<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 194</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230131">January 31, 2023</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S389">Mr. Kennedy</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, and <cosponsor name-id="S378">Mr. Lankford</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the disbursement of Federal funds to State and local governments that allow individuals who are not citizens of the United States to vote in any Federal, State, or local election. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="HCB4060AC91ED4CF4905A1BF16FCA9458"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Democracy by Preventing Foreign Citizens from Voting Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HF52F028F3804440C84098DA017B653F7"><enum>2.</enum><header>Federal payment restriction</header><subsection id="id87168153710449C1927AB80FA20F7AE7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal funds may be made available to any State or local government if such State or local government allows individuals who are not citizens of the United States to vote in any Federal, State, or local election. </text></subsection><subsection id="id10A7FB5A7AED45DAAC8E9A02EFE80548"><enum>(b)</enum><header> Certification</header><text>Upon application, approval, and receipt of any Federal funds, a State or local government shall certify that the State or local government does not permit individuals who are not citizens of the United States to vote in any Federal, State, or local election. </text></subsection><subsection id="H29C6892EBB204568B35D22AEAA62AC97"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The requirements of this section shall only apply with respect to any contract entered into or grant made on or after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
