<congress display="yes">118th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1890</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To provide for the establishment of a land health management program on Federal land in Malheur County, Oregon, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idcad55815-998e-4f22-af89-5d6a27153b4b" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Malheur Community Empowerment for the Owyhee Act</short-title></quote>.</text></section><section id="id2cf6c3f0-f47d-4b60-a172-1eaffa608ffa" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0cba1e3d-f9d2-479e-9036-6e71a1b06fb8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Bureau</header><text display-inline="yes-display-inline">The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="id3f5778a6-4c07-438a-a7f5-f8e7e40cf19a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">County</header><text display-inline="yes-display-inline">The term <term>County</term> means Malheur County, Oregon.</text></paragraph><paragraph id="ide5d6623e-aa3d-4c30-8c2b-b4e52bcbd896" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means land in the County managed by the Bureau.</text></paragraph><paragraph id="id6cbc114a-e17c-46db-b7e3-d100e5f9156d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Long-term ecological health</header><text display-inline="yes-display-inline">The term <term>long-term ecological health</term>, with respect to an ecosystem, means the ability of the ecological processes of the ecosystem to function in a manner that maintains the composition, structure, activity, and resilience of the ecosystem over time, including an ecologically appropriate diversity of plant and animal communities, habitats, connectivity, and conditions that are sustainable through successional processes.</text></paragraph><paragraph id="id0eba9350-45a2-49a9-949d-d9bd005c392d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Malheur C.E.O. Group</header><text display-inline="yes-display-inline">The term <term>Malheur C.E.O. Group</term> means the group established by section 4(b).</text></paragraph><paragraph id="id08fa542d-f3e0-4140-9149-1ad39a2c2872" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Operational flexibility</header><text display-inline="yes-display-inline">The term <term>operational flexibility</term>, with respect to grazing on the Federal land, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1f96f7c1-49b2-4834-bd84-98759a139a03" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a seasonal adjustment of livestock positioning for the purposes of that grazing pursuant to a flexible grazing use authorized under the program with respect to which written notice is provided; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide64a705e-01bc-4e88-9865-1b70ebd18286" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">an adjustment of water source placement with respect to which written notice is provided.</text></subparagraph></paragraph><paragraph id="idcf663f44-f722-47b5-bae5-e3d44a438664" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the Malheur County Grazing Management Program authorized under section 3(a).</text></paragraph><paragraph id="id9ea4164f-ae80-47a6-8b8b-2ff1122abfe8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id96edf90c-8355-4dcc-ad2f-343becb732f5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State of Oregon.</text></paragraph></section><section id="ida477ebd5-f28b-45c9-bd95-fca78ad458ac" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Malheur County Grazing Management Program</header><subsection id="id6dc9be61-596f-4ecb-9d58-8723e7a8d261" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may carry out a grazing management program on the Federal land, to be known as the <quote>Malheur County Grazing Management Program</quote>, in accordance with applicable law (including regulations) and the memorandum entitled <quote>Bureau of Land Management Instruction Memorandum 2018–109</quote> (as in effect on September 30, 2021), to provide to authorized grazing permittees and lessees increased operational flexibility to improve the long-term ecological health of the Federal land.</text></subsection><subsection id="id3a5088c8-b3ec-45bf-849d-fbb7d6939cfa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Permit operational flexibility</header><paragraph id="id73e33322-c3a6-45ff-95fd-b1fe2045f7fa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Flexible grazing use alternative for a grazing permit or lease</header><text display-inline="yes-display-inline">At the request of an authorized grazing permittee or lessee, for purposes of renewing a grazing permit or lease under the program, pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Secretary shall develop and analyze at least 1 alternative to provide operational flexibility in livestock grazing use to account for changing conditions.</text></paragraph><paragraph id="id000a9d12-8f40-4082-8b1f-a6f0f80e1791" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall develop alternatives under paragraph (1) in consultation with—</text><subparagraph id="idf08be220-0c90-40f1-9fda-22d977186792" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable grazing permittee or lessee;</text></subparagraph><subparagraph id="idb19c653f-3666-4095-b168-1d7159e19f4e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">affected Federal and State agencies;</text></subparagraph><subparagraph id="idcfcbfc04-25c8-4a55-85ea-98925e25385f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Malheur C.E.O. Group;</text></subparagraph><subparagraph id="id5a77f9f0-444f-4d5e-a833-e93e24456739" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Burns Paiute Tribe or the Fort McDermitt Paiute and Shoshone Tribes, as applicable;</text></subparagraph><subparagraph id="ided23ca70-c3e6-4878-a949-e48b00d9d7ec" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">other landowners in the affected allotment; and</text></subparagraph><subparagraph id="idb37f2969-4abc-4bd9-bb89-99ca3192d4d4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">interested members of the public.</text></subparagraph></paragraph><paragraph id="id96dd186a-37a6-4647-ba29-d9b83062f4ab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Implementation of interim operational flexibilities</header><text display-inline="yes-display-inline">If an applicable monitoring plan has been adopted under paragraph (4), in order to improve long-term ecological health, on the request of an authorized grazing permittee or lessee, the Secretary shall, using new and existing data, allow a variance to the terms and conditions of the existing applicable grazing permit or lease for the applicable year due to significant changes in weather, forage production, effects of fire or drought, or other temporary conditions—</text><subparagraph id="idf9758895-a525-429c-8dbc-59e2507f9bdb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to adjust the season of use, the beginning date of the period of use, the ending date of the period of use, or both the beginning date and ending date, as applicable, under the grazing permit or lease, subject to the requirements that—</text><clause id="id16828811-8b0c-407c-93d9-456926748e13" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">unless otherwise specified in the