<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 1868</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require an interagency study to produce a security assessment process on adjacent space to high-security leased space to accommodate a Federal agency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idb5944747-9b02-4758-8eb1-aeecdd58bcbe" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Adjacent Federal Property Act of 2023</short-title></quote>.</text></section><section id="id002f6d3e-ca85-452b-b164-dc3ea563cfd5" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id7e40cfa6-3b12-46b6-9ce8-1f24b7c9534d" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="idaf7381a0-8e78-4bb3-b4b3-5df9dd89a4e1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Beneficial owner</header><subparagraph id="idf46a842e-1931-4f55-ba74-ddda85b57182" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>beneficial owner</term>, with respect to a covered entity, means each natural person who, directly or indirectly, through any contract, arrangement, understanding, relationship, or otherwise—</text><clause id="id6f717164-5713-4fe4-a5ae-5e4baecd4aea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">exercises substantial control over the covered entity; or</text></clause><clause id="idfbc04ba0-4787-479d-85cc-4ba171d7a58e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">owns or controls not less than 25 percent of the ownership interests of, or receives substantial economic benefits from the assets of, the covered entity.</text></clause></subparagraph><subparagraph id="id4bcafa6c-2b9f-445a-8ed8-46875a579753" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>beneficial owner</term>, with respect to a covered entity, does not include—</text><clause id="id45f4db9c-4b77-4851-991a-c56f0ed3b24e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a minor;</text></clause><clause id="idfc834d55-0824-46ae-8ee9-9af38bff83d3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a person acting as a nominee, intermediary, custodian, or agent on behalf of another person;</text></clause><clause id="idf1ebb913-01a1-4755-a492-50f73dfda2f7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a person acting solely as an employee of the covered entity and whose control over or economic benefits from the covered entity derives solely from the employment status of the person;</text></clause><clause id="iddefaeef3-8488-4d01-b273-c21290eb5d19" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a person whose only interest in the covered entity is through a right of inheritance, unless the person also meets the requirements of subparagraph (A); or</text></clause><clause id="id2164d9e3-f314-46de-a635-632ce6c772f0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">a creditor of the covered entity, unless the creditor also meets the requirements of subparagraph (A).</text></clause></subparagraph><subparagraph id="idccf4e26c-0ce1-4a10-904d-3c05b00c5896" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Anti-abuse rule</header><text display-inline="yes-display-inline">The exclusions under subparagraph (B) shall not apply if, in the determination of the Administrator, an exclusion is used for the purpose of evading, circumventing, or abusing the requirements of this Act.</text></subparagraph></paragraph><paragraph id="idddd213e0-f223-4bb9-87a5-08ad9c576799" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Control</header><text display-inline="yes-display-inline">The term <term>control</term>, with respect to a covered entity, means—</text><subparagraph id="idd228d067-0163-4d9b-b873-b7e13edbe0b8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">having the authority or ability to determine how the covered entity is utilized; or</text></subparagraph><subparagraph id="id7e12765e-ffe8-4c41-be8d-763938a5cab5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">having some decisionmaking power for the use of the covered entity.</text></subparagraph></paragraph><paragraph id="id7d5d6650-d098-4b7e-9b64-beb810fa8296" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means—</text><subparagraph id="id9fe950f9-fb57-425b-a2d5-d136f36144e1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a person, corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group; or</text></subparagraph><subparagraph id="id3f8605ac-93ef-4251-9b5a-644f62e3faea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any governmental entity or instrumentality of a government.</text></subparagraph></paragraph><paragraph id="id2de61318-4ddc-41cc-8614-9b3bb003b50d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Executive agency</header><text display-inline="yes-display-inline">The term <term>Executive agency</term> has the meaning given the term in section 105 of title 5, United States Code.</text></paragraph><paragraph id="id26613b7a-9ca9-4b3f-a313-8d1a889dbedd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id479b04ad-b772-4a5c-9f1c-d5a8e36602d7" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">an Executive agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16a8a5c5-1606-4d7b-b1d2-05e61aeb2b11" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">any establishment in the legislative or judicial branch of the Federal Government.</text></subparagraph></paragraph><paragraph id="idc9f3ef1f-371a-4ea0-a98c-f9b1b77ae34a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Federal lessee</header><subparagraph commented="no" display-inline="no-display-inline" id="id097b7867-0f49-4b85-85a6-eb238aed3bfb" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Federal lessee</term> means—</text><clause commented="no" display-inline="no-display-inline" id="idcca5dc2b-1253-4428-b1d3-52a5b6acc0d0" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator; </text></clause><clause commented="no" display-inline="no-display-inline" id="id3ea67001-0aab-479d-aa9c-6c21c1341833" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the Architect of the Capitol; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id93e1cf12-78e8-4200-92d1-124913c693ce" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the head of any other Federal agency that has independent statutory leasing authority.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d855f3c-040e-4b3a-806e-fe020948e027" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>Federal lessee</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="id121d047a-eb3c-4285-bac2-c547f954f481" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the head of an element of the intelligence community; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2154c59a-50a0-490b-b111-803106167cf5" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of Defense.