which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide increased funding and opportunities to achieve national, long-term production goals for sustainable aviation fuel, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Aviation Emissions Reduction Opportunities Act</short-title></quote> or the <quote><short-title>AAERO Act</short-title></quote>.</text></section><section id="H3A68AFF65A714B62B9B089E7923F2508" section-type="subsequent-section"><enum>2.</enum><header>Alternative fuel and low-emission aviation technology program</header><subsection commented="no" display-inline="no-display-inline" id="idd0783518c7424ab9b17adb763c14bcf5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 40007 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/49/44504">49 U.S.C. 44504</external-xref> note) is amended—</text><paragraph id="id36e2c955f3d647b4955f0e789f1fa215"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id692f25314de24729baa83d785c3e50ec"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (5) as paragraphs (4) through (7), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfef29cf7c8f54efd94bf9a557a1e5973"><enum>(B)</enum><text>by redesignating paragraph (1) as paragraph (2);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36862d63e2684204a7ed9846195b0824"><enum>(C)</enum><text>by inserting before paragraph (2) (as redesignated by subparagraph (B)), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA613A62FE0364604B74818B30D0EF9CD"><paragraph id="idabbcbbc4779c43c3b586260a0d55c0a4"><enum>(1)</enum><text>the importance of using grants to assist with capital expenditures for facilities deploying technologies that are scalable and can help meet national long-term sustainable aviation fuel production goals established under the Sustainable Aviation Fuel Grand Challenge Memorandum; </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ada0f7ba8ee4399a7a3c82ec6b58873"><enum>(D)</enum><text>by inserting after paragraph (2) (as redesignated by subparagraph (B)), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9DA413BB00A641EF91424E615E189A04"><paragraph id="id25e1426284ca40e3b4a9378cdbf73aec"><enum>(3)</enum><text>the capacity of the project to scale to help meet national long-term sustainable aviation fuel production goals established under the Sustainable Aviation Fuel Grand Challenge Memorandum;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="iddea44b8c415c4b9fa46dc799144d31a5"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id15294705f9d648e6ba0e4758eb71b65f"><enum>(A)</enum><text>by striking <quote>shall be 75 percent</quote> and inserting <quote>shall not exceed 75 percent</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33d5a1e21eb64467bc0f2ac83b9389b8"><enum>(B)</enum><text>by striking <quote>shall increase to 90 percent</quote> and inserting <quote>may be increased to 90 percent</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaee809f3ac4d4573b109fbc1ed81f032"><enum>(C)</enum><text>by inserting <quote>, and requests an increase in the Federal share</quote> before the period;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ba9b9c1dbab4301ac1ca95e24d1c264"><enum>(3)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0EE55CE63F264E35AE5864EA97A289AB"><subsection id="H3D275C23B0984199B438D4EB1B72363A" commented="no"><enum>(d)</enum><header>Lifecycle greenhouse gas emissions reduction percentage</header><text display-inline="yes-display-inline">For purposes of subsection (e)(6)(C), the term <quote><term>lifecycle greenhouse gas emissions reduction percentage</term></quote> means, with respect to any sustainable aviation fuel, the percentage reduction in lifecycle greenhouse gas emissions achieved by such fuel as compared with petroleum-based jet fuel, as defined in accordance with any one or more of the following:</text><paragraph id="H49A97D2D381C4857B80E1AB74ECD17DB"><enum>(1)</enum><text>The most recent Carbon Offsetting and Reduction Scheme for International Aviation which has been adopted by the International Civil Aviation Organization with the agreement of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c7937c3dbe3491f803021196b6a6531"><enum>(2)</enum><text>The most recent version of the Argonne National Laboratory Greenhouse gases, Regulated Emissions, and Energy use in Technologies (GREET) model, as determined by the Secretary of Energy.</text></paragraph><paragraph id="HDE15E3CE78E9488AB22C6036BE7E8F07"><enum>(3)</enum><text>Any similar methodology which satisfies the criteria under section 211(o)(1)(H) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)(H)</external-xref>), as in effect on the date of enactment of this section, including the methodology established by the Environmental Protection Agency under subpart M of part 80 of title 40, Code of Federal Regulations.