appropriate allotment management plan or any other activity plan that is the functional equivalent to the appropriate allotment management plan under section 4120.2(a)(3) of title 43, Code of Federal Regulations (or a successor regulation), the applicable adjusted date of the season of use occurs—</text><subclause id="id2c6f0e80-e936-4d2f-b64e-0671caf7de43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">not earlier than 14 days before the beginning date specified in the applicable permit or lease; and</text></subclause><subclause id="id184fc10d-28c5-45c1-b07e-049a89800c4d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">not later than 14 days after the ending date specified in the applicable permit or lease; and</text></subclause></clause><clause id="id3d8d56e6-36f5-4d4b-b364-5116186234fc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the authorized grazing permittee or lessee provides written notice of the adjustment to the Bureau not later than 2 business days before the date of adjustment;</text></clause></subparagraph><subparagraph id="idafd2f58a-a609-4c5f-9d46-77d9e4475205" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to adjust the dates for pasture rotation based on average vegetation stage and soil condition by not more than 14 days, subject to the requirement that the authorized grazing permittee or lessee shall provide to the Bureau written notice of the adjustment not later than 2 business days before the date of adjustment;</text></subparagraph><subparagraph id="idddfafd7b-3926-4408-acc9-32249bdc6391" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to adjust the placement of water structures for livestock or wildlife by not more than 100 yards from an associated existing road, pipeline, or structure, subject to applicable laws and the requirement that the authorized grazing permittee or lessee shall provide to the Bureau written notice of the adjustment not later than 2 business days before the date of adjustment; and</text></subparagraph><subparagraph id="id01c4776f-722d-43c2-9bfa-7d2a3bef7981" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">in a case in which the monitoring plan adopted under paragraph (4) indicates alterations in the operational flexibilities are necessary to achieve ecological health or avoid immediate ecological degradation of the allotment or allotment area, to adjust the operational flexibilities immediately, subject to the requirement that the authorized grazing permittee or lessee shall provide written notice of the adjustment to the Bureau and the individuals and entities described in subparagraphs (B) through (F) of paragraph (2).</text></subparagraph></paragraph><paragraph id="id747725ae-c312-4ada-bbdf-a63a6601e160" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Monitoring plans</header><subparagraph id="id4ed1ba42-7aa5-4020-a30c-e7fda471e751" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Monitoring plans for permit flexibility</header><clause commented="no" display-inline="no-display-inline" id="idbf9dbc15-62c9-40cd-b4e5-5099cd05788c" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall adopt cooperative rangeland monitoring plans and rangeland health objectives to apply to actions taken under paragraph (1) and to monitor and evaluate the improvements or degradations to the long-term ecological health of the Federal land under the program, in consultation with grazing permittees or lessees and other individuals and entities described in paragraph (2), using existing or new scientifically supportable data.</text></clause><clause id="id0493c335-a92a-4145-9da7-657783fe7a97" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A monitoring plan adopted under clause (i) shall—</text><subclause id="id6e5784b4-7f55-4144-85fc-649d9aac2c8e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">identify situations in which providing operational flexibility in grazing permit or lease uses under the program is appropriate to improve long-term ecological health of the Federal land;</text></subclause><subclause id="id650b474b-dc88-4014-9013-d0543e71fe79" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">identify ways in which progress under the program would be measured toward long-term ecological health of the Federal land;</text></subclause><subclause id="id948a2a3c-aee7-4006-87c1-0dafad11c61c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">include for projects monitored under the program—</text><item id="ida61b77b2-7d53-4005-a963-cc25b9562f50" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">a description of the condition standards for which the monitoring is tracking, including baseline conditions and desired outcome conditions;</text></item><item id="id483ee5fa-b2d6-4283-841f-c87bbfe68704" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">a description of monitoring methods and protocols;</text></item><item id="idd0a72363-8eed-46de-a35f-fdf7632cf834" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">a schedule for collecting data;</text></item><item id="id9227a79a-0895-4bfc-a579-2ec6f477837c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(dd)</enum><text display-inline="yes-display-inline">an identification of the responsible party for data collection and storage;</text></item><item id="idb220ad01-c17f-4c72-9c76-e85d7a9ed37b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ee)</enum><text display-inline="yes-display-inline">an evaluation schedule;</text></item><item id="idb8e7c851-ccf3-4258-9dde-12ea3cc80929" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ff)</enum><text display-inline="yes-display-inline">a description of the anticipated use of the data;</text></item><item id="id76fe5768-92a5-4ad0-b6a1-2caa135e17fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(gg)</enum><text display-inline="yes-display-inline">provisions for adjusting any components of the monitoring plan; and</text></item><item id="id2d05618e-2124-43d1-9f26-e8dd1306c1a6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(hh)</enum><text display-inline="yes-display-inline">a description of the method to communicate the criteria for adjusting livestock grazing use; and</text></item></subclause><subclause id="idac7b2a18-b947-40b9-8125-ded90109c3b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">provide for annual reports on the effects of flexibility in grazing permit or lease uses under the program to allow the Secretary to make management adjustments to account for the information provided in the annual report.</text></subclause></clause></subparagraph><subparagraph id="id5ad1e233-c6af-4b0e-8783-f9ccb7121afd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Monitoring plans for interim operational flexibility</header><clause commented="no" display-inline="no-display-inline" id="idbba82422-71ef-4a81-a2ff-47a2874961da" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall adopt cooperative rangeland utilization monitoring plans and rangeland health objectives to apply to actions taken under paragraph (3) and to monitor and evaluate the improvements or degradations to the long-term ecological health of the Federal land identified for flexible use under the program.