</text></clause></subparagraph></paragraph><paragraph id="ida04a0000-adb4-455b-ace4-cfaa58a17969" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Federal tenant</header><subparagraph commented="no" display-inline="no-display-inline" id="idf66c3555-625a-462f-8e6c-95001b121d6c" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Federal tenant</term> means a Federal agency that is occupying or will occupy a high-security leased space for which a lease agreement has been secured on behalf of the Federal agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id487c5769-9e2c-4d1e-86c4-9632a6ce0f82" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>Federal tenant</term> does not include an element of the intelligence community.</text></subparagraph></paragraph><paragraph id="idc9e27a70-791a-4c57-b4b2-d4f43ceac72d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Foreign entity</header><text display-inline="yes-display-inline">The term <term>foreign entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c2019217b1a455a9041f569c35761c4" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group that is headquartered in or organized under the laws of—</text><clause commented="no" display-inline="no-display-inline" id="id06bfe1abb52f459bad7bf52bb5e7f667" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">a country that is not the United States; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id2a2bc80ac62e440b988cc16122f88064" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">a State, unit of local government, or Indian Tribe that is not located within or a territory of the United States; or</text></clause></subparagraph><subparagraph id="id542ca57ba42c4573821070008900668f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a government or governmental instrumentality that is not—</text><clause commented="no" display-inline="no-display-inline" id="id2e54a96ec9754fcda9ecb68e2368512d" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the United States Government; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id8268834ac0cd40afa4928b22cb44ec99" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">a State, unit of local government, or Indian Tribe that is located within or a territory of the United States.</text></clause></subparagraph></paragraph><paragraph id="idbf2b3706-28c0-45b5-ac15-546354a42aee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Foreign person</header><text display-inline="yes-display-inline">The term <term>foreign person</term> means an individual who is not a United States person.</text></paragraph><paragraph id="idcc23dd9c-0f8a-4387-94e3-43169f54d618" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">High-security leased adjacent space</header><text display-inline="yes-display-inline">The term <term>high-security leased adjacent space</term> means a building or office space that shares a boundary with or surrounds a high-security leased space.</text></paragraph><paragraph id="id0e14842c-8398-47b4-82bc-2180fe17042b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header display-inline="yes-display-inline">High-security leased space</header><text display-inline="yes-display-inline">The term <term>high-security leased space</term> means a space leased by a Federal lessee that—</text><subparagraph id="id7205210f-df5a-4634-bb3e-a61d812031c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">will be occupied by Federal employees for nonmilitary activities; and</text></subparagraph><subparagraph id="idb2d8427d-0953-44cd-a335-ffa10e0e7ddb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">has a facility security level of III, IV, or V, as determined by the Federal tenant in consultation with the Interagency Security Committee, the Secretary of Homeland Security, and the Administrator.</text></subparagraph></paragraph><paragraph id="id9381b424-3836-4c33-b49d-0bf980ee50d2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header display-inline="yes-display-inline">Highest-level owner</header><text display-inline="yes-display-inline">The term <term>highest-level owner</term> means an entity that owns or controls—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6f022645-7095-476b-8afb-cfcff46feacf" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">an immediate owner of the offeror of a lease for a high-security leased adjacent space; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id274d9012-bc68-42d1-bb9c-40647b2692ef" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">1 or more entities that control an immediate owner of the offeror of a lease described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="iddf0d8133-d06e-46f0-8d94-b7a0bada3cbd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header display-inline="yes-display-inline">Immediate owner</header><text display-inline="yes-display-inline">The term <term>immediate owner</term> means an entity, other than the offeror of a lease for a high-security leased adjacent space, that has direct control of that offeror, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id498c9b3f-6faf-4664-b668-9e244cae26a3" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">ownership or interlocking management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e555858-d7fc-422e-b021-2e7edf9bae22" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">identity of interests among family members;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37e06833-4d6a-425e-b856-1738b0a0a37c" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">shared facilities and equipment; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea3935ab-517c-4f58-9eac-ee8b60373f37" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">the common use of employees.</text></subparagraph></paragraph><paragraph id="ide37a4918-249f-404d-8dd1-e6a0555b8c41" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(15)</enum><header display-inline="yes-display-inline">Intelligence community</header><text display-inline="yes-display-inline">The term <term>intelligence community</term> has the meaning given the term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph><paragraph id="id8f947af6-50fd-4d4d-8d4d-c3ca248cc32c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(16)</enum><header display-inline="yes-display-inline">Substantial economic benefits</header><text display-inline="yes-display-inline">The term <term>substantial economic benefits</term>, with respect to a natural person described in paragraph (2)(A)(ii), means having an entitlement to the funds or assets of a covered entity that, as a practical matter, enables the person, directly or indirectly, to control, manage, or direct the covered entity.</text></paragraph><paragraph id="idf98ffb19-c90e-40d3-9c20-633c1d8700a1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(17)</enum><header display-inline="yes-display-inline">United states person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means an individual who—</text><subparagraph id="id1038e91a-e049-42be-b769-964401edf2f2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is a citizen of the United States; or</text></subparagraph><subparagraph id="idc9671cb8-bcda-4c05-bdaa-04d5cc54e1f9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is an alien lawfully admitted for permanent residence in the United States.