which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish in the Department of State the Office to Monitor and Combat Islamophobia, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0171462038BE4621B22E82039D35E7CD"><section section-type="section-one" id="HD5B1F4437FDE4A31BD1F7C0FFAA8E499"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating International Islamophobia Act</short-title></quote>.</text></section><section id="H48D88EFB2EC3429091D13609F3C7AEE4"><enum>2.</enum><header>Authorization for establishment of Office to Monitor and Combat Islamophobia</header><text display-inline="no-display-inline"> Title I of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HE3357A40833D49AF8784EABF6AEDEFD5"><section id="H467EFE8BC55F46CEA4EC6C3B80A21BE0"><enum>64.</enum><header>Monitoring and combating Islamophobia</header><subsection id="H6E3ABAD21148402B85F10D6C221B1CE1"><enum>(a)</enum><header>Office To Monitor and Combat Islamophobia</header><paragraph id="H098527D3F1B24BAAB61936751383373D"><enum>(1)</enum><header>Establishment</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary of State shall establish within the Department of State an Office to Monitor and Combat Islamophobia (in this section referred to as the <quote>Office</quote>). </text></paragraph><paragraph id="HEE334A4297B34CE4ACC18E5DA2F9835F"><enum>(2)</enum><header>Head of Office</header><subparagraph id="H66299BF817AB488BA66C8774B1B12952"><enum>(A)</enum><header>Special Envoy for Monitoring and Combating Islamophobia</header><text>The head of the Office shall be the Special Envoy for Monitoring and Combating Islamophobia (in this section referred to as the <quote>Special Envoy</quote>) who shall be appointed by the Secretary of State.</text></subparagraph><subparagraph id="H80A09BF24BAA43BBA25E0456795A137A"><enum>(B)</enum><header>Appointment of Special Envoy</header><text>The Secretary may—</text><clause id="id5D00423C09704FC2972F0029A8D567CB"><enum>(i)</enum><text>if considered appropriate by the Secretary, appoint the Special Envoy from among officers and employees of the Department of State; and</text></clause><clause id="id93AFE3B5591845C5AF13F14B67F70278"><enum>(ii)</enum><text>allow any such officer or employee appointed as Special Envoy to retain the position (and the responsibilities associated with such position) held by such officer or employee prior to such appointment.</text></clause></subparagraph></paragraph></subsection><subsection id="H5E095385E5AF47AD8065C5BA76ED8615"><enum>(b)</enum><header>Purpose of Office</header><text>The Office shall be responsible for the following:</text><paragraph id="H5DF288A339414ECB950C498E5C2EC4CB"><enum>(1)</enum><text>Monitoring and combating acts of Islamophobia and Islamophobic incitement that occur in foreign countries.</text></paragraph><paragraph id="H05F7C1C9D51B4998A1EC503512933A18"><enum>(2)</enum><text>Coordinating and assisting in the preparation of that portion of the reports required by sections 116(d)(9) and 502B(k) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref>, 2304(k)) relating to an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement.</text></paragraph><paragraph id="H9FF7C5196F9D4EE1A4F6B96B98274BA5"><enum>(3)</enum><text>Coordinating and assisting in the preparation of that portion of the report required by section 102(b)(1)(A)(viii) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6412">22 U.S.C. 6412(b)(1)(A)(viii)</external-xref>) relating to an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement.</text></paragraph></subsection><subsection id="H57681BB4373142B584E2293956132DE7"><enum>(c)</enum><header>Consultations</header><text>The Special Envoy shall consult with domestic and international nongovernmental organizations and multilateral organizations and institutions, as the Special Envoy considers appropriate, to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFD641B77179C48DE9106432FA4BCAD7A"><enum>3.</enum><header>Inclusion in Department of State annual reports of information concerning acts of Islamophobia in foreign countries</header><subsection id="H0A6C1439757E4543B23EDA655A08A5F3"><enum>(a)</enum><header>Inclusion in annual country reports on human rights practices</header><text>The Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) is amended—</text><paragraph id="HD676E28F6F58444DB8D8862D53F2F5D8"><enum>(1)</enum><text>in section 116(d) (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref>)—</text><subparagraph id="HCC96AA6D10324165AF6157C2546FCA30"><enum>(A)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idEE4FE941B20447F99609DFDE015D0FC1"><enum>(B)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H91DC3CDE5B2F47C7B8F6F074BF2F03B3"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H934FD77733AB40409EECC343CC849751"><paragraph id="H87C78E2C757246B29F3F1190812A844D"><enum>(13)</enum><text>wherever applicable, a description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occurred during the preceding year, including descriptions of—</text><subparagraph id="H842E9CC75BEE46E0AD1CD57456B0D2A9"><enum>(A)</enum><text>acts of physical violence against, or harassment of, members of the Muslim community, and