<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1923</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230608">June 12, 2023</action-date><action-desc><sponsor name-id="S372">Mrs. Capito</sponsor> (for herself and <cosponsor name-id="S375">Mr. Daines</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Environmental Protection Agency from finalizing, implementing, or enforcing a proposed rule with respect to new source performance standards from certain stationary sources, and for other purposes.</official-title></form><legis-body><section id="id2b961264e9ac47a591034f73c6bf3b0d" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Power Plants Act of 2023</short-title></quote> or the <quote><short-title>POPP Act of 2023</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="idf3a4fa34cde84d959d8ab6dc5ad5c86d"><enum>(1)</enum><text>the decision of the Supreme Court of the United States in West Virginia v. Environmental Protection Agency (2022) states that Congress must speak clearly if Congress wishes to assign to an agency decisions of vast economic and political significance;</text></paragraph><paragraph id="id438f4d70872140c8a81f0ed0e76f42d7"><enum>(2)</enum><text>Congress has not provided the Environmental Protection Agency with authorization for the proposed rule of the Environmental Protection Agency entitled <quote>New Source Performance Standards for Greenhouse Gas Emissions From New, Modified, and Reconstructed Fossil Fuel-Fired Electric Generating Units; Emission Guidelines for Greenhouse Gas Emissions From Existing Fossil Fuel-Fired Electric Generating Units; and Repeal of the Affordable Clean Energy Rule</quote> (88 Fed. Reg. 33240 (May 23, 2023)), a proposed rule that is intended to completely reshape the electricity grid and therefore has vast economic and political significance;</text></paragraph><paragraph id="id25c3de8e51244b2bae78c44c177d8af0"><enum>(3)</enum><text>section 111 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411</external-xref>) requires the best system of emission reduction to be adequately demonstrated;</text></paragraph><paragraph id="idddabd4ac105640ffbfd8547e594c1e88"><enum>(4)</enum><text>the carbon capture and clean hydrogen technologies proposed as the best system of emission reduction have not been commercially utilized, are not cost-effective, and are not feasible, and are therefore not adequately demonstrated; and</text></paragraph><paragraph id="id11b8b176cc584090a77ed85f709ff851"><enum>(5)</enum><text>the proposed rule described in paragraph (2) is an illegal interpretation of section 111 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411</external-xref>) and has not been authorized by that section or any other provision of Federal law.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id1517bc4e83224b5b88a5fa146822777a"><enum>3.</enum><header>Proposed new source performance standards and emissions guidelines for greenhouse gas emissions from certain stationary sources</header><text display-inline="no-display-inline">The Administrator of the Environmental Protection Agency may not finalize, implement, or enforce the proposed rule of the Environmental Protection Agency entitled <quote>New Source Performance Standards for Greenhouse Gas Emissions From New, Modified, and Reconstructed Fossil Fuel-Fired Electric Generating Units; Emission Guidelines for Greenhouse Gas Emissions From Existing Fossil Fuel-Fired Electric Generating Units; and Repeal of the Affordable Clean Energy Rule</quote> (88 Fed. Reg. 33240 (May 23, 2023)) or a substantially similar rule.</text></section></legis-body></bill>
