which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish judicial ethics.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial Ethics and Anti-Corruption Act of 2023</short-title></quote>.</text></section><section id="id5f92042f022545289f404b614243b183"><enum>2.</enum><header>Conflicts of interest rules for judges and justices and nonconflicted Federal employee investment accounts</header><subsection id="id201a36c3ef9e40618fe3cb85afdd0521"><enum>(a)</enum><header>Required divestments of conflicted assets</header><paragraph id="id1d2ff1e2faf84f6fa1c69eccd759b41b"><enum>(1)</enum><header>Stocks and securities</header><text>No judge or justice may own an interest in or trade (except a divestment required or approved by the Judicial Conference of the United States) any stock, bond, commodity, future, and other form of security, including an interest in a hedge fund, a derivative, option, or other complex investment vehicle, except nonconflicted assets allowed under subsection (b).</text></paragraph><paragraph id="id9dcc02a5524345e6a47b289957eb65d4"><enum>(2)</enum><header>Commercial real estate</header><text>No judge or justice may maintain ownership in commercial real estate, unless ownership of such commercial real estate is necessary for an entity described in paragraph (4)(C).</text></paragraph><paragraph id="idb0eb5f9b47c14840966d8d921271e5bd"><enum>(3)</enum><header>Trusts</header><subparagraph id="id0D9939196CCE4F7CBE0C4E75CD3F9846"><enum>(A)</enum><header>In general</header><text>No judge or justice may maintain a financial interest in any trust, including a family trust, if the Judicial Conference of the United States determines that the trust includes any—</text><clause id="id9941369512B34E6890A59E296B7625BE"><enum>(i)</enum><text>asset that might present a conflict of interest; or</text></clause><clause id="id2390E21EA315496892647386DD14FAA7"><enum>(ii)</enum><text>stock, bond, commodity, future, and other form of security, including an interest in a hedge fund, a derivative, option, or other complex investment vehicle, except nonconflicted assets allowed under subsection (b).</text></clause></subparagraph><subparagraph id="id1E14CE37CC524B75A760CC2033C47C01"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to a trust described in section 13104(f)(2) of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="id1546a11c54514afcb6c0d7488fad9724"><enum>(4)</enum><header>Businesses and companies</header><subparagraph id="id3E35DB47EFDC41A89392A09634031DF1"><enum>(A)</enum><header>Privately owned or closely held corporation</header><text>No judge or justice may maintain ownership in a privately owned or closely held corporation, company, firm, partnership, or other business enterprise.</text></subparagraph><subparagraph id="idF52646EF326B4640872FB944F1BAA274"><enum>(B)</enum><header>Board members</header><text>No judge or justice may serve on the board of directors of any for-profit entity, including any corporation, company, firm, partnership, or other business enterprise.</text></subparagraph><subparagraph id="id856ADDED40BD4A80877140ECFA1D7B4E"><enum>(C)</enum><header>Exception</header><text>Subparagraphs (A) and (B) shall not apply to a corporation, company, firm, partnership, or other business enterprise that has gross receipts for the previous taxable year of less than $5,000,000. </text></subparagraph></paragraph></subsection><subsection id="id5f2ca2608a044c2da3ce4f15423ee1ae"><enum>(b)</enum><header>Nonconflicted assets</header><paragraph id="id7b96705211a045fa8b47afd59fa9ad3e"><enum>(1)</enum><header>In general</header><text>A judge or justice may maintain assets that do not present a conflict of interest, including—</text><subparagraph id="ida4015fd6ade249238f8e662a382bf5bd"><enum>(A)</enum><text>a widely held investment fund—</text><clause id="idf10b180e5ae44a98ab7a0475e13d5073"><enum>(i)</enum><text>described in section 13104(f)(8) of title 5, United States Code;</text></clause><clause id="id677635cbb8c44bfc95b0950906cec635"><enum>(ii)</enum><text>that meets the requirements described in paragraph (2); and</text></clause><clause id="idde93220c65cb424aa59032083909aefa"><enum>(iii)</enum><text>that is diversified because the fund does not have a stated policy of concentrating the investments of the fund in any industry, business, single country other than the United States, or bonds of any single State; </text></clause></subparagraph><subparagraph id="idcd99d0ff13f94bf1bd307f5f2dd0c3a2"><enum>(B)</enum><text>noncommercial real estate, including real estate used solely as a personal residence;</text></subparagraph><subparagraph id="id00f80d48fa0e428dbd8f48eac5856767"><enum>(C)</enum><text>cash, certificates of deposit, or other forms of savings accounts;</text></subparagraph><subparagraph id="id7cc5f6ab2b6e48d59fbd238006648c37"><enum>(D)</enum><text>a federally managed asset, including—</text><clause id="idbc2aab937bb44990b1f275becc2bc839"><enum>(i)</enum><text>financial interests in or income derived from—</text><subclause id="id649ea80f119f4204983435a774baab7d"><enum>(I)</enum><text>any retirement system under title 5, United States Code (including the Thrift Savings Plan under subchapter III of chapter 84 of such title); or</text></subclause><subclause id="id5976a2eaa62445d1924826cc220b9538"><enum>(II)</enum><text>any other retirement system maintained by the United States for officers or employees of the United States, including the President, or for members of the uniformed services;</text></subclause></clause><clause id="id65311702ef724b30abf96a023c6a5c82"><enum>(ii)</enum><text>benefits received under the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/301">42 U.S.C. 301 et seq.</external-xref>); and</text></clause><clause id="id6efdec6150cb4e57aedf8d004877f9f1"><enum>(iii)</enum><text>an asset in the Federal Employee Investment Account described in paragraph (3);</text></clause></subparagraph><subparagraph id="idC41A46E1D0E5454DB28C1123D9D48EFB"><enum>(E)</enum><text>bonds, bills, and notes issued by governmental sources, such as the Federal Government, State, or other municipality;</text></subparagraph><subparagraph id="idDF3825ABE3BF4379A7B9AACF9ECCC700"><enum>(F)</enum><text>shares of Settlement Common Stock issued under section 7(g)(1)(A) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1606">43 U.S.C. 1606(g)(1)(A)</external-xref>); and</text></subparagraph><subparagraph id="idD11FD643BF854571959BAF90AEDFBA08"><enum>(G)</enum><text>shares of Settlement Common Stock, as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text></subparagraph></paragraph><paragraph id="ide9e0e8464f1e4a8697b9e335aa141fec"><enum>(2)</enum><header>Widely held investment fund requirements</header><text>A judge or justice may not maintain a widely held investment fund described in section 13104(f)(8) of title 5, United States Code, unless— </text><subparagraph id="ida7db40b3ff7d4ec6ba4fc2f48abd38d5"><enum>(A)</enum><text>the widely held investment fund is—</text><clause commented="no" display-inline="no-display-inline" id="id72a9aac6816a498782aea0dd703e3565"><enum>(i)</enum><text display-inline="yes-display-inline">diversified, as described in paragraph (1)(A)(iii); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id36eb931babbf47d5abccec14b0258051"><enum>(ii)</enum><text>registered as a management company under the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-1">15 U.S.C. 80a–1 et seq.</external-xref>); </text></clause></subparagraph><subparagraph id="id4C47B81521624F838BFE826A0B559BC0"><enum>(B)</enum><text>the widely held investment fund does not present a conflict of interest; and</text></subparagraph><subparagraph id="id8cf105dd5e8a4ffe9839ff8252845540"><enum>(C)</enum><text>any instructions to a manager of the widely held investment fund are shared with the Judicial Conference of the United States.</text></subparagraph></paragraph><paragraph id="id5957bb97029243f6b61e7e5641c4037a"><enum>(3)</enum><header>Federal Employee Investment Account</header><text>Section 8472 of title 5, United States Code, is amended—</text><subparagraph id="id404AC48910474CFDA69D1E547292572A"><enum>(A)</enum><text>in subsection (f)—</text><clause id="id9D35C8E73EB4479EA8D62C78A09A0979"><enum>(i)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></clause><clause id="id02F3FCE55F424CA6BBF908F68C4332A3"><enum>(ii)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon; and</text></clause><clause id="id76D5F90D9E104576A5013EDFC5523FCE"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE93B09617D144832B487FD7318B964A3"><paragraph id="idBD79FFD57AA54EAC878F706A1BD96ECF"><enum>(4)</enum><text>not later than 3 years after the date of enactment of this paragraph, establish Federal Employee Investment Accounts in the Treasury of the United States accounts for judges and justices to maintain investments in the stock and securities markets in which a judge or justice may—</text><subparagraph id="idB7D8B75654F24C4E9CF253CC73C81764"><enum>(A)</enum><text>sell an asset or security, including those assets or securities that present a conflict of interest under section 2(a) of the <short-title>Judicial Ethics and Anti-Corruption Act of 2023</short-title>, and invest the resulting funds into the Federal Employee Investment Accounts; and</text></subparagraph><subparagraph id="idF0185222E3F2449492F5A21EF8C1E1BC"><enum>(B)</enum><text>withdraw funds from their Federal Employee Investment Account at any time;</text></subparagraph></paragraph><paragraph id="idDFC83C2014C54BE89BF8029B50EA66C7"><enum>(5)</enum><text>act in the interest of the plan participants and beneficiaries of Federal Employee Investment Accounts when making decisions for the purpose of providing benefits to those participants and beneficiaries;</text></paragraph><paragraph id="id252701A0D15549B6A9D8FF906EEFC132"><enum>(6)</enum><text>establish a new and parallel system for recordkeeping with respect to Federal Employee Investment Accounts; and</text></paragraph><paragraph id="id7B0EC1F581A5436DB2821D6BB612EF8F"><enum>(7)</enum><text>establish a Federal Employee Investment Fund to fully cover administrative costs associated with managing Federal Employee Investment Accounts, which—</text><subparagraph id="id4C2A92942B1047619211F58C0A9EC1B1"><enum>(A)</enum><text>shall be separate from the Thrift Savings Fund established under section 8437, except with respect to administrative costs for common resources; and</text></subparagraph><subparagraph id="id6B8929C4211F4D80A15F04C45B66D7F0"><enum>(B)</enum><text>may be used for compensation to pay new employees, additional resources for information technology, additional call center capacity, and any other new capacity to handle the administration of Federal Employee Investment Accounts.