of this Act, all Federal land within the parcels described in paragraph (2) is withdrawn from all forms of—</text><clause id="idea95434c6da54b1f877a2780841d89bb"><enum>(i)</enum><text>entry, appropriation, or disposal under the public land laws;</text></clause><clause id="id24529f5f0aab4ed4ae044c343e25a685"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="id3bcd38dd8767473abd6af4374a406771"><enum>(iii)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></clause></subparagraph><subparagraph id="id0c372aaea6f34818bfa35d7cedfefb8a"><enum>(B)</enum><header>Expiration</header><text>The withdrawals pursuant to subparagraph (A) shall terminate on the date that the Secretary takes the land into trust for the benefit of the Fort Belknap Indian Community pursuant to paragraph (1).</text></subparagraph><subparagraph id="id2892c20e1d9e4b2caf85cbd2b964f84f"><enum>(C)</enum><header>No new reservation of Federal water rights</header><text>Nothing in this paragraph establishes a new reservation in favor of the United States or the Fort Belknap Indian Community with respect to any water or water right on the land withdrawn by paragraph (2).</text></subparagraph></paragraph><paragraph id="idedcb328f78b74131ae74be2750da7ae1"><enum>(5)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of Federal land in paragraph (2), the United States may, with the consent of the Fort Belknap Indian Community, make technical corrections to the legal land descriptions to more specifically identify the parcels.</text></paragraph><paragraph id="ideb17075050f64f5b8933f4f19564617c"><enum>(6)</enum><header>Survey</header><subparagraph id="id77a057d2d749495e90794a4e3be5d12d"><enum>(A)</enum><header>In general</header><text>Unless the United States or the Fort Belknap Indian Community request an additional survey for the transferred land or a technical correction is made under paragraph (5), the description of land under this subsection shall be controlling.</text></subparagraph><subparagraph id="id08987310bfa4427bb4e68560717c8702"><enum>(B)</enum><header>Additional survey</header><text>If the United States or the Fort Belknap Indian Community requests an additional survey, that survey shall control the total acreage to be transferred into trust under this subsection.</text></subparagraph><subparagraph id="idb6878973579a4648be7da2e05a0b2a1a"><enum>(C)</enum><header>Assistance</header><text>The Secretary shall provide such financial or other assistance as may be necessary—</text><clause id="id2611186f23c94807a622b132f831cb78"><enum>(i)</enum><text>to conduct additional surveys under this subsection; and</text></clause><clause id="id89758e7bbe1543e9bb20a01a1ae7866f"><enum>(ii)</enum><text>to satisfy administrative requirements necessary to accomplish the land transfers under this subsection.</text></clause></subparagraph></paragraph><paragraph id="idcee78726b8aa4f63b091270093c5fc1c"><enum>(7)</enum><header>Date of transfer</header><text>The Secretary shall complete all land transfers under this subsection and shall take the land into trust for the benefit of the Fort Belknap Indian Community as expeditiously as practicable after the enforceability date, but not later than 10 years after the enforceability date.</text></paragraph></subsection><subsection id="id75f8629e14e246a795064850d2c6a646"><enum>(c)</enum><header>Tribally owned fee land</header><text>Not later than 10 years after the enforceability date, the Secretary shall take into trust for the benefit of the Fort Belknap Indian Community all fee land owned by the Fort Belknap Indian Community on or adjacent to the Reservation to become part of the Reservation, provided that—</text><paragraph id="idca3835db27e94fa7b61bd64e21de59c3"><enum>(1)</enum><text>the land is free from any liens, encumbrances, or other infirmities; and</text></paragraph><paragraph id="id14d9f49b6d45499eb39d65cfe75f665a"><enum>(2)</enum><text>no evidence exists of any hazardous substances on, or other environmental liability with respect to, the land.</text></paragraph></subsection><subsection id="idf240955f50d64742b7f997b28b0c287d"><enum>(d)</enum><header>Dodson land</header><paragraph id="idb93cc2d5c0b44a3b9615a8a7a21e1eab"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), as soon as practicable after the enforceability date, but not later than 10 years after the enforceability date, the Dodson Land described in paragraph (3) shall be taken into trust by the United States for the benefit of the Fort Belknap Indian Community as part of the Reservation.</text></paragraph><paragraph id="id237ae97dc43041759dc990fa0393d546"><enum>(2)</enum><header>Restrictions</header><text>The land taken into trust under paragraph (1) shall be subject to a perpetual easement, reserved by the United States for use by the Bureau of Reclamation, its contractors, and its assigns for—</text><subparagraph id="id423bfa7186094e3783b6205550659148"><enum>(A)</enum><text>the right of ingress and egress for Milk River Project purposes; and</text></subparagraph><subparagraph id="idb72ea34e5d454092b1d4e7ab234f73e8"><enum>(B)</enum><text>the right to—</text><clause id="id1cc2792ebab8418f9409c57f84ae4c3c"><enum>(i)</enum><text>seep, flood, and overflow the transferred land for Milk River Project purposes;</text></clause><clause id="id320091a3c3a04fa4b6f208ea25a1998f"><enum>(ii)</enum><text>conduct routine and non-routine operation, maintenance, and replacement activities on the Milk River Project facilities, including modification to the headworks at the upstream end of the Dodson South Canal in support of Dodson South Canal enlargement, to include all associated access, construction, and material storage necessary to complete those activities; and</text></clause><clause id="idac12966dffb84ef5ac584d6e9c97fca6"><enum>(iii)</enum><text>prohibit the construction of permanent structures on the transferred land, except—</text><subclause commented="no" display-inline="no-display-inline" id="id40ce8994d6a44dc086214a60026155e5"><enum>(I)</enum><text display-inline="yes-display-inline">as provided in the cooperative agreement under paragraph (4); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7dad3fcf595f468f86ae27525ed8d1bb"><enum>(II)</enum><text display-inline="yes-display-inline">to meet the requirements of the Milk River Project.</text></subclause></clause></subparagraph></paragraph><paragraph id="ida819ed4df00b4721b6d30583d4b09d09"><enum>(3)</enum><header>Description of Dodson land</header><subparagraph id="id7895013411fa47fca25696dd3fffe548"><enum>(A)</enum><header>In general</header><text>The Dodson Land referred to in paragraphs (1) and (2) is the approximately 2,500 acres of land owned by the United States that is, as of the date of enactment of this Act, under the jurisdiction of the Bureau of Reclamation and located at the northeastern corner of the Reservation (which extends to the point in the middle of the main channel of the Milk River), where the Milk River Project facilities, including the Dodson Diversion Dam, headworks to the Dodson South Canal, and Dodson South Canal, are located, and more particularly described as follows:</text><clause id="id7c2b1109d8b34633b4375455b897b900"><enum>(i)</enum><text>Supplemental Plat of T. 30 N., R. 26 E., PMM, secs. 1 and 2.</text></clause><clause id="id4741cf1494b84213a9b66c6a83095c70"><enum>(ii)</enum><text>Supplemental Plat of T. 31 N., R. 25 E., PMM, sec. 13.</text></clause><clause id="id468aef5c39c44048964da5dff2dd54ee"><enum>(iii)</enum><text>Supplemental Plat of T. 31 N., R. 26 E., PMM, secs. 18, 19, 20, and 29.</text></clause><clause id="id7501dc46315245d7837b098e30914614"><enum>(iv)</enum><text>Supplemental Plat of T. 31 N., R. 26 E., PMM, secs. 26, 27, 35, and 36.</text></clause></subparagraph><subparagraph id="id946e6497cb564d16ba19a0ab92ca1900"><enum>(B)</enum><header>Clarification</header><text>The supplemental plats described in clauses (i) through (iv) of subparagraph (A) are official plats, as documented by retracement boundary surveys of the General Land Office, approved on March 11, 1938, and on record at the Bureau of Land Management.</text></subparagraph><subparagraph id="id358271cbeb0a48199350c1dade151c49"><enum>(C)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of Federal land in subparagraph (A), the United States may, with the consent of the Fort Belknap Indian Community, make technical corrections to the legal land descriptions to more specifically identify the parcels to be transferred.</text></subparagraph></paragraph><paragraph id="id7e5eff9a39044c7c92bdf06f66350e57"><enum>(4)</enum><header>Cooperative agreement</header><text>Not later than 3 years after the enforceability date, the Bureau of Reclamation, the Malta Irrigation District, the Bureau of Indian Affairs, and the Fort Belknap Indian Community shall negotiate and enter into a cooperative agreement that identifies the uses to which the Fort Belknap Indian Community may put the land described in paragraph (3), provided that the cooperative agreement may be amended by mutual agreement of the Fort Belknap Indian Community, Bureau of Reclamation, the Malta Irrigation District, and the Bureau of Indian Affairs, including to modify the perpetual easement to narrow the boundaries of the easement or to terminate the perpetual easement and cooperative agreement.