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id144f2ab4f1fc45fcb057de112afe9b37"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaa6b41d622ff4470a06bdb51f1abcae0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraphs (3) and (4), and inserting the following; </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F4B1B26F58141D59476EA327084591F"><paragraph commented="no" display-inline="no-display-inline" id="id690bf7623cb3415c87626daf58b03bf4"><enum>(3)</enum><header>Lifecycle greenhouse gas emissions</header><text display-inline="yes-display-inline">Subject to subsection (d), the term <term>lifecycle greenhouse gas emissions</term> means the aggregate quantity of greenhouse gas emissions (including direct emissions and significant indirect emissions such as significant emissions from land use changes) related to the full fuel lifecycle, including all stages of fuel and feedstock production and distribution, from feedstock generation or extraction through the distribution and delivery and use of the finished fuel to the ultimate consumer, where the mass values for all greenhouse gases are adjusted to account for their relative global warming potential.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id2b2ee1c8308846468046ac0e2247291a"><enum>(B)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0d6e580c6c1f4206ad9a1188fb9e29da"><enum>(C)</enum><text>in paragraph (4)(B) (as redesignated by subparagraph (B)), by striking <quote>increase utilization</quote> and inserting <quote>develop, demonstrate, apply, or produce sustainable aviation fuel that is likely to result in the increased utilization</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id798efc72f68d425dbdb1d431f830e59e"><enum>(D)</enum><text>by striking paragraph (7) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7DB22B7E4450451190094D1AC898A83D"><paragraph id="HEAF43B0CA00644B2A8B7BE67DA913E6F" commented="no"><enum>(6)</enum><header>Sustainable aviation fuel</header><text display-inline="yes-display-inline">The term <quote><term>sustainable aviation fuel</term></quote> means liquid fuel, the portion of which is not kerosene, which—</text><subparagraph id="HF117D66CBC5C42E39EC81980EFCD4734" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">meets the requirements of—</text><clause id="H5D1C8ECAB47344A0825CBB61F20B81E7" commented="no"><enum>(i)</enum><text>ASTM International Standard D7566; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idfad3ebef9c734ee5b1a6e0de0d2924a3"><enum>(ii)</enum><text display-inline="yes-display-inline">the co-processing provisions of ASTM International Standard D1655, Annex A1 (or such successor standard);</text></clause></subparagraph><subparagraph commented="no" id="H6B56F30E48C64B3BBE927F8BBE70E1E1"><enum>(B)</enum><text>is not derived from palm fatty acid distillates or petroleum; and</text></subparagraph><subparagraph id="id6E8A31A3F2654DD99E2A2AA3C140BBF0" commented="no"><enum>(C)</enum><text>in accordance with subsection (d), achieves a lifecycle greenhouse gas emissions reduction percentage of at least 50 percent.</text></subparagraph></paragraph><paragraph id="id213a99345ab740caae307e3357820340"><enum>(7)</enum><header>Sustainable Aviation Fuel Grand Challenge Memorandum</header><text>The term <term>Sustainable Aviation Fuel Grand Challenge Memorandum</term> means the Memorandum of Understanding among the Department of Energy, the Department of Transportation, and the Department of Agriculture (relating to launching a government-wide Sustainable Aviation Fuel Grand Challenge (the Grand Challenge) to reduce the cost, enhance the sustainability, and expand the production and use of Sustainable Aviation Fuel (SAF) that achieves a minimum of a 50 percent reduction in lifecycle greenhouse gas (GHG) emissions compared to conventional fuel to meet a goal of supplying sufficient SAF to meet 100 percent of aviation fuel demand by 2050), signed on September 8, 2021.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d647ff625144c67accaabe8ac0d8a8d"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD2C76A8434AF47AA8C60334171686B7E"><subsection id="id791AB2250E6B4428881E384612808238" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Additional funding</header><text display-inline="yes-display-inline">In addition to the amounts appropriated under subsection (a), there is authorized to be appropriated to the Secretary for fiscal year 2024, to remain available until expended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6eddc0f52c304abb9e7576e6268d7c53"><enum>(1)</enum><text display-inline="yes-display-inline">$489,258,000 for projects described in subsection (a)(1);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14cfd78ed7044f998e6474dbb4c31d19"><enum>(2)</enum><text>$209,682,000 for projects described in subsection (a)(2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e1ac242559f48719d7c2684fc6169fd"><enum>(3)</enum><text>$4,060,000 to carry out subsection (a)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idbd7d06acaee2427da8e3937aac2ba177"><enum>(b)</enum><header>Retroactive effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of section 40007 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>. </text></subsection></section></legis-body></bill>