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id3EE23D4FCE8A4221A13C1D53AD6DE7CD"><enum>(B)</enum><text>in subsection (g)(1)—</text><clause id="idE0404773C4A848D1A065CCC6B7695117"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></clause><clause id="id0B3163F1A0484AE9BCE7D1BF6678A834"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="id40C7D9FB4EB0432786182B244F287E09"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5873E95E231745B0A0D1C67803DAE1C1"><subparagraph id="id06390246998B49FE998A071FB622B46C"><enum>(E)</enum><text>promulgate regulations for the administration of Federal Employee Investment Accounts.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idD017E1A91B6E4EA2BD7FFA0B65752A6F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC8B921CA62094B7CB3C002FD0654DFF4"><subsection id="iddf43c1f912894149898bd58c2aaa8362"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to establish and maintain Federal Employee Investment Accounts established under subsection (f), including for the purpose of reducing any fees paid by participants in the Federal Employee Investment Accounts.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="ide870415d5de447889e4308af4930e402"><enum>(c)</enum><header>Civil fines</header><text>The Attorney General or the Special Counsel may bring a civil action in the appropriate United States district court against any judge or justice who engages in conduct constituting a violation of this section and, upon proof of such conduct by a preponderance of the evidence, such judge or justice shall be subject to a civil penalty of not more than $50,000 for each violation. The imposition of a civil penalty under this subsection does not preclude any other criminal or civil statutory, common law, or administrative remedy, which is available by law to the United States or any other person.</text></subsection></section><section id="id8FCF3414C92E4DCAA2047BAD54C188C1"><enum>3.</enum><header>Clarification of gift ban</header><subsection id="id97577454AD144A22BA42FF021238EAC7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7353 of title 5, United States Code, is amended—</text><paragraph id="idE0C1E33172984B40BB72A8FDBFE0D07A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1), by striking <quote>anything of value</quote> and inserting <quote>a gift</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5843edb5f1494a76aaeb8d0f56f48bac"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6CFBABF2DC824D6C81B1666210EF37A2"><subparagraph id="id05f95d5ac84d426da0c4c6eeef7ed225" indent="up1"><enum>(C)</enum><text>The total monetary value of any gifts accepted by a Member, officer, or employee pursuant to subparagraph (A) as personal hospitality during any calendar year shall not exceed an amount equal to the dollar amount established under paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/2503">section 2503(b)</external-xref> of the Internal Revenue Code of 1986 (as adjusted under paragraph (2) of such section) with respect to such calendar year.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3EDEB1F9C4694A668F2DE60CB428C690"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="id00E89277EE02458CAF43CD5316566182"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id39A200BE32504AC0ABC94D1D5D11CF9B"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id9EAB8B5CC1DF48B184DBDE1B154E5D2F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id28EB815BBDF14095983704D2EA4A3269"><paragraph id="id2B6709F09E2047CCA8A0BF800CBB491F"><enum>(3)</enum><text>the term <term>gift</term> means anything of value, including transportation, travel, lodgings and meals, whether provided in-kind, by purchase of a ticket, payment in advance, or reimbursement after the expense has been incurred.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id3A69EF761BB24AD0A6BE3A14E2E0C2CA"><enum>(b)</enum><header>Regulations</header><text>The Judicial Conference of the United States shall promulgate regulations to carry out the amendment made by subsection (a) with respect to the judicial branch.</text></subsection></section><section id="id4936cd06e6314be8b139e938dc8c7ff5"><enum>4.</enum><header>Restrict privately funded educational events and speeches</header><subsection id="IDD246992F9F0F492384B0357B8B6957B1"><enum>(a)</enum><header>Judicial Education Fund</header><paragraph id="ID023D5EB5B863448FAAF0F3A25C7B3820"><enum>(1)</enum><header>Establishment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/42">Chapter 42</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="ID7825CEE7C2C242B5B7C417450352F6C5"><section id="ID8732C66AFF104DBD8B6860249529E7A3"><enum>630.</enum><header>Judicial Education Fund</header><subsection id="IDE3B0CD7A1E914DAFACF976E3DA35F2A7"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idb70ccd34804f40ddb5ff97fba03bcfbf"><enum>(1)</enum><text>the term <term>Board</term> means the Board of the Federal Judicial Center established in section 621; </text></paragraph><paragraph id="id2867C628098A45A9B9228910095F3A16"><enum>(2)</enum><text>the term <term>Fund</term> means the Judicial Education Fund established under subsection (b);</text></paragraph><paragraph id="ID4BF1E09C2DE44BBDBCDCAC2F37EDE4C0"><enum>(3)</enum><text>the term <term>institution of higher education</term> has the meaning given that term under section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id857E500DC63145728D050417BD5AA99C"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>national bar association</term> means a national organization that is open to general membership to all members of the bar;</text></paragraph><paragraph id="ID6556BD94AC174642874657C1EAEB7F50"><enum>(5)</enum><text>the term <term>private judicial seminar</term>—</text><subparagraph id="IDF9FFA87497F44EE9941567A63773C8AD"><enum>(A)</enum><text>means a seminar, symposia, panel discussion, course, or a similar event that provides continuing legal education to judges and justices; and</text></subparagraph><subparagraph id="ID4B224BF2DCB7417AB329F217912178FE"><enum>(B)</enum><text>does not include—</text><clause id="IDC55F81AB6105444EB455DBEAB8C31E98"><enum>(i)</enum><text>seminars that last 1 day or less and are conducted by, and on the campus of, an institute of higher education;</text></clause><clause id="IDE433CB489C704BB1BB9DA9518DCD21E4"><enum>(ii)</enum><text>seminars that last 1 day or less and are conducted by a national bar association or State or local bar association for the benefit of the bar association membership; or</text></clause><clause id="ID6D3FDE370C614138970055DB7E6F2446"><enum>(iii)</enum><text>seminars of any length conducted by, and on the campus of an institute of higher education or by a national bar association or State or local bar association, where a judge or justice is a presenter and at which judges and justices constitute less than 25 percent of the participants; and</text></clause></subparagraph></paragraph><paragraph id="ID192E7041A18A45A4008EEA82CF1EFA35"><enum>(6)</enum><text>the term <term>State or local bar association</term> means a State or local organization that is open to general membership to all members of the bar in the specified geographic region.</text></paragraph></subsection><subsection id="IDFB8DC169EC6B4EEC9533A39BE2956995"><enum>(b)</enum><header>Fund</header><text>There is established within the United States Treasury a fund to be known as the <quote>Judicial Education Fund</quote>.</text></subsection><subsection id="ID74C61E660B674D76BDBD98F16268F475"><enum>(c)</enum><header>Use of amounts</header><text>Amounts in the Fund may be made available for the payment of necessary expenses, including reasonable expenditures for transportation, food, lodging, private judicial seminar fees and materials, incurred by a judge or justice in attending a private judicial seminar approved by the Board. Necessary expenses shall not include expenditures for recreational activities or entertainment other than that provided to all attendees as an integral part of the private judicial seminar. Any payment from the Fund shall be approved by the Board.</text></subsection><subsection id="IDC5A93910D8D94E8B891C3616FF401722"><enum>(d)</enum><header>Required information</header><text>The Board may approve a private judicial seminar after submission of information by the sponsor of that private judicial seminar that includes—</text><paragraph id="ID75D6B3ABB558403BB0244E142579D674"><enum>(1)</enum><text>the content of the private judicial seminar (including a list of presenters, topics, and course materials); and</text></paragraph><paragraph id="ID9470DCF65DC24CC4B35BCED4D3977E81"><enum>(2)</enum><text>the litigation activities of the sponsor (including any amicus briefs submitted by the sponsor) and the presenters at the private judicial seminar (including the litigation activities of the employer of each presenter) on the topic related to those addressed at the private judicial seminar. </text></paragraph></subsection><subsection id="ID3FD0ABDBCFFB4B68A326C5D169825CA4"><enum>(e)</enum><header>Public availability</header><text>If the Board approves a private judicial seminar, the Board shall make the information submitted under subsection (d) relating to the private judicial seminar available to judges, justices, and the public by posting the information online.</text></subsection><subsection id="IDAEBEFCADB49B4DD789BABD055C5470CE"><enum>(f)</enum><header>Guidelines</header><text>The Judicial Conference shall promulgate guidelines to ensure that the Board only approves private judicial seminars that are conducted in a manner so as to maintain the public’s confidence in an unbiased and fair-minded judiciary.</text></subsection><subsection id="IDC3A3653D6298490281D72EF5A665A8E9"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for deposit in the Fund $3,000,000 for each of fiscal years 2023, 2024, and 2025, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="IDD7AD43EE47FF46C79D6D8843CCE56098"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/42">chapter 42</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="ID276751863EDA480481B3D000E47154DB"><toc regeneration="no-regeneration"><toc-entry level="section">630. Judicial Education Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="IDAC56CAEC3B0A4412B0FCC458C4D31F9C"><enum>(b)</enum><header>Private judicial seminar gifts prohibited</header><paragraph id="ID59084B2E7B1F450AAD9BE25E41CC3F07"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="ID0C09E2AF38A04BDA88563191386DFBB7"><enum>(A)</enum><text>the term <term>gift</term> has the meaning given that term under section 7353 of title 5, United States Code, as amended by section 3;</text></subparagraph><subparagraph id="id192EBB33A94B4674A448D8F5187F2880"><enum>(B)</enum><text>the term <term>institution of higher education</term> has the meaning given that term under section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>); and</text></subparagraph><subparagraph id="ID8957E77C84BF4D608BFBA17E006B6423"><enum>(C)</enum><text>the terms <term>national bar association</term>, <term>private judicial seminar</term>, and <term>State or local bar association</term> have the meanings given those terms under section 630 of title 28, United States Code, as added by subsection (a).