</text></paragraph></subsection><subsection id="idcb7b97d8569d4463814849179d7a6554"><enum>(e)</enum><header>Land status</header><text>All land held in trust by the United States for the benefit of the Fort Belknap Indian Community under this section shall be—</text><paragraph id="id69b5dd94eb5f40928238d37f33cf50a5"><enum>(1)</enum><text>beneficially owned by the Fort Belknap Indian Community; and</text></paragraph><paragraph id="id8bcbac70c91a4786a89a7b1ee9f338dc"><enum>(2)</enum><text>part of the Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for the benefit of an Indian Tribe.</text></paragraph></subsection></section><section id="id24b18efb4c20451e85bcbe3e8429c34b"><enum>7.</enum><header>Storage allocation from Lake Elwell</header><subsection id="id8731a643d2dd4103abea0b0c3aebbd25"><enum>(a)</enum><header>Storage allocation of water to Fort Belknap Indian Community</header><text>The Secretary shall allocate to the Fort Belknap Indian Community 20,000 acre-feet per year of water stored in Lake Elwell for use by the Fort Belknap Indian Community for any beneficial purpose on or off the Reservation, under a water right held by the United States and managed by the Bureau of Reclamation for the benefit of the Fort Belknap Indian Community, as measured and diverted at the outlet works of the Tiber Dam or through direct pumping from Lake Elwell.</text></subsection><subsection id="id35e92714a97043b7aa0d463d22e70162"><enum>(b)</enum><header>Treatment</header><paragraph id="idc939f83db0cf4206b9f7a1502968ea47"><enum>(1)</enum><header>In general</header><text>The allocation to the Fort Belknap Indian Community under subsection (a) shall be considered to be part of the Tribal water rights.</text></paragraph><paragraph id="iddd99b04447b54054bb70524fcca6d46a"><enum>(2)</enum><header>Priority date</header><text>The priority date of the allocation to the Fort Belknap Indian Community under subsection (a) shall be the priority date of the Lake Elwell water right held by the Bureau of Reclamation.</text></paragraph><paragraph id="id221c2eca2aca493ba969e28b5d28a650"><enum>(3)</enum><header>Administration</header><text>The Fort Belknap Indian Community shall administer the water allocated under subsection (a) in accordance with the Compact and this Act.</text></paragraph></subsection><subsection id="idddecfe929c084836a2165199512b2dfb"><enum>(c)</enum><header>Allocation agreement</header><paragraph id="idb6d3fe3c3cec4738a2bfd9562771c41f"><enum>(1)</enum><header>In general</header><text>As a condition of receiving an allocation under this section, the Fort Belknap Indian Community shall enter into an agreement with the Secretary to establish the terms and conditions of the allocation, in accordance with the Compact and this Act.</text></paragraph><paragraph id="id7d3d3b8854a049af8e87562c0e56e854"><enum>(2)</enum><header>Inclusions</header><text>The agreement under paragraph (1) shall include provisions establishing that—</text><subparagraph id="id5c605a691a7c4313ab7b1542aad1bc56"><enum>(A)</enum><text>the agreement shall be without limit as to term;</text></subparagraph><subparagraph id="id6abf4c612d2643ca8301dcf4c902019a"><enum>(B)</enum><text>the Fort Belknap Indian Community, and not the United States, shall be entitled to all consideration due to the Fort Belknap Indian Community under any lease, contract, exchange, or agreement entered into by the Fort Belknap Indian Community pursuant to subsection (d);</text></subparagraph><subparagraph id="idbe977e1cb56f4d9d847e531097e71ebe"><enum>(C)</enum><text>the United States shall have no obligation to monitor, administer, or account for—</text><clause id="id29d4d5f5ed15478ba0c2169c52a126f6"><enum>(i)</enum><text>any funds received by the Fort Belknap Indian Community as consideration under any lease, contract, exchange, or agreement entered into by the Fort Belknap Indian Community pursuant to subsection (d); or</text></clause><clause id="id5d48f2742d2545b699675358ecda6bed"><enum>(ii)</enum><text>the expenditure of those funds;</text></clause></subparagraph><subparagraph id="id714752cf410f4be2bab9a6f76ba7b9b1"><enum>(D)</enum><text>if the capacity or function of Lake Elwell facilities are significantly reduced, or are anticipated to be significantly reduced, for an extended period of time, the Fort Belknap Indian Community shall have the same storage rights as other storage contractors with respect to the allocation under this section;</text></subparagraph><subparagraph id="idcd2bed452f28498cb68bd585c093fba3"><enum>(E)</enum><text>the costs associated with the construction of the storage facilities at Tiber Dam allocable to the Fort Belknap Indian Community shall be nonreimbursable;</text></subparagraph><subparagraph id="iddc48c3cdb68f4bcf9e0a6edb4d57a8a4"><enum>(F)</enum><text>no water service capital charge shall be due or payable for any water allocated to the Fort Belknap Indian Community under this section or the allocation agreement, regardless of whether that water is delivered for use by the Fort Belknap Indian Community or under a lease, contract, exchange, or by agreement entered into by the Fort Belknap Indian Community pursuant to subsection (d);</text></subparagraph><subparagraph id="id6c2f3c5686ee4b319730b5049003d35f"><enum>(G)</enum><text>the Fort Belknap Indian Community shall not be required to make payments to the United States for any water allocated to the Fort Belknap Indian Community under this section or the allocation agreement, except for each acre-foot of stored water leased or transferred for industrial purposes as described in subparagraph (H); and</text></subparagraph><subparagraph id="id00f0239df7e34df0a9aecdc460610cbd"><enum>(H)</enum><text>for each acre-foot of stored water leased or transferred by the Fort Belknap Indian Community for industrial purposes—</text><clause id="id878a07369f3a4b259af8993200a73aa5"><enum>(i)</enum><text>the Fort Belknap Indian Community shall pay annually to the United States an amount necessary to cover the proportional share of the annual operations, maintenance, and replacement costs allocable to the quantity of water leased or transferred by the Fort Belknap Indian Community for industrial purposes; and</text></clause><clause id="id4e5bc6eed3ad46c5af67d0917349e631"><enum>(ii)</enum><text>the annual payments of the Fort Belknap Indian Community shall be reviewed and adjusted, as appropriate, to reflect the actual operations, maintenance, and replacement costs for Tiber Dam.</text></clause></subparagraph></paragraph></subsection><subsection id="idc72d736309974d8c90ca7637cc1845ad"><enum>(d)</enum><header>Agreement by fort Belknap Indian Community</header><text>The Fort Belknap Indian Community may use, lease, contract, exchange, or enter into other agreements for the use of the water allocated to the Fort Belknap Indian Community under subsection (a) if—</text><paragraph id="id56fc12c561ee450d984a62ea97d9ab92"><enum>(1)</enum><text>the use of water that is the subject of such an agreement occurs within the Missouri River Basin; and</text></paragraph><paragraph id="idb667599a4db34c6db8ac224b58a4fb4e"><enum>(2)</enum><text>the agreement does not permanently alienate any water allocated to the Fort Belknap Indian Community under that subsection.</text></paragraph></subsection><subsection id="id708a59d6dc234d7db41a68c2d539ee7e"><enum>(e)</enum><header>Effective date</header><text>The allocation under subsection (a) takes effect on the enforceability date.</text></subsection><subsection id="idb997aaa7bac94880bf8a547c5fcfae94"><enum>(f)</enum><header>No carryover storage</header><text>The allocation under subsection (a) shall not be increased by any year-to-year carryover storage.</text></subsection><subsection id="id106374444a764d7285dcc73de91071cf"><enum>(g)</enum><header>Development and delivery costs</header><text>The United States shall not be required to pay the cost of developing or delivering any water allocated under this section.</text></subsection></section><section id="id2f57b9a8159e40dca32a017fee383214"><enum>8.</enum><header>Milk River Project mitigation</header><subsection id="id1858cc046aa24a0d956a50b1e86e01eb"><enum>(a)</enum><header>In general</header><text>In complete satisfaction of the Milk River Project mitigation requirements provided for in Article VI.B. of the Compact, the Secretary, acting through the Commissioner—</text><paragraph commented="no" display-inline="no-display-inline" id="id671728e401374807a54c4af464cc2963"><enum>(1)</enum><text display-inline="yes-display-inline">in cooperation with the State and the Blackfeet Tribe, shall carry out appropriate activities concerning the restoration of the St. Mary Canal and associated facilities, including activities relating to the—</text><subparagraph id="id89d507dcc9eb4c2d8bc430cea4587dce"><enum>(A)</enum><text>planning and design to restore the St. Mary Canal and appurtenances to convey 850 cubic-feet per second; and</text></subparagraph><subparagraph id="iddc8ff5b6a976451c80dae4dac51cebc2"><enum>(B)</enum><text>rehabilitating, constructing, and repairing of the St. Mary Canal and appurtenances; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3af9c80dbbb440db9dbc74ab5f8206c6"><enum>(2)</enum><text>in cooperation with the State and the Fort Belknap Indian Community, shall carry out appropriate activities concerning the enlargement of Dodson South Canal and associated facilities, including activities relating to the—</text><subparagraph id="idb9d81f29dee94754b9adb187bd8b68f6"><enum>(A)</enum><text>planning and design to enlarge Dodson South Canal and headworks at the upstream end of Dodson South Canal to divert and convey 700 cubic-feet per second; and</text></subparagraph><subparagraph id="idf77382c2b63f48ee8dcb6f122c6ab5af"><enum>(B)</enum><text>rehabilitating, constructing, and enlarging the Dodson South Canal and headworks at the upstream end of Dodson South Canal to divert and convey 700 cubic-feet per second.