which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Works and Economic Development Act of 1965 to provide for the establishment of a Critical Supply Chain Site Development grant program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunities for Non-developed Sites to Have Opportunities to be Rehabilitated for Economic Development Act of 2023</short-title></quote> or the <quote><short-title>ONSHORE Act of 2023</short-title></quote>.</text></section><section id="idC5E5EF545F844BFABADFFED5441306AB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 2(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121(a)</external-xref>) is amended—</text><paragraph id="id6E9B3CE9F4504E0AB9AE84C877EFA1CB"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id67A3B3B6413F4071865574C152C0163D"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idE3E06CE2D8874EA7A9FAEC2AD38F045B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD67B7AAC3BE744B09260057864F38967"><paragraph id="id7B8DC09CA5504D59BE3D32AC3F2C9727"><enum>(7)</enum><text>economic development in Tribal nations, States, cities, and rural areas of the United States can be best promoted by assisting communities and regions in developing and implementing cluster-based regional economic and innovation strategies that strengthen critical domestic supply chains, including by promoting industrial site development or expansion projects for the purposes of—</text><subparagraph id="id480E4361759B432FA117F975DE950567"><enum>(A)</enum><text>reshoring companies to the United States; and</text></subparagraph><subparagraph commented="no" id="id3D24707442E644618C2D34DA9AA8BF9C"><enum>(B)</enum><text>incentivizing greenfield foreign direct investments by companies headquartered outside the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id6B77CEBAA46F4EC68A185177235513FD"><enum>3.</enum><header>Critical supply chain site development grant program</header><subsection id="idEFAF93368F914E37B22FF16CD467194A"><enum>(a)</enum><header>In general</header><text>Title II of the Public Works and Economic Development Act of 1965 is amended by inserting after section 207 (<external-xref legal-doc="usc" parsable-cite="usc/42/3147">42 U.S.C. 3147</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB8E744AC2E4B4C358BDB03634EDEEE4F"><section id="idC2C588FD54DE4B38942C6A7EB6321FDE"><enum>208.</enum><header>Critical supply chain site development grant program</header><subsection id="id99D5CFBD2B0042B985A4DCFF6B526601"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a grant program, to be known as the <quote>Critical Supply Chain Site Development grant program</quote> (referred to in this section as the <term>grant program</term>), to provide grants to eligible recipients to carry out site development or expansion projects for the purpose of making the site ready for manufacturing projects, including foreign direct investment projects and advanced manufacturing projects, in industries determined to be of strategic importance by the Secretary.</text></subsection><subsection id="id0663C1ACC96A4F1794085D4E5AB137D6"><enum>(b)</enum><header>Considerations</header><text>In awarding a grant to an eligible recipient under the grant program, the Secretary may consider whether—</text><paragraph id="idD491BE124F784AA9A2FEF4F9BE375F31"><enum>(1)</enum><text>the proposed improvements to the site will improve economic conditions for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id999d31e0e6a048619b0e121a0ca33afa"><enum>(A)</enum><text display-inline="yes-display-inline">rural or Tribal communities; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id67ce988192f344fc9566611efa00e733"><enum>(B)</enum><text display-inline="yes-display-inline">economically disadvantaged regions experiencing chronic high unemployment, underemployment, outmigration, or low per-capita incomes, as determined by the Secretary;</text></subparagraph></paragraph><paragraph id="id1A0EC4113D5D49EC8ABFC7F78492EFB5"><enum>(2)</enum><text>the project is consistent with regional economic development plans, which may include a comprehensive economic development strategy; and</text></paragraph><paragraph id="id4a262eddc77e458f9a264533f39b81f3"><enum>(3)</enum><text>the eligible recipient has initiatives to prioritize job training and workforce development.</text></paragraph></subsection><subsection id="idD250478EE6254F428B900536717FB4CE"><enum>(c)</enum><header>Priority</header><text>In awarding grants to eligible recipients under the grant program, the Secretary shall give priority to eligible recipients that propose to carry out a project that—</text><paragraph id="idF06926B57CB34EA88418FDEA043413A5"><enum>(1)</enum><text>has State, local, private, or nonprofit funds being contributed to assist with site development efforts; and</text></paragraph><paragraph id="idb4588b50d3994809b622b69ec763371c"><enum>(2)</enum><text>supports the domestic manufacturing of technologies in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id530ae2e603e54a2ca1f06a624a827709"><enum>(A)</enum><text display-inline="yes-display-inline">a key technology focus area included on the list required under section 10387(a)(2) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19107">42 U.S.C. 19107(a)(2)</external-xref>) (referred to in this section as a <term>key technology focus area</term>); or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6c8b4e5902f4f8db27195fdb9e5d8d4"><enum>(B)</enum><text display-inline="yes-display-inline">other industries or technology sectors identified by the Secretary, in consultation with the Secretary of Defense, to be critical to national security and economic competitiveness.