</text></subparagraph></paragraph><paragraph id="ID36EAADA2B0174317BE32E5BC8399002E"><enum>(2)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Judicial Conference of the United States shall promulgate regulations to apply section 7353(a) of title 5, United States Code, to prohibit the solicitation or acceptance of a gift in connection with a private judicial seminar.</text></paragraph><paragraph id="IDD1A1AB827455416390001938437240DE"><enum>(3)</enum><header>Exception</header><text>The prohibition under the regulations promulgated under paragraph (2) shall not apply if—</text><subparagraph id="IDB73D9B506D674DB796EE11AA05CC4B3B"><enum>(A)</enum><text>the judge or justice participates in a private judicial seminar as a speaker, panel participant, or otherwise presents information;</text></subparagraph><subparagraph id="IDE10D4296CBDA4F00A8259747E4772181"><enum>(B)</enum><text>Federal judges and justices are not the primary audience at the private judicial seminar; and</text></subparagraph><subparagraph id="ID7BB7E4E4A6C34AEEBB45EF691F8B048D"><enum>(C)</enum><text>the gift accepted is—</text><clause id="IDEC300EA6F2514654AE2BED060544A24F"><enum>(i)</enum><text>reimbursement from the private judicial seminar sponsor of reasonable transportation, food, or lodging expenses on any day on which the judge or justice speaks, participates, or presents information, as applicable;</text></clause><clause id="ID89464181A92A4A95A12FFA997E499E55"><enum>(ii)</enum><text>attendance at the private judicial seminar on any day on which the judge or justice speaks, participates, or presents information, as applicable; or</text></clause><clause commented="no" display-inline="no-display-inline" id="IDEE2ECE86E1264E2DBB225B5BE9755947"><enum>(iii)</enum><text>anything excluded from the definition of a gift under regulations of the Judicial Conference of the United States under sections 7351 and 7353 of title 5, United States Code, as in effect on the date of enactment of this Act.</text></clause></subparagraph></paragraph></subsection></section><section id="H78CA75995453418D838A71F058210984"><enum>5.</enum><header>Code of Conduct</header><subsection id="idBD0FBBEF651C4B88A81FB6A53E6F63F4"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that in order for justices and judges, both of the supreme and inferior courts, to hold their offices during <quote>good behaviour</quote> under section 1 of article III of the Constitution of the United States, the judges and justices shall, among other requirements, adhere to the Code of Conduct for United States Judges adopted by the Judicial Conference of the United States described in this section.</text></subsection><subsection id="HE7F95B0D18D54A67A7A918A24F6487FC"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The Code of Conduct for United States Judges adopted by the Judicial Conference of the United States shall apply to the justices of the Supreme Court of the United States to the same extent as such Code applies to circuit and district judges.</text></subsection><subsection id="H374691552A7745238F7D9CE93D87DA66"><enum>(c)</enum><header>Enforcement</header><text>The Judicial Conference shall establish procedures, modeled after the procedures set forth in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/16">chapter 16</external-xref> of title 28, United States Code, under which—</text><paragraph id="HF811434B83BB4730B2D6D0E716D5E71E"><enum>(1)</enum><text>complaints alleging that a justice of the Supreme Court of the United States has violated the Code of Conduct referred to in subsection (a) may be filed with or identified by the Conference;</text></paragraph><paragraph id="HFC002373DE864D2E91DD1867E80F0B9F"><enum>(2)</enum><text>such material, nonfrivolous complaints and any accompanying material are immediately referred to the Supreme Court Review Committee established in section 10; and</text></paragraph><paragraph id="H7C6594F37E3C45FCA2B1328B946893A6"><enum>(3)</enum><text display-inline="yes-display-inline">further action, where appropriate, is taken by the Conference, with respect to such complaints.</text></paragraph></subsection><subsection id="HC4DACACCB72740EC96D6E179C2187D0B"><enum>(d)</enum><header>Submission to Congress; effective date</header><paragraph id="H633B24E693124FC1877E1420B1B12ACE"><enum>(1)</enum><header>Submission to congress</header><text>Not later than 180 days after the date of enactment of this Act, the Judicial Conference shall submit to Congress the procedures established under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC38DF6C13F0C4C61A7FC3ECE949BA0FB"><enum>(2)</enum><header>Effective date</header><text>The procedures established under subsection (b) shall take effect 1 year after the date of enactment of this Act.</text></paragraph></subsection></section><section id="id433224c203574072bdf223fc382f1d94"><enum>6.</enum><header>Improving disclosure</header><subsection id="idba662fb7c33f46f6ba6447c2d51eb677"><enum>(a)</enum><header>Recusal decisions</header><text>Section 455 of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB26FE7D45D08419DBD69CD0710A2A1B2"><subsection id="id3E928524CF6741C9921A9167E79B48D5"><enum>(g)</enum><header>Recusal lists</header><paragraph id="idC4000D6971A941D68850077C87F394AA"><enum>(1)</enum><text>Each justice, judge, and magistrate judge of the United States shall maintain and submit to the Judicial Conference a list of each association or interest that would require the justice, judge, or magistrate to be recused under subsection (b)(4), including any financial interests of the judge, the spouse of the judge, or any minor child of the judge residing in the household of the judge. </text></paragraph><paragraph id="id57d4526fb95d4f86a1d46a4ed4d1d72a"><enum>(2)</enum><text>The Judicial Conference shall maintain and make publicly available online, at no cost, each list required under this subsection that is filed with the Judicial Conference in a format that is searchable, sortable, machine-readable, downloadable, and accessible format, and accessible in multiple languages and to individuals with disabilities.</text></paragraph><paragraph id="idcf4d8a006c4f4bef960452058230459d"><enum>(3)</enum><text>The Judicial Conference may issue public or private guidance to justices, judges, and magistrate judges of the United States regarding the contents of the lists under this subsection to ensure such lists comply with the disqualification requirements of (b)(4).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8f070d2b43dc49f181b1ad15d91ad313"><enum>(b)</enum><header>Speeches</header><paragraph id="id816020D1453F4FC492E89AFB9AD179CE"><enum>(1)</enum><header>In general</header><text>Each justice, judge, and magistrate judge of the United States shall maintain and submit to the Judicial Conference of the United States a copy of each speech or other significant oral communication made by the justice, judge, or magistrate.</text></paragraph><paragraph id="id1fe7cbbaae2d44b8ab3cdac1d9ed993f"><enum>(2)</enum><header>Availability</header><text>The Judicial Conference of the United States shall maintain and make each speech or other significant oral communication submitted under paragraph (1) available to the public in printed form, upon request, and online, at no cost, in a format that is searchable, sortable, machine-readable, downloadable, and accessible in multiple languages and to individuals with disabilities.</text></paragraph><paragraph id="idB669823927B44D81AB73F7BC718B95C3"><enum>(3)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Judicial Conference of the United States shall promulgate regulations regarding the types of oral communications that are required to be maintained, submitted, and made publicly available under this subsection.</text></paragraph></subsection><subsection id="id316fbd6c99e141d183e848cbf11f867b"><enum>(c)</enum><header>Livestreaming judicial proceedings</header><paragraph id="id50cd0ad2a6f84fc7bc1ab7264d5a873e"><enum>(1)</enum><header>Definition</header><text>In this section, the term <term>appellate court of the United States</term> means any United States circuit court of appeals and the Supreme Court of the United States.</text></paragraph><paragraph id="id2e45dc35a3ce488f81f2985324a80cf3"><enum>(2)</enum><header>Streaming of court proceedings</header><text>In accordance with procedures established by the Judicial Conference of the United States, the audio of each open session conducted by an appellate court of the United States shall be made available online contemporaneously with the session, unless the appellate court of the United States, by a majority vote, determines that making audio of the session available online would violate the constitutional rights or threaten the safety of any party to the proceeding.</text></paragraph></subsection><subsection id="id0e33139ddfd14a7e92874c1cd52b437c"><enum>(d)</enum><header>Publicizing case assignment information</header><paragraph id="id2387EAB583264DD29CCF2D8065C0E240"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Judicial Conference of the United States shall promulgate regulations requiring each court of the United States to make case assignment data available to the public online, at no cost, in a format that is searchable, sortable, machine-readable, downloadable, and accessible in multiple languages and to individuals with disabilities.</text></paragraph><paragraph id="idEC0AB2179E9A4F629B6379FF6E04884A"><enum>(2)</enum><header>Contents</header><text>The case assignment data made available under paragraph (1) shall include, at a minimum, and to the extent available, the case title, docket number, case origin, filing date, and name of each authoring judge, concurring judge, and dissenting judge for each opinion issued in the case.</text></paragraph></subsection><subsection id="ide1a0b002a4a74993b5f46338925535f8"><enum>(e)</enum><header>Making websites user-Friendly</header><text>Not later than 180 days after the date of enactment of this Act, the Judicial Conference of the United States shall promulgate regulations requiring an evaluation of, and improvements to, the website of each district court of the United States to ensure the website is easy to understand, including that it is clear how to file a complaint relating to a judge or an employee of the district court.</text></subsection><subsection id="ide44e5ad57e8c4bcf8e2c5d07c70c4b44"><enum>(f)</enum><header>Accessibility</header><text>The Judicial Conference shall make efforts to ensure that any disclosures required under this section are made available to the public in plain language, in a variety of languages, and accessible to individuals with disabilities.</text></subsection></section><section id="id870E04C706314E02B33B7BAEAE665D58"><enum>7.