</text></subparagraph></paragraph></subsection><subsection id="ide8bef01345224ef3afd9fa6d2c723e52"><enum>(b)</enum><header>Funding</header><text>The total amount of obligations incurred by the Secretary, prior to any adjustments provided for in section 14(b), shall not exceed $300,000,000 to carry out activities described in subsection (c)(1).</text></subsection><subsection id="id675d647c0fca43559518547fcc064490"><enum>(c)</enum><header>Satisfaction of mitigation requirement</header><text>Notwithstanding any provision of the Compact, the mitigation required by Article VI.B. of the Compact shall be deemed satisfied if—</text><paragraph id="idb447cc1c1a6943188412c8875652c0cb"><enum>(1)</enum><text>the Secretary has—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7bcf6057d1f44c88d4b57be56e8c493"><enum>(A)</enum><text display-inline="yes-display-inline">restored the St. Mary Canal and associated facilities to convey 850 cubic-feet per second; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id661fa7ec94ed486a9dcdd92e92759364"><enum>(B)</enum><text>enlarged the Dodson South Canal and headworks at the upstream end of Dodson South Canal to divert and convey 700 cubic-feet per second; and</text></subparagraph></paragraph><paragraph id="id7ded5de8d544435697674aa998cce6ca"><enum>(2)</enum><text>the Secretary—</text><subparagraph id="ide423b926bf654b95bd5d5e5e306a51e8"><enum>(A)</enum><text>has expended all of the available funding provided pursuant to section 14(a)(1)(D) to rehabilitate the St Mary Canal and enlarge the Dodson South Canal; and</text></subparagraph><subparagraph id="id2b9718e0f0e94a82a1f640e25e4f383d"><enum>(B)</enum><text>despite diligent efforts, could not complete the activities described in subsection (a).</text></subparagraph></paragraph></subsection><subsection id="idd45d243c7b7d4c9c8e8e11339543feff"><enum>(d)</enum><header>Nonreimbursability of costs</header><text>The costs to the Secretary of carrying out this section shall be nonreimbursable.</text></subsection></section><section id="ida57ca90bd27a407c99165ec78390b915"><enum>9.</enum><header>Fort Belknap Indian Irrigation Project System</header><subsection id="idcf6d4311f0114d44bfb572e8cc4098e2"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary, acting through the Assistant Secretary for Indian Affairs, shall rehabilitate, modernize, and expand the Fort Belknap Indian Irrigation Project, which shall include— </text><paragraph id="id2262197ad8fd46cd939f719bec391505"><enum>(1)</enum><text>planning, studies, and designing of the existing and expanded Milk River unit, including the Pumping Plant, delivery pipe and canal, Fort Belknap Dam and Reservoir, and Peoples Creek Flood Protection Project;</text></paragraph><paragraph id="ida6b14878ce914cc28ed8b33089bc87bf"><enum>(2)</enum><text>the rehabilitation, modernization, and construction of the existing Milk River unit; and</text></paragraph><paragraph id="idb13ff7ef064d416f9f27dd640b9f6642"><enum>(3)</enum><text>construction of the expanded Milk River Project, including the Pumping Plant, delivery pipe and canal, Fort Belknap Dam and Reservoir, and Peoples Creek Flood Protection Project.</text></paragraph></subsection><subsection id="id1156a5f3c3b746b0a507be691a00e2de"><enum>(b)</enum><header>Lead agency</header><text>The Bureau of Indian Affairs shall serve as the lead agency with respect to any activities carried out under this section.</text></subsection><subsection id="id672a014f0f7c4428bb174663d49fede1"><enum>(c)</enum><header>Consultation with the Fort Belknap Indian Community</header><text>The Secretary shall consult with the Fort Belknap Indian Community on appropriate changes to the final design and costs of any activity under this section.</text></subsection><subsection id="id7d5c545d50ca47c2a804816b28d896fd"><enum>(d)</enum><header>Funding</header><text>The total amount of obligations incurred by the Secretary in carrying out this section, prior to any adjustment provided for in section 14(b), shall not exceed $415,832,153.</text></subsection><subsection id="id49d253a5306b4aa38c94080749d9edc7"><enum>(e)</enum><header>Nonreimbursability of costs</header><text>All costs incurred by the Secretary in carrying out this section shall be nonreimbursable.</text></subsection><subsection id="id46210e19c105432992152230958eadc1"><enum>(f)</enum><header>Administration</header><text>The Assistant Secretary of Indian Affairs and the Fort Belknap Indian Community shall negotiate the cost of any oversight activity carried out by the Bureau of Indian Affairs under any agreement entered into under subsection (i), subject to the condition that the total cost for the oversight shall not exceed 3 percent of the total project costs for each project.</text></subsection><subsection id="id546c002ec0e942ed8c965ebba6b06bd1"><enum>(g)</enum><header>Project efficiencies</header><text>If the total cost of planning, studies, design, rehabilitation, modernization, and construction activities relating to the projects described in subsection (a) results in cost savings and is less than the amounts authorized to be obligated, the Secretary, at the request of the Fort Belknap Indian Community, shall deposit those savings in the the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account established under section 12(b)(2).</text></subsection><subsection id="iddd556319ac8e435ead7799a9f18b005a"><enum>(h)</enum><header>Treatment</header><text>Any activities carried out pursuant to this section that result in improvements, additions, or modifications to the Fort Belknap Indian Irrigation Project shall—</text><paragraph id="id910fbb01d65847899003acb57a4938f7"><enum>(1)</enum><text>become a part of the Fort Belknap Indian Irrigation Project; and</text></paragraph><paragraph id="id9e4699ea4d834f31968a826fba97fb76"><enum>(2)</enum><text>be recorded in the inventory of the Secretary relating to the Fort Belknap Indian Irrigation Project.</text></paragraph></subsection><subsection id="id936a25a8bbeb4f8f98576506c7be0b7d"><enum>(i)</enum><header>Applicability of ISDEAA</header><text>At the request of the Fort Belknap Indian Community, and in accordance with the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>), the Secretary shall enter into agreements with the Fort Belknap Indian Community to carry out all or a portion of this section.</text></subsection><subsection id="id9ac0b8c41e464c168caa4eafc2ef0af5"><enum>(j)</enum><header>Effect</header><text>Nothing in this section—</text><paragraph id="idb4ca59ff765e4659a24a150db7b926b2"><enum>(1)</enum><text>alters any applicable law under which the Bureau of Indian Affairs collects assessments or carries out the operations and maintenance of the Fort Belknap Indian Irrigation Project; or</text></paragraph><paragraph id="id6fcea3e266084ca2b528cab955ce5941"><enum>(2)</enum><text>impacts the availability of amounts under section 14.</text></paragraph></subsection><subsection id="id90d5139b95ef42718f0310e3df612bf5"><enum>(k)</enum><header>Satisfaction of Fort Belknap Indian Irrigation Project System requirement</header><text>The obligations of the Secretary under subsection (a) shall be deemed satisfied if—</text><paragraph id="idf98e3b6d722445e9a14c858c4b326947"><enum>(1)</enum><text>the Secretary has rehabilitated, modernized, and expanded the Fort Belknap Indian Irrigation Project in accordance with subsection (a); or</text></paragraph><paragraph id="ide11d3e70c60245ab98880c6269dc3370"><enum>(2)</enum><text>the Secretary—</text><subparagraph id="id6fc835d35d8a46a3ada5c840ab370115"><enum>(A)</enum><text>has expended all of the available funding provided pursuant to paragraphs (1)(C) and (2)(A)(iv) of section 14(a); and</text></subparagraph><subparagraph id="id8d335a048ab14cada25162a73ebcf5dd"><enum>(B)</enum><text>despite diligent efforts, could not complete the activities described in subsection (a).</text></subparagraph></paragraph></subsection></section><section id="ida0155c39031c43ad8711382ffe1f4fb2"><enum>10.</enum><header>Satisfaction of claims</header><subsection id="id12566cf32706447da16d52d4e8900013"><enum>(a)</enum><header>In general</header><text>The benefits provided under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of the Fort Belknap Indian Community against the United States that is waived and released by the Fort Belknap Indian Community under section 11(a).</text></subsection><subsection id="id9a6df93198d248acb38f488e4bf32bda"><enum>(b)</enum><header>Allottees</header><text>The benefits realized by the allottees under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of—</text><paragraph id="idbcae6d0ed95a4ddca8f99306789a4741"><enum>(1)</enum><text>all claims waived and released by the United States (acting as trustee for the allottees) under section 11(a)(2); and</text></paragraph><paragraph id="idd1aaa1720aa74639aceaac93f485a96e"><enum>(2)</enum><text>any claims of the allottees against the United States similar to the claims described in section 11(a)(2) that the allottee asserted or could have asserted.</text></paragraph></subsection></section><section id="id71388808ff964f6a8b387c2a9bb07742"><enum>11.