which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit airport improvement grants funds from being used for contracts with entities that have violated intellectual property rights of United States entities.</official-title></form><legis-body><section id="idb6c2840a00a9465f964369db7ca7267c" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airport Infrastructure Resources Security Act of 2023 </short-title></quote> or the <quote><short-title>AIR Security Act</short-title></quote>.</text></section><section id="id2c52a1710c814cb19b8b88e405470fa8"><enum>2.</enum><header>Prohibition on provision of airport improvement grant funds to certain entities that have violated intellectual property rights of United States entities</header><subsection id="id20793fa5a11d43bdb18023307d61b358"><enum>(a)</enum><header>In general</header><text>During the period beginning on the date that is 30 days after the date of the enactment of this Act, amounts provided as project grants under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/471">chapter 471</external-xref> of title 49, United States Code, may not be used to enter into a contract described in subsection (b) with any entity on the list required by subsection (c).</text></subsection><subsection id="ida428396ed62544618dfb1ff2092138f0"><enum>(b)</enum><header>Contract described</header><text>A contract described in this subsection is a contract or other agreement for the procurement of infrastructure or equipment for a passenger boarding bridge at an airport.</text></subsection><subsection id="idc105ba3e0cd143ebb50f817e30938e14"><enum>(c)</enum><header>List required</header><paragraph id="ida3a7db2b46e947e2a5aee9d0b6c21e35"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, and thereafter as required by paragraph (2), the United States Trade Representative, the Attorney General, and the Administrator of the Federal Aviation Administration shall make available a publicly-available a list of entities manufacturing airport passenger boarding infrastructure or equipment that—</text><subparagraph id="id77aff0cad6854084b7a2bc5c3297ff14" commented="no"><enum>(A)</enum><text>are owned, directed by, or subsidized in whole, or in part by the People’s Republic of China;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85c4008d062446f29ee18d5e669e76c9"><enum>(B)</enum><text display-inline="yes-display-inline">have been determined by a Federal court to have misappropriated intellectual property or trade secrets from an entity organized under the laws of the United States or any jurisdiction within the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ca392d1c7304cda99b0673356b88140"><enum>(C)</enum><text display-inline="yes-display-inline">own or control, are owned or controlled by, are under common ownership or control with, or are successors to, an entity described in subparagraph (A);</text></subparagraph><subparagraph id="idc91e000e62f64164b91df0fb90cdb3cc" commented="no"><enum>(D)</enum><text>own or control, are under common ownership or control with, or are successors to, an entity described in subparagraph (A); or</text></subparagraph><subparagraph id="ide4e550fd072c4b839f5f976dac7342bd" commented="no"><enum>(E)</enum><text>have entered into an agreement with or accepted funding from, whether in the form of minority investment interest or debt, have entered into a partnership with, or have entered into another contractual or other written arrangement with, an entity described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id18dbc759a6a84b23a61056a9d5abb60b"><enum>(2)</enum><header>Updates to list</header><text>The United States Trade Representative shall update the list required by paragraph (1), based on information provided by the Attorney General and the Administrator of the Federal Aviation Administration—</text><subparagraph id="id3dd46e13e41740b99afd5ea968e7b9a3"><enum>(A)</enum><text>not less frequently than every 90 days during the 180-day period following the initial publication of the list under paragraph (1); and</text></subparagraph><subparagraph id="id046bcfaec9f844d5a41279d04e6e5a21"><enum>(B)</enum><text>not less frequently than annually thereafter.</text></subparagraph></paragraph></subsection><subsection id="id155944d2420b488fb214abb74757a288"><enum>(d)</enum><header>Definitions</header><text>In this section, the definitions in section 47102 of title 49, United States Code, shall apply.</text></subsection></section></legis-body></bill>