</enum><header>Oversight process for disqualification of justice, judge, or magistrate judge</header><text display-inline="no-display-inline">Section 455 of title 28, United States Code, as amended by section 6 of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47B9F6FD0C1248E18935DCAA5DD6506D"><subsection id="id3F2E56517FD645F2BAC3666A32662277"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5110307D53D2442AA8632E589A9EA883"><enum>(1)</enum><text>Any litigant appearing before a justice, judge, or magistrate judge of the United States may file a petition that the justice, judge, or magistrate judge of the United States, as applicable, shall be disqualified based on the criteria described in subsection (b).</text></paragraph><paragraph indent="up1" id="id38F86FF39F224042B3C3AEC2F77186AD"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id55EDE3E6D9FA4E7894C8CEA20C9F2892"><enum>(A)</enum><text>Any judge or magistrate judge of the United States subject to a petition under paragraph (1) may provide a public, written response to the petition that provides a written explanation relating to any disqualification decision.</text></subparagraph><subparagraph indent="up1" id="id21A7DF9E53A04B02AA50AF93134F7E02"><enum>(B)</enum><text>Any justice of the Supreme Court of the United States subject to a petition under paragraph (1) shall provide a public, written response to the petition that provides a written explanation relating to any disqualification decision. </text></subparagraph></paragraph><paragraph indent="up1" id="idE34497FC521F47DC927BE30CEED2C7AE"><enum>(3)</enum><text>If a litigant makes a petition under paragraph (1) relating to a justice of the Supreme Court of the United States, the Judicial Conference of the United States shall issue a nonbinding, public advisory opinion with its recommendation, which shall be shared with the Supreme Court Review Committee established in section 10 of the <short-title>Judicial Ethics and Anti-Corruption Act of 2023</short-title>.</text></paragraph><paragraph indent="up1" id="id080AAA89A4F64D159A5C0C5098721B80"><enum>(4)</enum><text>If the Judicial Conference of the United States recommends that a justice of the Supreme Court of the United States be disqualified under this section, the justice shall publicly explain a final disqualification decision in writing, which shall be shared with the Supreme Court Review Committee established in section 10 of the <short-title>Judicial Ethics and Anti-Corruption Act of 2023</short-title>.</text></paragraph><paragraph id="id691a3bb6a09447d69916d820507ab8e0" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9739686dd49b40dcbbe194c1da564941"><enum>(A)</enum><text>For any judge or magistrate judge of the United States, the Judicial Conference of the United States shall—</text></subparagraph><subparagraph id="id5ebda1641bb84b3881ff717147f599ed" indent="up1"><enum>(B)</enum><text>establish a written process to determine whether a judge meets 1 or more of the criteria in subsection (b); </text></subparagraph><subparagraph id="id1b343dba5490472ca69468d64736b3ce" indent="up1"><enum>(C)</enum><text>use any administrative procedures which may be necessary to aid in the execution of the written process described in subparagraph (B), which may include any procedures or software that may be necessary to determine whether a judge meets 1 or more of the criteria in subsection (b); and</text></subparagraph><subparagraph id="id967E355B8079460792E558728DC2339E" indent="up1"><enum>(D)</enum><text>the process described in subparagraph (B) shall be made publicly available and, at a minimum—</text><clause id="idbf91b1076cb545279ab065026c4dab0e"><enum>(i)</enum><text>include how an individual may make a petition under paragraph (1) for a judge to be disqualified;</text></clause><clause id="id16faf20f19cf419faf71b0b3ea36eaf3"><enum>(ii)</enum><text>ensure that a judge or group of judges other than the judge who is the subject of the inquiry determines whether the judge shall be disqualified;</text></clause><clause id="id19489aef6f144f62a2fc07a1ef1651b5"><enum>(iii)</enum><text>allow the judge or group of judges making the disqualification determination to receive the expert advice of ethics personnel and officials, including individuals with expertise in ethics at the Judicial Conference;</text></clause><clause id="id088f1aa0cc374fd9a6da24079c83efc8"><enum>(iv)</enum><text>require that the judge be disqualified should another judge or group of judges determine that the judge must be disqualified in accordance with this subsection; and</text></clause><clause id="id59522B28EBE04B25B657EE033417F7FA"><enum>(v)</enum><text>require that all recusal decisions be made publicly available and be accompanied by a written explanation for the recusal decision.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3CBD3C3BD4074655B5636796BBFFB505"><enum>8.</enum><header>Complaints against retired judges and judicial discipline</header><subsection id="idB45156A3C25C493F83B460B9F71C3A6E"><enum>(a)</enum><header>Complaints</header><text display-inline="yes-display-inline">Section 351(d) of title 28, United States Code, is amended—</text><paragraph id="idFEF9E37EF6124442AC993625C3E508FC"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id62C3974721214DD0B9E964A58583E8D2"><paragraph id="id1511bda528934575912cf0289fc70c07"><enum>(1)</enum><text>the term <term>judge</term>—</text><subparagraph id="idEDB1F8CA7A8F4B329079FC137D17FFBB"><enum>(A)</enum><text>means a circuit judge, district judge, bankruptcy judge, or magistrate judge; and</text></subparagraph><subparagraph id="idFBF66E1D5FB748DC9F8F8FD49CE9C625"><enum>(B)</enum><text> includes a retired judge described in subparagraph (A);</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id3B54F21E0B554BCEB8F0763E0254E952"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id449137C9E7C545F684B2192C0A017B6E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA2953CD52D04860A926B4899E21DDD5"><paragraph id="idBBE39C49569D4997B1BFA64666721483"><enum>(3)</enum><text>the term <term>retired judge</term> means any judge of the United States who has retired from regular active service under section 371(b) or 372(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2B032EEA5F3D4E0D8A2451C43D0DEFAE"><enum>(b)</enum><header>Review of complaint by chief judge</header><text>Section 352 of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6F705C7DD6BF4EBEA71F4BC091CBF4DF"><subsection id="id72D102D040A942BE9EC6DA8E11C0709E"><enum>(e)</enum><header>Definition</header><text>In this section, the term <term>intervening events</term> does not include the retirement of the judge whose conduct is complained of or the nomination or confirmation of the judge to the Supreme Court of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id0EB2C785FD6846CDA00806AEA29E382C"><enum>9.</enum><header>Action by judicial council in response to misconduct by judges</header><text display-inline="no-display-inline">Section 354 of title 28, United States Code, is amended—</text><paragraph id="id9B2A82766A414146877F730B98A4C768"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A7ED9A2158D468DA80EAEC3E867841B"><subparagraph id="idB5A4917E09B8427780E621812563C74D"><enum>(D)</enum><header>Retired judges</header><text>If the conduct of a retired judge is the subject of the complaint, action by the judicial council under paragraph (1)(C) may include—</text><clause id="idD9A06B9160664EB3AB3D2093712152FE"><enum>(i)</enum><text>censuring or reprimanding the judge by means of public announcement; and</text></clause><clause id="idE236440286B1451BB8CD9E78C034CB84"><enum>(ii)</enum><text> reducing or rescinding the nonvested pension benefits of the retired judge.</text></clause></subparagraph><subparagraph id="idC684866A375C4515AB23EC97026DB5A5"><enum>(E)</enum><header>Remedial actions for certain conduct</header><clause id="idC3DE0D4D912547648D2BFBDF37AE3430"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>covered judge</term> does not include a retired judge.</text></clause><clause id="id802826B60F924C8F9DAA5311F8F2C58A"><enum>(ii)</enum><header>Conduct</header><text>If the conduct of a covered judge is the subject of the complaint, action by the judicial council under paragraph (1)(C) may include mandating that the covered judge participate in professional counseling, treatment, education, or mentoring to address the misconduct at issue.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idCEC49CB8CFDA4BF98B9CC06A772D7ADE"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA1BC2DA786F9490B95C39442540AE51D"><subsection id="id60A26492AE7F448CB5D7AC7950A04C0F"><enum>(c)</enum><header>Report</header><paragraph id="id2A1E819BAED74C539B1CA5B00F62B849"><enum>(1)</enum><header>Submission to Judicial Conference of the United States</header><text>Each chief judge of the circuit shall submit to the Judicial Conference of the United States an annual report on, with respect to the previous year—</text><subparagraph id="id527498EF9A854910A70C62F6B7D025CF"><enum>(A)</enum><text>the number of complaints filed under section 351 against judges in the circuit; and</text></subparagraph><subparagraph id="id927980F8E75C4FE6851E4B186AC8C43F"><enum>(B)</enum><text>the outcome of the complaints described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idC1F3A59A23B54CF0BB5B472480016904"><enum>(2)</enum><header>Submission to Congress</header><text>The Judicial Conference of the United States shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives each report submitted under paragraph (1).</text></paragraph><paragraph id="id486c36948ce44c29a20d9c824853dcfd"><enum>(3)</enum><header>Public availability</header><text>No later than 30 days after submitting to Congress each report under paragraph (1), the Judicial Conference of the United States shall make the report available to the public.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id7338858391A14F15BEEDB91000BE00F0"><enum>10.</enum><header>Supreme Court Complaints Review Committee</header><subsection id="id1EE968D4AA5F4CF297AA0CF57750AF3E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idA41D29F22F84434DA6594AE15E054DB9"><enum>(1)</enum><header>Review Committee</header><text>The term <term>Review Committee</term> means the Supreme Court Complaints Review Committee.</text></paragraph><paragraph id="id255d82bacc3d43db9ea7d4fc0c65e46b"><enum>(2)</enum><header>Close family member</header><text>The term <term>close family member</term> includes—</text><subparagraph id="idefb1255c0b804c1aa059c56d0127905d"><enum>(A)</enum><text>a parent of the reporting individual;</text></subparagraph><subparagraph id="idd30412ca3922456ba9f25581d4302b0b"><enum>(B)</enum><text>a spouse of the reporting individual; and</text></subparagraph><subparagraph id="id8dc375ca85f0438facfd8820e5e94d4a"><enum>(C)</enum><text>an adult child of the reporting individual.