</enum><header>Waivers and releases of claims</header><subsection id="idf8124b745bdb4a6cb9861f9576ba04c2"><enum>(a)</enum><header>In general</header><paragraph id="id1f02707d3a194e8e92e7deb142b54950"><enum>(1)</enum><header>Waiver and release of claims by the fort belknap indian community and United States as trustee for the fort belknap indian community</header><text>Subject to the reservation of rights and retention of claims under subsection (d), as consideration for recognition of the Tribal water rights and other benefits described in the Compact and this Act, the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), and the United States, acting as trustee for the Fort Belknap Indian Community and the members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), shall execute a waiver and release of all claims for water rights within the State that the Fort Belknap Indian Community, or the United States acting as trustee for the Fort Belknap Indian Community, asserted or could have asserted in any proceeding, including a State stream adjudication, on or before the enforceability date, except to the extent that such rights are recognized in the Compact and this Act.</text></paragraph><paragraph id="id194e073a3b3049d7bc1011912cad915d"><enum>(2)</enum><header>Waiver and release of claims by the United States as trustee for allottees</header><text>Subject to the reservation of rights and the retention of claims under subsection (d), as consideration for recognition of the Tribal water rights and other benefits described in the Compact and this Act, the United States, acting as trustee for the allottees, shall execute a waiver and release of all claims for water rights within the Reservation that the United States, acting as trustee for the allottees, asserted or could have asserted in any proceeding, including a State stream adjudication, on or before the enforceability date, except to the extent that such rights are recognized in the Compact and this Act.</text></paragraph><paragraph id="id61ee57d2484a4d4382a26112ffeb91ca"><enum>(3)</enum><header>Waiver and release of claims by the Fort Belknap Indian Community against the United States</header><text>Subject to the reservation of rights and retention of claims under subsection (d), the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States)—</text><subparagraph id="id3455888155d647d1aa0ca3d571d16e96"><enum>(A)</enum><text>first arising before the enforceability date relating to—</text><clause id="id64b89dd43f6b47619c39c31370120ac8"><enum>(i)</enum><text>water rights within the State that the United States, acting as trustee for the Fort Belknap Indian Community, asserted or could have asserted in any proceeding, including a general stream adjudication in the State, except to the extent that such rights are recognized as Tribal water rights under this Act;</text></clause><clause id="id5df2e63d4abe41f89510409f78d6b015"><enum>(ii)</enum><text>foregone benefits from nontribal use of water, on and off the Reservation (including water from all sources and for all uses);</text></clause><clause id="id4ade84bd855543c5b55d0291f91a9fda"><enum>(iii)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights, including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of water or water rights, claims relating to interference with, diversion of, or taking of water, or claims relating to a failure to protect, acquire, replace, or develop water, water rights, or water infrastructure within the State;</text></clause><clause id="id4465ffc2f77b454a92eb45dabfadeae8"><enum>(iv)</enum><text>a failure to establish or provide a municipal rural or industrial water delivery system on the Reservation;</text></clause><clause id="id359f48c0491344a29a88f2e9e64159f1"><enum>(v)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to construction, operation, and management of the Fort Belknap Indian Irrigation Project and other Federal land and facilities (including damages, losses, or injuries to Tribal fisheries, fish habitat, wildlife, and wildlife habitat);</text></clause><clause id="id6f88119c7c1943c084180910b89033bb"><enum>(vi)</enum><text>a failure to provide for operation and maintenance, or deferred maintenance, for the Fort Belknap Indian Irrigation Project or any other irrigation system or irrigation project;</text></clause><clause id="id1268ef555ea5463a8d2b7387ecb9c67f"><enum>(vii)</enum><text>the litigation of claims relating to any water rights of the Fort Belknap Indian Community in the State;</text></clause><clause id="idd1bb5fc0bc5a40269a5e6153659c897b"><enum>(viii)</enum><text>the negotiation, execution, or adoption of the Compact (including appendices) and this Act;</text></clause><clause id="id0f1792d0e2af4e9791964046a816b602"><enum>(ix)</enum><text>the taking or acquisition of land or resources of the Fort Belknap Indian Community for the construction or operation of the Fort Belknap Indian Irrigation Project or the Milk River Project; and</text></clause><clause id="id49120454b7254779a44e6c3c9701b4db"><enum>(x)</enum><text>the allocation of water of the Milk River and the St. Mary River (including tributaries) between the United States and Canada pursuant to the International Boundary Waters Treaty of 1909 (36 Stat. 2448); and</text></clause></subparagraph><subparagraph id="id2412fb647bf2460cbcddce6b58864a52"><enum>(B)</enum><text>relating to damage, loss, or injury to water, water rights, land, or natural resources due to mining activities in the Little Rockies Mountains prior to the date of trust acquisition, including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights.</text></subparagraph></paragraph></subsection><subsection id="id4b31f3a1a60b471ab572e8ae232587a6" commented="no"><enum>(b)</enum><header>Effectiveness</header><text>The waivers and releases under subsection (a) shall take effect on the enforceability date.</text></subsection><subsection id="idf5f31dce5fea4dfd9093b8acb216b91b"><enum>(c)</enum><header>Objections in Montana water court</header><text>Nothing in this Act or the Compact prohibits the Fort Belknap Indian Community, a member of the Fort Belknap Indian Community, an allottee, or the United States in any capacity from objecting to any claim to a water right filed in any general stream adjudication in the Montana Water Court.</text></subsection><subsection id="id3dd6ee409d1b4464bc82b735494c25e5"><enum>(d)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsection (a), the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community, and the United States, acting as trustee for the Fort Belknap Indian Community and the allottees shall retain—</text><paragraph id="id5c78abe14b604b6b83ebe9473b76ebf7"><enum>(1)</enum><text>all claims relating to—</text><subparagraph id="iddbc086e18a0644278d5495770ea3d193"><enum>(A)</enum><text>the enforcement of water rights recognized under the Compact, any final court decree relating to those water rights, or this Act or to water rights accruing on or after the enforceability date;</text></subparagraph><subparagraph id="id0967573ff92045fd83223c8c5eca7ada"><enum>(B)</enum><text>the quality of water under—</text><clause id="id9026ee160ba14b43b397e0bac209c34b"><enum>(i)</enum><text>CERCLA, including damages to natural resources;</text></clause><clause id="idae9a798718f84888ba328a4759c5238c"><enum>(ii)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></clause><clause id="idfdd0221123164031bbd779f16c8efd2c"><enum>(iii)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and</text></clause><clause id="idcd6fd27e90ed47ae9c872553aac67b35"><enum>(iv)</enum><text>any regulations implementing the Acts described in clauses (i) through (iii);</text></clause></subparagraph><subparagraph id="id97a6484d7f5f463fb14b9a157f11b3aa"><enum>(C)</enum><text>damage, loss, or injury to land or natural resources that are—</text><clause id="iddb78a3ff3ee74a719ae8be942c634896"><enum>(i)</enum><text>not due to loss of water or water rights (including hunting, fishing, gathering, or cultural rights); and</text></clause><clause id="id8e77951603dd43038236e304f08fdc3d"><enum>(ii)</enum><text>not described in subsection (a)(3); and</text></clause></subparagraph><subparagraph id="id25b45c2d52c041149336e28ba8ece806"><enum>(D)</enum><text>an action to prevent any person or party (as defined in sections 29 and 30 of Article II of the Compact) from interfering with the enjoyment of the Tribal water rights;</text></subparagraph></paragraph><paragraph id="id4bbd855a49c54eb6a2c5f2688016dd6a"><enum>(2)</enum><text>all claims relating to off-Reservation hunting rights, fishing rights, gathering rights, or other rights;</text></paragraph><paragraph id="idf684529dbe864de8b1cd729a13d8636f"><enum>(3)</enum><text>all claims relating to the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph><paragraph id="id7043c57df05b44269decb33c437fe057"><enum>(4)</enum><text>all claims relating to the allocation of waters of the Milk River and the Milk River Project between the Fort Belknap Indian Community and the Blackfeet Tribe, pursuant to section 3705(e)(3) of the Blackfeet Water Rights Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1818);</text></paragraph><paragraph id="id4a99aae640d24506aae668a8709c1048"><enum>(5)</enum><text>all claims relating to the enforcement of the Act, including the required transfer of land under section 6; and</text></paragraph><paragraph id="idb0513f0989a7464cbdad8d2a5250baa3"><enum>(6)</enum><text>all rights, remedies, privileges, immunities, and powers not specifically waived and released pursuant to this Act or the Compact.