which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to develop requirements for military tenant advocates for privatized military housing, and for other purposes.</official-title></form><legis-body><section id="id0bf72f8327a0419f96c4cd223a8ae51f" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Tenant Advocacy Improvement Act</short-title></quote>.</text></section><section id="id90e08c002e9e49c79403c788ee43d97f"><enum>2.</enum><header>Requirements for military tenant advocates for privatized military housing</header><subsection id="id35B44957D6FA4F84940FD88A97F31C3B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2890">section 2890</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8F06B77BA7034DE6BA3F37A802AF3968"><section id="idF2E6EC6C94B94CEDAAF961B5CA41BB99"><enum>2890a.</enum><header>Military tenant advocates</header><subsection id="id418FA60C97594F88907F0ADF4BA4B9AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that each installation of the Department of Defense at which military housing under subchapter IV of this chapter is offered has a military tenant advocate employed by the military department concerned.</text></subsection><subsection id="idCD6A0AAD0BE447ECBB85CD2F09D54112"><enum>(b)</enum><header>Training and certification</header><paragraph commented="no" display-inline="yes-display-inline" id="idF9B74DA5B7744BEA9FBBF65696579CB6"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall implement a uniform training and certification program for all individuals serving or selected to serve as a military tenant advocate under subsection (a).</text></paragraph><paragraph id="id10c63ef419de4e2992ef7d93302af0cf" indent="up1"><enum>(2)</enum><text>The training and certification program under paragraph (1) shall include, at a minimum, instruction on the following:</text><subparagraph id="id0ef9239897584ea88d0905d223a1e69e"><enum>(A)</enum><text>The authority of the Secretary to provide military housing under subchapter IV of this chapter.</text></subparagraph><subparagraph id="id240101cfbe5c4eafba2f217519dcabc1"><enum>(B)</enum><text>The role, authority, and responsibility of housing management offices.</text></subparagraph><subparagraph id="id9e0cd5625cdd4e97b34bd514d16b7610"><enum>(C)</enum><text>The Military Housing Privatization Initiative Tenant Bill of Rights developed under section 2890 of this title.</text></subparagraph><subparagraph id="id2136814783b844cd828507b891af00e5"><enum>(D)</enum><text>The dispute resolution process under section 2894 of this title.</text></subparagraph><subparagraph id="idd14205824e294d97afc3a0f0301b5529"><enum>(E)</enum><text>The resources available to tenants of military housing under subchapter IV of this chapter to ensure that all such tenants are living in housing that meets the standards described in the Military Housing Privatization Initiative Tenant Bill of Rights.</text></subparagraph><subparagraph id="id77f309398a404d4ca8d0a424e704582e"><enum>(F)</enum><text>Relevant national, State, and local housing, disability, and environmental laws.</text></subparagraph></paragraph></subsection><subsection id="ida73f3408da874e039962f5b853e3ddce"><enum>(c)</enum><header>Outreach</header><text>The Secretary shall conduct public outreach and education at each installation of the Department with a military tenant advocate under subsection (a) to provide members of the armed forces and their families with information on the identity, role, and authority of the military tenant advocate.</text></subsection><subsection id="idf84e6164d4374e77893ee8debdf0c99a"><enum>(d)</enum><header>Hiring</header><text>When hiring or selecting individuals to serve in the role of military tenant advocate under subsection (a), no preferential consideration shall be given to individuals currently or previously employed by—</text><paragraph id="idE7B74AC3BF6C4FD0B183DF0505FAEA4B"><enum>(1)</enum><text>a housing management office;</text></paragraph><paragraph id="idB4FCC54D9303433BBB16E6D68F792FB7"><enum>(2)</enum><text>a garrison command; or</text></paragraph><paragraph id="idC7275904721F43848A627BDECEFFBCFC"><enum>(3)</enum><text>a housing provider or manager owning or operating military housing under subchapter IV of this chapter.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id510FAB472CBC4F22AA52D599823536AA"><enum>(b)</enum><header>Clerical and conforming amendments</header><paragraph id="id87C85CFD21E44C318593E5D76A1EE721"><enum>(1)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by inserting after the item relating to section 2890 the following new item:</text><quoted-block style="USC" id="id72cea0a8-6772-4442-820e-0bd1b4583dce"><toc><toc-entry level="section" idref="idF2E6EC6C94B94CEDAAF961B5CA41BB99">2890a. Military tenant advocates.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id60EF08556C574D118AD67E07BD4D4F16"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="idB35F56E0CA6F441597EBD15E0C3DDAFB"><enum>(A)</enum><header>Rights and responsibilities of tenants</header><text>Section 2890(b) of title 10, United States Code, is amended—</text><clause id="idD3364D1BEC3F42E9930C99750B847590"><enum>(i)</enum><text>in paragraph (5), by inserting <quote>under section 2890a of this title</quote> after <quote>advocate</quote>; and</text></clause><clause id="idD1713BE482664B138A9DF9185CCFE55E"><enum>(ii)</enum><text>in paragraph (8), by striking <quote>, as provided in section 2894(b)(4) of this title,</quote> and inserting <quote>under section 2890a of this title</quote>.</text></clause></subparagraph><subparagraph id="id54797E315C3D4BD9BFDF4C356CBCFE1C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Dispute resolution process</header><text>Section 2894(b)(4) of such title is amended by striking <quote>military housing advocate employed by the military department concerned</quote> and inserting <quote>military tenant advocate under section 2890a of this title</quote>.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