</text></subparagraph></paragraph></subsection><subsection id="id4B34B482635D4616B8881A50253EFC89"><enum>(b)</enum><header>Establishment</header><text>For the purpose of assisting the House of Representatives in carrying out its responsibilities under section 2 of article I and section 4 of article II of the Constitution of the United States, there is established in the legislative branch to be known as the Supreme Court Complaints Review Committee under the general supervision of the Committee on the Judiciary of the House of Representatives.</text></subsection><subsection id="id47a83ff1cab24f95ba9874dd3612691b"><enum>(c)</enum><header>Members</header><paragraph id="id104CA33AAE5742B98FA228D2E98089E2"><enum>(1)</enum><header>In general</header><text>The Review Committee shall consist of 5 members, of whom—</text><subparagraph id="idb3928b1d962f4bd8bcbd66a1fc42673d"><enum>(A)</enum><text>2 shall be appointed by the Speaker of the House of Representatives;</text></subparagraph><subparagraph id="id55751998fbf041d98edd19055222c1ce"><enum>(B)</enum><text>2 shall be appointed by the minority leader of the House of Representatives; and</text></subparagraph><subparagraph id="id69769991e2bf4355a975c46be09ea093"><enum>(C)</enum><text>1 shall be appointed by agreement of the Speaker of the House of Representatives and the minority leader of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id786fd2c230324cd4a602ee051d3c1028"><enum>(2)</enum><header>Qualifications of review committee members</header><subparagraph id="idcc0779b9fc9f45d782d46ed58efb0c4a"><enum>(A)</enum><header>Expertise</header><text>Each member of the Review Committee shall be an individual of exceptional public standing who is specifically qualified to serve on the Review Committee by virtue of the individual’s education, training, or experience in 1 or more of the following fields:</text><clause id="id7474D0FE73E640859D34B199FD55ED5E"><enum>(i)</enum><text>Constitutional law.</text></clause><clause id="id124372558D684DC2A7BDE018096E8EAC"><enum>(ii)</enum><text>Impeachment.</text></clause><clause id="idA7ACD4670BE24923AE3FF0A0C02685B8"><enum>(iii)</enum><text>Judicial ethics.</text></clause><clause id="id2DF6F7C1F02F4020B816B7C1403DF312"><enum>(iv)</enum><text>Professional ethics.</text></clause><clause id="id55FA341015944AFB9E9DA767FF4EDFB0"><enum>(v)</enum><text>Legal history.</text></clause><clause id="idFD4552C08C204C0F9671FCB5132D09DB"><enum>(vi)</enum><text>Judicial service.</text></clause></subparagraph><subparagraph id="id655ee1e754bd43969fd2830eaf334427"><enum>(B)</enum><header>Selection basis</header><text>Selection and appointment of each member of the Review Committee shall be without regard to political affiliation and solely on the basis of fitness to perform the duties of a member of the Review Committee.</text></subparagraph><subparagraph id="id4545564c02754329ae23566181eacf45"><enum>(C)</enum><header>Citizenship</header><text>Each member of the Review Committee shall be a United States citizen.</text></subparagraph><subparagraph id="id6469c856f6a8403795234d2b0612efe1"><enum>(D)</enum><header>Disqualifications</header><text>No individual shall be eligible for appointment to, or service on, the Review Committee who—</text><clause id="idc17717443be245eaa399431874e2b784"><enum>(i)</enum><text>has ever been registered, or required to be registered, as a lobbyist under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>);</text></clause><clause id="id42ff5c01c1174cc9ac8ca94589e3fac5"><enum>(ii)</enum><text>engages in, or is otherwise employed in, lobbying of the Congress;</text></clause><clause id="ide279aedb44b0492fb6c0ad09d253355d"><enum>(iii)</enum><text>is registered or is required to be registered as an agent of a foreign principal under the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>);</text></clause><clause id="id1f5a6106b72a4ca9863aea4392595917"><enum>(iv)</enum><text>is a currently serving judge, justice, or employee of the Federal courts;</text></clause><clause id="id82f2a65a51c9487db96d460c9d13308e"><enum>(v)</enum><text>is an officer or employee of the Federal Government;</text></clause><clause id="id7ed9c0f3483d4449b5a72eb182423852"><enum>(vi)</enum><text>is a close family member of any judge or justice of the Federal courts; </text></clause><clause id="ide12d70fa169e4296abe325abed434e07"><enum>(vii)</enum><text>during the 4 years preceding the date of appointment, engaged in any significant political activity (including being a candidate for public office, fundraising for a candidate for public office or a political party, or serving as an officer or employee of a political campaign or party);</text></clause><clause id="id244c138b083648efb9482c9a4c04680b"><enum>(viii)</enum><text>during the 2 years preceding the date of appointment, served as a fiduciary or personal attorney for a judge, justice, or employee of the Federal courts, including any judge or justice; or</text></clause><clause id="id8350BA787EE943C1B7ADB1454EEBE260"><enum>(ix)</enum><text>any currently serving Senator or Representative in, or Delegate or Resident Commissioner to, the Congress. </text></clause></subparagraph></paragraph><paragraph id="id5dd63a7b4911421da9f95cad43de57be"><enum>(3)</enum><header>Term and removal</header><subparagraph id="id5553f1550b8043878f2ac0bdacb9fd93"><enum>(A)</enum><header>Length of term</header><text>The term of a member of the Review Committee shall be for 2 Congresses.</text></subparagraph><subparagraph id="id7cdd0f36836948b3954510773b7af19e"><enum>(B)</enum><header>Term limits</header><text>A member of the Review Committee may not serve during 4 consecutive Congresses.</text></subparagraph><subparagraph id="id127d8283f9e9481e8acd4fb3ff424d09"><enum>(C)</enum><header>Removal</header><text>A member of the Review Committee may be removed upon unanimous agreement among the Speaker and the minority leader of the House of Representatives or by an affirmative vote of <fraction>2/3</fraction> of the members of the Committee on the Judiciary of the House of Representatives.</text></subparagraph><subparagraph id="idcc8d1884ca6c42c1877fef4cd9ffa02f"><enum>(D)</enum><header>Vacancies</header><text>Any vacancy on the Review Committee shall be filled for the unexpired portion of the term in the same manner, and by the same appointing authority, as the original appointment under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="ida896752ebbd547e8a048b0d6819cb09a"><enum>(d)</enum><header>Chairperson and Vice-Chairperson</header><paragraph id="ida375d1d6b388430da9afbc20cc92c5ad"><enum>(1)</enum><header>In general</header><text>The members of the Review Committee shall elect a chairperson and a vice-chairperson of the Review Committee by a majority vote. The chairperson and the vice-chairperson shall serve a 1-year term, and may be reelected for additional 1-year terms.</text></paragraph><paragraph id="idfcb33f015ffc4dcc97dfa93f4e03e23e"><enum>(2)</enum><header>Duties</header><text>The chairperson of the Review Committee shall preside at the meetings of the Review Committee, and the vice-chairperson shall preside in the absence or disability of the chairperson.</text></paragraph></subsection><subsection id="id32ae8b693090408c83e98f9c3158ea0d"><enum>(e)</enum><header>Meetings</header><paragraph id="id539ff4016c464e9c84cd27312c119a8b"><enum>(1)</enum><header>Quorum</header><text>A majority of the members of the Review Committee shall constitute a quorum.</text></paragraph><paragraph id="idb4c99ba2b0e44ec8939d66b5ebe99d5c"><enum>(2)</enum><header>Meetings</header><text>The Review Committee shall meet at the call of the chairperson, the chair of the Committee on the Judiciary of the House of Representatives, or the call of a majority of its members, pursuant to the rules of the Review Committee.</text></paragraph><paragraph id="idc815f6af22824c10a2b345b01165d424"><enum>(3)</enum><header>Voting</header><text>Except as otherwise specifically provided, a majority vote of the Review Committee under this subtitle shall require an affirmative vote of 3 or more members.</text></paragraph></subsection><subsection id="id65361c4c87474a63b6dd5b46de9c8de0"><enum>(f)</enum><header>Compensation</header><text>A member of the Review Committee shall not be considered to be an officer or employee of the House or Senate, but shall be compensated at a rate equal to the daily equivalent of the minimum annual rate of basic pay prescribed for GS–15 of the General Schedule under section 5107 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Review Committee.</text></subsection><subsection id="id3d33a0ed67b1430fba10159b21a52188"><enum>(g)</enum><header>Duties of review committee</header><paragraph id="id97b4bdf2100f41089645f4811aa2274a"><enum>(1)</enum><header>In general</header><text>The Review Committee shall review each complaint made against the Chief Justice of the United States or a Justice of the Supreme Court of the United States through the review process described in subsection (m).</text></paragraph><paragraph id="id5758294203054fc18d3884bc53a30cbe"><enum>(2)</enum><header>Hearings</header><text>The Review Committee may hold such hearings as are necessary and may sit and act only in executive session at such times and places, solicit such testimony, and receive such relevant evidence, as may be necessary to carry out its duties.</text></paragraph></subsection><subsection id="idf8f208a5b6714db9a21b100c06268a65"><enum>(h)</enum><header>Financial disclosure reports</header><paragraph id="idf71de0c93d1348c6b35a0b51e2ae8ce2"><enum>(1)</enum><header>In general</header><text>Each member of the Review Committee shall file an annual financial disclosure report with the Clerk of the House of Representatives on or before May 15 of each calendar year immediately following any year in which the member served on the Review Committee. Each such report shall be on a form prepared by the Clerk that is substantially similar to the form required for individuals at the executive branch who must complete a confidential financial disclosure report under section 13104 of title 5, United States Code.</text></paragraph><paragraph id="id2d62d5d945914ccf9ca780230345c2b1"><enum>(2)</enum><header>Distribution of report</header><text>The Clerk of the House of Representatives shall—</text><subparagraph id="id6d8bbf2ac0b844aebdd5bfa5035c8401"><enum>(A)</enum><text>not later than 7 days after the date each financial disclosure report under paragraph (1) is filed, send a copy of each such report to the Committee on the Judiciary of the House of Representatives; and</text></subparagraph><subparagraph id="id32f963785d76490ca54d4de07f72415e"><enum>(B)</enum><text>annually print all such financial disclosure reports as a document of Congress, and make the document available to the public.