</text></paragraph></subsection><subsection id="id7621530b692d4f4d8fda02ab13dec614"><enum>(e)</enum><header>Effect of Compact and Act</header><text>Nothing in the Compact or this Act—</text><paragraph id="id04b21a35453348a68e96b4d4896fd52b"><enum>(1)</enum><text>affects the authority of the Fort Belknap Indian Community to enforce the laws of the Fort Belknap Indian Community, including with respect to environmental protections;</text></paragraph><paragraph id="id249de32ad9c546f7b21ea5dadbe92de8"><enum>(2)</enum><text>affects the ability of the United States, acting as sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="ide0ad068e4db34901aa9a4040b14ce5ca"><enum>(A)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></subparagraph><subparagraph id="id8b1153b91819433bade88413928c2569"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="ide2358194880e44c995611cefa0a7c6de"><enum>(C)</enum><text>CERCLA; and</text></subparagraph><subparagraph id="id69157168a21d4605bcf1382c2c181a08"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C);</text></subparagraph></paragraph><paragraph id="id9ed3b3786b744faea59ea3d47cdbb068"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for any other Indian Tribe or an allottee of any other Indian Tribe;</text></paragraph><paragraph id="id64406ed715604b2082d260c9d1ba4935"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="id8275f7fa4a9e4e709f93ff265bad1eaa"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="idbe864b40a4374f46955329427be3dfb8"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law relating to health, safety, or the environment; or</text></subparagraph><subparagraph id="id17fdda16708a49cfa17b4886836c6f8e"><enum>(C)</enum><text>to conduct judicial review of any Federal agency action;</text></subparagraph></paragraph><paragraph id="idb799f8456b8c4f32af0390be1fb17144"><enum>(5)</enum><text>waives any claim of a member of the Fort Belknap Indian Community in an individual capacity that does not derive from a right of the Fort Belknap Indian Community;</text></paragraph><paragraph id="id4e0ccf48ec7942559e7a1121e7c22ba8"><enum>(6)</enum><text>revives any claim adjudicated in the decision in Gros Ventre Tribe v. United States, 469 F.3d 801 (9th Cir. 2006); or</text></paragraph><paragraph id="id3ba36c83b6704891bd8e8febcd4ba88d"><enum>(7)</enum><text>revives any claim released by an allottee or member of the Fort Belknap Indian Community in the settlement in Cobell v. Salazar, No. 1:96CV01285–JR (D.D.C. 2012).</text></paragraph></subsection><subsection id="id9e8a0af54eac4fc2be0624ed1f846119"><enum>(f)</enum><header>Enforceability date</header><text>The enforceability date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="id412156fe839a4b8e859d10314f2d7b6c"><enum>(1)</enum><text>the eligible members of the Fort Belknap Indian Community have voted to approve this Act and the Compact by a majority of votes cast on the day of the vote;</text></paragraph><paragraph id="id2541bdc813f14cce83f4023470de67dc"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ida8b19811bb984e19abc6bc539ce0f076"><enum>(A)</enum><text>the Montana Water Court has approved the Compact in a manner from which no further appeal may be taken; or</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id5e7f861be4ad44b99a6232f6e54806f1"><enum>(B)</enum><text>if the Montana Water Court is found to lack jurisdiction, the appropriate district court of the United States has approved the Compact as a consent decree from which no further appeal may be taken;</text></subparagraph></paragraph><paragraph id="id12d33b6fbd56435581e35cb0df5e85b6"><enum>(3)</enum><text>all of the amounts authorized to be appropriated<italic></italic> under section 14 have been appropriated and deposited in the designated accounts;</text></paragraph><paragraph id="idd6e36ce16aca4493bbef68b7760d1b8c"><enum>(4)</enum><text>the Secretary and the Fort Belknap Indian Community have executed an allocation agreement described in section 7(c)(1);</text></paragraph><paragraph id="id87671ab8936f4e2a83aa2f332ce61a91"><enum>(5)</enum><text>the State has provided the required funding into the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account of the Trust Fund pursuant to section 14(a)(3); and</text></paragraph><paragraph id="id167cab88105b4ef59012a073527893ec"><enum>(6)</enum><text>the waivers and releases under subsection (a) have been executed by the Fort Belknap Indian Community and the Secretary.</text></paragraph></subsection><subsection id="id86c2fa8e62844f0c88b124b12517b7ec"><enum>(g)</enum><header>Tolling of claims</header><paragraph id="id512f4e027ec648479744e07cd4cad8d1"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the enforceability date.</text></paragraph><paragraph id="ida76d68e5628e4be2b2da80c4bd0cc43e"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitations or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph></subsection><subsection id="ide5e8c47f02bb4b2f8d5941ec33636b52"><enum>(h)</enum><header>Expiration</header><paragraph id="id807b2fca9c9042a3afd85b8abb38a265"><enum>(1)</enum><header>In general</header><text>This Act shall expire in any case in which—</text><subparagraph id="id65d153dbd87b4ed1ab9e7b06e8fe886b"><enum>(A)</enum><text>the amounts authorized to be appropriated<italic></italic> by this Act have not been made available to the Secretary by not later than—</text><clause id="idb3652087781b4d899d8740059752c702" commented="no"><enum>(i)</enum><text>January 21, 2034; and</text></clause><clause id="id4ee0ef5cd52a4f5cbd2c5336775fc0b4"><enum>(ii)</enum><text>such alternative later date as is agreed to by the Fort Belknap Indian Community and the Secretary; or</text></clause></subparagraph><subparagraph id="idb971468e537d4f6ca0fb2481364ab561"><enum>(B)</enum><text>the Secretary fails to publish a statement of findings under subsection (f) by not later than—</text><clause id="id384e22a1697348dfb7ff676d0375d0ba" commented="no"><enum>(i)</enum><text>January 21, 2035; and</text></clause><clause id="id384610609b9f423c8d96a419bd867c47"><enum>(ii)</enum><text>such alternative later date as is agreed to by the Fort Belknap Indian Community and the Secretary, after providing reasonable notice to the State.</text></clause></subparagraph></paragraph><paragraph id="id72289480d9464c3daadf378ef8cdafd7"><enum>(2)</enum><header>Consequences</header><text>If this Act expires under paragraph (1)—</text><subparagraph id="idf2af1c6065024b4fb808d01a460b55f0"><enum>(A)</enum><text>the waivers and releases under subsection (a) shall—</text><clause id="idb2b27079fb2e483097b7297b562a6682"><enum>(i)</enum><text>expire; and</text></clause><clause id="idf122541f71d34fdeaf57768054b3d228"><enum>(ii)</enum><text>have no further force or effect;</text></clause></subparagraph><subparagraph id="id9fb50da005d54636becb892f2486de4a"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the Compact under section 4 shall no longer be effective;</text></subparagraph><subparagraph id="id684c357aa5fd4ebdaf462fb6c0a582f5"><enum>(C)</enum><text>any action carried out by the Secretary, and any contract or agreement entered into, pursuant to this Act shall be void;</text></subparagraph><subparagraph id="id9ef441fdac7f41f18dcc01915b06c621"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this Act, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this Act shall be returned to the Federal Government, unless otherwise agreed to by the Fort Belknap Indian Community and the United States and approved by Congress; and</text></subparagraph><subparagraph id="id4868f07f9e5147b086250d846510494a"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this Act that were expended or withdrawn, or any funds made available to carry out this Act from other Federal authorized sources, together with any interest accrued on those funds, against any claims against the United States—</text><clause id="id96dd58b3dbf44ee5b82d2dadc7e048ba"><enum>(i)</enum><text>relating to—</text><subclause id="id9578347185ce4bb78cf571c229de8c0a"><enum>(I)</enum><text>water rights in the State asserted by—</text><item id="id841e2dbe3e63472ca90445a73b5053d4"><enum>(aa)</enum><text>the Fort Belknap Indian Community; or</text></item><item id="id93662871a8e642289321440c62771d2a"><enum>(bb)</enum><text>any user of the Tribal water rights; or</text></item></subclause><subclause id="id91cf4d6a7b464b058e4825ae510da108"><enum>(II)</enum><text>any other matter described in subsection (a)(3); or</text></subclause></clause><clause id="idf533d6426e174f77a8de6312d2e104a1"><enum>(ii)</enum><text>in any future settlement of water rights of the Fort Belknap Indian Community or an allottee.</text></clause></subparagraph></paragraph></subsection></section><section id="id28f7a2e9c6854ae695f5142d4b137ce6"><enum>12.</enum><header>Aaniiih Nakoda Settlement Trust Fund</header><subsection id="idcb860b6fff094d4b893dc87127cddb09"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund for the Fort Belknap Indian Community, to be known as the <quote>Aaniiih Nakoda Settlement Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Trust Fund under subsection (c), together with any investment earnings, including interest, earned on those amounts, for the purpose of carrying out this Act.</text></subsection><subsection id="idef80f78d21f34c73a7fd34e2b5f8f862"><enum>(b)</enum><header>Accounts</header><text>The Secretary shall establish in the Trust Fund the following accounts:</text><paragraph id="id162d4fc038fd421c9a5fdd8d06f1df91" commented="no"><enum>(1)</enum><text>The Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account.</text></paragraph><paragraph id="id2a685edebc174491bbd648088c446486" commented="no"><enum>(2)</enum><text>The Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account.