which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the declaration of a Federal emergency relating to abortion.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Federal Emergencies for Abortion Act</short-title></quote>.</text></section><section id="idC8A3D6FDB64C4C69AC1DEE1D4A95CC5C"><enum>2.</enum><header>Prohibition on declaration of Federal emergency relating to abortion</header><subsection id="id79A168E8CFAF49E987305798A335656B"><enum>(a)</enum><header>Prohibition on declarations of national emergencies relating to abortion under National Emergencies Act</header><text display-inline="yes-display-inline">Section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9B8E0389E2E1449E8902863D958C9B48"><subsection id="id3D80E211701D47469AD8E16D7E9ABBB9"><enum>(c)</enum><header>Prohibition on declaring national emergences relating to abortion</header><paragraph id="idF6B0A32255A64584A50BEC6C04F14061"><enum>(1)</enum><header>In general</header><text>The President may not declare a national emergency under subsection (a) for purposes of—</text><subparagraph id="id2e857cd978df4509877b7d0dc5501e90"><enum>(A)</enum><text>promoting, supporting, or expanding access to abortion; or </text></subparagraph><subparagraph id="id1711BAC773EE48899C64866B6169A647"><enum>(B)</enum><text>taking adverse action against or litigating against States that prohibit or otherwise restrict abortion.</text></subparagraph></paragraph><paragraph id="id8204e519e514499a81b42d71ef63c52d"><enum>(2)</enum><header>Abortion defined</header><text>In this subsection, the term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or other substance or device to intentionally—</text><subparagraph id="id876e761cd40a44e081f4f213baf9b968"><enum>(A)</enum><text>kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="id03a642f1cdff455bb442584262c578aa"><enum>(B)</enum><text>prematurely terminate the pregnancy of a woman known to be pregnant, with an intention other than to—</text><clause id="id1cc90f6f67ce4106b1dac1fdc6e4e24e"><enum>(i)</enum><text>increase the probability of a live birth or of preserving the life or health of the child after live birth; or</text></clause><clause id="ide22ddc637ad341e1b765fa937ec7d91e"><enum>(ii)</enum><text>remove a dead unborn child.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCF1112B897E9408BA8AC5B7CC9D5A768"><enum>(b)</enum><header>Public Health Service Act</header><text>Section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id991981FE5246428EB8EB81F7CD90F83D"><subsection id="id0A87180A9BED4297825B8F2DB254F73F"><enum>(g)</enum><header>Limitation</header><paragraph id="id6A5420548DFE4226A6953BF86007E637"><enum>(1)</enum><header>In general</header><text>Notwithstanding this section, the Secretary may not declare a public health emergency under this section for the purpose of—</text><subparagraph id="idC91483E44F5949F9BBD0A753FC18E0A4"><enum>(A)</enum><text>promoting, supporting, or expanding access to abortion; or</text></subparagraph><subparagraph id="id408FA594493E40BCAC0B45E0F36C3645"><enum>(B)</enum><text>taking adverse action against or litigating against States that prohibit or otherwise restrict abortion.</text></subparagraph></paragraph><paragraph id="idB8DE9D57D7A545C7858C589D102EF377"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or other substance or device to intentionally—</text><subparagraph id="id9E4B68BD71DF48168F2212F9AFCB094E"><enum>(A)</enum><text>kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="id724E3BF7B0954C6BAB81E0C4C92A56D0"><enum>(B)</enum><text>prematurely terminate the pregnancy of a woman known to be pregnant, with an intention other than to—</text><clause id="idD6270101EC45484988F8370BC7CFE07C"><enum>(i)</enum><text>increase the probability of a live birth or of preserving the life or health of the child after live birth; or</text></clause><clause id="idED7CAAD3C0AC42A286D9ECA9E5B109E3"><enum>(ii)</enum><text>remove a dead unborn child.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idC441BD3803434B83865646A15756CAAF"><enum>(c)</enum><header>Emergency declarations under the Robert T. Stafford Disaster Relief and Emergency Assistance Act</header><text display-inline="yes-display-inline">Section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE10C80BD6F38467C98A3B04B615BB058"><subsection id="id07171A29C94B4E6883A62ED8BC33C15C"><enum>(d)</enum><header>Prohibition on declarations relating to abortion</header><paragraph id="idE8091BFDC54C41E09E9F643A97B2CAED"><enum>(1)</enum><header>Abortion defined</header><text>In this subsection, the term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or other substance or device to intentionally—</text><subparagraph id="id8EB782AD660D4DB984CC51CE3AEB2EE4"><enum>(A)</enum><text>kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="id64663529DD6E4FBC8D65843F2082E944"><enum>(B)</enum><text>prematurely terminate the pregnancy of a woman known to be pregnant, with an intention other than to—</text><clause id="idB922165DE87E494CA40502CEDC0C4F95"><enum>(i)</enum><text>increase the probability of a live birth or of preserving the life or health of the child after live birth; or</text></clause><clause id="id415356728EFC4165968F89FFE2D01205"><enum>(ii)</enum><text>remove a dead unborn child.</text></clause></subparagraph></paragraph><paragraph id="idAD548C692CE44761800C76E8FCF3DD7B"><enum>(2)</enum><header>Prohibition</header><text>The President may not declare that an emergency exists under subsection (a) for the purpose of—</text><subparagraph id="id8C7D5C07347C4BE0B7C05137BFB3564B"><enum>(A)</enum><text>promoting, supporting, or expanding access to abortion; or</text></subparagraph><subparagraph id="id856D05B30D2B4B4586B8609E6A8B136B"><enum>(B)</enum><text>taking adverse action against or litigating against States that prohibit or otherwise restrict abortion.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