</text></subparagraph></paragraph></subsection><subsection id="id2b847cfefaf34948a9fd423c15491a8f"><enum>(i)</enum><header>Duties and powers of the Review Committee</header><paragraph id="id51ff19942ecd4d9ea316c084006fc660"><enum>(1)</enum><header>In general</header><text>The Review Committee is authorized—</text><subparagraph id="id359e40767de548a082139e68f3b48c7f"><enum>(A)</enum><text>to establish a process for receiving and reviewing complaints from any person regarding allegations of misconduct by a justice of the Supreme Court of the United States;</text></subparagraph><subparagraph id="id60de64f42d80429f82e90bcf8027f2d3"><enum>(B)</enum><text>to conduct a review of material complaints regarding alleged misconduct by a justice of the Supreme Court of the United States; and</text></subparagraph><subparagraph id="idbdfbf615cb364fec9d00f8706439128e"><enum>(C)</enum><text>in any case where the Review Committee determines, on the basis of the review described in subsection (m), that a justice may have engaged in conduct which might violate the Code of Conduct for United States Judges adopted by the Judicial Conference of the United States or constitute 1 or more grounds for impeachment under article II of the Constitution of the United States, or which, in the interest of justice, is not amenable to resolution by the Review Committee, the Review Committee shall promptly certify such determination, together with any complaint and a record of any associated proceedings to the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id0d917d44c803486db9239b23fe2b9b1f"><enum>(2)</enum><header>Referrals to law enforcement officials</header><subparagraph id="id2227907695204f62b8935cbdb3447969"><enum>(A)</enum><header>In general</header><text>Upon a majority vote of the Review Committee, the Review Committee may refer potential legal violations committed by a justice to the Department of Justice or other relevant Federal or State law enforcement officials, which referral shall include all appropriate evidence gathered during any review or preliminary investigation conducted under this subtitle.</text></subparagraph><subparagraph id="id17975c03a90948cdbf826a3c9897ba76"><enum>(B)</enum><header>Notification</header><text>The Review Committee shall notify the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives of all referrals under this subsection.</text></subparagraph></paragraph><paragraph id="idce7146ab416743e8a2228f79c785b557"><enum>(3)</enum><header>Limitations on review</header><text>No review may be undertaken by the Review Committee of any complaint—</text><subparagraph id="id36eea10747e247a0b773b450d0e928cd"><enum>(A)</enum><text>that is primarily concerned with challenging the merits of a decision or procedural ruling;</text></subparagraph><subparagraph id="id4cf65045c78c42e6a81fbb55c0f923c9"><enum>(B)</enum><text>that is frivolous, lacking sufficient evidence to raise an inference that misconduct has occurred, or containing allegations that are incapable of being established through investigation;</text></subparagraph><subparagraph id="idce89aa84b6b844bebc4d055eed1076f1"><enum>(C)</enum><text>concerning any alleged violation of law, rule, regulation or standard of conduct not in effect at the time of the alleged violation; or</text></subparagraph><subparagraph id="idf8c672dfb48a4861953c147ae711ad0c"><enum>(D)</enum><text>concerning any alleged violation that occurred before the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="id7ed7761d35824c36bf09721f0493f0e7"><enum>(j)</enum><header>Prohibition on public disclosure</header><paragraph id="id698f8e1feb084d44914fed4a5a59d6a4"><enum>(1)</enum><header>In general</header><subparagraph id="id4b72a164d96c4358a0d4a0e7e19846fb"><enum>(A)</enum><header>Prohibition on public disclosure</header><text>No information obtained by a member or employee of the Review Committee regarding complaints shall be publicly disclosed to any person or entity outside the Review Committee, unless approved by a majority vote of the Review Committee. Any communication to any person or entity outside the Review Committee may occur only as authorized by the Review Committee.</text></subparagraph><subparagraph id="id2c41f50ea5914c5f815c3ca6cf8a5fea"><enum>(B)</enum><header>Procedures and investigation</header><text>The Review Committee shall establish, in consultation with relevant agencies, procedures necessary to prevent the unauthorized disclosure of any information received by the Review Committee. Any breaches of confidentiality shall be investigated by the Review Committee and appropriate action shall be taken, which may include a recommendation to Congress for removal pursuant to subsection (c)(3)(C). </text></subparagraph></paragraph><paragraph id="id963cd468bfc04655b66d8f8d0517d7bf"><enum>(2)</enum><header>Provision with respect to House and Senate Judiciary Committees</header><text>Paragraph (1) shall not preclude—</text><subparagraph id="id4bce4b7361cc4b1abec23744d185e838"><enum>(A)</enum><text>any member or employee of the Review Committee from presenting a report or findings of the Committee, or testifying before the Committee on the Judiciary of the House of Representatives, if requested by the Committee on the Judiciary of the House of Representatives pursuant to its rules;</text></subparagraph><subparagraph id="id632f706a1ebe48b0ac879e764581c8d8"><enum>(B)</enum><text>any necessary communication with the Department of Justice or any other law enforcement agency; or</text></subparagraph><subparagraph id="ideb3b1cdb211a43c1bd9a5fb2360c49f1"><enum>(C)</enum><text>any necessary communication with the Speaker or minority leader of the House of Representatives or the majority leader or minority leader of the Senate.</text></subparagraph></paragraph><paragraph id="id6b30367334df472fbfd0553d9d856e0e"><enum>(3)</enum><header>Opportunity to present</header><text>Before the Review Committee votes on a recommendation or statement to be transmitted to the Committee on the Judiciary of the House of Representatives relating to a complaint involving a justice, the Review Committee shall provide the justice whose conduct is the subject of the complaint the opportunity to present, orally or in writing (at the discretion of the justice), a statement to the Review Committee.</text></paragraph></subsection><subsection id="idcf71eaef8e5c4bdda2e0d1e894324ebf"><enum>(k)</enum><header>Presentation of reports to the House Judiciary Committee</header><text>Whenever the Review Committee transmits any report to the Committee on the Judiciary of the House of Representatives relating to a complaint involving a justice, the Review Committee shall designate a member or employee of the Review Committee to present the report to the House Judiciary Committee if requested by the Committee on the Judiciary of the House of Representatives.</text></subsection><subsection id="id92c0b5bf5a18452c92225bc9472a5abd"><enum>(l)</enum><header>Maintaining of financial disclosure reports</header><text>The Review Committee shall receive, and maintain, a copy of each report filed under section 13103 of title 5, United States Code, by a justice of the Supreme Court of the United States.</text></subsection><subsection id="id0c7878d806fa49a99527c2ffe29558b3"><enum>(m)</enum><header>Complaints</header><paragraph id="idd36fb649cb094a66b4aff1be46dadd3f"><enum>(1)</enum><header>Source of complaints</header><text>Any person, including a judge, justice, or employee of the courts of the United States, may file with the Review Committee a complaint alleging a violation by a justice of any law (including any regulation), rule, or other standard of conduct, including the Code of Conduct for United States Judges adopted by the Judicial Conference of the United States, applicable to the conduct of such justice in the performance of the duties, or the discharge of the responsibilities, of the justice.</text></paragraph><paragraph id="idd384c37171fd4ca88bf351ecbf5436f4"><enum>(2)</enum><header>False claims and statements acknowledgment</header><text>Any complaint submission under paragraph (1) shall include a signed statement acknowledging that the person submitting the allegation or information understands that section 1001 of title 18, United States Code (popularly known as the <quote>False Statements Act</quote>) applies to the information. </text></paragraph><paragraph id="id64627bb4216547628845f8a044365c66"><enum>(3)</enum><header>Review process of alleged violations by a justice</header><subparagraph id="idff911183c9d14ec99aebcd8330d800a1"><enum>(A)</enum><header>Review authorization</header><clause id="idBCAC1031FC1F49AA9F3512361312F0ED"><enum>(i)</enum><header>In general</header><text>After receiving a complaint under paragraph (1), the Review Committee may, by majority vote, authorize a review under subparagraph (B) of any alleged violation by a justice of any law (including any regulation), rule, or other standard of conduct, including the Code of Conduct for United States Judges adopted by the Judicial Conference of the United States, applicable to the conduct of such justice in the performance of the duties, or the discharge of the responsibilities, of the justice.</text></clause><clause id="idDDFF53CD57694572A7E791E2BCDB57CC"><enum>(ii)</enum><header>Requirements</header><text>The authorization under clause (i) shall—</text><subclause id="id5989EBAD0C8E4EC39222E3926D15474E"><enum>(I)</enum><text>be in writing; and</text></subclause><subclause id="idDC98EAB42D7F4C90A306E68ADFAFA575"><enum>(II)</enum><text>include a brief description of the specific matter and an explanation of why allegations in complaint meet the criteria in subsection (i)(3).</text></subclause></clause></subparagraph><subparagraph id="idcbafe427758942ad9e1144010b606e1b"><enum>(B)</enum><header>Review process</header><clause id="id6e6b10c2c5934007acbeb2abc72b296f"><enum>(i)</enum><header>Initiation and notification of review</header><text>After the date on which the Review Committee makes an authorization under subparagraph (A), the Review Committee shall—</text><subclause id="idb0edbe8fa1914e5ba90b6cd7c51d9324"><enum>(I)</enum><text>initiate a review of the alleged violation; and</text></subclause><subclause id="id32d43ff3de4b4a0ca0e5fed538c4ddd9"><enum>(II)</enum><text>provide a written notification of the commencement of the review, including a statement of the nature of the review, to—</text><item id="id1c3b69606f304775b63696ca411074a3"><enum>(aa)</enum><text>the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives; and</text></item><item id="id4a7a58047c634118934fe1c76e6f1bf3"><enum>(bb)</enum><text>the justice who is the subject of the review.</text></item></subclause></clause><clause id="id1fdb065cfb224028b4fba009bbf56971"><enum>(ii)</enum><header>Opportunity to terminate review</header><text>At any time, the Review Committee may, by a majority vote, terminate a review on any ground, including that the matter under review is de minimis in nature. If the Review Committee votes to terminate the review, the Committee shall—</text><subclause id="iddc3c545d1e484782857c9346d30d4597"><enum>(I)</enum><text>notify, in writing, the complainant, the justice who was the subject of the review, the Committee on the Judiciary of the Senate, and the Committee on the Judiciary of the House of Representatives of its decision to terminate the review of the matter; and</text></subclause><subclause id="id2ebbaac6c83b4cebb4e1402599cde976"><enum>(II)</enum><text>send a report, including any findings of the Review Committee, to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</text></subclause></clause></subparagraph><subparagraph id="idf7fc0693b3a742f69de506fa11948931"><enum>(C)</enum><header>Scope of review</header><text>During a review, the Review Committee shall evaluate the complaint and determine, based on a majority vote, whether the misconduct alleged in the complaint, if true, may constitute <quote>Treason, Bribery, and other high Crimes and Misdemeanors</quote> under section 4 of article II of the Constitution of the United States.