</text></paragraph><paragraph id="iddae0197777824b818f2857595b1f2521" commented="no"><enum>(3)</enum><text>The Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account.</text></paragraph></subsection><subsection id="ida4a194da972d4b8592d8bfdabb5aff37"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit—</text><paragraph id="idc0363a51355241d9bde27e57bf12ec3f"><enum>(1)</enum><text>in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account established under subsection (b)(1), the amounts made available pursuant to paragraphs (1)(A) and (2)(A)(i) of section 14(a);</text></paragraph><paragraph id="id052ffa2b360d4c44a57fd84a791c4611"><enum>(2)</enum><text>in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account established under subsection (b)(2), the amounts made available pursuant to section 14(a)(2)(A)(ii); and</text></paragraph><paragraph id="id481f47b99b044668984556159fb33ee4"><enum>(3)</enum><text>in the Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account established under subsection (b)(3), the amounts made available pursuant to paragraphs (1)(B) and (2)(A)(iii) of section 14(a).</text></paragraph></subsection><subsection id="id47a5fce6908a46b49751e769cb50f205"><enum>(d)</enum><header>Management and interest</header><paragraph id="id1c0588d48f814114bb36d38f23a5df7d"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of the funds into the accounts in the Trust Fund pursuant to subsection (c), the Secretary shall manage, invest, and distribute all amounts in the Trust Fund in accordance with the investment authority of the Secretary under—</text><subparagraph id="id85b8660694aa4c6995c174243331d4ae"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="id6bcdcb3528b74eb1ac2a044ea399879e"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id24f61c888a7f4fca840f68f4996a382f"><enum>(C)</enum><text>this section.</text></subparagraph></paragraph><paragraph id="idfb28393891e748c9b73e91a12320d8cb"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the amounts deposited under subsection (c), any investment earnings, including interest, credited to amounts held in the Trust Fund shall be available for use in accordance with subsections (e) and (g).</text></paragraph></subsection><subsection id="ida267a6e91c4d4ec797193f58377f8f6f"><enum>(e)</enum><header>Availability of amounts</header><paragraph id="id480e544114b84aedb4e953a914dd5b41"><enum>(1)</enum><header>In general</header><text>Amounts appropriated to, and deposited in, the Trust Fund, including any investment earnings, including interest, earned on those amounts shall be made available—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcfbee9f61b6945dea45f93caf916593a"><enum>(A)</enum><text display-inline="yes-display-inline">to the Fort Belknap Indian Community by the Secretary beginning on the enforceability date; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b6ddd1eb7824f0eb604697e088b2736"><enum>(B)</enum><text>subject to the uses and restrictions in this section.</text></subparagraph></paragraph><paragraph id="idb0d3fef1626f481fb497d79a814afcaa"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1)—</text><subparagraph id="id4e9d33f1cb0f45f097d279afe988dffe"><enum>(A)</enum><text>amounts deposited in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account established under subsection (b)(1) shall be available to the Fort Belknap Indian Community on the date on which the amounts are deposited for uses described in subparagraphs (A) and (B) of subsection (g)(1)<italic></italic>;</text></subparagraph><subparagraph id="id44289ed1ea4a49b1b2f22b5f7fbaf461"><enum>(B)</enum><text>amounts deposited in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account established under subsection (b)(2) shall be made available to the Fort Belknap Indian Community on the date on which the amounts are deposited and the Fort Belknap Indian Community has satisfied the requirements of section 11(f)(1), for the uses described in subsection (g)(2)(A); and</text></subparagraph><subparagraph id="id20320797e6fc4280875493a2e869dbb4"><enum>(C)</enum><text>amounts deposited in the Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account established under subsection (b)(3) shall be available to the Fort Belknap Indian Community on the date on which the amounts are deposited for the uses described in subsection (g)(3)(A).</text></subparagraph></paragraph></subsection><subsection id="id1fefa1e8ab314b4e9185f52b73a63651"><enum>(f)</enum><header>Withdrawals</header><paragraph id="ide3d038e126644032bb43d5a26a827f3b"><enum>(1)</enum><header>American Indian Trust Fund Management Reform Act of 1994</header><subparagraph commented="no" display-inline="no-display-inline" id="id7eb51d71037247838b2d074dc8afe95d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Fort Belknap Indian Community may withdraw any portion of the funds in the Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Fort Belknap Indian Community in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="id5d64829279014149b91d70288d9ff01d"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this paragraph shall require that the Fort Belknap Indian Community spend all amounts withdrawn from the Trust Fund, and any investment earnings accrued through the investments under the Tribal management plan, in accordance with this Act.</text></subparagraph><subparagraph id="id4c2fdf400362406ba6fe030baa4ac14e"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary—</text><clause id="ida5f115b0050741ccb5ac4a4a000ec076"><enum>(i)</enum><text>to enforce the Tribal management plan; and</text></clause><clause id="idf35952ea6aa64a78a069ed97df19ef10"><enum>(ii)</enum><text>to ensure that amounts withdrawn from the Trust Fund by the Fort Belknap Indian Community under this paragraph are used in accordance with this Act.</text></clause></subparagraph></paragraph><paragraph id="id674c6d5ef56f4140900f7234b8197a8c"><enum>(2)</enum><header>Withdrawals under expenditure plan</header><subparagraph commented="no" display-inline="no-display-inline" id="id8680c01fb64e4b41894edb664ff8caee"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Fort Belknap Indian Community may submit to the Secretary a request to withdraw funds from the Trust Fund pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="id0e5a8ddb6f7b4e45924224a042d56718"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw funds under an expenditure plan under this paragraph, the Fort Belknap Indian Community shall submit to the Secretary for approval an expenditure plan for any portion of the Trust Fund that the Fort Belknap Indian Community elects to withdraw pursuant to this paragraph, subject to the condition that the funds shall be used for the purposes described in this Act.</text></subparagraph><subparagraph id="id1d994a058d0a455499758a0330653273"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Trust Fund will be used by the Fort Belknap Indian Community in accordance with subsections (e) and (g).</text></subparagraph><subparagraph id="id37a63cb14d0a4b8aa97d6bee20400ed0"><enum>(D)</enum><header>Approval</header><text>On receipt of an expenditure plan under this paragraph, the Secretary shall approve the expenditure plan if the Secretary determines that the expenditure plan—</text><clause id="id44b04ae5f15c42a1a9d19bfcc538cc4a"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="ide3870a050b0a441394a36d7e3d2dc343"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this Act.</text></clause></subparagraph><subparagraph id="id002f588d17ba444ca89218568ae57da8"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan under this paragraph to ensure that amounts disbursed under this paragraph are used in accordance with this Act.</text></subparagraph></paragraph></subsection><subsection id="id3f38811e52e249a6b81cc6043de087d0"><enum>(g)</enum><header>Uses</header><text>Amounts from the Trust Fund shall be used by the Fort Belknap Indian Community for the following purposes:</text><paragraph id="id4261e2c414924f1199858ea1d5b8e9ca"><enum>(1)</enum><header>Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account</header><text>Amounts in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account established under subsection (b)(1) shall be used to pay the cost of activities relating to—</text><subparagraph id="idf85dfe896ca1432a9d6ec8fb6d2c24ac"><enum>(A)</enum><text>planning, studies, and design of the Southern Tributary Irrigation Project and the Peoples Creek Irrigation Project, including the Upper Peoples Creek Dam and Reservoir, as described in the Fort Belknap Indian Community Comprehensive Water Development Plan dated 2019;</text></subparagraph><subparagraph id="id1ef2c383701442a5ad63359e19b5abf6" commented="no"><enum>(B)</enum><text>environmental compliance;</text></subparagraph><subparagraph id="id637f0d4d28184d789d6805cb9e3774b1"><enum>(C)</enum><text>construction of the Southern Tributary Irrigation Project and the Peoples Creek Irrigation Project, including the Upper Peoples Creek Dam and Reservoir;</text></subparagraph><subparagraph id="idd6ab22675fac4017b93977428f9afddf"><enum>(D)</enum><text>wetlands restoration and development;</text></subparagraph><subparagraph id="id6cd45178203a4e13a89dba1d192ece15"><enum>(E)</enum><text>stock watering infrastructure; and</text></subparagraph><subparagraph id="id650067a14dca4187bac12de06610695f"><enum>(F)</enum><text>on farm development support and reacquisition of fee lands within the Fort Belknap Indian Irrigation Project.