<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1921</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230612">June 12, 2023</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S307">Mr. Brown</cosponsor>, and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to prohibit employment of children in tobacco-related agriculture by deeming such employment as oppressive child labor.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD8ADC05C53784DB786597674EF7D74E9"><section section-type="section-one" id="H54EE270FB45F45FA931BA2CCF98A1977"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Children Don't Belong on Tobacco Farms Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id02B9D2100835482CB32A229E003C4F99"><enum>2.</enum><header>Tobacco-related agriculture employment of children</header><text display-inline="no-display-inline">Section 3(l) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(l)</external-xref>) is amended—</text><paragraph id="id8E22D563C500408C8356F85B4D7C3593"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence—</text><subparagraph id="idEEA98BE3F1984444B02C35F134B93F5E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>in any occupation, or (2)</quote> and inserting <quote>in any occupation, (2)</quote>; and</text></subparagraph><subparagraph id="idCA060EE4566544F0BDA4502D3B72E1E4"><enum>(B)</enum><text>by inserting before the semicolon the following: <quote>, or (3) any employee under the age of eighteen years has direct contact with tobacco plants or dried tobacco leaves</quote>; and</text></subparagraph></paragraph><paragraph id="id5D6F73BF8AC94C2EA8946A5B32643244"><enum>(2)</enum><text>in the second sentence, by striking <quote>other than manufacturing and mining</quote> and inserting <quote>, other than manufacturing, mining, and tobacco-related agriculture as described in paragraph (3) of the first sentence of this subsection,</quote>.</text></paragraph></section></legis-body></bill>