acts of violence against, or vandalism of, Muslim community institutions, including schools, mosques, and cemeteries;</text></subparagraph><subparagraph id="HDF08B1DA7C624100A6A8F4CD9941AEF6"><enum>(B)</enum><text>instances of propaganda in government and nongovernment media that attempt to justify or promote racial hatred or incite acts of violence against members of the Muslim community;</text></subparagraph><subparagraph id="H704F2F756A5B44DBB08473DBF76A78AF"><enum>(C)</enum><text>the actions, if any, taken by the government of that country to respond to such violence and attacks or to eliminate such propaganda or incitement;</text></subparagraph><subparagraph id="H08ED7F7EDAAE441FBFDC1B077F3073D3"><enum>(D)</enum><text>the actions taken by such government to enact and enforce laws relating to the protection of the right to religious freedom of members of the Muslim community; and</text></subparagraph><subparagraph id="H7BD172127BC34A2A977FB3886B23BF0C"><enum>(E)</enum><text>the efforts of such government to promote anti-bias and tolerance education.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HE6D5DCCE259A4EE0AEDF0A5CC16113DC"><enum>(2)</enum><text>in section 502B (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304</external-xref>), by—</text><subparagraph commented="no" id="HD53CFF4C47DD49E7ACD618448B0B3E0D"><enum>(A)</enum><text>redesignating the second subsection (i) (relating to child marriage status) as subsection (j); and</text></subparagraph><subparagraph commented="no" id="HD1DF894436BA40A585A8E7A1903C71E5"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7FE29D2E7CC6485180576598B01AB9AA"><subsection id="H8851595560204899B81157A095A0530C"><enum>(k)</enum><header>Information concerning acts of Islamophobia in foreign countries</header><text display-inline="yes-display-inline">The report required by subsection (b) shall include, wherever applicable, a description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occurred during the preceding year, including descriptions of—</text><paragraph id="H3D1112D65C1546F89D6D4400A3411DDC"><enum>(1)</enum><text>acts of physical violence against, or harassment of, members of the Muslim community, and acts of violence against, or vandalism of, Muslim community institutions, including schools, mosques, and cemeteries;</text></paragraph><paragraph id="HEEB0CAC0E08047929A53A00CEAE9F7CB"><enum>(2)</enum><text>instances of propaganda in government and nongovernment media that attempt to justify or promote racial hatred or incite acts of violence against members of the Muslim community;</text></paragraph><paragraph id="HA8E083C76E4944C09AC5755A17D8C64B"><enum>(3)</enum><text>the actions, if any, taken by the government of that country to respond to such violence and attacks or to eliminate such propaganda or incitement;</text></paragraph><paragraph id="H1F34AE693F7C47898C3BF9010A5BE72D"><enum>(4)</enum><text>the actions taken by such government to enact and enforce laws relating to the protection of the right to religious freedom of members of the Muslim community; and</text></paragraph><paragraph id="HC75A523D7C3C49A9B17BCBFC60D6EF10"><enum>(5)</enum><text>the efforts of such government to promote anti-bias and tolerance education.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H61C9B9E753B54F37BAFFC1926D6F95E9"><enum>(b)</enum><header>Inclusion in annual report on international religious freedom</header><text>Section 102(b)(1)(A) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6412">22 U.S.C. 6412(b)(1)(A)</external-xref>) is amended—</text><paragraph id="HA2BAD158C0B34DFFA828E3C159354727"><enum>(1)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC34909F597ED4DC5A42CA7989D4647A3"><enum>(2)</enum><text>in clause (vii)(II), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H41378AF73F144CBFBB4F79C6248435A6"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" id="H495903031BC64B02A1B7A4B9DBD03635"><clause id="HE34A71B4E225439BAAC63B2824F1EE71"><enum>(viii)</enum><text>wherever applicable, an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occurred in that country during the preceding the year, including—</text><subclause id="HAACC000D112B418E873796B089DB915F"><enum>(I)</enum><text>acts of physical violence against, or harassment of, members of the Muslim community, acts of violence against, or vandalism of, Muslim community institutions, instances of propaganda in government and nongovernment media that incite such acts, and statements and actions relating thereto; and</text></subclause><subclause id="H4F02EB1F5AD9484291FABF4D499B93BC"><enum>(II)</enum><text>the actions taken by the government of that country to respond to such violence and attacks or to eliminate such propaganda or incitement, to enact and enforce laws relating to the protection of the right to religious freedom of members of the Muslim community, and to promote anti-bias and tolerance education.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7F3705706E46493983163C2920D3731F"><enum>(c)</enum><header>Effective date of inclusions</header><text>The amendments made by subsections (a) and (b) shall apply on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