</text></subparagraph></paragraph></section><section id="idb73f29b5-ff6d-4ee2-98a7-7a9ce182dc6d" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Government-wide study</header><subsection id="id33fac20a-fdf9-4f3c-b995-9e89e2918884" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Coordination study</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Director of the Federal Protective Service, the Secretary of Homeland Security, the Director of the Office of Management and Budget, and any other relevant entities, as determined by the Administrator, shall carry out a Government-wide study examining options to assist agencies (as defined in section 551 of title 5, United States Code) to produce a security assessment process for high-security leased adjacent space before entering into a lease or novation agreement with a covered entity for the purposes of accommodating a Federal tenant located in a high-security leased space.</text></subsection><subsection id="id27e69539-5ce2-4493-a484-1c585fcb0a6d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The study required under subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="id1f38b727-f2b1-448c-9c42-3e247745629e" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">shall evaluate how to produce a security assessment process that includes a process for assessing the threat level of each occupancy of a high-security leased adjacent space, including through—</text><subparagraph id="ideb613a3e-f6f3-4869-9000-902b2d1013d4" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">site-visits;</text></subparagraph><subparagraph id="id5f7af015-8662-4bbc-bdb9-8afc43980c15" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">interviews; and</text></subparagraph><subparagraph id="id30ea8ad5-4f80-4310-8544-1c8aa9b35ccc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">any other relevant activities determined necessary by the Director of the Federal Protective Service; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8be3feb7-e68c-48ce-889a-2c19935c8b6a" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">may include a process for collecting and using information on each immediate owner, highest-level owner, or beneficial owner of a covered entity that seeks to enter into a lease with a Federal lessee for a high-security leased adjacent space, including—</text><subparagraph id="ide901dde0-5097-4133-9a1d-97dc049fa289" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">name;</text></subparagraph><subparagraph id="id5f8334ba-0ed7-4b8c-ac0b-acbc9f3a8cb2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">current residential or business street address; and</text></subparagraph><subparagraph id="id737acdb1-0737-4975-8aaf-803831ac231f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">an identifying number or document that verifies identity as a United States person, a foreign person, or a foreign entity.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida23f1955-a715-40c3-b143-86b8fe4a0e3e" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Working group</header><paragraph commented="no" display-inline="no-display-inline" id="idd6ff08b5-8f1c-4516-bbba-7b6013ebb718" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator, in coordination with the Director of Federal Protective Service, the Secretary of Homeland Security, the Director of the Office of Management and Budget, and any other relevant entities, as determined by the Administrator, shall establish a working group to assist in the carrying out of the study required under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95c99cab-7d6b-435b-bea4-4dba8b754009" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">No compensation</header><text display-inline="yes-display-inline">A member of the working group established under paragraph (1) shall receive no compensation as a result of serving on the working group.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc983800b-4b76-425c-8b14-319b50182d2f" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The working group established under paragraph (1) shall terminate on the date on which the report required under subsection (f) is submitted.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddfd78a60-41b2-4dcd-b2be-82a8a4b595ad" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Protection of information</header><text display-inline="yes-display-inline">The Administrator shall ensure that any information collected pursuant to the study required under subsection (a) shall not be made available to the public.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6adfaf621d0641aea364c086d073baa3" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Nothing in this section requires an entity located in the United States to provide information requested pursuant to the study required under subsection (a).</text></subsection><subsection id="idc16a9c45-9ef3-4bcf-a0c4-8883ac1fd42e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator, in coordination with the Director of Federal Protective Service, the Secretary of Homeland Security, the Director of the Office of Management and Budget, and any other relevant entities, as determined by the Administrator, shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing—</text><paragraph commented="no" display-inline="no-display-inline" id="id54b193fe-1c0e-4edc-a3ce-55cb5d6eae99" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the results of the study required under subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id377ba140-ed09-46f9-9fe4-45578bf49d8f" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">how all applicable privacy laws and rights relating to the First and Fourth Amendments to the Constitution of the United States would be upheld and followed in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id35a2036d-7f9c-4c55-ac26-eee336a81eab" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the security assessment process described in paragraph (1) of subsection (b); and</text></subparagraph><subparagraph id="id69ec9d91-e4f6-4bb0-b6b6-4cbf9bb38775" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the information collection process described in paragraph (2) of that subsection.</text></subparagraph></paragraph></subsection><subsection id="id411c93bae577458a8e0ca3ee93a68977" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Nothing in this section authorizes a Federal entity to mandate information gathering unless specifically authorized by law.</text></subsection><subsection id="id7ecd36e4defb4725b0cab9d5eed1290f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">No information collected pursuant the security assessment process described in subsection (b)(1) may be used for law enforcement purposes. </text></subsection><subsection id="id2e73d495fd584d0a8833200a6331aef2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">No additional funding</header><text display-inline="yes-display-inline">No additional funds are authorized to be appropriated to carry out this section.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20241205" chamber="Senate">Passed the Senate December 5, 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
