<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/51/511">chapter 511</external-xref> of title 51, United States Code, to modify the authority for space transportation infrastructure modernization grants, and for other purposes. </official-title>

<section id="id06ac7f88b1884d1e8c2dd33b701358af" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spaceport Project Opportunities for Resilient Transportation Act</short-title></quote> or the <quote><short-title>SPACEPORT Act</short-title></quote>.</text></section> <section id="ide84b6982ed3c4ac68663404a9518a009" section-type="subsequent-section"><enum>2.</enum><header>Space launch infrastructure</header> <subsection id="idcca12b24d0ba49289d175befa32cb2d6"><enum>(a)</enum><header>Modification of grant authority</header> <paragraph commented="no" display-inline="no-display-inline" id="id1a78c6a7137842fe9791729c1be89e86"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (b) of section 51102 of title 51, United States Code, is amended to read as follows:</text>

<subsection id="ideabc19b01693460692b731d3b6614995"><enum>(b)</enum><header>Limitations</header>
<paragraph commented="no" display-inline="no-display-inline" id="idde0b464493af4021b0601d8ce174d32b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may make a project grant under this chapter only if the grant will not be for more than 90 percent of the total cost of the project. </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id545ea8f26e294ba28ee3d2bbb7d8d6ed"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive the application of paragraph (1) if the Secretary determines that such a waiver is in the national interest.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id95fdb5992e49424391d37463dc70e54d"><enum>(b)</enum><header>Eligibility criteria</header><text>Section 51103 of title 51, United States Code, is amended—</text> <paragraph id="idd04ddb684245471e9f9f77f58fbb58b7"><enum>(1)</enum><text>in subsection (b)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id22f6da9740424a5cb3c9e0ef52c1839c"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> <clause id="id067f3f34d10843ecb7164c4d30394525"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>the United States Government’s space transportation needs</quote> and inserting <quote>the civil, national security, and commercial space transportation needs of the United States</quote>; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id799b544750a14f32a72f29b775201bbb"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>contributions</quote> and inserting <quote>support</quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="id409f4c29ab3d4ef7915b516cba2a60e0"><enum>(iii)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>, as needed.</quote>; </text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idee38f662e96b45c2b04c3e986363dfbc"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id904B3EA8ED294F7DB44BED040FAFE3E5"> <paragraph id="id4b191c4d65ad4eebbe8ce4efd75759a9" indent="up1"><enum>(2)</enum><text>The Secretary of Transportation shall develop specific criteria for evaluating and selecting proposed projects based on the considerations under paragraph (1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="id8580d659aa114e57a62604453f3c4df0"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idE0827EDC9DEA4AF8A607BA7D51834FBA"> <paragraph id="ida5b84c9be96646428b7f29655217bec6" indent="up1"><enum>(3)</enum><text>The Secretary of Transportation shall consult with the Secretary of Defense, the Administrator of the National Aeronautics and Space Administration, the Secretary of Commerce, and the heads of other appropriate agencies of the Government with respect to subparagraphs (A) and (F) of paragraph (1), as appropriate.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id187eb7afde1e4574bcb6e862b26d1e0a"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="id738CCCDCA3D74C43B82BE9D7033E0182"> <subsection commented="no" display-inline="no-display-inline" id="ide8201a880dd54b48a398dbd87f142016"><enum>(e)</enum><header>Funding of program</header><text>Activities carried out under this section shall be funded only through appropriations approved by Congress and not through user fees or other funds.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id9b08f3af0a43494b92764c7a57ff1993"><enum>(c)</enum><header>Report</header>
<paragraph commented="no" display-inline="no-display-inline" id="ide7337f534ebf49d7b4652807f181ab4f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary of Transportation, in consultation with the Secretary of Defense, the Administrator of the National Aeronautics and Space Administration, the Secretary of Commerce, and the heads of other appropriate agencies of the Government, shall submit to Congress a report that—</text> <subparagraph id="id75459cac037842fabe3d1344f3f0cbbc"><enum>(A)</enum><text>evaluates the demand for space transportation services, including the civil, national security, and commercial space transportation needs of the United States and international commercial markets; </text></subparagraph>
<subparagraph id="id188663c62cac419bb165294ed3dbc312"><enum>(B)</enum><text>provides legislative, regulatory, and policy recommendations to ensure robust and resilient space transportation capabilities in support of the national space policy;</text></subparagraph> <subparagraph id="id4c3049c9022e4d4a97741e1e3a840bad"><enum>(C)</enum><text>examines a range of long-term funding options and related considerations for space transportation infrastructure projects; and</text></subparagraph>
<subparagraph id="ide5ea4f7923ba4dad9d749d7b8a5970e0"><enum>(D)</enum><text>provides an assessment of international space transportation capabilities and investments, including recommendations for maintaining United States competitiveness and developing an international space transportation network.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idd554b804af5545cbb5d1d6d93c8702dd"><enum>(2)</enum><header>Updates</header><text>Not later than 6 years after the date of the enactment of this Act, and every 4 years thereafter, the Secretary of Transportation shall—</text>
<subparagraph id="id9ec7cbf1208a40169f49ebbb65f0c5b5"><enum>(A)</enum><text>update the report submitted under paragraph (1); and</text></subparagraph> <subparagraph id="id8603a93978444c31bb746fbf26b863a9"><enum>(B)</enum><text>submit such updated report to Congress. </text></subparagraph></paragraph></subsection>
<subsection id="idb7768147657b4b3cbe3af9bec76a84b7"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 51105 of title 51, United States Code, is amended by striking <quote>Not more than</quote> and all that follows through the period at the end and inserting <quote>There is authorized to be appropriated to the Secretary of Transportation for each fiscal year not more than $10,000,000 to make grants under this chapter.</quote>. </text></subsection> <subsection commented="no" display-inline="no-display-inline" id="idc31a269e202d428085d134952b0055b9"><enum>(e)</enum><header>Technical amendments</header> <paragraph commented="no" display-inline="no-display-inline" id="id4ab10811a69140c3a5d3bb6997e6ee1e"><enum>(1)</enum><header>Chapter heading</header><text>The heading of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/51/511">chapter 511</external-xref> of title 51, United States Code, is amended to read as follows:</text>