</text></clause><clause id="id164bb027-13f7-4a6f-a505-9044d17bb199" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A monitoring plan developed under clause (i) shall—</text><subclause id="ideb1e22d9-5040-41f4-960d-4e86a370960c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">evaluate the percent utilization of available forage;</text></subclause><subclause id="id9aec8310-55de-463c-ae56-0fbb88cc25af" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">identify the appropriate percentage of utilization for the feed type, ecosystem, time of year, and type of animal using the allotment;</text></subclause><subclause id="idccc444b4-f0ff-477f-ac05-2392a02ef681" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">include—</text><item id="id9e60d7fc-80a2-445d-ba44-7bbc43b8bc83" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">a description of the utilization standards for which the monitoring is tracking, including baseline conditions and desired outcome conditions;</text></item><item id="id7baebb56-d452-450e-a105-c3ef988db12f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">a description of utilization evaluation protocol;</text></item><item id="id3ae2c61a-df13-4d94-81f8-b7e9282d1d94" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">an evaluation schedule identifying periods during which utilization data will be collected;</text></item><item id="id7526a0bd-81f6-459a-990c-04c0a0fd613a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(dd)</enum><text display-inline="yes-display-inline">provisions for adjusting any components of the monitoring plan, including acceptance of data from identified third parties; and</text></item><item id="id1b49abff-ce52-457f-ab8a-77615ae15df7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ee)</enum><text display-inline="yes-display-inline">a description of the method to communicate the criteria for adjusting livestock grazing use based on the on-the-ground conditions after the period of use; and</text></item></subclause><subclause id="id885558ee-29c6-4637-b02e-138e52e3727a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">provide for annual reports on the effects of flexibility in grazing permit or lease uses under the program to allow the Secretary to make management adjustments to account for the information provided in the annual report. </text></subclause></clause></subparagraph></paragraph><paragraph id="idc4931f81-3c81-4ee8-b420-b0e88d633a3c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Terms and conditions</header><subparagraph id="id8e5b8b21-7b00-45b8-bd80-5916f505208b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Preferred alternative</header><text display-inline="yes-display-inline">If the Secretary determines that an alternative considered under the program that provides operational flexibility is the preferred alternative, the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="id2d1e49f5-206d-48f7-b4fb-9cd51a3fefff" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">incorporate the alternative, including applicable monitoring plans adopted under paragraph (4), into the terms and conditions of the applicable grazing permit or lease; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idf7ca29e7-6102-43ca-a5ed-169e2e5b9bd7" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">specify how the monitoring information with respect to the preferred alternative should be used to inform management adjustments under the program.</text></clause></subparagraph><subparagraph id="id6edc626b-062a-4441-807e-38273a22d27c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Adjustments</header><text display-inline="yes-display-inline">Before implementing any measure for purposes of operational flexibility with respect to a grazing use authorized under the terms and conditions of a permit or lease with respect to which an alternative has been incorporated under subparagraph (A), the grazing permittee or lessee shall notify the Secretary in writing of the proposed adjustment.</text></subparagraph><subparagraph id="idb2876ea9-544b-4fdd-a325-25c434e2d402" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">The Secretary may include any other requirements in a permit or lease with respect to which an alternative has been incorporated under subparagraph (A) that the Secretary determines to be necessary.</text></subparagraph></paragraph></subsection><subsection id="id10501ea7-4ae3-40b8-a92e-c1e502d8e49c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Review; termination</header><paragraph id="idc766ab56-8c43-426c-a2b6-8f08f75eae43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Review</header><subparagraph id="id4f3da409-530d-4831-a149-debf3a0ecb49" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), not earlier than the date that is 8 years after the date of enactment of this Act, the Secretary shall conduct a review of the program to determine whether the objectives of the program are being met.</text></subparagraph><subparagraph id="ided8a3052-d08c-438c-9aad-2b473133d6fe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">No effect on program permits and leases</header><text display-inline="yes-display-inline">The review of the program under subparagraph (A) shall not affect the existence, renewal, or termination of a grazing permit or lease entered into under the program.</text></subparagraph></paragraph><paragraph id="id56e83f6c-4323-4ee1-b3b6-f5f326ae7d93" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">If, based on the review conducted under paragraph (1), the Secretary determines that the objectives of the program are not being met, the Secretary shall, on the date that is 10 years after the date of enactment of this Act—</text><subparagraph id="id2bd6c10b-7794-4096-bf19-4e5ac2b0f33d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">modify the program in a manner to ensure that the objectives of the program would be met; or</text></subparagraph><subparagraph id="id270e9ef9-abaa-4c2e-beb8-ac6a9c5275d2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">terminate the program.</text></subparagraph></paragraph></subsection><subsection id="id178e46c1-1787-4166-a48a-143734a1b514" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">No effect on grazing privileges</header><text display-inline="yes-display-inline">Nothing in this Act—</text><paragraph id="id04ca0988-8de9-40f1-868d-d7ca3848aab1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">affects grazing privileges provided under the Act of June 28, 1934 (commonly known as the <quote>Taylor Grazing Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315 et seq.</external-xref>);</text></paragraph><paragraph id="id4d7f9ea2-d8da-4f13-b89e-e18f6a47689e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">requires the Secretary to consider modifying or terminating the classification of any existing grazing district on the Federal land in any subsequent plan or decision of the Secretary; or</text></paragraph><paragraph id="id5e0db317f41843fe8393e9ea51ecdd30" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">precludes the Secretary from modifying or terminating an existing permit or lease in accordance with applicable law (including regulations). </text></paragraph></subsection></section><section id="id93d1e167-037e-4e48-950b-3f968df4d712" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Malheur C.E.O. Group</header><subsection id="id8eac82c6-a6de-48a0-bf49-f3f62755b623" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id04052e0c-2d70-4fab-bbca-fe07ef3576c7" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Consensus</header><text display-inline="yes-display-inline">The term <term>consensus</term> means a unanimous agreement by the voting members of the Malheur C.E.O. Group present and constituting a quorum at a regularly scheduled business meeting of the Malheur C.E.O. Group.