</text></subparagraph></paragraph><paragraph id="id0e79077c397e446e81d90a01dd3f12cf" commented="no"><enum>(2)</enum><header>Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account</header><text>Amounts in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account established under subsection (b)(2), the principal and investment earnings, including interest, may only be used by the Fort Belknap Indian Community to pay the costs of activities described in subparagraphs (A) through (C) as follows:</text><subparagraph id="id763791a69f804ef18482967202e1db1a" commented="no"><enum>(A)</enum><text>$9,000,000 shall be used for the establishment, operation, and capital expenditures in connection with the administration of the Tribal water resources and water rights development, including the development or enactment of a Tribal water code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14dfa17f8c07400294ffdd6b758b9829"><enum>(B)</enum><text display-inline="yes-display-inline">Only investment earnings, including interest, on $29,299,059 shall be used and be available to pay the costs of activities for administration, operations, and regulation of the Tribal water resources and water rights department, in accordance with the Compact and this Act.</text></subparagraph><subparagraph id="id33a2e77a0ba84a5ca8f9fdd873cd48a6" commented="no"><enum>(C)</enum><text>Only investment earnings, including interest, on $28,331,693 shall be used and be available to pay the costs of activities relating to a portion of the annual assessment costs for the Fort Belknap Indian Community and Tribal members, including allottees, under the Fort Belknap Indian Irrigation Project.</text></subparagraph></paragraph><paragraph id="id8c9d869868064ac2ab223ff606a68f80"><enum>(3)</enum><header>Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account</header><text>Amounts in the Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account established under subsection (b)(3), the principal and investment earnings, including interest, may only be used by the Fort Belknap Indian Community to pay the costs of activities relating to—</text><subparagraph id="id674e2def65ee4ae9959d19aef2bb2c64"><enum>(A)</enum><text>planning, studies, and design of domestic water supply, sewer collection and treatment systems, and Lake Elwell Project, as described in the Fort Belknap Indian Community Comprehensive Water Development Plan dated 2019, including water delivery to the southern part of the Reservation;</text></subparagraph><subparagraph id="idd5245e8faafe413183e9993a135c698e"><enum>(B)</enum><text>construction of domestic water supply, sewer collection, and treatment systems;</text></subparagraph><subparagraph id="idd22f6fc7bb1849ed90b8a8d5770ee640" commented="no"><enum>(C)</enum><text>construction, in accordance with applicable law, of infrastructure for delivery of Lake Elwell water diverted from the Missouri River to the southern part of the Reservation; and</text></subparagraph><subparagraph id="id02b990447910451480d3ca85f5edd70c" commented="no"><enum>(D)</enum><text>planning, studies, design, and construction of a Tribal wellness center for a work force health and wellbeing project.</text></subparagraph></paragraph></subsection><subsection id="id0663e8a1e40340e3b630a2f6226357ac"><enum>(h)</enum><header>Liability</header><text>The Secretary shall not be liable for any expenditure or investment of amounts withdrawn from the Trust Fund by the Fort Belknap Indian Community pursuant to subsection (f).</text></subsection><subsection id="id6e00f5bb07ab4b299cfc80626d9c55db"><enum>(i)</enum><header>Project efficiencies</header><text>If the total cost of the activities described in subsection (g) results in cost savings and is less than the amounts authorized to be obligated under any of paragraphs (1) through (3) of that subsection required to carry out those activities, the Secretary, at the request of the Fort Belknap Indian Community, shall deposit those savings in the Trust Fund to be used in accordance with that subsection.<italic></italic></text></subsection><subsection id="idc1cea52293e24c1aa069e2206e359b88"><enum>(j)</enum><header>Annual report</header><text>The Fort Belknap Indian Community shall submit to the Secretary an annual expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan or an expenditure plan described in this section.</text></subsection><subsection id="id7f8808a882474de0b08f640e2849ebc6"><enum>(k)</enum><header>No per capita payments</header><text>No principal or interest amount in any account established by this section shall be distributed to any member of the Fort Belknap Indian Community on a per capita basis.</text></subsection><subsection id="id3cbd571bee454e13a3c069912dd0239c"><enum>(l)</enum><header>Effect</header><text>Nothing in this Act entitles the Fort Belknap Indian Community to judicial review of a determination of the Secretary regarding whether to approve a Tribal management plan under paragraph (1) or an expenditure plan under paragraph (2), except as provided under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>). </text></subsection></section><section id="id902d7bd4347146dd87b5026d59699388"><enum>13.</enum><header>Fort Belknap Indian Community Water Settlement Implementation Fund</header><subsection id="iddc7b0a01f50f46f2a60402ca8f9b7bab"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a non-trust, interest-bearing account to be known as the <quote>Fort Belknap Indian Community Water Settlement Implementation Fund</quote>, to be managed and distributed by the Secretary, for use by the Secretary for carrying out this Act.</text></subsection><subsection id="id2af4ecee7a674e0681e0483750f809a2"><enum>(b)</enum><header>Accounts</header><text>The Secretary shall establish in the Implementation Fund the following accounts:</text><paragraph id="id4879c5c84d064ea3812e84dd6a1e6eea"><enum>(1)</enum><text>The Fort Belknap Indian Irrigation Project System Account.</text></paragraph><paragraph id="id2c182a8ced0646978274a09a5e86ea0f"><enum>(2)</enum><text>The Milk River Project Mitigation Account.</text></paragraph></subsection><subsection id="id22aee216bb8b4a9e8bb28e7f83913498"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit—</text><paragraph id="id24efdfaa50334bbcb4c2b57c84d49d28"><enum>(1)</enum><text>in the Fort Belknap Indian Irrigation Project System Account established under subsection (b)(1), the amount made available pursuant to paragraphs (1)(C) and (2)(A)(iv) of section 14(a); and</text></paragraph><paragraph id="id389dc0c038ea422b850264469ebc65df"><enum>(2)</enum><text>in the Milk River Project Mitigation Account established under subsection (b)(2), the amount made available pursuant to section 14(a)(1)(D).</text></paragraph></subsection><subsection id="id2d47cddb3daf42828b5c621c14d34250"><enum>(d)</enum><header>Uses</header><paragraph id="id5f8ca431c5aa437ca39dc33b8f1feb39"><enum>(1)</enum><header>Fort belknap indian irrigation project system account</header><text>The Fort Belknap Indian Irrigation Project Rehabilitation Account established under subsection (b)(1) shall be used to carry out section 9, except as provided in subsection (g) of that section.</text></paragraph><paragraph id="id57139aba2e574df280b061b90f32bdff"><enum>(2)</enum><header>Milk river project mitigation account</header><text>The Milk River Project Mitigation Account established under subsection (b)(2) may only be used to carry out section 8.</text></paragraph></subsection><subsection id="id00e8691d904d49d9b11ac2c8eb853b28"><enum>(e)</enum><header>Management</header><paragraph id="id92b9d62ab2c54ba5b9a15ae58d315f36"><enum>(1)</enum><header>In general</header><text>Amounts in the Implementation Fund shall not be available to the Secretary for expenditure until the enforceability date.</text></paragraph><paragraph id="id60cb5c4581f44fabac660cfe518afd68"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), amounts deposited in the Fort Belknap Indian Irrigation Project System Account established under subsection (b)(1) shall be available to the Secretary on the date on which the amounts are deposited for uses described in paragraphs (1) and (2) of section 9(a).</text></paragraph></subsection><subsection id="id0f08a9456fe34acf9f07e54b6aed0c58"><enum>(f)</enum><header>Interest</header><text>In addition to the deposits under subsection (c), any interest credited to amounts unexpended in the Implementation Fund are authorized to be appropriated to be used in accordance with the uses described in subsection (d).</text></subsection></section><section id="idec03bddcdd694378b36a59ad1fe50ecb"><enum>14.