<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1952</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230613">June 13, 2023</action-date><action-desc><sponsor name-id="S313">Mr. Sanders</sponsor> (for himself, <cosponsor name-id="S370">Mr. Booker</cosponsor>, and <cosponsor name-id="S422">Mr. Welch</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to expand eligibility for care from the Department of Veterans Affairs to include members of the reserve components of the Armed Forces, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reserve Component Healthcare Access and Expansion Act</short-title></quote>.</text></section><section id="id96d877663c1848d89d4a980e8adb7bcc"><enum>2.</enum><header>Expansion of health care from Department of Veterans Affairs to include members of the reserve components of the Armed Forces who are not on active orders</header><subsection id="id6830f713cbfe456188e93ed8ff5fea54"><enum>(a)</enum><header>Expansion of care</header><paragraph id="id6664AFC313B34B67B6071BB127DE55A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1789 of title 38, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="idF72D862219B74CFC9465B2AA3863C67D"><section id="id5adbfccc0a5746be87298c196779fcc8"><enum>1789.</enum><header>Health care for members of the reserve components of the Armed Forces</header><subsection id="id3FDB1475EA47459CB9E72A375D963A2E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary (subject to subsection (b)) shall furnish hospital care and medical services, including mental health services, to any member of the reserve components of the Armed Forces during any period in which the member is not entitled to benefits under TRICARE Prime (as defined in section 1072(14) of title 10).</text></subsection><subsection id="idb79c218758f6428a9a9b5917b649aa7c"><enum>(b)</enum><header>Limitation</header><text>The requirement in subsection (a) shall be effective in any fiscal year only to the extent and in the amount provided in advance in appropriations Acts for such purpose.</text></subsection><subsection id="id39E864373D2540B18B401E6864176228"><enum>(c)</enum><header>Consultation with Secretary of Defense</header><text>The Secretary shall carry out this section in consultation with the Secretary of Defense.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idACF8FC69C0C246DC9A221215556D6F21"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of subchapter VIII of chapter 17 of such title is amended by striking the item relating to section 1789 and inserting the following new item:</text><quoted-block style="USC" id="id2a021ab4-22a9-47bf-b729-37ed0c6dfeff"><toc><toc-entry level="section" idref="id5adbfccc0a5746be87298c196779fcc8">1789. Health care for members of the reserve components of the Armed Forces.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idDC3AB695B8EC4F95A4B81019F1CFD26F"><enum>(b)</enum><header>Enrollment in patient enrollment system</header><paragraph id="id6D30F8E1B9F34ACFAE356EF33580B609"><enum>(1)</enum><header>Priority for enrollment</header><text>Section 1705(a) of title 38, United States Code, is amended—</text><subparagraph id="id3932214EB7F04C67A02E8EBE1086BBCC"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>enrollment of veterans</quote> and inserting <quote>enrollment of individuals under such system</quote>; and</text></subparagraph><subparagraph id="id141A53564BB64317B2D8CB28626750C1"><enum>(B)</enum><text>in paragraph (7)—</text><clause id="id4E70EA9B3C184C7BA20A93530FDB4255"><enum>(i)</enum><text>by striking <quote>Veterans</quote> and inserting <quote>(A) Veterans</quote>; and</text></clause><clause id="id0A237F11801843CCAA6B12BE2BE8ADB4"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA3F120EDEA3A4BA0A5BDA9789377437F"><subparagraph id="id966B835254094518886A404C1C3B16EC" indent="up1"><enum>(B)</enum><text>Members of the reserve components of the Armed Forces for purposes of furnishing hospital care and medical services under section 1789(a) of this title.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idB1458E6B720C49A69C24D00C9CB3AC99"><enum>(2)</enum><header>Initial enrollment</header><subparagraph commented="no" display-inline="no-display-inline" id="idd850a10101e646ef82e5d74e758a3a1e"><enum>(A)</enum><header>Phased approach</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall implement a phased approach under subparagraphs (B) and (C) to enroll all members of the reserve components of the Armed Forces in the patient enrollment system.</text></subparagraph><subparagraph id="idcf50a52af2a948beb2467d9fa16596d6"><enum>(B)</enum><header>Uninsured</header><text>The Secretary shall ensure that all members of the reserve components of the Armed Forces who are uninsured are enrolled in the patient enrollment system by not later than December 31, 2023.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79aa0e0ac2344c488b37ab6e0911dd0a"><enum>(C)</enum><header>Other members</header><text display-inline="yes-display-inline">The Secretary shall ensure that all members of the reserve components of the Armed Forces not covered by subparagraph (B) are enrolled in the patient enrollment system by not later than December 31, 2024. </text></subparagraph></paragraph><paragraph id="id6EFAC7B0485041C585C55FB70E61EFF9"><enum>(3)</enum><header>Ongoing enrollment</header><text>After December 31, 2023, the Secretary shall automatically enroll in the patient enrollment system all new members of the reserve components of the Armed Forces upon those members joining the reserve components. </text></paragraph><paragraph id="id0580568345a34a19bcc6d97d3d7f6552"><enum>(4)</enum><header>Study</header><subparagraph commented="no" display-inline="no-display-inline" id="id1923db41c11143c5a59bae8460328214"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a study to evaluate options for improving access to health care for members of the reserve components of the Armed Forces, including by conducting a review of priority groups for enrollment in the patient enrollment system.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c1a07cc2e7d4658a0b96205ea22d07f"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the study conducted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id27E15659A4F4494388E067330D153AC6" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Consultation with Secretary of Defense</header><text display-inline="yes-display-inline">The Secretary shall carry out this subsection and the amendments made by this subsection in consultation with the Secretary of Defense. </text></paragraph><paragraph id="id643AD6B8E3444633A89DBA5F55CC7FFC" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Patient enrollment system defined</header><text>In this subsection, the term <term>patient enrollment system</term> means the system of annual patient enrollment of the Department of Veterans Affairs established and operated under section 1705(a) of title 38, United States Code.</text></paragraph></subsection></section></legis-body></bill>