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id465c04cb-c4fe-4f80-a623-f333d069160e" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Federal agency</header><subparagraph commented="no" display-inline="no-display-inline" id="id8e38a4e6-9a73-41ab-a830-1d4270b9844a" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means an agency or department of the Government of the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e1193d4-8a99-43df-aa8e-47f570567a5a" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> includes—</text><clause commented="no" display-inline="no-display-inline" id="idc174d273-8c01-474d-8157-75184ee863f4" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id31923bad-9ca4-48fa-bcd2-67fcf7361e24" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida52c2795-bae2-4178-a9c7-d9cfc233b3ef" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the Bureau;</text></clause><clause commented="no" display-inline="no-display-inline" id="id20b8ae51-cd5b-459b-b743-ae465efd7f50" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb53bcc9-b24f-46b0-b4d0-eb480555742e" changed="not-changed"><enum>(v)</enum><text display-inline="yes-display-inline">the Natural Resources Conservation Service.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99a9f781-4653-441a-9199-55761b202acb" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">The term <term>quorum</term> means 1 more than <fraction>1/2</fraction> of the voting members of the Malheur C.E.O. Group.</text></paragraph></subsection><subsection id="id21198898-df0b-456f-b13e-cd1297ffdf33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established the Malheur C.E.O. Group to assist in carrying out this section.</text></subsection><subsection id="idd2e6e0a0-4781-4ce5-b52e-fdf6bebd2dd6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header><paragraph commented="no" display-inline="no-display-inline" id="id9302a95c-dbf9-4e63-b31b-f81bb03340b7" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Malheur C.E.O. Group shall consist of 18 members, to be appointed in accordance with paragraph (2), including—</text><subparagraph id="idf487e90a-0dbc-41cf-bf30-42f9920968e6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">5 voting members who represent private interests, of whom—</text><clause commented="no" display-inline="no-display-inline" id="id4d7506f9-0dbd-447c-bb32-7aac45bf97c7" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">3 members represent livestock grazing interests, of whom—</text><subclause commented="no" display-inline="no-display-inline" id="id0a17db28-00fc-4f91-86c6-b5899c52b61c" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">1 member resides in the northern <fraction>1/3</fraction> of the County;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id30cc7199-7592-499d-997c-f7af4d2f53a4" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">1 member resides in the center <fraction>1/3</fraction> of the County; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5d431ee2-c31a-452a-9b8a-d44b9f32037f" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">1 member resides in the southern <fraction>1/3</fraction> of the County; </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id371a9d59-cee6-489c-961d-eb15190473d2" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">1 member is in the recreation or tourism industry; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1fe5b919-0d81-41bc-9893-9710e07382df" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">1 member is from an applicable irrigation district;</text></clause></subparagraph><subparagraph id="id52a232bd-374f-44b7-a0f5-d34834011550" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">2 voting members who represent the environmental community, 1 of whom is based in the County;</text></subparagraph><subparagraph id="idc5e39608-d91b-40dc-86b3-49d9a60c8b34" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">1 voting member who represents the hunting or fishing community;</text></subparagraph><subparagraph id="id4caf307a-2475-40e7-b026-fcfeb9d72f4d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">2 voting members who are representatives of Indian Tribes, of whom—</text><clause commented="no" display-inline="no-display-inline" id="idc5b80189-d85b-4f29-b2db-6415ae68bdd6" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">1 member shall be a representative of the Burns Paiute Tribe; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id68b021ba-011d-4664-a0d9-1e469c1716b7" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">1 member shall be a representative of the Fort McDermitt Paiute and Shoshone Tribes;</text></clause></subparagraph><subparagraph id="ideedceaa1-dade-422c-ae19-b61cf1c7670b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">2 nonvoting members who are representatives of Federal agencies with authority and responsibility in the County and who shall provide technical assistance, 1 of whom shall represent the Bureau;</text></subparagraph><subparagraph id="id15073651-e449-4af8-9bd9-33a74fa4daa1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">2 nonvoting members who are representatives of State agencies with authority and responsibility in the County and who shall provide technical assistance, of whom—</text><clause commented="no" display-inline="no-display-inline" id="id461571b2-a7f5-44ee-9379-a094dbcbf1d1" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">1 member shall be from the State Department of Fish and Wildlife; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7c814782-3327-4fc0-9298-175853413ee9" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">1 member shall be from the State Parks Department; and</text></clause></subparagraph><subparagraph id="id0781cf1e-3046-4f13-aed9-b9e7927b78b9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">4 nonvoting members who are representatives of units of local government within the County and who shall provide technical assistance, 1 of whom shall be from the County weeds eradication department.</text></subparagraph></paragraph><paragraph id="id9b28da79-d196-4594-9192-39d7f363f9e5" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Appointment; term; vacancy</header><subparagraph commented="no" display-inline="no-display-inline" id="id2e81612f-5e97-47fa-b1d4-ebbd56daf0f3" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Appointment</header><clause commented="no" display-inline="no-display-inline" id="idd8dd66c2-a476-4f59-a724-5587527cef56" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">Governmental agencies</header><text display-inline="yes-display-inline">A member of the Malheur C.E.O. Group representing a Federal agency or State or local agency shall be appointed by the head of the applicable agency. </text></clause><clause commented="no" display-inline="no-display-inline" id="id98371d33-e3fc-415b-a201-623eae69b7f1" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Private Interests</header><text display-inline="yes-display-inline">A member of the Malheur C.E.O. Group representing private interests shall be appointed by the applicable represented groups.