</text></subparagraph><subparagraph id="id0cf03b9635f54daaadd1e90c815a2275"><enum>(D)</enum><header>Completion of review</header><text>Upon the completion of any review, the Review Committee shall—</text><clause id="id76d5f68bd13247afa000e6ff036927fd"><enum>(i)</enum><text>transmit to the Committee on the Judiciary of the House of Representatives a written report that includes—</text><subclause id="idca70913d69aa4e8eb00659cc042b66a3"><enum>(I)</enum><text>a statement of the nature of the review and the justice who is the subject of the review;</text></subclause><subclause id="id7bbc97be84574568b9284b3bcadcb714"><enum>(II)</enum><text>the Review Committee’s determination under paragraph (3);</text></subclause><subclause id="id57cef3fc48b541ada69f291e366a0fbe"><enum>(III)</enum><text>a description of the number of members voting in the affirmative and in the negative for the determination under subparagraph (C);</text></subclause><subclause id="id8e51a82fd71e4945b298bc79bc480526"><enum>(IV)</enum><text>any relevant findings of the Review Committee, including—</text><item id="id10c235eac77e43b4ab17be53e43b6013"><enum>(aa)</enum><text>any findings of fact;</text></item><item id="id4933856ccd61447c91ce222d67923753"><enum>(bb)</enum><text>a description of any relevant information that the Review Committee was unable to obtain or witnesses whom the Review Committee was unable to interview, and the reasons therefor; and</text></item><item id="idca06930da9d54101877b932695e3ed01"><enum>(cc)</enum><text>a citation of any relevant law, regulation, or standard of conduct relating to the alleged misconduct;</text></item></subclause><subclause id="id9bd1b7ffe1db4a34afd25624eb0471b8"><enum>(V)</enum><text>any supporting documentation;</text></subclause><subclause id="id590eee78f8c542b2be759a2379af660f"><enum>(VI)</enum><text>a written determination of whether the misconduct alleged in the complaint, if true, may constitute <quote>Treason, Bribery, and other high Crimes and Misdemeanors</quote> under section 4 of article II of the Constitution of the United States; and</text></subclause><subclause id="id0210200807BB4EC4886F6AF464F6CE85"><enum>(VII)</enum><text>if necessary, a brief statement of dissent from the members of the Review Committee voting in the negative for the determination under subparagraph (C); and </text></subclause></clause><clause id="idb0dea6ec7ef546599eabd4ace0f6d3d6"><enum>(ii)</enum><text>transmit to the complainant and the justice who is the subject of the review the written report of the Review Committee described in clause (i).</text></clause></subparagraph></paragraph></subsection><subsection id="id0c971164e6204c7fb36982bd540b8a49"><enum>(n)</enum><header>House Judiciary Committee Consideration of Review Committee Report</header><text>If the Review Committee determines, after a review, that misconduct alleged in a complaint, if true, may constitute <quote>Treason, Bribery, and other high Crimes and Misdemeanors</quote> under section 4 of article II of the Constitution of the United States, not later than 30 legislative days of continuous session in the House of Representatives after the Committee on the Judiciary of the House of Representatives receives a report under subsection (m), the Committee on the Judiciary of the House of Representatives shall vote on whether to proceed with an investigation or an impeachment inquiry.</text></subsection><subsection id="id7c6d42bfff5143d4a5ca19e2c4c177f4"><enum>(o)</enum><header>Request from House Judiciary Committee</header><paragraph id="idec951d54b62b41f990e81664742ac5b1"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section, upon receipt of a written request from the Committee on the Judiciary of the House of Representatives that the Review Committee cease its review of any matter and refer such matter to the Committee on the Judiciary of the House of Representatives because of the ongoing investigation of the matter by the Committee on the Judiciary of the House of Representatives, the Review Committee shall refer such matter to the Committee on the Judiciary of the House of Representatives, cease its review of that matter and so notify any justice who is the subject of the review.</text></paragraph><paragraph id="idef01632bb8ae453f98d2459b88df4048"><enum>(2)</enum><header>Resumption of review</header><text>If the Committee on the Judiciary of the House of Representatives notifies the Review Committee in writing that the Review Committee may continue its review of the complaint, the Review Committee may begin or continue, as the case may be, a review of the matter.</text></paragraph><paragraph id="id598A3614ACD5441B92DFBA027A9E76BA"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to prevent the Review Committee from sending any information regarding the matter to law enforcement agencies.</text></paragraph></subsection><subsection id="idc1c87a88245e4418a120532e0bc38bbf"><enum>(p)</enum><header>Procedures</header><paragraph id="id2a5109973e1f4feb9f481d414bc39925"><enum>(1)</enum><header>Review powers</header><text>Members or employees of the Review Committee may, during a review—</text><subparagraph id="id78ab8f2be6ee4069be51a8635b3c1c02"><enum>(A)</enum><text>administer to or take from any person an oath, affirmation, or affidavit;</text></subparagraph><subparagraph id="idb7fd12ceb32b41d0a11e94a0bd48a329"><enum>(B)</enum><text>obtain information or assistance from any Federal, State, or local governmental agency, or other entity, or unit thereof, including all information kept in the course of business by the Judicial Conference of the United States, the judicial councils of circuits, the Administrative Office of the United States Courts, and the United States Sentencing Commission;</text></subparagraph><subparagraph id="id4e40f96b84884b359b9837ad55186d5e"><enum>(C)</enum><text>take the deposition of witnesses; and</text></subparagraph><subparagraph id="id69bd542ef8b54584a47ecc8d81acb4b6"><enum>(D)</enum><text>submit to the chair of the Committee on the Judiciary of the House of Representatives a request for the Committee on the Judiciary of the House of Representatives to require by subpoena the attendance of and testimony by witnesses and the production of any book, check, canceled check, correspondence, communication, document, email, paper, physical evidence, record, recording, tape, or other material (including electronic records) relating to any matter or question the Review Committee is authorized to review from any individual or entity, which—</text><clause id="id853ccfb20bd64a00a8fe2d6d4468b297"><enum>(i)</enum><text>shall be handled in accordance with the rules of the Committee on the Judiciary of the House of Representatives; and</text></clause><clause id="id3e2e6899300d444595461b7cd7d1523e"><enum>(ii)</enum><text>may allow for the transmission of information or testimony between the Review Committee and the Committee on the Judiciary of the House of Representatives, in accordance with rules of the Committee on the Judiciary of the House of Representatives. </text></clause></subparagraph></paragraph><paragraph id="idcc0d589b54104a0697befb3669d49ac3"><enum>(2)</enum><header>Prohibition of ex parte communications</header><text>There shall be no ex parte communications between any member or employee of the Review Committee and any justice who is the subject of any review by the Review Committee or between any member of the Review Committee and any interested party.</text></paragraph><paragraph id="id5f41eb00087f45d28ec705df34e8eb18"><enum>(3)</enum><header>Other review committee rules and procedures</header><text>The Review Committee is authorized to establish any additional rules or procedures pursuant to its duties and powers in paragraph (1) necessary to carry out the functions of the Review Committee in accordance with this section.</text></paragraph></subsection><subsection id="idea66f30879394f5c837a0968a7083d8b"><enum>(q)</enum><header>Personnel matters</header><paragraph id="id2c17187adf7849af97c744f890c5c5cd"><enum>(1)</enum><header>Appointment and compensation of employees</header><text>The Review Committee may appoint and fix the compensation of such professional, nonpartisan staff (including staff with relevant experience in investigations and law enforcement) of the Review Committee as it considers necessary to perform its duties, who—</text><subparagraph id="idEC0E55D598534EA38233CF7B8D5DBD2C"><enum>(A)</enum><text>shall perform all official duties in a nonpartisan manner; and</text></subparagraph><subparagraph id="idB445445760E841FAA13F0EC20EC1111E"><enum>(B)</enum><text>may not engage in any partisan political activity directly affecting any congressional or presidential election, or any nomination of a Federal judge or justice. </text></subparagraph></paragraph><paragraph id="ide9e75f364c4241b89295fe9ab4d3d725"><enum>(2)</enum><header>Qualifications</header><text>Each employee of the Review Committee shall be professional and demonstrably qualified for the position for which the employee is hired.</text></paragraph><paragraph id="idfdee6ca583974874ba162105c9908b83"><enum>(3)</enum><header>Termination of employees</header><text>The employment of an employee of the Review Committee may be terminated at any time by the Review Committee.</text></paragraph><paragraph id="iddc5514b3750648058d492d45acace9e4"><enum>(4)</enum><header>Code of conduct</header><text>The Review Committee shall establish a code of conduct to govern the behavior of the members or employees of the Review Committee, which shall include the avoidance of conflicts of interest.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ea1d37da76a477d8fdc288913f38ac3"><enum>(r)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section such sums as may be necessary. </text></subsection></section><section id="id4fd77f5ac7f34f8dae99489394767010"><enum>11.</enum><header>Expedited impeachment of Federal judges</header><text display-inline="no-display-inline">Section 355(b) of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id34BF2D0ECB22407A842996AFB051E5A8"><paragraph id="id1A8949DF446F4E8F81030554BD7A419B"><enum>(3)</enum><header>Expedited impeachment</header><subparagraph id="id71C9969FE43C41EAB06972265A00351F"><enum>(A)</enum><header>In general</header><text>After the Judicial Conference transmits the determination and the record of proceedings under paragraph (1) or (2) to the House of Representatives, the determination and record shall be immediately referred to the Committee on the Judiciary of the House of Representatives.