</text></subparagraph></paragraph></subsection><subsection id="idD109414986DD4484B99AB0110F888808"><enum>(d)</enum><header>Use of funds</header><text>A grant awarded under the grant program may be used for the following activities relating to the development or expansion of a site:</text><paragraph id="idDA616E32022649E197A6D5764FB456D4"><enum>(1)</enum><text>Investments in site utility readiness, including—</text><subparagraph id="id5E610D4632C5430EBD211CFBF13BB866"><enum>(A)</enum><text>construction of on-site utility infrastructure;</text></subparagraph><subparagraph id="idC7944C1F3C674C96B47D34B0D2F65ACC"><enum>(B)</enum><text>construction of last-mile infrastructure, including road infrastructure, water infrastructure, power infrastructure, broadband infrastructure, and other physical last-mile infrastructure;</text></subparagraph><subparagraph id="idD962271D374143CEA86603FEFAE5F0DF"><enum>(C)</enum><text>site grading; and</text></subparagraph><subparagraph id="id0BA2F451C677414EBFC65403CBB25A91"><enum>(D)</enum><text>other activities to extend public utilities or services to a site, as determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="id0751127D6F81480E9408A67AFB8525C3"><enum>(2)</enum><text>Investments in site readiness, including—</text><subparagraph id="idC7DDF05676464D18BEA55CB4639565E6"><enum>(A)</enum><text>land assembly and other land or property acquisition;</text></subparagraph><subparagraph id="id535C177CCCF747728E880A622DA44CA5"><enum>(B)</enum><text>environmental reviews;</text></subparagraph><subparagraph id="id71D63809369E438BA66EBC8F44932391"><enum>(C)</enum><text>zoning;</text></subparagraph><subparagraph id="idB418BDE203164ACEAAF9BD0563FB4FD3"><enum>(D)</enum><text>design;</text></subparagraph><subparagraph id="id2224F8D9350A4EFBB487DA95B2C35033"><enum>(E)</enum><text>engineering; and</text></subparagraph><subparagraph id="idEE08137D9B1C4C979051081B5E728594"><enum>(F)</enum><text>permitting.</text></subparagraph></paragraph><paragraph id="id1878E19BC8BD4635A12F35328C0BA81B"><enum>(3)</enum><text>Investments in workforce development programs, including job training and retraining programs.</text></paragraph><paragraph id="idFD897B7B138F4A3880ABA02195507B75"><enum>(4)</enum><text>Investments to ensure that economically disadvantaged communities have access to on-site jobs.</text></paragraph></subsection><subsection id="id51BC51CA49A94AA2A9D41402AA8C164D"><enum>(e)</enum><header>Minimum number of grants</header><text>Each fiscal year, the Secretary shall award not fewer than 10 grants under the grant program.</text></subsection><subsection id="id55D7AAA54E40424C80B27FFBD462A419"><enum>(f)</enum><header>Grant restrictions</header><text>In awarding grants under the grant program, the Secretary shall not—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e77860941584c868c6f1a99542cba47"><enum>(1)</enum><text display-inline="yes-display-inline">require an eligible recipient to demonstrate that a private company or investment has selected the site for development or expansion;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id658ff41214784fd092dec8898c432bed"><enum>(2)</enum><text>award a grant—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3b0d7da58e0743b88016a6aa3f9d5696"><enum>(A)</enum><text display-inline="yes-display-inline">to a foreign entity of concern (as defined in section 10612(a) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19221">42 U.S.C. 19221(a)</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98289788e10f4952a1ca842df9534551"><enum>(B)</enum><text>for a project that would benefit a foreign entity of concern (as so defined); or</text></subparagraph></paragraph><paragraph id="idb75db75ba61b4696a85abda2d59d0f3e"><enum>(3)</enum><text>award more than 20 percent of amounts made available to carry out the grant program for a fiscal year for projects that support any 1 particular key technology focus area or an industry or technology sector identified under subsection (c)(2)(B).</text></paragraph></subsection><subsection id="idBB17EB00B95046CE89CF9D0B78D6019E"><enum>(g)</enum><header>Cost sharing</header><text>Notwithstanding section 204, the Federal share of the cost of a project carried out with an award under the grant program may be up to 100 percent of the total project cost.</text></subsection><subsection id="id02EC40C8B58346379FE9AA2E4130BA08"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the grant program $100,000,000 for each of fiscal years 2024 through 2028.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8F0A95893096445B9E0B85BD982B38FA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents contained in section 1(b) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="public-law" parsable-cite="pl/89/136">Public Law 89–136</external-xref>; 79 Stat. 552; 112 Stat. 3597; 118 Stat. 1761) is amended by inserting after the item relating to section 207 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A4786C9401E4962AA2075EFDB910B68"><toc><toc-entry bold="off" level="section">Sec. 208. Critical Supply Chain Site Development grant program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2F437525802240789325EC7C5C77C7C6"><enum>4.</enum><header>Use of funds in projects constructed under projected cost</header><text display-inline="no-display-inline">Section 211(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3151">42 U.S.C. 3151(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>section 201 or 209</quote> and inserting <quote>section 201, 208, or 209</quote>.</text></section><section id="idBE91B4CEE89945A4BB24D3E79B5C9E7D"><enum>5.</enum><header>Direct expenditure or redistribution by recipient</header><text display-inline="no-display-inline">Section 217(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3154c">42 U.S.C. 3154c(a)</external-xref>) is amended by striking <quote>section 201, 203, or 207</quote> and inserting <quote>section 201, 203, 207, or 208</quote>.</text></section></legis-body></bill>