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide18cfacf-dc9d-4587-9b2f-bc6c682c0362" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">A member of the Malheur C.E.O. Group shall serve for a term of 3 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d324ccd-fd9b-487f-993b-b898731f59c1" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Vacancy</header><text display-inline="yes-display-inline">A vacancy on the Malheur C.E.O. Group shall be filled in the manner described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="ide8bc073a-d532-4b53-89e1-3394edd9790b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Projects</header><paragraph commented="no" display-inline="no-display-inline" id="id6420bacd-1823-4537-9304-d58204e0aae0" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Malheur C.E.O. Group shall propose eligible projects described in paragraph (2) on Federal land and water and non-Federal land and water in the County to be carried out by the Malheur C.E.O. Group or a third party, using funds provided by the Malheur C.E.O. Group, if a consensus of the Malheur C.E.O. Group approves the proposed eligible project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id591568d9-5d00-4c8f-811e-928cb651593d" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Description of eligible projects</header><text display-inline="yes-display-inline">An eligible project referred to in paragraph (1) is a project—</text><subparagraph commented="no" display-inline="no-display-inline" id="idec34eb1402f9456aa67ac4448c08d7ac" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">that complies with existing law (including regulations); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb45879f9dc704ac4a1de20279b66f1a4" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">relating to—</text><clause id="id31c3e9be-bfc4-4b33-b4a1-7e47ff969a0b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">ecological restoration, including development, planning, and implementation;</text></clause><clause id="id4b19fd2b-0943-4553-bdac-81e2c98e4bd9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">range improvements for the purpose of providing more efficient and effective ecologically beneficial management of domestic livestock, fish, wildlife, or habitat;</text></clause><clause id="id98595707-03c8-47ad-ae6d-68d09f592281" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">invasive species management or eradication, including invasive weeds, vegetation, fish, or wildlife;</text></clause><clause id="id955430e9-c40d-45ef-8a0e-4be12577d1cd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline"> restoration of springs and related water infrastructure to enhance the availability of sustainable flows of freshwater for livestock, fish, or wildlife;</text></clause><clause id="id0e5280bb-0b8a-4ff1-9a05-58505bbf4cb9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">conservation of cultural sites;</text></clause><clause id="id592bab34-023e-4cc3-945f-dff6c11ee229" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(vi)</enum><text display-inline="yes-display-inline">economic development or recreation management; or </text></clause><clause id="id777c298842e44b0d8e767e0c257fb081" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">research, monitoring, or analysis.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a814bc9-109c-4bf0-81e5-02f51774640b" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="idaf0f9ac0-ac56-458a-b7a6-46cc783090a5" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of an eligible project proposed under paragraph (1) that is to be carried out on Federal land or requires the use of Federal funds, the project may not be carried out without the approval of the head of the applicable Federal agency.</text></subparagraph><subparagraph id="idf20f5a54-32ad-4116-89b5-486561f46a08" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Failure to approve</header><text display-inline="yes-display-inline">If an eligible project described in subparagraph (A) is not approved by the head of the applicable Federal agency, not later than 14 business after the date on which the proposal is submitted to the head of the applicable Federal agency, the head of the Federal agency shall provide to the Malheur C.E.O. Group in writing a description of the reasons for not approving the proposed eligible project. </text></subparagraph></paragraph><paragraph id="id1833ecb9-370a-41bb-8e39-c63540ddb9fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Failure to approve by consensus</header><text display-inline="yes-display-inline">If an eligible project proposed under paragraph (1) is not agreed to by consensus after 3 votes are conducted by the Malheur C.E.O. Group, the proposed eligible project may be agreed to by a quorum of the members of the Malheur C.E.O. Group, subject to the limitations that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide3238041-0fa1-4ae3-96b7-634fd3c47e1a" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the eligible project may not be carried out on Federal land; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79a26f0a-bfec-49ec-ad7b-a39426104331" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">no Federal funds may be used for an eligible project that is agreed to in accordance with this paragraph.</text></subparagraph></paragraph><paragraph id="id4ebde732-edf7-4298-9902-6c1480aabab6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Acceptance of donations</header><text display-inline="yes-display-inline">The Malheur C.E.O. Group may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6db95c05-7f20-4e0d-b222-c0b32bf05910" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">accept and place into a trust fund any donations, grants, or other funds received by the Malheur C.E.O. Group; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5ce3bb3-083e-4f78-b35a-0edbb04068b0" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">use amounts placed into a trust fund under paragraph (1) to carry out eligible projects approved in accordance with this section, including eligible projects carried out on Federal land or water or using Federal funds, if the project is approved by the head of the applicable Federal agency.</text></subparagraph></paragraph><paragraph id="ideb3c4325-17c0-42e9-b5d3-87f4682d9266" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Cost-sharing requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="ida7177a99-86dc-490d-962a-cbb4d7d770b1" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Federal share of the total cost of an eligible project carried out using amounts made available under subsection (i) shall be not more than 75 percent.</text></subparagraph><subparagraph id="idb5b68316-375d-4bab-8894-27d317e8a8a7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Form of non-Federal contribution</header><text display-inline="yes-display-inline">The non-Federal contribution required under subparagraph (A) may be provided in the form of in-kind contributions.