</text></subparagraph><subparagraph id="id569A0356AE4641BA9B1B6ADFC1F5C12F"><enum>(B)</enum><header>Vote</header><text>Not later than 30 legislative days of continuous session in the House of Representatives after the Committee on the Judiciary of the House of Representatives receives the determination and the record of proceedings under subparagraph (A), the Committee on the Judiciary of the House of Representatives shall vote on whether to proceed with an investigation or an impeachment inquiry.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6A29ABD971CC46F5A120F78D70447A29"><enum>12.</enum><header>Restrictions on protective orders and sealing of cases and settlements</header><subsection commented="no" display-inline="no-display-inline" id="H500555C157FE4FFD8F59187173FA6170"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/111">Chapter 111</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H30494EFB883D4D69A0AEE7CF483DAC5C"><section id="H9827258A7F1E4BC8B1136817682143E0"><enum>1660.</enum><header>Restrictions on protective orders and sealing of cases and settlements</header><subsection id="H6B18F6F4A5A24CC2B850FD0B2CB74FDE"><enum>(a)</enum><header>Restrictions on orders relating to the disclosure of information</header><paragraph id="H275E8E072CB24318A56D25292A9A163D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any civil action in which the pleadings state facts that are relevant to the protection of public health or safety, a court shall not enter, by stipulation or otherwise, an order otherwise authorized under rule 26(c) of the Federal Rules of Civil Procedure restricting the disclosure of information obtained through discovery, an order otherwise authorized approving a settlement agreement that would restrict the disclosure of information obtained through discovery, or an order otherwise authorized restricting access to court records unless in connection with the order the court finds—</text><subparagraph id="H1978EB6DDB714BAE9156E06949745796"><enum>(A)</enum><text>that the order would not restrict the disclosure of information which is relevant to the protection of public health or safety; or</text></subparagraph><subparagraph id="H82982913BB424B16BBF9678EEAB0610C"><enum>(B)</enum><text>that—</text><clause id="id73A201D1AC2D48899214BC9A675D2BCB"><enum>(i)</enum><text>the public interest in the disclosure of past, present, or potential public health or safety hazards is outweighed by a specific and substantial interest in maintaining the confidentiality of the information or records in question; and</text></clause><clause id="H53C1F1D37AB44B459CF7E84AF8EF003E"><enum>(ii)</enum><text display-inline="yes-display-inline">the requested order is no broader than necessary to protect the confidentiality interest asserted.</text></clause></subparagraph></paragraph><paragraph id="H471C5FDA5DF34ED4936260D241662892"><enum>(2)</enum><header>Limit on effect</header><text>No order entered in accordance with paragraph (1), other than an order approving a settlement agreement, may continue in effect after the entry of final judgment unless at the time of, or after, the entry of the order the court makes a separate finding of fact that the requirements of paragraph (1) continue to be met.</text></paragraph><paragraph id="idD2F52789B7E14CB8B0882445733700DF"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in paragraph (1) shall be construed to require the disclosure of the identity of individuals who disclose evidence of a violation of any law, rule, or regulation or other fraud, waste, abuse, or misconduct or other persons protected from disclosure under Federal law. </text></paragraph></subsection><subsection id="HF26C3A78268446478A6833663A5127F1"><enum>(b)</enum><header>Restrictions on enforcement relating to Federal and State agencies</header><text display-inline="yes-display-inline">In any civil action in which the pleadings state facts that are relevant to the protection of public health or safety, a court shall not enforce any provision of an agreement between or among parties to the civil action, or enforce an order entered in accordance with subsection (a)(1), to the extent that the provision or order prohibits or otherwise restricts a party from disclosing any information relevant to the civil action to any Federal or State agency with authority to enforce laws regulating an activity relating to the information.</text></subsection><subsection id="HC1883336921F4787AAA9F32ED55BD902"><enum>(c)</enum><header>Limits on scope</header><paragraph id="id3FAFF25B683948B29A51B2A0DA5D6F2B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), a court shall not enforce any provision of a settlement agreement between or among parties to any civil action in which the pleadings state facts that are relevant to the protection of public health or safety that prohibits one or more parties from—</text><subparagraph id="H5E2BE4B55BC7483F8401DAD2D2139E9F"><enum>(A)</enum><text display-inline="yes-display-inline">disclosing the fact that the settlement was reached or the terms of the settlement (excluding any money paid) that involve matters relevant to the protection of public health or safety; or</text></subparagraph><subparagraph id="HEDF4DFA88BF144D0B88B6D1CC7AB7761"><enum>(B)</enum><text display-inline="yes-display-inline">discussing matters relevant to the protection of public health or safety involved in the civil action.</text></subparagraph></paragraph><paragraph id="HE4D66AACCB7D4648AF482657312614C7"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) applies unless the court finds that—</text><subparagraph id="HF381F5E87F984DB39E7BB77F544C5B60"><enum>(A)</enum><text display-inline="yes-display-inline">the public interest in the disclosure of past, present, or potential public health or safety hazards is outweighed by a specific and substantial interest in maintaining the confidentiality of the information in question; and</text></subparagraph><subparagraph id="HA69D5A3EF62C4309A10C2F4DF664D06E"><enum>(B)</enum><text display-inline="yes-display-inline">the requested order is no broader than necessary to protect the confidentiality interest asserted.</text></subparagraph></paragraph></subsection><subsection id="H90947803620143F48CCDD13C44D971E4"><enum>(d)</enum><header>Rebuttable presumption relating to personally identifiable information</header><text>For purposes of implementing subsections (a)(1)(B)(i) and (c)(2)(A), when weighing the interest in maintaining confidentiality under this section, there shall be a rebuttable presumption that the interest in protecting personally identifiable information of an individual outweighs the public interest in disclosure.</text></subsection><subsection id="HBB0CD0CC7707491494359517F0B5B875"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to permit, require, or authorize the disclosure of classified information (as defined under section 1 of the Classified Information Procedures Act (18 U.S.C. App.)).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6B39978B395A491AA581FBCF66AE9F50"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/111">chapter 111</external-xref> of title 28, United States Code, is amended by adding after the item relating to section 1659 the following:</text><quoted-block style="USC" id="HC9BDB516B9AB416EA81D87F77D8879E9"><toc regeneration="no-regeneration"><toc-entry level="section">1660. Restrictions on protective orders and sealing of cases and settlements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H36510B859B89496E947B23634947D933"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall—</text><paragraph id="HC391D347119F49EFB3A4B05C6612692E"><enum>(1)</enum><text>take effect 30 days after the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H429A17EB52EA4D3990A6C7EE9AB65C26"><enum>(2)</enum><text>apply only to orders entered in civil actions or agreements entered into on or after such date.</text></paragraph></subsection></section><section id="id5ca5f3647dd6441c80956997d36c61a2"><enum>13.</enum><header>Judicial workplace climate surveys</header><subsection id="idEECF335C784E47F98F585ACA3E7DD3AF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/21">Chapter 21</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7D99B7736A6142D09B569B5D0DB534B1"><section id="idB2BCCDCC2C5B4F219002A339DB4A22E4"><enum>464.</enum><header>Judicial workplace climate surveys</header><subsection id="idE73172DBAD364EABA42F317B1101949E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Judicial Conference of the United States shall administer a climate survey to each employee of a court of the United States about the work environment of the court, which shall—</text><paragraph id="id84b378faf1e141b0bbe07aa473e59e5b"><enum>(1)</enum><text>be administered not later than 18 months after the date of enactment of this section and every 2 years thereafter; </text></paragraph><paragraph id="id5C5016ABAD634D03BF61A28BE1B7DC66"><enum>(2)</enum><text>be voluntary;</text></paragraph><paragraph id="id3dd300f45c1e4985b3abb7666a7c8b12"><enum>(3)</enum><text>survey respondents on the general work environment, including attitudes in the workplace regarding diversity and inclusion and harassment or discrimination on the basis of race, ethnicity, disability, sex, sexual orientation, and gender identity; and</text></paragraph><paragraph id="idb32374646df248649d30eab4b0ef7423"><enum>(4)</enum><text>be anonymous and confidential, with notice of the anonymity and confidentiality made to the respondent throughout the survey.</text></paragraph></subsection><subsection id="idA9F768FD486D4370922E2D1E38ED03E4"><enum>(b)</enum><header>Transmission of information</header><text>Information obtained in a survey administered under subsection (a) shall be—</text><paragraph id="id33C3E23B181F42F3A765B0F980E334AE"><enum>(1)</enum><text>made publicly available; and</text></paragraph><paragraph id="id5FB13FE8169E471FBC5CA0D469DD953E"><enum>(2)</enum><text>transmitted to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives, the Chief Justice of the United States, and the Judicial Conference of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA154F2EB66EB4EA6A56D27C496990475"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/21">chapter 21</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="iddf7e63f3-e9ec-4f9d-8d8b-eed21e48ad81"><toc><toc-entry level="section" idref="idB2BCCDCC2C5B4F219002A339DB4A22E4">464. Judicial workplace climate surveys.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2f6f34da54ff41b2a2f9d6e277455825"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act and of the amendments made by this Act, and the application of the remaining provisions of this Act and amendments to any person or circumstance, shall not be affected.</text></section></legis-body></bill>
