<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1934</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230613">June 13, 2023</action-date><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> (for himself, <cosponsor name-id="S259">Mr. Reed</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, and <cosponsor name-id="S322">Mr. Merkley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Truth in Lending Act to empower the States to set the maximum annual percentage rates applicable to consumer credit transactions, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id133A0ABD61D94EC5A2E422C492B19018"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering States' Rights To Protect Consumers Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA5126DD10590458AB11A325DCF186C13"><enum>2.</enum><header>Limits on annual percentage rates</header><subsection id="idD930B306F8BB4531B2A8B949BDC86D83"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3BED67CC9E0463784D439CC258EBDEB"><section id="id7BFC393B4DF4426C9AB7381EAFCF1FF4"><enum>140B.</enum><header>Limits on annual percentage rates</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the annual percentage rate applicable to any consumer credit transaction (other than a residential mortgage transaction), including any fees associated with such a transaction, may not exceed the maximum rate permitted by the laws of the State in which the consumer resides.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA48E58776A474906BAA090181FFAF7C7"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for chapter 2 of the Truth in Lending Act is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4DAB09395D5445E5A4A35C641FB9AC57"><toc><toc-entry level="section" bold="off">140B.