</text></subparagraph></paragraph><paragraph id="idfb77f95a-37eb-4263-bb33-6704fc65a23c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Funding recommendations</header><text display-inline="yes-display-inline">All funding recommendations developed by the Malheur C.E.O. Group shall be based on a consensus of the Malheur C.E.O. Group members.</text></paragraph></subsection><subsection id="id43fd83af-8f3e-466a-9cdd-9c8e1001d6ea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">Any Federal agency with authority and responsibility in the County shall, to the extent practicable, provide technical assistance to the Malheur C.E.O. Group on request of the Malheur C.E.O. Group. </text></subsection><subsection id="idde55646a-f431-4f6f-9f65-e376181c0fdd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Public notice and participation</header><text display-inline="yes-display-inline">The Malheur C.E.O. Group shall conduct all meetings subject to applicable open meeting and public participation laws.</text></subsection><subsection id="id0711d5a9-a029-4136-8b3c-15b427ff68f5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">For purposes of approving eligible projects proposed under subsection (d)(1), the Malheur C.E.O. Group shall give priority to voluntary habitat, range, and ecosystem restoration projects focused on improving the long-term ecological health of the Federal land and natural bodies of water.</text></subsection><subsection id="id7fce9868-a9b6-4a12-8dff-d157ff4d0154" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Additional projects</header><text display-inline="yes-display-inline">To the extent permitted by applicable law and subject to the availability of appropriations, Federal agencies may contribute to the implementation of projects recommended by the Malheur C.E.O. Group and approved by the Secretary.</text></subsection><subsection id="idbcff860c-9fb5-4491-8f82-e30c854ae4b4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="id8f7e4856-d2e7-4834-a914-5ea199cf5f35" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $1,000,000 for each of fiscal years 2024 through 2034.</text></paragraph><paragraph id="idfadc0b7b-dca9-4424-9050-2399af5197a5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Maintenance and distribution</header><text display-inline="yes-display-inline">Amounts made available under paragraph (1) shall be maintained and distributed by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49b4f397-e284-4465-8d1e-5b1bde169b9a" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Not more than more than 5 percent of amounts made available under paragraph (1) for a fiscal year may be used for the administration of this Act. </text></paragraph><paragraph id="idf452a359-21b0-4366-8f4e-5d5ba478f8d1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">Of the amounts made available under paragraph (1), not more than 10 percent may be made available for a fiscal year to provide grants to the Malheur C.E.O. Group.</text></paragraph></subsection><subsection id="id93d029fa-b4e8-4cef-b671-cb474762a94d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header display-inline="yes-display-inline">Effect</header><paragraph commented="no" display-inline="no-display-inline" id="id3282f21c-05e4-4166-9d8d-b43128f6a684" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Existing activities</header><text display-inline="yes-display-inline">The activities of the Malheur C.E.O. Group shall supplement, and not replace, existing activities to manage the natural resources of the County. </text></paragraph><paragraph id="id8ae259d0-f495-4a50-b284-1928c977d95b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Legal rights, duties, or authorities</header><text display-inline="yes-display-inline">Nothing in this section affects any legal right, duty, or authority of any person or Federal agency, including any member of the Malheur C.E.O. Group. </text></paragraph></subsection></section><section id="id261988b8-8035-46b9-9d33-33e2014cf466" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Land designations</header><subsection id="ide225bedc-6884-4bfb-b70a-cb7af22c2307" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of wilderness area</header><text display-inline="yes-display-inline">In this section, the term <term>wilderness area</term> means a wilderness area designated by subsection (b)(1).</text></subsection><subsection id="id766b988a-f9c9-4fb0-9f9c-f2c969a85600" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Designation of wilderness areas</header><paragraph id="idecd1dedee52a4ab9ac316c1b374fe092" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following Federal land in the County comprising approximately 1,102,393 acres, as generally depicted on the referenced maps, is designated as wilderness and as components of the National Wilderness Preservation System: </text><subparagraph id="idc8650f3d5dcd4939af30a13059f17252" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Fifteenmile Creek Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 61,647 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Trout Creek–Oregon Canyon Group</quote> and dated December 12, 2023, which shall be known as the <quote>Fifteenmile Creek Wilderness</quote>. </text></subparagraph><subparagraph id="id836ecef3086748358c21bf2c220eb6cb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Oregon Canyon Mountains Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 53,559 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Trout Creek–Oregon Canyon Group</quote> and dated December 12, 2023, which shall be known as the <quote>Oregon Canyon Mountains Wilderness</quote>. </text></subparagraph><subparagraph id="id60b5e0a4abfb47788bd1996fe0e05718" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Twelvemile Creek Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 38,099 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Trout Creek–Oregon Canyon Group</quote> and dated December 12, 2023, which shall be known as the <quote>Twelvemile Creek Wilderness</quote>. </text></subparagraph><subparagraph Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 44,238 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Upper Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Big Grassey Wilderness</quote>. </text></subparagraph><subparagraph id="id8621527e069641c483f1beff478a5464" display-inline="yes-display-inline">Dry Creek Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 33,209 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Dry Creek Wilderness</quote>.</text></subparagraph><subparagraph id="id5ef6e4e636354d3ea1c7061f24140401" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(T)</enum><header display-inline="yes-display-inline">Dry Creek Buttes Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 88,289 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower December 12, 2023, which shall be known as the <quote>Upper Leslie Gulch Wilderness</quote>.</text></subparagraph><subparagraph id="idcde62d684bac4a3f919108b95b7cc288" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(V)</enum><header display-inline="yes-display-inline">Slocum Creek Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 7,534 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Slocum Creek Wilderness</quote>.</text></subparagraph><subparagraph id="ida579c1a1fef2481b9f9c623c9bf02110" changed="not-changed" commented="no" Wilderness</quote>.