which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand the categories of forfeited property available to remediate harms to Ukraine from Russian aggression, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transferring Illicit Assets to Ukraine Act of 2023</short-title></quote>.</text></section><section id="idbef2c9dfe26d4be38a743fb8d8cb3da8"><enum>2.</enum><header>Expansion of forfeited property available to remediate harms to Ukraine from Russian aggression</header><subsection id="id9754ec1c11874c04b18e78dd7b4937b1"><enum>(a)</enum><header>In general</header><text>Subsection (c) of section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023 (division M of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide034b777e7b64c5ca74ac8979c7465a9"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>which property belonged</quote> and all that follows and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id2fc148b108e34837a197f772a6ad807a"><text>which property—</text><subparagraph id="idd03f030b72354cc6b4743feb4db35380"><enum>(A)</enum><text>belonged to, was possessed by, or was controlled by a person subject to sanctions imposed by the United States with respect to the Russian Federation under any provision of law; </text></subparagraph><subparagraph id="id61fe46c1555e4246be270ce5969db555"><enum>(B)</enum><text>was involved in an act in violation of—</text><clause id="id2771305b44f9427f9178b38c563b0150"><enum>(i)</enum><text>any sanction described in subparagraph (A); or</text></clause><clause id="idec9b280c61924d639d930667d8fcaa86"><enum>(ii)</enum><text>any restriction on the export, reexport, or in-country transfer of items imposed by the United States under the Export Administration Regulations, or any restriction on the export, reexport, or retransfer of defense articles under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations, with respect to—</text><subclause commented="no" display-inline="no-display-inline" id="id76e40e7a531549f492423226ad5b2f98"><enum>(I)</enum><text display-inline="yes-display-inline">the Russian Federation, Belarus, the Crimea, or the so-called Donetsk and Luhansk People’s Republic regions of Ukraine;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida24e01df991d47e48d3b5864e0528a07"><enum>(II)</enum><text display-inline="yes-display-inline">any person in any such country or region on a restricted parties list; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf576214a31bd41858240876960a5f42e"><enum>(III)</enum><text display-inline="yes-display-inline">any person located in any other country that has been added to a restricted parties list in connection with the malign conduct of the Russian Federation in Ukraine, including the annexation of the Crimea region of Ukraine in March 2014 and the invasion beginning in February 2022 of Ukraine, as substantially enabled by Belarus; or</text></subclause></clause></subparagraph><subparagraph id="id518f2b66e9cc4ea3b401ee88e7e5eb1e"><enum>(C)</enum><text>was involved in any related conspiracy, scheme, or other Federal offense arising from the actions of, or doing business with or acting on behalf of, the Russian Federation, Belarus, or the Crimea, or the so-called Donetsk and Luhansk People’s Republic regions of Ukraine.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id091b136823b9483e8da1cda375825e7c"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3FA009977CD040A8AD88D0B62407F36D"><paragraph id="idadcc73087fa347d485cf205c2e7fc3f5"><enum>(3)</enum><text>The term <quote>Export Administration Regulations</quote> has the meaning given that term in section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>). </text></paragraph><paragraph id="ida1a0b2552fc14814a96c3767035c5463"><enum>(4)</enum><text>The term <term>restricted parties list</term> means any of the following lists maintained by the Bureau of Industry and Security:</text><subparagraph id="id3e7a1108d8284295948b5be84dc91771"><enum>(A)</enum><text>The Entity List set forth in Supplement No. 4 to part 744 of the Export Administration Regulations.</text></subparagraph><subparagraph id="id27ed000983d5445785c212665e97199d"><enum>(B)</enum><text>The Denied Persons List maintained pursuant to section 764.3(a)(2) of the Export Administration Regulations.</text></subparagraph><subparagraph id="id1de0a92592904e438eac91e6201453b3"><enum>(C)</enum><text>The Unverified List set forth in Supplement No. 6 to part 744 of the Export Administration Regulations.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide6a1b2781741450fbd89b6cb339615db"><enum>(b)</enum><header>Semiannual reports</header><text>Such section is further amended—</text><paragraph id="idffb197f59e3b45729696174185a2a8e7"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="idd4d597ad795c4193aa7fb20218af1963"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf7554dbea4864aab834f972f79617207"><subsection id="id06cf3dd9b93442c6964845d15591782a"><enum>(c)</enum><text>Not later than 180 days after the date of the enactment of the <short-title>Transferring Illicit Assets to Ukraine Act of 2023</short-title>, and every 180 days thereafter, the Attorney General, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit to the appropriate congressional committees a report on—</text><paragraph id="idd2ac6a90e257485b852244ce52618d30"><enum>(1)</enum><text>transfers made under subsection (a) during the 180 days preceding submission of the report; and</text></paragraph><paragraph id="id672f0047102f487398bbeae50ff387b5"><enum>(2)</enum><text>progress made in remediating the harms of Russian aggression towards Ukraine as a result of such transfers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf551587c127745bfb6bc5c9cfb267a3d"><enum>(c)</enum><header>Plan required</header><paragraph id="id1f85a580c0bf4174a5039a699b4d7b23"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Attorney General, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit to the appropriate congressional committees a plan for using the authority provided by section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023, as amended by this section.</text></paragraph><paragraph id="ida6b28b90485b4ba7a49e8f014cba661b"><enum>(2)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> has the meaning given that term by section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023, as amended by this section. </text></paragraph></subsection></section></legis-body></bill>