</enum><header>Funding</header><subsection id="id6e1d2e1ec3d34c3aaee222109a7c5ed3"><enum>(a)</enum><header>Funding</header><paragraph id="idf3e333ec690e4715afd41cefa3b2ea18"><enum>(1)</enum><header>Authorization of appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to the Secretary—</text><subparagraph id="id00ef2ef62eb14b6ab5ed42b4a6c32093"><enum>(A)</enum><text>for deposit in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account of the Trust Fund established under section 12(b)(1), $89,643,100, to be retained until expended, withdrawn, or reverted to the general fund of the Treasury;</text></subparagraph><subparagraph id="ida386fb8d645d4c9c82250ad7ff14b97a"><enum>(B)</enum><text>for deposit in the Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account of the Trust Fund established under section 12(b)(3), $157,371,593, to be retained until expended, withdrawn, or reverted to the general fund of the Treasury;</text></subparagraph><subparagraph id="id74f49bc0f7fa43c4a23efa7c1b0ca921"><enum>(C)</enum><text>for deposit in the Fort Belknap Indian Irrigation Project System Account of the Implementation Fund established under section 13(b)(1), such sums as are necessary, but not more than $187,124,469, for the Secretary to carry out section 9, to be retained until expended, withdrawn, or reverted to the general fund of the Treasury; and</text></subparagraph><subparagraph id="id521bf0576d3f4afd8cacd4ed5e8d881a"><enum>(D)</enum><text>for deposit in the Milk River Project Mitigation Account of the Implementation Fund established under section 13(b)(2), such sums as are necessary, but not more than $300,000,000, for the Secretary to carry out obligations of the Secretary under section 8, to be retained until expended, withdrawn, or reverted to the general fund of the Treasury. </text></subparagraph></paragraph><paragraph id="idc6d748e2e27945b3ae4891bd52da449d"><enum>(2)</enum><header>Mandatory appropriations</header><subparagraph id="id9b7ed9454b5c4a60afdeb49de7a96f48"><enum>(A)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit—</text><clause id="id205125b5e32d489e85b50b33e68ceb26"><enum>(i)</enum><text>in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account of the Trust Fund established under section 12(b)(1), $29,881,034, to be retained until expended, withdrawn, or reverted to the general fund of the Treasury; </text></clause><clause id="idd003243fc3264907b3283122a0386b39"><enum>(ii)</enum><text>in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, and Maintenance Account of the Trust Fund established under section 12(b)(2), $66,630,752; </text></clause><clause id="idb2943c01593c44d8800d6b6cf931e740"><enum>(iii)</enum><text>in the Fort Belknap Indian Community Clean and Safe Domestic Water and Sewer Systems, and Lake Elwell Project Account of the Trust Fund established under section 12(b)(3), $110,628,407; and</text></clause><clause id="id611d9c093e44436b8a02aa70bb9ef850"><enum>(iv)</enum><text>in the Fort Belknap Indian Irrigation Project System Account of the Implementation Fund established under section 13(b)(1), $228,717,684. </text></clause></subparagraph><subparagraph id="id165cf302f84d42709c96cf88e12c8121"><enum>(B)</enum><header>Availability</header><text>Amounts deposited in the Trust Fund under subparagraph (A) shall be available without further appropriation.</text></subparagraph></paragraph><paragraph id="id6fd179d3601c406f9440b86a2fecab66"><enum>(3)</enum><header>State cost share</header><text>The State shall contribute $5,000,000, plus any earned interest, payable to the Secretary for deposit in the Fort Belknap Indian Community Tribal Irrigation and Other Water Resources Development Account of the Trust Fund established under section 12(b)(1) on approval of a final decree by the Montana Water Court for the purpose of activities relating to the Upper Peoples Creek Dam and Reservoir under subparagraphs (A) through (C) of section 12(g)(1).</text></paragraph></subsection><subsection id="idd640dd4736ee45c5a6b255053136cc3a"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="id1961ea59b2144d89b258db1a2510848f"><enum>(1)</enum><header>In general</header><text>The amounts authorized to be appropriated under paragraphs (1) and (2) of subsection (a) and this subsection shall be—</text><subparagraph id="idc652d77a0dee4a4ea2033561d27f9c2c"><enum>(A)</enum><text>increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs occurring after the date of enactment of this Act as indicated by the Bureau of Reclamation Construction Cost Index—Composite Trend; and</text></subparagraph><subparagraph id="idaa10a66ad1594546803406fbb718d140"><enum>(B)</enum><text>adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></subparagraph></paragraph><paragraph id="idadc381b55b764eb299a9c108562f253e"><enum>(2)</enum><header>Repetition</header><text>The adjustment process under paragraph (1) shall be repeated for each subsequent amount appropriated until the amount authorized to be appropriated under subsection (a), as adjusted, has been appropriated.<italic></italic></text></paragraph><paragraph id="id32419f946107439b9d97295489c7a5f6"><enum>(3)</enum><header>Period of indexing</header><subparagraph id="id4e6fb1c42ca148e19a10a5f52a14c547"><enum>(A)</enum><header>Trust fund</header><text>With respect to the Trust Fund, the period of indexing adjustment under paragraph (1) for any increment of funding shall end on the date on which the funds are deposited into the Trust Fund.</text></subparagraph><subparagraph id="id4785136b9ac842d4a6dec065bd221252"><enum>(B)</enum><header>Implementation fund</header><text>With respect to the Implementation Fund, the period of adjustment under paragraph (1) for any increment of funding shall be annually.</text></subparagraph></paragraph></subsection></section><section id="id06c09d32fa42436a8c4009c34025700b"><enum>15.</enum><header>Miscellaneous provisions</header><subsection id="id3933f5ac6e0841d8a4d9c5e61c8fbe79"><enum>(a)</enum><header>Waiver of sovereign immunity by the united states</header><text>Except as provided in subsections (a) through (c) of section 208 of the Department of Justice Appropriation Act, 1953 (<external-xref legal-doc="usc" parsable-cite="usc/43/666">43 U.S.C. 666</external-xref>), nothing in this Act waives the sovereign immunity of the United States.</text></subsection><subsection id="id5fbef40422004ba98d58c84eccb7dee4"><enum>(b)</enum><header>Other tribes not adversely affected</header><text>Nothing in this Act quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, or community other than the Fort Belknap Indian Community.</text></subsection><subsection id="id6db1e17279ae470b9b06ff65b68546d9"><enum>(c)</enum><header>Elimination of debts or liens against allotments of the fort belknap indian community members within the fort belknap indian irrigation project</header><text>On the date of enactment of this Act, the Secretary shall cancel and eliminate all debts or liens against the allotments of land held by the Fort Belknap Indian Community and the members of the Fort Belknap Indian Community due to construction assessments and annual operation and maintenance charges relating to the Fort Belknap Indian Irrigation Project.</text></subsection><subsection id="idee3f3c5299024c7ab4aade3d61c70b03"><enum>(d)</enum><header>Effect on current law</header><text>Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection><subsection id="id6f7a43ffeaf54df29b3933ef06f583e9"><enum>(e)</enum><header>Effect on reclamation laws</header><text>The activities carried out by the Commissioner under this Act shall not establish a precedent or impact the authority provided under any other provision of the reclamation laws, including—</text><paragraph id="id435d9567c85344ceaf9a9cd466f725f1"><enum>(1)</enum><text>the Reclamation Rural Water Supply Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2401">43 U.S.C. 2401 et seq.</external-xref>); and</text></paragraph><paragraph id="id2aae7392237645b4bd16ea6407eb163c"><enum>(2)</enum><text>the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 991).</text></paragraph></subsection><subsection id="id33b515d3db1b4a8e8fd6f0ac74a27e1a"><enum>(f)</enum><header>Additional funding</header><text>Nothing in this Act prohibits the Fort Belknap Indian Community from seeking—</text><paragraph id="idc500894fc2a84490ac20a7cd14a08cd5"><enum>(1)</enum><text>additional funds for Tribal programs or purposes; or</text></paragraph><paragraph id="id956b0811d90942099461b04a04151182"><enum>(2)</enum><text>funding from the United States or the State based on the status of the Fort Belknap Indian Community as an Indian Tribe.</text></paragraph></subsection><subsection id="id26aa69c6f51844f69e21be79d31d2644"><enum>(g)</enum><header>Rights under state law</header><text>Except as provided in section 1 of Article III of the Compact (relating to the closing of certain water basins in the State to new appropriations in accordance with the laws of the State), nothing in this Act or the Compact precludes the acquisition or exercise of a right arising under State law (as defined in section 6 of Article II of the Compact) to the use of water by the Fort Belknap Indian Community, or a member or allottee of the Fort Belknap Indian Community, outside the Reservation by—</text><paragraph id="ide8af7ede01554f18a65ba5d81ff77a35"><enum>(1)</enum><text>purchase of the right; or</text></paragraph><paragraph id="id920ce3abb2914a51b9ca35e6ebd5d1df"><enum>(2)</enum><text>submitting to the State an application in accordance with State law.</text></paragraph></subsection><subsection id="id415b86a154ba4a5ea436cd9febbe3ff3"><enum>(h)</enum><header>Water storage and importation</header><text>Nothing in this Act or the Compact prevents the Fort Belknap Indian Community from participating in any project to import water to, or to add storage in, the Milk River Basin.</text></subsection></section><section id="id02f5ff2635784089853bdc2270ab3ccb"><enum>16.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this Act, including any obligation or activity under the Compact, if—</text><paragraph id="id89bcd014aa5c43eaa964b4cc4ad1d62d"><enum>(1)</enum><text>adequate appropriations are not provided by Congress expressly to carry out the purposes of this Act; or</text></paragraph><paragraph id="idecf1417fd188461dbf507d46558f1e0d" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>there are not enough funds available in the Reclamation Water Settlements Fund established by section 10501(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(a)</external-xref>) to carry out the purposes of this Act.</text></paragraph></section></legis-body></bill>