</text></subparagraph><subparagraph id="idfc70e7ac23054b68bf47a766e3038c2e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(X)</enum><header display-inline="yes-display-inline">Wild Horse Basin Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 18,402 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Wild Horse Basin Wilderness</quote>.</text></subparagraph><subparagraph id="id28736ab1b38746e780d31a08411f6046" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(Y)</enum><header display-inline="yes-display-inline">Quartz Mountain Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 32,943 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Quartz Mountain Wilderness</quote>.</text></subparagraph><subparagraph id="id9d75d39e04824288ade00ea245ce21f8" December 12, 2023, which shall be known as <quote>The Tongue Wilderness</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id870fb10f56eb482c914fcbd6a4011c05" changed="not-changed"><enum>(AA)</enum><header display-inline="yes-display-inline">Three Fingers Rock North Wilderness</header><text Federal land, comprising approximately 8,115 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Lower Owyhee</quote> and dated December 12, 2023, which shall be known as the <quote>Burnt Mountain Wilderness</quote>.</text></subparagraph><subparagraph id="id9dd24463acd748c8a71241cbfd81f1dd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(CC)</enum><header display-inline="yes-display-inline">Camp Creek Wilderness</header><text display-inline="yes-display-inline">Certain Federal land, comprising approximately 72,597 acres, as generally depicted on the map entitled <quote>Proposed Wilderness Camp Creek Group</quote> and dated December 12, 2023, which shall be known as the <quote>Camp Creek Wilderness</quote>.</text></subparagraph></paragraph><paragraph id="id23788a01-8284-486f-b53b-e38ed8abf42f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Maps and legal descriptions</header><subparagraph id="idd05aeea3-d225-486b-a4ac-972ae3b0bdd0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map and legal description of each wilderness area.</text></subparagraph><subparagraph id="id6097328e-a8c7-4f23-951f-dbb182a92a5a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Each map and legal description prepared under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></subparagraph><subparagraph id="idbdf6896c-4319-469a-b2b9-5f891377f7e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">The maps and legal descriptions prepared under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau.</text></subparagraph></paragraph><paragraph id="id527fd975-ce52-459c-9c23-0eb26013bd12" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Management</header><subparagraph id="idff82fedc-7ecc-43a0-8fdb-608449e4132a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to valid existing rights, the wilderness areas shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text><clause id="id9caa0a0d-24d8-48a1-a5f2-3f80169bad55" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text></clause><clause id="id132e610a-8279-42dc-a5e1-f89abf4db734" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text></clause></subparagraph><subparagraph id="id8410a52b-9cf2-405e-86cd-4d6b339e0e2b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Grazing</header><text display-inline="yes-display-inline">The Secretary shall allow the continuation of the grazing of livestock, in the wilderness areas, if established before the date of enactment of this Act, in accordance with—</text><clause id="id3faad37a-024f-421b-b41f-0cc67f8f294e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></clause><clause id="id2df02507-c5e3-45ff-a990-114e2c418e4e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph id="id7688aed7-1831-4ea0-8ab1-b784e99cdfde" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Roads adjacent to wilderness areas</header><text display-inline="yes-display-inline">Nothing in this Act requires the closure of any adjacent road outside the boundary of a wilderness area.</text></subparagraph><subparagraph id="id42f44aaf-a8c9-4a8a-9c58-0df95803d441" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Fish and wildlife management activities</header><clause id="id0235ff88-87a6-4e7c-a0ed-a703f8b69c58" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the Secretary may conduct any management activities that are necessary to maintain or restore fish and wildlife populations and habitats in the wilderness areas, if the management activities are—</text><subclause id="ida6ff7105-9ac1-40d4-92ba-ac2b78f18aab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">consistent with applicable wilderness management plans; and</text></subclause><subclause id="id54719b35-8574-4ca1-ac80-92cfbe7b232a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">conducted in accordance with appropriate policies, such as the policies established in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405). </text></subclause></clause><clause id="id7b65d051-8a7d-4f86-95f6-50c2b964c9a1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">Management activities under clause (i) may include the occasional and temporary use of motorized vehicles, if the use, as determined by the Secretary, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values while causing the minimum impact necessary to accomplish those tasks.</text></clause></subparagraph><subparagraph id="id5364d298-a72c-4b5f-b443-b554b38ced5c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Existing activities</header><text display-inline="yes-display-inline">Consistent with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and in accordance with appropriate policies, such as the policies established in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405), the State may use aircraft (including helicopters) in the wilderness areas to survey capture, transplant, monitor, and provide water for wildlife populations, including bighorn sheep and feral stock, feral horses, and feral burros.</text></subparagraph></paragraph></subsection><subsection id="idcc894ff0-8ad1-40cc-a683-c18c73d7d2d7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Management of land not designated as wilderness</header><paragraph id="id51089563-d31e-482b-92ba-b6dfc4198a60" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Release of wilderness study areas</header><subparagraph id="id17b2c4b1-8ef6-4c84-be36-e7c78a757522" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Finding</header><text display-inline="yes-display-inline">Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the Clarks Butte Wilderness Study Area, Saddle Butte Wilderness Study Area, and Bowden Hills Wilderness Study Area have been adequately studied for wilderness designation.</text></subparagraph><subparagraph id="id0d48cb06-5c98-474e-aa56-bd8dd267ce9d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Release</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the land described in subparagraph (A)—</text><clause id="idc1757f47-a611-4256-b0de-e5e003656a55" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause><clause id="id416d1331-525b-40c2-a2a2-661caf786e73" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be managed in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), including any applicable land use plan adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id7b066350-505f-4e7e-b359-1c1218ab5db2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Management of certain land with wilderness characteristics</header><text display-inline="yes-display-inline">Any portion of the Federal land that was previously determined by the Secretary to be land with wilderness characteristics that is not designated as wilderness by subsection (b)(1) and is not designated on the Map as <quote>land with wilderness characteristics</quote> shall be managed by the Secretary in accordance with the applicable land use plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>). </text></paragraph></subsection></section><section id="idf861af5e-fe02-4ab9-bf04-a8f9452524ac" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Land conveyances to Burns Paiute Tribe and Castle Rock Co-stewardship Area</header><subsection id="idc47d0836-4395-4bfa-a913-2b1e0bebe066" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Jonesboro ranch, road gulch, and black canyon land conveyances</header><paragraph id="id1349f97c-d5f0-4b4e-8951-109fa1a83bf2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Conveyance and taking into trust</header><subparagraph id="id3e2c4831-d624-474d-81dd-b3153760129e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Title</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall accept title to the land described in paragraph (2), if conveyed or otherwise transferred to the United States by, or on behalf of, the Burns Paiute Tribe.</text></subparagraph><subparagraph id="idc4b1ed2e-7829-48e2-bf31-9f3366e97f60" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Trust</header><text display-inline="yes-display-inline">Land to which title is accepted by the Secretary under subparagraph (A) shall—</text><clause id="idc3eb657f-81b9-43bf-be45-e09a41aa8971" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">be held in trust by the United States for the benefit of the Burns Paiute Tribe; and</text></subparagraph><subparagraph id="idc32d8f65-53f5-47ba-a9e9-f1dd84b6b103" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">be part of the reservation of the Burns Paiute Tribe.</text></subparagraph></paragraph><paragraph id="idf8008c2f-60aa-4b9c-bc8c-8ff8d3281756" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Castle rock co-stewardship area</header><subparagraph id="idfa2c80d5-eb47-416a-8ee4-8859588cf5bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Memorandum of understanding</header><clause id="ida665e79e-6270-4917-a312-0e7c18ef5225" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall seek to enter into a memorandum of understanding with the Burns Paiute Tribe to provide for the co-stewardship of the area depicted as <quote>Tribal Co-Stewardship Area</quote> on the map entitled <quote>Land into Trust and Co-Stewardship Castle Rock Group</quote> and dated December 12, 2023, to be known as the <quote>Castle Rock Co-Stewardship Area</quote>.</text></clause><clause id="id97c31b9a-5276-4965-8bcb-20badccd5c85" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The memorandum of understanding entered into under clause (i) shall ensure that the Castle Rock Co-Stewardship Area is managed in a manner that—</text><subclause id="idef4d708f-0a2e-45bf-baa2-272146717358" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">ensures that Tribal interests are adequately considered;</text></subclause><subclause id="id33bc80f2-181a-4af6-886a-54ad47c75a8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">provides for maximum protection of cultural and archaeological resources; and</text></subclause><subclause id="id54f10552-c300-499a-94ce-925b0f44701b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">provides for the protection of natural resources with cultural significance.</text></subclause></clause></subparagraph><subparagraph id="ide665b042-569d-4e17-b6bd-f6f9d0f63949" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Management agreements</header><text display-inline="yes-display-inline">In accordance with applicable law (including regulations), the Secretary may enter into 1 or more management agreements with the Burns Paiute Tribe to authorize the Burns Paiute Tribe to carry out management activities in the Castle Rock Co-Stewardship Area in accordance with the memorandum of understanding entered into under subparagraph (A)(i).</text></subparagraph><subparagraph id="id0c3b9665-52a1-42b0-8dc1-7eb45be33d86" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Grazing</header><text display-inline="yes-display-inline">The grazing of livestock in the Castle Rock Co-Stewardship Area, if established before the date of enactment of this Act, shall be permitted to continue in accordance with applicable law (including regulations).</text></subparagraph><subparagraph id="id3f8dd7ea-b27f-409d-afa0-7d06e0cecc33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Water rights</header><text display-inline="yes-display-inline">Nothing in this paragraph—</text><clause id="id4b7e3bba-537f-48a8-944f-e03a4b67bf25" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">affects any valid and existing water rights; or</text></clause><clause id="idb92614ca-ad90-4475-96ee-1a19f06ce8ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">provides the Burns Paiute Tribe with any new water right or claim.</text></clause></subparagraph></paragraph><paragraph id="idce483d9c-399d-4e0a-8ef7-9e809fc37b25" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Withdrawal</header><text display-inline="yes-display-inline">Subject to valid existing rights, the land taken into trust under paragraph (1) and the land comprising the Castle Rock Co-Stewardship Area are withdrawn from—</text><subparagraph id="id13396858-0bd1-4617-8df2-e28a644edbe7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">all forms of entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="idd7def856-3426-4c66-98cf-1596efbd9c90" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="id18bbf228-6b40-4bf1-926f-52f0f91a846d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">operation of the mineral leasing and geothermal leasing laws and mineral materials laws.</text></subparagraph></paragraph></subsection><subsection id="ide8a0408a-1d50-4196-bbde-f0c4d9630e3e" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $2,000,000 for fiscal year 2025.</text></subsection><subsection id="id51670167-aed3-46bb-a022-a9e9891a2ae8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Effect on tribal rights and certain existing uses</header><text display-inline="yes-display-inline">Nothing in this section, including any designation or nondesignation of land transferred into trust to be held by the United States for the benefit of the Burns Paiute Tribe under this section—</text><paragraph id="id0ebd9cbd-813a-45f4-879e-623c44999851" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">alters, modifies, enlarges, diminishes, or abrogates rights secured by a treaty, statute, Executive order, or other Federal law of any Indian Tribe, including off-reservation reserved rights; or</text></paragraph><paragraph id="id5e2f3c7a-a1ac-4e2e-b9ec-b8b91a8bb45e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">affects—</text><subparagraph id="idd27cfc96-de3c-4cc6-ba2b-35d393bdddc6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">existing rights-of-way;
